Diezani Alison-Madueke. The former minister was arrested and later released on bail last Friday

over allegations of corruption and money laundering. She was arrested alongside four other per-

Politics Page Three Æ s Editorial Empowering youths for agriculture

R

ecently, the Permanent Secretary in the Federal Ministry of Agriculture, Mr. Sunny Echono disclosed that the ministry has commenced the process of empowering 30,000 youths for jobs in the agricultural sector. Speaking during a stakeholders meeting with poultry farmers, he said the initiative is being undertaken under the Youth Empowerment in Agriculture Programme (YEAP). Expatiating further, Echono said that 250 candidates would be selected each from the states and the Federal Capital Territory (FCT) Abuja, under the first phase of the initiative. We heartily welcome this initiative and all the promise it holds for agricultural revolution in Nigeria. With nearly 60 per cent of the country’s population residing in rural areas and the majority youths, their poor participation in farming and the agricultural economy must be a matter of concern to all. However, if young people living in the rural areas do not find enough incentives, profitable economic opportunities and attractive environments in which to live and work, they will continue to migrate to the cities and the opportunity to attract a steady flow of investments to transform Nigeria’s agricultural sector will be missed. Moreover, without training in skills suited to the urban labour market, these youth have few opportunities in urban areas. Inadequately trained to compete successfully in urban labour markets, they often suffer worse levels of poverty and marginalisation in towns than in rural areas. Invariably, with agriculture’s major role in the rural economy, it has significant potential to provide solutions to the current problems of youth unemployment in the country and significantly reduce rural-urban migration. Getting young Nigerians in agriculture is a necessity since most of the country’s subsistence farmers are elderly and dying off. If proper incentives are not available to the succeeding generation to engage in agriculture, it will

leave a vacuum in the sector. It is fact that youth unemployment is a worldwide problem and Nigeria has its fair share of it. It is therefore encouraging to note that the youth agriculture empowerment is being coordinated by the Federal Ministry of Agriculture. Nevertheless, with little education and lack of opportunities within and outside farming, majority of the rural youth do not know what to do for earning their livelihoods. Incidentally, they also see high risk, high input agriculture being practiced with unpredictable returns. They have been observing their parents, following conventional farming, toiling hard on the farms, hardly making a decent living. For young people to take to agriculture, farming must be both intellectually satisfying and economically rewarding. The truth is that more than 50 percent of the country’s population is under the age of 25, and with an additional 100 million young people entering the labour force between now and 2035. Even under the most optimistic projections, non-farm wage jobs will be able to absorb only half of the additional workers, which means that for at least the next several decades, farming will be the most assured means of providing gainful employment for at least a third of youths entering the labour force. The youth have not only the potential to make agriculture sustainable and with proper guidance, they can lead communities towards achieving local food security. We believe governments at all levels can make agriculture attractive to the youth if the incentives become attractive. For now, the sector is not attractive because of challenges such as poor funding and lack of enabling environment. Therefore, government must invest meaningfully in agriculture to remove these obstacles and make it attractive and profitable. Despite the grim realities, there is a brighter future in agriculture. For that to happen, there must be improvements in electricity and irrigation, coupled with smart business and trade policies.

is surprising that more than four months after the All Progressives Congress (APC) took over Nigeria’s Presidency and the governorship seat in most states, chieftains of the party still delight in levelling all sorts of allegations against the immediate past administration of former President Goodluck Jonathan. Just last Thursday, one of the chieftains of the party, Governor Nasir el-Rufai of Kaduna State, alleged in a post on his facebook wall, that the Jonathan administration spent N64 billion on three independence anniversaries (2012-2014). As usual with previous allegations

against the Jonathan administration by chieftains of the party, el-Rufai failed to provide details. But not willing to let the allegation pass as truth, the Jonathan administration through the immediate past Minister of National Planning, Dr. Abubakar Sulaiman, on Sunday, said only N332. 6 million was spent on the three independence anniversaries by the outgone administration. He described el-Rufai’s allegation as “tissue of lies” and challenged the Office of the Secretary to the Government of the Federation to publish the amount spent on the anniversaries. While waiting to see if Sulaiman’s challenge will be taken up the APC-led Presidency, not a few see el-Rufai’s allegations as the

same as others by chieftains of the APC since the party assumed the Presidency. Fact is that el-Rufai’s allegations against the Jonathan’s administration and others before it remain unsubstantiated till date. And not a few see these allegations as a way to distract Nigerians from taking the likes of Gov. el-Rufai and the APC to task over the issues of governance which has largely been glossed over in the more than four months that the party has been in power. So, the earlier the Kaduna State governor and his likes in the APC stop making unsubstantiated allegations against the immediate past administration and face actual governance in their jurisdictions, the better for them and Nigerians.

cy on Sunday confirmed the arrest of Alison-Madueke, adding that it is working closely with British law enforcement on the matter. The confirmation was made by the Senior Special Assistant to the President, Garba Shehu, in a statement. He said: “The Federal

Government is aware of the arrest and all the government investigative agencies are working very closely with the British law enforcement.” “Nigerian authorities are saying for the first time that matters are being handled with seriousness and deep com-

mitment. Nobody wants to give the impression that this government is frivolous and unserious. “For this reason, government is only confirming active collaboration. Beyond this, we are not saying more. In due course, Nigerians will be briefed on updates as appropriate.”

The situation with the DSS, it added, has become so pathetic that it could not

even effectively analyze reported suspicious tweets “predicting the attacks” as a cue to forestall last Friday’s attack in Abuja and other parts of the country. The PDP declared that Nigeria cannot afford a retrogression from the gains already made in the fight against terrorism due to the failure of a disorganised, improperly coordinated and distracted intelligence agency, that is not able to live up to its billing. The opposition party therefore urged President Buhari, as a matter of urgency, to take a critical look at the situation in the DSS, overhaul its management, administration and operations to ensure that the required leadership and spirit needed to operate optimally exists in the agency. The PDP stated that its position is beyond politics, adding that security is a matter that concerns all Nigerians irrespective of political, religious and ethnic affiliation and must be taken seriously in the general interest of our dear nation. du Buhari disclosed Monday in Abuja that the 2016 National Budget being prepared by his administration will include fresh policies and measures to encourage the rapid diversification of the Nigerian economy away from its current over-dependence on the oil and gas sector. Speaking at an audience with the President of the Movement of the Enterprises of France (MEDEF), Mr. Pierre Gattaz and a delegation of French investors, President Buhari said that policies being evolved by his administration to boost domestic manufacturing and attract greater investment to Nigeria’s agricultural and mining sectors will be given full effect un-

der the 2016 budget. A statement by the Senior Special Adviser to the President on Media and Publicity, Garba Shehu, said Buhari, therefore, urged Mr. Gattaz and the French trade mission, which includes over 50 companies with interest in manufacturing, agriculture, infrastructure development and other areas, to return to Nigeria again next year in order to take full advantage of the new policies. President Buhari, according to the statement, also assured the French investors that under his leadership, Nigeria will not fall short of international standards in the protection of foreign investments and the repatriation of returns on such investments. Agreeing that domestic security and the inflow of

foreign investment were intrinsically linked, the President was said to have told the French investors, whose visit to Nigeria is a follow-up to his recent trip to Paris, that the Federal Government was taking all necessary measures to overcome Nigeria’s security challenges. “Our government came into office at a time when many people had abandoned the country’s manufacturing, agricultural and mining sectors. “We are doing our utmost best to encourage diversification into these sectors which can employ a lot of people and we will welcome your support in this regard. “Ultimately, reducing unemployment will also help to improve security because unemployment and insecurity are inseparable,” President Buhari

told the French investors, according to the statement. The statement equally quoted the President as saying that Nigeria will also welcome more French investment in its power sector because availability of steady power supply will lead to the reopening of closed factories and the creation of more jobs. He also assured the delegation that his administration was tackling corruption with vigour to ensure greater probity in the management of national resources, it added. The MEDEF President, who spoke on behalf of the French investors, sought assurances from President Buhari on the safety of their planned investments in Nigeria and the easing of bureaucratic bottlenecks, the statement by Garba also noted.

This extra pressure on the heart, for women, with RHD, can put them at risk of heart failure and arrhythmias – the symptoms of which are easily confused with late pregnancy: breathlessness, fatigue, heart murmurs and swelling. Oronsaye's ‘fraud’ trial begins Oct 28 Andrew Orolua Abuja

ÏÏÏJustice Gabriel Kolawole of a

Federal High Court, in Abuja, has fixed the trial of former Head of Service, Mr. Steve Oronsaye, for October 28, 2015. Oronsaye, Osarenkhoe Afe and a limited liability company – Fredrick Hamilton Global Services Limited – were arraigned by the Economic and Financial Crimes Commission (EFCC) for alleged fraud and money laundering offences involving N1.2 billion. Although the accused persons pleaded not guilty to the 24- count charge, in July, 2015, their trial could not commence, on Monday, as the trial judge, Justice Gabriel Kolawole initially declined to hear it and wanted to remit their case file to the chief judge, following the remark at the last sitting by the prosecution counsel that he, the judge granted Orasanye bail before the application was ripe for argument. Justice Kolawole said he took

the remark to mean the prosecution had lost confidence in his court, but the counsel said he didn’t intend it to mean impartiality and apologised. The chief judge had assigned the case for trial to Justice Kolawole, who first heard it as a vacation judge. Justice Kolawole only resolved to hear it after the prosecution and defence counsel had assured him of their confidence in the court. Consequently, he adjourned the matter till October 28 and 29 for accelerated hearing. After the adjournment, Orasanye, who had evaded camera lens, sat in the courtroom until about 1p.m., when the court rose. It would be recalled that shortly after their arraignment, Justice Kolawole released them to go home, pending the hearing of their bail application scheduled for July 21. He granted Oronsaye bail on “self-recognition”, on July 21. But the judge ordered that their release would be effective upon

filing of a written undertaking by the defence counsel within 48 hours and an assurance to produce the accused persons in court at the next hearing date. The accused persons allegedly collaborated in defrauding the Federal Government of over N118 million, under the guise of paying the money in tranches for the contract of biometric data capture project between March 2010 and December 2011. The fraud was allegedly perpetrated through the award and payment for fake contracts to nine companies including, Innovative Solutions, Fredrick Hamilton Global Services, Xangee Technologies Limited, Fatideck Ventures, Obalando Nigeria Enterprises, Moshfad Enterprises and Fesbee Global Resources Limited. Other companies, through which the accused persons allegedly siphoned the money from the Federal Government, included Jolance Integrated Concept Limited and MOF Investment Limited.

