n official of the Davao City Covid-19 Task Force emphasized that there is no discussion yet on removing the wearing of face masks, however, the removal of its policy depends on the incoming administration.

he release of the P500 monthly cash aid for low income families is targeted to be rolled out before the term of President Rodrigo Duterte ends this month, the Department of Social Welfare and Development (DSWD) said Saturday. DSWD spokesperson Director Irene Dumlao said the Department of Budget and Management, National Economic and Development Authority, the Bangko Sentral ng Pilipinas, and the DSWD issued a joint memorandum circular containing the guidelines for the distribution of the monthly subsidy in May. With this, she said, “Itong P500 na ayuda, maaari na tayong makapagsimula sa pamamahagi nito bago magtapos ang termino ni Pangulong Duterte.” (We can start distributing the P500 subsidy before the term of President Duterte ends.) Dumlao made the remark after she confirmed

that the cash aid remained undistributed, three months after Duterte approved it. In March, Duterte ordered that the monthly cash aid for the country’s poorest of the poor be increased from P200 a month to P500 a month amid the rising cost of fuel and other basic commodities. Dumlao said the target beneficiaries are the bottom 15% of the population or about 12.4 million low income households. She said that qualified beneficiaries include those under the Conditional Cash Transfer program, beneficiaries of the Social Pension program, and other poor households as identified by the DSWD’s National Household Targeting System for Poverty Reduction. The DSWD official said the monthly cash grant will be given at P1,000 every two months for a period of six months. Earlier, the Palace said

okyo will provide a 710 million Japanese yen (approximately PHP289.6 million) grant aid to the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM) and the Philippine Coast Guard (PCG), the Department of Foreign Affairs (DFA) announced Friday. The grant was formalized during the exchange of notes between Foreign Affairs Secretary Teodoro Locsin Jr. and Japanese Ambassador Koshikawa Kazuhiko on Thursday. “Japan’s provision of medical equipment for 10 hospitals within the Bangsamoro Autonomous Region in Muslim Mindanao and 13 portable generators for the Philippine Coast Guard demonstrates Japan’s commitment to help uplift the lives of the Filipino people and enhance the country’s maritime enforcement capabilities,” Locsin said in a statement. Koshikawa said addressing the medical and socio-economic development needs in the BARMM region will extend the peace process promoted by the Philippine government “and which the Japanese government is happy to support”. The Japanese Official Development Assistance (ODA) under the Econom-

ic and Social Development Programme for the BARMM is a provision of JPY500 million (approximately PHP204 million) worth of medical equipment for hospitals, including medical oxygen pipeline systems, dialysis machines, oxygen generating systems, medical waste autoclaves, and monitors and ventilators. The BARMM beneficiary hospitals are Iranun District Hospital, Maguindanao Provincial Hospital, Sulu Provincial Hospital, Cotabato Regional Medical Center, Amai Pakpak Medical Center, Datu Blah Sinsuat Memorial Hospital, Tamparan District Hospital, Dr. Serapio Montaner Memorial Hospital, Datu Halun Sakilan Hospital, and Lamitan District Hospital. The PCG, on the other hand, will receive 13 units of portable generators worth JPY210 million (approximately PHP85.67 million) to benefit coast guard district stations in BARMM, Metro Manila, Central Cebu, Northeastern Luzon, Pangasinan, El Nido, Davao, Southern and Southwestern Mindanao, Iloilo, Batangas, and Northern Mindanao. Dear Rachel:

As a rule, creditors, such as credit card companies or their collection agents, have the right to demand payment from their debtors when the obligation becomes due. This usually happens when the debtor has been delinquent in paying his or her account. A creditor can take reasonable measures in

demanding payment to compel the debtor to pay. This includes making threats to enforce his or her claim in court. In the case of Lee vs. Court of Appeals, 201 SCRA 405, the Supreme Court stated that such practice is legal as there is nothing unlawful on the threat to sue. It is a practice followed not only by banks but even by individuals to demand payment of their accounts with the threat that upon failure to do so an action would be instituted in court. Thus, the said a threat is legal within the realm of the law as a means to enforce collection. However, it must always be remembered that a creditor may only do legally appropriate acts in trying to collect from his or her debtor. If there comes

a time when the creditor acts beyond the limits of law, legal responsibilities would attach to him and the debtor would have a ground to sue in court. However, even if the said credit card companies or their collection agents have the right to collect the payment of his or her debtor, it should not resort to unfair collection practices. As can be gleaned from Subsections. 4301 N. 14, Manual of Regulations for Non-Bank Financial Institution as amended by Circular No. 454, s. 2004, unfair collection practices are the following, to wit: (a) use or threat of violence or other criminal means to harm a person, his reputation or property; b) use of obscenities, insults, or profane language

