Dear Readers,
Every year, our May issue is about Immigration, which is especially timely given that immigration has been a very controversial topic. During the last two years, many politicians including President Trump, have made statements about immigrants, especially illegal immigrants, building wall against US- Mexico border, and sanctuary cities. Reform of immigrations laws and policy has been at the forefront of President Trump’s agenda. After taking office, he revised some of the statements made during the presidential campaign. Many Desh-Videsh readers are first generation immigrants or children of first generation immigrants. Many of us are either US citizens or green card holders; however, many new arrivals are in the country on student visas or H1 visas and may be impacted by upcoming changes in immigration policies.
This issue features articles on upcoming changes to immigration law, including H1-B visas. Mainstream media, South Asian publications, and bloggers, offer their interpretation of the facts creating confusion and frustration among immigrant communities, including our own. There has been some discrepancy in the reporting of salary requirements for H1-B applicants. For those with questions about changes in the law, it is best to consult documents released by the administration* or with an immigration attorney rather than rely on hearsay.
It should be noted that President Trump is in favor of changing the way visas are currently awarded. He points out, “Right now H-1B visas are awarded in a totally random lottery and that’s wrong. Instead, they should be given to the most skilled and highest paid applicants and they should never, ever be used to replace Americans.” Large, established corporations have an advantage within this system as they can submit a larger number tickets into the system. As such, the owner of a smaller IT firm would not have much of a chance to secure an H1-B visa for a potential employee. Though the topic is a controversial one, I’m sure many of our community members would advocate a review of the H1-B program to make the process more transparent and easy to navigate. Happy reading,

Current Status of H-1B Visa The H-1B Visa is a non-immigrant visa classification for temporary employment in a specialty occupation with qualifying US Company. Currently, the H-1B Visa Program remains the same as it has been over the decade, although like in the past, there are several proposed bills pending with the House of Representatives to revise and revamp the H-1B Visa Program. Every year there are 65,000 new H-1B Visas available in the Bachelor’s Quota and an additional 20,000 new H-1B Visas available in the Master’s Quota for Candidates that possess a Master’s Degree from a US Institution. The quota is generally open for the first 5 business days of April every year. Over the last several years, United States Citizenship and Immigration Services (more commonly known as “USCIS”) receive over 300,000 applications for the

new 85,000 H-1B Visas available every year. For the Fiscal Year 2018 Quota, which just passed in April 2017, USCIS received 199,000 applications for the 85,000 available visas. USCIS conducts a lottery every year to determine which 85,000 applications will be accepted for processing (meaning assigned to an Officer to determine approvability based on the merits of the application) and the rest not picked in the lottery will be returned to
Petitioners along with their Filing Fees. Making it through the lottery and being accepted for processing is only the first hurdle that one must cross to be one step closer to obtaining an H-1B Visa. The next hurdle is to prove beyond a preponderance of the evidence that the Compa ny and the Candidate qualify for the Visa based on the documentation and evidence submitted. Not all 85,000 applications that are picked up for processing are approved.

Proposed Changes to the H-1B Visa Program Republican Representative Darrel Issa of California introduced a bill in the House of Representatives the first week of January 2017 to make changes to the H-1B Visa Program. Under his bill, any company paying an H-1B Visa Holder less than $100,000 will have to show that they could not hire American Workers for the same jobs. This bill, like current regulations, would only apply to Companies with more than 50

employees and for whom H-1B workers make up 15% or more of the total work force. Democratic Representative Zoe Lofgren, also from California, has drafted what she states is a “more comprehensive” bill that would award visas by which Employers offer the highest salaries. Under both the current and Issa’s proposals visas
are awarded by a random computer lottery system. Representative Lofgren’s bill will also propose changes to how permanent visas are awarded, eliminating limits allocated by Country. However, Rep. Lofgren’s bill has not yet been introduced, unlike Rep. Issa’s bill which is currently pending before the House of Representatives.

A Bill is Not the Law There are several processes and procedures that must take place before a proposed bill becomes a law. Knowing and understanding this process can limit the anxiety and panic among foreign nationals in the US who may be affected by any changes. In order for a bill to become a law, it must be approved by a majority of the House of Representatives first. Then it is passed on to the Sen-

ate, where it must also be approved by a majority and lastly it must be approved and signed by the President of the United States. While the bill is pending with each the House and the Senate, each cabinet assigns experts and specialists to review the bill and provide feedback
and suggestions for changes. Therefore, the proposed bill you see in the beginning of the process is likely not the final bill which will be passed because along the way, the House Committee and the Senate Committee will have made changes as they see fit.

veryone living in the United States has certain basic rights under the U.S. Constitution. According to the 14th Amend-