Nigeria Hydrological Services Agency has warned that 27 states across the country may be affected by floods this year. The agency said 25 states had already experienced different levels of flood, as it advised people living in flood prone areas to evacuate such locations, in order to avoid being caught up by flash floods. NIHSA, in its “Annual Flood Outlook” for 2015, said findings had revealed that most states would be hit by floods this year, as it stressed that the situation may be severe due to the heavy rains experienced in many parts of the country. The Director-General, NIHSA,

Mr. Moses Beckley, said the rise in sea levels and ocean surges had already caused flooding in some coastal areas. “The summary of the outlook showed that about 27 states are likely to be affected by flood in 2015. As we get to the peak of the rainy season, series of flood occurrences have been reported at different levels of severity in about 25 states across the country. “Some coastal areas including Ondo, Bayelsa, Rivers, Delta and Lagos States experienced coastal flooding due to rise in sea level and tidal/ocean surges. Flash and urban floods were also experienced in some urban locations such as

Lagos, Port Harcourt, Sokoto, Birnin Kebbi, Ibadan and adjoining settlements,” he said. A flash flood is a rapid flooding of low-lying areas which may be caused by heavy rainfall associated with a severe thunderstorm, hurricane, tropical storm, or meltwater from ice or snow flowing over ice sheets or snowfields. The agency, however, regretted that the floods experienced in about 25 states gave 80 per cent accuracy to its earlier prediction, adding that this could have been prevented or further mitigated had land use/town planning were adhered to and drainage systems well maintained.

The emergence of the former governor of Bayelsa State, Timipre Sylva as the governorship candidate of the All Progressives Congress (APC) has sent shock waves into the rival Peoples Democratic Party (PDP) in the state following the violence that attended the party’s earlier primaries which was later cancelled due to security issues. The primaries was dogged by violence and threats, a development that resulted into the

Fayose said: “A total of 476 delegates were listed for the election, 452 people were accredited, 24 were absent, while five votes were voided. “Governor Dickson, having scored 447 votes in the Bayelsa PDP governorship primary election, I declare him the winner. He is now returned as the party’s gubernatorial candidate in the state. “The election today shows that PDP is united and the transparency in the election is commendable. I must say that PDP will continue to be united not only in Bayelsa but Nigeria at large”, he said.

Hurdles before Lagos cabinet nominees As the Lagos State House of Assembly committee for the screening of commissioner-nominees into the state cabinet begins its works, there are indications that the nominees may face a tough scruitiny from the lawmakers. Indications to this effect emerged at the weekend with the tough conditions set by the Assembly members for the intending commissioners. Part of the tough conditions included a clearance to be obtained by each of the nominees from the Department of State Security (DSS) to be submitted to the committee before the screening can commence. Besides, to scale the screening process, each nominee is expected to present his or her original academic certificates which will not only be sighted by members of the committee but also verified by the Department of State Security (DSS). The Chairman of the ad-hoc committee set up by the House

for the screening exercise, Honnourable Wasiu EshinlokunSanni who spoke on the procedure for the screening exercise said the House in setting up the committee, was exercising its constitutional power as provided for in Section 103 (1) of the constitution which stated that, “a House of Assembly may appoint a Committee of its members for any special or general purpose as in its opinions will be better regulated and managed by means of such a Committee, and may by resolution, regulation or otherwise as it thinks fit delegates any functions exercisable by it to any such Committee”. Eshinlokun-Sanni, who is also the Deputy Speaker of the House, stated further that, Section 192(4) prescribes that, “no person shall be appointed as a Commissioner of the Government of a State unless he is qualified for election as a member of the House of Assembly of a State”.

“Fake result or certificate leads to automatic disqualification or withdrawal of confirmation if already given,” the committee chairman said. Eshinlokun-Sanni stated further that each nominee is also expected to: proof of party membership through letters from the state Chairman and his or her local government chairman of the party; should have the concurrence of the members representing his or her local government; should have clearance from the DSS; must be certified physically fit by any government general hospital; must provide vision for the development of the state in his or her area of competence; must provide evidence of his residency of the state through LASRA. He assured that the committee members will perform its duty without fear or favour. “Our general aim is to ensure that we assist in putting in place a cabinet that will work with

He gives you all the time with his good listening ear to deduce wisdom from it. To him, there is sense in every nonsense- what a good leader.

Indeed, every humble man is certainly a hard working Man, if you are close to any aide of his, they will tell you the Man Martin is a 24-hour productive working Man who believes that hardwork is key to breakthrough. With the humble nature of this hard working Deputy Governor during this era of change, another milestone of change is apparent to set Adamawa people free from the shackles of under development and all forms of economic stagnation.

Emefiele defends Naira stance Emmanuel Ogbonnaya with agency reports

of Central Bank of Nigeria, Mr. Godwin Emefiele, on Monday, defended the bank’s decision not to further devalue the naira despite the pressure on the currency. Speaking at a conference in London, Emefiele, said the naira was “appropriately priced” and that he would not allow a policy of “interminable adjustment” as this would only cause more pain for Nigeria’s 170 million people. The naira lost more than 20 per cent of its value between the start of the oil price fall in July 2014 and February, the last time the CBN allowed the currency to depreciate. Since then, Emefiele has introduced a range of currency controls — doing everything but adjusting

the currency to defend its value. The result has been an effective freezing of the country’s foreign exchange market. The lack of liquidity — the ability to move hard currency in and out of the country — was one reason JP Morgan removed Nigeria from its influential emerging markets bond index last month. The CBN governor’s comments on Monday about Nigeria’s dependence on imports suggests he believes his policies — will stimulate local production. For exmple, the central bank in June banned importers from sourcing foreign exchange for 41 key goods that he argues can and should be produced locally. “There’s no economy that does not protect its own, “Emefiele said, referring to the June move. “We

didn’t protect our own [in the past] and we are now a net importer of palm oil.” Nigeria was the world’s largest producer of the commodity in the 1950s and 1960s. Speaking at a panel on managing the commodities cycle, he added: “Liberalising can work in one economy and not in another.” Referring to the import controls, he added: “For Nigerians, [this action] is proper”. eign currency for now to preserve the country’s currency reserves amid plunging oil revenues, but will eventually relax them. Osinbajo, who defended the restrictions, said they had enabled the country’s foreign currency reserves to stabilise but said they were only a short-term measure. “We want an open foreign exchange market. But that market must be one that has the resources to make it robust and open,” Osinbajo told reporters late on Saturday. “So, long term, we expect that the Central Bank will ease restrictions as we go along.” “In fact, medium to long term and hopefully we will be able to go back to more or less where there was greater freedom of movement (before) current restrictions,” he said.

Buhari and Nigeria’s religious minorities

omething uncommon has been happening in Nigeria for a very long time. Before now, many things went wrong in Nigeria’s governance. However, while the happenings favoured one tiny group in the country, it disfavoured another tiny group. It is all about the Christian minority of the North and the Muslim minority of the South. It is clear for any judge to give verdict on the favoured and the disfavoured. There have been series of criticisms over President Buhari’s appointments. Since May 29, the president has appointed up to 29 key officials to man Nigeria’s economic and other important sectors. Among them are members of the Christian minority of the north. Still claims and counterclaims have mounted in the polity. It is quite normal to complain overtly in a democratic setup. Nigeria is of two internationally recognised religions: Islam and Christianity, which predominate in the north and south respectively. The minorities of these two religions are in the areas they predominate. I read one Iyu Awalu’s online comments where he queried the political position of Christians in President Muhammad Buhari’s government.

Immediately he declares for Islam, his own people reject him; in fact, he is tagged an “outcast”. He finds himself in the wilderness between the devil and the deep blue sea. With the number of Igbo Muslims who are graduates and experienced in Nigeria, no one has been appointed by the federal government and their state governments.” This is the yearning of Igbo reli-

gious minority. That is why Mr. President should appoint Igbo Muslims as Ministers, Director Generals of Agencies, Chairmen of Boards, Ambassadors, amongst others. This will be in the interest of equity, fairness and justice, which not all ex-presidents and Heads of State of Nigeria applied in their choice of cabinet members. Should Igbo Muslims continue to suffer under Nigeria’s democratic governments? No one has ever given an answer to the reason why they have been so much denied, at the same time that their Christian minority counterparts in core northern states have been and are still being uplifted by every successive governments. Can Nigerian patriots look into this matter dispassionately? These minority religious groups call for end of religious intellectual conflict in their areas. They advocate for at least recognition and inculcation of the sense of belonging. Buhari has already appointed some Christians as has been commended by the Northern Christian Solidarity Forum. The forum chaired by Rev. John Joseph Hayab fingers the emergence of Lawal as SGF and Dogara Yakubu as speaker of the House of Representatives as clear signal that the president means well for Nigerians. The group backs the anticorruption initiative and appointment of tested and trusted Nigerians into key positions, because “the failure of those critical sectors will spell doom for the nation. Nevertheless, the Special Adviser to the President on Media and Publicity, Mr. Femi Adesina, recently gave the assurance that Buhari’s political appointments will balance out soon. According to him, the President is trying to get the very best of Nigerians. The veteran journalist, Hajiya Bilkis, explained the matter further. She said that what Nigerians are complaining about is not religious but regional balancing in national appointments on the accounts that every Southerner is not necessarily a Christian while not every Northerner is necessarily a Muslim. However, let the good heads from the minorities be in the nation’s governance.