which amount to a criminal act or offense; (c) disclosure of the names of credit cardholders who allegedly refuse to pay debts, unless authorized by law; (d) threat to take any action that cannot legally be taken; e) purposely communicating or threatening to communicate false credit information; (f) any false representation or deceptive means to collect any debt or to obtain information concerning a cardholder; and (g) making contact at unreasonable/inconvenient hours before 6:00 A.M. or after 10:00 P.M., unless the account is past due for more than sixty (60) days, it is with express permission, or said times are the only reasonable or conve-

nient opportunities for contact. Under Republic Act (R.A.) No. 7653, known as the New Central Bank Act, the violation of the said rules by the credit card company or its collection agent would make them liable administratively and criminally. They might also be criminally liable under the Revised Penal Code, and civilly liable under the Civil Code. In view of the foregoing, the credit company or the collection agent’s threat to sue per se is not actionable. But if this is accompanied by the above-mentioned acts, you may file appropriate civil, criminal, and administrative complaint against the credit card company or its collection agent for the protection of your rights.

DENGUE SEASON Okay, it’s the rainy season now and so expect dengue cases to rise again in the city. This is the reason why June is celebrated every year as National Dengue Awareness Month. From January to May this year, a total of 654 dengue cases, including three deaths, have been recorded by the Davao City Tropical Disease Prevention and Control, according to the City Information Office (CIO). It was stated in a press release that the ancillary unit under the City Health Office is constantly conducting prevention and intervention efforts to combat dengue and other mosquito-borne diseases in the city. In addition, the control unit also conducts intervention measures like fogging upon request from the barangays. This practice, however, “does not guarantee full prevention of the disease,” said the unit’s Melodina Babante. In fact, fogging “may even cause undesirable side effects to the respiratory system.” So, instead of fogging, she recommends Dabawenyos to clean their communities as this practice is “a more viable method of preventing an outbreak.” Dengue is caused by one of any of four related viruses: Den-

gue virus 1, 2, 3 and 4. These are spread to people through the bite of an infected mosquito, particularly Aedes aegypti and Aedes albopictus. “Dengue is the world’s most important viral disease transmitted by mosquitoes,” declares Dr. Duane Gubler, health administrator of the US Centers for Disease Control and Prevention (CDC). Since there are four types, a person can be infected with a dengue virus as many as four times in his or her lifetime, according to the Geneva-based World Health Organization (WHO). Dengue causes a wide spectrum of disease. “This can range from subclinical disease (people may not know they are even infected) to severe flu-like symptoms in those infected,” the United Nations health agency explains. Although less common, some people develop severe dengue, which can be any number of complications associated with severe bleeding, organ impairment and/or plasma leakage. “Severe dengue has a higher risk of death when not managed appropriately,” the WHO warns. Also known as “breakbone” fever, dengue is the Swa-

hili term for “a sudden overtaking by a spirit.” Like death and taxes, dengue exempts no one: fat or thin, ugly or beautiful, rich or poor, educated and illiterate. Children, who are exposed in open areas while playing, are more prone although adults are not spared. I had a friend, a lawyer and a staff member of a former senator. He was based in Manila but at one time he went to Baguio, where he contracted dengue. A few days after being bitten by an infected mosquito, he suffered high fever, severe headache, and pain behind the eyes. There was also an outbreak of rashes in some parts of his body. From Baguio, he was brought to Manila. But it was already too late; he suffered hemorrhage in the liver and died three weeks after being confined in one of the well-known hospitals in Makati City. Even doctors die from severe dengue, too! There was a case of a lady physician whose daughter suffered from dengue. Unknowingly, a mosquito which bit her daughter had bitten the doctor. A few days after the daughter died, as a result of dengue, the doctor also showed manifestations of having den-

gue. She also died of the same disease. According to the WHO, dengue fever usually starts suddenly with a high fever, rash, severe headache, pain behind the eyes, and muscle and joint pain. Nausea, vomiting, and loss of appetite are common. A rash usually appears three to four days after the start of the fever. The illness can last up to 10 days, but complete recovery can take as long as a month. Most dengue infections result in relatively mild illness, but some can progress to severe dengue, which was first recognized in the 1950s during dengue epidemics in the Philippines and Thailand. With severe dengue, the warning signs are as follows: severe abdominal pain, persistent vomiting, rapid breathing, bleeding gums or nose, fatigue, restlessness, liver enlargement, and blood in vomit or stool. Without prompt treatment, the blood vessels can collapse, causing shock. Once this happens, it is just a matter of time that the person will succumb. Children are much more likely to get severe dengue than adults. “Dengue has no treatment but the disease can be managed early,” the Department of

