The first quarter of 2020 has seen a historic landmark as the UK is now no longer a member state of the European Union for the first time in over 40 years. This is not the beginning of the end, only the end of the beginning as the Prime Minister’s dedicated task force have until the end of 2020 to negotiate our future relationship with the EU.

In the meantime, the country is currently in the transitional period where the UK still adopts the EU laws on trading and we remain in the Customs Union until December, for the majority of local companies, it should be ‘business as usual’.

The Chamber is very proud to continue to be a partner in the Time to Change Worcestershire hub. Having signed the employer pledge in September 2018, there are now 10 time to change workplace champions who are actively involved in promoting key messages and organising initiatives to help reduce the stigma associated with mental health. The Chamber would love to hear from employers who would also like to become involved with the programme by signing the pledge and making a difference. Time to change has recently launched a new action plan for their Employer Pledge, which supports organisations to put in place best-practice interventions and policy that promote a positive mental wellbeing. MICHELIN STAR PENSONS HOSTS WORCESTER WOMEN'S BUSINESS FORUM 40 attendees gathered for the Herefordshire & Worcestershire Chamber of Commerce’s Worcester Women’s Business Forum, in association with Bishop Fleming. The event was held on Wednesday 15 January at the picturesque Pensons at the Netherwood Estate where guests had the opportunity to engage in networking over tea, coffee and brunch. Inspiring motivational talks were given by Wendy Andrews, VAT Director at Bishop Fleming, Emma May White, from Real World Coaching, Peta Darnley, Owner of Pensons at the Netherwood Estate, and finally Nicola Whiting, Chief Strategy Officer at Titania. Guests were impressed with the speakers as well as with the venue and welcomed the time allocated for networking with other businesses attending the event. On the success of the Forum, Sharon Smith, HW Chamber Chief Executive, said: “The Chamber is proud of our ever popular, growing Women’s Business Forums in both Herefordshire and Worcestershire, alongside

04

our Women’s Business Conference. Although officially open to all genders, the group provides an opportunity to network at a different time of the day that may be more conducive for some women, and feedback is that whilst never excluding anyone, sometimes groups with common features – be that business sector, gender, age or anything else – enjoy the opportunity to discuss similar challenges or thoughts with that group.” “From my perspective, I think we should celebrate this service. There are still widely reported national issues around gender equality in senior positions, and the gender pay gap, so why not enable women to continue their learning and development in whatever style forum meets their needs.” The next event will be held on Thursday 30 April, if you would like to attend this event please do get in contact with our events team on 01905 673612 or email events@hwchamber.co.uk www.hwchamber.co.uk/events

THE GROWING IMPACT OF SUSTAINABILITY FOR SMALL AND MEDIUM SIZED BUSINESSES The traditional cost of energy is continually rising, the big question is, how can we reduce the overall cost of our energy, and stop the continual price rises? Caplor Energy state that the key point for business owners to remember when looking at their day to day costs, is that they could invest in renewable energy to reduce their energy bills in the long term. It’s all about making the correct investment decisions to manage the long-term sustainability of your business, as well as the environment. One of the historical barriers to this is the need to find capital to invest in renewable energy. Today, there are lots of ways to

options at very low interest rates, making it easier to make the right choices. But businesses can still demonstrate their green credentials with simple items such as LED lightbulbs, more efficient heating, looking at efficient transportation and vehicle emissions. All of which will have the added benefit of lowering their day to day operating costs. generate that capital - it can be borrowed, come from cash reserves if available, grants or funding or be achieved through various financing arrangements. This means that the traditional capital barriers are being reduced with the availability of funding

Making the right decisions can actually be good for your business. It doesn’t have to cost a fortune to be sustainable, we just need to play our part with a hugely increased sense of urgency. www.caplor.co.uk

CUTTING YOUR CARBON FOOTPRINT FOR COMPLIANCE Changes to Minimum Energy Efficiency Standards As you may be aware, the Minimum Energy Efficiency Standards (‘MEES’) came into force in April 2018. So whilst MEES created a legal obligation on commercial landlords setting a minimum band of an E rating relating to Energy Performance Certificates (‘EPC’) for all new commercial lettings, it was only the first stage of the move towards more energy efficient commercial buildings. We are therefore now rapidly approaching the second significant deadline set by the government of 1st April 2023. This date may seem a long way off, however it potentially places a huge burden on landlords. That’s because the 1st April 2023 is the deadline for landlords to improve their properties to ensure that the energy rating for all existing leased premises, granted prior to 1st April 2018, have a minimum Energy efficiency rating of ‘E’. If you are a commercial landlord that also owns residential investment properties, you should note that the deadline to improve the energy rating for existing lettings for residential proprieties to an E rating is 1st April 2020. We trust your lettings agent has been in touch. Landlords should act now to ensure that they have complied with the regulations before the deadline or risk facing penalties. The Governments’ recent consultation has now outlined their aims to deliver energy and carbon savings in the medium term. By 1st April 2030 they will seek to

Holly Kisiel

achieve EPCs of a B rating for all future commercial lettings. This will create a significant duty on landlords to improve their properties so they are energy efficient, with works possibly costing thousands, in order for a landlord to legally let their property.

WHAT ARE THE PENALTIES FOR NON-COMPLIANCE? Non-compliance of MEES could be extremely costly for a commercial landlord as penalties are calculated on the rateable value of the property. Landlords could see themselves fined from £5,000 to £50,000. There is also a penalty for failure to comply with a penalty notice within 3 months, the additional fine ranges from £10,000 to £150,000. You have been warned!