he problem with Nigeria with the war against corruption is the lack of strong institutions to carry out the job. The institutions in Nigeria are around personalities, some strong and some weak, and how they carry out their functions depends on the personality being in charge. However, that is not how the war against corruption can be fought. What we need are strong and independent institutions that can operate on their own, without influence or interference from the person at the helm. If the institutions were strong and independent, the CCB would not have waited until now to prosecute Saraki for an offence he committed more than 12 years ago. Ayo Olukotun rightly advocated, “A proper reform project must both be able to punish offenders in a level playing field; as well as prevent corruption at source through institutional renewal”. Buhari cannot fight corruption with Saraki as the senate president, and impeaching him may not be possible. If those who should dispense justice were corrupt, then nothing would be achieved. Who will fight the war for him? The Chief Justice said “Corruption is characterised by the absence of culture of accountability, inefficiency, weak government structure, excessive concentration of power in the executive arm of government and lack of transparency.” That is what Buhari should know, because, the way he is operating as president is corruption, although he might not know it, so there is no way he wants to fight corruption, when his actions, inactions and utterances are tantamount to corruption. How can Buhari fight corruption when he is setting dangerous precedents, which will likely make the national assembly to lose its oversight functions? You remember how the president has made some key ap-

You have also seen how EFCC chairman refused to appear before a Senate committee probing the diversion of monies realised from recovered assets. Even in the ongoing public probe of the 2015 budget in the House of Representatives, it is the same. The Permanent Secretary in the Ministry of Finance and Governor of the Central Bank of Nigeria (CBN) has both refused to honour invitations sent out to them by the adhoc committee. These are clear signs. What of the billions of naira approved by Muhammadu Buhari as bailout funds to states single handedly? Did he seek for approval from the National Assembly? Truth be told, no matter how much the executive arm tries in a presidential system of government, frostiness in its relations with the legislature is as sure as night and day. Toshow that this government has a hand in Saraki’s travails,we learned the federal government has lined up a total of five witnesses against Saraki, including the former Minister of the Federal Capital Territory and incumbent governor of Kaduna State, Mallam Nasir El-Rufai. El-Rufai. About 50 senators and members of the house of reps, cutting across all the geo-political zones, accompanied Saraki to the Tribunal. Only the

We read that Asiwaju Bola Tinubu, Senator Tayo Alasoadura, from attending Southwest caucus meetings. Alasoadura’s sin was that he accompanied Saraki to the Code of Conduct Tribunal in solidarity. We learned Tinubu has vowed that the party would ensure Alaosadura remains irrelevant in the APC. There are allegations that some senators have been bribed to remove Saraki. It will not be easy to impeach him, despite the monetary inducements. A statement by Senator Ibrahim Abdullahi Danbaba, said the senators were happy Saraki appeared before the CCT in observance of the rule of law, pledging they were fully behind Saraki in his travails. “We reiterate that Saraki is our choice and no politically-motivated, mischievous and vindictive trial will change our opinion of him”, he said. Those calling for Saraki’s resignation are getting it wrong because the provision of the constitution does not criminalise the trial of the Code of Conduct Tribunal.

BoI creates N2bn Graduate Entrepreneurship Fund ÏÏÏ ƈ L n ƓƈƐ M d è ƈ Ɔ ƄƑ ƈ Ɔ ƍƋ ƗƆƒƆƋ ƍƆƏ Charles Okonji The Bank of Industry (BoI) has set aside the sum of N2 billion under its Graduate Entrepreneurship Fund (GEF) to fund 1000 youth corps members and has signed a memorandum of understanding with the National Youth Service Corps. This was disclosed yesterday by the managing director of the bank, Mr Rasheed Olaoluwa at the Bank’s headquarters in Lagos during the official launching of the Fund and the MOU signing ceremony. Olaoluwa stated; “The main reason we are gathered here today is to provide a solution to graduate unemployment in Nigeria, which if not urgently addressed could have adverse consequences for our society. It is gratifying to note the efforts of the NYSC Directorate in promoting an entrepreneurial mindset among NYSC members through its Skills Acquisition and Entrepreneurship Development (SAED) initiative.” He maintained that the programme was in consonance with the provisions of the NYSC Act, which states that one of its objectives was to enable Nige-

rian youths acquire the spirit of self-reliance by encouraging them to develop skills for selfemployment, stressing that it would contribute to the accelerated growth of the national economy. “This capacity building programme is usually organised during the three-week NYSC orientation programme and it is designed to facilitate the training and mentoring of 100,000 young graduates annually in skills acquisition and entrepreneurship development for selfreliance.” “The National Bureau of Statistics (NBS) has reported that each year, about 1.8 million young Nigerians enter the already saturated labour market, while over 50 per cent of youths in Nigeria are unemployed. In the same vein, the Nigerian Institute of Social and Economic Research (NISER) disclosed in 2013 that graduates of tertiary institutions have been badly hit by unemployment, as they constitute about 20 per cent of youth unemployment. Of the over 250,000 graduates of Nigerian tertiary educational institutions that enrol in the NYSC Scheme each year, more than

41 per cent of Nigerian graduates are without employment after the mandatory NYSC programme.” The MD lamented. He stated that Graduate Entrepreneurship Fund (GEF) is like a talent hunt for young entrepreneurs, which is meant to address the entrepreneurial capacity and funding gaps of the serving members of the NYSC. Selected corps members would be camped and tutored by the nine firms of business development partners in the six geopolitical zones of the country including Lagos. He said that the scheme was to encourage graduates of tertiary institutions that are serving under the one-year NYSC programme, to venture into business and become employers of labour rather than job-seekers, adding that it was to develop the entrepreneurship skills and capacity of the NYSC members. He stated that the following were among the reasons for initiating the agreement: to deepen financial inclusion by de-risking the NYSC members and making them eligible for small business loans to be provided by BOI, To develop the next generation of Nigeria’s business leaders and

promoting a business “can do” spirit among Nigerian youths, to bring focus and attention to the need to develop Nigeria’s real sector, as a basis for diversifying our economy. In his response, the Director General of the NYSC Brigadier General, Johnson Olawumi, noted that the collaboration would be of immense benefit to the corps members and the country expressing that unemployment was a major issue. He stated that over 400,000 corps members have been trained on different skills since 2011, explaining that the first stage is capacity building, the second is capital which BOI has taken charge of, while the third and the most important is the need for the government to formulate policies that would sustain budding entrepreneurs by opening up markets for their products. The Fund is only available to serving members who can access the online application portal on BoI’s website using their NYSC call up numbers and the facility can only be used to fund sectors captured under BoI 35 SME clusters focused on the real sector.

The Ebonyi State Governor, Dave Umahi, recently described agriculture as a ``key strategic sector’’ for addressing multiple challenges preventing the country from achieving broad-based economic growth during his presentation of 20.5million cheques to 20 rice cooperative farmers cut across the State in Abakaliki, the state capital city. Umahi who reiterated that the sector employs about two-thirds of the country’s total labour force; contributes about 42 per cent of the Gross Domestic Product (GPD) and provides 88 per cent of non-oil foreign exchange earnings pledged continued partnership with Fadama projects for agricultural development in the state. Represented by the Speaker of the Ebonyi State House of Assembly, Mr. Francis Nwifuru, the governor said the finances came from the Fadama III Additional Financing Project and seen as one of the vehicles for sustainable agriculture in the state The Commissioner for Agriculture and Natural Resources, Mr. Uchenna Orji, during his speech said that the intervention was a strategic encouragement to farmers, especially youths across the 13 local government areas in the state, adding that the governor has demonstrated readiness to partner with the project by approving the payment of the initial up-front of the counterpart fund of N36 million, within his first 100 days in office. Orji who also reveals that t the government would cultivate 200, 000 hectares in the farming season as well as make rice farming, an all-season activity, said the state wants to regain its status as the largest clusters of rice mills in West Africa with 800 rice mills and additional three gigantic government-owned rice mills, capable of processing five tonnes per hour each. “We will soon install the three parboiling machines with eight tonne capacities each, to absorb the rice produced by our farmers,” he said. The Fadama state’s Project Coordinator, Dr. Cletus Nwakpu, said that the programme would support massive production, processing and marketing of rice as he pointed out that the state’s enormous comparative advantage for rice clearly meets all the criteria for considering Ebonyi, to participate in the Fadama III Additional Financing Project.

What is your view about the state of the economy for now? I think it is there in the public knowledge, that things are not as good or are not as well as Nigerians would love it to be, considering the various issues and revelations that we have been reading about, and I think the biggest part of it is what are we doing and from what we can see, the country seems to be heading towards a new direction. As soon as the new government names its ministers and put all its structures in place, the only way we can go would be up I believe it is going to be better and better. How can you access the performance of the government, some people say he has not performed and some others say, he is Baba-go-slow, but how can you access the performance in term of the key economic issue in the country? I think the best way to evaluate somebody or a situation, I would use that biblical or religious sentiment that “by their fruits we shall know them”; generally if you look around, I believe very much and that is generally our knowledge that certain things that appeared impossible are now getting better and better. I have a very positive view of the current situation in this country I think it is up to individual to express or define what the term leadership means. There are different leadership styles which can get different results, one can’t say one style is better than the other, you can only conclude by looking at the results and if you look at the situation as it is, we are just starting and several things that were turmoil and serious crisis could appear to be settled. As you can see, you and I are enjoying electricity supply by a local power company, we are not burning diesel or whatever as we are taking, it is a small one but it also says something’s are being possible. Generally ,if you look at the environment, I don’t think that crime is getting higher, I believe very much that Nigerians have

been through a lot and behold, we are mostly very positive that the country is heading to the right direction, it might take some time, for many things to fully settled. You made mention of the improvement of power regeneration or power supply since it has improved in your place does it also attract extra charges? Obviously it reduces the cost of production, if you look at the cost of energy – if you are driving it yourself, depending on the size of your operation, it is quite expensive to burn diesel. Very expensive when you compare it with what you normally pay, it is significantly cheaper. That was why everybody was kind of hopeful that the old NEPA would perform, and then the new organisation that took over the responsibility would come up with new polices, the polices to regulate the kind of charges they can give; the kind of activities they can ask consumers to do like provision of transformers. How has the journey been so far as the chairman of PMA and as the MD and CEO of VODA paint? I would say it is very challenging in the sense that one can see that there are lots of things that members would want but unable to acquire them, but most of these things are not things you can just snap your finger and get done. The issues that are very dear to our members, to their existence, to their success, to their continuity, to the business and then most important things, is that the one that we can do on our own we are already attempting to fix them. We are looking at a set of activities in the first instance; we understand our problems much better such as unwholesome practices all over the place which affect our members adversely. It is not just our industry, it is the question of adulteration, the sale of substandard products and some kinds of importation, which are not completely well regulated or monitored, all of these are things we as members and as an association have resolved to see how

