Executive Director’s Report Thank you to all who have taken the time to renew your membership in MFDA. The list is growing and we continue appreciate your support. Those of you who have renewed should have received a 2014 MFDA Member decal to be displayed on a window surface in your funeral home. The decal is 41/2 x 2 3/4 in size and will be sent to firms and branches. We hope you display it with pride. As I speak with funeral directors around the state about MFDA and ask why they have...or have not...joined, I get a variety of answers. On the “have not” side I hear “I don’t belong to MFDA because...”it’s run by the big corporations,” or “it’s run by the metro area funeral homes.” My response is simply look at your Board of Directors and what areas they represent. Primarily from rural areas in small to midsize companies, individually owned and operated. These are individuals who recognize the strength in numbers, and although you are all competitors, your profession is unique and deserves support from all of you. On the positive (renewed) side, I hear...”It’s what a person does who values his/her profession”...”The connections made throughout the year are invaluable”...”The convention is both educational and fun”...”We feel our dues are an investment in our profession.” Every funeral service professional is vital in the effort to strengthen the business environment of funeral service in Minnesota. MFDA membership is more important than ever before as a means to protect not only your license as a professional, but the public’s health and wellbeing when experiencing a death among their family and friends. Moving forward and aiming high....

This site is a fully integrated website and AMS (Association Management Software) system. It will be interactive and include such features as blogs and group listserves. Getting a little tattered? We have decided to go ahead with a new version and look forward to both a print and online directory. Members only will be included.

Our leadership is increasingly critical in advancing initiatives at the State Capitol and we are already laying the groundwork for the 2015 legislative agenda. The grassroots efforts shown by funeral directors in the past few months have shown that we do have strength in numbers. Thank you for calling your representatives and expressing your opinion on HF 188, requiring funeral homes to post price lists on websites. As indicated in Mike’s article this issue has not found support at the Capitol to date and it is because of your due diligence. Thank you! As non-funeral related organizations continue to undermine the need for regulation in our industry it is licensed professionals, such as yourself, in partnership with MFDA, that must stress the importance of the funeral in our changing society. Remember, MFDA is, and will continue to be an ADVOCATE FOR YOUR SUCCESS as a funeral service professional. I strongly urge you to consider joining your fellow professionals as an MFDA member. Again, there is truly strength in numbers!

NFDA Advocacy Conference Spring is here and things are starting to get more active with MFDA. In March, Roger Bengston, Ashley Hoff, Shawn Kirby, Leif Larsen and I represented Minnesota at the NFDA Advocacy Summit in Washington, DC. While there we visited with each congressional office of Minnesota’s delegation, carrying the message that there is current legislation requiring the FTC to expand the Funeral Rule to cover all providers of funeral goods or services (current ruling is goods and services). Our reception was welcomed and we were able to speak with several congresspersons and a senator themselves, and always with the aide which covers our issues. As a side-note, I traveled to DC a day early and got snow bound there. If you think we slow down for snow, you should see the DC area - it shuts down! The federal government closed, schools closed for several days public transportation shut down, all for about 3 - 4 inches of snow. In fact almost all businesses shut down - we couldn’t even find a restaurant open! Metro Mass Fatality Workshop On the 20th of March Darlyne Erickson and I represented MFDA at a Mass Casualty Seminar for the metro area, which brought together the many entities that will/may be involved in a major mass casualty event. It was very informative and encouraging to see the levels of preparation of the many agencies. In the near future we, along with the Health Department, will be trying to put together and upgrade our professions resources and willing volunteers to be better prepared in the future for an event we hope will never happen. Legislative Issues • We have worked with the Health Department to put together legislation to address the prep room issue, which was the basis for last year’s law suit. We have been supporting this legislation and as part of a larger Departmental omnibus bill, it is moving along without a lot of controversy. The other issue we have been dealing with is a bill to require any funeral home with a web-site to place their GPL on that site. Your board decided to fight this legislation, maintaining that it is a personal business decision if you should want to. Just as the FTC requires that you have personal contact, either in person or by telephone, we believe you should have the opportunity to discuss or explain charges if you wish. There is no other profession that has this requirement. We would have to consider doing this if the medical profession would have to do the same! Thank you to all of you who responded to the call to contact legislators. It made a difference. It is

