College Savings Plan for Your Children

From the earliest times, Hindu scriptures have clearly denounced and condemned the practice of abortion unless the life of the mother was in danger due to a complication in pregancy. The college savings plan known as a “529” is often touted as a smart way to save for a child’s college education. But these plans involve more than just putting away money for college.

Edito r’s View Dear Readers, Let me take this opportunity to wish a Happy August 15th Independence Day to all of our Indian readers and Happy August 14th Independence Day to all of our readers from Pakistan. Both of the countries are completing 75 years of independence from the evil British Empire. In this issue, we have an article titled “India @75: Achievements and Aspirations for the Indian Centenary” which details India’s situation India when the evil British Empire left in 1947, its situation today in 2022, and where India could be in the next 25 years when we are celebrating 100 years of independence. Britishers came to India on a pretense of doing business with India. Unfortunately, when they saw the rich heritage and natural resources available in India as well as the kind-hearted Indians, they decided to stay longer — much longer. They also decided to take over India the same way they took over several other countries, including the US. That’s where the similarities ended. Unlike other countries, Britishers looted India, not only taking gold, silver, and diamond, including Kohinoor diamond, but also spices, tea, and many more items. When they left India in 1947, what did they leave? A shattered economy, a major drift between India and Pakistan, close to 95% illiteracy, no roads to connect from one city to another city, electricity in fewer than 3,000 villages out of 600,000 and less than 5% of a total share of the world’s economy. Now, you know why I always use the word “evil” every time I talk about the British Empire. Fortunately, they could not break India’s spirit, our affinity to 10,000+ years of heritage and energy within us. We are known for our hard work, dedication, and resilience in facing any obstacle that comes our way. The article “India @75: Achievements and Aspirations for the Indian Centenary” clearly shows that we have excelled in almost all fields post-independence. Whether it is in economy, science, information technology, sports, or even in the army, Indian men and women have showcased their true worth. The article also talks about India becoming a $5 trillion economy and the third largest economy in the world. Now, let me come to another serious issue, abortion — the killing of an unborn child. Dr Mohini Shinde, in her article on abortion, talks very passionately about the Hindu views of this practice. As stated in the article, thousands of years back, Hindu scripture clearly documented that abortion is killing an unborn child unless the mother’s life is in danger. In 1971, the Supreme Court of India ruled exactly that. Recently, here in the US, the Supreme Court reversed Row vs. Wade, making abortion illlegal again and giving each state the final decision on whether they wish to allow it or not. In this column, I am not going to discuss my views on this subject, because I agree with Dr. Mohini Shinde word for word. I do, however, want to talk about how the democratic party reacted when this verdict was reversed. They are talking about removing the filibuster in the Senate, and they are talking about packing the Supreme Court. That is wrong! It seems they have not learned the lesson as when the Senate Majority Leader Harry Reid removed the nuclear option. It seems that we are discussing several serious issues in this month’s Desh-Videsh. The next article we have covered is titled “Everyone Must have a will or Trust.” On the surface, the issue does not seem very serious, but in the last three years in South Florida alone, I have run across six Indian families where husbands died without a will and their loved ones went through serious problems — not only emotional problems, but financial problems. That is why I urge every one of our readers to take this issue very seriously and do what is necessary as soon as possible. As the article states very clearly, you do not have to be rich to have a will, and some lawyers charge as little as $75 to create a simple will. Finally, let me turn to a happy topic — our My Shadi Bridal Expo in Orlando on August 28 at Hilton-Orlando. As you know, we have not hosted any shows in the last three years because of Covid-19. Unfortunately, for that same reason, a lot of brides and grooms have had to postpone their weddings. It is my pleasure to report to you that a record number of brides/grooms are registering for this show. If you or your loved one is planning a wedding, engagement, anniversary, or birthday party in the upcoming year, please register on our website so that you do not have to stand in long lines. Until then… Be safe and Be happy! See you in Orlando on August 28! Raj Shah Managing Editor

nce the largest economy in the world, India emerged from the rule of the “Evil Empire” in 1947 as one of the poorest countries. India, the land of the Vedas, the land of diverse cultural heritage uplifting the principle of “unity in diversities,” and the largest democratic country in the world, is celebrating 75 years of freedom this year. This freedom from colonial British rule was achieved through two centuries of struggle and resistance, sacrifices and pledges of millions of common Indians. Finally, on August 15, 1947, India became an independent nation and was declared a “Sovereign, Socialist, Secular, Democratic Republic” by the Constitution of India. In the context of celebrating India’s 75th year of Independence during 2021–22, it is a watershed moment to examine the achievements of the past and aspirations for the Indian Centenary that will be celebrated in 2047. The International Monetary Fund (IMF) is predicting that India will be a global leader by 2047 in economic terms as well as in terms of prosperity. More importantly, it will be more inclusive, more sustainable, and more resilient. This global leadership will lead India to celebrate the Centenary with a greater sense of national pride, achievement, and fulfillment. The world will look to India as a role model for the developing world! August 15, 1947, was a new beginning for the newly independent country. Despite her physical and natural resources, the country was ravaged by the long colonial rule that was manifested through poverty, mismanagement, and other vices. The leaders and the administration had the Herculean task of reviving them and rebuilding the country to bring back the old prosperous days of this rich country.

