Nigeria’s impending food shortage

R

ecently, the United Nations Development Programme (UNDP) made a shocking prediction of impending food shortage in Nigeria if urgent interventions are not put in place to enhance food production. Giving this warning in Abuja, Lead Consultant, UNDP project on “Targeting Interventions to Foster Sustainable and Resilient Food Security in Nigeria,” Prof. Emmanuel Oladipo, said that many parts of the country would suffer from severe food insecurity, as not much attention is being paid to agriculture by the three tiers of government. He lamented that the current tomato crisis in the country could have been avoided if adequate proactive measures had been taken, even as he called for an integrated approach in proffering solutions rather than waiting for a crisis to develop before struggling to address it. Incidentally, what Prof. Oladipo said is not new to Nigerians, even though there is a sense of urgency to it. For long, there has been growing alarm at the decreasing food production in Nigeria brought about by variety of reasons that includes lack of official support for large scale mechanised agriculture, decreasing rural farming population due to old age and migration, desertification, and droughts. It is increasingly evident that Nigeria has become one of the largest importers of food in the world. The volumes of imported food items will give anyone cause to worry about the future of agriculture in the country. It is a fact that all kinds of food from all over the world find their way into Nigeria. These range from wheat, sugar, fish, milk, vegetables, fruits, rice and other food items that could be produced locally. Ironically, it is on record that successive administrations promised to

reduce the importation of rice into the country. However, rather than reduce, Nigeria has become the dumping ground of all types of rice from different parts of the world. It is sad that despite all that have been said about efforts towards improving agriculture, the country still cannot feed its citizens. This is a clear departure from what obtained before and immediately after independence in the 1960s. At that time, agriculture was the main source of employment, income and foreign exchange earnings for Nigeria. Many Nigerians will admit that until the discovery of oil in 1958, agriculture was the mainstay of the country’s economy with the regions boasting of different cash crops like groundnut, cocoa, rubber, palm oil and many more. Commentators and other stakeholders have argued that with more than 79 million hectares of arable land, diversified ecological conditions, abundant water resources and adequate rainfall, it beats the imagination as to why Nigerians should go hungry or be jobless. They posit that the increasing social vices, rising crimes and security challenges are traceable to poor attention to agriculture. It is therefore imperative that government at all levels should put in place pragmatic plans to make agriculture more appealing, particularly to the youth in order to boost food production. Moreover, farmers should be supported with government guaranteed loans to expand production. Provision of power, accessible roads and good transport system are also paramount. Many farm products perish in the farms due to lack of access roads and transport system to bring them to the consumers in urban centres. Until these problems are solved, the hope of Nigeria feeding her citizens will remain a mirage.

Plateau NSCDC to synergise with private guard coys to boost security Chijioke Kingsley Jos

Civil Defence Corps (NSCDC) has said as part of its efforts to boost security in Plateau State, it has taken urgent steps to partner with private security guards. It said the synergy with take the form of a Joint Task Force with the Association of Private Guard practitioners to rid the state from crime and also to stamp out unregistered private guard. According to a statement signed by NSCDC Naomi Cishak, the Public Relations Office (PRO) of the state command, and made available to newsmen on Monday reads in part, “the commandant of the corps, Mr. Solomon Olasupo in Plateau

Speaking earlier the President of the Association, Mr Edinen Usoh, lamented the influx of fake and unregistered outfits in the industry, saying they were frustrating the efforts of the genuine one. He urged the corps to assist in fishing out the culprits.

the erudite retired justices of the Supreme Court of Nigeria, Justice Niki Tobi has died. Justice Niki Tobi died last week’s Thursday, 16 June, 2016 at about 5.30 pm at the National Hospital Abuja, after a brief illness, members of the deceased’s family said. The late jurist joined the Supreme Court bench in 2002 and retired on July 14, 2010 on attaining the mandatory retirement age of 70 years. Justice Niki Tobi was born on July 14, 1940. He hailed from Esanma, Bomadi local Government Area of Delta State. He was before his appointment as a justice, the Dean of Faculty of Law and Deputy Vice Chancellor (Acedemic Services), University of Maiduguri. In a reaction to the death on Monday, the Chief Justice of Nigeria, Justice Mahmud Mohammed said “it is with a deep sense of shock but gratitude to the Almighty God that he learnt of the death of Justice Niki Tobi on Monday, 20 June, 2016. “According to the information received from members of the deceased’s family, Justice Niki Tobi died by 5.30 pm on Thursday, 16 June, 2016 at the National Hospital in Abuja after a brief illness,” he stated in a statement signed by

his aide, Ahuraka Isah. The CJN, on behalf of himself, the Justices, staff of the Supreme Court and indeed the entire Judiciary of the country commiserates with the immediate family, relations as well as friends and associates of the respected late jurist, who joined the Supreme Court Bench in 2002 and retired on 14 July, 2010. The deceased Justice indelibly contributed to the development of jurisprudence in Nigeria and will be greatly remembered for his assiduousness in reviewing the draft 1999 Constitution of Federal Republic of Nigeria, under the Military administration of General Abdulsalam Abubakar. CJN urges members of the deceased’s family to be comforted by the knowledge that the departed jurist served his country with commitment, dedication and honesty. While the Speaker argued in favour of constituency projects forming part of the national budget as it promotes fairness and equitable distribution of federal projects across the country, the minister challenged lawmakers at all levels to design a legislative framework that would guarantee that their insistence on constituency projects does not overlap with state and local government

Flag Officer Commanding, Western Naval Command, Rear Admiral Fergusson Bobai, on Monday, said the wellbeing of naval personnel was germane to national security. Bobai made the assertion in Lagos while inaugurating a Sick Bay at the naval base in Apapa. According to the FOC, the welfare of the personnel is germane to effective performance of officers in securing the country’s territorial waters.

According to Bobai, ``If you don’t have a healthy manpower, their efficiency may be hampered. As for me, I am very delighted to be party to what I am seeing today,’’ he said. Adm. Bobai said the Nigerian Navy was leaving no stone unturned in guaranteeing maximum health services for its personnel. He advised the personnel to use the opportunity to always come for checkups as often as possible; adding that checking their health was vital to carrying out their du-

ties. He also said that the command would ensure proper maintenance of the sick bay, noting that the infirmary was open to civilians and navy personnel. The sick bay has a consulting room, theatre, wards, radiology, laboratory office, pharmacy and waiting rooms for patients. The inauguration was attended by the Commanding Officer, Nigerian Navy Ship, NNS BEECROFT, Commodore Abraham Adaji and other senior officers at the command.

Civil servants SOT illegal – FG Continued from page 1 (SOT) allowance for which workers in the Ministry of Finance, Office of the Accountant-General of the Federation and the Budget Office of the Ministry of Budget and National Planning, took to the streets in protest, on Monday, illegal. Activities at the Finance ministry were paralysed on Monday as the workers protested over unpaid SOT allowances amounting to N2.1 billion. They had called for the removal of the minister through the various placards they displayed at the gate of the ministry. The minister, in a swift reaction, through the Director of Press in the ministry, Salisu Na’inna Dambatta, said in a statement made available to the Daily Times, that the payment of the SOT was stopped by the last administration in 2014 on

the grounds that it was not listed in any extant government Circular, Financial Regulations or the Public Service Rules. According to the ministry, the sum of N1.2 billion computed by the staff union for payment could not have been budgeted for in 2016 in the first place, not only because of the paucity of funds, but also the fact that the SOT allowance was not part of the remuneration in the Federal Public Service. The statement says: “The Federal Ministry of Finance, the Office of the Accountant-General of the Federation and the Budget Office of the Ministry of Budget and National Planning, do not individually or collectively, owe any of their personnel their salaries. “In view of the foregone, the Management of the Federal Ministry of Finance wishes to categorically

state that the protests have no justifiable grounds,” the statement read. Also, Permanent Secretary in the ministry, Mahmud Isa-Dutse, reacting to the claim by the protesting staff, said the N1.2 billion was an illegal payment that the workers have been receiving at the beginning of the year before now. He said the only salary yet to be paid was that of June, which is not yet due for payment adding “the demand for the N1.2 billion is illegal as it was not captured in the 2016 Budget.” Earlier, workers of the Federal Ministry of Finance, Office of the Accountant-General of the Federation and the Budget Office of the Ministry of Budget and National Planning, had declared war on Finance Minister, over unpaid allowances amounting to N1.2 billion. The workers, during the protest

within the Federal Ministry of Finance offices complex, also called for the removal of Adeosun as the Minister of Finance. They accused the Minister of collecting N30 million as her own house allowance, while refusing to pay their own Special Overtime (SOT) allowance which has amounted to N1.2 billion. A senior official in the Ministry who pleaded anonymity explained to Daily Times that they had been collecting the SOT since the regime of General Sani Abacha, and just like the staffers of Nigerian Customs Service and the Federal Inland Revenue Service (FIRS) which are revenue bodies of the Federal Government. At a joint public hearing of the Senate Committees on Aviation and Anti-Corruption, the Central Bank of Nigeria revealed that a total of N 300 billion was originally meant to be released as loan to about 10 airlines operating in the country . The Apex Bank however stated that of the N300b only N120 b was eventually disbursed. The Senate hearing unraveled the roots of the crises bedeviling the Nigeria’s aviation sector

