Story and Photos by Pat Krause Fantasy Springs Resort Casino had another hit event on Sunday night, Sept 6th with the Red Rocker, Sammy Hagar, and The Circle band. The Casino was abuzz with a capacity filled center of Hagar’s fans. Hagar has been a top performer for over 40 years and is celebrating his 68th birthday. Hagar is a Rock and Roll Hall of Famer along with being an entrepreneur and author. This man
is so multi talented it’s no wonder that he has so many fans that wanted to see this rock and roll legend perform. His performance Included members of The Circle band, Michael Anthony, Vic Johnson and Jason Bingham. Sammy Hagar did not disappoint his fans as he came on stage, with “I’m. Back.” Fans rose up, even before he came on stage and continued standing throughout most of his
performance. Fans were waving their hands and raising their glasses to his songs. Thunderous applause was the norm after most of his songs. His flair for the stage has been little equal. He roams the stage tossing his red curly mane of hair easily. His music is loud like a typical rocker and his song, Why Can’t There Be Love, is one of my favorites. The former front man for Van Halen is also a CA native going to Fontana High School.

Story and Photos by Pat Krause One of the best hot spots for entertainment is the Purple Room in Palm Springs. JoAnn Worley from the famous TV show, Rowan and Martins, Laugh In, made a return visit to the Purple Room with more of the show’s humor and song. JoAnn performed on Friday, Saturday and Sunday during the Labor Day weekend to a filled restaurant of adoring fans. Dick Taylor introduced JoAnn as she stepped on stage with her signature large roses, long strands of pearls and feathered boa. Guests enjoyed a scrumptious dinner before her performance in this most intimate of venues. A new sound system and two large-screen TVs enhanced the performances. Diners in the back across the room could enjoy the show watching these TVs while sipping exotically named drinks. The Cleopatra, Bacall, Dean Martini, The Sammy, The Mommie Dearest and the Purple Orchid bring fun names to specially made drinks. Guests could order either small plates or large dinners from the menu. JoAnn showed videos of some of the TV shows in which she starred, which included some
of the funniest clips of Laugh In. She was part of the game show where a contestant won $10,000 because of her help. These videos brought back wonderful memories. In between videos, she sang songs from that era. She told stories about her career in show business that brought laughter from the crowd. She still has an amazing voice and probably would not even need a microphone as she hits the high notes. Every now and then, she would say BORING from the Laugh In show. She has been a star on Broadway, in movies and TV with her amazing talent. It was a busy night on Friday as The Martini Kings followed the JoAnn Worley show for those that wanted late-night entertainment. This group has been performing for many years and is well known having been on the Oscars and Emmys stages plus performing with other famous stars. There are a lot of upcoming shows with Susan Anton performing on Friday the 11th and Sat. the 12th with dinner at 5:30 and show at 7:45. She will perform at a Sunday Brunch at 11:30 and show at 1:00. Susan Anton was a hit as a star in the Palm Springs Follies and a show not to be missed.

It’s at this time they get the ‘aha’ moment of retirement not being all cracked up to what they thought it would be. A good beginning is to find a hobby. CCAL California is in the fourth year of drought, and even with predictions of an approaching heavy “El Nino” rain season, it may take years before state water resources return to normal. The Legislature last year passed several laws requiring that associations let landscaping die during a declared drought emergency (Civil Code 4735(c)), permit drought tolerant landscaping of common interest development yards (Civil Code 4735(a)(1)) and not require pressure washing (Civil Code 4736). On September 5th, 2015, Governor Brown signed into law Assembly Bill 349 as an urgency measure, meaning that it becomes law immediately.
After vetoes of artificial turf legislation in 2010 by thenGovernor Schwarzenegger and again in 2011 by Governor Brown, drought concerns apparently have now overridden other expressed environmental concerns regarding degradation of plastic turf products. AB 349 expanded Civil Code 4735, and now, in addition to not banning drought-resistant landscaping, associations may not prohibit or impose conditions which ”have the effect of prohibiting the use of artificial turf or any other synthetic surface that resembles grass.” (Civil Code 4735(a)(2)). Does this mean associations must allow any green surface, or allow purple artificial turf (yes, it is available)? Hopefully homeowners and boards will be reasonable and agree that purple turf does not “resemble grass” as to color, just as a green painted concrete front yard does not “resemble grass” as to texture. Clearly, the law allows an association to pass reasonable specifications of approved artificial grass installations, so long as the restrictions are not so strict that they make the use of artificial grass impossible. Associations would be well September 9, 2015
advised to begin the process of adopting rules which allow the reasonable installation of artificial grass and homeowners should apply for approval before installing, to avoid unnecessary conflict. Such rules should also require the owner to periodically sweep or otherwise clean the surface of dirt. If your association CC&Rs requires live grass yards, this law renders that provision unenforceable. Association rules are adopted by the board, following the rulemaking process prescribed by Civil Code Sections 4340-4370. Although some may argue that the emergency statute creates the need for an emergency rule, the situation is not an “emergency as defined by Civil Code 4360(d). Others may argue that the 30 day notice process is not required because this rule change is required by law, under Civil Code 4355(b)(4), but the safe bet is to give 30 day notice and adopt the new rules in open session. Homeowners desiring to install plastic grass should be patient and give their board a reasonable period of time to consult with the manager and develop reasonable standards, while at the same time hopefully
boards will diligently prepare for such applications by investigating the available products and prepare appropriate rules. Once the drought emergency is declared ended by the Governor, may the association require artificial grass to be removed? No, Section 4735 has a new subpart “d” which states that owners who install water saving landscape measures may not be required to remove them after the emergency ends. So, the plastic grass or xeriscape may remain even when the reservoirs are, some day hopefully soon, full again. Who’s Going To Make The Playoffs: An NFL Season Preview By Julie Buehler PALM DESERT, Ca. - Every year since 1990, at least 4 teams make the playoffs one year that missed the year before. 2015 is no different. We’ll see teams that missed out last year, in it this year. The AFC division winners will repeat, while the Wildcards are new to the party and the NFL’s longest playoff drought comes to an end. Both teams that were in the Super Bowl will be back in the hunt, but there’s a changing of the guard in the NFC South (no surprise) and the NFC North (big surprise). I’m buying the running game in Philly and selling it in the Big-D. And after perhaps the most tumultuous off-season in franchise history, the Niners will shock the NFL with a return to the playoffs behind Jim Tomsula, Carlos Hyde, and this guy named Navarro Bowman who is a LOCK for Comeback Player of The Year. Here are my season predictions...
franchise established one of the NFL’s most historic reputations built on “The Steel Curtain� and sending Dick LeBeau to the Hall of Fame thanks to brilliant defensive strategy, it seems totally ridiculous that they’re going in this direction. But they are. They’ll put up a lot of points and fantasy owners will LOVE them so much, even those ugly bumblebee uniforms will get a pass. But this new look Steelers will resemble the Peyton Manning led Colts and a healthy Matthew Stafford led Lions: Lots of stats, not a lot of Super Bowls. Meanwhile in Indy, the Colts have added veteran leadership on offense and get Robert Mathis back (eventually). The Colts will benefit from playing in a conference in which every team has glaring deficiencies and they have the fewest. The Broncos will benefit from the fact they have Peyton Manning. I’m not a fan of the way this team was built. Too many “me� guys, not enough “heartbeat� guys. But there’s a