No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.” It is the word “person” that connects the dots of “due process” and “equal protection” in the 14th Amendment to the U.S Constitution, and it is those five words that make the Constitution of the United States and its 14th amendment one of the most important political documents. Therefore, “Aliens,” legal and illegal, have the full panoply of constitutional protections.
UNDOCUMENTED
If you are undocumented and immigration (ICE) agents knock on your door, know that you have the following rights: ● You do not have to open the door or let the officers into your home unless they have a valid search warrant signed by a judge. ● An ICE deportation warrant is not the same as a search warrant. If this is the only document they have, they cannot legally come inside unless you verbally agree to let them in. ● If the officers say they have a search warrant signed by a judge, ask them to slide it under the door or hold it up to a window so you can see it.
● If the warrant does not have your correct

name and address on it and is not signed by a judge you do not have to open the door or let them inside. ● If at any point you decide to speak with the officers, you do not need to open the door to do so. You can speak to them

through the door or step outside and close the door. You have the right to remain silent. You do not need to speak to the immigration officers or answer any questions. If you are asked where you were born or how you entered the United States, you may refuse to answer or remain silent. If you choose to remain silent, say so out loud. You may show a know-your-rights card to the officer that explains that you will remain silent and wish to speak to a lawyer. You may refuse to show identity documents that say what country you are from. Do not show any false documents and do not lie.

you have the right to immediately contact a lawyer. Even if you do not have a lawyer, you may tell the immigration officers that you want to speak to one. If you have a lawyer, you have the right to talk to them. If you have a signed Form G-28, which shows you have a lawyer, give it to an officer. If you do not have a lawyer, ask an immigration officer for a list of pro bono lawyers. You also have the right to contact your

assist you in locating a lawyer. ● You can refuse to sign any/all paperwork until you have had the opportunity to speak to a lawyer.

speaking to a lawyer, be sure you understand exactly what the document says and means before you sign it.
LEGAL PERMANENT RESIDENTS AND VALID VISA HOLDERS
Always carry any valid immigration document you have with you.

If you have a valid visa, work permit, or green card, be sure to have it with you in case you need to show it for identification purposes.
If you are 18 or older, you do have to carry your green card with you. Section 264(e) of the Immigration and Nationality Act (I.N.A.) requires all lawful permanent resi-
dents (LPRs) to have “at all times” official evidence of LPR status.
• Failure to have your green card with you is
a misdemeanor and if you are found guilty you can be fined up to $100 and put in jail for up to 30 days. (I.N.A. Section 264(e).) A copy is not good enough, because the law does not use the word “copy” or refer to “other evidence” of LPR status.
U.S. CITIZENS
U.S. citizens (by birth or naturalization) are not required to carry proof of their citizenship status. However, quite a number of naturalized citizens are fearful and uncertain given the present immigration climate. Even though it is not a requirement, quite a number of naturalized U.S. Citizens as well as those born here who are of a certain ethnic background are carrying evidence such as a copy of their U.S. passports or U.S. passport cards.

New US Executive Order Impacts Indian Outsourcing World The recent Executive Orders that stresses on ‘Buy American, Hire American’ and asks for a review of the H1-B visa system has many hitting the panic button. By Taniya Talukdar

ince Donald Trump assumed office in the White House, many people have been waiting on pins and needles to hear about his many reform ideas. One such idea being the Executive Orders that he recently signed stressing his ‘Buy American, Hire American’ agen30
da. This order emphasizes hiring American workers instead of getting skilled laborers from other countries to work for a lesser rate. The order also calls for the review of the H1-B visa that allows companies to temporarily employ skilled foreign workers in the US. These ac-
tions have led to people feeling insecure and unsure about their future on American soil largely because America has always been viewed as an immigrant country. Without any substantive changes made yet, this recent move has managed to have

That the outcome of the review might affect the spouses of H1-B visa holders isn’t lost on them. One such spouse on conditions of anonymity says, “Spouses of H1-B visa holders get an H4 dependent visa and it doesn’t give them the power to work. Because of that they can’t

There is an overwhelming narrative that is unfortunately perpetuated by the media outlets and what should be business leaders in our community, that foreign workers contribute little to the booming US economy in spite of empirical data showing otherwise,” informs Ann K. Cun, an immigration lawyer. Balaji Gupta, a software professional, who has been in the US for two and a half years on an H1-B visa says, “I don’t think it’s going to affect directly yet but there’s a surprise everyday. I was in the process of applying for an H1-B visa for my wife but I have put a stop to it at the moment as we’re not sure yet what will come out of the review. Though I feel that it will mostly affect workers from the lower income group, if at all it does.”
have bank accounts or social security numbers. However, in 2015, under President Barack Obama’s administration, certain spouses were allowed to work under the H4EAD rule. It stated that anyone who had an I-140 approved could obtain a work permit. But this might change if
there are changes proposed and approved after the review.” Upon further review, the situation is not as grim as it seems. All’s not lost yet as the order hasn’t set a deadline for the review, nor does it suggest any changes to the program yet. Viswa Alluri, who is also on an H1-B visa in the US, has a positive approach towards this. He says, “I don’t see anything that is going to impact H1-B holders with the recent executive orders. It is an order to USCIS and other officials to investigate more into the program and try to stop abusing it.” Cun believes the latest Executive Order might not really be clear in terms of the outcome. She says, “It is very vague in providing guidance to federal agencies on the specif-
ics and the timelines in which the President would like to see reforms to the H-1B program. While there was a lot of fanfare surrounding the announcement last week, the substantive guidance that the public is seeking is sorely missing. President Trump has essentially asked various federal agencies to conduct an internal review, provide reports and make recommendations on how to streamline the H-1B program. It can hardly be said to be a road map for any meaningful reform.” “It’s always recommended to read reliable news sources about immigration-related events rather than relying on word-of-mouth rumors about what may or may not happen,” she signs off.

