ast Sunday, June 5, 2016, the international community marked the World Environment Day (WED). The day is usually set aside to create global awareness about environmental problems facing the world. Since 1973, World Environment Day has been celebrated as an annual event to raise the global awareness on the importance of healthy and green environment in the human lives, as well as to make everyone responsible for saving the environment. It is one of the principal vehicles employed by the United Nations (UN) to stimulate worldwide awareness of the environment while calling for political attention and action. The theme for this year’s celebration is “Fight against the illegal trade in wildlife”. It focuses on saving the life of wild animals like elephants, rhinos, gorillas, whales, sea turtles, orangutans, pangolins, rosewoods, helmeted hornbills, tigers including other species. The most important purpose of WED is to take strong actions to restrict illegal trade of wildlife, which is putting the biodiversity of the planet into danger. It would be noted that the campaign started as part of addressing the huge environmental issues like wastage and losses of food, deforestation, increasing global warming and others. Moreover, the occasion reminds people all over the world on the need to change destructive negative habits towards environmental issues, even as it encourages them to make their surroundings safe and clean. In Nigeria, the war against environmental degradation has been moving at glacial pace, while the vast majority of people continue to engage in practices that endanger the environment, tourism and livelihood. For example, those living in coastal communities have continued to use dynamite and cyanide for fishing, thereby wreaking
havoc on fragile marine ecosystems, even as Illegal logging continues despite several deadly floods and landslides resulting from deforestation. It will be recalled that the United Nation Environment Programme, (UNEP), in a recent report stated that many of the earth’s ecosystems are nearing critical tipping points of depletion or irreversible change. Basing its findings on the high population growth and economic development, it said that if the current trend of consumption and production remain the same coupled with a population, expected to reach 9.6 billion in 2050, the earth would need three new planets to sustain our current wasteful ways of living. There is no gainsaying the fact that a healthy environment is a key factor for sustained economic growth. Unfortunately, Nigeria’s environmental laws have not substantially moved forward. We are yet to effectively and appropriately meet the three core functions of environmental laws, namely: preventive, compensatory and remedial functions. Furthermore, our environmental governance is still seriously challenged by problems of unequal inheritance in federalism, insufficient public participation, and lack of cooperative governance. The resultant effect is that environmental decision making, standard setting and enforcement strategies are operating in chaos. This is why we are calling on the National Assembly to enact legislative and regulatory action to promote an effective environmental programme. We hope that World Environment Day will be a good time to remind Nigerians that natural resources are finite and that this planet can only take so much abuse. Therefore, citizens should care about the environment before food sources are depleted, health care costs soar due to air pollution and take care of our towns and cities before they are overrun by garbage.

News Analysis Tuta Absoluta, Lai Moh’d and Nigerians Segun Adio

Federal Government is as confused as Nigerians on the actual cause of the scarcity of the tomato. For some months now, Nigerians have groaned under the acute shortage of the key ingredient in their menu. In markets across the country, the commodity is now not only scarce, but where it is available, the price is far above the roof and beyond the reach of the average Nigerian. Of course, the present leadership, as change agents, would not sit idly by and watch the citizens go malnourished. So, recently, Agriculture minister, Audu Ogbeh, surely speaking the mind of the Federal Government, declared to Nigerians that something called Tuta Absoluta (otherwise called Tomato Ebola) was responsible for the scarcity. Tuta Absoluta – there is nothing one will not hear in this country. Anyway, Ogbeh explained further that the Tuta Absoluta is a pest now ravaging six of the 36 states of the Federation. He had assured Nigerians that the government was already working to contain the scourge. Chief Ogbeh is not a known expert in information management. He seemed to have been too truthful in acknowledging the presence of a pestilence in the land. While Nigerians were
trying to comprehend Tuta Absoluta, Alhaji Lai Mohammed, the Minister of Information, rubbished Ogbeh’s position. Doing what he knows to do best, Mohammed attributed the cause of scarcity of the commodity on Boko Haram insurgents. He reasoned that the problem of insecurity had forced many farmers to abandon their trade and out of the zone where tomato is heavily sourced. The minister has since come under the sledge hammer of some people for linking mere tomato scarcity to insurgency. He has a point, no doubt, but his position is not only verbose, but smells of the usual politicising of critical issues. He is short of linking scarcity of tomato to the previous administration. Granted that many farmers had fled and left behind their farmlands, the minister should explain why the commodity had not been scarce since the advent of insurgency in the country over a decade ago. Why wait till a couple of months ago before effect of insurgency had to hamper bumper harvest of product? By the way, whose theory should be believed between Chief Ogbeh and Lai Mohammed? Most Nigerians would take the former’s explanation. There is no doubt that the government as a team is quite confused on the true state of things. In all, subjecting all issues to politics will not do Nigerians, nor the administration any good.
FG closes case against ex-governor Dariye Andrew Orolua, Abuja

to prove its case of N1.162b fraud against Chief Joshua Dariye, former governor of Plateau State, the prosecution counsel on Monday closed its case. Dariye is standing trial over alleged diversion of about N1.162bn Ecological Fund meant for the state. The witness, Mr. Mohammed Kawu Mohammed, an operative of the Economic and Financial Crimes Commission (EFCC), told the trial judge, Justice Adebukola Banjoko of an Abuja High Court sitting in Gudu District that the anti-graft agency took possession of a property belonging to Dariye located at Asokoro in Abuja. Mohammed who was attached to the Assets Forfeiture and Recovery Section of the ECFCC, told
the court that his team took over the property in 2012 following an interim forfeiture order from a High Court adding that EFCC leased the property and realised the sum of N67 million as rent for the period it took over. However, while under cross-examination by the defence counsel, Mr. Garba Pwul (SAN), Mohammed said he was not part of the investigative team that probed the former governor in 2007, saying:”I did not participate in the investigation of Chief Dariye. Therefore, I have no idea of how the charges came up. “We took over the property and warned the tenants not to relate with the defendant or any other agents. The money we recovered on the property is in the EFCC recovery account” he said. Justice Banjoko adjourned trial till June 10.

Senator representing Kaduna Central Senatorial district in the National Asembly, Senator Shehu Sani, on Monday, described the Kaduna State Governor, Mallam Nasir el-Rufai, as a desperate, saying the governor should be blamed if any harm befalls him. In a statement to newsmen in Kaduna, Senator Sani said that after the condolence visit by the governor over the death of his mother, el-Rufai has continued to use local radio stations against him. According to him, the governor is a Lilliputian who cannot take or stand criticism. The statement reads: “Our attention has been drawn to a hate speech and threat to life made by Governor Nasir el-Rufai against distinguished Senator Shehu Sani in the governor’s circus christened as Town Hall meeting in Giwa Local government on 4th June 2016.
“The governor reliably and evidently referred to Senator Sani, Dr. Hakeem Baba Ahmed, Isa Ashiru Kudan as “ants he will match and crush”. We could have easily dismissed or ignore this statement as tantrums of an accidental governor, but we decided not to take things for granted in view of his history and his allergy to criticism. “Also fresh in our mind is the mass killings and burial of members of the Islamic movement in Zaria last December. We view his unguarded and provocative utterances as nothing but a hate speech and a direct threat to the Life of Senator Sani and others whom the governor perceived as his “enemies”. “We hold Governor Nasiru elRufai personally responsible for any harm done on Senator Sani. This statement is to publicly alert security agencies and the General public that in the event of any injury or assassination of Senator