presented AND the defense is healthy and back and even injured last year, they allowed the fewest rushing touchdowns in the NFL. I thought about the Chargers, but their lines, offensive and defensive, are still a concern and I’m looking forward to watching

This year, they’re making the playoffs because of Tom Brady, but their defense lost a lot of it’s grit. It feels like the Steelers are about to embark on a fun experiment called “What Wins Rings: Offense Or Defense.� Of course after a

California Third in Nation in Creating Clean Energy Jobs By Desert Star Staff SACRAMENTO - California is third in the nation in creating green jobs in the second quarter of 2015, behind Texas and Nevada. The ranking comes in a new clean energy jobs report from a national nonpartisan b u s i n e s s g ro u p c a l l e d Environmental Entrepreneurs, or E2. E2 Executive Director Bob Keefe says the Golden State has long been a leader in smart, clean energy and environmental policy. “And it’s paying off for the state,” says Keefe. “In the second quarter alone in California, we saw about 1,200 clean energy job announcements – a lot of solar of course but also we also saw manufacturing jobs,
at an electric-vehicle maker in Moreno Valley.” E2 tracks clean energy job announcements quarterly and the latest report shows the country added more than 10,000 green jobs from April to June, part of about 40 projects across 22 states. Applications are available through October 9, 2015 for the 2016 Coachella Valley Spotlight awards. All Coachella Valley-based nonprofit 501(c)3 organizations that have not previously received the Coachella Valley Spotlight are eligible to apply. Since the program began in 2008, $2
million in grants have been awarded to 80 local nonprofit organizations. The grantees will be selected by the CBS Local 2 Community Advisory Board, which includes representatives from the H.N. and Frances C. Berger Foundation and members of the community. Twelve recipients are selected, and then one is recognized each month during 2016 on CBS Local 2’s community program, Eye on the Desert, as well as in public service announcements

Babysitting device will have your dog taking selfies By Desert Star Staff Creators call it “the first smartphone for pets.” The intelligent robotic babysitter that’s now being funded on Indiegogo does a lot of things, from putting your worried mind at ease, to teaching your dog to take selfies! The PetBot gadget even has facial recognition that instantly knows when your pet has approached. The device, using “petificial intelligence”, allows you to record your voice to call your pets and have them run to the device, where an automated camera will take their selfie and the dispenser then release a treat. The gadget can be accessed from your Apple or Android phone, which
is programmed to allow you to control the amount of snacks released and to stream live video or take selfies – even when you’re not expecting any. There are also scheduled activities to help keep your pet on track and prevent them from wandering off doing something crazy to the house, or simply to give them a sense of regularity and certainty that a snack will jump out at this or that time; it can even play soothing music to calm them if need’s be. And if the little ball of fur – be they a dog or a cat – has a preference, just record their favorite sounds. The gadget promises also to notify the owner if the pet barks
too much or is feeling otherwise agitated, thanks to the bark recognition feature. The gizmo isn’t particularly expensive. A single unit with the iOS or Android app will set you back $149. The creators require some $80,000 to get production going. An early bird price will, however, cost you an extra $50. They want to ship it by next year. “Help us make pet care smarter!” goes the tag line. The creators first tried to get things going in 2013, but didn’t manage. But they didn’t have “petificial intelligence” then – the selfie function and some other features were missing.