as stakeholders recounted how airline owners mismanaged or rather diverted the intervention. Some of the Airline owners were said to have diverted the funds released to them into private pockets and never used it any bit of it to revive their ailing airline, a factor said to be responsible for the near collapse of the aviation sector in Nigeria today. The Senate frowned at the way the N120 billion allocated to the Aviation sector as bailout, from the entire N500 billion intervention fund, was mismanaged or diverted. However, the Minister of Transportation, Rotimi Amaechi , told the committee that his ministry

and the agencies under it , based on available records, were not aware of the fund. The CBN governor, Godwin Emefiele, represented by a Director, Mudashiru Olaitan, was then asked to shed light on the release of the fund and the beneficiaries, more so as the problems in the aviation sector was yet to abate. The CBN affirmed that the sum of N120 billion intervention fund was injected into the Aviation sector, recalling that only N39.5 billion had so far been recovered while the remaining N81.2 billion is still outstanding. He affirmed also that some of the ten Airlines that benefited from the fund, are now moribund

or had folded up outright. He said the fund released by the Federal Governmet was meant to prevent the ailing airlines from folding up in the first instance. According to him, the moribund airlines include, Air Nigeria and Chanchangi Airlines while Arik Air, Dana, Aero, Kabo, Overland, First Nation, Odenegene are still in operation on with proper use of the fund. The CBN representatives, however failed to offer tangible reason on why the two airlines folded up, as he referred to the monitoring authority; the Bank of Industry ( BOI ) being the facilitator of the loans to them to offer cogent explanations.

The two principal officers of the Senate are to be arraigned along with the former Clerk of the National Assembly, Alhaji Salisu Abubakar Maikasuwa and his deputy, Mr. Benedict Efeturi on two-count charge of alleged criminal conspiracy and forgery of the Senate Standing Rules, 2015. However, the Senate had at the weekend described the plan by the executive to arraign Saraki and Ekweremadu as a ‘Coup’ against the legislature, aimed towards undermining its independence while subjecting the law making institution to the whims and caprices of the executive. Reacting to the plan to arraign Saraki and Ekweremadu, the Senate had in a statement signed by its Committee Chairman on Media and Public Affairs, Senator Aliyu Sabi Abdullahi warned that the Presidency should not take the maturity and hands of cooperation by the Upper Chamber to the government of President Muhammadu Buhari as a sign of weakness, calling on President Muhammadu Buhari to call the Attorney General of the Federation to order. The suspects are appearing before Justice Yusuf Haliru who has been assigned the case file marked suit No. CR/219/16. It was filed by the Federal Government through the office of the Attorney General of the Federation. In the affidavit attached to the case file, which was filed on June 10, 2016, the investigative police officer swore that the investigations in the case have been concluded.

ÎÎÎAbia State governor, Dr. Okezie Ikpeazu, has advised the people of Ukwa/Ngwa to be fair minded in their demands on him as the governor and consider people from other parts of the state. Governor Ikpeazu, according to a statement on Sunday by his Chief Press Secretary, Mr. Enyinnaya Appolos, stated this during the concluding phase of his ongoing Abia State town hall meeting in Abia South. Governor Ikpeazu, who hails from Ukwa/Ngwa axis of the state that has not produced the governor of the state until 2015 when he emerged as the 4th

democratically elected governor of the state, also assured the people that everything due to them will be given to them. Speaking at the Obehie venue of the meeting, Governor Ikpeazu said: “I’m here to fulfill the promise I made to you during the campaigns. I promised that I will always return to you as the owners of the mandate I’m holding in trust, to report to you on what we’ve done, what we are doing and what we want to do. “I’m not your ruler, but your servant, therefore, I’m here to tell you what we’ve done in the first one year of our government and what we plan to do in the next one year, or our second year of our four years tenure. I

will also give you the opportunity to ask me questions, and I will answer all your questions here, that’s why we are here in this town hall meeting. “I will not lie to you because I don’t have any reason to do so. You elected me as your governor to tell you the truth always, and not to lie to you. “All I am asking from you is your continuous prayers. Be rest assured that Abia is in God’s safe hands”, the governor said. Speaking on the plans of his administration to develop the state, the governor said: “My dear brothers and sisters from Ukwa/Ngwa, it is true that I am one of you, it is also true that we’ve not been governor until now, but I am the governor of Abia State,

and not just the governor of Ukwa/ Ngwa people. “So, when I want to take decisions about our state, I will think of Abia as a state and not Abia South or Ukwa/ Ngwa. This is one truth that I must tell you. “I know where I come from, and our brothers and sisters from Old Bende know that I come from somewhere. With this development, IzeIyamu will now face Mr. Godwin Obaseki of the ruling All Progressives Congress (APC) in the September 10 governorship election in the state. revoke road contracts awarded in United States dollars and re-award them in Naira. Minister of Niger Delta Affairs, Pastor Usani Uguru Usani, made the disclosure in Uyo, Akwa Ibo State capital during the Town Hall Meeting of the Governors of South-South Geopolitical zone recently. Usani disclosed that the contract for the construction of Section Five of the East West Road (Oron to Calabar) will be reviewed soon before the contractor commences of work on the project. According to a press statement made available to the Daily Times

in Abuja through its Director of Communications, Mr. Mashal H. Gundu, the contract which was initially awarded in dollar currency, would have to be re-awarded in Naira. The statement explained that the review was necessitated due to Federal Government’s move to rescue the naira and give it a purchasing power. The contract was earlier awarded in dollars. He explained that the Federal Government was doing something on the award of the contract on that section of the road that would be acceptable to all stakeholders at the end of the day. The minister also disclosed that work on the construction of section four of the East West Road (Eket to Oron) was not

abandoned, adding that the project was on course. Usani reiterated that the mandate and vision of the Ministry of Niger Delta Affairs was being reviewed to fast-tract well-coordinated projects and programmes in the Niger Delta region. He added that a development strategy that involves participation of benefiting communities, local government areas, state governments, other government agencies, development partners and other stakeholders on project conception, implementation and completion in the Niger Delta region was being put in place. In order to address the security challenge in the Niger Delta region, the minister also brought to fore the need for an inter-agency

security committee which had been inaugurated and comprised of the Ministries of Niger Delta Affairs, Information and Culture, Interior, Niger Delta Development Commission, the Amnesty Office, Institute of Peace and Conflict Resolution, the Nigerian Army, the Nigerian Navy, the Nigerian Police Force and the Nigeria Security and Civil Defence Corps. ÏÏÏRespite, on Monday, came the way of former Special Adviser on Domestic Affairs to President Goodluck Jonathan on Domestic Affairs, Warpamo Owei Emmanuel Dudafa, as a Federal High Court, Ikoyi, Lagos admitted him to bail in the sum of N500 million, with three sureties in the like sum. Justice Mohammed Idris also admitted bail to his co-accused, Iwejo Joseph Nna, who is also known as Taiwo Ebenezer and Olugbenga Isaiah, in the sum of N250 million with two sureties in the like sum. The Judge ordered that the sureties must have landed properties within the jurisdiction of the court,

while the accused persons must deposit their international travel passports with the court’s Deputy Chief Registrar (DCR). Justice Idris however ordered that the accused persons be remanded in Prisons Custody pending the perfection of the bail conditions while he adjourned their trial till July 4 and 5. The two accused persons were arraigned before the court by the Economic and Financial Crimes Commission (EFCC) on 23 countcharge bordering on alleged N5.1 billion fraud, and they had pleaded not guilty to all the counts charge. In the charge signed by Rotimi Oyedepo, the EFCC alleged that Dudafa, and Joseph Nna, who also

claimed to be Taiwo Ebenezer and Olugbenga Isaiah, had between June 11, 2013, and June 2015, used different companies to fraudulently steal and thereby committed the alleged offences. Aregbesola and the murder of innocence

hese are not the best of times in my state of origin, Osun; where we are currently observing funeral ceremonies of innocence as the extremes tendencies of the state governor, Rauf Aregbesola have put a knife to the very thing that made us one people. I met Ogbeni Rauf Aregbesola in 1998 when on Sunday Adigun Street in Ikeja, Lagos, the then campaign headquarters for the governorship bid of Lagos State by Senator Bola Tinubu. Myself and Dr. Bunmi Omoseyindemi gravitated towards him as he was the most ideological person in the campaign. Added to that was his pious disposition which marked him out as one of the very few men I have seen on campaign grounds not crazy about cornering resources. That was why I approached him that a particular item being done by the campaign could be done at half of what the vendors were taking and he endured we got it done. The gentlemen who were handling it whom I thought were friends to the candidate later came to fight me for spoiling their market. He was not overtly ambitious then. I recall as myself, Omoseyindemi and him stood in Abiola’s compound during the June 12 celebration after Tinubu won the election and he said he was not after any position but would not object if the new governor ask him to be his personal assistant. But by some stroke of fate he was named the Commissioner for Works. If I had any reservation about him, it was only about his overt religiosity. He would come to the campaign office most times in his Islamic gown with his goatee to match. When he wore normal dress, his tebliq trouser stood him

