Get protected before it’s too late The importance of intellectual property assets In our current economic climate, it is vitally important for a business to maintain a competitive edge in the market place and ensure that it maximises the value of its assets. Intellectual Property (IP) rights, and the commercial exclusivity that they can provide, can be extremely valuable for a business and in many cases, are one of the most important assets that a business can possess. Intellectual Property protection can take a variety of forms, including: n Patent protection for new technologies and

innovations (e.g. new products, processes, and/ or their applications). n Trade mark protection for brand names, slogans, company names, logos etc. n Protection for new designs. n Copyright protection for creative works. To maximise the commercial benefit that IP rights can provide, it is important to take appropriate action to protect your IP. When applying for IP rights, it is advisable to seek professional advice.

As Nigel Sanderson, partner at HGF and Head of the Chemistry Team advises; “The ultimate value of IP rights comes from the commercial protection that they can confer. Any other party that seeks to commercialise a product or service covered by your IP rights will infringe these rights and you have the ultimate option of pursuing legal remedies in the courts to stop the infringement and seek compensation”. In this way, IP rights can be used to provide you with valuable commercial exclusivity and give you a competitive edge in the market place. HGF, one of the UK’s leading patent and trade mark specialists, have a long experience of working with clients to ensure that they maximize the value of their IP portfolio. If you would be interested in a free IP audit check, visit our website at www.hgf.com and contact one of our local attorneys in your area.

In the chemical and pharmaceutical fields, patent protection is a key IP right. Patents provide protection for inventions and one of the main challenges facing innovative chemical and pharmaceutical companies is to recognise when they have created a potentially patentable “invention”.

After our worst winter in 30 years, emergence from a two year recession and our first coalition government in over 60 years, focusing on economic success may not be at the forefront of everyone’s mind. However, during all of this time our chemical industry in Yorkshire and the Humber has shown its strength in depth through resilience, maturity and innovation and proved itself able to weather all that has been thrown at it. Much of this resilience can be attributed to the highly skilled nature of the workforce, which has been developed to meet the ever changing needs of the global markets. This, alongside the regions well developed supply chain infrastructure, bodes well for the chemical industry as recessionary problems ease. It cannot be stated strongly enough how much the chemical industry means to the region. It contributes a staggering £8 billion to our local economy every year and is one of the region’s largest employers. Underpinning this resilient industry is a strong business network, which Yorkshire Forward is proud to support. These networks include Yorkshire Chemical Focus, Humber Chemical Focus and the Centres of Industrial Collaboration, which give invaluable academic expertise and business experience to support SMEs and multinationals alike. We may still have challenging times ahead, but with the expertise of our local companies and their support networks we can look forward to a confident future of our chemical industry in Yorkshire and the Humber. Yorkshire and Humber is home to one of the largest concentrations of chemical related activity in the UK, making up 10% of the UK total. The region’s chemical sector has a diverse range of companies within it, attracting many of the world’s industry giants, together with many independent companies, as well as a high proportion of start-ups. With 14% of all new chemical businesses based in Yorkshire; Sheffield, Leeds and York have been identified by the Royal Society of Chemistry as the UK’s major clusters of chemical science spin-outs. Over 450 chemical companies are located in the region, with over 400 chemical manufacturing sites here and a well-developed supply chain of supporting industries. Expertise in the region is diverse with the chemical industry making products for a wide range of end uses. This includes everything from paper production, plastics and cosmetics to agricultural products. The Yorkshire and Humber Chemical Sector: n Contributes 10% to the UK chemicals’

sector overall. n The sector is expected to grow by 21% by 2012. n Chemicals are our largest manufacturing sector. n The sector turns over £8 billion in our region. n 24,000 people work for 450 chemical companies.