By Desert Star Staff SACRAMENTO, Calif. - Salmon are safe for now because a federal judge ruled this week against two Central Valley Water Districts that wanted to stop reservoir water from being released into local rivers. The San Luis and DeltaMendota Water Authority and Westlands Water District have been suing the U.S. Bureau of Reclamation since 2013 - each year asking for a preliminary injunction to prevent the bureau from releasing water from Trinity Reservoir in Northern California. Jan Hasselman, an attorney from the environmental law firm Earthjustice, said the extra water is crucial to preventing a massive fish kill such as the one in 2002.
“In the last few years, that has meant releasing some additional water from Trinity Reservoir in late summer when the chinook are migrating to prevent the disease outbreaks that occur with low-flow high-temperature conditions,” Hasselman said. The water districts, which serve farming operations in the Central Valley, argue that the bureau decided to release the water from the reservoir without going through the proper channels or doing an Environmental Impact Statement. But the judge said they were not likely to win on the merits of those claims and denied the injunction. Glen Spain, northwest regional director of the Pacific Coast Federation of Fishermen’s
Associations, said the drought is forcing the bureau to make hard choices on where to send the water. “The balance of interests, the judge said, really is in favor of protecting the fisheries,” Spain said. “The Westlands Water District is a junior water rights holder - they’re last in line. What they’re really trying to do is grab water from people who are first in line.” T h e b u re a u s t a r t e d releasing the water last week and will continue through midSeptember. Gray Wolf Returns to California
By Desert Star Staff MOUNT SHASTA, Calif. The wolf pack is back - literally! A pack of gray wolves has been discovered in California for the first time since they were hunted almost to extinction about 90 years ago. Trail cameras recently caught sight of what’s known as the Shasta pack in Siskiyou County near Mount Shasta. Pamela Flick with the nonprofit Defenders of Wildlife says the gray wolf has been under federal protection since 1973 but was just listed as endangered in California last year, making it illegal to hunt or harass the animals. “The Shasta pack is known to have at least five pups and the alpha male and female,” says Flick. “The presence of a whole pack affirms that wolves know that there is suitable habitat in our state and are already using it. Grey wolves are back for good.” The wolves are believed to have spread from existing packs in Oregon. The California Department of Fish and Wildlife has been working with

Rabid Bat Encounters in Riverside County
By Carlos Herrera RIVERSIDE COUNTY Human contacts with rabid bats are becoming a concern in Riverside County. According to the Riverside County Department of Public Health and Riverside County Animal Services, there were three rabid bat incidents in the county in the month of August. Two of those incidents happened last week. One of the more bizarre incidents happened in the
Coachella Valley. A woman suffered a bat bite to one of her fingers, while she was visiting the valley. A bat flew into her truck’s open window and bit her finger. Another incident occurred in Lake Elsinore. Public health officials say up to eight people were exposed to a rabid bat. The incident is still under investigation by county health officials who are trying to determine exactly how many people were exposed. In Moreno Valley, a woman
came in contact with a bat when it flew into her garage and then into her hair. Health experts say being exposed to bats can be very dangerous. “Rabies is a serious illness that can result in a death in humans, therefore, the need is to ensure they seek medical care and get evaluated for post exposure rabies treatment,”County of Riverside Director of Disease Control Barbara Cole said. The emphasis is on people being
aware that contact with bats could potentially present a health issue, she added Rabies in humans is rare, but the most common cases are a result of people coming in contact with a rabid bat. Health experts recommend if you see a bat or any animal that appears sick, do not touch the animal. If you do have contact, they recommend to see a doctor immediately. Source KMIR
West Nile virus detected in Bermuda Dunes Virus activity continues in the Valley - Residents urged to take precautions against mosquito bites By Desert Star Staff INDIO, Ca, Four samples of mosquitoes collected this week have tested positive for West Nile virus (WNV). One sample came from a trap in Bermuda Dunes near the corner of Lima Hall Road and Starlight Lane. This is the first time this year that WNV has been detected in Bermuda Dunes. The other samples, which tested positive for the virus, were collected from Highway 111 and El Dorado Drive in Indian Wells, and the west shore of the Salton Sea off of Buchanan Street. This brings the total number of WNV-positive mosquito samples this year in the Coachella Valley to 91, making it the second highest number of positive samples detected in the Valley in the last decade. Staff will also set additional traps, increase larval surveillance to identify sources, and carry out larval and adult control as necessary in an effort to reduce
the number of mosquitoes and interrupt further transmission of disease. Residents are encouraged to be careful not to create standing water sources in their yards or irrigation runoff into street drains, and to be on the lookout for standing water sources and report them to the District. Residents are also encouraged to avoid mosquito bites by following simple personal protection measures. Protect yourself from mosquito bites: Apply Insect Repellent. Use a repellent with DEET (N, N-diethyl-m-toluamide), picaridin (KBR 3023), oil of lemon eucalyptus [p-methane 3, 8-diol (PMD)] or IR3535 according to the instructions on the product label. The paintings were loaded on Wednesday and locked in the new black trailer behind Elena Bulatova Studio in Backstreet Art District in Palm Springs. The trailer was prepared to be going on a regular weekly trip to San Diego frame shop to frame all art and trailer itself would be wrapped with colorful significant logo of the gallery. A