out always. When he became commissioner, I was with him in his office one night during the America-Afghanistan war and was surprised at his almost child-like excitement when news came on CNN that the Talibans inflicted some damage on the American forces. It is those manifestations of his that have turned Osun into a sorry case today and leading to the death of innocence among our young people along religious lines. I had my primary education in Ondo town and returned to Osun State for my secondary education in the late 70’s. We never cared who was a Christian or a Muslim as we mingled freely. Some of my classmates who were Muslims have remained best friends till date because they were not veiled and I could put faces to their names. We were in the old Oyo State then with a Christian, Chief Bola Ige becoming our governor in 1979 and his deputy Sunday Afolabi also of the same faith. It was not an issue as everybody focused on the cardinal programmers of the Unity Party of Nigeria which they faithfully implemented. In Lagos, Lateef Jakande and Rafiu Jafofo were the men UPN picked to implement the plan. Michael Ajasin and Akin Omoboriowo in Ondo were both Christians just like there was no issue in Ogun that Bisi Onabanjo and another Christian named Sesan Soluade were giving free education. That liberal disposition in Yorubaland would see a Ganiyu Fawehinmi being married to a Christian wife, an example which a Wale Oshun has replicated without rancour. That was the spirit of our fathers who stood at the gates as

warriors when Jihadists were going to inflict strange doctrine on Yoruba psyche. But the Aregbesolas of the Yoruba nation are changing all that stoking religious war in our syncretic space. Aregbesola, on assumption of office in 2011, constituted the Professor Wole Soyinka-led education summit to look into the state of education in Osun. The summit gave birth to the re-classification of schools in the state including merger, school feeding programme, and provision of same school uniform for students in the state. It is the merging of schools which became mega schools that gave birth to the current disharmony between Christians and Muslims in Osun as each of them wants to protect its faith. The reforms from the Soyinka summit were to later have the interpretation of conditions precedent to access the Sukuk bond as the Islamic bank had to be convinced they were investing their money in Islamic schools. The governor in his first time surreptitiously introduced Hijab in Osun School but backed off when it was going to boomerang and a second term project still lay ahead. They stylishly moved the battle to the courtroom where after three years a Justice SAKA has ruled that Muslims can wear hijab to school and even granted

some prayers that were not put before him. The resistance to the move have seen children of other faiths coming to school in choir robes and egungun attires. The symbolism of these forms of protest should not be missed. That is the irresistible spirit of Yoruba people which Islamists (the political Muslims) should reckon with in their quest to bring strange doctrine into a space where religious extremism has always been a stranger. After he booted Oyinlola out of office, Aregbesola made a commitment that he was going to outdo Awolowo in Osun. We didn’t know what he meant was that he was going to do what Awo did not do. Baba Layinka was not going about dividing Yoruba along religious lines rather he brought higher ideals for people of all faiths to rally around. Aregbesola is a Yoruba patriot and he should pause and ask himself how he wants to be remembered 20 years down the line. Would he be happy to be recorded in history as a destabilizer of an existing social order? A jihadist from within who reawakened the Jihad of yore defeated in the battle front by our ancestors? After him Osun must never again go for an extremist -Christian or Muslim-as a governor. We will do well with a moderate and unifier.

Buhari: Retrospect of one year in office

resident Muhammadu Buhari is yet to make any significant impact on the lives and livelihoods of Nigerians in the past 12 months. The policies of his government as well as pronouncements of senior cabinet members are simply incongruent with the change, which they promised. Meanwhile, the so-called ‘government of change’ is almost turning out to be that of pains. Admittedly, the Peoples’ Democratic Party (PDP) laid the foundations for misery which Nigerians are now experiencing. It is therefore suffice to say that the rot will take time to be cleared. As such, our patience, as a nation, is what Muhammadu Buhari desperately needs. He also needs our understanding. Nevertheless, the buck stops on his table. Hence, whatever blames there are now shift to his party, the All Progressives Congress (APC). No matter what, they are liable. Nonetheless, some people will have us believe the administration is still learning on the job. However, if the government cannot initiate economic growth in one year, does it expect us to not admit it? What is more, it appears the government’s stance on main issues of the day is rather medieval. The impression is that it lacks the capacity to rise to the challenges of Nigeria. Nigerians need qualitative

education, mechanised agriculture, healthcare delivery, and sustainable power to attain their potentials. With education, the government ought to reduce its direct participation in operating schools and allow schools to be adopted by communities but not downsizing the teaching workforce. That is in order to

recover costs, which can be invested in upgrading out-dated facilities. The universities are over regulated and centralized,,thus making it uncompetitive to fit or, meet world-class status. We should employ digital and off-campus national academic award resources to develop new models of access to higher education. This will

encourage innovation at our universities, institutes and laboratories. We know that our institutions especially the public universities have been crippled by the lack of organised administration. Hence, private initiatives such as the Adopt-A-School programme should be supported, as should the semi-autonomous management of academic institutions. Agriculture presents the country with opportunity to mobilise the enormous potentials of the people, especially the unemployed youths. However, smallholder farming cannot help the country much to achieve food security. We must therefore develop Farm Settlements with homegrown technology relevant to peculiarities of our environment. Healthcare is another sector that has always been faced with challenges because the government equates health with medicine. The destructive rivalry among health workers has bedeviled the system in the past four decades. What the country needs is quality management and service delivery. Healthcare delivery will have to be strictly health administration practices worldwide specifies and guaranteed to be so administered to last, a la carte i.e. per ability to pay, per complication of care and ailment, and per sophistication of consulting clinic/personnel amongst other factors. Bitter truth on power supply

t has been said that the truth is bitter. In terms of the cause of poor electricity supply ravaging the nation nowadays that fact was brought home vividly in a statement issued by office of the Minister of Power, Works and Housing , Mr Raji Fashola . Issued by one of his aides, the Minister said it was immoral to expect the Federal government to blame electricity distribution companies called discos for the poor electricity supply in the country . Ostensibly, Fashola was responding to the news that the House of Representatives had invited him and stakeholders in the electricity industry to explain the cause of power failure in Nigeria . The statement was therefore meant to apprise the legislators before hand until he eventually showed up in the House on the subject . In effect, the Minister killed the proverbial two birds with one stone . He answered the question of the legislators from afar as it were . He also allayed their fears also on the mistaken notion that the discos

were the culprits of the poor power supply in the country . Let me state clearly as a keen observer of the power sector and its development in the right direction in Nigeria I find the pronouncements and statement of the Minister candid , informed and most patriotic . In particular, I urge our lawmakers to emulate these virtues even as they grandstand to nail perceived culprits for the poor supply. . The Minister’s statement pointed out some facts .The first was that pipeline vandalism had disrupted and decreased electricity supply massively nation wide and power generation , and transmission had suffered and such distribution had been scanty all over the nation . The second is that many government parastatals and institutions owe the distribution companies a lot of money predating his recent appointment as Minister of Power thus tying his hands to stop the discos from demanding immediate payment from such agencies or have them face massive disconnection. Which ipso facto is the legal resort for such breach of payment

in the face of continuous enjoyment without payment of electricity supply by these government facilities and corporations ? The third was the fact that the Federal government before the advent of this administration had sold its ownership in the power companies and had no control over them in terms of generation and distribution of electricity . The Minister admitted that aside from the violation of the law inherent in assuming false ownership and giving futile orders, there was the dangerous risk of creating a potential rash of litigation to stop the discos from realising revenue for sold services both now and in the past. Especially from government institutions, which have become brazen debtors to discos , which are privately owned by equally patriotic and hard working Nigerian businessmen and investors ? In addition, the Minister harped on the fact that the discos charged cost reflective tariffs approved by law and it would be immoral for government to ask the discos not to take money for services rendered . Indeed to support the Minister on

this stance was the advice he offered Nigerians when the Senate summoned him earlier in the year to explain the new electricity tariffs approved for the discos by the Electricity Regulation Commission of Nigeria. Unfortunately, the Nigeran Senate stopped the new tariff increase rather wrongly. The Minister said then that the increased electricity tariffs were like bitter quinine, which ultimately will make life better for any patient or victim of Malaria. That example was very apt and instructive but the Senate ignored it then and electricity generation and distribution took a nosedive even before the vandalisation reached the present uncontrollable situation. If you add to that the fact that the union leaders asked Nigerians to strike on the new tariffs in electricity along side the fuel price hike of N145 then you must admit that it was indeed honorable of the Minister to say publicly that it would be immoral to blame the discos for poor electricity supply as the unions had done so unpatriotically. In a statement by the Chairman, House Committee on Information and Strategy, Olatunbosun Oyintiloye, the Assembly lauded the initiative as a right step in a right direction. According to the parliament, the measure would guarantee fairness and honesty in business transactions in the state and would, in turn, encourage people from all other neighbouring states to want to come to Osun for commercial ventures. It stressed that there was

no transaction that could be conducted to the mutual satisfaction of the parties involved, unless it was fair and honest. The Assembly added that the traditional modes of measurements that market operators were used to had encouraged cheating, and so dragging the improvement of the economy, not only in Osun, but also in other parts of the country. It added that the compliance

with the Standardised Weight and Measure would, by extension, boost the internally generated revenue of the state government. The Assembly said it would assist the government in its efforts towards making the state a regional hub for trade and commerce. The parliament also noted that there must be an effective sensitisation of the people on the use of the standardised measure.