Jonathan’s remarks were made known on Monday in a statement made available to newsmen in Abuja by the former President’s Special Adviser on Media, Ikechukwu Eze. As the statement was being released, the former president also spoke with Bloomberg TV where he said he is currently under investigation for corruption. “Of course, obviously, I would be investigated. In fact I am being investigated. Investigations are going on. I would not want to make certain comments because government is working,” he said in the television interview. According to the statement,
Jonathan said such a Bill of Rights would end discrimination and tribalism, and promote equality, enabling everyone to work towards the common goal for the development of the nation. “A Bill of Rights, like the British Magna Carta, passed some 800 years ago, enshrined the principle of Habeas Corpus; so that no person is deprived of his liberty without a trial of his peers,” he said. “A Bill of Rights, like that introduced by America’s founding fathers, which stated ‘the people shall not be deprived or abridged of their right to speak, to write, or to publish their sentiments; and the freedom of the press, as one of the great bulwarks of liberty, shall be inviolable.’” Borrowing an ancient Roman phrase, “Civis Romanus sum,” meaning, “I am a Roman citizen,”
Mr. Jonathan said the phrase meant more than its literal interpretation. He argued that the phrase, which was attributed to Cicero, meant that every Roman was entitled to all of the rights and protection of a citizen in Rome, irrespective status and class. “Wouldn’t it be good for us to aspire to a Nigeria where we too could apply that same principle, ‘Civis Nigerianus sum,’” Mr. Jonathan asked. “When each of us could say, I am a citizen of Nigeria! We would be able to look beyond where each of us comes from, and look past our tribal origins. We would be able to evaluate each other on our merits, rather than our religion, or region. “We would be free to think or do as we wished, as long as we observed the laws of the land, without
fear that the land would withhold our rights under the law.” By confessing Nigeria, Mr. Jonathan said each citizen would be judged by their merits and not by tribe and everyone would have access to education that would help them succeed in whatever path they choose. Continuing, he said, “You would be part of a proud culture, one that others want to invest in. You would be safe in knowing that society judges you by your successes and failures, rather than your place of origin. “You would be equal before the law and your protection is enshrined in the laws of the country. Speaking to journalists in his Abuja residence on Monday, Faleke said although he would have to consult with his lawyers, he will be appealing Justice Halima Mohammed’s ruling. Faleke said: “I watched the verdict of the tribunal on TV, one thing I can say is that, the judges have delivered their own judgment. I will consult my lawyers, upon which I am very certain that we will appeal the judgment.” “I am not a lawyer but I can say that it (the judgment) is not in tune with our constitution,” Faleke added. He said the court was wrong to have ruled that he had no locus standi in the case. Reacting, Kogi State Governor, Alhaji Yahaya Bello, hailed the judgment of the tribunal, which upheld his victory at the poll. He said the decision of the tribunal has further justified his election as governor of Kogi State, adding that the victory belongs to the people of the state, the APC and lovers of democracy across the nation. Oyo State Government has ordered the immediate closure of all primary and secondary schools in the state to protect lives and properties of the entire citizenry. This was sequel to protests by some youths believed to be members of the ruling All Progressives Congress (APC) who allegedly attacked the state NLC office following demonstration by the over detention of their leaders. The government linked the closure to the attempt by some members of the Nigeria Labour Congress and the Nigeria Union of Teachers to “expose our staff and students to danger arising from the on-going court action against their members”.

While the search for the peace seems to have turned bloodbath, the peace also seems
to be elusive as Ogbe-Ijoh youths have allegedly continued with their hostility and have attacked one Sunday Damijo, a native of Aladja community, allegedly leaving him with severe injuries. But the Acting Police image maker in the state, Mr. Charles Muka, confirmed that the Police were working hard to restore peace to both communities, disclosing that three persons were arrested and are currently helping the Police on their investigation. He said: “We cannot confirm if the three persons allegedly attacked have died, but we are aware they were attacked and
we are doing our best to bring a lasting peace.” Speaking to our correspondent, the victim, Sunday Damijo said he took a lady passenger to Ogbe-Ijoh on his motorcycle to the health centre, adding that while he was waiting, some youths from Ogbe-Ijoh allegedly attacked him, and left him with deep cut wounds in his head. Investigation revealed that Ogbe-Ijoh youths have refused to thread the path of peace as two buildings belonging to Aladja indigenes have been demolished, while some residents of Aladja community have fled their homes for fear of the unknown.
On Sunday night, sources said there was sporadic shootings allegedly sponsored by youths believed to be from Ogbe-Ijoh, but an elder statesman in Ogbe-Ijoh, Chief Paul Mulkoro dispelled as untrue, stating that the crisis degenerated when youths from Aladja community allegedly beat up two youths from Ogbe-Ijoh. Expectedly, the communal clashes which also involved boundary dispute between the two communities have been unabated in the past six months, a situation several persons had been allegedly killed and houses burnt inn a swift reaction.

State House of Assembly has constituted a seven-man Ad-hoc committee to look into the problem of nonpayment of salaries in most local governments of the state. The committee came up as a result of a motion moved by the Deputy Speaker, Mr Sunday Peter, under “Matter of Urgent Public Importance”. Sunday Peter raised concern over non-payment of council staff, local health workers and teachers for several months, adding that as representatives of the people from the grass roots, the House needed to intervene in finding solution to the problem. Other speakers at the Monday plenary including Mohammed Mahmud (APC-Mayo-Belwa), Emmanuel Tsamdu (PDP-Madagali), and Hassan Barguma (APC-Hong), lamented the plight of council workers and urged the house to intervene. The House Speaker, Kabiru Mijinyawa, who presided over the plenary where a resolution was passed for an ad-hoc committee, listed seven member committee with the deputy speaker as chairman. The committee is to submit report in one week.

