HOW LICENSEES CAN STAY ON THE RIGHT SIDE OF THE LAW Licensing has changed quite a bit over the course of the last few years - from the Licensing (Scotland) Act 2005 to the Alcohol etc. (Scotland) Act 2010 and the Criminal Justice and Licensing (Scotland) Act 2010. There will be further changes to come with yet another Licensing Bill to be laid before Parliament before summer 2014. Here’s a quick guide to some things you need to know to stay on the right side of the law. Most important: If in doubt, take advice! Thanks to Stephen McGowan of TLT

A MISTAKE BY YOUR STAFF COULD COST YOU YOUR LICENCE!

Your licence can be revoked or suspended as a result of a mistake made by your staff. If a staff member sells alcohol to someone under 18, you, as licence holder, can be prosecuted as well as your employee. It is not enough that all your staff have 2 hours training, although if they are involved in the service, delivery or sale of alcohol that is a requirement. It is not even enough that they are personal licence holders. The law makes clear that it is your responsibility to make sure that your staff are fully up-todate and made aware of the changes and their obligations. All of the rules about promotions are conditions of your licence. If they are breached, your licence could be suspended or even revoked. It is recommended to carry out refresher training for staff at least every six months. If something goes wrong, the more information and training records you have the better. You should be able to show that you have a good system in place to prevent a breach of the law. Training is very important and keeping that training refreshed and up to date is just as important. Record all training - internal to the premises and that carried out by external training providers. Keep clear records and make sure these are updated and available for inspection on the premises by police or LSO’s. You are not required to do training all by yourself but make sure if you delegate this to managers that you check it is being regularly updated and that they are recording the training and keeping the records in the premises. Also make sure those doing the training are allowed to under the legislation. For the 2 hours training, the trainer must be a personal licence holder. Even if your staff have been with you a long time and you trust them, always remember as an operator you need to protect your livelihood.

AGE RELATED SALES – YOU MUST HAVE A POLICY FOR CHECKING YOUR CUSTOMER IS OVER 18 The minimum legal age of 18 has not changed but under the 2010 Act, premises must have a policy for checking they are not selling alcohol to persons under that age. If anyone serving believes a customer may be less than 25 years old, steps must be taken to verify the customer’s age. It is essential that all staff involved in the sale of alcohol are made aware of this policy. All staff should receive training and regular reminders. Posters and notices in staff areas and in the main shop are useful. Till prompts should be considered. All of this will help if a staff member fails to ask for ID from someone who is clearly under 25 years old and a test purchase failure is brought to the courts or to the licensing board’s attention. Detailed records should be kept of everything and a refusals book should be in place. If a sale is refused, this should be recorded. It is sensible to record as much information as possible, such as where ID is requested and produced. This shows a pattern of requesting ID. While that can be a challenge at a busy bar or till, the more information the better is the general rule. The policy held by each premises must be in writing and it should be checked and updated regularly. Acceptable ID is: passport, EU (photographic) driving licence; photographic ID card approved by the PASS scheme, and as of 1 October 2013, military ID, biometric immigration ID, and EU identity cards together with identity cards from Norway, Iceland, Switzerland, Liechtenstein. No other ID is currently acceptable. Make sure staff are trained to know what these forms of ID looks like - there are many fake and lookalike cards in circulation. You should note that licence holders and staff have a “right of refusal” and if ID presented is unfamiliar or unconvincing then the sale should be politely refused. Having an age verification policy in place is a mandatory condition of all premises licences and must be adhered to. It is no longer voluntary.


LICENSING If the designated premises manager resigns, dies or ceases to act as premises manager for any other reason, the relevant licensing board must be notified within seven days. That is seven days – not seven working days. This is a very tight time scale. If this is missed, premises can be forced to stop trading until an application to change the premises manager is lodged. As long as the seven day notification time is met, from the date of the change to the premises manager there is a 6 week period available in which to lodge an application with the board to change those details. It does not have to be granted within six weeks, just lodged. The six week countdown begins on the date the change happens. If the seven day deadline is missed, the premises would not properly be able to trade until the new manager appointment was lodged. This can be deemed to be granted as soon as it is lodged with the relevant board. If the six week deadline is missed, premises would have no designated premises manager on the premises licence until an application to name a new manager is lodged. That may mean the premises have to cease selling alcohol until then. It is important these time scales are met. If there is a change to the name or address of the premises licence holder or premises manager, the relevant licensing board must be notified within one month of the change. DISPLAYING YOUR LICENCE - AND KEEPING IT SAFE The licence comes in two parts – the summary and the main licence. The summary has to be ‘prominently’ displayed in the premises. This means it should be able to be seen by members of the public who are in the premises at all times. It should NOT be behind a counter or in an office – but should be accessible to the public. It is an offence not to display this properly. The main licence should not be displayed but should be kept in the premises. It is an offence not to be able to produce the licence when asked for it by the LSO or police. To avoid lost licences, a certified copy can be displayed and stored in the premises and the original kept in a safe location. Only the Clerk to a board or a solicitor can certify copy licences at present. If the principal licence is lost or stolen, this is serious and you must report that to the police. They will give you a reference number. To get a new principal premises licence certificate, an