The Director of MURIC, Professor Ishaq Akintola, specifically advised the CAN to approach the court rather than inciting minors to misdemeanors and encouraging disorderliness in the state. fresh motion filed by Nnamdi Kanu, the leader of Indigenous People of Biafria (IPOB), seeking to disqualify Justice John Tsoho from presiding over his trial and an abrupt change of counsel by the second defendant, Benjamin Madubugwu, on Monday, stalled Kanu’s treason and felony trial. When the matter came up before Justice Tsoho, the prosecution counsel, Shuaibu Labaran, informed the court that he was “confronted this morning with the motion clearly framed

by the defendants to frustrate the proceeding of this court.” He said he needed time to respond to it. Although, the motion was not moved,the document in court prayed for “an order disqualifying itself from further proceeding in this matter” on the ground of bias against the defendants. It stated that a formal complaint letter had been sent to the National Judicial Council with an exhibits marked NJ1 and NJ2 illustrating manifest case of bias in the conduct of the case and other issues that were inappropriate to be mentioned

in an affidavit. The motion also stated that the court had in the course of its ruling delivered on the 26 April, 2016 openly expressed serious prejudice against a member of the defence team. But before justice Tsoho on Monday, Chuks Muoma (SAN), the lead defence counsel, announced a conditional appearance for Kanu and David Nwawuisi. He said his protest was on the ground that he had a contrary instruction on his arrival in court, different from his earlier brief on the matter. He complained that he needed a confirmation on the extraction

of the second defendant, Benjamin Madubugwu, from the list of his clients. “My conscience will make it impossible for me to pretend I did not take the instruction. I am the only counsel in this matter. I would like to clarify this embarrassment until that is done my further appearances will be conditional.” The second defendant, Benjamin Madubugwu, confirmed before the court that Amobi Nzelu, who announced appearance, was his counsel. Even as that resolve the issue of representation, counsel in the matter agreed that Nzelu also needed time to study the case file and arrive at a decision whether or not to align with the motion seeking to disqualify the judge. A strong constitutional and electoral reform, they maintain, would not only strengthen the electoral institution, but guarantee the necessary political muzzle needed to contain the excesses of politicians, check electoral violence, and ensure that electoral offenders were

promptly punished as a deterrent. The calls were made in Abuja at a round table titled: “Inconclusive Elections: The Facts and the Myth”, involving the civil society groups, led by the Independent Service Monitoring Group (ISMG) and the INEC chairman, Professor Mahmud Yakubu. The INEC boss, who was represented at the event by his Director of Voter Education, Mr. Oluwole Osaze Uzzy, observed that certain conditions necessitated the declaration of any election as inconclusive – including natural disasters, incidence of electoral violence and over-voting, the compromise of the electoral process through bribery and corruption. He noted that presently,

elections in Nigeria were becoming competitive, where every vote counted and the successful candidates likely to only win marginally, and encouraging agitations by those who failed to win. Lagos govt warns residents against Ogun River vegetation ÏÏÏThe

Lagos State Government on Monday warned residents to keep off the Ogun River, near the Kara Cattle Market which was recently blocked by vegetation, saying that the river could open up at any time with dire consequences. Last weekend, the river was taken over by vegetation, caused by a heavy storm, which created a compacted layer over it. Residents in the area were stunned by the incident and turned the area to a tourist site of some sort, with some residents

seen walking on the blocked river and taking pictures. But the State Government in a statement signed by the Commissioner for Waterfront Infrastructure Development, Engr. Adebowale Akinsanya, said it was dangerous for residents to besiege the dry area as the flow of the river was still active beneath. He said, “It is important to notify the public that have been worried about the environmental consequence of a dried up river to note that the flow of the

river is still active beneath the vegetation and the situation is been evaluated. “However, because of the compacted nature of the vegetation residents and onlookers are of the erroneous belief that the river has suddenly dried up and can walk across the vegetation. “A lot of people that have turned the place to a tourist destination are unaware of the danger lying ahead. It’s important for the public to be aware that the vegetation can give away at any

time and can lead to a disastrous situation,” he said. ongoing trial of two engineers charged with negligence and manslaughter in the collapsed building of the Synagogue Church of All Nations (SCOAN), Dr. Olusegun Oyenuga, on Monday, told an Ikeja High Court that the church did not respond to requests for documents at the start of investigations into the building collapse. The witness, who is a civil engineer, made this known while under cross-examination by the lead counsel for the defence, Mr Lateef Fagbemi (SAN). According to Oyenuga, the Council for Regulation of Engineering in Nigeria

(COREN), sent a letter to the Synagogue Church to furnish some documents which would help in the investigations of the collapsed building, but none were received during the investigations. At the trial on Monday, Oyenuga listed his educational qualifications as an HND in Civil Engineering from the Yaba College of Technology in 1978, a first class BSc degree in Civil Engineering from the University of Lagos in 1981. He listed his professional qualifications as; A fellow of the Nigerian Institute of Structural Engineers, a past President of the institution, who served from 2009 to 2011 and a current registered engineer of COREN. Oyenuga further told the court

that the nine-man investigative committee that visited the site of the collapse building was created by COREN in conjunction with the Nigerian Buildings and Roads Research Institute (NBRRI). “The investigative committee consisted of nine people, there was no geophysist on it, he said.” However, Oyenuga admitted he had no knowledge of who delivered the letter of request from COREN to SCOAN neither did he have an acknowledgment copy of the letter. Mrs. Titi Akinlawon (SAN) a counsel for the defence questioned Oyenuga’s claim that he received no documents from SCOAN. “You had alleged in your evidence that you got exhibits P2

and P3 from the church, in what circumstances did you get those documents? Akinlawon asked.” “I did not get those documents from the church but rather from the office of the Coroner which was set up to investigate the building collapse”, Oyenuga said. Akinbela Fatiregun and Oladele Ogundeji alongside their companies – Hardrock Construction and Engineering Company and Jandy Trust Limited – and the trustees of SCOAN are facing a 111-count charge of gross negligence and manslaughter brought against them by the state. According to DPP, the offences were committed between August 20 and September 2013.

FRSC to pay lawyer N200, 000 fine Jacob Ogodo, Abakaliki

A state high court sitting in Abakaliki, the Ebonyi State capital, has ordered the state command of the Federal Road Safety Corps (FRSC) to pay the sum of N200, 000 to a legal practitioner in the state, Chinedu Ngele, for trampling upon his fundamental human right. Ngele was on November 9, 2014 stopped by special marshals of the corps in front of the corps’ office along the Abakaliki/Enugu Expressway who were on duty in the area. He was accused of using expired tyre which they said attracted N2, 000 fine and immediately impounded the vehicle. But he insisted that his vehicle tyre was okay and must go with it, a situation that made the marshals to cease his driving license and two law books pending when he brought a bank teller as evidence that he had paid the N2, 000 fine so as to reclaim his vehicle. He was said to have paid the fine and returned to the marshals with bank teller as evidence and was told that it was some minutes past the hour of 4pm and as a result should come back the next day.

