Terms and conditions
The buyer should endeavour to check all the sale particulars, plans and condition of property, searches, boundaries, leases, measurements, locations, photographs. All measurements and distances are referred to are approximate.
Option 1: On the fall of the gavel contracts are exchanged and the buyer must pay £3,500 or 3% (plus vat) whichever is greater and a £1,500 fee as a property deposit. Completion must occur in 28 days. Prior to the auction legal packs are available and we would recommend buyers and legal representatives to view any special conditions of sale.
Guide Price
Option 2: On the fall of the gavel buyers must pay a £3,500 or 3% (plus vat) whichever is greater and a £1,500 fee as a property deposit. Exchange of contracts to occur within 28 days and completion in a further 14 days.
All properties are subject to a reserve and guide price. The guide price is where the bidding will commence. The reserve price is the seller’s minimum price at auction at which the property will sell for. The reserve price will remain confidential between the seller and auctioneer, and the guide price can be set 10% higher than the reserve price. The guide price and reserve price can be subject to change up to and including the day of auction. Price comparable and rental incomes are deemed fair and used as a guide only and cannot be guaranteed.
Ways to Bid At Auction The bidding is conducted in a user friendly way by way of a bidding paddle, by phone or by proxy. 1. Telephone bidding is very simple, you bid on the telephone during the auction. A member of properties Under The Hammer will contact you a few minutes prior to the property of interest being offered for sale. We will repeat the auctioneer’s word to you and you will instruct us as to how much you wish to bid.
The buyer and representatives are advised to read auction terms and conditions, listed in our brochure and online. It’s important to note whilst the catalogue details are described fairly the buyer must be satisfied with the lot prior to bidding.
You will need to complete a remote bidding form to make a proxy or telephone bid. You can find this online or in the auction catalogue.
Payments and Deposits Deposit may be paid by cheque, debit card or bankers draft or by prior arrangement in the client account of the agents property auction. Proof of identity and address is required to enable us to comply with Money Laundering Regulations. Only original documents must be provided, photo copies will not be accepted. We can accept the following -current signed passport, fire arms certificate, current full UK/EU photo card driving license and resident permit issued by the home office to EU nationals.
2. Should you be unable to attend the auction, you can submit a bid in writing and authorise a member of Property Under The Hammer to act as a proxy for you. The bidding is made in increments as the auction progresses and they do not offer your highest amount automatically.

TERMS AND CONDITIONS 1.1 Introduction and Interpretation 1.1.1 this Catalogue is issued to Buyers and Sellers and their professional advisers (you) on the strict condition that these Auction Terms and Conditions of Business are accepted by you and cannot be waived or varied by any other document or representation including the Common Auction Conditions. 1.1.2 The Common Auction Conditions shall, in this Catalogue, consist of the Glossary, the Auction Conduct Conditions and the Sale Conditions. 1.1.3 References in this Catalogue to the Common Auction Conditions are references to the relevant sections of the Common Auction Conditions of this Catalogue. 1.1.4 Words commencing in capitals have special meanings which are defined in the Glossary in bold blue type. 1.1.5 References to Auction 1 or Auction 2 are references to the type of Auction an individual Lot is placed into. 2. Conditions relating to Auction 1 and Auction 2.
2.1 Auction 1 conditions. The following shall apply in relation to a Lot being sold under Auction 1 conditions: 2.1.1 The Common Auction Conditions will apply subject to the following variations: a) Completion shall take place within 28 days from the date of the exchange (being the date of signature by the buyer of the auction contract)or if that day is not a business day on the next business day; b) The Seller must provide details of any special conditions which relate to that Lot at least 24 hours before the Auction. c) The prospective Buyer is responsible for obtaining copies of any special conditions, legal pack or any Addendum containing variations, and also to verify that no revised version is in place;