It has been a very interesting journey, managing in this period has been a major problem, as you know, the past decade in particular has been a very challenging one in this country. The paint industry is one area that this country should be proud off, the paint industry is the place where you have the highest number of local initia-

tives, if you look around, MAN members, you would find that this are ousters that started on one little seat and one brick at a time, but they have grown very big and that is a source of pride to this country, so if you are competing in such an industry, it is a tough one that is why we all have subscribe to the association. What do you would you want the government to do in other to make Nigeria a safe haven for manufacturer, especially the paint sector which you are heading? Given the fact that Nigeria is part of the global community Nigeria, that is a sign on several things that the days of protectionism is likely gone, so, what is most important is that the association would benefit and all other sectors would benefit from would be actions if the government in states and implement policies that would help ensure smooth running of business in the country.

ignorance by those who were saddled with the task of improving and revamping the education sector. Adigun disclosed that 13 months’ deductions from members’ monthly salaries as check-off dues, which ordinarily should have been remitted to ASUSS are being withheld by government, owing to the blackmail from the NUT. The NUT chairman had during a press conference to herald the World Teachers’ Day last Wednesday described ASUSS “as an illegal body” and accused “former state Governor Kayode Fayemi of breaching the law to have granted it recognition”. “Before any union can operate, it has to be registered by the Registrar of the Trade Unions in Abuja. Former Governor of Lagos State, Babatunde Fashola, did not recognise ASUSS. He told members that as a senior lawyer he cannot breach the law. So, ASUSS to us is an illegal body,” Akosile said. But countering the position, Adigun said: “ASUSS is a union that was legalised to unionise all secondary tutors in Nigeria through the approval of the Federal Ministry of Labour and Productivity. “I am indeed worried, and seriously bothered and challenged that ASUSS that had been operational in many states of the federation could be labelled as an illegal body.

An ocean going vessel identified as MT Askja and a barge have been seized by Nigeria’s Join Task Force on the grounds of a suspicion of being involved in loading of stolen crude oil. The troops arrested the vessel together with the eight suspected oil thieves while the vessel was moored along the Forcados estuary in the Warri South West, according to JTF spokesman Isa Ado, cited by Platts. According to him, the ship is currently secured at Yokri for preliminary investigation. In addition, the command is reported to have confiscated an oil bunkering barge laden with 1000 metric tonnes of what was described as illegally acquired automated gas oil along the river Santa Barbara in Rivers State. The arrest comes in the wake of Nigeria’s national oil company

NNPC’s lifting of ban on 113 tankers imposed in July. The ban was ordered by President Muhammadu Buhari on July 15th, but reasons behind the decision had not been disclosed. However, it is believed that the move was triggered by the country’s efforts to curb illegal oil trading. The list of tankers attached to the ban consisted of mostly Very Large Crude Carriers (VLCCs), with some ship names appearing twice and others that have been absent from Nigerian waters for quite some time like the Happiness, the Huge and the Diona, operated by Iranian group NITC. Following the ban lifting, ship owners have been cautioned by Intertanko to be very careful if trading in Nigerian waters as they might be exposed to checks and potential arrests arising from the ban.

He said that the foundation would incorporate the Attorney General, Commissioner for Education and the Speaker of the State House of Assembly as board members, adding that the board members would ensure that the beneficiaries of the educational gesture were genuinely the less-privileged. He said that 75 per cent of the students would be orphans, adding that the foundation would train the students to the university. WHO warns over global upsurge of blindness

The World Health Organisation (WHO) has warned that at least 285 million people, world-wide, live with low vision and blindness, 39 million people blind, while 246 million have moderate or severe visual impairment. The Chairman of the Nigerian Optometric Association, Imo State Chapter – Dr. Martin Ohiri – stated this while briefing newsmen in Owerri, the state capital, on the activities of the union for this year’s World Sight Day, with the theme “Universal Eye Health”. Ohiri said that the WHO had equally disclosed that an estimate of 19 million children were visually impaired, as 90 percent of blind people live in low income countries. Quoting the Nigerian National Blindness and Vi-

sual Impairment Survey, conducted from 2007 to 2009, Ohiri said that it was estimated that more than one million individuals, aged 40 and above, were currently blind in the country. “This is why a more proactive and intensive intervention approach should be used by governments, governmental and international agencies in tackling this challenge,” he said. He called on the multinationals and individuals to key into the call for eliminating avoidable causes of blindness, as directed by the WHO Global initiative for the elimination of avoidable blindness.

Army bans use of military uniforms by ex- students

Nigerian Army has banned the wearing of unauthorised Army uniforms, accoutrement and kits by ex-students of Nigerian Military School, Zaria (aka Ex-Boys) in civil institutions. The Nigeria Military High Command said the wearing of Nigerian Army uniforms and kits by ex-students apart from obvious security implications, impacts negatively on the image of Nigerian Army. reiterating that wear-

ing of military uniforms or kits on campus by anyone is absolutely unlawful. "More worrisome, is the fact that most of the offenders are ex-students who have deserted the Army, and are not legally entitled to have military uniforms or items within their possessions. "It is particularly important to mention that the ex-Boys who left Nigerian Military School from 2012 when the school ceased to be a military institution,

are expected to surrender their military uniforms and kits after graduation. The Nigerian Army wishes to state that illegal possession of military accoutrement is punishable under sections 109,110 and 251 of Nigerian Criminal Code. "Consequently, the Nigerian Army is working with other security agencies to apprehend defaulters/ impostors in all civil institutions of higher learning in Nigeria. The security

departments of civil institutions and the general public are also requested to report suspected impostors to nearest Nigerian Army formations or security agencies", it stressed. 27.5% Teachers Enhancement Allowance (TEA) by the state government, and the non-payment of September 2011 salaries owed to Secondary School teachers. ‘’It is embarrassing that these salaries are still withheld even when other workers in the state civil and public service have been paid as far back as April, 2015’’, he said. In his remarks, Governor Dave Umahi, who described

teachers as very important in child upbringing and the nation building, pledged to tackle their problems. He said there should be no reason for salary discrepancies in the state civil and public service. You answer the same name with a renowned activist and senior advocate, Femi Falana, has there been any time there was confusion in the courtroom when announcing your appearance before a Judge? Yes, it reminds me my first experience after been called to Bar in 2000. I was to work with Mr Segun Ajibola SAN and on that day, he gave me a test case which was before Justice Marsh. I was to go and adopt summons for direction. I did it happily and I came back to meet him at the Court of Appeal. At that time, Justice Oguntade was the Presiding Judge at the Court of Appeal, Lagos. On getting into the Court, Femi Falana SAN happens to be senior to Segun Ajibola SAN. Few minutes when I came in, the learned silk, Falana, walked in and sat behind us. The matter was called and Segun Ajibola stood up and announced appearance before the Justices been Presided by Justice Oguntade. When he now mentioned his appearance and said appearing with me are my learned friends Tunde Kalaro and Femi Falana. I stood up to take a bow and already lawyers were wondering why Segun Ajibola will announce the appearance of Femi Falana who is his senior at the Bar. The lawyers were astonished when they saw me standing up because I was a new wig at that time. The whole court began to laugh. I took a bow and wanted to sit down quickly but, Justice Oguntade held me on to it. He asked: “where is this new lawyer coming from?” I thought I could have it expressed by smiling and nodding but he asked me: “are you in any way related to the popular Femi Falana?” I said my Lord, biologically, no but, professionally, yes. He is my learned senior. Justice Oguntade again asked:

“are you from the same state?” I answered no. I am from Owo in Ondo state and Mr. Femi Falana SAN is from Ilawe in Ekiti state and I told Justice Oguntade Ekiti state was carved out of Ondo state. All those in court were laughing. If I had been the timid type, it could have been enough to give me a pin fall. At the end of the day, Justice Oguntade said: “the new Femi Falana, I think it will be better to look for a way so that you can also distinguish yourself.” Also, there was a time a letter was written to a client of mine. Again, there was an altercation. Somewhere, somehow, somebody mischievously wrote a petition against me, sent it to the learned silk, maligning that I was actually parading myself as a SAN. When he read the petition he put a phone call to me and said: “is that Femi Falana SAN?” I was just coming out of the court and I answered him no sir. He asked again: “is that not Femi Falana SAN?” I said this is Olufemi Falana. He asked: “is there any difference between Olufemi Falana and Femi Falana?” I said Femi Falana is a popular one who is a SAN but this one is Olufemi Falana, he is not a SAN. Prior to 1960 there wasn’t anything like Nigerian Law Report, Chief Gani Fawehinmi SAN came, brought it up and now we have our own indigenous law reports even after his demise, the law reports is still going on. Prior to that time, we rely on the British Law, most of our laws then were all imported laws but now we have our indigenous reported cases into the judicial system we now cite. Citing of cases is part of the authority we use. Also, prior to 1960, there wasn’t any senior advocate but, we now have them, we now have Nigerian Law School, we have Advanced Legal Studies. The Nigerian judiciary has gone far and wide, it has excelled, as a matter of fact, lawyers are being taken from the system to now represent Africa, to now be part of the World Court, Justices Elias was there, Kayode Eso was there, Bola Ajibola was there, amongst others. if you look at some of the cases being handled by the highly classical and intelligent Judges in recent times, you compare them with Lord Denin of old. When we talk about computer too, it has come in although we have not got to the level of the developed world but we are making an impact. Immediately after the independence we were only having one Supreme Court and now if you look at the hierarchy of the court it has changed tremen-

dously. We now have different courts handling different issues. In 1975, Federal High Court was created. We now have National Industrial Court that takes care of industrial disputes while the FHC takes care of matters under section 71, federal matters that are basically on the exclusive list. We now have different Court of Appeal into many divisions, we have it in Akure, Lagos, Ibadan, Ilorin, Enugu, Kaduna, Sokoto so, there has been an improvement, there has been a lot of development and even in the learning of the law. The judiciary has not done badly, they’ve done well. There is a suggestion that only constitutional matters should be allowed to go to the Supreme Court due to the volume of cases pending at the apex court. Do you share this view? We will be compelled to look at the economy of the state if you now suggest a multi-dimensional courts into the system, where is the wherewithal, the human and financial resources to back them up. We will take into account at the moment that if you want to advice based on what operates in a developed country, if you bring it down to Nigeria, it may collapse. The foundation in 1960 may be good but thereafter, we couldn’t live up to it, it became porous, in such a way that putting something on it is like putting something on noth-