Terminal operators should embrace dialogue

oget’s Thesaurus Dictionary defines Dialogue as colloquy, parlance, repartee, Talk. Aristotle Socrates and Plato were the greatest minds in ancient Greece. Socrates (C. 469-399BC) left no writings but much about him was through the dialogues of Plato. His legacy is the Socratic method of reaching an answer through a dialogue of questioning, and arriving at the truth by discerning the difference between opposite points of view. Nations dialogue over contentious issues, families dialogue over property, especially when the upkeep allowance is no more realistic. Corporate organisations or public agencies dialogue with unions over unpaid emoluments. Dialogue is therefore acceptable as conflict resolution mechanism. Therefore, there is dignity when parties dialogue to resolve issues that hitherto looked confrontational. And this is why Churchill once said that, “our destiny sometimes depends upon the most trivial of the decisions.” Recent moves by terminal operators to sue the Federal Government calls for caution. The commercialisation of port operations in Nigeria in 2007 saw the leasing/concessionning of 25 port terminals to private operators with lease agreements ranging between 10 to 25 years. One of the concessions was to Build, Operate and Transfer (BOT) basis. If we critically undertake a stock taking in the past nine years, the 16 terminal operators that have worked in Nigeria and equally examine their investment portfolio, there is no gain saying that they actually invested heavily in equipment, human resources and automation.
Their presence to a certain extent changed the face of shipping and its operations in Nigeria. We must therefore commend them for believing in Nigeria and bringing their foreign expertise to bear in our port operations. However, they too must acknowledge that their return on investment compared to other climes will reveal a marvel. It must be positive + positive return. If a study or comparative analysis is conducted vis-à-vis their parent companies, it will definitely show that terminal operators are enjoying the best of times in Nigeria I was a bit worried to know that terminal operators instituted another court case against the Federal Republic of Nigeria. While some cases have been vacated or struck out for some reasons, some are still ongoing. In addition, what are the bases of all these litigations?. Challenging the Federal Government’s appointment of a regulator that will bring sanity to the ports. When the Nigerian Shippers’ Council was pronounced as Port Economic Regulator, apprehensions set in. Recall that in 2007 port concessionning agreement, there was a clause stating that there must be a regulator to ensure sanity of purpose. Nevertheless, the Federal Government in its wisdom or lack of it could not appoint one at inception. So, in February 2014, the Federal Government pronounced Nigerian Shippers’ Council as Port Economic Regulator and followed it up with an order titled: Ports Economic Regulator Order 2015 and published in the Federal Republic of Nigeria official gazette No 34 Vol. 102 of March 27, 2015, as government. Notice No 40. The NSC Act provides sufficient brick wall for economic regulation in section 3. Most importantly, it outlines the basic responsibilities of improving
the regulatory regime of Nigerian ports for the control of tariffs, rates, charges and other related economic charges. It also requires NSC to enforce fair trade practices to protect rights and balance interest of providers and users of port services. The Act also allows NSC to mediate and establish modern dispute resolution mechanism and to minimise high costs of doing business at Nigerian ports. From the above, one would appreciate that the numerous litigations by terminal operators is not against the Nigerian Shippers’ Council as an institution of change but the must curious challenge is why it should look into the “gold mine” we have been digging unhindered since 2007. This is why, it is advisable that terminal operators toe the line of decency and engage the regulator in a dialogue. Experience shows that those who question the veracity or otherwise of government institutions and its laws often end up the losers. Look at the judgments entered into or against FAAN by Bi - Courtney Nigeria or the MTN/ NCC row. MTN had to invite the President of South Africa to come and dialogue with Nigerian leaders over the impasse. Also, as part of the dialogue process, MTN withdrew its litigation on the matter. Also, recall, how some banks caught over financial sleaze or FOREX round tripping opted for dialogue with CBN to mitigate their penalty. It is not likely for any corporate entity to sue a government agency regulating its functions and get away unhurt. This is why I advise the terminal operators to withdraw all impending cases and extend an olive branch to NSC for a new era of rapprochement. Politicians of all hues will always say that there
are no rights without responsibilities. This is used to justify the taking away of rights and privileges of people to claim benefits, unless they meet their responsibilities. Nigerian Shippers’ Council as an organic entity can only live when the terminal operators and all port users survive and grow. I am sure that if the concept of dialogue is applied, the council would take another look at the contentious issues especially the tariff hike, and port charges. As at today, cost of inflation and sourcing of FOREX are negatively impacting on port operations. All these will be taken into consideration if the parties come to a round table. Agitation for enhanced wages and the global recession occasioned by energy costs will be part of the review process. Volatile issues are resolved amicably and warring parties go home dignified without loosing or bruising their egos. Anon once said that; “Contra negantem principia non est disputandum, meaning; You cannot argue with someone who denies the first principles.” The Federal Government and its agencies are giagantic institutions and as father of all, they patiently listen to the cries of their children who confidently turn to them. Wisdom is being wise at the right time. I therefore urge terminal operators to critically review the journey so far and examine if they have chosen the right path or enter into dialogue. The Federal Government wants your survival because you play a critical role but not in a hostile environment. Remember when you quarrel, always leave room for making up. t is heartwarming that the Nigerian Labour Congress (NLC) heeded the rational admonition of the Labour Minister, Senator Chris Ngige, to call off their strike before government would resume discussion with it. It is unfortunate that the two umbrella labour bodies, NLC and TUC fell apart on the option of strike action but this time they should stream line their perspectives and reach a reasonable consensus with the government on how to ameliorate the pangs of the increase in petroleum prices. The most important thing is to prevail on the federal government to immediately review revenue allocation so that more money will go to the states to enable them implement the inevitable new minimum wage.
It amounts to an illusion to expect the states to pay the envisaged new minimum wage with the subsisting revenue allocation. The pervasive unemployment situation in Nigeria calls for creative ways by the Labour Ministry to solve the problem. This is because the ministry occupies a strategic position with enormous challenges to live up to one of the cardinal election manifestoes of the APC-led Federal Government. It is the expectation of Nigerians that President Muhammadu Buhari will manifestly be committed to ensuring that every facet of the Nigerian economy is resuscitated to impact positively on the lives of the downtrodden. Therefore, economic diversification must be seen as a desideratum and it calls for immediate amendment of the laws that prevent state govern-
ments from exploring and exploiting the natural and mineral resources in their domains. According to Buhari, one of the main thrusts of his government is to create the enabling environment to position the private sector to create jobs. The Minister of Labour, Dr. Chris Ngige in a forum expressed the readiness of the ministry to synergise with public and organised private sectors to create the institutional frameworks for job creation and good welfare packages for the employed. It has become imperative that jobs have to be created to absorb the evergrowing army of productive individuals yearning to contribute to national development. It is pertinent to note that the untimely demise of the Minister of State in the ministry Barr. James Ocholi on March 6 2016 in a ghastly road mishap
robbed the administration of a resourceful personality. In his tribute, vice president, Yemi Osinbajo said that within government and the party, Ocholi was highly regarded. “We have lost someone we held in high esteem”. Recalling some of the official engagements of Ocholi, it became obvious that he and the substantive minister were selected as if by premonition of the President. The late Ocholi intervened to avert industrial action in the health sector. He prevailed on the aggrieved workers to sheath their swords, which enabled him to study the antecedents, which at the end of the day enabled the President to proffer lasting solution to the protracted industrial unrest. the way of ex Director-General of Nigerian Maritime Administration and Safety Agency (NIMASA), Raymond Omatseye, who was convicted on charges of contract scam, as a Federal High Court, in Lagos granted him N500, 000 bail. The court had found Omatseye guilty of 24 out of the 27 counts preferred against him. Justice Rita Ofili-Ajumogobia granted him bail pending the hearing and de-
termination of his appeal at the Court of Appeal. “I have looked at the processes filed by appellant but I have a discretion which must be exercised judicially and judiciously. “In the applicant’s affidavit, he deposed to the fact that his child suffers from a severe medical condition, which is an uncontrollable epilepsy seizure, which has put the family under serious strain. “I will admit the appellant to bail on the single ground of been a father. “Even a mad woman will
come after you if you toil with her child. “The applicant is hereby admitted to bail in the sum of N500, 000 with two sureties each in like sum. “One of the sureties must be a level 16 officer in the civil service, who must deposit his international passport with the court’s registry,” she held. Justice Ofili-Ajumogobia had on May 20, sentenced Omatseye to a prison term of five years for awarding contracts above threshold while in office. She, however, discharged
and acquitted him of three out of the 27 counts bordering on bid rigging. Ajumogobia found Omatseye guilty of the offence of awarding contracts above stipulated threshold, and accordingly convicted him on counts 1 to 20, 24, 25, 26 and 27. She, however, discharged and acquitted him on counts 21, 22 and 23 of the charge. In challenging the verdict, Omatseye had prayed the court to grant him bail pending the determination of his appeal lodged at the Court of Appeal, Lagos Division.

The community stated this through its Town Union President, Mr. Matthias Ekere, that the gesture would ensure full recovery from psychological trauma they suffered as a result of the April 25 Fulani herdsmen attack. “On behalf of the community, I commend federal government, state and local governments for their quick interventions after the attack. A disturbing one, at least for me, was the fact that killings in the first year of President Muhammadu Buhari have been the highest compared to former presidents Obasanjo, Yar’Adua and Jonathan. Remember, we are talking about killings in the first year of these governments and not the total time they spent in office. The data analyst wanted to gloss over this grim fact but the presenter called his attention to it. But I’m sure neither Seun Okinbaloye, the programme presenter, nor Chido Onumah, a friend and brother, could be clairvoyant enough to know that the next day, May 30, would witness more killings. Onumah had fixed May 31 for a public presentation of his new book, ‘We are All Biafrans’, in Abuja. As at now we are not sure of the number of casualties that resulted from the Onitsha, Anambra State killings by men of the Nigeria Army on May 30. De-

Also, the president declared imperially on May 9 at the Emir of Katsina palace that “Nigeria is indivisible.” Why he had to make that declaration in his home state and at the emir’s palace will be something for presidential scholars and watchers to ponder as the ghost of the civil war has refused to go away. “A few individuals who were not even born at the time of the war are
now out agitating for secession. I fought in that war to unite Nigeria and there is no way I will allow such to happen while I am alive. I will not take it lightly with anybody agitating for selfsecession. I am ready to die defending this country. I cannot fight for the unity of this country and somebody just comes out overnight and chases me out of it. That is not possible.” These were the president’s words at the gathering. So for our president it is a matter of personal honour as a soldier who fought in the war and also as a general who must crush the enemies to a pulp. Interestingly under Buhari, our country has voted publicly at the international arena to support the Palestinians and the Saharawi Arab Democratic Republic, which operates a government in exile. We support self-determination abroad but crush it at home. By the way, I’m against the breakup of this country but that is just my view out of the millions of Nigerians who are supposed to determine this. The political leaders in Igbo land too are doing themselves a great harm by pretending this is an agitation that will go away. They can continue to play the ostrich but they will be the first casualties of this agitation as their legitimacy will be swept away and made redundant. The Biafra agitators need to up their game as well as the campaign needs better coordination for the world to truly hear what they are saying. Driving peaceful dissent underground could be counter-productive just as it has not really worked. I hope our soldiers and the government are listening.

