You may have noticed a new sign at the Tortuga Dunes office at Zahn Road and SH 361. The office at the moribund project is being used as a temporary police station. A police car stays parked out front but the office is staffed only sporadically.

1031 Exchange Defers Tax Due By Mary Lou White marylou@baxterbrooks.com 361-960-9460 You can always tell when times improve and people start to think of Real Estate, as an investment tool. I have not heard anyone mention a 1031 exchange since 2007, until this month. Probably because for the past seven years, very few owners have realized a “gain” on their property that has sold. Given the new condo/townhome construction, on The Island, that is being sold as investment property…I thought it was a good bet to review this tax device that allows the Owner to defer taxes, at the time of Sale.

Typically, cash is needed to buy the Replacement Property, since Lenders will have trouble making this work within their guidelines.

Caveat Emptor This tool can be very beneficial as a financial strategy. However, it is highly detailed and specific. Please, consult your CPA and attorney to discuss this route, before you plan to sell your current investment property. I cannot stress enough the importance of using a qualified Intermediary, who deals with these transactions on a REGULAR basis. Step number 1, in my opinion, is have your CPA estimate the amount of taxes that would be owed, to the IRS, if you sell outright. Then, compare that amount to the fees that will be paid to the Intermediary, to complete the transaction. These fees can be substantial and you can expect sleepless nights, when deadlines are approaching and transactions are stalled, beyond your control. Being informed is a Good Thing……

Seven Basic Rules Apply Rule #1: This Tax Deferment Plan applies ONLY to investment properties and NOT personal residences. Exchange properties must be within US borders and they must be used in a business , trade or held for investment purposes. It only includes “real property” , meaning some form of Real Estate. Rule #2: You must determine this form of “property exchange” and have an “intermediary” assigned BEFORE you close, on your currently owned investment property. All documents must meet the IRS guidelines and you have only 45 days to identify, in writing, which new investment property you will buy. No extensions on time are allowed! You can identify multiple properties as a replacement, but you must close on at least ONE property, before the deadline. Rule #3: You MUST CLOSE and RECEIVE TITLE on the new property (properties) within 180 days , after you sold your previous investment, no exceptions on time limit. It must be at least one or more of the Properties listed on the 45 day list. If you are purchasing property under construction, this could be a critical factor. Something like Russian Roulette. Rule #4: You must use a QUALIFIED Intermediary. That means an independent Third Party, not ANY family member or any business professional, who has worked for you during the past two years. The function of the Intermediary is to properly prepare and file all IRS documents and forms, plus hold all proceeds in a SEPARATE account until all transactions are completed. You can receive any interest earned during the escrow period, but it will be treated as Ordinary Income for tax purposes. Please note: pick your Intermediary carefully! No Federal or State agencies, regulate or license the individuals or companies that work in this capacity and many are not bonded. Rule #5: Title Holders before and after the transaction, must be identical. Consult an attorney, before Closing on your currently owned investment property, to make sure all Deeds and Loans will be in the correct names of ALL title holders, both before and after the exchange transactions. Rule #6: To defer 100% of your tax liability, the new investment property must be of equal or greater value. You can deduct closing expenses and commissions paid from the Sale Price of the property being Sold. You may also add, to the replacement investment property, closing costs and allowable capital improvements, per IRS guidelines. Rule #7: Reverse Exchanges can be accomplished, but require dedicated observation of rules and timelines. In this situation, you purchase your replacement property before, you sell and close on your existing investment property. Critical factor to remember…Both properties