Election petition tribunal-Interlocutory appeal should be discounted from 180 days - Etiaba What is your take on the Nigerian Bar Association (NBA) national election coming up next month and the modality for e-voting? Well, my take on it is that the Nigerian Bar Association is always leading the way in positive ways that is a very good one at least for the first time, every lawyer is entitled to vote in the election, it is no longer a delegates type of election where a few people determine the future of the entire people so I see it as a welcome development and beyond the issue of e-voting comes with the achievements of the present administration with the reasonable innovations which hitherto were thought is impossible. For example the use of stamp and seal which has actually gone a long way in weeding out fake lawyers. Before now fake lawyers were able to pay practicing fees, come to court, carry on while some of us never knew they were non –lawyers until the issue of stamp and seal came. The NBA

administration has done well, the ID cards are out for the first time a lawyer has ID card given to him by the Bar Association, the branch where he practice. The regime has done well, the plan for succession is also going on well by the introduction of this mode of election. What is your assessment of two presidential candidates contesting the election? The problems we have with Nigerians and the electoral process most times is that people are appealed to run for an election. You see people who are reluctant candidates contest an election and most times when people appealed to them to run for the election they win because some interest, power blocs feel that such characters can be manipulated so they will go and convince them to come out and run for election. But what we are seeing in the NBA election is that you have two people who are desirous on their own to contest for the election, the two people who have mani-

fested their interest. The two people who have come out have the capacity to lead the Bar so I am impressed. How do you see the move by the Senate to commence the process of amending the 2010 Electoral Act in order to pave way for early primaries and also strengthen the electoral process? The move is welcome and it is not new. Normally, after every election, the problems in the electoral process are articulated and that informs the amendment that comes unfortunately this amendment coming is a bit late in coming, amendment should have come before the last election though the electoral Act 2010 as amended if we have amended the 2010 and continued with amendment, we would have had a better 2015 general elections but if that has also happened by now, there would be clamor for move for another amendment because you could see certain realities that played out at the election tribu-

nals, it could not have been taken care of because they were innovations that came in 2015 general elections. For example, the card reader, the card reader has not been used in general elections before, they were only used during this 2015 general elections so the Electoral Act couldn’t have anticipated and that is why most judgments including that of the Supreme Court stated clearly that card reader is not part of our Electoral Laws, until it is inscribed into our electoral law that elections cannot be adjudged to be fair or unfair, what the court rely on before now, is the manual voters’ register and that also bring me to the point where people who are not ceased of electoral matters will sit in the comfort of their homes and offices and begin to pass judgments over judgments passed by election petition tribunals, Court of Appeal and the Supreme Court even when they do not know what the laws curtailed.

Now that we are doing the amendment I expect that the issue of card reader will be brought into the electoral act and every court will now use it. All card reader is needed for is accreditation. Card reader is the one that will show that a voter was accredited or not accredited and the reports will also find the details. It is a welcome development. What are your expectations from this amendment? Are there any other amendments that you envisaged the Senate would look into? The Senate has to look into the 180 days rule. Every elections contested must be determined within 180 days counting from when it was filed until when judgment is given that is a major problem. It is a major problem because once there is an interlocutory challenge you can tell that that particular petition will suffer a set- back, it can never be concluded within 180 days. goes to the Court of Appeal and probably it comes back to the tribunal for retrial what you find is that you can hardly go a step further within the 180 days so if they can look at it let us amplify the 180 days rule by saying the period of interlocutory appeal will be discounted from the 180 days. That will be good. I hope they will look into it. There are other issues like objections that are not really taken that should come within first schedule, there can now be a definite pronouncement by the first schedule that all interlocutory applications should be taken at the end of trial so those are issues that can be taken care of and also look at the positions of the parties. In view of most elections being conducted by this administration declared inconclusive, do you think the Independent National Electoral Commission (INEC) can conduct a free and fair elections in 2019? It is too early to judge them but, I must tell you, going by the inconclusive nature of the isolated elections that they have conducted so far, I have my fears; they really will have to work hard to give us credible elections in 2019. It is too early to say they cannot but there is work to be done. Could you assess the nation’s judiciary and what you think is responsible for its perceived rots? The judiciary in Nigeria has not done badly, I always say it, the judicial system is a system within the larger system called Nigeria and the Judges are Nigerians, they are not from the moon, going by the rot you find in Nigeria I can tell you the judiciary has done well, extremely well and if you ask me whether there is need for improvement I will say yes, there is need for improvement and when people talk, they talk as if the judiciary has not been self -cleansing. In the past six months I can tell you how many Judges they have disciplined, quite a lot of Judges but people don’t look at this, people judge the judiciary base on how judgment that comes from there affects them. The Supreme Court founded its judgments on certain principle and nobody has accused them of deviating from those principles rather they will say in AkwaIbom state, they gave it to PDP, in Rivers state, they gave it to PDP, in Abia state they gave it to PDP, they have not said whether they deviated from those principles that they as court has settled. People will always comment on the judiciary based on where they stand and I don’t waste my time with such people. And at times you also find people who assess the judiciary out of bad faith, some out of ignorance. A lawyer who has not gone to court in over 20 years now have the idea which judgment is correct or not correct, from which knowledge of law? Basically we have to

see beyond the smokescreen, the judiciary has done well, even where there are lapses they have been cleansing themselves. Many lawyers’ have described Nigeria’s system of government as unitary federalism and that the country should be restructured. Do you agree with this? It is not an issue of whether I agree or not, until Nigeria is restructured, we would continue to have problems because we have not come to terms that there should be respect for every region. Now, we toil around when it suits us to six regions in the country but I tell you until there is mutual respect for all the ethnicity and all the regions there will always be problem. It is just not right that you have 54 federal appointments and the Ibo tribe get only one slot out of 54. We have six regions; divide 54 by six that is what the South-East should get. We are talking about fairness and until the country is restructured on the realities of the state of our union, we will al-

ways have problems. We have to be careful. That call will always continue no matter how long. Apathy was there for a long time until one day, it was pulled down so this is a mountain that must be pulled down. Are you saying the SouthEast is marginalized in federal appointments? Am I speaking in tongues? The South-East is marginalized and nobody has challenged it rather, what they say is that the SouthEast did not vote for the party in power at the center which to me is a very, very unfortunate assumption. What is your view on the Kogi state election petition tribunal which dismissed the petition of Honorable James Abiodun Faleke’s petition for lack of merit? There you go again, that is where Nigerians go wrong, I did not see the petition, I am not in full grip of the facts, I don’t know what the laws that the tribunal applied says and you want me to comment obviously, I will be talk-

ing like an idiot and I don’t want to sound like an idiot. Controversy has continued to trail the wearing of hijab in Osun state. What is your take on the court’s decision that allows Governor Rauf Aregbesola’s policy to stand? Aregbesola’s decision and the court’s decisions are decisions that will take the people of Osun State back to the dark-age. We are talking about looking for money to pay salaries, every state is talking about how to go back to agriculture, how to encourage young entrepreneur, how to industrialized the states and in a state where salaries are owed the focus is no longer how to pay salaries and improve on the IGR of the state, they are talking about hijab and that is the legacy he has decided to bequeath as his tenure runs to an end. It is very sad. The other day I saw in the newspapers the Christians, some wore their worship choir clothes, others wore white gowns. That is what we called a state of anomy, a state where nobody is in control that is what he has foisted on the state. I hope he will look beyond party lines. I know the state worked before he took over, I know how hard the former governor Olagunsoye Oyinlola worked hard to position the state and I know how bad the state has gone back now. Has there been a situation where the Supreme Court reverses itself ? Can the apex court do so? Of course, the Supreme Court can reverse itself because they are made up of human beings who are also fallible but there are conditions that must exist before they overrule themselves. What are these conditions? You must prove that the judgment was delivered per incuria, that is to say, that the judgment was delivered without considerations of the state of law. You must show that the decision of the Supreme Court runs contrary to their previous decisions which are sound. You must show that if they have averted their minds to certain principles of law and judgment they have delivered that that judgment wouldn’t have gone the way it went. You can isolate a Supreme Court judgment and challenge it. It is done.

Why only four organisations in Nigeria are partially using IPV6 —Investigation Tony Nwakaegho The world is transiting from the use of Internet Protocol Version 4 (IPV4) to Internet Protocol Version 6 (IPV6) based on the fact that the keeper of the free address pool, the Internet Assigned Numbers Authority, (IANA) in February, 2011 fully allocated and exhausted all of the IPv4 Addresses. However, investigation has shown that 35 organisations in Nigeria have so far acquired these IPV6 addresses, while only four of the organisations are partially making use of the IPV6 on the internet. The enquiry also revealed that in Nigeria many of these organizations are using the Network translation system in their operation; hence Tony Nwakaegho has to undertake an investigation to unearth why these organisations are reluctant to migrate to IPV6. A NAT (Network Address Translation or Network Address Translator) is the virtualization of Internet Protocol (IP) addresses. NAT helps improve security and decrease the number of IP addresses an organization needs. Network address translation (NAT) is a method of remapping one IP address space into another by modifying network address information in Internet Protocol (IP) datagram packet headers while they are in transit across a traffic routing device. The technique was originally used for ease of rerouting traffic in IP networks without renumbering every host. It has become a popular and essential tool in conserving global address space allocations in face of IPv4 address exhaustion by sharing one Internet-routable IP address of a NAT gateway for an entire private

network. Mr Yemi Adedoyin of Broadband and Converged Solution Phase 3 Telecom in an interview with Daily Times explained that translation will still be in effect because there are challenges to migrate to IPV6, so people in IPV4 are using the translation so that they can put the limited IPV4 public IP address into multipurpose use in their offices and still be able to connect to the internet. “But as people migrate from IPV4 to IPV6 there will be no need for that translation. The reason why they are doing that translation is because there is not enough IP addresses to go round, but once people migrate to IPV6 there will be enough IP address system to go round so you don’t need to do translation. Translation is just using few numbers to map to one IP address system,” he said. Commenting on the reason why those organizations don’t want to migrate immediately to IPV6, he said that all over the world there is some traction from migrating for IPV4 to IPV6 because they are two different networks that cannot operate together, adding that most people already have the IPV4 may not find it necessary to migrate to IPV6 particularly for instance if there is no commercial advantage to migrating into IPV6. “So if I am in IPV4 and I see that I don’t have too many customers or clients I can still stay there,” he noted. He emphasized that Nigerians from now on should ensure that the appliances and equipment they buy are IPV6 compatible so that if Nigeria migrate from now till the next 20 years from IPV4 to IPV6 with the equipment you have now, you don’t need to buy new equipment. “So you will have equipment that is IPV4 compatible and equipment that is IPV6 compatible at the same

