Social Security Disability Benefits for Adult Children in New York State

In the state of New York if a child under 18 years of age has a disability, that condition need not be taken into consideration when determining if he or she qualifies for Social Security benefits as a dependent. These benefits are almost always terminated at the age of 18, or possibly 19 if the child is still enrolled in school. Definitions and Guidelines For a child to receive disability benefits beyond the age of 18, the disability must have begun before the age of 22 and after 18 years. The


Social Security Administration must also determine if the person has an adult disability as defined by the SSA. This definition, of course is very stringent and the guidelines are firmly adhered to in each case. An child disabled before the age of 22 may be eligible for the parent’s benefits. This child can possibly be a stepchild, a grandchild or a step grandchild depending on circumstances. In addition to the timeliness of the disability, this child must not be married and must be 18 or older. If the child does marry and has been disabled since a child, the benefits are usually terminated. However, there are some instances under which these benefits are protected, such as marriage to another disabled individual. At that time, a Social Security representative must be contacted for determination. Payments If eligible, the payments will be based on the parent’s salary. The child cannot work in any capacity, and must have been unable to work in the past. Of course, this adult child must not have any considerable income. The amount of monthly allowable income in 2016 was $1,130. Any expenses that arise in order for the child to work may be excluded from this total. Some of these services may be public transportation or counseling services. Although this adult child is receiving Supplemental Security Income or Disability benefits, it still may be worth their while to check and see if he or she is eligible for benefits or additional benefits on a parent’s income history. Additional benefits, such as increased income and Medicare benefits, may be accessible. Of course, in order to receive parent’s benefits, the parent would need to have worked and made payments into the Social Security system.


New York If a child is disabled, the determination for Disability benefit will be evaluated under the adult qualification process. The application will then be sent to the Disability Determination Services in the state of New York. These state services determine the benefit eligibility. Social Security does not allow applications for adult child benefits to be submitted online. Applicants must contact Social Security for an appointment.