COMMERCIALLY SPEAKING… Jane Rudge The result of the statutory measures mentioned above will mean landlord’s costs may increase in the short term (and therefore affect income levels) however in the long term bringing properties up to standard could potentially increase the value and attract more competitive lending rates from mortgage lenders. It would therefore be wise for landlords to plan ahead to meet the 2023 standards over the coming 3 years and so avoid paying out large expenses in the rush to meet the statutory requirements before the deadline.

If you do have any questions as a commercial landlord please contact Holly Kisiel, Commercial Property Solicitor on 01905 730450 or email hkisiel@thursfields.co.uk

CLOUD FOR DIGITAL TRANSFORMATION: It’s hard to imagine a world without cloud technology. From social platforms like Facebook and Twitter, to Skype, Whatsapp and even Netflix. When it comes to business, cloud technology has enabled us to use our most productive tools over the internet, allowing you to work on documents, presentations or spread sheets from anywhere, at anytime. However, many businesses have not yet fully embraced the potential of cloud, perhaps only utilising one or two services. When it comes to digital transformation, cloud offers a multitude of opportunities, from cost effective solutions to business flexibility. Whether your business is looking to replace tired IT systems, avoid spend on refreshing kit, or simply start from scratch, cloud offers the cutting edge technology to transform your digital workplace.

COST EFFECTIVE: Although the prospect of digital transformation seems costly, cloud offers a scalable service model, where organisations simply pay for the resources they need, particularly when technology sits idle during periods of lower demand.

Time consuming data processing and software patching are made redundant with cloud freeing up vital resources and removing unnecessary business expenditure such as computer equipment, hardware and software. Ultimately, businesses can save both time and money by streamlining operations into one accessible cloud platform or service.

SECURITY: Most organisations are now aware of the implications of storing data in-house, whether via desktop folders, hard drives or even basic filing cabinets. It only takes one unexpected data breach, system shutdown or disaster to lose all of this critical information, with detrimental costs to the business. Cloud enables businesses to easily create multiple backups of data, alongside high performing cyber security solutions that minimise the risk of security breaches and downtime.

RAPID PROTOTYPING: For digital transformation to work, organisations must innovate, test and implement technology. Cloud provides a flexible platform where organisations can easily build, test and deploy applications without the need to set up complex infrastructure or invest in costly hardware. When developing your

digital technology, cloud allows your organisation to experiment with multiple applications, on varying platforms throughout your transformation phase.

BETTER COLLABORATION: With many organisations still operating on disparate systems, cloud enables businesses to communicate and collaborate in a single unified environment. The ability to access data anywhere, at anytime means employees can work in real time from a central digital location, saving on duplicate data and ensuring everyone has the right access to the information they need. EBC Group are an award winning cloud and managed service provider, providing a number of cloud solutions to organisations across the UK, including; Private, Managed and Hybrid. As winner of ‘Cloud Project of the Year’ at the national SDC Awards, EBC Group have helped a number of organisations across the region implement cloud solutions, helping to transform their workspace into a high performing digital environment. BUSINESS COSTS PROVE BIGGEST BARRIER TO GROWTH IN 2020 MANIFESTO Businesses repeatedly report that rising costs are squeezing profit margins and placing insurmountable pressure on operations. With the increases to the national minimum wage, the introduction of IR35 and the prospect of extended producer responsibility for the costs associated with waste products, it is likely that the financial burden for businesses will only increase as we enter a new decade. As the Chamber commences data collection for the first quarter of 2020, the political certainty delivered by the results of the general election, and the single

010

party majority which now exists in the commons, should translate into an uptick in economic activity. With the domestic deadlock broken, the new government has every opportunity to give business the practical advice and structured guidance it needs to make a smooth exit from the EU. As we approach the March 2020 budget, businesses will be keen to see reforms to business rates. Some much-needed relief from the overflowing costs that have become a critical burden for businesses will be welcomed. Exchange rates and remaining competitive in the context of such huge political and economic upheaval remained the primary causes of concern for businesses in 2019. Where historically corporation tax and business rates would have topped business concerns every quarter, the political and economic context of the past two years of EU exit negotiations have

shifted the focus of businesses. At the time of writing, the Chamber’s 2020 Business Manifesto is in the process of being produced. The manifesto is an evidence led report which outlines the priorities of the business community in Herefordshire and Worcestershire. This year the Chamber will be joined by the Director General of the British Chambers of Commerce, Adam Marshall, to launch the 2020 Business Manifesto at Yamasaki Mazak on Friday 20 March 2020. Booking is recommended as this is an immensely popular event, with over 120 businesses joining us last year. To secure your place, email events@hwchamber. co.uk.

BUSINESS PLANNING IN UNCERTAIN TIMES

During the last few months of 2019, businesses have faced a challenging environment. A second EU Exit deadline during October, followed by a general election in December has taken uncertainty to new heights. Never before has the political arena been so closely wedded to economic activity. It is immensely frustrating for businesses to constantly prepare for a myriad of potential outcomes. Although preparing for a range of scenarios is time consuming and frustrating, it has never been more important for businesses to formulate or review their current business plan. It is certainly of concern that the Herefordshire & Worcestershire Chamber of Commerce Q4 Quarterly Economic Report, produced in partnership with Bishop Fleming, revealed that only 50% of businesses from across the two counties have a formal written business plan. The remaining 50% either reported that they do not have a strategic business plan or the plan they do have is not documented.

It will come as no surprise to see that the larger a company, the more likely they were to have a documented business plan. On average, just 15% of businesses with 50 or more employees had an undocumented business plan. By comparison, 37% of businesses who had less than 50 employees had an undocumented business plan. SME’s account for the overwhelming majority of the UK economy – employing 60% of the workforce and representing 99.9% of the business population across the UK. It is surprising, therefore, that this report, drawn from a representative sample from the two counties, demonstrates that only 60% of SMEs have a formal documented business plan. Chris Walklett, Tax Partner at Bishop Fleming, has advised four key steps for a company to address when creating a business plan: Vision – What is the company trying to achieve. Objectives – Defining what the vision means in measurable goals. Controllables – The strategy that will help you achieve your objectives based on what you can control.