application must be made to the relevant licensing board. They are likely to ask for a note of the police reference number. Without that reference number, the board may refuse to issue you a new licence. PROMOTIONS : GOOD FOR BUSINESS - BUT YOU HAVE TO STICK TO THESE RULES Promotions were dealt with in the original Licensing (Scotland) Act 2005 but have been changed with the recent legislation. Mandatory conditions have been sent out by licensing boards in Scotland and every licence holder should now be displaying these. Premises can still have drinks promotions but must be careful not to breach these mandatory conditions. Each board area and their respective Licensing Standards Officers can apply slightly different views and interpretations to promotions so take advice on these before going ahead. A “promotion” can be anything that encourages people to buy alcohol. It does not have to be advertising a specific product or brand. Even a sign saying ‘Cold Beer Sold Here’ could be considered a promotion. Things to think about include discounts and special offers. Alcohol cannot be given away free. Offers such as ‘three for £10’ are no longer acceptable. A single unit cannot be sold for more than a multipack price. If three cans of lager or three vodka and cokes are sold, the price for the three must be at least three times the price of the individual drinks. A single vodka and coke is sold at £1 therefore three vodkas and coke must be at least £3. You can no longer offer any of the following buy one, get one free; three for the price of two/five for the price of four and so on; cheapest free; buy six (or another quantity) and get 20% off. Off sale premises can have two alcohol display areas – one public area and a secure area (i.e. an area inaccessible to the public). In on sales premises, some boards do not require off sales areas to be shown. If you operate an on sales premises, but your licence allows you to sell alcohol for consumption off the premises, you may have to show your display areas such as behind the bar, wine fridges and similar on your plans. Changes to these areas may need a variation application so be very careful and take advice before going ahead with proposed changes. Alcohol and other goods can be displayed but there are restrictions on mixing displays of alcohol and non-alcoholic goods. These apply only to the public areas – not the secure areas, which are normally

behind a counter or bar. Alcohol, non-alcoholic drinks or anything which is packaged with alcohol can be displayed. Branded, non-alcoholic products in this area may now be displayed in this area, such as a sporting items bearing the logo of a drinks company, or clothing with a sdrink’s brand name. Newspapers, magazines and other publications can also be displayed. No alcohol can be displayed outwith the alcohol display areas. Any free newspaper, magazine or other publication which contains promotion of alcohol, cannot be displayed in the main store unless the space devoted to alcohol is less than 50% of the total space. The way promotions are advertised is also regulated. This includes not only the wording (and sometimes images) on posters, displays and leaflets but also ‘A boards’ on the street, window graphics and in-store magazines. A window display for an off sale premises which is outwith its alcohol display area, may not be used for alcohol promotions. Drinks promotions cannot be run within 200 metres from the boundary of the premises. The boundary is shown on the layout plan which is attached to the premises licence. Anything distributed within the 200 metre zone must not be a “drinks promotion”. Flyers that contain less

than 50% of material promoting alcohol can be distributed. Bus stops and passing buses were also a concern – how can premises be held responsible for promotions which are within 200 metres of their premises but are not associated with nor controlled by the premises? New regulations confirmed that operators can only be responsible for promotions which are in connection with the premises and you have some control over them. Even in-store tannoy announcements and radio cannot carry alcohol promotions, unless they are heard only in the alcohol display area. If the store is a dedicated off sales then that may not be an issue. Promotional material from drinks companies linked to alcohol promotions must be displayed in the authorised alcohol areas only. If these items are for sale and do not constitute a drinks promotion, they can be displayed anywhere in the premises. Operators must be careful not to run promotions, such as “five pints and you get a free hat or ball”. If there are promotions being run in conjunction with sports events or other events, such as Christmas, St Patrick’s Day and so on, advice should be taken on how to incorporate the promotional goods without breaching the conditions.