d) The right is reserved, without liability on our part, to change a particular Lot to Auction 2 at any time and for any reason and we also reserve the right to withdraw any Lot from the Auction and possibly enter it into the next Auction. e) Subject to the provisions herein, we will enter the Lot into the Auction. f) Annexed to the Auction contract will be a copy of any special conditions and/or revisions by way of Addendum. g) In addition to the deposit payable on exchange of contracts, the Buyer shall also pay to us the buyer’s premium of 3 percent of the sale price of the Property plus VAT, subject to a minimum charge of £3,500 plus VAT.
2.2 Auction 2 conditions If a Lot is being sold subject to Auction 2 the following shall apply: 2.2.1 The Common Auction Conditions will apply insofar as they are not inconsistent with these Auction 2 conditions for the type of Auction conducted under Auction 2. 2.2.2 A sale memorandum will be exchanged upon a successful bid being made. The sale memorandum Is not a binding legal contract for the sale of the Property but notice of intention between Seller and Buyer to enter into a binding legal contract within 28 days of the sale memorandum being exchanged with Completion fourteen days thereafter. In the event that the date of exchange of contracts and/or the Completion date is not a business day, then exchange of contracts/Completion shall occur on the next working day. 2.2.3 The Buyer shall pay a non-refundable deposit of £1,500 to Property Under the Hammer Auction Limited. 2.2.4 If exchange of a binding contact does not occur by the relevant date for exchange of contracts, or such other date that is mutually agreed in writing between the Seller and the Buyer or their legal representatives, the non-refundable deposit is forfeit by the Buyer and is paid to the Seller 2.2.5 In addition to the non-refundable deposit the Buyer shall also pay on signing the sale memorandum, the buyer’s premium of three percent of the sale price of the Property plus VAT, subject to a minimum charge of £3,500 plus VAT to Properties Under the Hamer Auction Limited.

3. Liability 3.1 No liability is accepted on our part for the maintenance upkeep repair or security of any Property comprised within a Lot entered into the Auction; 3.2 Under no circumstances shall we be liable to the Buyer in respect of anything contained or referred to in this Catalogue being incomplete, inaccurate, misleading or unfair, subject to the Buyer’s statutory rights in law.
4. Remuneration 4.1 TheBuyer must pay us a buyer’s premium being commission of three percent of the sale price of the property plus VAT, subject to a minimum charge of £3,500 plus VAT, following a successful bid, whether under Auction 1 or Auction 2. In the event that the Property is sold before the Auction or by private treaty, the buyer’s premium shall be paid by the Buyer upon the Buyer signing the auction contract. Payments can be made by cheque, banker’s order, or electronically by CHAPS or same day payment. No deduction, setoff or counterclaim shall be permitted in relation to such payment.
4.2 Anti-money laundering regulations; 4.2.1 Under the anti money laundering regulations introduced the Government we are obliged by law to identify the Seller, Buyer and any other person or company who is involved in our Auction. Such persons are required by us to provide evidence of their identity and source of funding and/or finance arrangements. Such evidence can be kept by us for at least six years. 4.2.2 We are obliged to comply with the Proceeds of Crime Act 2002 and as such, we must obtain assurance that there is no money laundering and any parties to a transaction are not involved in an offence contrary to the Proceeds of Crime Act 2002, or any related criminal offences. If we have sufficient suspicions relating to any funds sent to our bank we reserve the right to report such suspicions to the relevant authorities and decline to apply such funds to the relevant transaction or return such funds to the party who has paid the funds to us. In circumstances which we generally feel we are unable to complete with the anti money laundering requirements, we reserve the right to decline instructions from Seller/Buyer or any other party.

5. Miscellaneous 5.1 The Catalogue, and any document incorporated or referred to therein, shall comprise the whole agreement between the parties and supersedes any previous arrangement understanding or agreement. Each party acknowledges that in entering into the provisions of the Catalogue, they do not rely on any statement, representation, assurance or warranty made by or on behalf of any person to include, without prejudice to the generality of the foregoing, the Seller, their professional advisers and Properties Under the Hammer Auction Limited. 5.2 The provisions of this Catalogue and documents referred to therein shall apply without variation, unless such variation is in writing and signed or initialled by or on behalf of the relevant party. 5.3 If a clause of this Catalogue and any document incorporating them is found to be illegal invalid or unenforceable, the clause shall apply with such modification necessary to make it legal, valid and enforceable. 5.4 Any dispute or claim arising out of or in connection with the Auction shall be governed by and construed in accordance with the laws of England and Wales. It is hereby agreed and declared that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with such matters.
6. Notices 6.1 Any notice to be given relating to the auction arrangements shall be in writing and shall be delivered by pre-paid first class post to the respective addresses of the parties as last notified to the other parties. Emails shall not be accepted as notices. 6.2 Notices delivered shall be deemed to have been received when: (a) posted from and to addresses in the UK, on the second day after posting; (b) posted from and to addresses overseas, on the tenth day after posting and; (c) sent by fax, the notice shall be deemed received immediately. 6.3 The sender must prove that the notice was correctly sent. A notice which cannot be supported by evidence that it was correctly served will be considered to be invalid.