The system is so loose at the moment, we have not been recording successes in everything we’ve been doing and it all bothers down on corruption. If an average Nigerian wants to enlist in the Army or Police, his or her main target is not to serve the fatherland but, to be corrupt and that system comes into the judiciary system. If you now say let there be a Supreme Court strictly responsible for constitutional matter while another will be for allied matters. The problem now would be that because our system is so corrupt, it will lack coherent of the decisions to be taken up there. We are having just one apex court, when they bring out decisions from there we are still having problems there, the only thing lawyers would say is that Supreme Court has overruled itself. We have seven Justices at the Supreme Court to make a full court on constitutional matters though five of them could sit on allied matters or read judgments, the same also at the Court of Appeal, one Justice could read a judgment of three, if other two are not available in such exceptions but, as it is presently, some of the courts don’t sit because they don’t form quorum, where they are three, several times, if one of them is sick, the court of appeal will not sit and several times the Supreme Court could not form a quorum when they were to sit on constitutional matters and backlog of cases were there especially during the Babangida regime. If we now want to divide the Supreme Court, where are the personnel? Where is the economy to sustain them? That again will necessitate going back to the constitution and have it amended, if it is going to be amended, who will amend the constitution? How do you want to amend the constitution that you did not draft? To what extent is it going to be formidable? Ordinary civilians have never drafted a constitution in this country except the 1963 constitution. It is not only constitutional matters that goes to the apex court, we still have other criminal matters that are of capital punishment unto which you can’t separate them, they are of right in an appeal, straight to the apex court. Whereas there are some matters that got stocked at the Court of Appeal, for instance, electoral matters. It has been said that the constitution lied about itself

as a result of the preface which states that: “We the people of Nigeria…” whereas it was only few individuals that drafted it. Are you also of this view? I am of this view and I concur with the same argument of these people who believe that we are just alien to the constitution that we claimed to be ours. We are just masquerading to the fact that we have a constitution. The constitution which states that: “We the people of the Federal Republic of Nigeria having solemnly sat together to make this constitution that we would call ours”, was there a referendum between us that suggested what we wanted and now say let this be our constitution? No. When the military came in prior to 1979, the military suspended the constitution and were ruling us with decrees and regrettably the decrees were housing many provisions of the constitution, the military suspended substantially all parts of the constitution. When Obasanjo left in 1979, Shagari came in and we said we were back to constitutional life, a civilian regime but, we know that the constitution that was suspended prior to 1979 was the 1963 constitution. To make a constitution, every voice of members of that country must be heard but what they did was to inaugurate a constitutional

drafting committee that was headed by the late Chief Rotimi Williams SAN and other friends of the military who were made to be part of it. The constitution was drafted, never passed into law in anywhere. When they now transferred government to the civilians, they said: “this is your constitution, the 1979 constitution.” We read it in the preamble that “we the people”, life continues from there compared to the American constitution of hundred thousand words that originated from the scratch to the last. It went on and in 1983 it was again suspended when Buhari came back. From that 1983 till 1999, we were being ruled by military fiats, decrees, we knew a lot of them. When it was getting to 1999 they said 1999 constitution, “we the people of Nigeria”, are the military the only people in Nigeria? We met and found ourselves in a state of helplessness, in such a way that there wasn’t anything we could do even though there were many to be done but, it’s a thing that will bring anarchy into the system. No wonder people keep saying we have no constitution and that being the reason it has been so difficult for them to amend it and that being the reason why there is still anarchy in the land, because the constitu-

tion we called ours is not ours, it was formulated by a few. At a point in time when they realized the High Court was having too much power, the 1979 constitution called it unlimited jurisdiction somebody just woke up in his room and said this unlimited jurisdiction we have to take it away from the High Court and it was turned to limited. Where did we sit to agree it should be limited? At a point in time, somebody just felt they need more land and they said let there be Land Use Act and they have it included in the constitution and before you know it, they took our lands away, we no longer have the freehold, land became the leasehold. These were all laws and activities that were planted into the 1963 constitution; they were rolling the constitution over, including so many laws and till it got to the 1999 constitution which now became as amended. The constitution we operates today does not originate from the people, it originates from the military, right from Aguyi Ironsi down to Abdulsalam Abubakar that last ruled us, they were the ones making the constitution. So which of the constitutions adopted by the country would you adjudged to be the best for the people? None, except the independence constitution and the 1963

constitution that was basically formulated by the civilians though they were originally incorporated by our British masters, changed it into our system and we start operating it that is the one that reflects whom we are, our ethics, ethos and practices. But, if you look at it from that period, they were constitutions made by the military, handed over to us to be using including the 1999 constitution as amended that we call ours. There has not been anyone made by civilians but by a group of the military who have ruled us for so long and bought us down to this level we are now. There is no constitution I can say is the best. The 1999 constitution incorporated the desire of some few individuals like I earlier mentioned in some sections that were brought there. Whatever we want to incorporate into the constitution such as National Industrial Court, the Land Use Act, Federal High Court, all these must come from the people. It should not be a thing dictated to us by Obasanjo and have it incorporated and have it handed over to us in such a way that the Land Use Act is no longer an act that can be quashed by the National Assembly but, part of the constitution. Some lawyers are advocating for the adoption of report of the last national conference. Do you think that the implementation of the confab report is a way forward for the country? I say equivocally and without any regret but with absolute sense of responsibility that that confab report is not the way forward, there is nothing there. A lot of those icons who went into the confab went there with good intention believing that most of the bad areas in the constitution would be put right but, after coming out of it, their intention was not total. A lot went to protect their selfish hegemony; some went there to make money. Ask some of them that what did they bring from the confab, what did they contribute? Some said the name of the country be changed, is the name of the country the problem? No. What is our problem? It is corruption and to what extent is that confab able to handle the issue of corruption from the grass root? I have not seen where it has actually been addressed. All the sector of the economy has been infected in such a way that even if Jesus Christ is to come and amend it, he would be infected.

helsea midfielder Mikel Obi and Odion Ighalo of Watford were the first Super Eagles players to arrive the team’s training camp in Belgium ahead of friendlies against DR Congo and Cameroon. Mikel was not listed by his troubled London club at the weekend, while Ighalo smashed his fifth goal in the EPL for Watford. he Nigeria Football Federation has confirmed that Stade de la Cite de l’Oie, Vise and Ros Beiaard Stadion will now host Super Eagles’ international friendlies against DR Congo and Cameroon on October 8th and 11th respectively. Stade Charles Tondreau – home of Belgian division 3 outfit Royal Cercle Sportif Visé will be the battle ground when the Super Eagles slug it out with DR Congo on October 8 with the kick off at 7 pm. Three days later, Sunday Oliseh’s men will head for Ros Beiaard Stadion where they face arch rivals Cameroon which starts by 6pm. This was confirmed by the Nigeria Football Federation via their Twitter handle. The Super Eagles last played the Indomitable Lions in February 2004, when Austin Okocha’s free kick sent them out of the quarter final of the Africa Cup of Nations in Tunisia. These games were lined up to prepare Nigeria for next year’s Africa Cup of Nations and World Cup qualifiers.

Buhari shall not be the petroleum minister “The President shall not, during his tenure of office, hold any other executive office or paid employment in any capacity whatsoever.” – Section 138, Constitution of the Federal Republic of Nigeria, 1999.