Elena Bulatova and Efi Mashiah, founders and owners of Elena Bulatova Fine Art, which opened in 2013, said they’ve never had something like this happen before and that the team is devastated by the “unprecedented event.” “We are very upset about
art works that disappeared,” the artists told. “Efi worked for about six months on these paintings, and the whole thing lasted for less than 24 hours. We don’t know who would want to steal large weighty paintings with 8000-15000 screws in them that are so massive that require 2-3 people to lift them. Paintings stolen include new abstracts of Elena Bulatova created this summer and screw art of Efi Mashiah. Over 2,500 winegrowers, distillers and other partners from the Cognac region received their invitations from Martell employees, who delivered them personally to mark their special relationship. For a month ahead of the event, they criss-crossed the Charente countryside in Martell branded trucks to handdeliver the invitations to partners. “This is a very special year for Martell, which is celebrating three centuries of cognacmaking and close bonds with the people of Cognac. We wanted to invite all the local partners with whom we have nurtured a truly remarkable partnership for nearly ten generations, and

Spectacular staging for an experience rich in sense & history Guests were treated to a spectacular surprise at the start of the evening when two fighter jets roared across the Cognac sky, followed by three planes from the “Cartouche Doré”, a squadron of seasoned flight instructors from the French air force flight academy in Cognac. The squadron is considered the “little brother” of the famed Patrouille de France aerobatics team, which put on a demonstration for guests during the 20 May event in Versailles. Two Cap Ten aerobatic planes then wrote out the number “300” in white smoke before dropping three parachutists – carrying some flags marked with Martell colours – who joined the guests and presented César Giron &
Alexandre Ricard with bottles of the limited edition cognac given to guests as a gift. This exceptional 40-minute airshow –a tribute to a shared history anchored in savoir-faire, excellence and passion – was crowned by a stunning fireworks display to set the stage for a grandiose evening in an amazing setting. In an enchanting decor reminding of Versailles, guests had the chance to enjoy cocktails created especially for Martell’s 300th anniversary by Thierry Hernandez (head barman at the famous Plaza Athenée). The concert was punctuated by the unexpected arrival of French singer-songwriter Louis Bertignac (a founding member of the group Telephone), a friend of the House who couldn’t resist a chance to play several of his hits.

‘Saint Laurent’ What do you think Walt Disney, Vincent Van Gogh and fashion designer Yves Saint Laurent had in common? One answer is, they were all innovators with artistic vision and talent. be a part of the glamour and decadence of the European Fashion world at that time. St. Laurent was born in Algeria in 1936 and died 72 years later of brain cancer in Paris. But in between that time line he led an amazing, often times decadent life as one of the world’s greatest designers. His world was filled with success, defeat, glamour, drugs, booze and art. His desire to design began in his youth when he created paper figures and dressed them in lovely gowns of his own deign. For his youthful inspirations, he devoured his mother’s fashion magazines. He was shy and often bullied, but eventually he, like the proverbial butterfly, emerged from his cocoon to create haute couture fashion designs that dazzled the world. They were innovative, classy and classic. Throughout his life, he gazed upon the world through signature dark-rimmed glasses and by age 21, he took over the fashion house of Dior. When he was called up for military duty, he was replaced at Dior. As a result, he fell apart and wound up in a mental hospital. In 1958, he met Pierre Berge (Jeremie Renier) who became not only a lover, but his trusted business partner, friend and guardian of the Yves Saint Laurent brand and worldwide reputation. While Laurent’s life seemed like a fashion fairy tale, filled with color and glamour, it was also a life tinged by substance abuse and self-doubt. Now, due to this film and a documentary filmed by David Teboul, the truth of his often tortured life comes to the big screen. Gasbard Ulliel, who plays Saint Laurent in the Sony Classics film, “Saint Laurent,” describes the man as “an artist, not just a designer.” Actor Jeremie Renier (Pierre) sees the icon as “A September 9, 2015

Martin Milner, “Route 66” and “Adam-12” star, dies By Lindsey Bahr LOS ANGELES (AP) - Martin Milner, whose wholesome good looks helped make him the star of two hugely popular 1960s TV series, “Route 66” and “Adam12,” has died. He was 83. “Adam-12” costar Kent McCord, who spoke to Milner’s children, said Milner died Sunday near the La Costa neighborhood of Carlsbad, Calif. He said the family is doing well, but gave no other details. Milner, who began his career as a teen actor, shot to fame in 1960 with co-star George Maharis in the iconic TV drama “Route 66,” which found two restless young men roaming the highway author John Steinbeck had dubbed “The Mother Road” in a red Corvette convertible. Milner was Tod Stiles, a young man born to wealth but suddenly broke when his father died and left him nothing but the new Corvette. Maharis was Buz Murdock, a hardened survivor of New York City’s Hell’s Kitchen. Together they toured the country in Tod’s new Corvette,