Health states. For severe dengue, maintenance of the patient’s body fluid volume is critical, the WHO says. The best protection against dengue is not to be bitten by the mosquito carrying the virus. “The first step to prevent dengue is within our homes,” says Health Secretary Francisco T. Duque III. “It is important to remove any space or container that can hold unnecessary stagnant water which may become breeding sites of mosquitoes.” The health department urges everyone to implement the Enhanced 4-S. It stands for Search and destroy mosquito-breeding sites; secure Self-protection measures like wearing long pants and longsleeved shirts and daily use of mosquito repellent; Seek early consultation, and Support fogging/spraying only in hotspots areas where increase in cases is registered for two consecutive weeks to prevent an impending outbreak. “We are taking proactive actions in preventing outbreaks and raising awareness to curb the increase in the number of (dengue) cases,” says Dr. Maria Rosario Singh-Vergeire, health undersecretary and DOH official spokesperson.

he Board of Investments (BOI) reported the agency is already cleared from the Commission on Audit (COA) report that it has undistributed personal protective equipment (PPE) donated by China’s Panhua Group as of end2021. In a press conference on Friday, Trade Undersecretary and BOI Managing Head Ceferino Rodolfo shed light on a news report published June 7 that the “BOI failed to distribute donated PPEs”, using a 2021 COA report. Rodolfo said COA cleared the agency on the issue last March. This, as the donated PPE from China -- with the BOI as the recipient -- for health care workers are non-medical grade. “We are talking about products here that are meant to protect our health workers so when we received the packages,

as a protocol, the BOI had to do proper checking and evaluation of the protective health gear products including its location of origination as well as its quality,” Rodolfo said. He added that the agency has no intention to hold or stockpile the donations. The senior trade official said the PPE donations were distributed to the Philippine General Hospital. Since the donated PPE are non-medical grade, these were distributed to non-front line workers including security guards and administrative officers, among others. “We have to understand also that the BOI, with the intention of acting based on prudence and compliance with relevant laws, rules, and regulations, conducted due diligence first to ensure that everything is in order,” he said. t least 1,100 jobs will be created in the Philippines as three Israeli companies have expressed their interest to expand their operations in the country. Economic Attaché and Head of the Economic Mission of the Israel Embassy Tomer Heyvi said Friday software development company Amdocs, agro-business firm LR Group, and information technology and business process outsourcing (ITBPO) company Maroonz Holdings are the companies that submitted their Letters of Intent (LOIs) to the Department of Trade and Industry (DTI). On Thursday, DTI Secretary Ramon Lopez told

reporters that “early harvest could be around USD150 million this year” from these companies. The Israeli Embassy in Manila said the expansion of Amdocs will create additional 1,000 jobs, while investments from Maroonz will generate 100 jobs. Heyvi said, aside from increasing merchandise trade, Israel also wants to grow trade in services with the Philippines. “Leading tech companies

in Israel today use the BPO services,” Heyvi said in an interview. He added that the headcount of these Israeli BPO firms here is “a growing figure”. Meanwhile, with the growing number of overseas Filipino workers (OFWs) in Israel, Heyvi said a Philippine bank will be putting up its branch in Israel to help with the remittances between the

ORDINANCE NO. 0898-22 Series of 2022 AN ORDINANCE REGULATING THE MAINTENANCE OF IDLE POLES AND ABANDONED WIRES AND CABLES IN THE CITY OF DAVAO Be it ordained by the Sangguniang Panlungsod of Davao City in session assembled, that: SECTION 1. TITLE - This Ordinance shall be known as “AN ORDINANCE REGULATING THE MAINTENANCE OF IDLE POLES AND ABANDONED WIRES AND CABLES IN THE CITY OF DAVAO. SECTION 2. DECLARATION OF POLICY – Along some streets of Davao City are untidily scattered with idle poles, strewn with abandoned and unused wires, cables and unbundled or nonfunctional overhead electrical wires and communication cables that not only present unpleasant sight and view but also posing hazard to persons and properties. This Ordinance aims to regulate the maintenance of abandoned wires, cables and poles considered as nuisance within the City. This will create a safe and clean environment for individuals protecting them from harm or injury that may be caused by abandoned wires, cables and poles. SECTION 3. DEFINITION OF TERMS – For purposes of this Ordinance, the following terms are defined: 3.1 Abandoned wires – refer to wires and cables installed and serving no purpose; 3.2 Barangay Inventory-refers to the inventory submitted by the barangay consisting of a list of all abandoned wires, cables and idle poles within their jurisdiction, with actual pictures of the colorcoded wires, pole number and exact location; 3.3 Cable- an assembly of one or more insulated conductors or optical fibers within an enveloping sheath that supply electricity or telecommunications signals; 3.4 Color-coded wires – refer to wires and cables marked with certain colors that identify the ownership of such wires;