time. So if you are working in an IPV4 network your equipment works and if you are operating in IPV6 network your equipment also works. The IPV4 equipment will not be discarded they will work side by side with IPV6 equipment,” he explained. Adedoyin disclosed that there are 35 organisations in Nigeria that have acquired IPV6 but only four are partially using them, stressing that it is so because even globally apart from T Mobile of the UK that has such equipment, completely IPV6 network and a few Universities in China that have complete IPV6 networks we don’t have networks that are entirely IPV6. “So if I have a website that is IPV4 and I have an IPV6 address it cannot be accessed except that person does a translation to IPV4 address. It is due to the fact that you have a lot of tractions that people are not working on IPV6. But they can still work together, as all I need to do is that if in my company I have a website that is IPV4 enabled then we will have website that IPV6 enabled. The true is most networks are IPV6 enabled and the two networks are separate and there are a lot of investments. In US for example for 20 years they needed $25billion to migrate to IPV6. Now, you will are seeing people saying that they want to invest in IPV6 in all networks. Most people don’t want to invest; they want to run with what they have. The same time you have in Nigeria, there are still many networks that are 3G whereas we have 4G and LTE. How many people are working on that? Many people have invested in 2G, 3G and so until they recoup their investment, they may not go to that,” he emphasized. According to him, government is trying its best and there is a lot of awareness on the part of the Nigerian Communications

every citizen of that country with 10megabyte per second service. “Since it is the government that came out with that policy every company has to comply. That can also drive the IPV6 in this country,” he buttressed. When asked whether the companies will not also resist the compliance with IPV6 migration as they are doing on listing at the Nigerian Stock Exchange, he pointed out that when you want to achieve something you have to use carrot and also use stick. “You have to approach people, lobby and inquire from the stakeholders, adding that the truth of the matter is that government doesn’t have money to give to anybody. “They can only encourage you by creating the enabling environment. So what is going to happen is that there will be tractions, and reluctance by the private organization, but government has to find a creative way of persuading them to be able to buy into IPV6,” he stated further. When probed on how feasible it is for this IPV4 transition to end by 2020, Adedoyin declared: “What I mean is not the transition, but about the available IP addresses to Africa. It could by 2020, but it doesn’t mean that we will stop communicating. It only means that if I want to have an IPV4 address system I won’t be able to get it from a company. Analyst Gartner has disclosed that it is expecting a big drop in smartphone sales growth, projecting the market will shrink from 14.4 per cent growth in 2015 to just 7 per cent in 2016 with only 1.5 billion smartphone units being shipped globally this year. The high watermark for smartphone sales was back in 2010, when Gartner notes the market grew 73 per cent. The signs of a slowdown in the global smartphone market have been clear for more than a year, with mature Western markets saturated and China’s growth engine also slowing as demand has topped out. Incentives for consumers to upgrade their devices yearly have also softened, with Gartner noting that new devices offer only incremental upgrades over existing hardware and carriers have been moving away from subsidizing upgrades. In emerging markets it says the average lifetime of premium phone is between 2.2 and 2.5 years, while basic mobiles have an average lifetime of three years and up. Gartner sees the biggest remaining opportunity for smartphone growth in India, noting that sales of feature phones — aka dumbphones — accounted for a majority (61 per cent) of total

Gartner predicts drop in smartphone sales in 2016 mobile device sales last year, leaving plenty of scope for upgrades as smartphones continue to become more affordable. It is estimating 139 million smartphones will be sold in India this year, growing 29.5 per cent year-over-year. It notes the average selling price of mobiles in the country remains below $70, and it expects smartphones priced under $120 to continue to contribute around half of overall smartphones sales there this year. So little to cheer Apple there in terms of growth opportunity for premium priced devices, but potentially there is good news for alternative smartphone OS maker Jolla which last year inked a deal with Indian OEM Intex to get devices running its Sailfish platform into the market. The first Sailfish device for India, the Intex Aqua Fish, is priced below $120 and due to arrive this year, although its launch has been delayed — and last month was being slated as arriving “in the coming months”. Turning to China, the story last year was flat smartphone sales, and Gartner is expecting “little growth” in the region in the next five years — couching it as a “saturated yet highly competitive” market — and noting that sales of smartphones represented 95 per cent of total mobile phones sales last year. ambitious homegrown player Xiaomi, which has been gunning for high growth just as the local market is saturating. Last month it signed a deal with Microsoft on patents — paving the way to hunt elusive smartphone growth overseas. Gartner does say it sees opportunity for “non-traditional” vendors in China, projecting that by 2018 at least one such phone maker will be among the top five smartphone brands in the country. “Chinese internet companies are increasingly investing in mobile device hardware development, platforms and distribution as they aim to grow their user bases and increase user loyalty and engagement,” notes Gartner analyst Annette Zimmerman in a statement. NCC needs to look at the proper use of its licenses moving forward. For instance, Globacom has invested in intra-city and inter-city fibre network, which are presently not in use. This infrastructure is required to increase broadband penetration in the country, the regulator should ensure the effective utilization of licensed spectrum,” he said. Adeleke also blamed the current economic situation in the country which is not

conducive for people to make investment. “The situation in the country does not support investment, if an investor spends money in rolling out service, EFCC will come after him to query how he made money he is spending or return on investment is not guarantee because of fear that there won’t be demand for the service as people’s purchasing power is low.” “Any regulation that will make businesses to grow or create right environment for success of business and not making money for government should be the focus of NCC and other government agencies,” he noted. Engr. Lanre Ajayi, immediate past president, Association Telecommunications Companies of Nigeria (ATCON), said that making spectrum available is certainly a good idea. It will help in addressing the last mile challenges. But the question is, are the investors confident about our investment climate? I think we need to make our

environment more investment friendly in addition to making spectrum available to ensure that we do repeat a situation where we will end up with just one bidder. Engr. Gbenga Adebayo, chairman, association Telecommunications Operators of Nigeria (ALTON) said that spectrum licensing will help to achieve the 30 percent broadband penetration target, but policy will do more towards the targeted 30 percent penetration by 2018. He said that granting multiple operational licenses to operators does not guarantee investment in that regard, but implementation of well -articulated policies that will encourage operators to invest their money. He said Government must go beyond granting of licenses to eliminating those barriers such as bottlenecks in securing ‘right of way’, impediments to smooth network operationswhere operators are forced to pay levies that are not legalized, and vandalisation.

Investigation: How NNPC paid $6.5b subsidy to itself in 3 yrs Opeoluwani Akintayo The Nigerian National Petroleum Corporation (NNPC) sells around one million barrels of oil a day, or almost half of the country’s total production. In 2013 alone, its oil was worth an estimated $41 billion, constituting the government’s largest revenue stream.

However, investigations show that the Domestic Crude Allocation, DCA, revenues spent by NNPC delivers poor value for money. A large portion of NNPC’s withholdings are spent on fuel subsidy payments, which are vulnerable to misappropriation and excessive spending. According to a document obtained by Business Times, KPMG

for example, revealed how NNPC paid itself roughly $6.5 billion in three years to fund the subsidy on 15.6 billion liters of products that “apparently were not available to the Nigerian market.” NNPC has also spent hundreds of millions of dollars in DCA revenues on pipeline protection, but levels of theft from crude oil pipelines have risen—in some cases by

birds could be reduced if aviation agencies stepped up control measures at the airports. This, Meggison said, is important because bird strikes could contribute to air disasters if not checked. Bird strikes, he said, could damage the aircraft engine blades, leading to possible malfunction, which is a threat to airline operations.

