Not Again: FTC Notice of Penalty Authority on Product Substantiation

In April, the FTC sent out new penalty offense notices to 670 companies, warning them that failure to substantiate product claims could result in civil penalties of more than $50,000 per violation. For many companies in direct selling, this is the second or third penalty offense notice that they have received in less than two years, having received one regarding earnings claims and/or one regarding endorsements and testimonials, both in October 2021. The latest notice comes on the heels of the FTC updating its Health Claims Guidance in January.
