VOTERS GUIDE Early Voting in the November 8 General Election will began on Monday, October 24. If the turnout for this Presidential cycle is similar to previous years there will be about 100,000 votes cast across Nueces County. There are currently 7332 registered voters on Padre and Mustang islands inside the Corpus Christi City Limits. The two largest Island precincts contain most of those voters with a few voters who live on Mustang Island included in Precinct 19 in Port Aransas but vote in Corpus Christi city elections. Island precincts 40 and 81 traditionally have the highest turnout of any precincts in Nueces County. In the last Presidential cycle the turnout approached 90%! If that holds for this election Island voters could cast more than 6% of the total votes in Nueces County. We will run a sample ballot in the next issue. Stuff I Heard on the Island By Dale Rankin A few weeks ago I wrote in this space about the potential of the current Corpus Christi City Council taking a vote that could/would determine if sort-of-resigned At-Large City Council member Mark Scott could run for Mayor in 2018. We are there. That set of events came to pass at the council meeting on Tuesday but the council dropped back five yards and punted. At question is whether Scott’s attempt to do an end run around term limits by resigning a few months before his full term is up exempts him from mandatory term limits and makes him eligible to run for the Mayor’s seat in two years as he has stated he intends to do, or whether he is termed out for the next six years. Clearly the intent of the City Charter Amendment instituting term limits, as stated Tuesday by the head of the commission that wrote them, makes Scott ineligible to run in 2018 but Councilman Scott’s personal political agenda took precedent in his mind and he is willing to turn City Hall on its head in order to make a run at the Mayor’s seat in 2018.

A loophole in the rules An outside council hired by the city came back Tuesday and said that while Scott’s early resignation does not negate the intent of the City Charter limiting time on the council to twelve consecutive years because under state law Scott is still on the council until he is replaced and serving through the end of 2016, according to the special council, making him ineligible to run in 2018. But there’s a catch. A shorted term in office when the city moved elections from April to November means he did not serve an entire “two year” term and therefore term limits do not apply and therefore he is eligible to run in 2018. The accidental short term allows him to thumb his nose at term limits and run in 2018. But there is more; there is also a provision in the Charter that allows the council to remove/ impeach any member who has three unexcused absences from council meetings. This leaves the council the option of voting Scott off the council before the end of 2016 in which case he would be ineligible to run for Mayor in 2018.

A tawdry affair So now our self-governance at city hall comes down to counting how many times a guy who says he has quit the council has missed meetings and if it is more than three – look for Scott to claim it isn’t - they have to decide whether to act. If that isn’t tawdry enough by itself Mr. Scott, who on local radio chastised the council for hiring outside council, has now said that since his Mayoral run in 2018 has been washed in the blood of same said outside council he didn’t want them to hire in the first place he will re-claim his seat on the council at next Tuesday’s meeting. A meeting at which a vote could be taken to decide whether he is to be removed from office – after he himself said he resigned then changed his mind – and ipso facto whether he can run for Mayor in 2018.

Faith in government Clearly the intent of the term limits approved by voters was to create turnover at City Hall, specifically after twelve consecutive years in office, but as it turns out the language is sloppy. Scott’s only defender during open session Tuesday was none other than our own District 4 Council representative Colleen McIntyre who made a convoluted defense of Scott by saying if he had skipped a couple of terms here or there his time on the council would not be consecutive and therefore he could still run in 2018. Well, he didn’t do that. He got himself elected in 2014– not mentioning he would resign before the term was out – and had it not been for the accidental shortened term he would be ineligible in 2018. Two former council members who also served the same shortened terms as Mr. Scott did not seek re-election after an in-house legal ruling that said their shortened terms counted against term limits, the same limits Mr. Scott now hopes to thumb his nose at. This is about faith in local government. Why have term limits if they can’t be enforced? And now Mr. Scott’s self-serving action means another Charter Amendment to tighten up the language in the term limit provision will have to be held because if the ruling of the outside council is abided by then only people who serve exactly 730 days have served a “two year” term. All of this turmoil over the raw ambition of one person. Judging by the discussion at Tuesday’s meeting I’m guessing if a vote to impeach Mr. Scott is held Tuesday it will be either 6-2 or 5-3 – Scott even if he is present cannot vote – with McIntyre and Mayor Nelda being two of the votes in Scott’s favor. Based on what I saw Tuesday District 5 Council member Rudy Garza (currently running unopposed in his district but who may need Island support later for a run at an At-Large seat) and At-Large Council member Michael Hunter (currently running for At-Large after being appointed to the seat) may be on the fence. The current council didn’t ask for this problem, Mr. Scott did. No matter the outcome here this is exactly the type of self-dealing behavior that has undermined faith in our city government for decades and held our city back. While the roads erode, city debt rises, we have regular water boil orders, and the city faces more than $2 billion in mandatory repairs to infrastructure our council is forced to debate how many times one of its members has been absent and what if anything to do about it. Thank you Mr. Scott.