Business Direction published by Herefordshire & Worcestershire Chamber of Commerce

Behaviours and values – engaging your people in the company’s business plan to ensure they embody the behaviours and values that will result in success. Although the unprecedented changes to regulatory alignment with the EU do bring challenges, businesses should use this uncertainty to trigger a business plan review. With the result of the general election established and the passing of the EU Exit deadline to the 31st January 2020, businesses should use the coming months to review their plans and engage in strategic thinking. Businesses who invest their time in such planning will find the potential fiction and additional costs, which may arise as a result of the new regulations and policies which are implemented after the transition period, easier to navigate. FOCUS ON TECHNOLOGY

YOU COULD BE MORE SUCCESSFUL USING LINKEDIN. HERE’S HOW. The mission statement for LinkedIn is to ‘make the world’s professionals more productive and successful’. Who wouldn’t want to ride the wave of a global technology company that measures its success by how successful it makes you? There are so many ways to market yourself, and your business, in the digital age. They don’t all lend themselves to being measured particularly well either. Many of us have heard stories of companies spending large sums of money on search engine optimisation, or online advertising or on new websites and never seeing a return on investment. LinkedIn bucks this trend. When we were designing our specialist LinkedIn marketing, growth and lead generations services, one thing was clear to us – what makes LinkedIn so fundamentally different from other methods of marketing is that you are engaging with named decision makers. You can be clear about who you are aiming your messages towards and how best to add value and build relationships. Measurement is far easier – being based on who you have converted from being an online LinkedIn connection, to being an offline sales opportunity, and ultimately which connections convert into customers. As time has gone on, trends and best practices have emerged that can guide you and help build a steady pipeline of business. Authenticity is key Concepts such as ‘personal brand’ and ‘authenticity’ are highly important. If you are involved in a B2B marketplace, then the chances are high that your target customers are using the LinkedIn platform. Unlike the other major social networks, LinkedIn is unique with the quality of its users and the quality of the content that’s shared. Some interesting statistics: 40% of active LinkedIn users log in daily. Some 45% of LinkedIn users are involved in senior management or have decision making authority. LinkedIn Is the #1 channel B2B marketers use to distribute content.

012

LinkedIn accounts for more than 50% of all social traffic to B2B websites and blogs. Senior executives and decision makers place a high degree of trust in the content they find on the LinkedIn platform. Used well, the LinkedIn platform is akin to a living, breathing CRM system. Generating leads via the LinkedIn platform requires three primary components; time, consistency and skill. In practice, most salespeople must balance the use of their time against other competing priorities. Efforts to gain the most significant benefit from the platform can be drowned out by the noise of other sales tasks. Collate Systems address the 3 primary components of LinkedIn success head on. Our tools, expertise and approach allow us to add the equivalent to 30-40 hours of LinkedIn productivity per week for each sales executive using our services. And our approach is based on 6 principles of Influencing; reciprocity, scarcity, authority, consistency, liking and consensus.

There is no ‘one size fits all’ approach with our services. However, for each client we create a unique lead generation plan that selects the most appropriate of our tools and aligns them against budget and ambition. The future of social selling is replacing traditional sales. The act of cold calling will become harder as intelligent buyers look for social proof of a company, service or person before allocating their important time. We are experts at what we do. Our positioning is that we hold accreditations directly from LinkedIn for getting the most from the platform. Further, we have in-house technology that significantly extends sales capacity by 30 – 40 hours per week and we have created unique social selling processes that combine our knowledge and technology. We take great pride in helping our clients to win more business on LinkedIn. Why not get in touch to find out how we can take your business to the next level using LinkedIn? Contact Martyn Allan on 01684 439 673 or martyn@collatesystems.com

Importantly, we do not claim to offer ‘instant fixes’ or ‘magical solutions’ to lead generation. Instead, our services deliver a long-term strategy that builds relevant audiences, engages with them, builds rapport and shares interesting content.

INTELLIGENCIA TRAINING COMMENCE DELIVERY OF NEW HIGH PROFILE COUNTER-FRAUD APPRENTICESHIP Intelligence training specialists Intelligencia Training have recently included the Government’s new Counter-Fraud Investigator Apprenticeship Standard to its portfolio of established, innovative intelligence and risk apprenticeships. The new Counter-Fraud Investigator Apprenticeship Standard was developed by a consortium of sector specialists from within a range of high profile organisations, including Cabinet Office, HMRC, NHS Counter-Fraud and many local authorities, to recognise the skill set and experience required to operate within these challenging roles. The ability to professionalise and formalise the way in which many organisations operate delivers significant advantages.

4 SUCCESS Older workers employed within Worcestershire can access FREE training at local colleges. Funded by the European Social Fund and delivered by WCG, Train 4 Success (T4S) gives older Worcestershire workers an opportunity to boost their workplace skills and knowledge – AT NO COST.

The Fraud Investigation Standard was developed to provide a recognised and robust pathway for fraud investigators that would allow for parity across sectors and comprehensive development of all knowledge, skills and behaviours associated with being an effective and competent investigation professional.

A wide range of courses take place at WCG colleges, including Evesham, Pershore, Malvern Hills and Leamington Spa.

Building on from their success in delivering cutting edge intelligence and analytical training within both public and private sectors (including Government agencies, public sector departments, law enforcement and custodial sectors, local authorities and the banking / insurance sectors) Intelligencia Training are confident their exposure and experience gained within existing counter-fraud departments will provide tangible benefits.

Eligible individuals must be aged 50 or over and work for a company with no more than 250 employees and a max £50m turnover.