President has no power to ban governor from travelling abroad Robert Clarke: – Clarke Chief Robert Clarke, a Senior Advocate read law at the University of Lagos and was called to the Nigerian Bar over four decades ago. In this interview with PETER FOWOYO, he stated that although the president does not have the power under the constitution to ban a governor from travelling abroad but, due to security reason, he can direct the security agents not to allow the governor travel outside the country. Chief Clarke also spoke on the creation of state police, the crisis rocking the Kogi state House of Assembly, the fight against corruption and sundry other issues. Does the President have the constitutional power to ban a governor from embarking on a foreign trip? Well, according to the constitution of Nigeria the president has no power to ban any governor from travelling abroad. However, circumstances might dictates a situation where for security of the nation the government might feel that the governor’s visit outside Nigeria is a security risk and he cannot ban but, what he can do is to stop him at the point of embarking on that trip, the security might disrupt his departure that is what I think can happen. But whether the president can ban a governor from travelling abroad is not provided for in law. But since Section 5 of the constitution vested all executive powers in the president, in the exercise of that executive power base on security reason that will affect the nation, he might direct
the security agents not to allow him to travel. That is just the situation that can arise. Is it fair for the president to declare a state of emergency in states where there is civil unrest when the power to control state apparatus is vested in the hands of the executive? According to the constitution the chief law officer of the state is the governor there is no doubt about that. But we have a scenario in Nigeria where the instrument of controlling the police is vested in the Inspector General of Police who takes directives from the president. Whereas in law, a governor is in charge of the security in the state but in fact, in exercising that power, he has to go through a commissioner of police who is not subject to his control in relation to the hierarchy or the dictates of the police force. So if a governor directs a commissioner to do something in
the state the fact is that he will first get a clearance from the Inspector General of Police and depending on what situation is on ground, there might be a refusal on the part of the commissioner. So actually the governor is in charge of the security of the state but in fact and let us be realistic, it is not so a times. In view of this scenario you painted, there have been agitations for the creation of state police. Would you support this view considering the fact that it could be tools in the hands of those in control of power against political opponents? You see, you are a young man. This question you are asking me has been from the 50s in Nigeria. It has been one of the contentious debates. During the constitutional conference before independence, it was an issue. Awolowo, was campaigning seriously that states should be allowed to control their police forces. The NCNC and the NPC who are the other major political parties opposed it that there must be a uniform police force. But then we have what we called the Local Government Police, the Northern region has its own called ‘Dandugaz’ whereas there was a centralized police hierarchy where states or region then were allowed to have their local police, they called them Native Authority Police. However, since the incursion of the military in Nigeria, the first thing the military did and I remember, it was the Aguiyi Ironsi government then, they abolished all this Local Government Police and Native Authority Police because it was an instrument, let us be honest about it, it was an instrument being used by the government to attack the opponents. I remember vividly the case of Adelabu. Adelabu was sentenced to imprisonment by Local Police Authority, charged to a Local Government Customary Court, he was jailed, he had to appeal before he was set free. So when the military came in, they abolished Local Government Police and Native Authority Police but that did not stop the agitation till today that state government must be allowed to have their own
police force. Their reasons are cogent, good but, it depends on which divide you are. The proponents of that is that policemen are better within the locality they are born, they know the people, they know the family harboring this or that so that if you have problem in Yoruba land, it is better you have Yoruba police who will know the family but, if you bring an Ibo man to Yoruba land as a police man he might not be able to effect proper police work. It depends on which divide you are. But as far as the constitution is today, the police is still a centralized police. Whether it should be decentralized or not is between you and I depending on which divide you are. So on which divide are you? Well, personally speaking, people who are saying it should be decentralised are correct to a certain extent because what they see as authoritarian use by the federal government there is no doubt that when they too have that control knowing what Nigerians are capable of doing , it will still be the same thing. A governor of a state we have seen it, if not because the police are centralized would have use the police to destroy the opposition so, it depends on which divide you are. the police force should still be centralized. The Nigerian Army said it acted in self- defense when it killed BIAFRANS and MASSOB protestants in the South East. What is your view about the human rights record of this administration? We lawyers have a principle that we take to our hearts that facts are sacred. It is when you are ceased of facts that you will be in a position to comment on issues. I am not ceased of the facts of these incidents you are telling me about whether policemen killed or the BIAFRANs revolted are not within my knowledge, I cannot say who is right or wrong or whether the army are right or wrong. The other question on the human right record, well, it also depends on which divide you are. Human rights activists will tell you the government is not conforming with human rights that certain people are being detained after courts have granted them bail but if you follow the scenario, you will find out that there is not much in that statement in refusing to release an accused person in a courts after he has been granted bail, what they have carefully done, is to carry that same accused person, preferred charges against him and take him to another court. So, the bail of one court does not subsist for the bail of all courts and people fail to realize that. What this government is doing is not actually an affront to due process of law but it is a clever maneuver because we are in difficult times. You and I know what we are hearing about how the money of this country has gone down the drains, you and I are suffering today, we have no electricity, no water, no good health system because two, three or four politicians have derailed the economy of this country and when there is a concerted effort to bring them to book, human rights activists will still say the government should follow due process. I don’t see anything wrong with what the government is doing because due process you cannot envelop it into a small jacket, when the court grants bail and the prosecutor carries the same person on a fresh charge to another court and that court says I am not granting you bail, it is within the
law. The grant of bail is within the discretion of the court so there is no breach of fundamental right as far as I can see it. Are we really in a democratic dispensation if the President can deploy soldiers to where there are civil unrest without consulting the legislatures? Is it constitutional for the President to do that? Maybe if you have been privileged to listen to Femi Falana SAN on Channels television and I was called in the following day to rebut what he said. Section 187 or 188 of the constitution, I cannot remember clearly now, empowers the president as the Chief Commander of the armed forces to deploy them. The constitution also allows him not only to deploy them but delegate the powers he has to the military whenever any situation of unrest arises in Nigeria, the president has the power under the constitution to ask the military to go there and quell it. Even without consulting the National Assembly? He doesn’t have to. As I have told you section 5 of the constitution vests all executive power on Mr. President that section 5 of the constitution is so important and many people don’t appreciate the extent of the powers of Mr. President and the constitution specifically provides that the president can deploy not only deploy soldiers, he can give them instructions, not only that he can delegate part of his powers to them under the constitution. He has very wide powers over the army. The House of Representatives took over the Kogi state House of Assembly and many viewed it as unconstitutional. What is your take on this? Well, that is an area I don’t want to offer an opinion because despite what has been happening in that state, I was reading in today’s newspaper that a group of 5 minority members of the state House of Assembly are still being led in the chambers by armed soldiers. That situation is becoming abnormal as I know and I don’t want to comment more on it because I don’t feel it is proper for soldiers following a minority of 5 legislatures to go and assume proceedings in the hallowed chambers of the legislatures. My comment will stop at that. How will you assess this gov-

You are given your day in court, you are allowed to ask for bail if you are taken to court and the court grants you bail and they have been following it. Do you have any incidence where you think due process has not been followed? You might wish to point to the BIAFRAN case, Nnamdi Kanu. Well, he has been charged for treason and treason is an offence that you cannot be granted bail. You are young, Obafemi Awolowo, the most popular Yoruba man was charged for treason in 1963 he was not granted bail throughout his trial and the
heaven did not fall, nobody carried placards on the streets that Awolowo must be freed, it is not unusual. Once you are charged for treason, you cannot be granted bail so, there is nothing wrong in not granting him bail. What is your take on this administration’s 365 days in office. Would you say the President has performed well? Let me borrowed what Professor Wole Soyinka said few days ago that he is not saying the administration has done wonderfully well but he said and I accept his saying that with the huge amount of rubbish left for him that he’s trying. I will also agree that the present administration come in at a time when this country is at its lowest. Lowest in moral, lowest in monetary output and they are trying
their best, let us give them time. In another year if you come to me I will be able to give you answer. If you are asked a yes or no answer, what will be your response? You are asking for an answer to a human problem, it cannot be yes or no. Anybody who does that must have some problem because there are many aspects of problem; you have to look at all the aspect of governance. We have no electricity, why? Is it because government is not trying? It is because of sabotage, we have no petrol, is it because of this government? It is because of sabotage so when you look at all the scenario playing out, it is difficult to say yes or no. Under this administration, the Independent National Electoral Commission INEC has conducted quite a number of inconclusive elections. Do you see the umpire conducting free and fair elections in 2019? Let me say this, it is a shame to us in Nigeria. I have visited Ghana when they were holding general elections; you will not believe that elections were being held, no policemen on the street. I have gone to Benin Republic when they were holding presidential elections; you won’t even know that people are voting. Nigeria has a history of thuggery and why? Because politicians are not here to look after your interest, they are here to look after their pockets so that you find young lawyers, young doctors abandoning their profession to go into politics because there people are stealing money and therefore it is a do or die battle so you can’t blame electoral commission for anything, we have to blame ourselves first. Why can’t we conduct a peaceful election when our neighbors in Ghana, Benin republic and other African countries are conducting elections?