meeting all kinds of people and becoming involved with their lives. The series was said to have been inspired by Jack Kerouac’s novel “On the Road” and it featured such weekly guest stars as Robert Redford, Alan Alda and Gene Hackman in some of their earliest roles. As much the show’s star as Milner and Maharis was Route 66 itself. Since bypassed in favor of bigger, faster interstates, the iconic highway stretched unbroken from Chicago to the Pacific Ocean during the show’s heyday and was venerated as a driving force behind the country’s 20th century westward migration. “Route 66” was the only TV show filmed entirely on location in the early 1960s, moving to new towns and cities for each new episode. But ironically, the action often took place off the highway. “The problem was that once you get into Oklahoma and Texas on the route, the scenery is flat and boring,” Milner recounted in a 1997 interview. “Pictorially it just wasn’t very interesting.” Maharis, who became ill with
hepatitis and missed part of the third season, left “Route 66” at the end of that year amid rumors of a contract dispute. He was replaced by Glenn Corbett, who played a war hero trying to cope with civilian life. The magic was gone, however, and the show lasted just one more season. In 1968 Milner signed on to another buddy series, “Adam12.” This time he was Officer Pete Malloy, a veteran of the Los Angeles Police Department assisted by rookie cop Jim Reed, who was played by Kent McCord. “I had a long, long friendship with Marty and we remained friends up till the end,” said McCord on Monday. “He was one of the really true great people of our industry with a long, distinguished career...Wonderful films, wonderful television shows, pioneering shows like ‘Route 66.’ He was one of the great guys. I was lucky to have him in my life.” Los Angeles Police Department Chief Charlie Beck said Monday that Milner’s “depiction of a professional and tough yet compassionate cop” led September 9, 2015
to his own decision to apply to the department. The series was produced by Jack Webb, who applied the same realistic treatment of police doings that had made his “Dragnet” TV show, in which he was Sgt. Joe Friday, a huge hit. During the seven-year life of “Adam-12,” both Reed and Malloy won promotions. Milner had met Webb years before “Route 66” when both were appearing in the feature film “Halls of Montezuma,” and Webb had hired him for an early radio version of “Dragnet.” Later, he appeared in several episodes of the 1950s TV version. When Milner was in the Army at Northern California’s Fort Ord, he would sometimes visit Los Angeles and look Webb up. “Even though there wasn’t a part for me in ‘Dragnet’ that week,” he recalled in 1989, “Jack would write one in so I could collect $125.” Before and after “Route 66” and “Adam 12” Milner appeared in numerous TV guest roles and in films. Early film roles included “The Sands of Iwo Jima,” ‘’Marjorie
Morningstar” and (as Marty Milner) “Sweet Smell of Success.” Others films were “Louisa,” ‘’Our Very Own,” ‘’Operation Pacific,” ‘’Battle Zones,” ‘’My Wife’s Best Friend,” ‘’Springfield Rifle,” ‘’The Long Gray Line,” ‘’Mister Roberts,” ‘’Gunfight at the O.K. Corral.” ‘’Valley of the Dolls” and “Three Guns for Texas.” Martin Sam Milner was born in Detroit and grew up in Seattle, where he worked as a child actor in local plays. When the family moved to Los Angeles, he found jobs in movies, notably in his film debut as the second son in 1947’s “Life with Father” which starred William Powell and Irene Dunne. After finishing the film he was stricken with polio and spent a year in bed. He recovered and enrolled in theater arts at the University of Southern California but dropped out after a year to devote himself to his acting career. ‘War Room,’ Spanish language cartoon stand out at box office
By Lindsey Bahr LOS ANGELES (AP) Summer blockbusters gave way to the small and highly targeted over a sleepy Labor Day weekend at the box office, with notable performances from the faith-based “War Room” and the Spanish language cartoon “Un Gallo con Muchos Huevos.” Sony’s “War Room” fought its way to first place in its second weekend in release, earning $12.6 million across the four-day holiday weekend, according to Rentrak estimates on Monday. The microbudget family drama, which cost only $3.5 million to produce, has grossed $27.9 million to date. Financial success for faithbased films is not exactly a surprise at this point, but “War Room’s” impressive hold from its opening weekend is significant. Paul Dergarabedian, Rentrak’s senior media analyst, attributes “War Room’s” second
weekend success to heightened awareness after it nearly usurped “Straight Outta Compton” last weekend. Also, word of mouth is strong for “War Room.” Dergarabedian said according to exit polling, 75 percent of the audience said they would definitely recommend the movie - a substantial and interesting contrast to the dismal critical reception for the film. “It’s just a great story of a film that really filled a void in the marketplace, with a message that the audience could really get behind,” he said. New release “A Walk in the Woods,” debuted in third place, behind previous champ “Straight Outta Compton,” with $10.5 million from 1,960 screens. The buddy dramedy based on Bill Bryson’s memoir starring Robert Redford and Nick Nolte cost a reported $8 million to make and has taken in $12.2 million since its
Wednesday opening. The action pic “The Transporter Refueled,” meanwhile, opened in fifth with a lackluster $9 million from over 3,400 screens. Costing only $21 million to produce, this franchise outing subbed in a relatively unknown actor, Ed Skrein, for star Jason Statham, who had helped the previous three films succeed. Dergarabedian said while both films will likely perform decently in theaters, their VOD earning potential is great. “Both of those movies will end up being profitable on the small screen down the road,” he said. But, it was Pantelion’s Spanish-language animated film “Un Gallo con Muchos Huevos,” that truly stood out among the pack, taking in $4.4 million from just 395 locations over the fourday weekend. Although it doesn’t come close to the sensational $10.4 million Labor Day weekend
debut of Pantelion’s 2013 film “Instructions Not Included,” it does still illustrate the significant power of an underserved audience. “Latinos represent 17 percent of the population and buy 24 percent of movie tickets. They go to the movies all the time and they go to movies as families. If we can create a film that resonates with families over a holiday weekend, it tends to do well,” said Paul Presburger, CEO of Pantelion. “Where Hollywood releases big movies that appeal to everyone, we release movies that specifically and culturally appeal to the Latino audience,” he added. They relied on grassroots marketing to get the word out about the film and plan to expand to over 580 locations next weekend. “It’s the highest per-theater average of any film in national release, that film, like ‘War Room,’ filled a void in the marketplace,”
said Dergarabedian. “Hollywood is creating a lot of diverse product. It’s all about people relating to what’s going on on-screen.” Estimated ticket sales for Friday through Monday at U.S. and Canadian theaters, according to Rentrak. Warrant now required for federal ‘Stingray’ surveillance use By Desert Star Staff US Department of Justice agents now have to acquire a search warrant before utilizing a cell-site simulator, the department said, though the new policy allows for exceptions. The devices, known as ‘Stingrays,’ trick phones into connecting to them. The Department of Justice (DOJ) announced on Thursday that while the department’s agents have followed “appropriate legal authorizations” for cell-site simulators in the past, effective immediately, federal agencies must now get a search warrant supported by probable cause before using a cell-site simulator. The Harris Corporation’s ‘Stingray’ is the most well-known brand of the controversial spying technology, used by the FBI, the Secret Service, the Drug Enforcement Agency, and many state and local police agencies. By impersonating cell towers, the suitcase-sized devices force phones in the area to broadcast information that can be used to identify and locate users. The devices are able to indiscriminately collect and intercept data from hundreds of phones at once. The new policy does allow federal agencies to skirt those rules in the case of “dire circumstances,” such as when agents are attempting to avoid a death or injury, to keep a cellphone or other device they are tracking from being destroyed, or when a pursued criminal is in danger of escaping. Agents will be required to note how many