Pursuant to the above quoted Section 138 of the Constitution of the Federal Republic of Nigeria, 1999, the President is expressly, definitively and unambiguously disallowed from holding any other executive position throughout the duration of his presidency. As has become a customary, albeit most offensive, feature of his presidency, Mr. Buhari chose to formally inform his fellow citizens of his ill-advised intention to retain the coveted Petroleum Resources ministerial portfolio while on foreign soil, precisely during his recent visit to New York, in the United States of America. Media sources have quoted the President’s spokesperson, Malam Garba Shehu, as citing the deisre to personally superintend the restructuring of the corruption-infested pertoleum industry, as the rationale for Mr. Buhari’s controversial decision. The unstated precedence that may have encouraged the Mr. Buhari to do likewise, is the fact

that his predecessor, former President Olusegun Obasanjo, also held the office of Petroleum Resources Minister throughout the latter’s tenure, from 1999 to 2007, in violation of Section 138 of the Constitution of the Federal Republic of Nigeria, 1999. As we await the processing of President Buhari’s ministerial nominees by the Senate, pursuant to Section 147 (2) of the Constitution of the Federal Republic of Nigeria, 1999, it is pertinent to raise a clear alarm not only about an imminent infraction, but indeed to shed light on an ongoing illegality. Since his assumption of office on May 29th 2015, President Buhari has been exercising the substantive power and authority of the Minister of Petroleum Resources; and is likely to continue to do so till the very hour of the publication of this piece. Perhaps he may even continue to do so thereafter if he is not advised to the contrary. Based on the foregoing, it is indisputable that Mr. Buhari is in ongoing violation of Section 138 of the Constitution of the Federal Republic of Nigeria, 1999. It is possible that former President Obasanjo and in-

cumbent President Buhari may have relied, or may be relying, on the seemingly broad power of the office of the President, pursuant to Section 5 (1) (a) of the Constitution of the Federal Republic of Nigeria, 1999 which states: “Subject to the provisions of this Constitution, the executive powers of the Federation shall be vested in the President and may subject as aforesaid and to the provisions of any law made by the National Assembly, be exercised by him either directly or through the VicePresident and Ministers of the Government of the Federation or officers in the public service of the Federation.” However, I believe it is settled in law that where certain provisions of any grundnorm are ambiguous on a particular subject matter, the existence of any prohibitive provision effectively circumscribes and supercedes every other section which may suggest otherwise. This means that the express prohibition provision as stated in Section 138 of the Constitution of the Federal Republic of Nigeria, 1999 effectively precludes President Buhari from appointing him-

self Nigeria’s Minister of Petroleum Resources and, therefore, also disallows him from exercising the substantive power and authority of the referred executive office. Accordingly, the widely reported speculation that the President is likely to nominate Dr. Emmanuel Ibe Kachikwu, the Group Managing Director (GMD) of the Nigerian National Petroleum Corporation (NNPC) as the Minister

of State, Petroleum Resources, should also be reviewed. Going ahead with this plan is most likely to violate certain provisions of the Nigerian Petroleum Act, 1969 which clearly states the functions of the Minister of Petroleum Resources, the Board of NNPC, the GMD of NNPC, etc. Furthermore, may I humbly suggest that the President reconsider

this plan and allow the eminently qualified Dr. Kachikwu focus on the already onerous task of reconstructing the NNPC. Since President Buhari has an established reputation as a dogged advocate for the rule of law, I hereby invite other more learned persons and constitutional authorities to weigh in on this very important subject matter, in order to prevent the President from perpetrating a constitutional breach which, as of today, is ongoing. Nobody can convince me that in a country (i.e. Nigeria) that boasts of many leading authorities in Petroleum Resources engineering and administration, President Buhari is unable to find any competent and credible person to champion the much anticipated reforms in the petroleum industry. Like millions of Nigerians and many well-meaning persons all over Africa and the world at large, I continue to pray that God grants President Buhari the grace and wisdom to enable him steer this nation aright. bia Warriors coach Ladan Bosso is regretting their failure to secure all three points following their thrilling 3-3 draw against Rangers on Saturday in the Nigeria Professional Football League. Home boy Chisom Chikatara scored a hat-trick and Warriors led 3-2 right down to the death, before Chisom Egbuchulam scored a last minute equalizer for Rangers. But Bosso, whose team benefited from two very controversial penalties, believes they should have won the game. “It was a game we should have won because we played better,” Bosso said. “We created chances and played better and I thought we should have won it but maybe we were a bit unlucky in the end.” The former Nigeria U20 coach however goes on to commend Rangers for giving them a good game. “The truth is Rangers played well. They are also a good team and we must not forget that. They gave us a good game and when we thought we had won the game, they scored an equalizer.” Elsewhere, Heartland defeated Enyimba in the other Oriental Derby 2-1, to blow open the title race after Warri Wolves beat Sunshine Stars 3-0 on Saturday.

Rap diva, Eva Alordiah, aka Eva, has been creating quite a buzz ever since she came into the music industry. Eva, who doubles as the CEO of Make-up by Orsela, a make-up/cosmetic outfit, is not leaving any stone un-turned when it comes been creative. In this chat with MUTIAT ALLI, the sensational Rap queen reveals her love for style, music and other issues. Excerpts: Beyond the songstress, who is Eva? Eva is a laid back, I-don’t-wanna-go-out type of chic. I love to stay home, cook and serve people food. I’m a go-getter, very calm but aggressive with my work. I believe in the gifts that abound from sharing. I believe in the satisfaction derived from personal worship with God. I am a strongwilled person. What thrills you the most about makeup? That would definitely be special effects. It’s more challenging than the regular beauty and fashion looks, especially if you are working on whole body pieces. I have loved horror movies since I was a child. I mean, I don’t even think I enjoy a movie if it isn’t horror or action where there’s a lot of blood and special effects going on. I think that’s where my interest in SFX stems from. Special effects makeup is like my getaway drug. Zombies, dead skin, bruises, scars, animated characters, missing limbs, skeletal frames, the works; I just sit there and create realistic life forms and it fuels my creative senses, makes me happy. You do your make-up unaided? Yes, I do my make-up for my video shoots, photo shoots, events, etc. I also have a lot of exciting job opportunities from artistes, celebrities, magazines and a host of others.

So if I am at the makeup school teaching for instance, I couldn’t be bothered with what’s going on with my music in the studio and so on. Which is more fulfilling for you? I find fulfillment in just being creative. So whether it is music, movies, makeup, writing or fashion, as long as I am creating something, I am fine. I find them both fulfilling in their different ways. I guess music and makeup both serve their purposes for me. I can’t exactly say this is how much satisfaction or joy I derive from doing music and performing, or compare that to how I feel with make-up artistry. Everything I do satisfies me and fills me in its own way. I’m very grateful to God for being able to do the things I do. Really they are all hobbies. I don’t necessarily treat them like tedious work. Out of the other genres of music, why Rap? It was love at first listen for me, really. I have always been a writer and lover of music all my life. My brothers brought hip-hop to the house and I got hooked on that. Rap challenges my writing process and I guess I like a challenge. I love how so true rap can cut across globally and it is fun to be part of that, maybe even create over here with people who love it enough to keep doing it. You have a very strong personal style which has come to be accepted as the “Eva” brand. How would you describe your style? My style is full of funk and flare. I guess I could say that. I am very edgy, very spontaneous and I like to stay younger and younger with it. I don’t like it difficult. I like it extra creative and well put together. For the most part, I am at my best when a lot of people do not agree with my choices. That’s how I know I satisfy myself.

How are you able to combine this talent of yours, from been a rap diva to make-up and entrepreneur? I haven’t been able to combine things as best as I would. I really just have enough time to focus on something at a time. But I love being all these different things and they all find a home in my career as a music artiste. I supervise the business end of my music. I do my makeup for my shoots and videos. I design and style my outfits with some of the most talented designers across Nigeria. These are just extensions of me being a creative person at heart. So whether it is writing, designing, drawing, creating music or makeup artistry, as long as I am creating something, then it’s just relatively natural for me. So, I guess you could say I am being of service to Eva right now. When I get breaks from music, I exert

What cheating on my fiancé taught me about monogamy Mutiat Alli

T

ade was my first real boyfriend, my high school sweetheart, my date to four proms. He was the first guy I’d ever brought home who could look my mom in the eye. A nice guy. A year after Tade and I first started dating, I came home from high school one day and my father was gone. Just like that, he’d left my mother for another woman. I never dealt with the abandonment. Instead, I consoled myself with the knowledge that Tade loved me and would never leave me, not like my dad had. Never mind that he and I grew less compatible as we got older, he was everything my father wasn’t. The first time I cheated on Tade, we were in university and I was living in Mexico as a student abroad. I slept with a guy who worked behind the deli counter of the bodega on the street where I lived. I told myself, what happens in Mexico, stays in Mexico. I told myself it didn’t count. Then it happened again, this time back on campus. One night, I drunkenly stumbled home with a guy I’d met at a party. I told myself it’d been a mistake. I kept dating Tade. I never told him and he never found out. A lot of people think monogamy simply doesn’t work. They argue that human beings just aren’t wired to be with one person and one person only — a common argument that was used in defense of the people ousted in the Ashley Madison hack — and that it’s time to do away with this convention. This was how I justified my transgressions back then, by telling myself I couldn’t control it. It was just human nature. I didn’t stop. My first full-blown affair happened a few years later, after Tade and I had graduated from the university. This time was different. Tayo and I had been friends first. We trusted and respected one another. That didn’t change when we started having sex. I thought I was in love with her, and so I came clean and told Tade I was having an affair. I thought that telling him about Tayo would absolve me of the guilt I felt for all my past indiscretions, but that didn’t happen. Tade was devastated; it was all my fault. To Tade’s credit, the fact that it was a woman made it neither better

nor worse. He wanted to work it out, and I felt I had no choice. I was confused, we decided. I convinced myself that Tayo had taken advantage of me and that it had been a mistake. After my affair with Tayo, I redoubled my efforts to gain control of the situation: I tried to be “good.” I stopped drinking and started running marathons. I quit my job and went to journalism school to become a writer. Two years later, Tayo and I were engaged. But in the journalism school, I met a new group of people. They thought like me and read the books that interested me. We talked about sexual liberation. I considered myself sex-positive, part of a social movement that embraced sexuality with few limits. The problem was that — when it came to sex — these political and intellectual beliefs about sex made it that much harder to admit that my personal sexual conduct was problematic. I’m just incapable of monogamy, I was still convinced. Since Rick wanted to be with me, this was something he’d just have to accept. Austin was a guy I met in journalism school. He and I would chat online all day when I was at work, and we started attending literary readings together in the evenings. We were seen together so often people started to assume we were dating. Secretly, I enjoyed this. Never mind that I was still engaged to Tade at the time. Austin was a writer, destined for success, popular in the way that tenacious, overachieving kids can be. Though my relationship with Austin had yet to turn sexual, it felt inevitable. One night during this time, a guy named Elliott walked me home after class. Whatever we talked about was not interesting, but I could tell that Elliott was interested in me and I liked the feeling of being desired. Under the pretense of having something to do with school, we started