THE UK CHEMICALS MARKET Chemical and pharmaceutical businesses in the UK are a £60 billion industry. Every day for the past decade the sector has added £20 million to the UK balance of trade, whilst the rest of manufacturing has shown a £200 million deficit. The jobs of 600,000 people in the UK depend on the chemical and pharmaceutical industry. Workers in our industry perform high quality skilled jobs reflected in pay levels that are 20% higher than other manufacturing sectors. When people speak about manufacturing, the focus is on sectors like aerospace – an important sector and a key customer for our companies. However, there is more to manufacturing than aerospace: n Chemicals and pharmaceuticals represent

12% of total manufacturing, more than twice that of aerospace. n Chemicals and pharmaceuticals has an average value added per employee of £92,000, nearly 25% more than aerospace. n Chemicals and pharmaceuticals has paid employee costs of £42,000 per head, almost 1/10th more than aerospace. These facts demonstrate how chemicals and pharmaceuticals manufacturing is at the heart of the UK economy. It’s simple; future growth depends on us.

PROVING AFFORDABLE AND INNOVATIVE MEDICINES FOR HEALTHIER LIVES There has been a long history of manufacturing activity at the Mirfield site starting with textile weaving and dyeing at the start of the twentieth century. However, the site is now very much in the 21st century with state of the art manufacturing facilities and has transitioned to become a manufacturer of Active Pharmaceutical Ingredients (APIs) and supplier of Custom Pharmaceutical Services. It has been part of Dr Reddy’s Laboratories, a global pharmaceutical company, since May 2008. Dr Reddy’s was started 25 years ago in India by Dr Anji Reddy with the purpose of “proving affordable and innovative medicines for healthier lives”. In 2001 it was listed on the New York Stock Exchange. The company has grown quickly to exceed $1. 5 billion sales. The company now comprises of 3 business units: n The Proprietary Business comprises of

New Chemical Entities (NCEs), biosimilars and differentiated formulations. n The Global Generics business markets over 200 branded formulations (more than 50 in the US) across the world. n The third business unit is Pharmaceutical Services and Active Ingredients which comprises of the Active Pharmaceutical Ingredients (API)

and Custom Pharmaceutical Services (CPS) businesses. The API business offers over 150 APIs. CPS offers a full range of development and manufacturing services supporting all stages of the pharmaceutical product lifecycle. Mirfield’s role in the global Dr Reddy’s picture is twofold. The site supplies APIs to established customers. It also offers value as part of the CPS organisation. It has particular expertise in chiral technology (where orientation of the molecule is not lost during a chemical reaction) including selective hydrogenation, hydroformylation and biocatalysis. The site is fully equipped with supporting research and development, QA/QC functions, engineering, procurement and logistics. Further support is available from the R&D site in Cambridge and from Dr Reddy’s globally. The site currently employs 60 people and generates approximately £10 million revenue for the Dr Reddy’s Group. In line with Dr Reddy’s corporate values the site has an excellent record in Health Safety and Environment and is keen to work closely with the local community. INDEPENDENT PROCESS SAFETY SERVICES FROM CHILWORTH GLOBAL Process safety deals with the hazards associated with the storage and processing of hazardous materials that, if inappropriately handled or processed, could cause interalia fires, explosions and/or toxic chemical release. Accidents or incidents of these types have the potential for multiple fatalities and injuries both on and off-site, accompanied by major environmental damage. The resulting economic impact, combined with the social impact arising from such an event, can threaten a company’s reputation and commercial viability. Prevention of incidents and mitigating the effects of accidents, can only be achieved if a company has an effective process safety management (PSM) system and the culture to support it. People – at all levels from the CEO to shopfloor workers – are essential components of any approach to process safety, and it is these human factors that have a strong influence on process safety management. The impact of people’s behaviour and communications – whether positive or negative – on the process safety management system is known as the process safety culture. In order to maintain a high standard of process safety management, it is vital that an organisation has a good process safety culture. Based in the UK, the Chilworth Global group