FUNERALS - OCCASIONAL LICENCES AND EXTENDED HOURS Previously, occasional licenses and extended hours caused problems because they could not be obtained at short notice. This particularly caused problems for funerals andante for public halls and other buildings where a function may have been arranged at less than four to six weeks notice required by most boards. Now, where the Licensing Board is satisfied that the application requires to be dealt with quickly the occasional licence can be advertised for less than 21 days to any period of not less than 24 hours. It is up to the Board to determine how short a period between 24 hours and 21 days. Extended hours to allow later opening at the start or end of a day are also given the same reduced periods, this time between 24 hours and 10 days. PERSONAL LICENCE APPLICATIONS Personal licence applications have been made a little more difficult only because the applicant must sign the application and it cannot be signed by a solicitor or agent. On the plus side, this avoids operators or managers signing applications for staff and means all staff are therefore aware of what information has been included in any application for personal licence. PERSONAL TRAINING

REFRESHER

Every holder of a personal licence must pass a refresher training course within five years of the date the licence was granted issued, and present evidence that this has occurred to the licensing board within three months of that five year deadline. The refresher course is a half day version of the full course applicants had to pass in order to apply for the personal licence originally. A large number of personal licence holders were granted or issued their licence on or before 1 September 2009. For these licence holders, the refresher training must

be passed before 1 September 2013 and the certificate presented to the relevant licensing board before 1 December 2013. It is strongly recommended that all personal licence holders get booked on a course as soon as possible as there is expected to be significant demand and there are concerns that some may miss the deadline. If the course is not passed in time, or if the updated certificate not presented in time, then the licensing board has no option but to revoke the licence and you cannot reapply for five years. It is incredibly important that personal licence holders therefore get booked on a course in plenty of time. For those licence holders issued or granted after 1 September 2009, the same five year and three month deadline apply but will be calculated based on the relevant date which applies to that licence. Any personal licence holders who are unsure of their obligations should seek immediate advice. WHAT THE LICENSING STANDARD OFFICER CAN DO NOW... L i c e n s i n g Standards Officers have more powers introduced by the Criminal Justice and Licensing (Scotland) Act 2010. They now have powers to enter, inspect and seize items. They can take copies of documents or entries in documents found on the premises and can seize and remove any substances, articles or documents found on the premises. They now also have the power to require any document which is stored in electronic form to be produced in a legible format. You are not required to produce a document if you could refuse to produce that document in any proceedings in any court on the grounds of confidentiality of communications. You can also refuse to produce it if to do so would incriminate that person, that person’s spouse or civil partner. Where a LSO seizes any substance, article or document, they must leave a notice on the premises stating what was seized and explaining why it was seized.

elhaven Best remains Scotland’s top-selling ale, despite fierce competition from Caledonian Best. The brand has been promoted with extensive marketing activity in 2013 which included a return to television advertising as part of a combined £4.5m promotional campaign, while the brand also launched a new TV campaign for Belhaven Black. Belhaven Best has been a proud supporter of the Scottish Golf Union since 1999, which is worth raising a glass to. Belhaven Best is the Scottish Golf Union’s biggest and longest serving sponsor. The Belhaven Best Scottish Club Handicap Championship is Scotland’s biggest participation golf event, with more than 25,000 golfers taking part every year, and its trade golf challenge is well respected too.

Caledonia Best, Scotland’s fastest growing ale, has been building listings and market share through its programme of brand engagement led by golf and rugby sponsorships. The brand deployed its partnership with Clubhouse Captain and golfing legend Sam Torrance by treating club stewards to a great day of golf in March at Dundonald Links. 2013 also saw Caledonia Best stage the exciting finale to their summer long tournament for trade customers at the 5 star La Manga resort on the South West Spanish coast. 2014 will see the brand continue its golfing activity as well as a partnership with Scottish Rugby as the official partner to the national team, Edinburgh Rugby, Glasgow Warriors, the Emirates Airline Glasgow 7s and London Scottish Rugby.