This is exactly the kind of double dealing, selfserving behavior that has undermined faith in our city government for decades. And Mr. Scott has been part of city government for a long time serving by my count sixteen years at City Hall so far. I would remind Mr. Scott that a City Council seat is not a career nor a profit center – a story for another day. At this point I think it is fair to ask ourselves why it is that Mr. Scott is so intent on hanging onto a seat on City Council; a job that pays barely enough to buy gas to get to City Hall. What is driving him here? My cynical side says follow the money. So now the current eight members of City Council have a decision to make and that is whether to vote Mr. Scott off the council next Tuesday – again after he has already resigned.

Take Steps to Protect Yourself and Your Family From the Flu By Todd Hunter, District 32

With Fall in full swing and the holiday season right around the corner, now is the time to take the necessary steps to protect from becoming ill during the 2016-2017 flu season. Influenza, or flu, is a contagious respiratory illness affecting the nose, throat and lungs caused by the influenza virus. Symptoms of the flu virus usually occur within one to four days of contraction and include fever/chills, body aches, cough, sore throat, running nose and extreme tiredness. The flu virus is highly infectious and most commonly spread by human to human contact; most adults with the flu are contagious beginning one day before symptoms appear and an additional five to seven days after becoming sick. For this reason, it is important to take certain precautions to avoid getting the flu. According to the Centers for Disease Control (CDC), getting an annual flu shot is the best way to protect yourself and your family from getting the virus. It is recommended that individuals ages six months and older should receive a flu vaccination at the start of flu season. Flu season commonly begins in October and can continue to occur into the late spring months, though it is possible to contract the seasonal flu virus at any point during the year. In Texas, flu season generally peaks in January and February, although cases of the flu are often reported in the early Fall months. It takes approximately two weeks following a vaccination for the antibodies that protect against the virus to develop, which is why it is recommended to get the flu shot before the height of flu season. While it is still possible to get the flu after being vaccinated, the symptoms, recovery time and risk of complications are significantly reduced as compared to individuals who get the flu without a vaccination. In addition to getting vaccinated, there are several other important precautions to take in order to prevent getting or spreading the flu. These include washing your hands regularly, avoiding touching your eyes, nose or mouth and avoiding contact with those who are sick. For those with the flu, it is important to stay home in order to avoid spreading the virus and reduce recovery time. Most people who get the flu will recover in

To schedule a time to receive a vaccination, please call 361-826-7238. The cost of each vaccination is $30 for adults 19 and older and $10 for children ages 2-18. The Department of State Health Services (DSHS) regional office, located at 5155 Flynn Parkway, also has vaccinations available Monday through Friday from 8am-5pm. Former Nueces County Courthouse Up for Sale If you had to do a double take when reading the headline above you are not alone. When this idea was presented to the Nueces County Commissioners Court I think it is safe to say we all did a double take. As many of you know the old courthouse has been a difficult decision for this county for many years. With a historic designation on it that prevents the County from tearing it down until 2027 what to do with the courthouse has been a longstanding debate with little options. So in an attempt to be proactive and not let the courthouse sit the Commissioners Court has decided to try and sell it. Many of you might ask why don’t you just restore it and make it great again? Good question and the answer is we do not have the 40 million dollars that was estimated several years ago (probably much more now) to restore the courthouse. So in a proactive attempt we have put the courthouse up for sale. The asking price is $800,000. There are some conditions that must be met. The new owner must pay the back taxes (approximately 1.5 million dollars). The reason for this is that our attorneys have advised us back taxes cannot be waived so someone has to pay them. That is fair. Further, the new owner must take it with the historical designations. That means that if someone is interested they must buy it knowing they cannot tear it down. There are other restrictions but those are the big two. Now on the positive side there are buyers of buildings like this who can get federal tax credits for restoring historically significant buildings. So our hope is that one of these buyers will make us an offer we can’t refuse and help restore this building. The Commissioners Court felt this effort was worth a try and quite frankly I agree. It is better than just letting it sit there another 11 years and doing nothing. I will keep you posted.