extremely important to be pro-active in this manner. We are the authorities on the subject in our areas, and they respect our opinion. In the future, if a request is made to you, please make the contact. • The Health Department is planning to do an overhaul of 149A next year. In the meantime, they have put together a task force of interested parties to discuss the topics and come to agreement on language and content so battles don’t have to happen in the Legislature. Our representatives are Roger Bengston, Mike Kosloski, Morrie Nilsen, Corey Michaelson and myself. If you have any suggestions of issues to be addressed, changed, added, etc., please contact one of us. We will be meeting every other month throughout the rest of this year. Children’s Grief Connection One of the great resources we have in funeral service is the Children’s Grief Connection and Hearts of Hope Camp. Starting this group was the best thing we, as a profession, have done for funeral service, giving back to those we serve and showing we care. However, we are failing this organization! While our financial support has dropped and they have had to resort to other funding sources, the real failure is in spreading the word and encouraging our families to attend. It is a Grade #1 experience for both grieving children and their families ( it is a simultaneous side-by side camping experience). However, they struggle with the lack of numbers, with a decreasing number resulting from funeral home contacts. It’s hard to believe that Continued on page 7 www.mnfuneral.org 5

over a six month period that there are only a dozen families that would benefit from this experience! We’ve all had families that have had children involved - either for parents, grandparents or siblings. It doesn’t cost them (or you) anything for the experience, and it would benefit them enormously and benefit you greatly for the PR that it would generate for your firm. Spread the word, get some brochures and offer encouragement to those you serve. Your families deserve the best care you can provide, and this does just that! The Convention is Soon Upon Us Please look over the schedule and plan to attend. There is something of value for everybody. If you haven’t heard Thomas Lynch speak, he is worth the price of admission alone. He is a noted author, has done award-winning television specials and speaks eloquently about the profession he loves. He has recently finished a book with Dr. Thomas Long entitled “The Good Funeral”, which is a dialogue between a clergy person and a funeral director about what a funeral is and should be. If you haven’t read it, you should. It’s thought-provoking. I’m sure he will have copies available with him at the convention as well. Glenda Stansbury will be speaking to us about the use of celebrants for funerals. She is the workpartner with Doug Manning, a clergy person who has written many after-care and pre-need items for funeral service and developed Celebrant Training. We are also thrilled that Jerry Kill will speak. He is the football coach at the University of Minnesota, whose career has been affected by Epilepsy. He is a very sought after speaker, very entertaining, and extremely inspirational. You won’t want to miss his presentation and hear his story. We also have quite a number of break-out presentations on a variety of topics. I know you can find something that will be helpful to you as you go forward in our profession. There are fun things planned as well. We are again planning a boat trip on the river. Last years trip at Treasure Island was thoroughly enjoyed by everyone. This year we will be on the river in the metro area and close to the convention site. Put on your “river legs” and come and warm up for the convention with us. Please also plan to attend Tuesday evening’s event

at the convention. Dueling Guitars is a great event for all ages, with participation and great music, along with food and libations. It will be an event you won’t want to miss. There are also many exhibitors participating in the convention. Please visit the exhibit floor, visit their booths and thank them for being part of our convention. Without them, our convention would not happen!

I was flattered and honored to attend the NFDA Advocacy Trip in early March, representing MFDA. It was interesting to watch our government work. I also want to thank Roger Bengstem, Mike Dahl and Leif Larson for leading the way. They have all done this before and were very seasoned with their presentations in the Capitol. We spent a lot of time explaining the F.T.C. Funeral Rule to law makers. I think most of them were in agreement that there needs to be an equal compliance to not only funeral homes but cemeteries, crematorium and merchandosers.

As Spring peeks around the corner, enjoy it’s vibrancy and new growth. That’s why we have the convention in the Spring - to energize us in our profession and encourage us to new growth. Let’s grow together! See you there!