From Alexander onwards, the Greeks, the Turks, the Moguls, the Portuguese, the British, the French, and the Dutch, all of them came and looted India and took over what belonged to India. Today, if we look back and take note of what has been done, we shall find a glorious period of success and achievements. India has been able to build itself into an upcoming and strong nation, with indices of development in all fields. The global population and the power corridor look at India with respect and awe. India matters in the spheres of power, economy, and development. The journey of 75 years has been a remarkably fulfilling one.
In 1948, the total foreign investment in India stood at $320,000. In 2020-21, India received a record US $81.72 billion in foreign direct investment (FDI).
Agriculture and Food Production Becoming a self-sufficient nation in agriculture and food production has been a top priority for India after gaining its independence. India has come a long way since being that country that used to import food grains in the 1950s. Now, India has successfully utilized its agrarian heritage and has become a net exporter in food grain. The total food production in 1950 was 54.92 million tons. It jumped to 305.44 million tons in 2020-21.

Literacy Rate The literacy rate in India has shown major signs of improvement. The achievement of 77.75% in 2022 is up from just 12% at the time of Independence in 1947. Kerala with a 93.91% literacy rate is the top state in India while Jammu and Kashmir with a literacy rate of 68.74% is the least literate union territory in India. With the abrogation of 370 and 35A this number is bound to change.
Steps taken by the Government of India to improve Literacy Rate in India: As per the Right to Education Act of 2010, the Government provides free and compulsory elementary education to all. The following steps to success include:
● The setting up of new schools and colleges at district and state levels
● The formation of committees to ensure proper utilization of funds allotted to improve literacy rate
● Female literacy rates have increased to a great extent, thanks to the Beti Bachao, Beti Padhao initiative taken by the Modi Government.
● Government support to NGOs such as Ekal Vidylay, Pratham, and AIM
In Independent India, the Indian Railways have focused on unifying all rail gauges, electrification of railway lines, and connecting northeast India to the mainland. The railway lines have been extended, including Northeastern states to the railway network continuing to a length of more than 67,956 kilometers. Roads have expanded exponentially in the last 75 years. In 1950, India only had 0.4 million kilometers of roadways. Today, the total length of roadways in India has multiplied by 16 times that to 6.4 million kilometers, making India’s road network the second largest in the world.
Space Research India has achieved noteworthy success in the field of space research in the 75 years after its independence. The Indian Space Research Organization (ISRO) was established on August 15, 1969. In 1975, India launched its first space satellite, Aryabhata, and in 1986, Rakesh Sharma became the first Indian to go to space. Now, under the Make in India program, space vehicles and satellites are manufactured by Indian scientists. When India successfully launched the satellite Chandrayaan to the moon, it became the first country to reach Mars through Mangalyaan. That success has only given India an appetite to achieve even more. Former president A P J Abdul Kalam shared his vision of reducing the cost of launching satellites from $20,000 per kg to $2,000 per kg by the year 2050.
Electricity for All Rural electrification has been a great success in postindependence India. While only 3,061 Indian villages had electricity in 1950, now that percentage has reached nearly 100%. From only 50% of the population covered by access to electricity in 1995 to 76% in 2010 to nearly 100% of people, the development has been staggering.
Connecting India The infrastructural development of India has radically changed the infrastructural facilities and communication network of the country 75 years after independence.

India @ 2047: One of the Top Three Global Leaders The International Monetary Fund (IMF) released its World Economic Outlook in April 2022 and forecasted that India could potentially achieve the $5 trillion economy target by the year 2026-27. Interestingly, the current projections by the International Monetary Fund are almost the same as the Modi-led government’s target of achieving the coveted status by the fiscal year 2025-26. The central bank, major multilateral institutions, and rating agencies released their latest FY22 real GDP growth forecasts for India. As per these forecasts, GDP growth ranges from 8.3% as per World Bank’s forecast to 10% by the Asian Development Bank’s forecast. Projections of global economic rankings suggest that by 2040, the Indian economy is expected to be the third largest after China and the US. Factoring population size, favorable demographics, and economic dynamism, India’s economy will be a striking distance from the US economy in terms of GDP by the time it celebrates 100 years of independence! That means that India would be re-emerging as one of the largest economies in the world just as it was in the eighteenth century.