exchanging emails daily. Austin and Elliott were friends, and I kept my relationship with one from the other (and both, obviously, from Tade). The impossibility of my actually being with either of them made it all the more exciting. Elliott suggested once that I shouldn’t flirt with him because I had a fiancé. Hearing “no” only egged me on. I admired his resistance. Then, once while drunk, I leaned into Austin and kissed him. He kissed me back. I immediately regretted it, knowing exactly what would happen. I knew I’d become insecure and possessive. Like my relationship with Tayo, my friendship with Austin would be destroyed. It was as if the only way I knew how to handle having done something I regretted was to do it again. That kiss led to a short-lived affair with Austin, which lead to a series of other infidelities. For the next month, any chance I got, I’d get drunk and fall into my classmate’s mouths — forgettable, regrettable, sloppy encounters in the restrooms, stairwells, and alleyways. I told myself I was having fun, experimenting. But it was more than harmless fun. I pretended Tade and I had an open relationship. I convinced myself that our rule was “Don’t ask, don’t tell.”At the same time, I resented Tade for not calling me out. I lost respect for him. I also lost respect for people who fooled around with me. I lost respect for myself. Ultimately, carrying on multiple relationships was a complicated way of avoiding intimacy. I clung to Tade, even though it was an ill fit. Because he didn’t satisfy my impossible neediness, I cheated. I was never fully present in any one relationship, and thus avoided being vulnerable. Underneath it all, my actions were motivated by the fear I was unlovable and that I would be abandoned. The worse I felt, the more I sought reli ef. When I finally left Tade, I took everything:

the furniture, the posters from the walls, photographs ripped from the albums. I came by the night after I moved out and found Tade crying, alone, sitting on the floor. The look on his face was as if I had died, and so I felt afraid. I said, “Stop crying or I’ll leave.” “You’re leaving anyway,” he said. “There’s nothing I can do to stop you.” He was right. There was nothing that he or anyone could have done to stop me. I was a monster, abandoning someone who loved me. I was just like my father. It took me a long time to recover, whereas Tade started dating someone else less than a month after we’d broken up — the woman he would eventually marry. Around the time they started dating, Elliott stopped returning my emails. He was doing me a favor by cutting me off, but of course I didn’t see it that way then. When Elliott refused to step in and rescue me, I grew increasingly desperate. I felt abandoned. I was angry at my friends. Recovery began when I finally started taking responsibility for my actions: I went to rehab for my alcoholism, and my addiction to sex and love. I didn’t do recovery perfectly. They tell you to take time away from dating, but I couldn’t do that. My sixth day of sobriety, I fell into a codependent relationship that lasted for six years. It was dysfunctional, but at least I was monogamous. When that relationship ended, I dated lots of people. But eventually I did go cold-turkey single for around three months, and it was one of the most transforming periods of my life. I learned to enjoy my own company. I grieved the loss of my father and became acquainted with the feelings I was running from. Today I know that while non-monogamy may be human nature, cheating is not. Everyone is capable of being honest about their feelings, wants, and needs. Before this, I blamed everyone for my cheating and had loads of excuses, but when it comes to infidelity, I don’t think there’s ever an excuse. The fact that I’m in a committed, monogamous relationship today is almost beside the point. To be right in a relationship, I needed to get right with myself. In the life of every teenager, society plays an important role in shaping teens character; society also helps shape ability to leave among people, their ideas of wrong and right and their general outlook of life. Teens also need help from their parents; parents have strong influence in the lives of their teens. A Christian Broadcasting Network programmes says: “Understanding the influence various aspects of society have on your teens help parents to nurture the character of their teens�. Parents spends more time with their teens and influence them through their actions and

words. Teenagers learn a lot of skills such as Nurturing, Socializing, and DecisionMaking through observation and communicating with parents. Involved parenting is more likely to prevent their teens from drug and substance abuse or teenage unwanted pregnancy. Although teenagers may seem rebellious, they are likely to adapt the good character as they mature.

Teenage and Media The Media also can influence teenagers positive or negatively because teenagers spend more of their time on the internet, watching TV, reading magazine and listening to music. Negative influence from the media include violence, hateful or vulgar language in movies or music, explicit sex scene, gender, religious

or ethnic stereotyping, and unrealistic presentation. Alternatively, the media is a source of info-mating teens. It helps create cultural, political and social awareness for teenagers. They also help teens get a better understanding of their environment and society. We can also look at the aspect of friends in the lives of a teen. In the life of every teenager, the choice of friends and people to associate with can influence them positively or negatively. This is why parents try everything possible to keep a close eye on their teens and the kind of friends they associate with in the society. Outside this, teenagers play very vital roles in the society and they are not taken very seriously on what they do, what they can accomplish. The role of a teenage boy or girl in a society should

be taking into consideration; first they are relatively cheap labour. Also, they are the ones responsible for learning, so when they grow into their 20s, they can fix the ills of societies. Next, teenagers are to change the stereotypes associated with them. Every generation grows up into a completely distinct world, depending on when they grew up. There are many teenagers in the society today who are risk-takers and are drawn to adventures and dangers of life. Community, if I will say, plays a measure and important role both in the life of teens and their behaviour. By getting involved with community activities, teenagers can come into contact with like-minded peers and positive adult role models other than their parents. Interacting and cooperating with other adults encourages teenagers to see the world in different ways.

DEMO Africa: ICT offers Africa opportunity for job, wealth creation — NITDA DG Stories by Tony Nwakaegho Director General of the National Information Technology Development Agency (NITDA), Mr. Peter Jack has said information communications technology [ICT] offers Africa tremendous opportunity for job and wealth creation, and especially for Nigeria that is blessed with over 1.2 billion people with a huge opportunity for growth and improvement. Jack, who made this declaration at the just concluded DEMO Africa, hosted by Nigeria and sponsored by NITDA, noted that African youths are beginning to rise up to explore the power of ICT in order to create “a new lifestyle for themselves”. DEMO Africa is one of the flagship initiatives of LIONS@ FRICA and aims to connect African startups to the global ecosystem. DEMO Africa is the place where the most innovative companies from African countries get a platform to launch

their products and announce to Africa and the world what they have developed. Nigeria has hosted Demo Africa twice, 2014 and 2015. Jack said Nigeria was delighted to host its friends and partners within and outside the continent for the important technology event. “This is such an event where African ICT startups and entrepreneurs have the opportunity to show to Africa and the rest of the world their innovative products that are addressing specific challenges within our continent, and perhaps with potential for export to other parts of the world with similar challenges.” “Africa has a huge population of over 1 billion people. Despite this contrast, Africa possesses a huge market potential for trade and investment and a huge opportunity for growth and improvement. Building the value chain that will deliver these end results has become or should become the collective responsibili-

ties of many players across the world”, he explained. According to him, through ICT, great companies such as Microsoft, Google, Facebook, Twitter and Amazon which are products of DEMO Africa have been birthed. The National Broadcasting Commission (NBC) has disclosed that the federal government can generate as much as N330 billion yearly from digital broadcasting, should Nigeria achieve the new date of June 20, 2017 for the country’s Digital Switchover (DSO). Digital switchover is the name given to the process by which analogue terrestrial television is being replaced with digital terrestrial television. It is sometimes referred to as the “analogue switch off ”. The Director-General, NBC, Emeka Mba, said although Nigeria had missed out twice in its DSO plan, the recent date, being June 17, 2015, the country still has huge opportunity to catchup with DSO, should government sees it as self-sustaining project that will contribute to the country’s Gross Domestic Product (GDP). country before end of the year. He said over 500,000 set top boxes would be manufactured and channeled to Jos for the relaunch, adding that “Offshore mass production and delivery of initial subverted boxes for Jos pilot project is envisaged to be completed by the end of October, while the local manufacture of the set top boxes is expected to begin in April next year. “By the end of November 2015, we plan to complete the process of setting up the contact centre, which becomes available for all enquiries from members of the public regarding the implementation of the DSO.” Speaking on the benefits of DSO to consumers, Mba emphasized by the time Nigeria would go digital, Nigerians would receive over 30 new free to air channels per annum for the price of a N1,500 set top boxes. 27 Nigerian varsities go online to boost content, research & development Prof. Julius Okojie, executive secretary, National Universities Commission (NUC), said so far 27 Nigerian universities had been connected to share high-speed 10 gigabit core and internet resources content to boost research findings in the nation’s higher institutions. Prof. Julius Okojie, who made this disclosure at the just held West African Research and Education Network (WACREN) workshop on Network Monitoring and Measurement, said the installation in the 27 federal universities, which is the first phase, had so far gulped $10 million (N2.4bn), while informing that N28 billion was still needed to cover all the universities.

“The focus is to enable online researches in universities and offer efficiencies of unified communications and consolidation of digital content in research and development in line with global demands,” he said. He noted that over a period of 30 years, Nigeria lost out in research findings in higher institutions because of lack of capacity from professors and academic doctors who travelled out as diasporans outside the country. “What we are trying to do is to ensure that we intervene through diverse means by ensuring we build capacity of our academics, build infrastructure on ICT to accommodate diverse

research methodologies such as video conferencing, teleconferencing, that would bring faster results for collaborative learning between educational institutions within and outside the country,” he said. SAP has revealed the start of Africa Code Week, a continentwide initiative to spread digital literacy and simplify access to coding education for 20,000 youth. UN Broadband Commission to remain focused on sustainable development goals

