Welcome to your July issue... High summer is now upon us, and the warm, dry weather outside has put a welcome smile upon many faces. What’s more, however, is that it has helped to sweeten the bitter pill issued recently by the government, postponing the “final” easing of the Covid restrictions until Monday July 19th.

I

t means that almost seventy weeks will have passed since the initial “You must stay at home” announcement of March 2020! Life must go on … and it will, but whatever “normal” is going to look like or feel like later this month will be anyone’s guess. Social distancing and the masking of faces I suspect won’t be missed, but I hope that the attitudes of looking out much more for others and actually communicating more with other people will be a long-lasting legacy of this awful pandemic.

Everyone is eager for the “return to normality”, but some might say that we’re already there – England’s men are still more than capable of getting hammered at cricket, New Zealand following India’s lead on that front. Rain will most likely disrupt Wimbledon, before Novak Djokovic wins the men’s title again, and on the football field, “normality” could well rest on England’s penalty takers in the Euro 2020 tournament, but then again … Finally, two to take your mind off the footy:

Blue Therapy Available at Tallington Lakes!

I

n this age of being always “switched on”, it’s great to take a moment to unwind and immerse yourself in nature. With the summer sun finally here, finding time to be near, or on, water can rejuvenate and re-energise both the mind and body in a way that only the natural ebb and flow of water can provide.

This meditative state brought on by water, more commonly known as “Blue Mind” or even “Blue Therapy”, is a subject of growing research and recognition, pioneered by marine biologist, Wallace J. Nichols. The added bonus of potential physical activity too will increase these benefits ten-fold as, whilst exercise increases your endorphins (happy hormones), the water reduces your cortisol levels (stress hormones), giving us a moment to reconnect with ourselves and nature after months of lockdown.

Huge Praise for Wright Care at Home My first encounter with Wright Care at Home was when I was facing the discharge from hospital of both of my parents who both had very different care needs but had come to the stage in life where they were no longer able to care for themselves or each other.

W

right Care at Home hadn’t been established long and, to be honest, we were a bit out of our area, but Sammy Wright agreed to visit us and discuss our needs. As I was tasked with trying to provide them with care, this in itself was a huge relief – having someone who was prepared to just come and have a chat was such a delight, but when my parents and I met her, we knew her ethos and that of her business was head and shoulders above any other care company. I consider myself one of luckiest of people when Sammy agreed to put in place a care package for my parents.

It was like a huge weight had been lifted off my shoulders, but that was just the start. What followed was quite simply exceptional. Carers who were passionate about their job, individuals with so much care and concern and a management structure that ensured my parents were central to everything that was provided for them, whilst I was also key to the whole support regime and kept informed of any issues Mum and Dad were having, often things they wouldn’t have shared with me. Wright Care at Home gave me back my independence, following several months of trying to do it myself, and at the same time gave my parents their lives back, free to live their lives in their own home. It was a perfect relationship between all the various parties, and I watched as my parents thrived. Sadly, my Dad didn’t enjoy the care for too long, but thanks to his carers we were alerted very quickly to health issues and were able to get him the hospital care which made his last days as comfortable as possible. The care that then followed for my Mum was exceptional and well beyond any expectations. Wright Care at Home supported her fantastically through a very difficult time and kept me very well informed of how she was doing, at times on a daily basis, right up to her unexpected passing a year later. I will remain eternally grateful to Sammy and the team at Wright Care at Home for all they did for my parents, and indeed for all they did for me. I couldn’t have chosen better.”

T

here are 351,000 children aged seventeen years or under in the UK who are living with a learning disability. Maybe one lives with you. If they do, you might want to consider what you need to do to protect their interests as they get older.

We are privileged to work with Medehamstede Academy (Peterborough) and Family Voice (Orton Goldhay), helping families with their planning as their children transition from childhood into adulthood. One of the conversations we have most often is “Who makes decisions for my child?” The answer is like so many – it depends! If you do nothing, then technically your parental responsibility ends on their eighteenth birthday and your ‘newly minted’ adult child becomes the responsibility of your local adult social care team. For most people, this is not ideal, and the transition from children’s services into adult care is difficult. However, it doesn’t have to be that way; you can make provision to keep control of decisions that relate to your child.