Growing its share of global trade from its current 2.3% to a target of 5.8% by 2040 would make India the world’s second-largest trading nation, behind China. I will conclude this article with the wise words of a senior team member of Greater Pacific Capital based in UK: A growth model that recognized these factors and harnesses India’s advantages would lead to a very different middle-income country. The India of 2040 would be service- and knowledge-oriented, highly educated, productive, and wealth generating, while enjoying a level of prosperity and material wellbeing. “India delivering on both counts will deliver its tremendous soft-power benefits, making it an attractive partner for like-minded countries and a role-model for countries further behind and in need to develop their own development path” previously not witnessed in any country with population size. It would be a leader in key emerging technologies that are relevant internationally such as data, finance, and healthcare, which it would have deployed at scale, as well as a global engine of the mass-knowledge economy for the world, exporting services and intellectual property to the rest of the world. More importantly, achieving this transformation while adhering to the principles of democracy and free speech will ensure that this future India remains an open and free society that allows the free flow of goods, services, people and information in a manner that creates ongoing and long-term sustainable growth.

Abortion: A Hindu Perspective By Dr. Mohini Shinde
F
Looking Through The Hindu Lens at the abortion in the wake of the Roe versus Wade reversal AUGUST 2022 - WWW.DESHVIDESH.COM
rom the earliest times, Hindu scriptures have clearly denounced and condemned the practice of abortion unless the life of the mother was in danger due to a complication in pregancy. Hinduism believes the fetus is a living entity, a conscious being who deserves to be protected. Hindu scriptures refer to abortion as garha-batta, meaning “womb killing” and bhroona hathya, meaning “killing the undeveloped soul.” A.C. Bhaktivedanta Swami Prabhupada, India’s greatest scholar, philosopher, author, cultural ambassador, and spiritual leader, said on the subject of abortion: They are killing the baby in the womb. How cruel! In this age of unwanted population, man is losing his compassion. When you kill a living entity, even an ant, you are interfering with its spiritual evolution, its progress. That living entity must again take on that same life form to complete its designated life term in that body. And the killer must return to pay for damages. While talking about abortion, Swami Kamalatmananda of the Ramakrishna mission stated, “No human being has the right to destroy the fetus. If having a baby is economically and socially problematic, one can very well take precautions to avoid such unwanted birth rather than killing the baby. Precaution is better than destruction.” There has been and still is much debate and discussion on abortion. Is it right? Is it ethical? Is it humane? Is it legal? Recently, the US Supreme Court reversed the Roe versus Wade verdict which was in existence for more than 50 years. In India, the Medical Termination of Pregnancy Act, which was passed in 1971, took both sides of the argument into consideration. After the act was passed in India, there was no discussion or argument on the subject. The act stated that an abortion can be performed until the 20th week of pregnancy if:
27
Hindu Beliefs on the Life Cycle A woman has a serious disease and the pregnancy could endanger her life. A woman’s physical or mental health is endangered by the pregnancy. The fetus has a substantial risk of physical or mental handicap. A woman contracts rubella, commonly known as German measles, during the first three months of pregnancy. Any of a woman’s previous children had congenital abnormalities. The fetus is suffering from RH disease. The fetus has been exposed to irradiation. The pregnancy is the result of rape. A woman’s socio-economic status may hamper a healthy pregnancy.
28
Being the oldest living religion in the world, Hinduism holds a unique view of the fetus or the unborn child. Hindu philosophy believes that the life cycle begins long before conception. The unborn child, the fetus inside the mother’s womb, is the beginning of the journey of the soul, the journey as a living being. Abortion means killing the soul that was supposed to live its life. Since Hinduism propagates the doctrine of reincarnation, it holds that the fetus is an unborn soul waiting for its new life. An act of abortion violates the wish of God, and is therefore a crime according to the Hindu religion.
No human being has the right to destroy the fetus. If having a baby is economically and socially problematic, one can very well take precautions to avoid such unwanted birth rather than killing the baby. Precaution is better than destruction.
Hindu Scriptures on Abortion A popular Rig Veda hymn appeals to protect the fetuses.---- The Kaushitaki Upanishad compares abortion to the act of killing one’s parents. ---- The Atharva Veda says the fetus slayer, termed brunaghni, is the greatest of the sinners.
The Gautama Dharmasutra and Apastamba Dharmasutra indicate that abortionists become “outcasts.” In this sense, the Dharmasutras consider abortion equivalent to