Intelligencia Training’s Commercial Director – Nick Atkinson, commented, “We are proud to announce that we have added this long awaited Apprenticeship standard to our portfolio of cutting edge training programmes to support further our growing number of high profile public and private sector clients. Our engaging delivery models and highly skilled tutors, that include those who have operated within senior intelligence and counter-fraud roles, will bring significant new skills, knowledge and behaviours to benefit those who, previously, may have not been offered formal counter-fraud training. We are confident that those organisations who have previously utilised our widely publicised intelligence analysis apprenticeship will now look to offer even more role specific programmes to their wider business.”

AIRBAND HELP APPRENTICE OBTAIN DEGREE WITHOUT ANY STUDENT DEBT Thanks to the growing popularity of higher and degree level apprenticeships, Worcester’s buoyant IT sector is providing an increasing number of local young people with the opportunity to work in this exciting environment without the need to gain a University degree first. Jon Parkes, Service Manager at Airband, said: “Having an apprentice is a wonderful opportunity to gain an extra resource and to mould them to be the perfect fit for your organisation.” Extra support is now on offer for local companies who, like Airband, employ higher and degree level apprentices. Worcester City Council runs an Employers Apprenticeship Grant scheme, which

016

awards up to £2,000 to local companies towards the training costs incurred. Airband successfully applied for the grant to support three higher and degree level apprentices – including Worcester Sixth Form College student Hannah Baylis. She had gained ‘A’ levels in History, Politics, Physics and Maths, but began to question whether a ‘traditional’ route to University was the right one for her. The apprenticeship has offered Hannah the best of both worlds with the chance to work towards a BSc degree in Digital and Technology Solutions from the University of Wolverhampton without incurring any student debt in the process.

BUSINESS NEWS

HOW FINANCE OPTIONS CAN HELP WITH YOUR STRATEGIC CHALLENGES Growth, innovation, working capital and realising shareholder value are examples of strategic challenges that companies face on a year-to-year basis. All these strategies require access to cash. Funding options range from banks, private equity, debt funds, angel investors and crowdfunding. Targeting and entrusting the right funder and funding option is key to the successful implementation of an organisation’s strategy. Companies with strong management and attractive growth plans are more conducive to the private equity model. Buy-outs typically also involve a level of debt financing, while short-term financing projects or working capital support are better suited to debt. A wide number of facilities and funders are available, the most common being invoice discounting, asset-based-lending and cash-flow loans.

Kevin Gates, Managing Director of Neoperl UK

MINIMUM WAGE INCREASE MUST BE APPROACHED IN THE RIGHT WAY Private equity enables acceleration of growth as the company benefits from access to capital, a deep pool of specialist expertise and synergies from portfolio businesses. The first half of 2019 saw a 21% decrease in UK private equity deals completed compared to 2018. Despite this, there is significant appetite from private equity with an estimated $1.7 trillion of dry powder globally for investment. www.bdo.co.uk

Debt requires capital and interest payments, often with covenants to be adhered to. Despite low interest rates, lenders are being more selective to the sectors to which they are lending, as reflected by the volume of UK & Ireland loan deals in the first nine months of 2019 decreasing by 41%.

It was announced in January that the new National Minimum Wage would rise to £8.72 per hour for people aged 25 and over, a rise of 6.2%, will come into effect in April. For this to be sustainable the government must offset the increased charges to businesses that this rise will bring. By raising wage by more than double the rate of inflation, this will pile further pressure on cash flow and possibly eat into training and investment budgets. The change will pose a significant increase in companies wage and pensions costs and present a number of issues to businesses across the country, if not approached with caution. Kevin Gates, Managing Director of Neoperl UK, said: “Whilst it is laudable that government has pledged to give workers the pay rises they deserve, the extent and in particular the rapidity of the increase will add significant cost to the business, and of equal significance, will also have a knock on effect for other pay rates, by tightening the gap and differentiation between the skill levels." www.neoperl.co.uk

FUTURE WORKSPACES

Hate hot desking? Chaotic commute? You’re not alone

If you loathe hot desking, and want to reduce your commute time, you’re not on your own. More than 400 people answered our survey on what they want from their workspace, and a good proportion of the respondents agree that a dedicated desk, an office with natural daylight, and more time spent working from home would make them more productive. Your employer, however, may not think these factors matter. In fact 32% of respondents who gave a reason for why they don’t currently work from home, said their company doesn’t allow them to, although only 5% of employers who responded said they don’t endorse homeworking. There’s clearly a gap here which we’re interested in exploring further.

On average, people work from home less than one day per week.

One respondent to our survey said: “Working from home enables me to complete more tasks throughout the day as the distractions at the office are not surrounding me, e.g. chatting with colleagues, trips to the kitchen to make coffee and taking screen or toilet breaks – these often lead to losing track of what you’re doing as you end up speaking with colleagues as a result of being in the same ‘social space’ as them, and this causes delays in productivity. That said, the social atmosphere and support at the office is sometimes a driver to productivity, so overall a mix is better for me.”

Another respondent said, when asked what the biggest factor that influences productivity is: “Noise in open plan offices. Hot desking is rubbish! And an overheated office.” Andy Dyke, Director of ICONICS, a leading company delivering software solutions within the intelligent buildings sector and commercial real estate digital transformation, said that it would be interesting to understand why people don’t like hot desking. He said: “Possibly it’s because it’s not handled correctly by the business - if a member of staff could book a desk, choose it in the right

thermal zone, with the right noise level, in the area of a selected team, they might like hot desking, as it gives them more flexibility, personal preference, and a blended approach to leveraging more working from home.

