Protect Your Business from Credit Card Processing Scams By Steven Foster, Three Rivers Consulting

All too often during business hours the phone rings and time is lost on a salesperson that has nothing you need at that busy moment. It’s possibly a wasted minute or two. Their goals are relatively easy to assess as soon as you answer the phone. You politely “let them go”. Professional scams on the other hand, or “slamming”, are far more insidious and can result in large losses for your business on several fronts. The slammers know what they are doing; they understand the boundaries of human trust and rely on your sincerity and good will. Scam calls, often from “merchant services”, can result in a merchant providing secure information to someone who is impersonating the service or support department of a reputable merchant services provider. The scammer convinces the merchant to execute fraudulent agreements for billable merchant related services that were neither needed nor wanted.

Always ask the caller who they work for. A caller saying they “represent” Visa, MasterCard, or “your bank” is not enough. Ask what company they work for. Scammers are evasive. A reputable company will be very forthcoming with that information. Never give your account information to someone because “your account has been locked”, or because you need to “update your account information”. That is likely a Scammer. If you believe there is an issue, call your processor directly.

Never sign a document to get a price quote on credit card processing. To get a quote from TRC, you will have to provide your contact information, and statements from your current credit card processor. Only Scammers will ask your to sign something for just a quote. Never sign a document without reading it thoroughly. Scammers will encourage you to sign documents for quotes, or updating account information. But in reality those documents they are asking you to sign are likely leases for equipment you don’t need, and agreements for high-priced, low-quality services that you don’t want.

NEW CONSTRUCTION: The End of the Three-Story Walk-Up is Near By Joe Passkiewicz

Death Notice Alright, I’m calling it. The winds of change are blowing again and there is a shift occurring in the new construction apartment market. We are seeing the gradual sun setting on the stick built three story walk up apartments. They are fading away much like the two story walks up died in the mid 90s. The three story walk up is on its deathbed! Giving way to four and five story wood framed behemoths; we are just not seeing many three story walk ups in the pipeline. There has been a shift in the market that has made our old standby less desirable. This shift is based on a number of conditions that are occurring in multi-family development. These conditions are centered on the typical development balance of costs and rents as well as municipal requirements and market demands. “The key to today’s development cycle is density,” said David McDaniel, Principal of Integra Land Company, a Lake Mary, Fla. based development company. “Sellers are requiring it in order to maximize the price of the land and municipalities are requiring it from a zoning and entitlement standpoint.” The density requirements have flip flopped in some cases from municipalities mandating open space and less density to now requiring a minimum number of units per acre. These requirements, as well as the numbers, have forced developers to go higher and bigger to achieve the density requirements. The market demands are also changing. With the four story threshold you are required by building code to provide an elevator and the rental market likes the elevator- think carrying a sleeping four year old up three flights of stairs! In addition to the elevator, the four and five story products provide a greater sense of community. “Some of the things we are seeing in these new higher density projects are well finished and furnished amenity functions that provide social connectivity to the resident”, said Gary F. Brock, AIA, Principal of

Charlan Brock & Associates, a Maitland, Fla. based design firm. “The courtyards and pool area have well designed hardscape elements that provide a high level of connectivity for entertainment. The Millennials want an environment that has more of a resort hotel feel both in amenities, concierge services and the treatment of hallways and lobbies, like an upscale hotel.” These features come with an added construction cost that must be supported in development model through the combination of increased density and a favorable rent structure. Like any good thing, these larger buildings come with issues. We loved the three story walk up as it was predictable and scalable. The design lends itself to our typical production process. We completely understand the code requirements. The design was like a warm blanket for the entire development team. However, it’s a new day and these four and five story buildings have significant challenges. Here are a few of the notable items:

Code Requirements The complexities of the structures are an issue. Life safety, structural requirements, MEP issues, fire separations and fire protection systems all come into play. With four stories you are required to provide elevators and with five stories the requirements expand to fire treated lumber and NFPA 13 fire systems (fully sprinkled buildings including truss spaces and attic areas). When the design requires that you tuck the leasing and amenities under the resident buildings you create significant fire separation issues due to the mix of Continued on page 18

Technology also has transformed workplace environments, from cramped downtown cubicles to home offices. A Gallup poll in 2013 found that on average workers were more productive working from home. In 2014, Harvard Business Review reported that those who worked from home were not only more productive but happier and less likely to quit their jobs, much to the benefit of employers.