Veterans Day Upon Us –Friday November 11 My father was a veteran and I always love celebrating this day so much. To remember the sacrifices that so many have made and to honor our Veterans is a wonderful thing. There are so many wonderful ceremonies around the Coastal Bend that I hope you will take a moment and attend one. One of, if not my favorite one is the one that the community of Port Aransas puts on. It is a moving ceremony that includes children, adults and recognition of our wonderful veterans. Again, please take some time on Veteran’s Day to thank a Veteran. They are special and should never be forgotten.

Taste of the Island a Huge Success Wow is all I can say! The Padre Island Business Association has outdone themselves again. The Taste of the Island was a huge success and the venue was perfect. What seemed like the biggest Taste of the Island I have attended, it was exciting and the food was outstanding. Please get this event on your calendar for next year.

Port A Honors I was pleased to author two resolutions recently honoring some happenings in Port A. The first was to recognize the retirement of Ann Vaughn. Ann who has run the Port Aransas CVB and Chamber of Commerce is retiring. Ann has been a tireless advocate for Port A and her shoes will be very difficult to fill. The second one was for the historical groundbreaking for the Port Aransas art center. Karen and Dan Winship and so many others have worked so hard on that project and soon it will be a reality. Congratulations.

Flour Bluff Loses a Legend While I hate to end on sad note I must. Longtime constable, public servant and all around great guy Jerry Boucher passed away recently. His commitment to our County was second to none. Flour Bluff will not be the same without Jerry and my deepest condolences go out to his family.

Corpus Christi Crime Stoppers Celebrates 35th Anniversary

Corpus Christi Crime Stoppers began October 21, 1981 in an effort to make Corpus Christi a safer community. The Corpus Christi Crime Stoppers is a non-profit organization operated by volunteers in the community with the purpose to afford the public to

provide anonymous tips to Detectives to close unsolved criminal cases in Nueces County. Crime Stoppers was developed by Albuquerque New Mexico Police Detective, Greg MacAleese in 1976 which led to the solution of a horrible murder of a gas station attendant as a result of a violent robbery. Michael Carmen was a 20-year-old University of New Mexico student who was engaged to be married when Carmen chose to work an extra shift in July 1976 at the gas station where he was employed; but Carmen was murdered at 2am. Detective MacAleese was assigned the case, featured the crime as a re-enactment with help from the media, and the case was solved by a Crime Stoppers tip. Crime Stoppers spread throughout the country and reached Corpus Christi in 1981. Crime Stoppers celebrates 40 years of existence this year and Corpus Christi Crime Stoppers thanks the media and the public for 35 years of success this year. Corpus Christi Crime Stoppers has recorded 5,034 crimes solved as a result of tips to Corpus Christi Crime Stoppers since October 21, 1981. Corpus Christi Crime Stoppers has led to the recovery of $3,952,621 dollars in recovered stolen property and the seizure of $1,234,621 dollars in the street value of illegal narcotics since the organization began in 1981. Crime Stoppers is regulated by the Governor’s Office and operates without any tax dollars. All the rewards and the operating expenses from Crime Stoppers is solely from donations. Corpus Christi Crime Stoppers has approved $49,930 dollars in rewards so far in 2016. Crime Stoppers is a method for the public to provide information to Detectives about unsolved cases anonymously and they will not be compelled to appear in court. The anonymity provides protection for people who are close to violent criminals and violent associates. The rewards offered by Crime Stoppers overcomes apathy in the community which prompts others to provide the good information. The first tip provided to Crime Stoppers which leads to an arrest makes the tipster eligible for the reward as long as the tipster is not in law enforcement or in the media. Recently, tips to Corpus Christi Crime