Dr Ogbonnaya Onu, minister of Science and Technology, who disclosed this in Abuja, explained that the idea was to stimulate children’s interest in science and technology. “The science museum is very important. We want our young people to have interest in science and technology. A Science and Technology and Innovation Museum will do a lot for us. “One, all the natural phenomena that happen – lightning, rainfall – we will have explanations on them there. “All these little equipment and so on, we will put it in a way that children will start developing interest from early age. “Then adults will also like to go in because we also showcase major achievements of science and technology across the country. “It will take us time to get it built but it is very important; there is no major country that does not have many of those. “So, we need to start again with one; then as funds become available, we do more. We will start in Abuja.” Commenting on SHESTCO Silicon Valley, the minister said the Federal Government would soon begin work at the site as funds had already been allocated for the project. “We are going to start a technology village. The money allocated is not much, but we thank President Muhammed Buhari and we are assuring of more support. We will start work; our intention is to have it in the six zones. People should stop, think before they connect online - Afon What is Cybersecurity Association of Nigeria all about? Cybersecurity Association of Nigeria is a non-profit organization (CSEAN) made up of Information security professionals, centred on a collective purpose and vision to be a vehicle championing the cause and awareness of Information security best practices, acting as an agent of change to address Cyber Crime phenomena through engaging, government, intellectual minds, business and political leaders. As Cyber Security protagonist we look to hold healthy debate, to expand the audiences’ knowledge, awareness and understanding of the issues around Cyber-crime among others. We have heard a lot about cyberthreat even when there is a law in place in Nigeria to deal with such crimes, what is your Cyber Security Association of Nigeria doing about this? I will say that the law is in existence, but it is the implementation that is lacking. So there is a lot to be done by government for the implementation of that law. It is not enough for cybercrime when people commit crime online and they get apprehended, but there are stipulated numbers of years to spend in jail or fine imposed on them. The problem now is that people commit crime online on daily basis but the law enforcement agencies in this country are not equipped enough to apprehend and prosecute this cyber criminals. As the President of CSEAN what has your body suggested to the government as the way forward to stem this tide? We have been trying to sensitize the government on the need to equip the law enforcement agencies. There is the need for the government to spend a lot of money in acquiring tools that can be used to track cybercriminals online. As part of our own efforts as an Association, we organized training for the Nigerian Police Force last year on the latest trends in terms of cybercrime as part of our contribution to the government. The youths in this country are mostly engrossed in cybercrime via their exploration of the internet to siphon peoples’ resources instead using the internet to create and generate

He spoke with Tony Nwakaegho in this interview during the launch of Stop, Think and Connect initiative programme at the just concluded DigitalSense Forum in Lagos. Excerpts:

It is good that DigitalSENSE Africa Media is organizing this forum on Internet Governance and Cyber Security, and the youths are involved in order to sensitize them. Like you rightly said a lot of Nigerian youths are involved in ‘yahoo yahoo’ internet crime by using that same brain. It still boils down to government, because government needs to come up with a scheme that instead of these youth using their skills in a negative way they should be able to encourage them and bring them in to protect the government and also protect organisations. Other countries like China have done it in the past with a scheme whereby cybercriminals are being converted back to do good things even after committing that offence. American too employed some ex-hackers to protect their government. So government should be able to do that rather than leave them roaming about the streets and committing that crime. They should be able to track them, and give them the orientation so that their skills which they are using to fight people get information to steal money, that kind of skills could be used to protect the government and organisations. How will unsolicited and
malicious information being sent to Individual’s emails in form of spams be checked by CyberSecurity Associations globally? First of all it will be difficult to stop that, as it will continue to occur. What is very important is awareness, people should be aware and there should be a national awareness security programme which my Association- Cyber Security Association of Nigeria has started with a campaign on that, which we launched today during this DigitalSense Forum programme. We tagged the campaign: “Stop, Think and Connect”. What we are saying is that people should stop, think before they connect online because there are so many dangers online and they have to be very careful and be aware of those dangers. Once people are aware of the danger online even when people send official email to them, they will be able to identify those emails and not be victim of cybercrimes. What much is Nigeria losing in term of this cybercrime? Nigeria is losing a lot to cybercrime. The only problem we have is that there is no reporting. I can tell you categorically that the Banks are suffering as they are losing millions of Naira on daily basis. I can also tell you categorically that individuals
are equally losing millions of Naira on daily basis if you aggregate it together. I can tell you categorically that even telecommunication firms are being hacked and they are losing money but these are not being reported and as long as they are not being reported we are not going to have the statistics of the lost that is taking place. That is the reason why we are also advocating for the law for reporting so that people will know the significance and the economic implications on hacking in this country. Do we have a good data base in Nigeria where information could be stored for use? Obviously, there is a need for data base. In this country we don’t have a source of data base and that is the reason why you see a lot of people gathering and collecting data from different sources. For instance the Nigerian Identity Management Commission (NIMC), INEC, Banks through CBN, Telecommunications companies all collect data. There is no data protection in this country to start with, so when people steal data they just get away with it. There should be a law to protect peoples’ sensitive data such that there will be onus on organizations to protect and make sure that those documents are secured and not stolen. I will give you an example, talking of data protection and lack of data in this country, you look at the issue of criminal records, there is no criminal records in this country so how do you know who is an ex-convict in Nigeria and United Kingdom. If you don’t have data protection that means there is going to be a continuous production of criminals at the helm of our affairs. First and foremost we need data and secondly we need criminal records to be taken care of. What is your assessment on the programme that DigitalSENSE has put in place that is tailored towards that development of the youth and other issues in the cyber space? This is a fantastic programme that DigitalSENSE has organized and I must give
them kudos for that. But my advice to the organizer is to get more participants in the area of corporate organizations to get involved in this kind of programme because they are also sensitizing people on the benefit of IPV6 which a lot of people don’t even know about. That is quite fantastic thing that they have done. Is your Association also providing solutions to checkmate whatever is going on in form of cybercrime in Nigeria? Absolutely, my Association has been doing that by way of advising government and organisations on the control measures they need to put in place, by sensitizing people on what they need to do, as well as providing information to people, government and organisations in terms of dangers online. You mentioned that ‘Stop, Think and Connect’ is a campaign initiative to create awareness about cybercrime. What awareness impact has been created through it in Nigeria? We have just launched it here during this programme in Lagos, and that is going to be rolled out in all Universities and Secondary schools. We have launched it in some other States, but this is the first time we are launching it here in Lagos. We will take the campaign to all the Universities and Secondary Schools in Lagos State, and that is how we will spread the message all about. What is your advice to the students whom you are preparing this campaign for now? My advice to the students is that they should be productive in whatever they do, for example the students that are here in this programme have learnt a lot of things regarding the opportunities that are there, so they should engage their time productively instead of using it negatively online. They should think of how they can add value to the society, the internet has provided that opportunity for them so they should go ahead and garb that opportunity.