Multifamily housing employees want more training. At least that’s what a recent Pew Research Center survey about the American workforce and changing job market suggests. The U.S. employment landscape has morphed from hands-on tools to fingers on keyboards. Over the last 35 years, workers are rethinking the skills they have and what they will need to compete. Some 54 percent of adults in the labor force believe they will need to get training and develop new skills throughout their work life just to keep up. About a third of workers say they don’t have the education and training they need to get ahead, and many are trying to do something about it. Nearly half of adults are already trying to either bone up for new jobs or to stay on pace where they currently work. Many are doing so on their own accord.

Workers need to be prepared in changing work environment. As with many industries, rapidly changing technology has altered the multifamily housing workplace and culture. The days of manually accepting rent payments and exercising leases, for example, have gone from pen and paper to computer and mobile technology. Establishing rent rates based on what competitors are doing have gotten far more sophisticated, and maintenance technicians are now armed with tablets and mobile devices in addition to hammers and power tools to do their jobs.

But working away from traditional offices is one reason why some industry leaders believe that additional training is essential. “With the number of people who are working remotely now, they are not as connected face-to-face with people as they used to be,” says Doug Bibby, National Multifamily Housing Council President. “I think that really calls for making sure that people are prepared to do their jobs, particularly when they are working remotely, and even in the team environment.”

‘There is a lot of catch-up work to be done right now’ According to Pew, employment has been rising faster in occupations requiring more preparation. Last year, about 83 million people worked in jobs that require an average or above average level of preparation – education, experience, and job training. That’s 68 percent more than the number in 1980. Bibby says training expenses often can be a casualty during budgeting, especially during tough economic times. Since the recession, technology has played a greater role in apartment management but empowering employees to keep pace with it has been lacking. “What I’m hearing is people have been backing away,” he said. “During the recession and coming out of the recession training was not emphasized. I think there is a lot of catch-up work to be done right now.”


On-site personnel need training to maintain technology’s pace Veteran industry consultant Anne Sadovsky, who has worked in multifamily for 48 years, knows first-hand how the apartment industry has grown. “It’s getting so different compared to back in the day, in the 70s when I was on-site,” said Sadovsky, “It was sort of like you tried to be nice, hand out keys and take checks. And everything was on the peg board. You did everything by hand.” Today, on-site personnel are managing units and handling resident requests online, and in some cases, on various platforms that require knowledge of new or advanced work-flows. While many on-site positions don’t require a college degree, employees need up-todate skill sets to negotiate technology not only for today but as it changes. “For multifamily, as fast as the pace of technology is changing, that really calls for people to be as prepared as they can be,” Bibby said. “Many of our NMHC members have multiple platforms. They’re using a variety of suppliers, who may not always talk effectively and efficiently to each other. That’s another area where training is important.”

Aging out of maintenance techs may present industry a problem Sadovsky fears that unless apartment leaders address a changing of the guard among maintenance technicians that the multifamily industry is could stumble on the service side. She is concerned that as older maintenance techs age out there won’t be enough younger workers to take their place.

“I’m predicting there will be a huge, huge lacking of service techs and our industry will be hurting because of that,” she said. “It’s hard to find anybody decent now. Can you imagine as the Baby Boomers continue aging out, it’s hard to find young people who want to do that kind of thing. A thermostat can’t be replaced by a computer.” According to the Bureau of Labor Statistics, the median age of general maintenance and repair workers in the U.S. − not specific to the multifamily housing − has actually gotten younger, from 48.4 in 2011 to 47.6 in 2015. Also, more workers ages 20-24 and 25-34 have maintenance and repair occupations than four years ago. However, six percent fewer workers ages 35-44 and 45-54 combined are in the occupation since 2011, suggesting that there are less experienced workers in the trade. Also, building and grounds cleaning maintenance occupations are getting older. In 2011, the median age of workers was 43.8; last year is was 44.4.