times those exceptions are used so that they can be part of an audit at a later date. The policy says federal agents cannot collect content from phones, including email, text messages, or GPS data, but they can monitor the general location of a tracked device. All data gathered and used to locate a device must be deleted as soon as it’s located, or no less than once per day. “Cell-site simulator technology has been instrumental in aiding law enforcement in a broad array of investigations, including kidnappings, fugitive investigations and complicated narcotics cases,” said Deputy Attorney General Sally Quillian Yates in announcing the new guidance. “This new policy ensures our protocols for this technology are consistent, well-managed and respectful of individuals’ privacy and civil liberties.” The guidance only applies to federal law enforcement, not state or local policing agencies, which have increasingly turned to Stingrays, not just for highprofile terror plots or other major criminal cases, but for routine police investigations. The Federal Bureau of Investigation has long advocated secrecy surrounding Stingrays. But in May, the FBI said that its non-disclosure agreement (NDA) with local law enforcement agencies regarding Stingrays is actually not intended to shield the technology’s use. Dozens of law enforcement departments nationwide have long attempted to hide Stingray use, going so
far as to drop cases rather than disclose that the technology was used, according to documents obtained through Freedom of Information Act requests. For example, it was revealed last month that the Baltimore Police Department has used Stingrays to pursue petty crimes while concealing that usage from suspects, their attorneys, and judges. “The FBI’s concern is with protecting the law enforcement sensitive details regarding the tradecraft and capabilities of the device,” FBI spokesman Christopher Allen said in May. The FBI has previously justified the secretive aura around Stingrays based on the possible ability of criminals to thwart FBI tactics. The public cannot know about Stingrays because criminals are part of the public, the FBI has suggested. “The FBI routinely asserts the law enforcement sensitive privilege over cell site simulator equipment because discussion of the capabilities and use of the equipment in court would allow criminal defendants, criminal enterprises or foreign powers, should they gain access to the items, to determine the FBI’s techniques, procedures, limitations and capabilities in this area,” Bradley Morrison, chief of the tracking technology unit at the FBI, wrote in an affidavit last year. “This knowledge could easily lead to the development and employment of countermeasures to FBI tools and investigative techniques by subjects of investigations and completely
The American Civil Liberties Union said that “after decades of secrecy” surrounding Stingray surveillance, it was cautiously optimistic about the DOJ’s new policy. However, it was also concerned about the myriad loopholes attached to rules guiding police tracking capabilities. “[T]his policy does not a d e q u a t e l y a d d re s s a l l concerns,” the ACLU wrote. “Disturbingly, the policy does not apply to other federal agencies or the many state and local police departments that have received federal funds to purchase these devices. In addition, the guidance leaves the door open to warrantless use of Stingrays in undefined ‘exceptional circumstances,’ while permitting retention of innocent bystander data for up to 30 days in certain cases.” The ACLU has identified more than 50 state and local policing agencies in 21 states, plus the District of Columbia, and at least a half dozen federal law enforcement agencies, as owning Stingray surveillance devices. Civil liberties groups that have been making public records requests in order to learn more about the technology have discovered that non-disclosure agreements exist between governments and companies like Harris. The ACLU has also uncovered the ability of a
By Desert Star Staff An Iraqi woman has taken revenge on the Islamic State commander who forced her into sex slavery, killing him near the city of Mosul. The woman killed a senior commander known as “Abu Anas” three months after he forced her to marry several men under his command, Kurdistan Democratic Party spokesman Saeed Mamouzini told al-Sumaria TV. The commander was killed on Saturday in the Tal Roman district, west of militant-held Mosul, according to Mamouzini. There is no information on how the militant was killed or what has become of the woman, who some reports say is a member of the Yazidi-Kurdish minority. According to the ABNA news agency, the report emerged just days after an unspecified number of “non-Iraqi” women were transported into Mosul for use as sex slaves, under a direct
order from the Islamic State (IS, formerly ISIS/ISIL) leader Abu Bakr al-Baghdadi. This is not the first incident of women fighting back against Islamic State. In August, IS militants reportedly executed 15 women at Ghazlani military base near Mosul, after the victims refused to marry the terrorists. Another 19 women in Mosul were executed for the same reason in July. Mosul, the second largest city in Iraq, has been under IS control since June 2014. The militant group has established several sex slave markets, where captured Yazidi, Christian, and Shia women are sold. Women are often stripped naked before being sold to the highest bidders. In one incident, revealed by United Nations official special envoy Zainab Bangur, IS militants forced a Yazidi woman to ‘repair’ her hymen 20 times in order to restore her virginity before she was married off to fighters.
Last month, the UN confirmed an Islamic State sex price list, which is offered to fighters and other men trying to purchase sex slaves – some as young as one. Children aged one to nine can be purchased for about US$165, while adolescent girls cost $124. A woman over 20 is even less, and someone over the age of 40 can be sold for as little as $41. In June, IS held a Koran memorizing contest with a grand prize of sex slaves. According to a pamphlet released by Islamic State at the end of last year, militants are allowed to have sex with Yazidi women, especially if those captured are virgins. If the woman is not a virgin, the manual says, “her uterus must be purified” before intercourse. Frustrated that governments aren’t doing enough to help women and girls forced into sex slavery, one Canadian man has launched an organization aimed at returning victims to their loved ones.
By Desert Star Staff SACRAMENTO, Calif. – Workers and labor advocates are rallying in Sacramento today in support of a bill to combat wage theft by companies that fail to pay workers overtime or give legally-required breaks during work shifts. Senate Bill 588, known as the “Fair Day’s Pay Act,” would close loopholes that have allowed some unscrupulous employers to avoid paying judgments when they’re found guilty of wage theft. Alexandra Suh, executive director with the Koreatown Immigrant Workers Alliance in Los Angeles, says only about 15 percent of employees who win judgments are ever paid. “Workers across California are facing a crisis of wage theft,” she says. “Even when they go to the Labor Commission, they win judgments but they cannot collect. SB 588 provides tools to help those workers collect.” The bill has already passed