“I also think it’s interesting that the survey says more people want to work from home, but everyone wants their own desk. This will never wear for businesses trying to drive down commercial real estate costs and maximise space utilisation. These are just some examples of the conflicts at play.”

of respondents said having their own dedicated desk positively impacted their productivity.

Carolyn Wood, COO at Auckland Home Solutions, has seen employees’ dislike of hot-desking in action – after hot-desking was introduced, staff turnover rose sharply. She said: “No-one had their own desk and the effect was really clear – they had no attachment to the office because they couldn’t personalise anything - no-one felt they really belonged. It really impacted people’s mental health and commitment levels.”

SUTCLIFFE & CO INSURANCE BROKERS ON HOW TO REDUCE THE COST OF YOUR FLEET Chamber Strategic Member Sutcliffe & Co Insurance Brokers has some words of advice for businesses with a fleet. There are ways to reduce your costs, improve productivity, and manage risks.

CHECK YOUR RIGHTS IN COMPANY DISPUTES Leading commercial litigation lawyer, Sam Pedley has urged the shareholders of businesses in the two counties to check their rights in the event of disputes with directors and other stakeholders. Sam, a Partner at mfg Solicitors, has warned that too many minority shareholders think they have to sit on their hands and just accept decisions they feel are wrongly being forced through by those with the biggest stake in the business. He said: “How much of a say people have depends largely on what proportion of the shares they own, but some minority shareholders may have more power than they think. However, too many minority shareholders don’t know about them and end up just cutting their losses or sitting on their hands. I see it too often and it doesn’t have to be that way.” Readers looking to find out more can email Sam through samuel.pedley@mfgsolicitors.com

There are three key areas to look at: Safety programmes - Safety experts believe that there is a direct correlation between safety and a company’s profit. Studies indicate that for every £1 invested in effective safety programmes, £4-£6 can be saved as illnesses, injuries and fatalities decline. Fuel - The best way to optimise your fleet’s fuel efficiency is by implementing smart driving initiatives. Even the basics of correct tyre inflation can make a difference Risk - Instead of addressing risks as they develop and constantly fire fighting, analyse information you already hold. By doing so, you can potentially isolate and eliminate your businesses biggest risks. Finally, speak with your insurance broker: they are best placed to help you understand your fleets risks and ways to manage – and potentially also reduce premium costs in doing so. www.sutcliffeinsurance.co.uk

BIGINTERVIEW

PLAIN SAILING IN THE EYE OF THE STORM It could cost your business a king’s ransom if your cyber-security isn’t ship shape and Bristol fashion, the Titania software development company tells HELEN COMPSON.

026

Yes, cyber-attacks are on the rise and companies pay the price when malware, for example, gets through, but Titania, for one, knows businesses can better protect themselves. Founded a decade ago by Ian Whiting, a veritable innovator in his field, Titania and its cyber security auditing software are now securing networks all over the world – in 95 countries to date.

Its clients are mostly global operations with stringent compliance demands, among them the American army, navy and federal agencies. So chief technical officer Keith Driver is well placed to talk about the rising cost to businesses of data breaches. “It’s hard to put a figure on it,” he said, “but it is increasing, because there is

March/April 2020

BIGINTERVIEW more software being used in every part of every organisation today and the people attacking it are more numerous and using better and better tools. “It’s a perfect storm! “Eventually, they are going to be successful and defeat more cyber protections - particularly where businesses don’t treat it seriously and that inevitably gives rise to business costs, whether that’s having to bring in experts to remedy the problem or dealing with reputational damage or, hitting the bottom line, missed orders.” There is no magic solution, of course. Those organisations holding private data simply have to be vigilant and responsible, namely by making sure their IT systems are configured to maximum effect. That really means making sure they are kept up to date, with the latest patches designed to protect against the latest viruses circulating, and keeping their network device and compute resources configured correctly. “I can’t emphasize enough that companies should follow the advice of the National Cyber Security Centre ( NCSC, part of GCHQ ) , which issues excellent very practical advice that is easy to follow,” said Keith. “Listen to that advice and you will reduce enormously the likelihood that a cyber attack will get through” Titania’s expertise lies in the accurate identification of how and precisely where a company’s IT system might be vulnerable, particularly in the configuration of network devices, desktops, laptops and servers. While its Titania Nipper software package audits firewalls, switches and routers, its Titania Paws package audits workstations, laptops and servers.

A third product leveraging Nipper and Paws is on its way, too, designed to be used holistically across complete networks, integrated with existing network management systems - enabling daily automatic assurance of configuration compliance. Automated diagnostic systems designed by Ian Whiting himself, the man who was an accredited penetration tester when he worked on the front line knew they would save businesses time and money. Keith said: “Ian worked for large organisations and a huge part of the job was down to very repetitive analysis, so he decided to automate the tests and the reporting. “To begin with, it was about saving himself time and about making the outputs more consistent and less prone to error.

“Over there, everyone has to comply with STIG (the Security Technical Implementation Guide), for example – it is mandatory. Here in the UK, we don’t have the same level of prescriptive regulation.” UK network operators could choose to adopt standards, but so far they haven’t made in to the UK market, he said. Either way, automated testing packages were a boon to an American market duty-bound to meet the most stringent of security standards, while the British market benefited from an off-the-peg auditing system that met those higher standards.

“The software has grown in time to accommodate more types of devices and able to detect many more and different types of risk.” In a nutshell, Ian created solutions that use the virtual modelling of device configurations to identify those risks. Titania’s products, therefore, extract configurations from devices on a network and look for vulnerabilities. The company uses the firefighting information provided by CERT, the Computer Emergency Response Team founded in the 1980s to combat cyber-crime, as well as the US National Vulnerability Database among others to keep its own approaches up to date In the US DoD networks, they have stringent standards networks must adhere to. The DISA STIG (Security Technical Implementation Guides) are a series of specific and prescriptive documents that Titania’s products implement to check automatically, ensuring compliance.