Mercury Emission Research At the beginning of the year if you had asked members of the MFDA Legislative Committee what legislative issue would arise in 2014 for funeral service it would have been lowering mercury emissions as they relate to cremation. As you know this issue did not reappear this year. However, as reported in the December Bulletin, a stakeholder group was created to research and quantify mercury emission resulting from the cremation of dental amalgam in Minnesota. Funding was provided by a grant from the Minnesota Pollution Control Agency. The first goal of this project is to estimate the quantity of surfaces of mercury-containing dental amalgam restorations in the teeth of Minnesotans who were born between the years of 1934 and 1950. Two students with background in dentistry plus a statistician have been hired to work on the project under the direction of the research partners from the University of MN, School of Dentistry, Program of Mortuary Science and Anatomy Bequest

Program and the MN Pollution Control Agency. Quarterly updates have been opened to others interested in the topic. If interested, contact Dr. Sandra Myers at myers025@umn.edu Project Update as of March 28, 2014 Dr. Sandra Myers reported the project has progressed as planned over the last few months. The two students hired for this project have charted 200 subjects documenting their findings within the axiUm database. Results to date: The Students found that within the 216 subjects charted they contained 1196 crowns. The University suggests that we amend the contract to include charting crowns. A review of Allison’s Zank’s project and data as well as trade journals determined that the weight of mercury amalgam underneath the crown is unknown. The University suggests that we amend the contract to include work to determine the weight of mercury amalgam within the tooth underneath the crown. After reviewing potential methods, Dr. Myers and the students propose to use a weak acid to decalcify extracted molars with crowns collected from patients of the University Dental School to separate the crown and restorations from the tooth. They will evaluate the procedures and materials used when placing those crowns, and calculate the average weight of mercury amalgam and the maximum weight of mercury amalgam in these teeth. The group discussed the addition of the crown work to the contract and decided due to the large number of crowns found (average of 5 per person) that the project would be incomplete without this additional data. Questions developed about the unexpected high incidence of the presence of crowns, first in terms of accurately estimating the amount of mercury, and then in potential future regulatory requirements. Successful restorations with crowns are not likely distinguishable by the funeral industry because they look like normal, healthy teeth. This led to some discussion about what this means in terms of controlling the presence of mercury amalgam. How will the MPCA use the outcome of this study? The MPCA answered that this information will be used to estimate emissions, but other factors have to be included to develop a trend line of emissions. Further discussions will be needed with stakeholders from cremation, air quality control and other related industries. The MPCA is not currently aware of control equipment adapted for crematories in the United States. The next meeting will be held in June.

Despite the political, sociological, religious and nationalistic diversity of the world’s ethnicities, one common denominator will always prevail. Since the beginning of recorded time, it is irrefutably the human need to “honor the dead.” The traditions, ceremonies, procedures and processes of paying homage to those who have died vary from Siberia to Sudan, Australia to Angola and from Poland to Portugal ad infinitum, but one driving, inexorable element is universal. It is simply the need to mourn while celebrating the life that has been lived with love, generosity and dignity. Therefore, herewith is a brief synopsis of one of the world’s many Funeral Practices.

LAOS: The Hmong Culture Hmong Culture – The Hmong people originated in China centuries ago and today they are considered Laotian even though the majority still live in China, Laos and the United States. Hmong Culture consists primarily of three (3) religious sects; Shamanism, Christianity, and Buddhism. Recently I was privileged to attend a Hmong funeral and was mesmerized by the love, compassion, respect and spiritual aura that radiated among the family and friends of the deceased. The Funeral – Traditionally, the Hmong people who live in the United Sates schedule their funerals on weekends. For three (3) days this past weekend, at least 1,500 people from the Hmong community came to pay their respects and for over 72 hours many people stayed, prayed, donated money to the family and provided

food, beverages and resting facilities for those who chose to remain for the three days of the ceremony. A Hmong funeral is the classic portrait of human kindness, love and a spectacular event replete with music, prayers, singing, chanting, gorgeous, colorful clothing and sharing in the life and times of the one beloved. Rituals and Accouterments – Cremation among the Hmong culture is rare. Embalming and earth burial with casket and burial vault is most common. The funeral to which I refer was a Shamanistic ceremony where more than one Deity is worshiped and propitiated. A type of indigenous wood casket from the cypress tree called “Hinoki” has spiritual significance for the Hmong and is most frequently provided for the interment. Among the myriad rites, rituals and ceremonies of the Hmong Funeral, a potpourri of musical instruments is prevalent. Drums, bells, recorders and a four-foot long bamboo reed flute called a “kjeet” provided spiritual music throughout the entirety of the funeral ceremony. Goodbyes –The Elmhurst Cemetery graveside service was a moving and solemn event with songs, sermons and mourners standing in line to gently and lovingly touch and caress the face of the one beloved. In the cold and windy rain, the service lasted for over one hour. Such is the quintessentially memorable funeral of a proud and traditional people.