Interbank foreign exchange trading began on Monday after the CBN ended a 16 month currency peg but deals were thin due to concerns about U.S. dollar liquidity. This was as the apex bank sold $500 million at N280 naira to a dollar at the interbank market on Monday after a “managed float” of the naira failed to attract trading between banks due to liquidity concerns, and was exchanged at N345 per dollar at the parallel market, traders said. Forex traders in Lagos yesterday said that the interbank trading was extended until 5pm, with the CBN’s Authorised Dealers (ADs) setting the pace for the market-driven trading window through the FMDQ Thomson Reuters Foreign Exchange Trading System (the System). The Guidelines, which set out a single and autonomous interbank FX market structure for the nation, supports the CBN’s desire to enhance efficiency and facilitate a liquid and transparent Nigerian FX market. NECA urges legislators enact competition law Stories by Joy Ekeke The Nigeria Employers Consultative Association (NECA) has called on members of the House of Representatives to ensure that the motion on competition law which has passed second reading in the house ends up passed into law before the end of this year. Speaking at a ‘Walk for Competition Bill’ in Lagos, NECA Director-General Mr. Segun Oshinowo said there was nothing to cheer despite the bill passing second reading in the House of Representatives, because previous attempts to pass the bill even passed this stage before being abandoned. “We, therefore, urge the lawmakers to match words with action and give Nigeria a competition law before the end of this year. We also call on the Federal Government to revisit the Draft Competition and Consumer Protection Policy Document and approve it as a matter of urgency. “It is this policy that sets out the goal of promoting competition in the economy. We further call on the Federal Government to mainstream competition in broader areas of economic development such as trade and

NEPC plans capacity building for youths to boost non–oil exports The Nigerian Export Promotion Council (NEPC) has disclosed plans to train 80 youths for free to equip them with the knowledge of export procedures to boost nonoil exports. NEPC’s Regional Coordinator, Mr. Babatunde Faleke, made this known in Lagos recently. Faleke, who said the programme was targeted at youths in Lagos, explained that the lack of knowledge of export procedures had greatly limited the volume of non-oil exports from Nigeria. He told journalists that the programme was the fifth in the series being organised by the council, but the first to be held in the South-West beginning with Lagos. According to him, the

training programme is a practical mentorship programme that would handhold them from day one to the end and is aptly tagged: ‘’Zero to Export’’. “Zero to Export programme is a capacity programme that is a practical mentorship programme, designed for those who have passion and funds to export but don’t know how to go about it. “It is an eight week programme where people would be taught on the regiments of export. The processes will involve the documentation, procedure, sourcing of products and everything that has to do with export. “If you don’t know anything about export; we take you

through until you export. The problem we are trying to address is that most people come to our office and register as exporters. “We discovered that the level of registration is high; people just register for the sake of registration without having the deep knowledge. So we now developed this programme to make sure we take them through, using people that have exported and sharing experiences on how to go about it. “We are partnering with Fidelity Bank, our targets are those who registered with us and they are not exporting. We already have 80 participants registered with us; it will be a quarterly programme,” he said.

Brief Over 2000 ex-PHCN staff owed severance package for three years Three years after the Federal Government’s privatisation of the power assets, over 2000 disengaged workers of the defunct Power Holding Company of Nigeria (PHCN) are yet to receive their severance pay. This was disclosed by the President-General of Senior Staff Association of Electricity and Allied Companies (SSAEAC), Comrade Chris Okonkwo at a briefing in Lagos. Okonkwo, bemoaned the development, saying it does not show determination on the part of the government to settle the outstanding payment of the ex-workers. He urged the Federal Government to ensure that all outstanding and related payments on severance of PHCN workers were settled. “Government is also advised to urgently conclude severance payments and others involving past and present workers in the sector to close that chapter. “The Minister of Power, Works and Housing, Minister of Labour and Employment and Director-General of Bureau of Public Enterprises (BPE), should take specific note to avoid another threat to industrial peace in the sector in connection with this matter,” he said.

The scheme which was launched with Port-Harcourt being its first beneficiary, cost N10, 000 per annum, after which subscribers would have access to health care worth 1300 Euro yearly. According to Shell, the scheme was launched as part of its continuous social corporate responsibility to Nigeria and its host community. The Managing Director of SPDC and Country Chair, Shell Companies in Nigeria, Osagie Okunbo, said the company’s dedication to providing essential amenities to the Nigeria is “not by accident”. According to him, “Shell and its partners believe they can make a real difference in the lives of Nigerians, and

we targeted our investments at community and enterprise development, education and health. Of course, we cannot take the place of government but we are keen tom play our part in the development of a country we’ve been part of for more 50 years,” he said. Shell Companies in Nigeria have spent a total of $195.5 million on social investments in Nigeria in 2015, making Nigeria the largest concentration of social investment spending in the Shell Group. Of the amount, some $145.1 million was paid to the Niger Delta Development Commission, NDDC as required by the law while another $50.4 million was directly expended in social investment projects by the Shell Petroleum Development Company of Nigeria, SPDC Limited operated Joint Venture and Shell Nigeria Exploration and Production Company, SNEPCo. Speaking on Shell’s contribution to developing human capital in the country, Okunbor said it spent some $0.9 billion on local contracting

and procurement. “Ownership of key assets such as rigs, helicopters and marine vessels was a key focus of these efforts to support Nigerian and community contractors,” he added. Okunbor also said Shell Companies in Nigeria are actively involved in the development and utilization of natural gas, pioneering its production and delivery to domestic consumers and export markets. He said “although the SPDC JV’s market share of domestic gas has reduced through a series of divestment since 2010, which enables Nigerian companies to play a more strategic role, Shell companies still remain a crucial part of the national gas energy mix. For example, our Afam VI power plant alone contributed 14 percent of Nigeria’s grid connected electricity in 2015, consolidating its achievements since first power in August 2008. Another entity, Shell Nigeria Gas, SNG supplies natural gas to 87 industrial customers,” he said.

State governments to raise funds from capital market The Minister of Finance, Mrs. Kemi Adeosun, has reiterated the Federal Government’s plan to enable state governments raise long-term funds from the capital market to finance capital projects. Lessons from NCC sanction on MTN, other infractions The Nigerian Communications Commission (NCC) is the regulatory authority in the telecommunications industry in Nigeria that believes in net neutrality regulations since the inception of the industry in 2001. There were times when pundits and stakeholders in the industry accused the regulator of being only able to bark without biting, writes TONY NWAKAEGHO.

Prof. Danbatta: Nigerians would never forget in a hurry the slamming of a gargantuan N1.04 trillion ($5.2 billion) fine on MTN Nigeria by the Nigerian Communications Commission, NCC, for failure of the operator which controls 43 percent of the country’s telecommunications market to fully deactivate subscribers with unregistered and incomplete Subscriber Identification Modules (SIM) cards details within the stipulated time. Daily Times recounts that in 2012, NCC fined the four GSM operators, MTN Nigeria, Airtel Nigeria, Globacom Nigeria and Etisalat Nigeria N1.7 billion for poor quality of service on their networks. Although the operators protested the fine, they eventually paid after months of argument. The tales of infractions by the telcos in Nigeria which includes MTN Nigeria, Airtel Nigeria, Globacom Nigeria and Etisalat Nigeria have been a recurring decimal as the sanction only came after the Commission was inundated with several complaints from consum-

ers and stakeholders. Accordingly, NCC again fined Glo, MTN, Etisalat and Airtel N22million for contravening the ban on promotions and lotteries in their respective networks in March 2013, which is a direct contravention of guidelines on Adverts and Promotions, as well as the Nigerian Communications Enforcement Processes, and Regulations of 2005. The Head, Media and Public Relations for NCC, Mr. Reuben Muoka said MTN Nigeria would pay N10million on account of five promotions at N2 million for each promotion while Etisalat would pay N6million for three promotions running on its network. Airtel, he said, would pay N4 million for running two promotions against the ban while Globacom would pay N2 million for one promotion. Again, the four Nigeria’s leading telecom operators were sanctioned by NCC in 2015 for having pre-registered SIM cards in their systems. They were sanctioned and asked to variously pay N120.4 million for failing to fully comply with the di-

rective of the Commission to deactivate pre-registered and defective customer SIM cards. While MTN, which controls over 62 million subscribers on its network, was asked to Pay N102.2 million; Globacom was slammed with N7.4 million; Etisalat N7 million and Airtel N3.8 million. The communications industry regulator noted in the letters to the operators that the monitoring exercise had revealed that the operators were still harbouring activated preregistered and defective SIMs on their networks. The latest fine on MTN Nigeria is an indication to the fact that the era of impunities are over as the change mantra of the present administration has snowballed into the telecom sector. Observers from around the world got curious on the latest fine on MTN Nigeria and expressed eagerness to see the end game of that huge sanction on MTN due to the fact that it is a South African company. For the benefit of hindsight, the