I can’t emphasize enough that companies should follow the advice of the National Cyber Security Centre ( NCSC, part of GCHQ ) , which issues excellent very practical advice that is easy to follow.

NATIONAL RECOGNITION Titania had additional cause for celebration on December 31st when its chief operations and strategy officer Nicola Whiting was awarded an MBE in the New Year’s Honours list. Nicola has been appointed a Member of the Order of the British Empire for services to international trade and diversity for her work campaigning for inclusivity in cyber-security, particularly for women and neurodiverse individuals. Autistic herself, Nicola firmly believes that diversity in all forms will bring better business solutions. A role model for many women working in technology, she has taken Titania from ambitious start-up to the multi-million-pound, award-winning company it is today.

NEW TAX RULE CLOSES LOOPHOLE On the eve of a new financial year, large and medium-sized companies are being warned another responsibility is about to drop onto their shoulders. This might be the era of the gig economy and flexible work patterns, but companies taking advantage of that beware! For leading employment lawyer Sally Morris, of Worcester-based MFG Solicitors, warns you could be caught out by new IR35 tax regulations being introduced in April. “I am concerned that many businesses here in Worcestershire are unaware of the seriousness and complexity of the new rules which will be ushered in from April,” she said. “In many ways the rules are an unfair burden on businesses who rely on using specialist contractors as a number of liabilities will pass over to them. This includes them having to be responsible for issues such as National Insurance contributions and employment taxes. “It’s a weight many don’t need, but must understand if they are to stay on the right side of the rules when they engage contractors.” The IR35 rules and regulations were originally introduced in 2000 by a Labour government tackling perceived tax avoidance. The target was individuals setting up personal service companies to provide services to just, for example, one other company (the client). “Although tax efficient for them, where there is such an arrangement it could be deemed by HMRC to be a sham”. There has also been a more innocent move away from traditional employment patterns in recent years as people sought flexible hours and the option of working at home. Many a company had moved to different models of contract as a result, but as HMRC’s clampdown on the likes of Uber and Deliveroo demonstrated, the accompanying tax and national insurance loopholes were now being closed. In 2017, IR35 was beefed up with the Off Payroll Working Rules in relation to the

028

Sally Morris

public sector by shifting the burden of determining tax status for work undertaken by personal services companies to the so-called client. Since then, it has been the responsibility of the client to make the decision whether that provider of services could be carrying out work that could be deemed employment and as such required to process PAYE and NIC’s through its payroll. The move ensured contractors paid tax in the same vein as employees. In April the legislation expands again, this time to embrace large and medium-size businesses in the private sector too. “Large and medium size businesses are those that satisfy two of the following condition - more than £10.2m annual turnover, more than £5.1m on the balance sheet and more than 50 employees” Sally clarified. The first thing MFG did for its clients, many of whom were members of this Chamber of Commerce, was to check whether they

would be caught by off-payroll rules or IR35. She said: “If you are a small company, although you don’t necessarily have to worry about the new off-payroll rules being brought in, you will need to pay attention to IR35, if you are contracting with a personal services company. “Unfortunately these changes do bring with them an additional cost burden to a business, because if a determination is made that work carried out on its behalf is deemed employment, the company will have to pay the 13.8% NICS and also the 0.5% apprenticeship levy where appropriate.” She cautions the busy employer from putting the matter to one side ‘for now’. “If you are a medium or large company and you don’t look at this and do what you are supposed to do in a timely manner, you may automatically be deemed responsible for making the required deductions.” “You might enter the realms of HMRC investigation and penalties by default.”

LESS IS OFTEN MORE! Worcestershire’s commercial property consultants are being encouraged to think small for big business gains. Sounding a wake-up call for local developers, the annual Worcestershire Commercial Property Market Report has just been published by experts GJS Dillon. The commercial property market right across the county’s six districts is thriving, with some of the lowest vacancy rates in the country. No, the problem is not the lack of enterprise, said the author of the report, Andrew Lewis, but the lack of space in which it can breathe.

“The report provides unbiased market data designed to aid business growth by defining the needs of the business community,” said Andrew.

indeed have very low vacancy rates, but then again, nothing is being built and all the good, quality stock has been taken up.

“Commercial property is getting more and more expensive, primarily due to lack of stock. This report is looking to address that supply issue.

“There are few properties for companies wishing either to start-up or expand. Quality stock is needed to cater for the demand that is already there.”

“It speaks to land and property owners, saying ‘this is what we need to provide the market to assist with business growth’.”

There have actually been some big commercial schemes completed in Worcestershire in the past 18 months, such as the 72-hectare Worcester Six Business Park, near junction six of the M5.

Those prices weren’t having too adverse an effect though in that they were balanced out by today’s low business and banking rates. “Prices aren’t limiting the businesses ability to purchase,” he said. You need look no further than the report and some of its statistics for evidence of that. Bromsgrove, with a little over a million square feet of office space at its disposal, has a vacancy rate of just 2.5%. Worcester has nigh-on twice the footage and still only a 3% vacancy rate. But as Andrew points out, the last new office complex to be built in Worcester was more than a decade ago. “We do