John Smith’s The UK’s biggest-selling ale is named after Tadcaster’s most famous son, John Smith, who founded the North Yorkshire brewery in 1847, to meet the thirsty demands of the town’s thirsty mill workers and factory hands. Brand owner, Heineken, continues to support its famous No Nonsense ale with focused marketing campaigns designed to appeal to the brand’s primary target market, built around John Smith’s sponsorship of a UK wide, all-year-round programme of flat and jump racing at racecourses around the UK, including John Smith’s race days at Ayr and Musselburgh, however the brand is no longer sponsoring the Grand National.

McEwan’s Wells & Young’s Brewing Company, McEwan’s owners, announced it had bolstered its presence in Scotland with a new team based in Edinburgh towards the end of 2013. As well as appointing Peter Mooney, to lead the Scottish team, they also appointed two new brand ambassadors for McEwan’s who have been assigned to increase the brand’s presence in bars. The company also added a new ale to the range in 2013, McEwan’s Red, aimed at a younger audience. Sampling campaigns and new brand initiatives are planned for 2014.

Hornsby’s Cider Hornsby’s cider launched exclusively in the on trade in July 2013. This new addition to C & C Group’s cider portfolio offered a bold new proposition of ‘cider served the American way’. Hornsby’s has a softer carbonation and is designed to be enjoyed chilled and straight from its stylish 330ml long neck bottle. The brand has enjoyed success since launch, driven by promotional in-bar activity that brought Classic Americana style to outlets across Scotland. This activity will continue throughout 2014.

n Summer 2013 Magners celebrated the heritage of the brand by launching its ‘Now is a Good Time’ advertising campaign - encouraging people to get together to enjoy the ‘Now’. Towards the end of 2013, the brand also brought back the traditional green associated with the cider when it launched in the UK in 2005, with the unveiling of a striking new packaging design. The vibrant new design helps, say the company, reinforce the brand’s Irish heritage and give greater standout on-shelf, on back bars and in fridges. In the on-trade, a new glass was introduced. The re-worked design now suits both draught and over-ice variants and brings to life the cider vat icon featured across all new pack designs. The addition simplifies the Magners on trade offering and creates a more streamlined look and feel for the core range and Golden Draught. In 2014, Magners will continue to sponsor Celtic Football Club.

Kopparberg This popular Swedish brand rounded off 2013 with the news that Mitchells & Butlers had named Kopparberg its Supplier of the Year. It was just another reason to celebrate after the brand revealed record breaking sales, and its inclusion on the Cool Brands list for 2013/14 and Best Performing Beer/Cider on the Youth 100 list for the second year in succession. During the summer the brand posted volume increases in July of 79%, followed by a 55% increase in August compared with the same months in 2012.

Strongbow Strongbow is far and away the largest brand in the Cider category, accounting for 6 out of 10 pints consumed on draught in the UK. The brand has embarked on a journey of transformation over the last 12 months, introducing new look fount and branded glassware , a new ‘Earn It.’ marketing campaign and Strongbow Pear, a refreshing new flavour variant offering a distinctive pear aroma that is low in sweetness and easy to drink.

GIN THE BOTANIST

T

he Botanist, is a small-batch, artisanal Islay gin that uses nine of the classic gin aromatics – orris root, cassia bark, coriander seed, etc – and augment these with a heady harvest of 22 wild, native island botanicals, hand-picked by an expert foraging team from the windswept hills, peat bogs and atlantic shores of the Hebridean island of Islay. This truly seasonal and exotic cocktail is then slow “simmer” distilled in its unique and cherished lomond pot still, “ugly betty”. Betty prefers to work at low-pressure and won’t be rushed. So its precious botanicals are slowly and gently coaxed into releasing their complex, signature aromatics. This was a unique project for head distiller, Jim McEwan. Jim says he had to “learn a new dance” with Betty, and its first distillation took 17 hours. The result was a highly distinctive, complex, floral gin with outstanding finish and impeccable provenance. In an age of re-badged industrial gins, the Botanist stands out as a truly artisanal, small-batch, hand-crafted labor of love and distiller’s art. A breath of botanical Islay in every glass.

Edinburgh-based independent bottlers Wemyss Malts, produce Darnley’s View Gin, an award winning small batch London Dry gin. It’s now available in two formats with different botanicals, as a light floral gin with a focus on elderflower and citrus (the original Darnley’s Gin) and now also as Spiced Gin with an emphasis on warming spice botanicals such as cinnamon, nutmeg and ginger. Spiced Gin has been quick to win several key awards this year including a Gin Masters from Spirits Business magazine and silver medal in the IWSC. While Darnley’s View, added to its awards with a Silver Medal in the Premium Gin category of this year’s Gin Masters.