YCF REACH/CLP NETWORK

YCF REACH / CLP Network – to support companies of all sizes, sharing a common goal to implement and conform to the REACH and CLP Regulations. YCF REACH Network has now been expanded to include the new Globally Harmonised System (GHS) for classification and labelling of chemicals. The GHS is being implemented in the European Union as the new EU Classification, Labelling and Packaging (CLP) Regulation (EC) No. 1272/2008. This will eventually replace the CHIP and ADR Regulations. REACH (Registration, Evaluation, Authorisation and Restriction of Chemicals) is a major piece of regulation which came into force across all EU member states in 2007; it replaces a number of European Directives and Regulations with a single system. It has global implications and affects the whole of the chemical supply chain in the EU, with a resultant impact on companies’ time and resources. REACH has several aims: n To provide a high level of protection of

human health and the environment from the use of chemicals. n To make the people who place chemicals on the market manufacturers and importers

responsible for understanding and managing the risks associated with their use. n To allow the free movement of substances on the EU market. n To enhance innovation and the competitiveness of the EU chemicals industry. n To promote the use of alternative methods for the assessment of the hazardous properties of substances e.g. quantitative structure-activity relationships (QSAR) and read across. A major part of REACH is the requirement for manufacturers or importers of substances to register them, supported by a standard set of data on that substance. The amount of data required is proportionate to the amount of substance manufactured or supplied.

RESPONSIBLE CARE CELL (RCC) In the UK this rigorous, voluntary programme is led by the Chemical Industries Association and hosted by YCF. This network brings local companies and regulatory bodies together to discuss environmental, process safety, occupational health and hygiene, emergency response, community liaison and industry reputation issues. There are currently 17 local Responsible Care Cells, of which West Yorkshire is one of the most active. WHAT IS RESPONSIBLE CARE? Responsible Care is the chemical industry’s global voluntary initiative, under which companies work together to continuously improve their health, safety and environmental performance, and to communicate with stakeholders about their products and processes. Responsible Care helps our industry to operate safely, profitably and with due care for future generations. Through the sharing of information and a rigorous system of checklists, performance indicators and verification procedures.

THE PURPOSE OF THE CELL IS n To share experience, concerns and best practice on all aspects of health, safety and environmental management. n To

discuss appropriate local industry reputation and community issues with the aim to improve the reputation of the industry both nationally and locally. n To provide an effective forum for members

and Regulatory Agencies to hold open and honest discussions in a neutral environment. Cell members are typically Health, Safety and Environmental Managers, Technical Managers or Health and Safety Practitioners. Member companies range from small local firms to large multinationals, including those not generally regarded as ‘chemical’ companies. The Network meets 4-5 times a year. Membership of the network is open to manufacturers, importers, only representatives and downstream users. Regulators, stakeholders, services providers, consultants and experts attend the meeting by invitation only. The Network is free to attend, preregistration is required for all meetings.

EXPLOSION HAZARD TESTING LIMITED

Virtually all process industries have the potential for fire and explosion in their workplace. With the subsequent loss of production and the possibility of injury to personnel and damage to plant this applies to the chemical and auxiliary industries in particular.

We offer:

We all rely on material safety data sheets but most have little or no useful information on the flammable / explosive properties of material we are working with. Of course pure materials are made into mixtures and then how many of us know the true properties of those mixtures.

Wherever possible testing is carried out to the relevant British, European or American standards.

They may become safer or more flammable / explosive than the individual components. Any change significant in formulation can alter the properties.

EPSRC INITIATED A SERIES OF GRAND CHALLENGES IN NANOTECHNOLOGY In 2007 the Research Councils, led by EPSRC initiated a series of Grand Challenges in Nanotechnology to take Nanoscience from Engineering to Application. From the outset, each Grand Challenge project was required to be an integrated, interdisciplinary effort, encompassing basic and applied research intended to move the technology towards deployment. The first research projects on Solar Energy started in 2008, the second on Healthcare in 2009 and the third, on Carbon Capture and Utilisation starts this year. There was consultation with the scientific and stakeholder community on each occasion to define the topics within each call and this has resulted in some very exciting projects, many involving more than one research centre and with the key objective of producing results that can be translated into practice and commercialisation. The ÂŁ16.5 million in nano for healthcare focuses on developing new techniques for screening and treating major public health issues such as cancer, stroke, AIDS, influenza, MRSA and dementia. There is an emphasis on using nanotechnology to develop healthcare solutions for the future, particularly through working in partnership with business and end users towards developing cheaper, more effective treatments, according to public need. The Challenge was developed in close consultation with members of the public