Federal Communications Commission (FCC) once declared its intent to fine multinational telecommunication giant AT&T $100 for violating a provision of the agency’s Net neutrality regulations in 2015 and many subscribers commended the move, describing it as a peoplefriendly action as the FCC’s fine was the largest the agency has ever proposed at the time. Similarly, Nigeria became the focus of Africa and indeed the world when a gargantuan fine of N780 billion was imposed on leading Telecoms Company MTN Nigeria by the Nigerian Communication Commission (NCC) leaving the company in an uncertain state of what seemed to be its worst regulatory encounter in Nigeria. Like the fine on AT&T, the local, international observers followed every related detail through the varying phases, the twists and turns and the public hearing rigmaroles surrounding the MTN/ NCC regulatory imbroglio. It will be recalled that for about a period of six months intense consultations, negotiations, and renegotiations were ongoing, with the historic visit made by South African President Jacob Zuma, MTN’s acquisition of a foreign lawyer, the withdrawal of the case from court and even the N50billion good faith payment were all momentous scenes in the protracted debacle. The House of Representative Committee on Communications began public hearing into the whole episode without coming out with a tangible answer in further-

ance of their over sight function. When the NCC announced its decision to review the fine to 300 Billion Naira, the news did more than provide an amicable solution but also created an all-round way forward for virtually all involved. Indeed it marked a fruitful end of that enduring regulatory crisis. Commenting on the decision the Executive Vice Chairman (EVC) of the NCC, Professor Umar Danbatta said “Our decision was taken based on professionalism and global best practices and in line with the NCC values to be fair, firm and forthright”. According to the EVC, the Commission has always carried industry and stakeholders along in taking transparent regulatory actions, adding that at no point will the regulator do anything to jeopardise the business health of the entire sector. Although not many would have predicted a conclusion in this matter as the disposition of Nigerian lawmakers did little to convince observers that the debacle was headed for a conclusion this calm in a storm that saw the exit of top executive officers, Sifiso Dabengwa, the Group CEO; Mike Ikpoki, CEO of MTN Nigeria; and Akinwale Goodluck, Director, Regulatory and Corporate. The lesson in this imbroglio and reduction of the fine meant more than just a passive compromise to an obvious entanglement as it carried implications that cushioned the effect for those involved. Apart from the reduction, the flexible payment plan also gives MTN enough payment span and breathing space, as it provides that the balance of N280 billion would be made in six tranches within a period of three years. Interestingly and in spite of the odd, the company made significant strides within the period under consideration some of which includes the acquisition of the Visafone CDMA technology platform, securing a license to stream TV contents and the launch of digital TV channels, and being granted the operating licence to continue its extensive provision of service as an opportunity to demonstrate the company’s commitment to sustaining a beneficial relationship and increase it contribution to the development of the Nation’s economy through ICT.

Why do you find the saxophone so appealing? From the time I was a trumpet player, people said that I sound like a saxophonist. The sound of the saxophone itself is something that appealed to me. I listened to a few jazz saxophone players back then and that influenced my saxophone playing. Some people believe that there are some health hazards associated with playing the saxophone, is that true? There isn’t really any health hazard that comes with blowing the saxophone. The only thing is that blowing the saxophone affected my front tooth because of the way my teeth griped the embouchure of the saxophone so it made my tooth very brown. I just fixed the tooth recently, the tooth was very discoloured. Other than that to be honest there is no health hazards associated with blowing the saxophone. Thinking back, how do you feel losing your father a year before you shot into limelight? It felt terrible because he never saw me become successful. He never saw me become a star, he only saw me as his late child who he called to always entertain his friends with the guitar that I made by myself. That is all he knew about me. He knew me as a trumpet player but he did not see me as the person other people have come to love his songs. He was more into my academic and never had a problem with it but he always knew that I am gifted. He wanted me to be in a profession like medicine, law, or engineering. He never saw me rise into stardom and up till today I always imagine how he would feel if he was alive. I remember the way he used to be very proud of my sister who was a lawyer and he always called her, ‘omo mi lawyer’, meaning my child who is a lawyer. I wonder if he would have given me a nickname as well. It seems you are more popular abroad than in Nigeria, why is that? The truth is that I actually do a lot of things in Nigeria. I am flown in a lot of times to do gigs in Nigeria. The scenario is more like, is my music being played or is it as popular as it used to be? The honest truth is that the industry has changed. When I released my first three albums, you did not have to chase after people to play your music, if your music was good, they would play it, unlike what we have now. They don’t care how good or big you are, you will still have to grease palms to get your music played. That is an issue we need to address; that style of greasing palms

to get your music played does not sit well with me. I am not ready to compromise before my music is played on the radio. I believe my music is good enough. When I give my album to some On Air Personalities, I tell them to enjoy my music. I don’t beg them to play it but if you love it then feel free to play it. Of course a lot of stations play my songs and those are the ones that love good music. They play the songs not because of who I am but because they love good music. Everything has changed about the industry. I have chosen a genre of music that I know would appeal to people who love good music. When it comes to giving people money to play my songs, I don’t think I can do it. I get award nominations a lot but I feel somehow when I have to campaign for votes. I did it the last time and I cleared a lot of awards but in my heart I asked myself why I had to campaign for vote. That is just my school of thought. Is it true that you are into jazz because it is lucrative? I went into jazz because I fell in love with it. When I started out there was no incentive. I began to play jazz because I love it and I want to be a blessing to people. It was not because of any financial gain or for award considerations; it was solely because I have a passion for it. Everything I have done, even Sax Appeal is because of passion and not because of what I can get from it. When I began Sax Appeal people questioned my reasoning because there was no money to be made in the venture, I had to even sell some of my property but I have no regrets. I like the fact that I am able to create something for a certain people who care about good music. When we started Sax Appeal for instance, I wanted to do the kind of music that would be on the mainstream and not in the background. That is why the kind of publicity we did for it was similar to that of a normal hip-pop concert. As it is, jazz is not a very popular genre of music and it is more difficult for a jazz artiste to be recognised. I did not choose this genre of music because it appeals to ‘big boys’. I did it because of the passion I have for it. It just happened that it appeals to that set of people. Someone once met me at and event and asked how much I was paid and when I replied, he was shocked. Those that value the music really appreciate it. When you started out as a musician you just had sideburns but now you rock a full beard. What inspired this look? I feel that a person’s sense of fashion is an inward part of who the person is. At different times, I try to see what suits me especially because I play an unpopular genre of music. I like my beards. What is your wife’s opinion about your beards? She loves it and she is crazy about it in a good way. She will always refer to the way I looked in Sax Appeal 3, where I kept a full beard. She likes it, different women with different opinions. She tells me that I don’t have to shave it off because it suits me a lot. She does not mind and I think it is her thing. Is it right to say that you are keeping the beards because of your wife? Yes, and I think it is a good enough reason; anything to keep your wife happy. Most times you are always seen wearing native attire, is there any reason behind that? I have always loved our culture and fashion is what makes Africa unique. I love associating my brand with Africa. I also wear the western outfits but when I am at events, I love wearing natives. It is part of me representing Africa and showing the uniqueness of our fashion.

Love problems mess When we are into a relationship, it is evident that we will face certain love problems. Love is a complicated phenomenon, something that we cannot really put into words even after experiencing it. When you are in love, you will face many love problems as a relationship is prone to it. It so happens when a couple get married, the honeymoon, shopping phase lasts for a year and then things start changing. Some people are way too excited about the whole concept of marriage but have you thought about the amount of responsibility that you would have once you get into the social institution of marriage? Marriage is certainly not a child’s game and so isn’t love. You are waiting for his call as his phone is switched off. An idle mind is a devil’s workshop, we all have heard about that, haven’t we? You are waiting and your idle mind is thinking that he might be with some other woman sharing his bedroom secrets. When the reality is that he is busy with work and has forgotten his charger at home. Another instance could be that he promised to take you out on a date on a specific date but due to work issues he had to change the dates. To you, it might be disappointing. But for him, he might want you to extend your understanding and support. Your friend told you that your girl was spotted with some random guy in a café. Whom to believe? Your friend who might be lying or your girl whom you are dating for years? There shouldn’t be any confusion here as trust is the base of any relationship. If it is making you think then you are in for serious trouble. There are lots of love problems in this world it would probably take a decade to jot down all of them.

How to gain your partner’s trust When you are in love, you will have little tiffs which might

lead to a war but is it worth it? Sometimes it can be very stressful to be able to spend 15 out of 24 hours in a day with your partner. The key here is to wait for your partner and extend your support. Nobody likes a nagging partner who is constantly revolving around you like satellites. There might be endless hardships in a relationship but we should always remember to show our love to our partner as that is the best way to connect. Showing love doesn’t really have to be buying an Audi or diamond necklace for your partner on every birthday but some small things like just being there for them can make a huge difference. You can always make an effort. Even if you are running short of money, flowers can do the trick! Flowers are not too expensive and also have the power to brighten up someone’s day. Send some nicely scented flowers to his office or bring home red roses for your lovely lady it might just make their day. Never ever forget an important day. Many women complain that men forget important days. Show her that you remember she will appreciate it.

Romantic ideas to express your love

Giving time has become a big issue. Many couples are not able to spend time with each other as they are constantly in a rat race, working hard and trying to make it big. To be honest, love problems can be many, but giving time is the biggest problem in a relationship. It can make or break a relationship. You might be a super-busy person but never ever make your partner feel that they are lonely because that leads to cheating on you. When our partners start finding happiness somewhere else, we assassinate their character without thinking that we are the sole reason for the same. If you give time to your partner, shower endless love maybe your partner wouldn’t even think of going to someone else to find happiness. It doesn’t matter if you do not have time, a short call in a day or ‘I miss you’ can actually make a big difference. Why do people cheat on their partners? It is because they are not finding the happiness that they should get from you. Before pointing fingers, you might just want to reflect that you might be at fault too.