Stingray to negate cell phone calls by either downgrading mobile devices from 3G or 4G connectivity to 2G – enabling them to access identification and location information – or by using the devices’ “catch-and-release” functions. Last week, a US federal appeals court validated the National Security Agency’s bulk collection surveillance program under Section 215 of the USA Patriot Act. The three-judge appeals court threw out a 2013 verdict against the NSA that deemed unconstitutional the agency’s bulk collection of telephony metadata. Plaintiffs argued that the NSA refused to provide evidence showing they had been spied on, though the judges said that secrecy is basically how the law was intended to work. “Plaintiffs complain that the government should not be allowed to avoid liability simply by keeping the material classified. But the government’s silence regarding the scope of bulk collection is a feature of the program, not a bug,” Judge Stephen F. Williams wrote in the decision. The controversial section of the Patriot Act expired at the end of May, after a bipartisan group of lawmakers filibustered to prevent its extension. Under the subsequently passed USA Freedom Act, the collection of metadata will be entrusted to telecom companies, and the NSA will be able to obtain the records through seeking a warrant from the secretive Foreign Intelligence Surveillance Act (FISA) court.

According to a UCLA labor study, workers in Los Angeles lose $1.4 billion a year to wage theft. Suh says employers often change the name of their business to avoid paying judgments – placing an additional burden on employees. “ Wo r k e r s w o r k s i x , sometimes seven days a week, but many of them aren’t even getting the minimum wage, overtime, meal breaks and rest breaks,” she says. “The levels of wage theft are staggering, and people are trying to support their families.” Suh notes the California Chamber of Commerce objected at first to the bill, worrying it would lead to frivolous lawsuits. The bill’s authors made adjustments and the chamber dropped its opposition.