Training starts with employers And while U.S. workers say they should bear the responsibility of getting trained, Sadovsky says the onus should be on employers to ensure that their workforce can do the job, especially when it comes to people skills. “When you’re in housing and work where people live, you have to have more training in soft skills,” she said. “You can have all the technology in the world, but it’s about when the rubber hits the road and you’re face-to-face or at least ear to ear on the phone with a customer.” Tim Blackwell is a long-time publishing and printing executive in the Dallas/Fort Worth area who writes about the multifamily housing and transportation industries. uses. In less urban markets may be required to educate the local building code reviewers. All of these items combine for a much more complex design that requires additional expertise and coordination to achieve a successful project.

Scale This goes without saying- these buildings are big and tall! There are significant issues with access and logistics. Sequencing the work shifts to division by floors and sections instead of individual buildings. At five stories, typical lulls (articulated forklifts) will not reach which may require crane service in order to stock materials in the buildings. Loading materials and construction logistics must be considered upfront or you may box yourself in and struggle to access the building for the remainder of the construction process.

Building Turnover The size of the buildings dramatically affects the turnover process. “Sequencing the turnover of units is a big challenge”, says Brock. “Working with the local building departments to coordinate turning over the club and units in phases for efficient leasing and move-ins requires a lot of up front coordination.” Local building departments that are still recovering from the recession are often under manned. The inspection process can be a real schedule nightmare. Many development teams are opting for costly private inspections where allowed by the municipality. Power utilities are also an issue. In order to have electrical meters set, you will need the electrical inspections completed. If provisions are not made in the design, you may need the entire building cleared before you can get meters set and energize the units. These issues have significantly lengthened the delivery schedule beyond the typical durations.

Podiums and Structured Parking With the density, podiums and structured parking are becoming more common. Adding these concrete elements in combination with a wood structure requires close attention to details. A failure to completely understand the interface between the materials and sequencing requirements can lead to real problems. Podiums provide a great location for a mixed use element which continues to be the darling of the local planning commission. Although structured parking is a costly element it is often a necessity to achieve the required parking calculations. These giant buildings are becoming the new construction multi-family norm and are now finding their way to more suburban locations. Consistent with the density trend is the changing expectations of the renter. “The Millennial renters want to be closer to or in the urban areas that are walkable with connectivity to the urban lifestyle”, added Brock. “They (larger buildings) help to accomplish many of the goals required in the current multi-family environment.” So where are we going next? I can only guess that the trend will continue and push design bigger and taller. Building designs with a more urban feel. Three story walk up- we will miss you! You were great for so many years. LEGAL OR NOT?

I just became the community manager last month. I noticed that we have several apartments with more people living in the apartments than are on the lease. Apparently, the previous manager was completely uninformed or simply was not concerned about this problem, as long as the rent was paid on the first of each month. I spoke to the residents, and several came in with their unauthorized occupants who successfully completed applications and will be added to the leases. My continuing source of stress is with three apartment homes that are ignoring my requests for applications for the unauthorized occupants. Am I out of options, or can I take action?

You face a huge hurdle in trying to eliminate these unauthorized occupancies. The prior manager may have “authorized” them, and your property is bound by the action, or in this case inaction, of the prior manager. If an unauthorized occupant has been residing in an apartment, and it has been known to the landlord or the landlord’s agents, and the rent has been accepted for months, the landlord has probably waived this lease noncompliance. The landlord may be prohibited from evicting the resident if waiver is present. One possible solution may be to non-renew the uncooperative residents. On the other hand, perhaps the uncooperative residents may have misled the prior manager about the unauthorized occupants, if they indicated that they had moved or were only visiting or would be leaving. In that scenario, the prior manager may not have waived anything if she acted reasonably in relying on the residents’ representations and regularly inspected those units. You should check with the community staff to see if there is any reason to believe the prior manager was misled, but also keep in mind that you may have significant proof problems with an attempted eviction case if the prior manager is unavailable to testify.