7.A.2 The Team shall recommend issuances of citation tickets, and the removal of nuisance wires and poles. 7.A.3 The Team shall formulate the Implementing Rules and Regulations of this Ordinance. 7.A.4 The Team shall meet at least once a month for purposes of complying with the functions enumerated under this Ordinance. 7.B COMPOSITION. – Aside from the existing composition of the Wires and Cables Technical Team, additional members shall be as follows: 7.B.1 Chairperson, Committee on Information Technology 7.B.2 Chairperson, Committee on Public Safety 7.B.3 Officer in Charge, Ancillary Services Unit 7.B.4 Representative of CONVERGE 7.B.5 Liga ng Barangay President SECTION 8. TRANSITORY PROVISION – The City Government of Davao, Telecommunication Companies, and Davao Light and Power Company shall jointly enter into an agreement of similar instrument to stipulate such terms and conditions for the removal and maintenance of existing structures established before the effectivity of this Ordinance. SECTION 9. IMPLEMENTING RULES AND REGULATIONS – Within three (3) months after the effectivity of this Ordinance, the Wires and Cables Technical Team shall formulate rules and regulations for the effective implementation of this Ordinance. This Ordinance shall remain effective even in the absence of an IRR. SECTION 10. PENALTY – Any person who fails to submit to the requirements of this Ordinance shall be penalized as follows: 10.1 First Offense – Notice of Violation; 10.2 Second Offense – if no action has been made after 30 days of notice of violation, a fine of Five Thousand Pesos (Php5,000.00) per pole and abandoned wire; 10.3 Third Offense – if no action has been made after 30 days of the second offense, a fine of Five Thousand Pesos (Php5,000.00) per pole and removal of abandoned wire, and revocation of business license and permit. If the violation is committed by a partnership, corporation, association, cooperative, or firm, the penalty shall be imposed on the president or general manager thereof. SECTION 11. ORDINANCE VIOLATION RECEIPT OR CITATION TICKET – An Ordinance Violation Receipt, otherwise known as a “Citation Ticket” shall be issued to the violators of this Ordinance. The Citation Ticket shall state the name and address of the violator, the specific violation committed and the provisions of the succeeding Section on the “No Contest Provision.” If the violation of this Ordinance is deemed to have been committed by a corporation, partnership or juridical entity, duly recognized in accordance with law, the chief executive officer, president, general manager, managing partner, or such other officer-in-charge, if known, shall be cited for the commission of the offense. SECTION 12. NO CONTEST PROVISION – Any person cited for violation of this Ordinance, who does not wish to contest the violation and is willing to pay voluntarily the fine imposed upon him or her under this Ordinance prior to the filing of a formal complaint before the Office of the City Prosecutor shall be allowed to pay said fine with the City Treasurer’s Office to avoid being criminally prosecuted. The availment of the “No Contest Provision” shall exempt an individual from criminal liability under this Ordinance. For this purpose, the City Legal Office and the City Treasurer’s Office shall provide the procedure for the availment of the “No Contest Provision” and establish a case inventory and recording system for all violations of this Ordinance.

3.5 Idle poles – refer to all poles installed which are no longer in use or dilapidated;

Provided, that if a violator has already availed of the “No Contest Provision”, he or she can no longer avail of the same; and the corresponding complaint for any violation of this Ordinance shall be immediately filed.

3.6 Incident Report – refers to the report issued by the Wires and Cables Technical Team after a priority-tagging of the Barangay inventory;

SECTION 13. REPEALING CLAUSE – The provisions of any ordinance, resolution, order, rules and regulations that are inconsistent with this Ordinance are hereby repealed, modified or amended accordingly.

3.7 Nuisance – refers to any act, omission, establishment, business, condition of property, or anything else which injures or endangers the health or safety of others;

SECTION 14. SEPARABILITY CLAUSE – If, for any reason, any section or provision of this Ordinance shall be declared unconstitutional or invalid, no other sections of provisions shall be affected thereby.

3.8 Overhead Lines – all kinds of wires and cables installed overhead;

Any wire or cable that is not removed on the 3rd offense shall be removed by the Ancillary Services Unit subject to the permission of the Wires and Cables Technical Team. 4.2 Bundling of Wires and Cables – Loose, unbundled or cluttered wires, and cables that are still in service shall be bundled or bound together to form a single unit by the use of zip tie, tie wire or by lashing, or by the use of any other strong and safe material. An Incident Report must be filed with the Wires and Cables Technical Team. Violations under this Ordinance must be treated per Incident Report. Failure to observe the abovementioned acts shall be a violation of this Ordinance and shall be penalized accordingly.