killing one’s husband and slaying a learned scholar – a Brahmin. The Manava Dharmashastra goes as far as forbidding the water libation to those “who have caused an abortion…” According to the Garbha Upanishad, the soul remembers its past lives during the last month the fetus spends in the womb. In the Mahabharata, it is mentioned that Abhimanyu learned about the Chakravyūha (a type of battle formation used to surround enemies) while in his mother’s womb.
Dharma and Karma Hinduism reflects a perfect picture
Dharma, teaches its followers to be righteous, ethical, and to always follow the path of good deeds. Such high morals of Hinduism naturally condemn the act of abortion as against its principles of Dharma and Karma. Moreover, abortion is principally against the Hindu bioethics that describes it as unethical and sinful.
Ahimsa or Non-violence Mahatma Gandhiji, the biggest promoter of non-violence, clearly stated in his writings, “It seems to me clear as daylight that abortion would be a crime.” Apart from its spiritual foundations and preaching, the prodigious religion of Hinduism also supports the value of Ahimsa, or non-violence. Abortion, according to Hinduism, violates the values of non-violence, as it is the killing of an unborn child inside a mother’s womb. It is an unethical and sinful act that will create a burden of virtue on the person(s) doing this. It should always be opposed in all forms. Ahimsa — non-violence — teaches that it is wrong not only to kill living beings, but also to kill embryos. Hindus believe that all life is sacred, to be loved and revered, and, therefore, practice ahimsa. All life is sacred because all creatures are manifestations of the Supreme Being.
Preserve Life of unity in diversity. There are so many idols, so many rituals; yet the essence, the driving principles remain the same. It is these principles that unite the Hindus under the great canopy of Hinduism. Dharma in Hinduism represents the duties and responsibilities of human beings and their way of life. Karma refers to the principles of ethics and morality that follow a law of cause and effect — one good deed results in virtue while one sin results in the vice. The core of Hinduism, also called Sanatan
30
Hinduism believes in the ideals of protection of life and laws of inheritance. According to Hindu
philosophy, the unborn fetus is a soul that is ready to come into this world as a new life. The parents have certain responsibilities and obligations toward this unborn child which are also related to their ancestral duties. Abortion is detrimental to their ancestors and against the values of Dharma and Karma. Abortion may have legal authorization, but a true believer of Hinduism should never resort to this procedure which is viewed as being as bad as murder. It takes away the life of a yet-to-be-born child, breaking the continuity of reincarnation while going against the morals of Dharma and Karma. A devoted Hindu should always consider the religious essence and ethics before opting for abortion.

College Savings Plan for Your Children
By Robert H. Scott III
Professor, Dept. of Economics, Finance & Real Estate, Monmouth University
T
he college savings plan known as a “529” is often touted as a smart way to save for a child’s college education. But these plans involve more than just putting away money for college. Here an expert on 529s, shines light on how the plans work.
What are 529 plans? A 529 college savings plan is an investment account that families can open to save for college by investing money that grows tax-free. The name
32
of the account comes from Section 529 of the U.S. tax code. The money can be used for qualifying education expenses, such as tuition, room and board, textbooks, computers and travel. People can add money to a 529 account whenever they like, or set up automatic withdrawals from their checking account. At the end of 2020, Americans had invested a total of US$425 billion in 529 plans. In 2020, the average 529 plan had $25,644, but average
balances vary by the age of the child. This amount is almost exactly the total cost of only one year at an in-state, four-year college. The average total cost of one year at a private school is more than double that amount. When money is placed into a 529, it’s not as if the money is just sitting there. You will have several possible investment options to choose from that comprise stocks, bonds or a combination of the two. There are usually preset investment portfolios based on a child’s age. When a

lowest fees, the best investment options and the best overall returns.
Anyone can contribute to a person’s 529 plan, so it makes a great gift that will not end up being broken or thrown away.
child is young, these portfolios are mostly stocks and are invested more aggressively. But as the child ages, the portfolio automatically transfers more money to bonds, which are usually less volatile. So the effectiveness of a 529 plan depends on how well the stock market performs.
Is the money only for the first four years of college? It is also possible to use 529 plans for graduate school. So if a child earns a full scholarship as an undergraduate, then the money from the child’s 529 plan can be saved for graduate school. A recent change in 529 plans allows them to be used for education before college. More specifically, they can be used to pay up to $10,000 per year for tuition at K-12 schools.
There are no residency requirements. In other words, you don’t have to live in a particular state to invest in the state’s 529 plan. However, if a state offers a tax deduction for investing in its 529 plan, then you have to live in that state to get the deduction.
What if the beneficiary of the 529 doesn’t go to college? It is possible to move funds in 529 plan accounts from one beneficiary to another. Beneficiaries who do not use their 529 plan funds can even transfer the account to their own children or another family member without penalty. The biggest problem with 529 plans is that money not used for qualified education expenses incurs a 10% penalty on investment earnings. Those earnings are also subject to federal and sometimes state income taxes if they are not used for education expenses that qualify under a 529 plan.
Who should invest in 529 plans? Families unable to qualify for financial aid are the target investors for 529 plans. A 529 plan account with a large balance could keep a student from
being eligible for financial aid, even if the balance is much less than the overall cost of the degree. So, in cases like this, a 529 plan could cost families money rather than help. Grandparents whose grandchildren are unlikely to qualify for financial aid are also common investors in 529 plans. Parents, grandparents or anyone with the ability and desire can contribute up to $16,000 each year if a child’s parents are not married – or $32,000 if they are married – and not pay gift taxes. People can contribute up to this maximum amount each year for each beneficiary. So, if a grandparent has two grandchildren whose parents are married, they can contribute $32,000 in one year to each child’s 529 plan. Each state has different rules on how much someone can contribute over a lifetime to any one 529 plan, but it ranges from $235,000 in states such as Georgia and Mississippi to $550,000 in Missouri and $418,000 in Florida.
Do 529 plans work? Yes. They are a way for families to invest money in the stock market and, if all goes well, enjoy financial gains that they can withdraw for their children’s education without paying taxes. They work best under several conditions.
For college, however, there are no limits on how much can be withdrawn to cover education expenses.
Do 529 plans vary by state? Every state in the United States, plus Washington, D.C., has its own 529 plan. However, not all plans are the same. For that reason, it is important to research which plans have the