50 Yorkshire Chemical Focus Directory

and took account of their aspirations and concerns relating to potential nanotechnology applications for healthcare. The UK has great strengths in biomedicine and the global market in healthcare is of both a high monetary and societal value. It is becoming clear that nanotechnology might provide solutions for improved diagnosis and medical imaging, and drug delivery, offering the possibility of lower doses of medicine targeted at the places in the body where they are most needed. THE SPECIFIC PROJECTS ARE: n Point-of-Care nanotechnology for early blood clot detection and characterisation in disease screening, theranostic and self monitoring applications. (Swansea University and London School of Pharmacy). n Bio-functional magnetic nano-Particles:

Novel High Efficiency targeted Agents for Localised treatments of Metastatic Cancers. (UCL). n Detection of infectious organisms:

a controlled approach using genomics, molecular engineering and nano-enabled bio-MEMS technologies (Newcastle University). n Silicon Nanowire Arrays for Viral

infection markers (Southampton University). n Multi-marker nanosensors for HIV

(UCL). n Engineering virus-like nanoparticles

for targeting the central nervous system (Sheffield University). n New imaging methods for the

detection of cancer biomarkers (Middlesex University). n Nanoparticles for the targeted delivery

of therapeutic agents to the brain for the treatment of dementias (UCL). By formulating nanoparticles in the size range of 65-100nm with a neutral or negative surface charge and then delivering to the brain, this project hopes to achieve a widespread dispersion for therapeutic delivery. Agents such as genes, siRNA and beta amyloid-degrading enzymes may be delivered.

for the treatment of brain diseases (London School of Pharmacy) This project will identify the mechanism by which nanoparticles cross the blood-brain barrier and engineer nanoparticles to achieve this and deliver therapeutic agents. These projects will undergo a Stage Gate process and the most promising will be awarded further funding to take the work on to the development stage, matched with additional funding from sources outside of the Research Councils. This will ensure that there is a high degree of Research Council support to these projects during the critical early stages. Peter J Dobson (Strategic Advisor on Nanotechnology to RCUK) Chris Jones (Manager Nanotechnology and Physical Sciences Strategy Development, EPSRC)

n Non-Attrition Highly Active Antiretroviral

Therapy nanoparticles for HIV/ AIDS drug delivery (Liverpool University). This project will also be assessing novel high throughput assays that can be used for rapid material evaluation and be useful in the field of nanotoxicology. Technologies

REMAIN COMPETITIVE IN THE 21ST CENTURY BY EMBRACING NEW TECHNOLOGIES Micro and nano-moulding processes allow large volume production of high valueadded components for lucrative markets. The Centre for Micro and Nano Moulding forms a brand new facility within the world class Polymer IRC laboratory based at the University of Bradford. This Centre allows open access to equipment and expertise required for companies of all sizes to develop a successful micromoulding or nano-scale surface feature moulding process. WHAT ARE MICRO- AND NANOMOULDING? Recent advances in micro and nano-technology are realising devices with a huge range of applications in the telecommunications, biomedical and automotive sectors. However, batch-process manufacturing techniques such as silicon micromachining and lithography can be expensive and have limited output. Micromoulding has emerged as a technique for micro-device and nano-scale surface feature manufacture, which offers all the benefits of conventional injection moulding such as high production capacity at low marginal cost. CUSTOMER FOCUSED R&D Our laboratory has been actively researching micro-moulding since 2001 when we were awarded an Engineering and Physical Sciences