Stories by Tony Nwakaegho The power of broadband to leapfrog development roadblocks and bring access to education, healthcare and employment opportunities should put highspeed information and communication technology (ICT) network roll-out at the top of every country’s SDG strategy, according to members of the UN Broadband Commission for Digital Development, which met in New York . This week’s adoption of the 17 SDGs sees the Commission enter a new phase, with 22 new members drawn from a range of sectors including the global technology industry, government ministers, leaders in education and healthcare, and two additional UN bodies who join existing Commissioners from ITU, UNDP, UNESCO, UN-ORHLLS, WIPO and the UN Foundation. Established in 2010, as a toplevel advocacy body promoting broadband as an accelerator of global development, the group is chaired by President Paul Kagame of Rwanda and Mexico’s Carlos Slim Helú, with ITU Secretary-General Houlin Zhao and UNESCO Director-General Irina Bokova as co-Vice Chairs. “The UN Sustainable Development Goals will stimulate action over the next fifteen years in areas of critical importance for human-

ity and the planet. “All three pillars of sustainable development – economic development, social inclusion and environmental protection – need ICTs as key catalysts. That is why the Commission believes that ICTs, and particularly broadband, will be absolutely crucial for achieving the SDGs,” ITU SecretaryGeneral Houlin Zhao said. The Commission’s annual State of Broadband report, released earlier, reveals that household Internet access in developed countries is close to saturation, with more than 81.3% of households connected. But while the proportion of households in the developing world with Internet access has increased from 31.5% to over 34.1%, it remains well short of the Commission’s target of 40% by 2015. Household connectivity figures also mask strong disparities; in the 48 UN Least Developed Countries fewer than 7% of households have Internet access, while in sub-Saharan Africa only 1 in 9 households is connected. “To succeed, the new Agenda will draw on all accelerators of inclusion, all multipliers of poverty eradication and sustainability, and our message is that broadband, and new technologies, are a transformational force, to build inclusive knowledge societies. “This goes beyond mere advo-

This is about opening new paths to create and share knowledge, about enhancing freedom of expression, about widening learning opportunities, especially for girls and women, about developing content that is relevant, local and multilingual – this message has never been so important,” UNESCO Director-general, Irina Bokova said. Speaking at the opening of the Commission session earlier, President Paul Kagame stressed the importance of putting technology at the heart of development. According to President Kagame, “Four billion people still have no Internet access. There is an urgent need to reverse this trend. Fewer than seven per cent of households in the Least Developed Countries are connected. This is a problem, of course, but it is also means there is a lot of room for growth. In Africa, we are determined to seize this opportunity. An example is the Smart Africa initiative, which encourages nations to invest more in infrastructure, innovation, and entrepreneurship.” President Kagame invited Commissioners to attend the Transform Africa Summit taking place in Kigali on 19-21 October, adding that the summit will be a time to forge the way forward towards further implementation of smart and sustainable ways to harness ICT for Africa’s development. This 12th meeting of the Commission also welcomed a number of special guests, including H.E. Luis Guillermo Solís, President of Costa Rica; distinguished British filmmaker and activist Baroness Beeban Kidron; and Klaus Schwab, Executive Chairman of the World Economic Forum. “The proposed set of 17 SDGs provides a clear and solid framework for human development. Broadband represents a powerful way to accelerate progress towards their attainment. We need to look at innovative crosssectoral strategies that can leverage the power of high-speed networks to improve education, healthcare and the delivery of basic social services to everyone, and especially the poorest in the world who need them most,” Broadband Commissioner Dr Carlos M. Jarque, who also represented Co-Chair Carlos Slim said at the meeting.

In preparation for Africa Code Week, SAP has deployed its own IT experts as volunteers to train adults, parents, teachers and government staff, giving them the tools they need to bring coding knowledge to children and youth. To-date, they have already trained 1,500 educators. Workshops for the 8-11 and 12-17 age groups are based on Scratch, the famous system developed by the MIT Media Lab to simplify the

ICANN approves waiver for registrar’s insurance The Board of Directors of the Internet Corporation for Assigned Names and Numbers (ICANN) said it has approved a waiver for the registrar’s insurance requirement in the accreditation process of the global domain names. The industry analysts has canvassed that it has become an unnecessary barrier to registrar accreditation globally and likely to bring about reduction in cost of doing business in the domain name industry. However, It will be recalled that since 1999, the Registrar Accreditation Agreement (RAA) has required that registrars maintain Commercial General Liability (CGL) insurance policies with policy limits of at least US$ 500,000, while in some countries it varies but not less than $200 on average. The board decision is coming on the heels of an 18-month research, analysis and community consultation, to determine that this type of insurance may not serve its intended purpose of protecting registrants, and, in fact, may have inhibited the ability of prospective registrars to be-

come accredited in some regions. It was based on this that ICANN’s board resolved on 28 September 2015 that ICANN waives this requirement in all RAAs, effective immediately. ICANN also remarked that CGL insurance policies, for instance, generally only cover certain incidents that occur on a company’s premises, as qualifying events may include a customer that is injured in an accident on the premises or an incident that occurs due to an employee’s actions. While this coverage is useful for these types of incidents, it would not cover registrars’ potentially wrongful acts, such as failure to renew a domain name. ICANN said that another factor considered include the availability and cost of CGL insurance globally. “While it is common and readily available in some regions, it is more difficult to find—if available at all—and significantly more expensive in many other regions, including parts of South America and Africa,” ICANN stated in blog post.

THE PRICE OF AN AFRICAN FOOTBALLER’S DREAM F

ake agents and false promises trap budding footballers who seek overseas contracts to make a name for themselves. Saeed Osumar’s passion brought him from Ghana to Moscow after someone posing as a football agent five years ago had asked him for $2,000 to secure a contract with a Russian club. The amount was four times the annual minimum wage in Ghana. Osumar made his own way to Moscow, eyeing the greener pastures that apparently awaited him. Once he got there, the ‘agent’ disappeared. And so did the money. Tales like Osumar’s are not uncommon. According to an estimate by Foot Solidaire, a Paris-based charity working to increase the protection of young footballers globally, up to 15,000 young African footballers are taken abroad annually under false hopes – over a third of them head to Europe. ‘Stay patient and focused’ Twenty-six-year-old Nigerian footballer Stephen Sunday has developed an international career in Europe after a remarkable twist of fate. At 15, he was left stranded in Paris after a man who had promised him an overseas contract disappeared. After spending two months alone in France, he managed to move to Madrid, where some fellow Nigerian footballers helped him secure his first contract. He now plays in the Bulgarian top tier with CSKA Sofia. “My advice to young players would be to take one step at the time, to stay focused and not allow any agent to distract them from what they are doing,” he said. “One needs to give an agent two years [before trusting him]. If he really cares about you and wants the best for you and your career, he will stick with you and press clubs until he finds the right one.”

Many end up stranded in Europe, Asia, North America or the Middle East as they cannot afford to return or are too ashamed to do so. New rules Under the new Fifa rules - finalised in in 2009 and coming into effect on April 1, 2015 - contract negotiations between players and clubs are no longer facilitated by licensed football agents, but by ‘intermediaries’. Football agents were required to take exams run by their country’s football association before obtaining a license. The intermediaries are now asked to register by self-certifying they have an ‘impeccable reputation’ and no conflict of interest. A Fifa spokesperson said that the reform was conceived precisely to curb the ‘unacceptable practices’ that had arisen in the business. Players and clubs are now required to disclose to their football association the full details of each transaction an intermediary is involved in. “The new system should be more transparent, effective and simple to administer and implement, resulting in better and more efficient enforcement at national level,” the spokesperson said. Increased risk? Only up to 30% of international transfers used to be concluded through licensed agents when the reform was drafted, according to Fifa. But Foot Solidaire is concerned that scrapping of the licensing system will increase the risk of frauds and abuse. “It’s a catastrophic reform for the protection of players, particularly young ones, and especially in Africa,” Foot Solidaire founder Jean-Claude Mbvoumin said. This is because the new rules remove the independent vetting and scrutiny of those coming into contact with young footballers. Similar concerns have been raised by

Jake Marsh, head of training and youth protection, sport integrity, at the Dohabased International Centre for Sport Security (ICSS). “[The reform] opens players up to more forms of exploitation,” Marsh said. “We could potentially see more trafficking and it will become harder to investigate.” Marsh argues that football, and sports in general, should adopt more businesslike practices. “I don’t know of many other industries where intermediaries can self-certify their good character, where a broker isn’t properly vetted, regulated or has professional standards.” The Fifa spokesperson, though, stressed that the new regulations only set minimum criteria. Football associations can introduce any additional requirements they deem necessary to allow intermediaries to operate. The English FA, for example, has established that individuals representing minors need to provide a criminal record check from an official body to obtain specific authorisation. An ‘organised scam’ But many football associations will just comply with that minimum criteria, according to Marsh who added that criminal activity in sports has become increasingly sophisticated, which deepened the need for more scrutiny and guidelines. Academy and young players often publish their videos and provide contact details on social media in order to be noticed by scouts. And that is where fake agents often approach them. The criminals then offer the possibility of participating in trials.

“It is an organised scam but for a young talented player, the offer could look totally credible,” added Marsh. Agent Eby Emenike, who works in the UK, Nigeria and Ghana through her agency TBD Sports Management, has seen how convincing the tricks devised by rogue operators are. She has run workshops raising awareness among young players. “I have seen documentation [sent by fraudsters], for example letter-headed documents that are identical to the clubs’ logos,” she said. “The information on there is as it would be if it was a real letter.” Fake agents usually manage to extort sums between $300 and $3,000 for processing paperwork, paying for travel expenses, passports and visas, according to Emenike. Young footballers eager to leave Africa are also inclined to try their luck if they are given a chance, no matter how small, to realise their dream. He was 20 at the time. “I have now realised he probably wasn’t a proper agent. But I never checked. I never thought about doing some research, the only thing I thought was I was getting out of Africa.” He was able to return home and is

now training with a first-division club. But he is still committed to finding a way to leave, arguing that talent alone was not key to securing a major foreign contract. “People outside think football here in Africa is played on merit. In reality, it’s about who you know and can bribe. All the youth wants to travel abroad to play football. And that’s the reason the fake agents take advantage of.” Cracking down Fifa is committed to tackling this issue, according to its spokesperson, and protecting minors was a ‘constant priority’. For example, the new regulations prohibit the compensation of intermediaries involving players under the age of 18. Since 2009, Fifa has also mandated that a dedicated sub-committee approves all international transfers or registrations of minor footballers. Foot Solidaire’s Mbvoumin has urged Fifa to do more to raise awareness among youngsters in Africa, as he believes this is the main solution to eradicate the problem of fake agents. The charity is planning to establish an international information centre, hoping it could help educate players on market dynamics, regulations and rogue agents in a better way. “It’s very important to be on the field, to work with the kids on the ground.