NB Gin NB Gin, from North Berwick has been made with carefully sourced ingredients and using the best techniques to create a premium quality product. It’s made from pure British grain spirit and a combination of seven botanicals, all of which have been meticulously selected to produce a deep and balanced flavour. The gin is stilled, blended, bottled and labelled by hand in North Berwick in very small batches, to ensure that every bottle is of the highest quality. The still itself was custom built in London and installed in North Berwick by the oldest makers in the world, their first gin still being made in the early 1800s. Launched in October 2013, there has already been great demand for the new spirit. NB is owned by husband and wife team Steve and Viv Muir who are delighted with its progress so far. Expect to see a lot more of NB in 2014. Sipsmith’s While Scottish gin is making great progress Sipsmith’s in London is the English equivalent of a artisan gin. The guys behind it certainly have a modern take on producing gin. They are all with drinks industry experience and call themselves “sip-smiths” to celebrate the craft of distillation and their artisanal methods. They are located in a building that was once home to the esteemed whisky expert Michael Jackson, but now it is where they craft and hone Sipsmith Gin. The team also brought on board a one-of-a-kind copper pot still, called in Prudence, and started producing a great of range of handcrafted small batches gins. It looks modern and is quirky too. In Scotland bartender Alec Dyson is your man. 27

MONSTER Monster is the 3rd largest Energy brand in the on-trade and the 5th largest contributor to total packaged soft drinks. The on-trade energy drinks market is worth around £220 million and is still experiencing double-digit growth. This Coca-Cola Enterprises Brand is forging ahead and gaining market share and is the “preferred energy drink” of Carlsberg. They distribute through their freetrade network. This deal was designed to expand its energy drinks distribution in the on-trade. Twitter for Monster is all about their hashtag #UnleashTheBeast and if you do a quick search through Twitter you can see that it is often trending, this allows Monster to constantly have a large captive audience.

Red bull Red Bull remains the most popular brand in the UK on-trade but for many years its success has been due to its popularity in late night venues and clubs. But at the start of 2013 they launched various new flavours to encourage people to drink Red Bull during the day. Blueberry, lime and cranberry variants are now available. The brand continues its association with extreme sports and has really milked its sponsor of Felix Baumgartner’s now infamous Red Bull Stratos Jump which last year became one of the most popular branded videos. The footage clocked up nearly millions of views in just two days. They really do their social marketing well. Their Twitter account alone has more than one million followers using the #Givesyouwings.

relentless The Relentless brand is now worth in the region of £62m and its market share is also still growing. It also has a Relentless Energy Drink Postmix proposition for the on-trade. It was founded in 2006 but backed by Coca Cola’s expertise in the industry they’re certainly one to watch. Relentless have got their brand involved with much more than just extreme sports - it has aligned itself to popular music gigs and concerts, aiming at an audience who want to keep the party going and promoting the fact that Relentless is the way to do it. Professor Green spearhead their advertising. Extreme sports do figure, but more on the skateboarding and BMX side. 29

carling Carling was the first brand to support a wide range of the Scottish FA’s commercial activities, becoming the Official Beer of the Scotland National Team and the Scottish Cup and also the beer of choice at Scotland’s National Stadium, Hampden Park. This deal comes to its conclusion in 2014 and its rugby deal expired in 2013. However it did invest in a new £9.6m marketing campaign which included outdoor, press and digital advertising. It ran throughout 2013. Plans for 2014 have yet to be unveiled.

or Tennent’s Lager, the summer of 2013 was all about the 20th year celebrations of Scotland’s best music festival, T in the Park. Plans are already underway to take this hugely successful partnership into its third decade in 2014. 2013 was also the year when Tennent’s reopened its doors to welcome the public on brewery tours, giving them an insight into the brewing of Scotland’s favourite pint. The latter part of the year has seen Tennent’s Original Export join forces with the leading UK charity Help for Heroes to launch an official new fundraising beer. Beer drinkers are being urged to make a difference throughout 2014 by picking up packs of this special beer in store – and publicans are also being asked to get behind the campaign by stocking the beer in their outlet.