Our apartment community received code violation letters earlier this week from the fire marshal due to a few of our residents storing gas and charcoal grills on the patios. This is a complete violation of the county fire code. Two months ago we had a fire which destroyed the management office building. Now we have continuous inspections by the fire marshal. We have sent numerous letters and emails to the residents in question and posted letters on their doors advising them that the grills must be removed immediately, but most of these residents have failed to respond to our emails and likely placed the letters in the garbage. We have received $5800 in fines, and that amount continues to grow. The fire marshal is threatening larger fines if we do not comply with the fire code. How can we forcefully require the residents to remove the grills? May we tell these residents that they will be evicted if they do not cure these lease violations?

Charles Marshall Humorous Motivational Speaker Some people love the idea of making New Year’s resolutions and some people, well, not so much. Personally, I think it’s a great opportunity to plant a flag in time and start moving in a new or different direction. So, I am offering the following five simple resolutions that I hope challenge and inspire you to be your best in the coming year.

Stop talking negatively. My mom used to say, “If you don’t have something positive to say, don’t say anything at all.“ That means resisting the urge to criticize policies or processes at work. It means curtailing the desire to pile on and chime in on Facebook. It means not participating in office gossip. I promise you that if you resist the urge to make a negative comment, the people in your life won’t miss it. It takes no talent to point out what’s wrong in the world. Why not be the one person who points out what people are doing right? Stop engaging in entitlement thinking. If any part of you is interested in growing this year, you need to understand that the world doesn’t owe you anything other than what you have earned. The biggest harm of entitlement thinking is that it robs you of the feeling that real achievement brings. People who spend their lives waiting for others to do for them wind up missing the adventure of exploring their potential. Why would anyone try to grow and explore their potential if a trophy is going to be handed to them regardless of their effort? No, in order to reach your potential, you have to abandon any thought of anyone handing you anything that you haven’t won yourself. Engage discomfort. From the time that we are born, our basic needs condition us to seek comfort. Babies cry whenever they are hungry, messy, or lonely. It is our nature. But as we grow, we are forced to confront or ignore discomfort in order to reach the next stage in life--walking, talking, reading, working, or building relationships. Without exception, all growth necessitates discomfort. Just about

everything worthwhile in life is uncomfortable at first. Force yourself to walk through uncomfortable situations to achieve what you want and become who you would like to be. Read more. Trust me on this. Watching videos all the time is turning your brain into mush. Having images flash in front of you is great for entertainment and information gathering, but if you want to expand your horizons, strengthen your mind, and catapult yourself beyond what and who you are now, you’ve got to read. It doesn’t matter if you don’t see yourself as a big reader or if you don’t particularly enjoy it. If it is uncomfortable for you, that is all the more reason for you to power through it. I recommend taking just five or ten minutes at the beginning or end of each day and reading just a few pages of whatever book you would best enjoy. Dump mediocrity of attitude and effort. The opposite of success is never failure, because failing is a huge part of the growth process. The opposite of success is stagnation--just doing the bare minimum to get by. It’s flying under the radar and keeping your head down. Why aspire to be in the middle of the crowd? Why not pick something and make an effort to be your very best at that one thing? It’s important to remember that success is never one big event but rather the cumulative result of consistent daily action. Instead of making one big effort for the year, try altering your behavior just a bit today, and then do it again tomorrow. And then a year from now, you will be much closer to the person you would like to be.

Is It Right to Re-gift? By Bruce Weinstein, PhD, “The Ethics Guy®

Along with the phrases “low talker,” and “not that there’s anything wrong with that,” Seinfeld introduced the term “re-gifting” into the popular lexicon. However, the practice of giving an unwanted gift to someone else is surely as old as the custom of gift giving. Thus, one may legitimately ask: “Is it ethical to give someone else a present I was given but don’t need or want?” The answer may surprise you: Yes, it is right to re-gift. In fact, we have a duty to do so. Here’s why.

Second, we have a duty to express our thanks to the many people who have aided us throughout the year, or who enrich our lives with the gift of friendship or familial love. If you’re a huge fan of The Andy Griffith Show and you already have the complete series on DVD, re-gifting a duplicate of season three to your friend who also loves the show is just another way of saying, “Thanks for being my friend.” And meaning it.