Ekeh declares Nigeria ripe for eVoting during elections Tony Nwakaegho Dr. Leo Stan Ekeh, chairman of Zinox Group, Sub-Saharan Africa’s biggest integrated Information and Communication Technology (ICT) conglomerate, has declared that Nigeria is ripe to develop its democratic culture through the full deployment of electronic voting during elections. Ekeh made the call at a recent retreat organized by the House of Representatives Committee on Electoral and Political Parties Matter in Abuja. on use of ICT in elections affirmed that the gains recorded with the use of the card readers in the 2015 general elections goes a long way to show that with the adoption of e-voting, the country will take a huge leap towards sound democratic governance. “In your life, there must be a little bit of disruption for you to move forward. The country is ripe for transition to electronic voting. A lot of us are in this business because technology does not lie – it’s either you are right or you are wrong. With the use of the card readers in the last general elections, we saw a significant reduction in electoral fraud and other electoral malpractices. However, a few challenges were also encountered as no technology can be said to be 100 percent perfect. “A country cannot move forward where the elected leaders who take
decisions are not the choice of the people. It’s like running a company and you are a shareholder in that company. If your son is not qualified to lead, you will be destroying that company by manipulating the system to favour that son. So, this was the essence of our submission to INEC on the adoption of electronic voting – that things should be done professionally with your support and that of the entire nation. “Today, there are about 774 local governments in the country and each one with about 10, 800 polling units, some of which are in the riverine areas. Even if INEC purchases 1000 vehicles, it will still find it difficult logistics-wise to cover all the areas and this leaves the process open to manipulation by emergency contractors as INEC lacks the requisite man-power.
“If finally adopted and implemented, electronic voting will ensure that you now have reasonable infrastructure to handle this. While you have the mobile units and active screens at the polling units, the database of registrants or eligible voters is sitting at the national database of INEC. Once a voter’s number is entered at the polling unit, it pulls up the details of the voter from the list of registered voters. Verification will no longer be a problem and during voting, once a voter clicks on the icon of a chosen party, the same information hits the INEC back-end. This will go a long way in reducing litigations as INEC can provide verifiable evidence in court. “With this technology in place, voters will no longer have to travel back to their wards to cast their votes. Furthermore, INEC can also monitor the entire process easily as each electronic voting device is equipped with a tracker and can be configured to shut down immediately voting ends,” he stressed. Ekeh traced the country’s transition towards electronic voting, examined the benefits and challenges of the Direct Data Capture (DDC) machines used during the 2007 elections and the meticulous process which eventually culminated in the use of the card readers for the 2015 general elections. “When Prof. Jega came on board, a decision was made to do a proper data capturing of eligible voters. We started the process and I must thank the National Assembly as
they supported us despite being a local company. We designed the technology and ended up working for everybody in deploying the Direct Data Capture (DDC) machines nationwide including the 600 servers. These helped promote the concept of one man, one voter card, streamlined the electoral process and also reduced multiple registration, ineligible and under-age registrants – we did a lot of these from the back-end. As a result, we were able to deliver a strong database which reduced arguments and other related issues. “From there, we moved to the use of card readers. Back then, there were calls for proposals for electronic voting which the National Assembly to a large extent didn’t consider as the country was seen as not ripe to embrace the technology then. Most of the issues encountered with the card readers had to do with the National Assembly and the budget for INEC as well as the late release of funds after election dates had been set, among other disruptions. So, INEC had no time to conduct a mock election using the card readers. I had recommended a regional mock then as this would have helped smoothen the process. “I would like to plead with the National Assembly to support INEC in its effort to adopt electronic voting. Until we embrace this disruption, the nation will not move forward in this regard because the government is the decider of the future of the people” he said .
NCS to induct over 500 IT/ICT professionals, others In the quest of the Nigeria Computer Society (NCS) leadership’s agenda to grow the membership base, the society is set to induct over 500 newly registered members at the 26th national conference that will hold from July 19th to 21st, 2016 at the NAF Conference Centre, Abuja. Professor Sola Aderounmu, NCS’ president confirmed the record increase in membership to Daily Times in Lagos, adding that such drive was in line with the present National Executive Council (NEC) determination to assiduously work towards increased membership, increased membership due collection and open channels for willful donations and employment creation for the teaming Nigerian youths. ATCON identifies data sovereignty for local data center growth, cybersecurity Association of telecommunications Companies of Nigeria (ATCON) has identified proactive data sovereignty policy framework as indispensable condition for cyber and national security drives. Mr. Olusola Teniola, made the remark in his maiden press conference as the newly elected president of ATCON, adding that the most tactical approach to tackling cyber security involves developing local content and localization of data hosting infrastructure. He explained that in the knowledge economic order championed by the internet, data is the precious currency every country, including Nigeria, must guide jealously.

Similarly, Ovum reported recently that the global migration to cloud-based IT systems is forcing governments to update data privacy regulations to meet evolving data sovereignty requirements. Ovem said that the data privacy regulatory landscape is seriously concerning global businesses, as twothirds of businesses expect to have to change in their global business strategies to accommodate new data privacy regulations.

Stakeholders urge govt to use unlicensed spectrum for broadband penetration As the Federal government seeks to achieve a 30 percent broadband penetration target by 2018, stakeholders in Information and communications technology have urged the government to consider making available more unlicensed spectrum for the provision of broadband internet particularly in the rural areas in view of the protracted process of realizing National Rural Telephony Project (NRTP). Engr. Lanre Ajayi, immediate past president, Association of Telecommunications Companies of Nigeria (ATCON) said that spectrum generally, should be unlicensed but because it is limited resources that are valuable made some of the spectrum to be licensed. Ajayi explained that unlicensed spectrum is used for the benefit of the people and need not to be given commercial value. He cited Wi-Fi which he described as an unlicensed frequency that smartphones and laptops use for internet connectivity at hotspots. “Government should make available more frequencies as unlicensed for use in the rural areas in the provision of broadband internet just as United States is doing”, he stated. His statement is coming against the backdrop of a recent report by Consumer Electronics Association (CEA) which estimates that growth of devices relying on unlicensed spectrum is extremely strong. CE devices that rely most heavily on unlicensed spectrum, which include Bluetooth and radio frequency identificationenabled devices, have a cumulative annual growth rate of roughly 30 percent from 2011-2016. Consumer demand for products like these is now, in turn, driving the need for even more unlicensed spectrum. Mohammed Rudman, managing director, Internet Exchange Point of Nigeria agreed that though unlicensed spectrum such as Industrial Scientific Medical (ISM) bands operating on 2.4 ghz among others, are mostly used by university community and research centres among others. “It could be deployed in small communities for internet connectivity just as it is in United States of America. Presently, such unlicensed frequency is being used in some towns in Jigawa and Kano states to provide internet connectivity within those towns,” Rudman said. Chima Onyekwere, chairman, Linkserve a pioneer internet service provider, said that unlicensed spectrum has been proven over time to be stable in service provisioning and also suitable for providing internet connectivity in rural areas, but noted that such spectrum are not designed for profit making which means that for it to be made available for rural broadband internet government needs to subsidize it for the operators.

According to industry data, power supply to households and businesses across the country dropped significantly in May as the national grid recorded six total collapses and one partial collapse within the period. The data further revealed that the national grid collapsed eleven times in the first five months
of 2016, compared to six and nine times for the whole of 2015 and 2014 respectively, the report says. The report says that the most recent total system collapse was recorded on 1 June, 2016. On Friday morning, it was reported that 11 power plants, including the Shiroro Power Station in Niger State, were not operating. Other plants that were not operating included Afam IV & V, Geregu I, Omotosho I, AES,
ASCO, Trans-Amadi, Rivers IPP, Gbarain, Olorunsogo I and II. According to the ministry of power, the total national power generation stood at 2,604.5MW as of 6am on Friday, down from a peak of 5,074.7MW on February 2, local media reported. The Executive Director of the International Aviation Management and Security (IAMS) Mr John Nwosu who disclosed this to aviation correspondents in Abuja said the event will bring together participants from all over the world adding that it was intended to attract 50-billion-dollar worth of investment into Nigeria’s aviation industry through its international business forum. The Nigeria Employers’ Consultative Association (NECA) has said the Federal Government was not in a position to order banks not to disengage staff. It said the directive last week by the Minister of Labour and Employment, Senator Chris Ngige, to banks to halt further sack of its workers was faulty. Ngige gave the directive last week following the sacking of over 1,400 staff by two banks. NECA, through its Director General, Olusegun Oshinowo, said over the weekend that it was not in the place of Ngige or the Federal Government to issue such order. NECA, therefore, told banks, financial institutions and other employers of labour to ignore the directive. Oshinowo said the country’s labour law did not empower Ngige to issue such a directive. He said the directive was only populist, but uninformed. He said: “The minister seems

Nigeria’s trade balance declines by 22.6% in Q1 2016 – NBS Stories by Motolani Oseni Nigeria has recorded a negative trade balance in the first quarter of 2016 which stood at 22.6 percent lower than the preceding quarter. This was released by the National Bureau of statistics (NBS) in a document tagged, “Foreign Trade Statistics for the First Quarter of 2016.” The report said that the total value of Nigeria’s merchandise trade at the end of first quarter of 2016 stood at N2.7billion. It said that from the preceding quarter value of N3.5 billion, this was N793.5 million or 22.6 percent less. A development was said to have arisen due to a sharp drop in both imports and exports. “Exports saw a decline of N671.1 billion or 34.6 percent, while imports declined by N122.4 billion or 7.8 per cent. “The steep decline in exports brought the country’s trade balance down to N184.1 billion, or N548.7bilIion less than in the preceding quarter. “The crude oil component of total trade decreased by N716.7 billion or 46.6 per cent against the level recorded in fourth quarter of 2015,’’ the report said. It said that China was followed by the United States at N127.1 billion or 8.7 percent while India with N89.4 billion or 6.1 percent. “Netherlands followed India with N73.8 billion or 5.1 per cent and United Kingdom with N61.4 billion or 4.2 percent of total imports.
“Imports by economic region revealed that the country consumed goods largely from Asia with import value of N611.2 billion or 42.0 per cent,’’ it said. The report further said that the value of the export trade totaled N1.269.9 billion in first quarter of 2016. “This is showing a decrease of N671.1 billion or 34.6 per cent over the value recorded in the preceding quarter.
“Year-on-Year analysis shows that the country’s exports dropped by N1.395.2 billion or 52.3 per cent as against the export value recorded in the corresponding quarter of 2015. “The structure of Nigeria’s export trade is still dominated by crude oil exports, with the contribution of crude oil to the value of total domestic export trade amounting to N821.9 billion or 64.7 percent,’’ it said.

