PUNE: Maharashtra’s cooperation minister Subhash Deshmukh has said the amendments to the State Cooperative Societies Act, 1960 will be “citizen friendly”. A high-powered committee will ensure that the changes are in agreement with the Maharashtra Housing Federation’s views, he added. The bill, put up in the ongoing winter session last week, will come up for discussions in the assembly on Tuesday.

“The amendments will make the functioning of housing societies easier. The housing federation has expressed its concern about several issues. One of them is the Rs 25,000 fine on committee members for not providing details. The other is the provisional membership in the society to the nominee after the death of a member. Once the bill is taken up for discussion, points will be incorporated through a study and checked before it is in force,” Deshmukh told TOI on Monday.

The proposed bill states that any member can inspect for free during the society’s office or at a time fixed for the purpose by the society, the copy of the bye-laws, all the records, books of accounts and correspondences, excluding personal information of the other members.

The society shall furnish the documents requested by the member, “possibly by charging fees as decided by the registrar, within a month’s time,” the bill proposed by the cooperative minister

says.

The federation has strongly demanded the cancellation of the Rs 25,000 fine on committee members suggested as part of the amendments to the State Cooperative Societies Act.

Vice-chairman of Maharashtra State Cooperative Housing Federation Suhas Patwardhan said, “The proposed fine amount is too high. Some society members can harass the committee.’’

The federation has sought a detailed discussion on the proposed amendment that associate members or the co-owners will not have their names on share certificates and not contest elections but can perform duties on the owners’ behalf after their consent. Patwardhan said the fine amount should be around Rs 5,000 and the rules about associate members needs deliberation.

The proposed bill also rules out a real estate agent as a committee member, which the federation has supported. It also agreed with the move for 50 per cent members’ consent for redevelopment of their society.

The federation opposed the change about the nominee of a property, upon the owner’s death, would be a provisional member or act as a trustee and become an actual member on the basis of testamentary documents, succession certificate, legal heirship certificate, or documents of family agreement executed by those entitled to the inheritance. It will be a long drawn process, Patwardhan said.