What you need to do depends on your child’s abilities and their assets. It might be something as simple as applying to be an appointee to deal with their benefits; it might well be a case of putting Lasting Powers of Attorney in place; or you may need to apply to the courts to become a Deputy to manage your child’s affairs. All of the options have different criteria, costs and levels of complexity, so you need to know which option is best for your circumstances, and those of your child. hilst it is normal for everyone to feel sad or upset from time to time, when these feelings are overwhelming, persistent, or are affecting your ability to function on a daily basis, it may be that you are suffering from depression. W

ith the summer now upon us, thoughts turn to the great outdoors and the ways in which our communities have, for a long time now, taken to the open air when seeking a venue for a communal event. Garden fetes have always been a popular option and, this month, we take a look back at two such events, held in the grounds of Hanthorpe House, over 130 years ago. Leaving the village of Hanthorpe, near Morton, on the Stainfield Road today, you will find W.B. Cox & Son’s sawmill and woodyard, on the site of what was once Hanthorpe House, a very spacious country house which was demolished in 1951. The building dates back over two hundred years and the images here depict an impressive amount of style and much grandeur, towards the end of the nineteenth century, the time at which the garden fetes of 1887 and 1888 shown here would have taken place. The “various amusements”, the “excellent band”, the “dancing (without extra charge)” and the “sale of work and fancy articles” at the 1887 event could all feature in such a fete these days. The “best baby competition” on the other hand seems to have gone out of fashion of late!

The “Morton Feast Garden Fete” of 1888 looks to have been a much more elaborate affair, according to the poster shown here. The “Exhibition of Queensland Curiosities” I’m sure would have appealed to many, and who could have resisted entering the “Quoit Handicap”? The mind boggles at what “Uncle Sarah – a new and exciting game” might have involved! A very interesting summary of the history of Hanthorpe House can be found in “Lost Lincolnshire Country Houses – Volume 6” by Robert Pacey, (ISBN 978-09562230-0-5). Local losses covered in this text include Swinstead House, Scottlethorpe Manor, Osgodby Manor, Uffington House and Aswarby Park.

EMPLOYMENT DISPUTES REQUIRE ADVICE WORDS FROM RICHARD WOOD Since 2010, employment disputes have required more work by clients and their solicitors. In 2010, Tribunal fees were introduced, but later, they were ruled unconstitutional. However, a would-be claimant at the Tribunal must use the ACAS Compulsory Early Conciliation Scheme before issuing a claim at the Employment Tribunal. That has the effect of freezing the usual time limits for issuing the claim at the Tribunal. The usual time limit is three months. There are limitations as to making claims which interact with the operation of the ACAS Early Conciliation and, if not calculated properly, can mean that a claimant is out of time and prevented from making a claim. Care is needed and advice should be taken. If the conciliation fails, a certificate is issued, and that detail is needed to issue the claim. There is a calculation as to how many days a claimant has

to file the claim from the end of the conciliation, which is generally the number of days over which the conciliation continued, added to the remaining period of limitation (usually what is left of three months) if the conciliation is started in the first two months after the incident occurred. However, if the conciliation commences in the third month following the incident, the additional period added to the usual three months is one month. When the claimant issues, the Tribunal will issue an Order of Directions that the parties must follow. There is a lot of work. If the parties do not settle, a trial will eventually take place to decide matters. In these troubled times, some parties negotiate a settlement which results in an agreed ‘Settlement Agreement’ before ACAS and the Tribunal are required; this can end up being cheaper and potentially less stressful. No Fault Divorce, At Last!