At the end of 2012 Doug and Glenda had conducted almost 90 Celebrant trainings for over 1800 participants. Thomas Lynch, Author, Poet and Funeral Director Thomas Lynch is a funeral director and the author of several books of essays, poems, and short stories. His book The Undertaking: Life Studies from the Dismal Trade won an American Book Award and was a finalist for the National Book Award. His work has been the subject of two documentary films, including the Emmy Award-winning The Undertaking (PBS Frontline, 2007). He recently co-authored the Good Funeral with Thomas G. Long.

Jerry Kill was named head coach of the University of Minnesota football program on December 7, 2010. He completed his 20th year of being a head college football coach in 2013 and his overall collegiate head coaching record is 144-94. Kill’s rebuilding of the Minnesota program is also taking place in the classroom. The Gophers recorded a 994 Academic Progress Rate (APR) for the 2011-12 season, the first under Kill’s leadership. The 994 score is the highest single-season score that the Minnesota football team has ever recorded and only 10 teams have tied or beaten a score of 994 since the NCAA has made single-season scores available. Kill came to Minnesota after spending three seasons on the sidelines at NIU. Kill led the Huskies to three consecutive bowl games during his tenure and also coached NIU to a berth the MidAmerican Conference Championship game in 2010. Kill was 23-16 in his three seasons with the Huskies. We look forward to having Coach Kill as one our keynote speakers during the 124th Annual Convention.

On Funeral Service, Life...And Kevin Costner By Justin P. Zabor, CFSP

Have you ever met someone famous? I have. And no matter what you think of his acting, either positive (think Field of Dreams) or negative (think Waterworld), my experience with Kevin Costner was great! An encounter with stardom taught me at least three valuable lessons about how to be a success in the funeral business and in life that I would like to share with you today; 1) Take Chances 2) Overcome Your Fears 3) Hit Your Mark. I’ll get into all 3 of these in just a little bit. But first a little background… For the record, I am a third-generation funeral director and professional speaker but I’m also an actor as well. Right now you might be thinking, “So what you’re saying, Justin, is that you’re a jack of all trades but a master of none”. And that may be true! I have been practicing the arts of all three for over a dozen years. As an actor, I can tell you that I have appeared in films, TV commercials, print media, and radio voice-over spots that you probably have never heard or seen. Trust me, most of them you probably never want to hear or see! But by far my highest profile gig to date will be the upcoming film “Draft Day” starring Kevin Costner (released April 11, 2014) and directed by Ivan Reitman (Ghostbusters). The movie stars Costner as Sonny Weaver, General Manager of the Cleveland Browns and is the fictional story of how one team navigates the tricky inner workings of the NFL Draft. “Draft Day” is like the “Major League” of football movies. It was a dream come true for someone like me who grew up in Cleveland as a lifelong Browns fan. Here was a big time Hollywood picture shooting in my city and I had a chance to appear in it. I play a Cleveland Browns scout who works in the “War Room” on the day of the NFL Draft. I’m going to check my ego at the door right now. Truth be told, I am only an extra in the film and don’t even utter a single line. However, that didn’t prevent me from interacting with Costner who is one of Hollywood’s best and longest running talents. On a movie set, there is an unwritten rule that extras are not supposed to talk to principle actors while working. So for the 9 days I was on set acting out the War Room scenes I debated in my head what I would say to Kevin Costner if I got the chance after filming wrapped. All I wanted was a picture of the two of us on my phone to prove to family and friends that I met