56 Yorkshire Chemical Focus Directory

Research Council (EPSRC) grant which was the first to be awarded in this research area. We have since expanded our activities to include a range of micro-moulding process technologies and metrology equipment, which allows us to keep at the forefront of technology advancement. Our research activities fall in three main areas: POLYMER RHEOLOGY Measurement of the flow properties and material consistency of the polymer melt. Materials subjected to the high injection speeds and small cross sections of micro-moulding cavities can experience wall shear rates and associated shear heating effects which are orders of magnitudes higher than those seen in conventional injection moulding. We have pioneered work investigating the flow behaviour of a range of materials under typical micro-moulding flow conditions and are actively researching the effects of mixing, behaviour, thermal considerations and the presence of impurities on rheological properties. PROCESS CHARACTERISATION In-process measurements are vital to fully understand the micro-moulding environment. We have investigated a variety of sensor technologies including ultrasound, magnetostrictive, advanced thermocouple and piezoelectric designs to accurately quantify

machine dynamics, pressures and temperatures within the mould cavity. High-speed camera based optical techniques have also been adopted to provide full field evaluation of micro-moulding flow behaviour plus stressinduced birefringence contours and shrinkage measurements. This data is helping to develop simulation software which provides a route for micro-moulding process design without costly R & D trials.

This combination of equipment provides flexibility and allows us to fabricate a variety of component types from a range of materials including engineering thermoplastics, nanocomposites and metal and ceramic powders. www.microandnanomoulding.co.uk

PRODUCT PROPERTY EVALUATION One of the major challenges associated with micro-moulded products is how to quantify the geometric, mechanical and morphological properties of the products. The physical size of these products has required us to adopt advanced characterisation techniques such as Atomic Force Microscopy, White Light Interferometry and Scanning Electron Microscopy for product metrology. We are also investigating a number of in-process inspection techniques allowing quality inspection of 100% of the manufactured products prior to assembly and packaging operations. The Centre has an extensive range of processing hardware specifically designed for micro and nano moulding activities, including: n Battenfeld Microsystem 50 n Fanuc 2000i Roboshot n Rondol High Force 5 n MILC (twin screw compounding/

micromoulding).

Future of the European Chemical Industry

The European chemical industry is facing the dawn of a new reality. While the industry worldwide is still reeling from the current cyclical downturn and the recent global recession, chemical companies in Europe are faced with the ongoing rise of new competition in the Middle East and Asia (especially from China and India). These factors appear to be driving an inexorable shift eastward in the global chemical industry, particularly at the bulk / commodity end of the sector. Indeed, our research suggests that new global capacity being developed in the coming years will render 14 of 43 crackers in Europe

uneconomic by 2015. The closure of these plants would correspond to the loss of 26 percent of total cracker capacity in Europe. At the same time, Middle Eastern chemical producers continue to seek expansion along the value chain into higher value add solutions. Their Chinese counterparts are attempting to fulfil a government directive to make the country self sufficient in chemicals. These Middle Eastern and Chinese entities are often cash rich and backed by government support. A rapid path to achieving these goals appears to be offered by acquisition of technology and intellectual property from a European chemical industry seemingly beset by structural problems. However, KPMG believes that the death knell of the European chemical industry has been sounded prematurely. This remains an industry that employs over 1.2 million people and contributed in 2007 to a European Union (EU) trade surplus in chemicals of EUR 35.4 billion. There is no doubt that the shape of the global chemical industry is changing, but the industry in Europe can continue to play a significant role in this new reality if it can: n Make hard choices now to rationalise

unprofitable facilities that might not be able to compete with newer, more efficient plants being built outside of Europe

innovation to stay ahead of the competition, especially in terms of sustainable solutions which will be increasingly in demand

n Leverage

its longstanding customer relationships to develop more specialised, higher performance solutions n Actively seek beneficial joint ventures and

strategic alliances that provide access to both cheap Middle Eastern feedstocks and growing Asian markets Many European companies are already recognising the possible advantages – and the necessity – of repositioning themselves as solutions providers rather than just basic suppliers for their customers. This can include finding new ways to work with companies that have traditionally been perceived as major competitors. The companies that successfully achieve this transition should be better positioned to meet the global competitive challenges of the 21st century.