over the plan they invest in, so some kids may have several. For instance, I have 529 plans for both of my kids, but their grandparents have 529 plan accounts for them, too. There are other situations that allow you to withdraw 529 plan funds and not be subjected to the 10% penalty, such as when a beneficiary dies, becomes disabled or earns a full scholarship. Relatives might find this type of saving more emotionally rewarding than gifting money now or giving a larger inheritance at death. First, if a family is unable to qualify for financial aid, 529 plans offer an effective way to save for college because the money is invested in the stock market and can grow faster than other options, such as savings accounts. Plus, the gains are not taxed as they would be if invested in a non-529 plan investment account. Second, because the investment time horizon is short – possibly less than 18 years – your money does not have much time to grow, so you have to invest early. There is no age limit for beneficiaries of 529s. You can start one for yourself or someone else at any age. Third, if you live in one of the states that offer a tax deduction for investing in a 529 plan, that is a factor to consider. Specifically, a 529 holder should look at whether the value of the tax deduction is large enough to outweigh the fact that there are fewer or worse investment options. Fourth, anyone can contribute to a person’s 529 plan, so it makes a great gift that will not end up being broken or thrown away. Fifth, grandparents or other relatives, and even family friends, can set up 529 plans for grandchildren, stepchildren, nieces and nephews. In general, it’s probably more efficient to have one 529 plan, but some people like to retain some control
34
It is possible to move funds in 529 plan accounts from one beneficiary to another. Are there any drawbacks? There are two primary problems with 529 plans, even for families that might benefit from them the most. First, timing when to withdraw money is more challenging than, say, for retirement. For example, if the market is having a down year, but a beneficiary is in college and you need to pay tuition, then the benefits can be smaller overall. Say you have $50,000 invested in a 529 plan, and
the market falls 10% right before you withdraw the money. If that happens, then you would only have $45,000 to withdraw. On the other hand, if the market increased 10% right before you needed the money, then you would have $55,000 to withdraw. Second, your investment options are limited. If your state offers a tax deduction for investing in a 529 plan you might choose to invest in your state’s plan even if that plan might not be very good, such as if it has expensive fees. Alternatively, you might choose to invest in another state’s 529 plan and lose the state tax deduction, but have more investment options and fewer fees. This could save you more money in the long run.