someone famous. I was working but yet had a front row seat to watch one of the finest actors of his generation perform scenes day after day. On the last day of filming I finally got my chance. Our directions in the scene were to show our disapproval for a draft pick that Costner’s character had made behind our backs. He was to say nothing and just walk out of the door while the rest of us sneered, jeered, and yelled at him. I was the last staffer he walked past on his way out. After a few takes of the scene and once the director yelled “cut” I decided to say something. So I mustered up the courage to speak to Kevin Costner because I may never have this opportunity again. I said trying to be as cool and casual as possible, “This must do wonders for your self-confidence, huh?” He chuckled which was exactly the reaction I was going for! Hollywood directors shoot as many angles of scenes as they can from 360 degrees around the room to have as many “takes” as possible. A few shots later on another angle the camera shows Costner walking past me out the door as my character glares at him and he says to me kiddingly off screen, “Don’t get any ideas or else you’ll hear from my lawyer!” I quipped back, “Don’t worry Kevin, I already figured you’re probably pretty lawyer-ed up”. Again he laughed. I was bantering with Kevin Costner! On the last take of the scene I am supposed to walk into the frame and stand on a “mark” – a piece of colorful duct tape on the floor. Costner sees me eye my mark before I start walking. So after the director yells “cut” Costner says to me, “You know that you don’t have to look down at your mark? Come here”. He says and motions me over to him. Remember that he is not only a fine actor but an Oscar-winning director as well (Dances with Wolves). With an actor’s heart and a director’s head he says to me as he acts it out, “Look, you can feel the mark on the floor as you step over it. Try it”, Costner says to me and I do exactly as he instructed. He was exactly right. You can “feel your mark” as you step over it. Here was a Hollywood star teaching another actor his tricks of the trade learned over a long career. He wasn’t speaking loudly so that others could hear as if to say, “Look at me telling this lowly extra what to do”. There were dozens of other people in the room yet he made me feel like it was just him and I. Simply one actor giving


a bit of helpful advice to another. So that’s my Kevin Costner story.

Right now you might be thinking, “It’s a nice story, Justin, but what does it have to do with achieving success in the funeral profession or in life?” That’s a great question, and here is the answer. I learned three things from acting in a movie with Kevin Costner and they are 1) Take chances 2) Overcome Your Fears 3) Hit Your Mark. Here are a few of the ways that you can apply these concepts.

First, by talking to Costner I took a risk. That risk paid off and I have the story to prove it. I could have listened to the unwritten rule that said extras were not supposed to talk to principal actors and for eight days I did. It was only on the last day that I took the chance. Lucky for me I had nine days and several dozen takes to do it. Sometimes in life and business we have only one chance. What risk have you been thinking of taking in your funeral business? What should you capitalize on in your personal life before it’s too late? Do it right now and don’t wait otherwise you might regret it. I would have always been upset with myself had I not talked to Kevin Costner. Secondly, you need to overcome your fears. I was afraid of speaking up at first. It could have been a disaster! Instead of laughing at my initial comment Costner could have glared at me as if to say, “Shut up kid! I’m working” and that would have been the end it. Luckily for me he did not. I overcame my fears, bent the rules a little bit and it paid off. Sometimes in business and life we need to just do that; assess the situation, overcome your fears, and take a risk. Lastly, know how to “hit your mark”. Knowing how to hit a mark assumes that there is a mark in the first place. Without setting a goal or evaluating a situation we have no framework in which to operate. Without knowing where the bar is set how can we measure our success? If we set goals, develop a plan, and then execute that plan we are already reading ahead in the script. Sometimes that is all you need to achieve success. And sometimes it is more complicated than that. Until you execute a plan you won’t know if you have hit your mark. The key is to take that first step, feel your mark and try. In funeral service, just as in life, we are already in the movie. There are stars, principal actors, extras, and many more cast and crew working behind the scenes. Your job is to learn from the best in the business and strive to constantly improve. By taking chances and overcoming your fears you can learn to feel for your mark and hit it with ease. Sometimes success just means seizing your moment in the spotlight!