INVESTIGATING THE HIDDEN COSTS OF IN-HOUSE SAMPLING Effective sampling is essential to driving chemical sales. However the hidden costs and inefficiencies of in-house sampling could be having a negative effect on the growth and profitability of many businesses. The points outlined below are some of the key issues to consider when comparing in-house versus outsourcing:

PACKAGING

Sampling is not a core function for most chemical manufacturers and distributors. Therefore sourcing a range of sample packaging in terms of size, materials etc can be problematic and expensive. SampleRite stocks a wide range of packaging options to meet every possible need and legislation.

LOST SALES

Getting samples to customers quickly and before your competition is crucial in turning samples into orders. In-house sampling may not provide a fast enough service, resulting in the risk of your competition getting samples in first and ultimately winning the business.

REPORTING

Many companies do not have a reporting facility for sample activity. This makes it difficult to follow up on samples and runs the risk of missed opportunities. SampleRite provides a monthly report of sample activity.

STOCK MANAGEMENT & WASTE

Managing sample stocks effectively is crucial in minimising waste. In-house sampling can often result in part containers which are redundant for sale, compromised product quality and stock which is out of shelf life. SampleRite works closely with clients to ensure stocks are managed efficiently, taking into consideration the needs of the business (e.g. product launch/withdrawal), and therefore keeping waste and disposal costs to a minimum.

INTERNAL ADMINISTRATION

Processing a sample request, including order entry and arranging transport takes time. SampleRite offers an online ordering system, which can reduce time and therefore costs involved in administration. A confirmation email is sent when an order is both received and dispatched, eliminating the need for chasing colleagues internally. CSV uploads are also an option for those clients with CRM systems.

TRANSPORT

Freight is not one of the typical ‘hidden’ costs and can generally be easily identified. However, many companies do not send samples out regularly and can be subject to excessive transport prices, particularly on hazardous. SampleRite sends out on average 25,000 sample bottles per year. Our clients benefit greatly from volume-driven transport discounts and the knowledge of the best companies to use for the destination in question.

LABOUR

On average it takes approx 25 minutes to complete a non hazardous and 50 minutes for a hazardous sample, including decant, labeling and paperwork. Depending on the salary of the employee(s) involved and the number of samples dispatched, labour costs can quickly add up. It is also often the case where sampling is part of someone’s job (e.g. Chemists, warehouse staff) and as a result may detract from their core role within the organisation.

DOES YOUR ORGANISATION HAVE THE RIGHT TEAM TO RIDE THE RECESSION?

Is the business using the correct recruitment methods to identify high performers who will have an immediate impact?

Over the last two years it has become an increasing challenge for organisations to ensure they have the right staff in place, especially as many organisations have been forced to make considerable cuts to their teams.

Understanding the current workforce requires the creation of consistent analytical reference points enabling none-subjective measurement of each individual. Senior management need to agree these measures within their business function, therefore facilitating the analysis of their teams.

However, many organisations are making these critical decisions, often without a true understanding of what employees their business requires to deal with the immediate challenges and more importantly to capitalise on growth when it happens. Critical decisions about the workforce require the development of consistent analytical points of measurement for each of the business functions. Analysis of employee performance against these points enables insights into the workforce profile, identifying strengths, weaknesses and gaps. Understanding the staffing related challenges will ensure the people aspect of business strategy is fit for purpose. Does the organisations have the right staff to deal with today’s business and tomorrow’s growth? Is the business able to provide the training required? What percentage of the current workforce is due to retire in the next 3-5 years? Is the business attracting the right talent?

Once the workforce questions have been answered and the existing employees have measured, a more complete staffing strategy can be created to meet the needs of the business. This strategy will drive training requirements, people management and recruitment plans. Effective recruitment is often critical to the creation of a workforce strategy. Organisations that truly understand their workforce challenges, will identify gaps in their current staffing. Filling these gaps with the right individuals often requires competitor talent mapping, innovative attraction techniques and the creation of successful recruitment partnerships. If your organisation requires more information about talent mapping and the creation of innovative attraction techniques, please contact us at Search Consultancy at: www.searchconsultancy.co.uk Audrey McCulloch Associate Director- Scientific Division Search Consultancy