foster’s Foster’s, which celebrated its 125th anniversary in 2013, has benefitted from memorable marketing campaigns many of which have a comedy focus. After all Foster’s is the leading sponsor of comedy in the UK with a sponsorship portfolio that includes the Foster’s Edinburgh Comedy Awards and the Gilded Balloon’s ‘So You Think You’re Funny?’ stand-up competition at the Fringe Festival. The Heinken-owned brand is now Scotland’s third biggest draught and continued to sponsor the Scottish Amateur Football Association in 2013. There are also nine Foster’s branded bars at the new SSE Hydro, which opened last year, the largest entertainment venue in Scotland. It’s presence comes following brand owner Heineken’s five-year sponsorship deal with the 12,000 capacity venue.

heineken Heineken has just extended its sponsorship of the Uefa Champions League. It’s association with Europe’s top football competition dates back to 1994 and has grown in popularity. The extension which lasts for a further four years, is complimented by a social media campaign, which sees the likes of Fernando Morientes, the former Real Madrid and Liverpool star, clipping a Bonsai tree in the top floor penthouse suite of a plush Madrid hotel. Morientes’ topiary skills were being put to use as part of Heineken’s #ShareTheSofa campaign, which lets football fans interact with ex-football stars through the ShareTheSofa hashtag while watching a Champions League game. The brand owner also signed a five-year sponsorship deal with the SSE Hydro. 31

birra moretti Birra Moretti benefitted from the continuation of an extensive marketing campaign in 2013, and with Scotland being a haven for Italians, this Italian premium brand has made its mark on the Scottish market. It teamed up with leading Italian restaurateurs Giancarlo and Katie Caldesi as the faces of Birra Moretti in the UK which emphasised its Italian credentials and also sponsored the World’s 50 Best restaurants. Moretti prides itself on taking an authentic Italian approach to three of life’s great simple pleasures: great beer, great food, great company. Its continued marketing support includes Facebook activity, sponsorship tieups, experiential events and sales promotions as well print advertising.

rewing company Tsingtao, 20 years ago, achieved the first overseas listing by a Chinese company. Today the brand continues to forge its way in the UK market and also carries activity in Scotland too. In November it hosted a Table Tennis tournament at Glasgow’s Merchant Square, and also came to the Edinburgh Boutique Bar Show and encouraged bartenders to take part in its interactive workshop sessions. Tsingtao also revealed it is backing the 2014 British Superbikes series. January 31st sees Chinese New Year – 2014 is the Year of the Horse, so look out for Tsingtao activity over this period. It also continues its support of Legacy of Taste which recommends the best Chinese food the UK had to offer.

Desperados Desperados, the tequila-flavoured premium bottled lager, is the UK’s fastest growing beer brand. Desperados has seen value sales increase by an unprecedented 475% YOY. Dubbed ‘SPEERS’, the fast-emerging Spirit Beers segment is already thought to be worth over £26m. 18-34 year olds accounting for over 70% of the brand’s drinkers. Heineken took over UK distribution for the brand in early 2012 and has since invested in the brand to increase distribution. Building on the success of Desperados, Heineken will be up-weighting its support for Desperados in 2014 with a £6m marketing campaign. Strengthening the brand’s association with festivals and the party occasions.

Foster’s radler Foster’s Radler was launched in March 2013 to meet the need of drinkers who want a beer with a lower alcohol content. The brand, with an ABV of 2%, is aiming to capitalise the new mid-strength moderation segment, currently worth £90m, the category could be worth £300m. The Low ABV Lager segment has grown by 34% over the last year which shows there is definitely a demand for lower alcohol drinks. The Foster’s Radler launch has been supported in Scotland by a heavyweight advertising campaign, and on-trade point of sale. UK-wide it has sold in the region of 14 million bottles, which would equate to around 1.4m in Scotland. 41

WHISKY - BLENDED Whyte & mackay

Black Bottle The end of 2013 saw this brand relaunch in a new bottle and with a refreshed flavour. Owners Burn Stewart say they carried out extensive global consumer research to create the new Black Bottle which they say “heralds a return to the original Scotch, which the Graham brothers created in Aberdeen at the turn of the 19th Century.” The company also re-introduced the distinctive black glass bottle which was the original inspiration behind the name of the brand. 2014 will see a marketing campaign to promote the new look and new taste.