Stoppers lead to the solution of the murder at Shooters Depot (Case #1609010150). Crime Stoppers tips also led to the safe capture of a fugitive who was the driver in a single vehicle crash on the Crosstown Expressway that killed an 11 year old girl. The fugitive made threats to law enforcement and a Crime Stoppers tip led law enforcement to sneak up on the fugitive and capture him without any injuries (Case #1609100140). Corpus Christi Crime Stoppers is afforded a Corpus Christi Police Officer liaison to present the unsolved crimes to the public in a manner to protect victims, and preserve the case for courtroom prosecution. Shorty’s installed beautiful new full size pool tables last weekend waiting on Halloween and then Thanksgiving and our beloved Turkey Bowl, of which I am a former WORLD CHAMPION. You know it was a local’s kind of weekend when mostly all I have to tell you about is Shorty’s new pool tables. There was a nice little audience gathered at the “Oldest and Friendliest” last Saturday to watch with great exuberance the installation of the two new pool tables. The old Brunswick tables were put into Shorty’s in 1961 after Hurricane Carla wiped us off the map, but actually they were much older than that coming from Nevada about the time Shorty’s came to life. Thank you Shorty’s family member and bartender, Brian Underwood for the history lesson. And keeping in true Shorty’s fashion, the old Brunswick’s got shipped out to J.W. George in Bandera and the new “Presidentials” were broken in within two

The Mike Stinson Band from Houston played Giggity’s last Friday mon, you should have been here last weekend. There was two stepping at every corner. The great Mike Stinson (Houston, TX) brought his “California meets Texas” sound featuring the guitar monster Lance Smith in tow and brother, it was glorious. They will be back at the end of November and trust me… you need to see these

hours of installation by a local idget with bad manners and an equally bad stomach situation. It all got cleaned up, but not without a swift kick to the backside of said idget, by their illustrious bar manager, Howie Andersen.. The tables were purchased through Don Patterson’s Third Coast Billiards in Port A and he and Howie had the honors of lagging for the first break and playing the first game on the sparkling new tables. Don also runs a very popular eight ball tournament in Port A and sells dart supplies as well. Don gave me a run down on the new tables (like I said, it’s a slow week): “The Tables are 8’ Presidential Legend Table made of Solid African Mahogany. The Legends were quite similar to the design of the 1920’s Brunswick Tables that were at Shorty’s. The original

guys. Especially if you are a Graham Parsons fan. Have I ever steered you wrong? And, I caught someone new to me, Tyler Rogers, at the Back Porch and, in a word, wow. Good stuff. It’s high energy and original and tempered with a young man’s flair. I was impressed. He lives in Dallas but brags about his degree at Texas Tech in economics and political science on his Facebook page. And he’s single. Just sayin’. On Saturday it was all James Little (Corpus Christi, TX) at Gigg’s. What a powerhouse this guy is.

HALLOWEEN… Halloween falls on a Monday this year so most of the bars are doing their costume contests on Saturday the 29th. Giggity’s is doing theirs on “Halloween proper”, the 31st with Austin Hall of Famer’s, Greezy Wheels. That ought to be rip-snortin’. Halloween is typically a big blow-out in Port A every year. I may have to break out the Mary Craft makes one heck old “Vampire of a Big Bird. Chicken” costume of Mike Ellis fame, and which has been floating around the Moon Monkey staff for years. I personally think Mary Craft donned it as the finest “Big Bird” I’ve ever seen. The Porch has

Cruise Control and I’m but positive that exmayor and celebrity MC, Keith McMullen, will be conducting the extravaganza, as he does ever year. I think the Cheech and Chong guys won it last year. On Friday the 28th, the powerhouse blues guys from Austin, Ulrich Ellison and Tribe, will play Giggity’s and Louisiana roots band, Charlie Hagar and Captain Legendary (Baton Rouge, LA) will play the Back Porch. Also, Rasta Cowboy, Billy Snipes, will play the Gaff and Ty Dietz will play the Wild Horse. And over at the Gaff on Saturday, my little hillbilly gospel band, The Sand Bottom Boys, will play their Bluegrass Festival from 2-4 along with the Vintage Sounds Bluegrass Band. Father James Derkits and local celebrity retired lawyer, Arnie Govella will also be joining the SBB’s. And in Corpus, the ZiegenBock Festival featuring Gary Allan, Cody Johnson, Bart Crow and others will be going on at Concrete Street. Plus there will be a charity fundraiser in the parking lot of the IGA called “Shine for Life” with locals Billy Snipes, Port of No Return, Dudes of Paradise and Adrian Taylor. Watch out for those little goblins out there. Be safe!