First, we have an ethical obligation not to be wasteful. You may not have a need for another wool sweater, but there are many people who do. To shove the sweater into the bottom of your drawer and forget about it denies someone else the chance to stay warm. As the gap between the haves and the have-nots grows wider, we have an ever stronger obligation to ensure that others benefit from our blessings. Beyond giving charitably, however, you probably have a friend or colleague who would like the gifts you don’t want or need. Giving them the things you don’t plan to use isn’t just acceptable —it’s the right thing to do.

Rules of Re-gifting There are several caveats to keep in mind before you re-gift: • Do it soon. There is a statute of limitations for re-gifting. If it’s old, dusty, or out of season, you’re out of luck. Next time, give it away right away. • Do it out of town. The person to whom you are re-gifting an article of clothing shouldn’t run the risk of running into the original giver of the gift. The most fundamental ethical principle) of all is Do No Harm, and since hurting someone’s feelings harms that person, it is best to err on the side of caution and avoid the possibility of an unwelcome surprise. • Don’t use it first. This is just basic decency. • Sometimes you shouldn’t re-gift at all. If someone gives you an unwelcome gift but expects to see you using it, the ethical obligations to avoid causing harm and to respect others require you to bite the bullet and go along with it. These situations are unfortunate, since the purpose of giving a gift is to give pleasure to someone else, not to bolster one’s own pride or self-esteem.

Nevertheless, we all have people in our lives with this need, and, if we truly care about them, we should honor this wish, as unpleasant as it may be to wear that bizarre tie or display the cheap plastic cuckoo clock with Erik Estrada’s picture on it—at least when we invite the gift giver over for dinner. You may wonder how it can be justified to practice deception. Unless your friend is the kind of (rare) person who would not be offended to know that she is receiving a re-gift, the practice of passing on an unwelcome present to someone who might want it falls under the category of a “benevolent deception.” “But any kind of deception is wrong!” you might argue. Really? So it was unethical for your parents to tell you about Santa Claus or the tooth fairy? Come on! In ethics, as in all other issues we confront, we have to pick our battles—and this isn’t one of them. Thus, you may re-gift with a cheerful soul and a clear conscience. Of course, sometime this season, you will surely get a re-gift yourself, and you will probably give a present that will get re-gifted, too. Not that there’s anything wrong with that. LEGAL OR NOT?

U Unfortunately, you have made a very common and significant mistake committed by property managers every day in Florida. Your mistake is sending letters and emails to your pr residents instead of serving legal notices. In some cases when you email a resident about re a lease violation, the resident corrects the problem. However, by sending emails or letters instead of a “legal notice”, you are giving the resident a second chance. The real problem in starts when certain residents do not comply with your letter or email. What should you st do when that happens? Can you send a particular resident’s file to your eviction attorney so that an eviction can be filed? No way! An eviction requires a legal notice, such as a Seven-Day Notice to Cure. Letters and emails are not legally sufficient in most cases; you Se must give your Seven-Day Notices and wait seven straight days. Since you did not give m a Seven-Day Notice to Cure to begin with, you are giving these residents an additional opportunity to correct the lease violation that will delay the removal of the grills from the patios. It is crucial when there is a lease violation by one of your residents that you promptly serve the resident with a formal Seven Day Notice to Cure, if the situation in fact involves a curable problem. If the problem is not cured, we recommend that you contact your attorney immediately to see if you are in a position to evict. If your property knew about the unauthorized grills for months, you will also have a major waiver concern.

About 2 months ago, one of our residents ran into the office and announced that he was showering, and then a large piece of bathroom ceiling caved in due to a leak. We immediately composed a work order request. Our maintenance supervisor was able to figure out the source of the leak. Within 24 hours, our staff had cleaned up the apartment home, and the ceiling was fully repaired within 48 hours of the report of the incident. We never heard from the resident about this again until today, when we received a nasty letter from his attorney asking for our insurance information and stating that the resident was injured when the ceiling “fell on his head”. This is ridiculous. Did we handle this issue properly? Do we have to provide the insurance information to his attorney?