to the court-supervised process of distributing an estate.
Keep it up to Date
I
Everyone Must have a Will or Trust
n this uncertain world, two things are very certain — everybody has to pay taxes and everybody is going to die. Of course, nobody wants to think about their own death. In fact, many of us try to avoid the topic at all costs. Unfortunately, there are consequences for not planning. Similarly, everybody talks about a will, but many people fail to actually do it. Each person has his/her own reason why they don’t do it. Many just don’t get around to doing it. In fact, one survey found that the most common reason adult Indians living in America failed to do a will is just that — procrastination. Some people think that a will and estate planning is only for rich people.
Legal Requirements for Drafting a Will As long as you are an adult and of sound mind, you are entitled to create a will. General requirements to ensure a will’s legality include signatures of at least two witnesses and your own signature, along with the date the document was created. Even though there are websites available where you can create your own will, the attorney cost is not that much, so utilizing an attorney’s expertise is highly recommended.
Legal Mumbo Jumbo
When you start looking into creating your own will, you will come across a few words which you may not be familiar with or you may have a misconception about.
36
The first word is estate. What is an estate? If you are thinking of a large land with a multi-story, multi-room mansion, you are not even close. The simple basic estate consists of the following: • Checking and savings accounts • Investments • Your home and other real estate • Your car • Life insurance • Your personal possessions The second term you may come across is a trust. Depending on the complexity of your estate, your financial planning may benefit from a trust rather than a will. A will must undergo probate — the process of proving it in court — which can slow down the execution process. A trust does not. The third term you may see frequently is the power of attorney, which is the authority to act for another person in a specified or all legal or financial matters. The fourth term you will hear is the living will. The living will is a written statement detailing a person’s desires regarding their medical treatment in circumstances in which they are no longer able to express informed consent, especially an advanced directive. Depending upon your situation, you may need all four legal documents. The fifth term is a probate. Probate, mentioned earlier, is the legal process that ensures your will is valid. It also refers more generally
As you update your computer and your mobile devices from time to time, all of these legal documents need to be updated as well. As you accumulate more assets over your lifetime, get married, and have children, revisiting your documents to make any necessary revisions is very important.
Here are the most important Reasons to have a Will: 1. Peace of mind for your loved ones Some people put off creating their will because they assume their loved ones will automatically get an inheritance. This isn’t always true. If you do not have a will, the legal process to obtain the money you thought might automatically go to them can be long and expensive for your loved ones after you pass. Recently a 45-year-young Indian IT professional in South Florida passed away after a heart attack. He did not have a will, and he did not put his wife’s name on bank accounts or any other investments as a beneficiary. Even though he had over $100,000 in his bank account, his wife could not withdraw any money. Unfortunately, she did not have enough money to pay for the funeral. A few days later when she hired an attorney, she found out that it would cost her a minimum of $5,000, and that it may take five to six months to get even one dollar from the bank.
2. A will determines who is responsible for your finances. Deciding who will handle your finances is a great reason to have a will. When you write a will, you have the opportunity to nominate an “executor.” This is the person who will be in charge of wrapping up all of your affairs. The responsibilities of an executor may include everything from closing bank accounts to liquidating assets, so you should choose someone who is capable and who you trust to carry out
AUGUST 2022 - WWW.DESHVIDESH.COM
these activities. If you don’t choose an executor in your will, the court will pick one for you — and it may not be the person you’d want. In most cases, executors tend to be spouses, children, or parents of the deceased.
3. Decide who will take care of your minor children. Any time you think about your children’s future, you are bound to get emotional. If you have to think about what would happen to them if you were to die, you get even more emotional. That, however, should not prevent you from having a plan in place regarding who will take care of your minor children should both parents die. If you don’t nominate a guardian in your will, a court will decide from among your family members. However, you know your child best and are probably in a better position than a court to make sure your child does not end up in the wrong hands. Therefore, this is another of the most important reasons to have a will.
4. Minimize the potential for family disputes.
6. Make a legal process easy for your loved one.
Every family experiences conflicts and goes through ups and downs in their relationships. These conflicts can flare up if one of the family members dies without a will. When you die without a will, your loved ones will have to guess at what your final wishes were. This ambiguity can create friction, and even fights, which sometimes last a long time. A will may reduce these conflicts considerably.
Most legal terms are confusing and misunderstood by many. Most people think that probate is always lengthy and expensive, but that is far from the truth if you have a will. A clearly drafted one will definitely reduce the delay. If a disgruntled family member “contests” the will because he or she thinks they deserve a larger share of your estate, your will can quickly settle the dispute.
5. Minimize estate taxes
I am sure you want to leave a positive impact on the world and leave a legacy after you die. The easiest way to do this is to support a charity or cause you love most. When you create a will, you can preserve your legacy by leaving a part of your estate to a non-profit organization. This donation, up to certain amounts, may also reduce your estate taxes. Disclaimer: Author is not an attorney, accountant or a financial advisor. The article is for general information. To understand pros and cons you should consult your attorney.
In the beginning of the article, I mentioned that everybody has to pay taxes regardless of his or her situation. Unfortunately, when you die, your loved ones will have to pay taxes on their inheritance. If you plan and create a will after you consult your attorney and your accountant, there is a very good chance they will suggest how to minimize the inheritance taxes your loved ones may have to pay when they receive property from your estate.