T

he very long-awaited Divorce, Dissolution and Separation Act 2020 is to come into force on April 6th next year. This is a lot later than originally hoped and it would seem that the delay has been due to the IT changes necessary on the Government online divorce platform. But April 6th, 2022, is now fixed on the parliamentary record. So, those of you who have been holding off starting divorce proceedings on the traditional grounds, can now work towards this new timetable. The new law will allow married couples to divorce without attributing blame as a reason to end the marriage. The current law only provides for “blameless” divorce if you have been separated for two years, or five years. Otherwise, the majority of divorces where the spouses agree they can’t wait for two years, require allegations of unreasonable behaviour to be raised by one against the other, or agreeing that adultery has taken place. Neither ground is exactly the best start to ending a marriage in a civil and amicable manner. The new law will permit spouses to divorce after being apart for a limited period of time. The exact rules will be finalised over the coming months and your local family law specialist will be able to provide more details closer to the date. So, watch this space …

You’ll learn to sing, meet new people, challenge yourself, perform live on stage AND raise money for this much-loved local charity. Absolutely no previous singing experience is needed, just a willingness to step outside your comfort zone, get stuck in and give it a go. Maths at Morton

T

his term, the Year 5 children at Morton C of E Primary School have been engaging in an exciting maths project. The Royal Institution, a charity whose goal is to foster a love of science and maths in children, are providing a set of live maths masterclasses.

Following an introduction lesson for all of Year 5, a series of three sessions has begun which challenges and inspires children to think more deeply within the subject. These lessons are being delivered virtually, in conjunction with Year 5 classes across other local schools.

Each session focuses on areas of the subject that would not normally be included in the curriculum – for example, the children learnt about the French mathematician, Blaise Pascal. They looked for patterns using Pascal’s Triangle and learnt how the work done by Pascal is used today in applied probability

Through these shared experiences, children will leave primary school with a better understanding of the value of maths outside the classroom and a desire to always keep learning. This is just one example of the activities we provide to build aspirations and for children to learn skills for their future. It looks like it is going to be a busy summer at Morton!

Headstart Nursery Children Prepare for School As the final few weeks approach before saying goodbye to their pre-school children, Headstart Day Nursery and Pre-School have been doing all they can to ensure that their children have the best possible start to school life. This has included doing their own mini-P.E. sessions. Twice a week, the children would bring in their own P.E. kits, get themselves changed and then enjoy a short P.E. session outside. This has been incredibly beneficial for the children, as it has really supported their independence and given them that sense of achievement when they have got dressed, all by themselves.

All of the children have had so much fun, and even some of the lower-pre-school children have been asking their parents to bring their P.E. kits in.

Headstart will continue to work alongside local primary schools to ensure that, even with restrictions still in place, there can still be a smooth transition for all of the children who are leaving in the late summer. It has been her ambition to develop her longstanding work, caring for disabled youngsters in the past, and provide opportunities, not solely for them, but for everyone in the area, to have somewhere nearby where they are free to pet a wide range of farm animals, in a safe and controlled way.

Early signs are very favourable, with Tracey highlighting how one local, Northorpe, volunteer has been raising funds for the farm by selling their eggs, along with donated teddy bears, on his stall in the street – step forward, Arthur Unsworth, aged nine! The Halls have created a picnic area, close to the petting pens, and with parking space and toilet facilities on hand, they are hoping for the general public to come flocking! (but please leave the dogs at home).

Tracey has no doubts about the benefits to be gained from such an exposure to our hairy/furry/ feathered friends. Young children will no doubt find the offering at Tiny Steps Farm irresistible, but other groups of people too, especially the elderly and the lonely,

In early June, we had the privilege of being invited to what has become an established ‘icon’ of Bourne.

I

t was an absolute pleasure to open the upper floor of Harrison and Dunn’s hardware emporium where, apparently, they are still asked for “four candles” but where you can buy that “little whatsit” that you need but can’t get anywhere else! Established by Messrs Harrison and Dunn in 1930, what would Bourne be without this gem of a shop?