This almost certainly will not be the last time you must deal with one of an these fact patterns. You acted correctly by writing up a work order, but made a crucial th error in not meeting with the resident and having him write up a report or request. Your er management company should create an “Incident Report” form for the resident to fill m out, because at the time of the incident, the resident has not had the time to think up a ou fr fraudulent claim or consult an attorney. This report should be utilized whenever there is an un unusual occurrence, damage, theft or loss to a resident’s property, vehicle or any injury a re resident reports. If a resident finds out that your company will not be reimbursing for a loss, th then there is a strong probability that they will inflate or otherwise make a fraudulent claim. We recommend that you have the resident write everything down prior to making statements that could incite the resident, such as telling him that he should have purchased renter’s insurance and that your company is not liable for the loss. The disclosure of the insurance information is required by law when requested by the attorney. Your insurance/risk management department and insurance carrier should also be notified about the resident’s attorney.

Don’t Take a Pass on Passwords

pass By Reid Goldsborough Using good passwords on the Internet is so basic that not doing so is almost funny. Actually, it is funny. For years now, two of the most common passwords that people use, according password management firm SplashData (splashdata.com), are 123456 and password. In its most recent findings, SplashData revealed that other popular passwords in the current top ten, in order, are 12345678, qwerty, 12345, 123456789, football, 1234, 1234567, and baseball. How long do you think it would take a hacker to get into an account “secured” by such a password? According to other studies, additional mistakes people make with passwords are using your name, your pet’s name, your company’s name, your birthdate, the name of a relative, the town you grew up in, or a dictionary word. Some password-cracking programs simply run through all of the words in a particular dictionary. Many banking, credit card, and other sensitive sites these days require you to use longer passwords that include at least one capital letter and one number. But hackers, by breaching even one of the sites you use, may be able to collect data they can use to crack other sites. Eventually, you wind up with a huge credit card bill, your bank account is emptied, or you otherwise have your identity stolen.

The main issue with passwords is balancing security with convenience. This leads to another common mistake, using the same password with all of your sites. This of course isn’t a secure option either since a breach of one site leads to a breach of all. The same is true with user-names. It’s best to use different ones at different sites since your username is half of your user-name-password lock.

Choose security questions whose answers can’t be easily guessed by hackers or found from information publicly available online, such as the city where you went to high school. A recent study by Google of the security questions that people choose and how they answer them indicates it can be relatively easy for a hacker to guess answers. Google found, for example, that a hacker has a 20 percent chance of guessing that an Englishspeaking user loves pizza. Relatively few people do this, but changing your passwords every three months or so also provides extra protection.

Even if you’re not required to, you should use upper and lowercase letters and numbers as well as punctuation marks or symbols in your passwords. The more types of characters you find on your keyboard that you include in a password, the more difficult it will be to crack it. It’s better to use longer rather than shorter passwords. Eight characters should be the minimum, but twelve is even better. According to the security software company Symantec, a password with only eight lowercase letters can be cracked in less than a minute. Even more secure than using a long password is using a “passphrase.” A short sentence, such as “Go forth 4 ever&more,” can be easy to remember, not too difficult to type, and very difficult to crack. One option in remembering passphrases is to make yours a variation of one another, changed in a standard way based on the site you’re connecting to. As just one of many possible examples, you could include the first three letters of the site’s name within the passphrase that are pushed forward three places, so that GOO becomes JRR.

So you don’t have to remember passwords and usernames, a good option is to use a password management program. It goes without saying that this is more secure than writing your passwords on a piece of paper and taping the paper to your computer or pinning it to a bulletin board. A password management program lets you use one password for it and fills in your passwords, automatically and behind the scenes, for sites you visit. Two recommended password managers are Lastpass (www. lastpass.com) and KeePass (www.keepass.info). Some general security programs, such as Norton Security, include automatic password-generating modules. Use fingerprint authentication if it’s available. Passwords are an old technology, coming into existence in the 1960s at MIT. Fingerprint or thumbprint authentication, though not absolutely foolproof either, is more secure. Other security options, though still new, include facial recognition and voice recognition. Whenever it’s available, use dual-factor authentication, sometimes called two-step verification, particularly with financial or other sensitive sites. Dual-factor authentication requires you, when gaining access, to provide along with a password a second piece of information, such as answering a security question or returning a code that’s texted to you.