Do you like that? Me either. I HATE answers like that, but it seems that the public wants me to answer them. Have you ever asked your doctor a question like that? I’ll bet you have, even worse you may have taken simple advice. Look again at the first question at the top of the page. I am asked that, in some form or another 10x a day. Along the same lines I am asked, “Is (blank) good for you - it’s bad right?” as one question! seriously, fill in (blank) with anything…gluten, advil, flip flops, football, sleeping on your stomach, back or shoulder, you name it, I’ve heard it. Because I am a sports doc and health nut and lecturer I tend to be fairly smart in a lot of health related topics so friends/clients/family and strangers want some advice. I don’t blame them. But – guys, those are complex answers, do you have a minute? I’ve said it before and I’ll preach it again, I don’t give simple answers to complex questions. I do however have a reason for most of the advice and decisions I make in a day, that’s probably why I am able to write these articles. The answer to all of these, as most things in life is, “it depends…and here’s why…” So why do we do it? I’m not sure. I know I’m guilty of it too. “man, this tastes great, how’d you make that burger?” Not sure if I really want the whole process, if I just think I sound smart or if I just want to seem interested, but it happens. This is my plead to have us stop asking for simple answers. It counterproductive to us getting real information and makes us all an easy target for jokes and eye rolling. Nine times out of ten when I get asked something along these lines and start to answer

She would always ask these goofy questions just to get a chance to chat. Her best ever? “Professor x (not his real name but it sounded cool) anyway… Professor X, have you ever heard this thing about this vitamin that does something for you?”

You can’t get more lame than that. He politely answered, “Probably, but you’ll have to give me a little more than that to work with” anyway good for a laugh, but some version of this happens to all of us.

Guys, I’ve said it before, I’m preaching to the choir here…You guys are smart, you chose Padre Island to live. Its great here and you nailed it. Time for us as a community to be smarter about the questions we’re asking.

2nd thought – When you get answers such as, “these are the best shoes, best exercise, best of anything or “try this” at least ask YOURSELF if not the so called expert, “why?” simple answers are nearly as annoying as simple questions.

On that note, I love writing this column, send me an email about what you would like to see discussed or my opinion on- in the MOON for the next columns, I love to share some knowledge and motivation while hopefully giving a smile wherever I can.

ARK – Animal Rehabilitation Keep. Located in Port Aransas the ARK is affiliate with the University of Texas at Austin Marine Science Center. They handle the rehabilitation of most species of wildlife in the area with an emphasis on marine animals. They care for abut 1300 animals each year, including about 300 sea turtles and more than 100 species of birds. Island Strategic Action Committee. Is a 14-member committee which meets (usually) at 5:30 p.m. on the first Tuesday of each month at the Comfort Suites on Windward Drive. The committee’s purpose is to advise the Corpus Christi City Council on matters pertaining to The Island.

Island’s PIPPs Chapter of Corpus Christi Red Hat Society. In 2004 a group of Island ladies got together under a Palapa and founded the Padre Island Palapa Pals (PIPPs). Our only rule is that there are no rules! We are all about fun and friendship. We meet once a month for lunch and various fun outings from cupcake making to CPR.

Coastal Bend Troop Support Comes to Padre Island. Coastal Bend Troop Support packages and mails care packages to 70-80 soldiers monthly. Troop names are given to the group and they support that person until his or her deployment ends. Each box contains a hygiene kit, foot care products, writing material, candy, snacks, reading material and many other things. Padre Island Scout Pack and Troop 949 will be assisting by collecting donations on Padre Island and community locations (Wal Mart, CVS, Ace Hardware). The Scouts will be collecting monthly letters written by the students at SLC and SMA that will be included in the packages. The Moon will be providing newspapers to include in the packages. A permanent drop off location has been established at Coldwell Banker Island Realtors, 14945 South Padre Island Drive (drop off times 8-5 Monday Friday, 9-5 Saturday and Sunday 11-4. Police Blotter Fire at Holiday Inn Police were called to the Holiday Inn on Windward on Monday after an air conditioner unit caught fire in one of the rooms. No one was hurt and the damage was restricted to one room.

The Corpus Christi Police Department has received 74 reports of firearms stolen from unattended vehicles so far in 2014. The Corpus Christi Police Auto Theft Task Force investigates the reports for burglary to vehicles and noticed 74 stolen firearms as of May 31, 2014. Corpus Christi Police Lieutenant Chris White, the supervisor of the Corpus Christi Police Auto Theft Task Force, said only three firearms have been recovered of those 74 stolen firearms.