Motorcyclist Survives Plunge off Highway 74 By Kitty Alvarado PALM DESERT -- A motorcyclist went over the side of Highway 74 on Sunday, bringing traffic to a halt in both directions Firefighters say they’re used to seeing accidents on Highway 74, fortunately this time it was not deadly. The motorcyclist is lucky to be alive after plunging 70 feet over the side of Highway 74. “(We) arrived at scene and and found the victim over the side and began to start rescue operations to get the victim up to the roadway,” said Steven Fralia with Calfire.
The accident happened near Vista Point at around 10:30 in the morning. California Highway Patrol shut down the highway in both directions until the victim was taken by helicopter off the windy highway. According to Calfire, the victim suffered moderate injuries. Calfire says Highway 74 is treacherous. They warn motorists to be careful on this stretch of road. “Highway 74 is busy during the weekend, it’s very curvy and dangerous. We do come up here very often for incidents like this
and we just caution everybody to drive slow,” said Fralia. Stephen Gutierrez was riding his own motorcycle down the highway when he got caught up in the traffic. The accident brought back memories of his own friend who was taken much too soon on this same highway. I’ve even had a friend die up here so it’s always doesn’t feel good seeing another rider go down,” said Gutierrez. Two Car Shooting in Desert Hot Springs By Carlos Herrera DESERT HOT SPRINGS, Ca. - A 15-year-old girl remains in critical condition at Desert Regional Medical Center, following a shooting at a gas station in Desert Hot Springs. Palm Drive and Dillon Road remained closed for several hours after Desert Hot Springs police investigated a shooting, which happened at 11:21 a.m. at the Valero gas station in that busy intersection. According to police, two vehicles were involved in the
shooting. The car was heading north on Palm Drive, near the Dillon Road intersection, “when another person fired several shot into it,” Desert Hot Springs Chief of Police Dale Mondary said. One of the cars was shot multiple times. The 15-year-old girl, who’s name has not been released, was a passenger in that car. She was transported and underwent surgery to some bullet wounds. Police detained the male driver of the victim’s car for
questioning. According to Mondary, authorities are still trying to identify the other car involved. The cause of the shooting is still under investigation. The name of the victim have not been released. All lanes of Palm Drive were closed at Dillon Road until about 5 p.m. This intersection is not known for shootings or any violent crime, Monday added. The retail state average for a gallon of regular is $3.39. That’s 9.2 cents less than last week. The average price of self serve regular gasoline in Riverside County is $3.42, that is 12.6 cents lower than last week and 54 cents less than last month. The price has dropped for 23 consecutive days. Low gas prices helped labor day weekend travelers to save
big this year. “It saves 50 cents a gallon so that’s good news. A little extra money to spend on other things,” Labor Day weekend traveler Tom Pugel said. According to AAA, about 2 million California residents drove to their destinations. Dropping gas prices gave travelers more flexibility in their getaway budgets, experts said. Nationally, according to AAA, The average gas price is still one dollar or more lower than in most areas of Southern California, but local prices are dropping faster here than in most other states.

Largest Yakuza syndicate’s 1st split in 30 years confirmed
By Desert Star Staff The offshoot has confirmed a split within the largest Yakuza syndicate in Japan. Thousands of excommunicated members of the Yamaguchi-gumi formed a new crime syndicate over the weekend. Police expect a wave of violence. T h e Ya m a g u c h i - g u m i reigns supreme over all other conglomerates, with about half Japan’s gangsters directly or indirectly employed by it. The Yakuza grouping has had a tumultuous history, and splits in its ranks have always deserved the attention of authorities, owing to the wave of bloody retributive violence that inevitably follows such events. The last such rift occurred in the mid-80s, leading to 293 violent clashes and a series of killings. Now, the newly-formed group which according to Kyodo News
would call itself Kobe Yamaguchigumi has officially declared its split, issuing a document, according to investigative sources speaking to Japanese media. The document contains quite brazen descriptions of Shinobu Tsukasa (aka Kenichi Shinoda), the sixth-generation leader of the syndicate. Many in his ranks accused Tsukasa of extreme egotism, sources said Monday as cited by the Japan Times. Reportedly, another reason is his desire to expand the gang’s turf from its native Kobe into Tokyo and other areas. The secession document was signed by Kunio Inoue, the leader of the Yamakengumi – a Yakuza clan within the Yamaguchi-gumi, also based in Kobe, and consisting of 2,000 members. Inoue and others who
California Death Penalty on Trial
By Desert Star Staff PASADENA, Calif. – The death penalty itself is on trial today in the U.S. Ninth Circuit Court in Pasadena. C a l i f o r n i a ’s a t t o r n e y general is appealing last year’s ruling that declared the state’s system of capital punishment unconstitutional. The federal judge in that case said the extensive delays mean the system itself constitutes cruel and unusual punishment, and does not deter crime or exact retribution. Matt Cherry, executive director of the anti-capital punishment group Death Penalty Focus,says this is the first time that type of argument has been made. He notes the average time between conviction and execution in California is 25 years. “When those delays extend into decades and decades so that most of the people who are sentenced to death will never be actually executed, then I think the whole system collapses under the www.desertstarweekly.com
weight of its own contradictions,” he states. The state argues that delays in the system are inevitable because all appeals must be exhausted to make sure no innocent person is executed. If the prior ruling is upheld, the case could be appealed to a panel of circuit court judges, and then to the U.S. Supreme Court. California re-instituted the death penalty in the late 1970s, and since then more than 900 people have been sentenced to death with just 13 executed. Cherry says a death sentence in California really amounts to life in prison with a small chance of execution. “Those delays are so unreasonable and so arbitrary that the death penalty really does not function anymore in California,” he maintains. The current case originated with the 1995 death sentence of Ernest Jones, who was convicted of raping and fatally stabbing his roommate’s mother.

Suspicions within the Yamaguchi-gumi began to emerge over the summer, leading to the excommunication of the 13 Yakuza leaders of clans thought to be the most dangerous to the syndicate’s unity. The Yamaguchi-gumi was born in 1915, founded by a western-Japanese fisherman.

Its wealth measures $80 billion, Fortune magazine said last year, making it by far the richest syndicate in the world – a wealth acquired from drug trafficking, prostitution and white collar crime; although, in a bid to expand, the Yakuza have been branching out into new crime sectors, which is a departure from the golden age of Japanese Yakuza – the 1980s.