EB-1A Extraordinary Ability Green Cards
O
ne of my favorite areas to practice immigration law involves representing exceptional individuals with extraordinary abilities. I first use a personally created and detailed analytical analysis of my client’s (or potential client’s) specific profession, skill set, and unusual talents to determine their chances of successfully petitioning for an extraordinary ability visa. After a rather rigorous screening process involving one or more consultations, we determine if it is in the client’s best interest to apply for such a visa or green card. We always ensure to appropriately manage a client’s expectations and balance the risks and rewards of such an important decision. While any attorney could manage Elon Musk or Lionel Messi, a confident and creative attorney may be willing to take on certain challenging or less obvious cases. One example of an unusual EB-1 client would be Polish glider pilot Sebastian Kawa. A glider pilot would require a little more effort not because he won’t necessarily qualify, but because he doesn’t fit the typical EB-1A mold. Sebastian was a 9X World Champion, the world (FAI) leading glider competition pilot (currently
50
number two in the world rankings of the FAI Gliding Commission), and the current World Champion in 15m Class. Kawa has associated with the Mountain Gliding School “ar” in southern Poland. Sebastian is also known in the Polish gliding community for numerous blogs and films popularizing the sport. His autobiography and advanced gliding tutorial “Sky Full of Heat” (English and Polish language editions) were published in December 2012. I recently began representing an artist on an EB-1A petition. My client “Jonathan” is an internationally famous painter from China who has built his career over the last 20plus years while living in France. Jonathan studied at one of the most prestigious universities in all of China and afterwards he was sponsored by a French art school and academy to continue painting and teaching in Europe. His works are displayed at expensive homes and offices all over Western Europe and his patrons include well-known attorneys, businessmen, and diplomats. Mr. Bansal’s other entrepreneurial endeavors included solving college students’ housing and related problems through an online portal called searchmycampus.com. In 2019, he was listed in Fortune India’s Best 40 under 40 entrepreneur and Bansal is currently judging India’s first-of-its-kind reality show Shark Tank season 1 (an accomplishment that would likely resonate strongly here in the States). Advantages of the EB-1A: 1.
The EB-1A allows for premium processing (where the EB-2 currently does not) 2. The EB-1A allows you to self-petition (meaning you do not need to have a job offer to petition for you) 3. The EB-1A also does not require a permanent labor certification. Other employment-based green cards like the EB-3 require the PERM process. 4. Most importantly, the August 2022 visa bulletin for green cards is current for both India and China in the 1st employment-based preference category (EB-1). Unfortunately, the wait is approximately eight years for EB-2s from India and over ten years for EB-3s from India. The EB-1A is one of the most challenging visas for approval. To qualify for an EB-1A green card, you must prove that you have extraordinary ability in one of the following fields: a) Science, b) Art, c) Education, d) Business or e) Athletics. Additionally, you must possess a level of expertise in your field that indicates that you are one of the small percentage of people who have risen to the upper echelon of your area. Yoga and meditation are designed for self-realization and the Yoga Sutras of Patanjali provide a step-by-step guide to reach enlightenment.
Ahimsa A Motivator of Veganism? By Chahna Tailor Gupta
T
he ancient Vedic science of yoga is gaining more and more popularity each and every year. Even though the current practice of yoga is slowly moving towards mindfulness rather than just stretch-based fitness, many still fail to realize that yoga is so much more. Yoga and meditation are designed for self-realization and the Yoga Sutras of Patanjali provide a step-by-step guide to reach enlightenment. To attain this, however, one must be able to quiet the mind and find a stillness between her thoughts. The first step of the Yoga Sutras is “Yama” which translates to selfrestraint or moral discipline and has more to do with our relationship with the exterior world. Yama includes:
54
ahimsa (non-violence), satya (truthfulness), asteya (non-stealing), brahmacharya (conscious direction or use of energy), and aparigraha (non-attachment). For enlightenment, finding stillness between the thoughts is easier when we are at peace with our thoughts. This is because peace does not produce a reaction. On the other hand, excitement, anger, sadness, and other emotional reactions disrupt stillness. Reflecting on our actions can affect us in times when we want to simply focus and meditate. At first glance, Yama seems easy to interpret. However, in actuality, there are many layers to it. For example, ahimsa, non-harming, can
be interpreted as not hurting people or ourselves. But what about other actions, or even inactions, through which we may contribute to it? An obvious action that conflicts with ahimsa is eating meat or dairy, which is why veganism is sweeping the world. Vegans abstain from consuming animal products, byproducts, and even those items that exploit animals during the production cycle, such as honey from bees and silk from silkworms. It is easy to see how veganism is a conscious practice of ahimsa. When yoga and Vedic sciences were flourishing, living off of the land and being one with nature was a huge part of the lifestyle. In general, yogic diets usually favored (and still do favor) light, easy-to-digest, seasonal, sattvic foods. This did not include meat, but did include dairy when taken from the animal without harming them or their babies and taking only what was needed. Mass production is the main culprit of animal abuse which helped propel the vegan movement. As Dr. David Frawley states, “Yoga

represents a Dharmic approach to spiritual harmony” and “aims at taking us to self-realization, which depends on a purified body and mind.” For those who think about the concept of veganism from an ahimsa perspective, the silence they seek can be obstructed by the guilt of hurting another jiva (sentient being). Vegan food today is usually met with disdain from those who are not vegan, even Indian vegetarians. However, as technology and brilliant chefs come together, new and improved vegan recipes are being designed, tried, and tested every day. As a way to promote and practice ahimsa and offer an avenue for people to try delicious vegan cuisine, our upcoming event, Life Market, taking place on September 17, 2022, will feature only vegan food vendors. Come take a free yoga class, meet ayurvedic professionals, and try sattvic and plant-based alternatives that highlight how delicious guiltfree, non-violence tastes!

Teaser of Emergency released with high praise for Kangana Ranaut as the late PM Indira Gandhi
T
he “Queen” of Bollywood is back with another surprise! She released the teaser of her upcoming movie Emergency on social media where she is seen portraying the role of the late Prime Minister Indira Gandhi. She looked perfect as the late PM with her signature hairstyle, cotton saree, spectacles, and super-strong personality. Her look created a huge buzz among the netizens who praised the powerful actress highly for her anticipated great performance. Netizens were taken aback at the striking resemblance of Kangana Ranaut to the late Indira Gandhi. They were surprised to find that an actor who had previously bore a striking resemblance to J. Jayalalitha in another role could look so similar to Indira Gandhi now. With four National Awards to her credit, Ranaut has a special talent for portraying powerful women in films, be it the Queen of Jhansi Lakshmibai (Manikarnika) or the superstar-turned-politician, the late J. Jayalalitha. The film is produced and directed by Ranaut. The teaser shows that Indira Gandhi receives a phone call from the US Secretary of State Henry Kissinger asking whether US President Richard Nixon can address her as Ma’am instead of Sir. Indira Gandhi. She says “yes” but instructs her secretary to communicate to

President Nixon that everyone in her office refers to her as “Sir.” According
to
Ranaut,
the
emergency has a special significance in Indian politics as it changed the public viewpoint on power. She further added that she is starting the
shooting after thorough research and understanding. Her make-up and look were perfected by the Oscar-winning make-up artist David Malinowski, famous for films like Darkest Hour (2017), and The Batman (2022). The film will be released next year.