The Corpus Christi Police Department recommends that owners not leave the firearms unattended in vehicles, but store the firearms in a locked safe inside a building.

One of the biggest needs this year will be getting additional collector boats to help pick up toys on Friday or Saturday night or both nights during the boat parades (December 12th and 13th). With the increase in the number of toys the PIYC really needs several more boats to help pick up toys from the docks of the houses along the canals. This is a tremendously important way of helping kids and everybody involved in Toys for Tots.

The Corpus Christi Police Auto Theft Task Force reported the following data for 2014: January – 6 firearms reported stolen from vehicles; February – 7 firearms reported stolen from vehicles; Mach – 18 firearms reported stolen from vehicles; April – 24 firearms reported stolen from vehicles;

We want this to be another record year in terms of collecting toys and need several more collector boats to help pick up the toys from the decks and docks and then transfer those toys to the larger transfer boats that tote the toys to the Padre Island Yacht Club.

State Agencies Undergo Sunset Review Process – Texas Department Of State Health Services

Last week, I wrote about the Texas Health and Human Services Commission undergoing the sunset review process. As a reminder, this is the process in which the state has to identify and eliminate government waste, duplication and general inefficiencies in state agencies, the Texas Legislature established the Texas Sunset Advisory Commission in 1977. The sunset review process is designed to review each of these agencies every twelve years. This review is done by taking up a certain number of the state agencies each time the Texas Legislature convenes. In this week’s article, we are going to review the Texas Department of State Health Services. (DSHS) The Texas Department of State Health Services is an agency that has under gone multiple name changes over the years and has had its duties and responsibilities changed and/or transferred to and from other state agencies. Today, the agency is sub-agency of the Texas Health and Human Services Commission. Additionally, the day to day operations of the agency are overseen by the agency’s commissioner who oversees the staff of the DSHS and implements the duties and responsibilities of the agency. According to a publication submitted to the Texas Sunset Advisory Commission by the Texas Department of State Health Services in May of 2014, the Department was originally created in 2003. This agency is currently a division of the Texas Health and Human Services Commission, which I featured in last week’s article. Originally, the Texas Department of State Health Services was created as an experiment. This experiment however, would result in one of the most complicated and complex state agencies in the state of Texas. Some of the former agencies that were either combined or renamed to create the current Department of State Health Services were the Texas Commission on Alcohol and Drug Abuse, The Texas Department of Health, The Texas Department of Health Care Information Council, and the Texas Department of Mental Health and Mental Retardation. They merged these various former Texas state agencies with

a very ambitious mission in mind thereby creating over 200 programs and 165 funding streams with the intent and goal to improve the health and wellness of our fellow Texans. As I had mentioned previously, the Texas Department of State Health Services is one of the most complex agencies in the state of Texas with regards to its overall scope and service. Due to its vast diversity of services, the DSHS executive team needs to be agile and have excellent multitasking abilities in order to be effective in crisis management related situations. A few of the components of the agency are to oversee both mental health and substance abuse programs and be able to effectively try and integrate the health service organizations. Though this was the intent, it has resulted in what has been described as a “nesting doll of agencies within agencies”. Some of the facilities that the agency operates are the state mental health hospital system along with substance abuse programs and other various associated community mental health programs. This is the feeling that I get every time I pack up my metal detector, shovel and goodie finds and trash bag and head out on a hunt, whether it be 300 miles away or 30 miles away, the feeling is always the same.

This was any detectorist’s dream. I began scanning the area like a kid in a candy store, with no rhyme or reason to where I was going. I was popping up coins, buttons, bullets and all sorts of old relics. These included Civil War buttons and bullets, an occasional Republic of Texas Button, coins from the 1800’s and early 1900’s. There seemed no end to the signals in the ground. Anything that you can possibly imagine was coming up out of the ground. Old brass door knobs, some glass door knobs, electrical insulators of various types and even a kitchen sink was unearthed.