WHISKY - BLENDED

D

iageo acquired a 27.4% stake in Whyte & Mackay owners, United Spirits Limited, last year and the company has just announced that it will put the brand up for sale to alleviate competition concerns. Whyte & Mackay continues to be the Scottish on-trade’s second biggest selling blended whisky after The Famous Grouse. Whyte & Mackay’s marketeers describe the brand as “a brand that’s aimed at people in their mid-life, in their 40s and 50s, but not when you’re settled in your armchair in your pipe and slippers. It has a Glasgow, urban feel about it rather than Highlands and Islands.” Sponsorship last year was confined to the Force India Formula One team, to give the brand more of a global reach. It unveiled a new consumer campaign in December that ran through Scottish media titles and also nationally on Talk Sport. The Scottish ‘We Are’ print campaign featured six local Glasgow bars including the Oran Mor and The Quarter Gill. This year, the ‘We Are’ campaign will be further rolled out to consumers via exciting media executions and engaging social media concepts, as well as innovative on and off trade amplification and POS.

Isle of Skye Owner Ian Macleod Distillers unveiled a brand new look for its entire Isle of Skye blended range last year and recently it launched a new advertising campaign for the brand built around the Scottish landscape. Towards the end of 2013 it revealed it had sponsored Scottish Mountain Rescue and as well as raising funds for Scottish Mountain Rescue the company has already donated £10,000 to the organisation, with 15p from every bottle of Isle of Skye going to the charity. Over coming months expect to see television advertising, a new campaign promoting hillwalking and highlighting mountain safety, and PR activity focused on the ontrade, particularly pubs that focus on the walking and climbing communities in Scotland.

Johnnie Walker Red Johnnie and Ginger is the new bar call from Diageo-owned brand Johnnie Walker Red. The brand is planning a big push in the UK for 2014, particularly with the Ryder Cup fast approaching. A TV ad, all the way from Australia, was screened for the first time in the UK. The first Johnnie Walker adertisement seen here since the 1960’s. It is the world’s bestselling Scotch Whisky and Diageo are hoping the new £7.2m domestic marketing campaign for it will breathe fresh life into the declined blended whisky market in the UK. Advertising will appear throughout the year featuring the tagline, “Where Flavour is King”. 43

benromach 10 yo Benromach 10 year old rounded off 2013 by winning the Oran Mor ‘People’s Choice’ whisky award. The brand also saw volume growth of 29% to the year ending February 2013, a trend which has continued with sales volumes increasing 25% to the end of October 2013. Owners Gordon & MacPhail also revealed that they are planning to expand the distillery following the brands success. It is to recruit another distiller as production is increased. 2014 will see the brand continue its sponsorship of Piping Hot Forres, the European Pipe Band Championships and its sponsorship of Spirit of Speyside Whisky Festival Photographic Competition 2014.

014 is going to be a huge year for Scotland and Glengoyne. With the Commonwealth Games taking place in Glasgow just 14 miles from the distillery, the award winning attraction is gearing up for record visitor numbers. In England, the brand has just launched it’s three-year sponsorship of London Scottish Rugby Club with a 2014 Burns Supper as the first major piece of activity. Glengyone also sponsor the annual Auld Enemy Dinner to coincide with the Six Nations international fixture. Next year marks the 100th anniversary of the Calcutta Cup match between Scotland and England and all money from the dinner on the eve of the fixture will go to support Erskine Hospital, the leading care organisation for ex-servicemen and women in Scotland. And finally, a major new Glengoyne product release is also scheduled for 2014 with more details to come in the New Year.

The Glenrothes The Glenrothes, owned by Berry Bros & Rudd Spirits and distributed by Maxxium, got a revamp to its livery in 2013. The Glenrothes Extraordinary Single Cask 1970 #10573 picked up the whisky industry’s highest accolade for design at the World Whisky Awards winning the sub-category for ‘Best Design - Limited Edition’ followed by the overall grand prize for ‘World’s Best Design’. Since the release of the 1979 Vintage in 1994. In 2013 the brand also released its latest vintage – Vintage 2001.

Springbank 10 year old Springbank Distillery in Campbeltown is the oldest independent family owned distillery in Scotland. Founded in 1828 on the site of Archibald Mitchell’s illicit still, the Springbank Distillery is now in the hands of his great great great grand son, Hedley G. Wright. Springbank is the only distillery in Scotland to carry out the full production process on the one site. One of the highlights in 2013 was the Jolomo Award Winner and local Campbeltown lass Dawnne McGeachy’s distillery exhibition which was attended by First Minister of Scotland, Alex Salmond.