Ramayana starring Ranbir Kapoor and Hrithik Roshan will commence shooting in mid-2023
After long discussions and speculations on one of the most ambitious and highly anticipated projects of Bollywood, the mythological film Ramayana, it has finally been announced that the shooting for the film will begin in mid-2023. The cast of this film includes two superstars of Bollywood: Hrithik Roshan and Ranbir Kapoor. The film will be directed by Nitesh Tiwari. According to reports, the two actors have agreed to start the shooting next year. The mythological film will have a lot of VFX elements. However, the mythological plot and the story of the epic will not be affected in any way. Ranbir Kapoor will play the role of Rama and Hrithik Roshan will be seen as the demon king Ravana. This is the first time that these two actors have worked together. The film has a massive budget considering the VFX and the mythological backdrop. While the roles of Rama and Ravana have been finalized, the search for the actor to play Sita is still on. There have been rumors that Deepika Padukone may fill the role of Sita, but nothing has been confirmed by any of the sources. Hence, the actor to play Sita is yet to be finalized. It has been known that the official declarations for the film will be made on Diwali this year. Ranbir has two important releases of Shamshera and Brahmastra in July and August 2022, respectively. Hrithik has finished shooting Vikram Vedha with Saif Ali Khan and will soon start the shooting of Fighter with Deepika Padukone as the female lead.

Not only that, but it has also been able to improve its scores from 2.8 to 3.00. Some new twists and turns in the storyline have perhaps attracted more viewers towards this mega serial starring Rupali Ganguly. The title character, Anupamaa, and her childhood love Anuj have adopted a child. Making the serial even more attractive is Kinjal’s pregnancy and the love story of Pakhi. Despite many controversies and a demand for a change of storyline, this serial continues to experience considerable success. Rohit Shetty’s famous reality show Khatron Ke Khiladi 12 has secured the second position with a score of 2.5. It started on July 2 and quickly made it to the top 5 list. Dangerous stunts
coupled with glamour and smart anchoring make the reality show a must-watch for most viewers. KKK is the only reality show to enter the top 5 this week. However, reality shows like Dance India Dance Supermom, Super Star Singer, and Ravivaar with Star Parivaar are getting more viewers’ attention now. Yeh Hai Chahatein ranked in the third spot with a rating of 2.2. The
romantic equation between Sargun Kaur Luthra and Abrar Qazi is enjoyed by the viewers. This serial is the spin-off of Yeh Hai Mohabbatein. The fourth position has been occupied by four shows all with a rating of 2.1. The shows are Yeh Rishta Kya Kehlata Hai, Bhagya Lakshmi, Ghum Hai Kisikey Pyaar Meiin, and Imlie. The fifth spot goes to Kundali Bhagya with a score of 2.0.

thought of dubbing his portions, but Bachchan requested to see his work first. After hearing his Gujarati, he was stunned. The film’s title, Fakt Mahilao Maate, means all for women. The story revolves around the life of a 28-year-old person, Chintan Parikh. The role of Parikh is played by Yash Soni. The middle-class man gets into all kinds of trouble due to the women around him. Confused and irritated, he goes to different temples and prays for the ability to gain the power to handle women and the troubles created by them.
Disney+Hotstar’s Shoorveer gets a mixed review. Soon after the release of the military drama Shoorveer on the OTT platform Disney+Hotstar, viewers began expressing their opinions on their social media handles. There is a mixed response among them. Some highly acclaimed the series while others were not impressed by it. Shoorveer is produced by Juggernaut Productions and directed by Kanishk Varma. The ensemble cast has senior actors, such as Makarand Deshpande and Manish Chaudhari along with Regina Cassandra, Armaan Ralhan, Abhishek Saha, Aadil Khan, Anjali Barot, Kuldeep Sareen, Arif Zakaria, Faisal Rashid, Sahil Mehta, and Shivya Pathani in various roles. The story of Shoorveer is about the Hawks, a joint task force of the Army, Air Force, and Navy formed by the Indian government. This force works as the first
responder in cases of severe threats to the national security system. Members of the Hawks are the most competent soldiers from across the country. The series portrays different cases the force is required to face and solve. Shoorveer has excellent visual effects for the aerial and other encounters. Some viewers were highly impressed by these encounters as well as the visual effects. They praised the series for its nationalistic approach, storyline, and visuals. On the other hand, some viewers did not find anything special in the series. They even compared it to the daily soaps. Comparisons to Top Gun Maverick starring Tom Cruise have also been made in reviewing Shoorveer. However, according to the reviewers, it lacks the skill and effort of the Hollywood movie.
No detail of the role portrayed by Amitabh Bachchan has been revealed yet. However, there is no doubt that it will create the usual magic of the megastar as always.