Being from the Coastal Bend area, the local history has always interested me and I have spent countless hours reading about the area history and looking at every old map that I can find. The Corpus Christi area is rich in history of early settlers to the area, later Republic of Texas activity and eventually the Civil War activity that occurred. It was the summer of 1862 when Union ships entered the Corpus Christi Bay area and quickly Loot from the Corpus Christi Bayfront captured a couple of Confederate ships. The re-opening of the water passage under Encantada has taken on a new urgency as the construction of the water exchange bridge under SPID (Park Road 22) approaches. The passage would allow water pushed by the prevailing southeast through the Island canal system providing much needed circulation. Currently aerators on each side of the roadway are in use to provide enough oxygen for marine life. A preliminary study done by the Padre Island Property Owners Association found that building a culvert above the canal water line, to avoid being plugged by sand, would cost about $2.25 million. A bridge to allow for boat passage would cost an estimated $3 million, however, an Island developer believes the bridge can be built for $2 million. The council is considering placing a total of $90.1 million in projects to put before voters on the November ballot, divided into two Propositions. City Manager Ron Olson told the council Tuesday there is currently $55 million in bond funds in Proposition 1 that can be spent without raising city taxes . The approximately $19 in increased tax per $100,000 of appraised property value would be offset by the same amount of bonds retired. However, Olson also said if the current appraisal numbers for the 2014-2015 fiscal year hold another $15 million in bond money could become available before the November ballot without a tax hike since bond assessments are tied to rising aggregate property values across the city.

At the current level with $51.2 million in bonds in Proposition 1 and another $38.9 million in Proposition 2 the Islands tab, which is 15% of the city’s tax base, would be about $13.5 million. The proposed Encantada bridge is the only project on The Island being discussed but is not on the current list of projects presented to the council on Tuesday.

The council has yet to determine if the additional $15 million in funds, if they are available, would be part of Proposition 1, which includes sixteen street projects, or Proposition 2, which includes eight street and safety projects. . The final numbers from the Nueces County Appraisal District are expected to be available before the bond projects go back to the council in late July for deliberation on the final ballot language.

McIntyre suggested Tuesday that the Encantada project be put on the Proposition 1 list of projects and has the backing of District 2 Council member Chad Magill who is running for an At-Large council seat on the November ballot. At-Large Council person Lillian Riojas, who also received an endorsement from the Island PAC in her race, also said she would support the project.

The Encantada project is expected to be discussed by the Island Strategic Action Committee, an advisory committee to the city council, at its next meeting on Tuesday, July 1.

No, I’m not talking about the game of basketball, but rather the first five players inducted into the National Baseball Hall-ofFame Museum located in Cooperstown, New York. Contrary to popular belief, the first election of players into the Baseball Hall of Fame occurred in 1936, not 1939. And yes, even though the famous picture of the inaugural class contains ten new members, there were only five original inductees. Twohundred and twenty six voting members made up the original Baseball Writers Association of America (BBWAA). This game called baseball had been played professionally since 1869. So naturally a special Veterans Committee, made up of men who were more familiar with the players from the early years, was given the authority to also select new members. The overall intent was to have fifteen honorees by July 12, 1939, the year the Hall of Fame would actually open its doors to the public. These fifteen would be represented by ten players from the 20th century writers and five from the 19th century Veterans Committee.