Following the delay in the release of the details surrounding the proposed flexibility in the foreign exchange (FX) market, the Nigerian equities market resumed the week on a negative note as the NSE All Share Index declined by 0.13 percent to close at 27,598.54 points against 1.66 percent gained last Friday to close at
27,634.42 points. Market capitalization dropped N13 billion to close at N9.479 trillion against N154.8 billion gathered previously to close at N9.491 trillion. Diamond Bank shares led the day’s Most Active stocks on Monday as 15 million units of the stocks were traded for N31.7 million. FCMB followed exchanging 14.8 million shares worth N24.4 million while Ac-
cess traded 14 million shares valued at at N78.5 million. Vitafoam led the day’s declining 24 stocks with a loss of 6.32 percent or 28 kobo to close at N4.15 per share, Diamond Bank Plc trailed with a depreciation of 6.28 percent or 14 kobo to close at N2.09 per share. MayBaker Plc dropped 5 percent or 6 kobo to close at N1.14 per share, Stanbic IBTC Plc fell 4.95 percent or 78 kobo to close at N14.97
per share and Union Bank Nigeria Plc declined by 4.94 percent or 27 kobo to close at N5.20 per share. Leading the day’s 16 advancing stocks were Union Dicon Plc which added 10.22 percent or N1.27 to close at N13.70 per share followed by Axamansard Plc which gained 5 percent or 10 kobo to close at N2.10 per share, while Ashaka Cement Plc increased by 4.99 percent or

Cadbury Nigeria reports earnings of N7.1b for Q1 2016

Recently released First Quarter (Q1) results for Cadbury Nigeria Plc. showed that revenue grew (for the first time since Q3 2013) by 5.8 percent to N7.1billion, as against N6.7 billion recorded for the same period of 2015. The beverage producing company also recorded a Profit Before Tax (PBT) of N693.5 million naira as against a loss before tax of N303.5 million posted for the same period of 2014, as well as a Profit After Tax (PAT) of N672.8 million
compared with a loss of N303.5 million in Q1 2015, this moved earnings per share to 36 kobo per share from a loss of 16 kobo per share. The top and bottom line growth suggests that the company’s recent investment in its manufacturing plant, which management expects to increase Bournvita production by around 30%, may be paying off. Another reason for bottom line growth is the 14 percent reduction in operating expenses from N2.03 billion to N1.74 billion in 2015.

The bank which recorded a loss after tax of N163.2 million in 2014 erased losses to settle at a profitable position of N55.5 million for FY 2015. Retained earnings still remained in red, but dropped 86.8% from a negative position of N198.1 million to a negative position of N26.1 million. The bank’s results further showed a 6.2 percent increase in interest and similar income to N1.09 billion for 2015 from N1.03 billion recorded in the same period of 2014, while Net
assets grew by 0.8 percent to N6.61 billion from N6.55 billion posted for 2014. The bank formerly known as Abbey Building Society Plc changed its name to Abbey Mortgage Bank following the approval of the Central Bank of Nigeria and Corporate Affairs Commission, subsequent to its listing on the Nigerian Stock Exchange (NSE) in 2008. The financial service provider is listed on the mainboard of the NSE, with market capitalisation at N5.3 billion and 4.2 billion shares outstanding. The bank shares last traded at N1.25 per share. Meanwhile, Interim financial statements for Equity Assurance Plc and its subsidiaries has shown that
the group made a loss of N132.4 million for the first quarter (Q1) of 2016. This a 218.2 percent decline from N112.1 million declared as profit in the same period of 2015. Although revenue increased by 10.2 percent to N1.4 billion from N1.3 billion in 2015, profit before tax fell by 155 percent to a loss of N89.3 million from a profit of N161.9 million declared in 2015. Net assets for the insurance firm stands at N5.9 billion, 2 percent lower than N6.0 billion recorded for the same period of 2015. The firm simultaneously released its full year results for the period ended 31st December 2015, depicting a 7.7 percent drop in revenue from N4.85
billion in 2014 to N4.47 billion in 2015, driving profit of N183.3 million made in FY 2014 to a loss of N580.2 million in FY
2015. For the full year (FY) 2015, the group posted a pre-tax loss N487 million against a pre-tax profit of N310.8 million.

Amazon’s bestselling author to revolutionise customer service in Nigeria Jamaican born bestselling author on Amazon.com, Michael Williams in an exclusive interview with MATHEW DADIYA said that the only way the Nigerian government can create million jobs is by providing an enabling environment for the Small and Medium Scale Enterprises (SMEs) to thrive. Williams who is the Managing Director of Cross River Tourism Bureau, told Daily Times during the launching of his book ‘The More3 Formula’ that he wants to lead a customer service revolution in Nigeria, so as to inject life into the activities of the SMEs in the country because the sector remains the largest employer in most of the developed economies of the world. He also said that he wants to change the way people think of managing customers describing Nigerians as ‘good managers of circumstances.’ You have worked in Nigeria and understood the terrain in terms of business and customer service, in what way do you think your strategies can change the approach to customer service in both public and private sectors of the economy? I have a saying ‘I want to start a revolution in Nigeria.’ That is a customer service revolution, I want to change the way people think of managing customers and Nigerians are good managers of circumstances. Let’s see how we can surprise our customers, delight our customers and make our customers go whoa! Such that they start to transform their actual quality of life. Quality of life in Nigeria is poor, and most of it comes down to poor customer service from the power sector, from the government, from the local supermarket and stationary stores and anywhere else. If that customer service was different, your quality of life would be different because, certainly, someone is valuing you, you are getting your light, you are getting your water and you are getting your petrol and you are getting a proper service from the supermarkets with quality goods as well as reasonable prices; that is all what customer service revolution is all about. If that is happening in Nigeria, the quality of life in the country would drastically improve. Now, whether anybody in government would listen to me to make these changes is another matter. The current President said, his administration is about change, I have seen them arresting people for corruption but what I am not seeing is changes in institution, changes in the systems that would allow these institutions to now give Nigerians a better deal, give them more service, give them more directives for what they have voted for but I don’t see it. I am ever ready to offer my service because I love to be able to help. Maybe somebody in government could call me you never know, I am here to help whenever I am called upon. How would it impact the economy, especially by creating jobs for Nigerian youths? If you have thriving small busi-
nesses that are growing, that is what takes care of your employment problem because the government cannot employ much people they are already overstaffed. The big business that can employ a lot of people, some of them are overstaffed with the wrong people. Small business is the only way to go, America for example, they have the huge companies that most of you know but a lot of people don’t realize that the largest employer in the United States is small and medium enterprises. All those network of stores, suppliers, and small manufacturers are the businesses that keep the American economy going; they are responsible for over 50 to 60 per cent of the entire employments rate in America, more than the government and more than the big corporation. What inspired you to write on The More3 Formula, and your interest in customer service? What inspired me was the experience of my clients and my own experiences on the job too. I had an advertising agency in London and I found out that my small clients were getting more customers from the advertising I was doing for them but they weren’t able to keep them and profit from them. Meanwhile, the big companies were getting customers from our advertising firm and were able to keep them and profit from them. Then, I kept wondering what was the difference between the small businesses and the big businesses, and I realized the difference was very simple. The big businesses understand certain techniques – certain things you have to do in order to exceed customers’ expectations. So they were keeping the clients, making them happy including the old clients without losing anyone and that is how you grow. The small ones were getting new customers through the back door and were losing them at the back door because of poor customer service. So, I develop the Three More Formula as a way to capture all these big business strategies and teach the smaller business. And the focal point of the example that I drew was just to show people example of great customer service wherever you are; and most of these businesses are international but they operate here in Nigeria. For example, Virgin Atlantic flies out of Lagos airport but they operate different level of service to most airlines and I talked about the difference in terms of what they do. What is the book all about? My book is about business success, from small to medium enterprises, that if they succeed, then they would be employing more people, there would be more money generated, customers would be happier and your quality of life will go up. As quality of life goes up, you now have a higher standard and as you get higher standard for yourselves, you now demand more customer service. So you keep driving those businesses to do better and as those businesses are doing better, there would be increase in demand, and if there is higher demand, more
people would be employed and the suppliers would also have to employ more people. This book is currently selling on Amazon, how would you describe the response so far? I launched it in December 2015, and it went straight to number one in the business category, I am on Amazon.com number one selling book. People can download it for their candle, the hard copy would be available very soon in Amazon, it is currently available in Nigeria, I first launched it in Abuja, and then Calabar and from the 18th of May, 2016, it would also be available in Lagos. How would you relate the efficacy of this to your stint at the Cross River Tourism Bureau? We tried with the Calabar festival, the areas that I was in charge of, we definitely improved on our response to sponsors. Before, I came on board, sponsors would give money and it was not clear what the money was used for.