I have said that we will, if it benefits Bourne, go to “the opening of an envelope” and so it was with great relief, for all concerned, that we opened the refurbished toilets at Bourne Bowls Club! The club has been a stalwart organisation in Bourne for a good many years and so it continues, with a large and very strong membership. We were made very welcome by Chairman Brian and a vibrant membership that is always ready to welcome new members, especially younger, as well as ‘young at heart’, ones. Thank you to those members who provided a lovely lunch.

Scouts and Wake House, has had his head shaved to raise money for charity – an absolutely star in his own very particular way well done Greg! Finally, don’t forget to come and join us at the ‘Picnic in Wellhead Park’ on Sunday July 4th. There will be live music spots throughout the park, and we have many local performers who are absolutely keen to do what they do best, entertain. The Picnic will officially start at 11 am and squashed family tomato sandwiches could really be the way to go! If you do decide to join us, please make sure you choose a spot that has space around it, for the comfort of everyone else, but most importantly have a good time! Paul Fellows

Invited to the official opening of the ‘Don’t Lose Hope’ garden and ‘Man Shed’, it was awe-inspiring to see how much this organisation has, and continues, to achieve in such a relatively short time. Primarily providing a very much-needed service for young people, ‘Don’t Lose Hope’, through the garden and shed projects, are also reaching out to the community as a whole. They have developed a formula/ plan to help finance and deliver a service that is a pattern for the county, if not the country. Well done to everyone who made it happen. hroughout the summer, the Stamford Shakespeare Company presents a season of plays at the stunning Rutland Open Air Theatre. One of My Biggest ‘Growing Pains’ for the Business is Finding the Right People.

henever we have recruited new team members, we are extremely careful about finding the right people that fit into our team. As an employer, I work very hard to try and build a positive work environment; finding people with the right mindset is a huge part of that.

A

Misconduct Investigations?

n employer might be forgiven for thinking it fair to dismiss an employee seen out drinking by a manager whilst allegedly ill in bed and unable to attend work.

However, last month’s BBC report that driver, Colin Kane, had won his claim of unfair dismissal against Debmat Surfacing Ltd in such circumstances, highlights the critical importance to employers of following a fair investigation and dismissal process. Manager, Shaun Johnson, was driving when he saw Mr Kane smoking outside a social club on March 9th, 2020, his first day of absence. Mr Johnson informed the Managing Director, John Turner, who then rang Mr Kane. Mr Turner’s account was that Colin Kane had told him that he had “been bad in bed all day with his chest”. So, what went wrong for Debmat Surfacing? The law relating to misconduct cases The employer is required to undertake as much of an investigation into the misconduct as is “reasonable in all the circumstances” and “to follow a fair disciplinary procedure”. The Newcastle Employment Tribunal found a number of flaws in Debmat’s investigation and that its disciplinary procedure “fell below the standard expected from a reasonable employer”. Key things to bear in mind to ensure a reasonable investigation are: ●

Taking written accounts from witnesses to any alleged misconduct as soon as possible.

Those who have given witness accounts should not have any part in leading an investigation, including any interview with the employee alleged to have committed the misconduct.

Widening the investigation to include other potential or likely witnesses and taking written accounts.

Checking that your company Disciplinary Policy includes the acts that you intend to position as misconduct or gross misconduct. In this case, Debmat placed considerable reliance on the point that any action by an employee while they are off sick that delays their return to work is misconduct and that Mr Kane should not be smoking and drinking when off work with a bad chest, but the Tribunal judge found that there was nothing in Debmat’s brief Disciplinary Policy to this effect.

Disciplinary procedure Avoid legal challenges that the person holding the disciplinary hearing is biased and/or that the outcome is pre-judged: A manager who has been (or should have been) included as a witness to the alleged misconduct or who was involved in the investigation should not handle the disciplinary hearing.

Check the facts and be clear of the events that you are presenting to the employee to answer in the disciplinary hearing.

This includes specifying clearly what the nature of misconduct is that the employee is alleged to have carried out.

Follow a fair appeal process and look properly into any points raised by the employee.