First five Interestingly, players who had been thrown out of baseball like “Shoeless Joe” Jackson and Hal Chase were included on the original ballot, but few writers chose to vote for them. Each of the voting writers was instructed to vote for ten players and 75% of those votes or 170 votes were needed to be enshrined. A total of 47 different players received votes on the very first ballot, but only five players received enough votes to reach the 75% mark. They were as follows, in order: Ty Cobb received 222 votes or 98.2% to lead all players; “Babe” Ruth and Honus Wagner were tied for second with 215 votes each or 95.1% of votes cast; the first pitcher, Christy Mathewson, collected 205 votes or 90.7%; and Walter Johnson was fifth with 189 votes or 87.6%. That’s a heck of a starting five. The Veterans Committee was comprised of 78 voters, and 57 different players and managers received votes. As with the writers, 75% of the votes cast or 59 votes were needed to be inducted, but none received the 75% required. Eight new members were elected for the class of 1937, three players by the writers and five by the Veterans Committee. “Nap” Lajoie 83.6%, “Tris” Speaker 82.1%, and “Cy” Young 76.7%, received the votes needed for enshrinement by the writers. The Veterans Committee elected John McGraw, Connie Mack, George Wright, Byron Johnson and Morgan Bulkeley. The 1938 class consisted of just three new members. Pitcher Grover Cleveland Alexander received 80.9% of the writers’ votes, while the Veterans Committee selected Henry Chadwick and Alexander Cartwright.

Why I live in Port A…

Nicole Buitron-Bickerton and Ruben Limas performing at the Giggity’s Open Jam last Monday This is one of the reasons I live in Port A and not San Antonio or Austin. Congratulations to the San Antonio Spurs on their fifth national championship! What a classy outfit they are. I actually found myself passing through San Antonio last Friday afternoon, but at a snail’s pace. I got caught up in one doozey of a traffic jam on Loop 410 and sure didn’t have much good to say about the city at that particular moment. I spent a good hour stuck in traffic. But, I finally did made it to Bastrop to see the family and found out the ROT (Republic of Texas) biker rally was in Austin all weekend and the city was saturated with thousands of bikes and bikers. So I decided to park it at my sister’s house and never did make it into Austin to listen to music like I normally do. I did go into downtown Bastrop on Saturday night just to see if there was any live music scene going on there and found a little bit at some of the

The club has all the backline set up to accommodate most any form of musician who might want to play (drums, bass and guitar amps, microphones, full PA, etc). One conclusion I came to at the last couple of jams is that this town needs more drummers. Rusty Hicks and Preecher Williams have been good to show up and play but if they aren’t there the drum kit sits empty. But you can always count on resident bass player, Chris Jordan, to be there, and they do get a good share of guitarists and acoustic performers. It’s fun to see who might walk through the door. One surprise was an island friend I’ve known for several years and had no idea she was so talented. Enter the charming Nicole Buitron-Bickerton, who is also a manager at Jay’s Spaghetti Works. She’s been holding out on us. Nicole pulled out a ukulele and took the stage with Ruben (who just happened to have a ukulele, too) and belted out a few songs like she was playing the Lincoln Center. She performed one cool song a cappella with Ruben on drums (who knew Ruben could play drums?) and blew our minds. I think this gal needs more encouragement. She’s pretty darn good. BTW, the jam is hosted by Ruben Limas, Stevie Start and Jef (With one F) Wilson, who rotate the duties each week. Next week will be Jef Wilson.

The Cowboy Church in Elgin, TX restaurants…but not much. The impression I got was that if you wanted to hear any music down there, you were going to have to buy dinner to do it. I’ll have to dig a little deeper into that community to find more music the next time I go. Maybe someone can point me in the right direction… the internet wasn’t much help. I did get up and go with my sister to the Cowboy Church in Elgin on Sunday morning. All I can say is that it’s certainly a lot different than my church, Trinity By the Sea, in Port A. The pastor wore a cowboy hat and had a head-set mic (à la Michael Jackson) and a teleprompter and used one of those clickers that TV weathermen use for the giant video screen above the stage. They had a full electric band on stage singing religious songs with a country slant and part of the service was video presentations about their recent youth activities. It was fairly high tech. They did a children’s sermon that was called the “little corral” and there were a lot of cowboys there who all took their hats off when they prayed. It was an unusual setting for a church service but the message was the same and the congregation was certainly spirited. It’s always great to get out of town but even greater to get back home. It becomes more apparent with every trip why I choose to live in Port Aransas.