NFDA and AATB Share Updated Best Practices for Cooperation Between Tissue Banks and Funeral Homes Brookfield, Wis. – The National Funeral Directors Association (NFDA) and the American Association of Tissue Banks (AATB) have released updated guidelines to help donation professionals and funeral directors better work together to serve families who wish donate the tissues or organs of a loved one who has died. More than 10 years ago, representatives from NFDA and the AATB reached a historic agreement on a set of best practices involving organ and tissue donation. Previously, there was a lack of communication and understanding of different roles and responsibilities between and among funeral service and donation professionals. The best practices document helped clarify roles and responsibilities and helped both professions better serve families. “The original best set of best practices that AATB and NFDA developed served our respective members well,” said Frank Wilton, CEO of AATB. “However, after more than 10 years, it was time to revisit the document so that we could explore how each association could further educate its respective members and better serve donor families. We are proud to share these new guidelines with our members and encourage them to work cooperatively with funeral professionals in their community.” The new document, Best Practices for Cooperation Among Tissue Banks and Funeral Service Professionals, contains important changes that will help improve the working relationship between donation professionals and funeral directors. The updated best practices document places a very strong emphasis on communication between donation professionals, families and funeral directors. First, communication between the recovery agency and the donor family is crucial. Donation professionals should ensure families understand the donation and recovery process and the impact it may have on the body, especially if they wish to have a viewing or open-casket funeral. The family must also understand the timing of the recovery so that they can work with the funeral director to schedule a funeral. Second, the recovery agency and the funeral director serving the donor family should establish an agreed-upon method and schedule for communicating. Regular communication will help ensure a successful recovery and enable the funeral director to help the family plan a meaningful funeral or memorial service. The updates also place a special emphasis on the recovery agency’s need to respect and accommodate the donor family’s religious or ethnic funeral practices and customs. In some cases, the recovery process may impact those customs. Funeral directors can help staff at the recovery agency understand the family’s needs.

Finally, the best practices document offers guidelines regarding how funeral directors can effectively and efficiently seek reimbursement from tissue banks when post-donation embalming requires additional time or materials. Ethically, funeral directors should not charge families more for embalming or other preparation of the body of the decedent because of the family’s decision to donate their loved one’s organs or tissues. “For some families, donating a loved one’s tissues or organs helps them heal and find something positive in the midst of their grief,” said NFDA President Robert L. “Robby” Bates, CFSP, CCO. “We encourage our members to do all that they can to work with local recovery agencies to support a family’s decision to donate. The updated best practices document will serve as an important tool in forming stronger relationships with donation professionals.” The updated Best Practices for Cooperation Among Tissue Banks and Funeral Service Professionals document can be found on both the NFDA (www.nfda.org) and AATB websites (www.aatb.org). IN MEMORIAM Phyllis R. Johansen was born March 29, 1923 to Anders and Anna (Rix) Utoft in Tyler, Minnesota. She was baptized and confirmed at Danebod Lutheran Church in Tyler. She attended school in Tyler and graduated from Tyler High School. After graduation she moved to Washington State, where she met Marlowe Johansen. On April 28, 1944 the couple was married. Their union was blessed with two children—Douglas and Linda—and 61 years of life together. The couple lived in Minneapolis while Marlowe received his mortuary science education. In 1951, Anders Utoft invited them to return to Tyler to join the work of the UtoftJohansen Furniture Store and Funeral Home. After Anders retired in 1960, Marlowe and Phyllis owned and operated the businesses, which they sold in 1980 when they retired. They moved to Danebod Village in 2003. Marlowe passed away December 9, 2005. Phyllis entered Tyler Healthcare Center on Tuesday, March 4, where she died on Wednesday, March 12, 2014, at the age of 90, seventeen days before her 91st birthday. Phyllis was a member of Danebod Lutheran Church, where she was active in the Ladies Aid. She enjoyed golf, cooking, bowling, tennis, and bridge, and especially time spent with her family and grandchildren. Phyllis is lovingly remember by her children, Douglas (and Julie) Johansen of Overland Park, Kansas, and Linda Watson of Chanhassen, Minnesota; two grandchildren, Nycole (and Chris) Nibbe of Lake Benton, Minnesota, and Caroline (and Kirk) Vandaveer of Overland Park, Kansas; three greatgrandchildren, Samuel, Braden, and Sydney Nibbe; a sister, Joan (and Robert) Gilmore of Bloomington, Minnesota; a brother, Charles (and Gladys) Utoft of Victoria, Minnesota; and many other relatives and friends. She was preceded in death by her husband, Marlowe; her parents; and two sisters, Katherine Jorgensen and Helen Skov.