Andrew said: “Developments like that offer really big warehouses – we’re talking units of 50,000sq.ft. plus – which is great for bringing large companies into the area, but it’s not necessarily what all local businesses need at the moment. “Over 90% of businesses in Worcestershire are small to medium sized enterprises and typically need accommodation much smaller than that, so let’s keep that in mind.” Each of the six districts had its own identity and strengths, he said. While Bromsgrove was rather congested nowadays, it had good connectivity and

lots of compact commercial property, so small businesses were doing well there. Malvern Hills was starting to make its mark as a UK technology centre of excellence. “It is the Midlands’ cyber valley, according to one Worcestershire LEP report - a lot of tech businesses have moved there,” said Andrew. “But we do need to build on that and provide them with some manufacturing space too.” Redditch did well on the large-scale industrial front, with its huge new warehouse complexes. Close to Birmingham, the M42 and the airport, it attracted national companies needing to be keyed into transport networks. And as for Worcester, it sat at the junction of two motorway networks and boasted a legion of traditional businesses. Andrew said: “Wychavon has the standout performance. Of its 914,887sq.ft. of office space, only 2.1% is vacant. “It has four motorway junctions in the vicinity and good connectivity, thanks to its network of A-roads and a brand new railway station at Worcestershire Parkway.” “That is all good news, but we need to continue to provide smaller schemes, so that as well as big companies, local people based on these A-roads can have small units for companies employing up to ten people.” The Worcestershire Commercial Property Market Report is now available at www.gjsdillon.co.uk

As homes, homes for businesses, and often as businesses themselves. They are also an extremely good investment. But what do we do when a structure is no longer suitable for our requirements? The obvious answer is to move to a new location, or alter and extend your existing property. Unless you are fortunate enough to find somewhere that is exactly right for your needs, you are probably going to need building work done.

10 Years of serving the Business Community and proud winners of

This can seem daunting – how do you set about this process, and how do you define what you want? What are the correct legal processes and how do you obtain the necessary permissions? And what will it cost, who can advise you on this, and how do you avoid being ripped off by unscrupulous contractors? Again, there is an obvious answer – use reputable building companies with proven credentials, and do not avoid relatively small sums for professional advice. You are making a major investment, so do not assume that doing this in the cheapest possible way will work out best. The building industry is currently expanding rapidly, after a number of years in recession. All sectors are busy, and prices are increasing. New start-up companies are appearing - some of these will employ people with many years’ experience, and should be applauded – others not so. How do you choose? The answer is to use firms with relevant trade or professional recognition, and seek proper independent advice at all stages.

Worcestershire’s first new train station for over 100 years is now open Worcestershire Parkway is a key part of the County Council’s commitment to improve rail infrastructure around the county. Better rail connectivity allows easier travel into and out of the county, supporting the business and leisure economy.

The brand new station, Worcestershire Parkway, is situated just off M5 Junction 7 and is open for business. Fast, direct services to London Paddington run from the new station along with new direct services that call at Cardiff, Derby and Nottingham.

Worcestershire County Council’s Cabinet Member for Economy and Infrastructure, Councillor Ken Pollock, said “We are delighted that the station is now fully open. “Not only will it transform rail travel to and from the county, it looks great as well! “I’d like to thank all those involved in making this station, which has been talked about for over 30 years, a reality.”

The brand new station follows rail improvements already made by Worcestershire County Council at Bromsgrove, Foregate Street in Worcester, Malvern Link and Kidderminster. Users of the station can benefit from easy access from the B4084 and a 500-space car park with reasonable charges. The station is already helping to remove traffic from the county’s main roads and motorways as commuters that had previously driven the entire journey or drove to larger stations out of county, are now using the station. POLAND – A LARGE, ACCESSIBLE, DYNAMIC CENTRAL EUROPEAN MARKET FOR NEW AND EXPERIENCED EXPORTERS

Further to our last article on the Central and Eastern European regional commercial opportunity for exporters we are now putting the spotlight on Poland. In 2004 Poland joined the EU and became part of the Single European Market. With a population of nearly 40 million it represents the largest Central and Eastern European country market and is the 38th largest commercial market in the world. In the 2018 World Economic Forum Global Competitiveness report Poland ranked 37th out of a total of 180 countries. It is classified as a high-income economy by the World Bank and ranks 23rd worldwide in terms of GDP as well as 24th in the 2017 Ease of Doing Business Index. GDP growth in 2019 averaged over 4%.

040

Poland’s main import partners are Germany (28.3%), China (7.9%), Netherlands (6%), Russia (5%), Italy (5.3%), France (4.2%) and Czech Republic (4.1%) – sadly, even given very close links, the UK is only the 12th largest exporter to Poland.

but are not limited to; Defence, Security and Cyber, Healthcare and Lifesciences, Infrastructure, Environmental, Energy, Manufacturing, Construction and Retail (Poland has the 7th largest retail market in Europe) amongst others.

Poland represents a great international opportunity for both new and more experienced exporters. It is easily accessible from the UK (2.5 hours direct flight time to Warsaw), English is widely spoken and the cost of doing business there is low. Sector opportunities include,

COURSES FOR NEW AND INEXPERIENCED EXPORTERS:

WHY EXPORT? As the UK begins the EU Exit transition period, companies may now be considering looking at international markets to hedge potential downturns in revenues from their domestic market or mitigate against the risk of a tougher trading environment in Europe after December 31 2020, when the UK plans to leave the Single European Market. If a company hasn’t considered exporting before, some compelling reasons to do so include: Revenue risk mitigation by diversification: If a company is exporting to several different countries and adverse market conditions exist in one country market, the risk to company revenue and profitability can be offset by more positive trading conditions in the other markets that the company is also exporting to. Increased profitability: Different stages of market development in different countries for the same product or service can offer companies the opportunity to increase profit margins e.g. when a product can only be positioned “as less than premium” in a UK market because of prevailing market conditions, the company may be able to position the same product as “premium” in an international market where the market is less mature or developing. Seasonal offset: A company’s UK sales could fluctuate on a seasonal basis, a risk that could be offset by trading internationally e.g. if UK sales are weather dependent on just two seasons, this seasonal limitation could

be negated by trading in an overseas market that can extend the UK seasonal opportunity. Less competition: Different international markets may have differing levels of competition, the company may be able to identify international markets that are not as competitive as they are in the UK, thereby enabling higher potential profits, higher revenues etc. for a company’s products or services. Increased market opportunity: Products and services may prove more attractive in overseas markets based on local business environment factors such as: social and cultural trends, legislative, technological, economic, environmental and political conditions. Expansion of the life cycle of a UK product or service: At the end of its product life cycle in the UK market, the same product could be introduced to an international market where the same or similar product has never been sold before.