Becoming American, Being Indian: An Immigrant Community in New York City By Madhulika S. Khandelwal Since the 1960s the number of Indian immigrants and their descendants living in the United States has grown dramatically. During the same period, the makeup of this community has also changed—the highly educated professional elite who came to this country from the subcontinent in the 1960s has given way to a population encompassing many from the working and middle classes. In her fascinating account of Indian immigrants in New York City, Madhulika S. Khandelwal explores the ways in which their world has evolved over four decades. How did this highly diverse ethnic group form an identity and community? Namasté America: Indian Immigrants in an American Metropolis by Padma Rangaswamy At some point during the 1990s, the size of the Asian Indian population in the United States surpassed the one million mark. Today’s Indians in America are a diverse group. They come from every state in India as well as from around the globe: England, Canada, South Africa, Tanzania, Fiji, Guyana, and Trinidad. They also belong to many religious faiths, including Hinduism, Islam, Sikhism, Jainism, Christianity, and Zoroastrianism. Many have high professional skills and are fluent in English and familiar with Western culture. They have settled throughout the United States, largely in metropolitan areas. Namasté America tells this story of Indian immigrants in America, focusing on one of the largest communities found in Chicago.

2017 Ellis Island Medal of Honor: South Asian Recipients

ach year, the National Ethnic Coalition of Organizations (NECO) presents the Ellis Island Medal of Honor to native-born and naturalized US citizens who “embody the spirit of America in their celebration of patriotism, tolerance, brotherhood and diversity.” Awarded to a select group of individuals, the Ellis Island Medal of Honor acknowledges the immigrant experience and recognizes the accomplishments made by these individuals across fields. This year is no different than previous years in that several prominent South Asian received the prestigious award. Dr. Adil H. Haider, MD, MPH, FACS: Dr. Haider is a trauma surgeon, public health researcher, and the Kessler Director of Center for Surgery and Public Health at the Brigham and Women’s Hospital, Harvard Medical School.
Indra Nooyi: PepsiCo CEO since 2006 and chairman since 2007, Nooyi has since become a champion for diversity and women’s rights.

For Here or To Go Explores Hardships of an Expiring Visa
F
or here or To Go is a story based on the experience of a software engineer from India whose visa is about to expire. The film explores his visa struggles in the United States and follows the process he takes for visa renewal. While the movie has a strong story, the plot at times stalls. For Here or To Go is a timely film based on the current immigration issues within the United States. The story revolves around software engineer Vivek (played by Ali Fazal) who works in Silicon Valley on a H-1B visa. Having worked several years in the industry, he finds life to have become boring and monotonous. One day, he lands a job offer from a healthcare start up company and finds the work stimulating and engaging. The story takes a twist when recruiters realize that his visa expires within a year and suddenly his offer vanishes. What follows next are a series of struggles, turmoil, love, romance, advice and an ardent interest on Vivek’s part to stay in the US. The film’s story is based on the varied experiences of Indians struggling to survive in the US with an expiring visa. In addition to Vivek’s troubles, the 44

film follows the legal experiences of his friends played by Omi Vaidya, Samrat Chakrabarti and Amitosh Nagpal. It is undoubtedly one of the freshest looks at this hot-button topic, but with an added aspect of humanity. Though the storyline is easily relatable, at times the movie stalls. The complexities of visa renewal and the presence of the lead actress adds some gravity to the story. Vivek’s girlfriend’s father, played by Rajit Kapur, interjects with advice of returning to India, a question with which Vivek struggles to find an answer Shot in Northern California, the film’s director, Rucha Humnabadkar aims to send a strong message. While the narrative at times feels heavy and complex, the film does highlight the struggles many Indians face as immigrants living in the current political climate in the US. From assimilating in your adopted country to wondering if your talents are better served in your homeland, For Here or To Go offers audiences a modern look at immigration in the US.

Hindu Cremation in South Florida
On behalf of the Hindu community, Desh-Videsh and a few local community leaders approached Funeral/Cremation Vendors in Broward and Dade County and negotiated a fixed price for cremation and last Hindu rites.
Not too many people know about Direct Cremation. It is a low cost way for the families to carry out cremation for their loved ones. Funeral/Cremation places do not discuss this option for obvious reasons.