I did not go into politics for money - Kenny Saint Best Multiple award winning gospel act and Kennis music vice-president, Kenny Saint Best was among the top celebrities who made their intentions known to venture into politics in the run up to the 2015 general election. Though, she lost during the primaries, KSB as she’s fondly called is now a card carrying member of the All Progressives Congress (APC) and she appeared in virtually all the party’s activities. In this interview, she opens up on the reason why embraced politics among other sundry issues. Excerpt: Let’s talk about you and politics, what influenced your decision to go into it? I reside in Onigbongbo Local Government Area of Lagos State, and for over 6 years, I’ve been part of the local government in area of development basically in area of education, development of the public schools and upgrading of public schools in Onigbongbo local government under the chairmanship of Honourable Idowu Obasa, so I’ve been a part of it. At the state level, I was the main act at the state children’s Christmas party, and I was very active during the 2007 elections that brought in Governor Fashola. So, I’ve always been q u i t e active in t h e
background of politics, but it was last year that I decided that I can do something about changing the face of youth development in Ikeja and Lagos as a whole. Apart from being a youth coach, youth pastor that requires me to see to the development of the youth, I have a yeaning and pull towards the street and seeing that every girl that comes out to hustle on the street at night should have a privilege to become a better citizen, and be given the privilege of better productivity in the areas of what they can do to improve their lives apart from prostitution. What makes you feel politics is the way to go to make this kind of change? Each time I look at it that I’m going into politics, I feel somehow, because of the kind of image politics has in Nigeria, it gives me shivers. I see it more as Public Service and if I look at it more in the area of seeing to getting people developed, human appreciation, and what I see in my local government especially the Opebi axis where I reside baffles me. The rise of prostitution has gone up by almost 1000%. It never used to be this bad; back then, you can count the number of girls you see on one hand, but now especially at that Pekas junction, it seems like a trailer comes to offload them for the night from 7pm. It looks like the street is pulling those more and more all because of money, and what they do depreciates humanity. I think there can be a change, something can be introduced to these girls and let them know that there’s a gift on the inside of them that can improve their personality and make money with their body by working h a r d without having to

themselves. So really it’s the area of human productivity that’s really pulling me into Public Service, and that’s why I need to get on a platform to get the job done and if that platform is called Politics, then maybe you can call me a politician (laughs). Coming from your background as an entertainer, do you really think you have what it takes to make any change in politics? I think what it takes is the passion for change in human beings. It’s like saying why is Pastor Tunde Bakare in politics? Is it that he’s not getting enough money from the pulpit? It is the same call to build humanity, and it’s about spreading the good news through government. Yes, there is a youth ministry, but their attention seems to be more on sports development and we have seen how that has bettered the live sports practitioners, especially in football. It’s only in football that you have platforms for under 13, under 15, under 17, Flying Eagles and then Super Eagles. They don’t have such organised platforms for any other of youth development; we don’t have it for models, fashion or even musicians and actors. The government can’t boast of any support or effort to grow these industries so much so that it’s the effort of these entertainers that has added to the GDP of Nigeria that has made us to have the highest GDP in Africa. Personally, I belong to Kennis music and 16 years of my life has been dedicated into human development and that is what we still do, but we do not have any structure despite the fact that we can see the potentials. The money or loan they said they granted the industry, how many people can come out to say they’ve benefitted from it. So, somebody needs to come into government to enlighten them and let them know the amount of tax they can generate if the industry is properly structured, that’s why I’m doing my best from the grassroots. Lagos is the hub of entertainment in Africa, we need to get it right. The best way to curb crime is to create employment and empower the youth otherwise we’ll continue to have people brainwash them into commixing petty crimes for money. the past 16 years, I’m an expert in this industry. The government knows how to get professionals to handle other ministries but when it comes to youth and entertainment, they don’t. I still say it everywhere that Nigeria’s GDP rose because of the huge contributions of the entertainment industry, meanwhile we don’t have an entertainment ministry or agency representing the industry as a whole. The industry is so big that it encompasses movies, music, modelling, fashion, make up and more. And when they decide to have entertainment at government events, they only bring cultural dancers as if that’s all about entertainment. The bulk of unemployed Nigerian youths are actually educated, the energy is just lying fallow. This energy needs to be channelled into something positive and productive. At the moment, the energy is in a neutral gear which can only be pushed into positive or negative gears. You can’t just talk about youth empowerment and gather youth together for seminars upon seminars without practical ways of making money. A lot of graduates now have to learn makeup artistry, make small chops, or learn video production to make ends meet, and all these that I’ve just mentioned do not fall into any category in the structure of government. What if people say you’re going into politics to make money? Am I broke? Am I poor? I’ve been blessed, because what most people are still praying for and still have on their list of prayer requests, I’ve been given. So, if it is money that’s driving me, it would kill me because I would see so much money and die. If it’s just money, then I’m not going to be fulfilled. Since you made your intention to go into politics know, what’s been the reaction of people towards it? People are excited, and they know what I and my family have done in the Nigerian entertainment industry. For instance, Davido has won Best African act awards at 3 international awards and yet no governor or brand has said well-done to him for making Nigeria proud simply because it’s not sport. Imagine the hype and government support for Blessing Okagbare who won Gold at Glasgow. This is simply because we don’t have a structure to support entertainment. Now that I’ve decided to stick my neck out to bring Nigerian youth to the point of relevance, people are really about it and giving me all the support. If the government cannot create a ministry for the entertainment industry, they can create an agency for it just like LAWMA and co.

relationship Entering a new relationship is a big deal, particularly when your past relationships continually failed. If you are having reservations about starting fresh with someone new, it might be best to reflect on your dating habits first. Here are some questions to ask yourself to ensure that your next relationship is the happiest, healthiest one yet. 1. Am I ready? Relationships take time and energy. Make sure your current lifestyle is ready for the commitment. If you have a new job, if you are in pursuit of a dream, or if you are endearing a family emergency, it might not be best to throw another human being into the mix. Wait until you are settled before considering a relationship. 2. Am I truly over my ex? Do not enter into a new relationship if your answer is NO, and you secretly want your ex back. Rebound relationships are not only destined to fail, they are destined to bruise the emotions of your new partner. No one wants to feel like they are a rebound, and no one deserves to be one. The best way to get over your ex is to work on yourself. Decide what didn’t work in your last relationship, and what personal aspect of your own life need adjusting to make your next relationship a success. 3. What did not work in past relationships? Perhaps you sacrificed too much for your last partner. Perhaps it lacked trust or honesty. Maybe your relationship didn’t work because of distance. Make a list of all the things that went wrong in your prior relationships and find solutions. 4. What worked in my past relationships? If you don’t recognize the positive aspects of a functional and healthy relationship, it will be difficult to transfer those ideas into a new one. If your own relationships lack insight, look at the couples around you. Perhaps your own parent or friends have harbored long-term relationships, and can lend some
advice. 5. What kind of relationship am I looking for? In other words, how serious do you want it to be?