As the domestic market becomes more competitive, and for reasons noted in the previous section, UK businesses are looking at exporting as a way of increasing their revenue and profit streams from overseas markets. Three courses for new and inexperienced exporters are being offered by the Chamber of Commerce to support them at the beginning of their international journey, the course dates are: How to Build Overseas Sales – Essential Tips for Exporting Monday 20 April 9.30am-4.30pm £260+VAT for Members £285+VAT for Non-members How to Select and Manage Overseas Distributors and Agents Tuesday 21 April 9.30am-4.30pm £260+VAT for Members £285+VAT for Non-members Pricing for Export Wednesday 22 April 9.30am-4.30pm £260+VAT for Members £285+VAT for Non-members

For further information please visit: www.hwchamber.co.uk/training

Gaining of new knowledge: Operating in different country markets offers a business the opportunity to acquire new and more market knowledge on competitors, technologies, and information on potential commercial threats and opportunities. Of course, as in any other areas of business, there are also challenges to internationalisation and exporting and a company will need to ensure that these are also fully explored, understood and planned for before starting to export.

MALVERN PANALYTICAL PROVIDE SOLUTION FOR SHELL REGARDING COST SAVINGS ON OIL-RIG WCC FUNDED DOWNTIME COUNTY Deep-sea off-shore drill rig operations are affected by the composition of ENTERPRISES drillings, including oil and rock. Samples OFFER PACKING are usually flown by helicopters to labs on-shore, causing a delay of several AND ASSEMBLY days before results can be delivered. SERVICES Malvern Panalytical’s solution is based on a small, powerful and robust XRF analyser and combined with Shell’s process knowledge, translating elemental composition to drill-rig operation information, offers tremendous savings and benefits for all drill rigs, not only deep-sea rigs. With this instrument on the rigs themselves, the analysis or result delivery time is reduced to less than an hour. This means fast insight into rig operations, potentially saving clients millions of dollars, if drilling operations and production needs to be deferred. www.malvernpanalytical.com

WORCESTER BOSCH DISCUSSES PART L As the UK gears up to face the difficult but necessary challenge of net-zero emissions, heating and hot water in the home is proving to be one of the most essential tasks to tackle. As part of this there are new proposed changes in UK Building Regulations, with the most relevant section being Part L. The document currently concentrates on new properties only but has set out two suggested options in order to uplift energy efficiency standards and requirements in new builds. Whether through increased insulation, certain fabric choices or highly efficient heating systems, new homes are required to show either over 20% or over 31% reduction in CO2 emissions, compared to those built today.

048

The positive is that as we are talking about new build homes, not existing homes where insulation levels and old systems will need to be either retrofitted or upgraded, this is a blank state. Highly efficient gas boilers or electric heatpumps can be easily installed. Also, if they are built on the gas grid, then the homes are open to future carbon-free technologies such as hydrogen-fired boilers. Government believes the cost of new build homes will rise by £2,557 for option one and £4,500 for option two – which may seem steep; however, it is necessary to ensure that the UK reaches its net-zero target by 2050. www.worcester-bosch.co.uk

SKILLS IN THE DIGITAL AND TECH INDUSTRY According to the World Skills Economic Forum, more than half of the current workforce will require new skills by 2022 in order to maintain relevance in the workplace. That’s more than half of all employed people in the developed world requiring training or reskilling in the next 18 months – 2 years. The tech and digital area are already a massive employment sector, worth over £90 billion more than the construction industry, double that of legal and accounting services and three times that of the sports and recreation, film, television and gambling industries combined. The rapid progression of the digital age has seen more and more roles fall victim to automation, however that’s not to say there are less jobs. Simply, that the jobs that are now becoming relevant to the modern-day workplace have changed and require staff to have new and different skills. From cyber security, software testing, data analysis to web design and digital marketing, just to name a few. This is an incredibly exciting shift and now highlights employer ownership of skills, implementing employer defined occupational standards to rocket your business into the new age. This presents a unique challenge for businesses, as the pace at which the landscape of employment is moving is unlike anything seen before in history.

However, pre-empting this, the government introduced a levy in 2016 specifically to fund skills development and apprenticeships in order to proactively meet the inevitable impending skills gap, which all employers can draw from to either employ new apprentices or develop existing staff. So, what that basically means is that employers can access either a 95% or 100% funded apprenticeship programme, offering someone a fantastic new opportunity while also preserving the future of the company’s efficiency and output. The Development Manager (TDM) based in Worcester works alongside businesses to help employers retain and motivate their existing talent as well as attracting new talent.

Derrin Kent, Managing Director at TDM, explains further: “Employers of Tech and Digital staff need to retain and motivate their existing talent, as well as to attract new talent. We deliver ESFA funded Apprenticeships from level 3 through to Higher and Degree Apprenticeships, and now a West Midlands Combined Authority (WMCA) funded Digital Retraining Pilot. Which allows for courses to be delivered more efficiently.”

The May/June edition of Business direction will be titled ‘The Future Workforce is a Skilled One’ where articles will focus on attracting and retaining skilled workers, preparing young people to be the future workforce, health and wellbeing in the workplace and more. Make sure to submit your 150-word article and a high-resolution image online or to businessdirection@hwchamber.co.uk For further information please visit our website where all upcoming themes and deadlines are detailed.
