espite the low number of Covid-19 cases in Davao City and a positivity rate far from the acceptable 5 percent, the Davao City Covid-19 Task Force is still monitoring for a possible surge in cases after the May 9 local and national elections. Davao City Covid-19 Task Force Spokesperson Dr. Michelle Schlosser reported that as of May 20, 2022 the city has recorded four cases of Covid-19. “Naa ta’y four cases as of May 20 but still kung basehan nato ang positivity rate still one percent below sa acceptable rate of the positivity rate na five percent. Adding to the concern is the recent detection of the Omicron subvariant BA.2.12.1, which has entered the Philippines after it was detected in 14 individuals - 11 foreign tourists, two Metro Manila residents, and one resident of Puerto Princesa City in Palawan. Schlosser said it’s a matter of time before the said subvariant will enter Davao City wherein there are no longer interlocal and interzonal restrictions and traveling in Davao City is already allowed.

Meanwhile, Shclosser reported that on May 19, 2022 the city recorded only one case of Covid-19, however, the patient, who was an unvaccinated senior citizen, died. “For a long time wala na ta’y kaayo natala na deaths but on May 19 we have a case, one case pero death pud siya, a senior citizen and unfortunately wala siya nabakunahan. Based on history wala gyud siya ka receive ug vaccine. Maka-sad kay mao ni ang atong gustong iwasan,” she said. Due to the lack of specific details, I would have to qualify my answer to your questions. If the title of the property is under the name of your grandmother, then your father has no right over the property that was sold anymore. While

your father as a child of your grandmother is a compulsory heir, the fact of inheriting is only an inchoate right while your grandmother is alive. Hence, your grandmother has the right to sell the property without the consent of your father, because as the owner she has the right to enjoy and dispose of a thing, without other limitations than those established by law. However, it will be a different story if the property is owned by your father. If the property is under the name of your father, then by all means he can avail of the remedies under the law to vindicate his rights. Since according to you, the property was sold by your grandmother secretly, therefore without his consent, your

father can file an action to nullify the deed of sale that was executed. An action for annulment of sale is filed where consent is vitiated by lack of legal capacity of one of the contracting parties, or by mistake, violence, intimidation, undue influence or fraud. By its very nature, annulment contemplates a contract which is voidable, that is, valid until annulled. Annullable contracts that have been annulled are the confer no right and produce no legal effect. Furthermore, If the title in under the name of your father and that the sale transaction happened without his consent, then it is highly probable that a document was forged to facilitate the sale. Take note that an action to annul a deed of sale

prescribes after four (4) years from discovery. You should first check with the Registry of Deeds to make sure that the title has not been transferred yet. If the title has already been transferred to the name of the buyer, then the action that should be filed is Reconveyance of Property. An action for reconveyance, on the other hand, is a legal and equitable remedy granted to the rightful owner of land which has been wrongfully or erroneously registered in the name of another for the purpose of compelling the latter to transfer or reconvey the land to the rightful and lawful owner, or to the party with superior right over it, without prejudice to innocent purchasers in good faith.

While the Deed of Sale is a legal instrument proving the sale transaction, it will not automatically transfer the title to the name of the buyer. You still have to go through a process before the title under the name of the seller will be cancelled and consequently a new one will be issued under the name of the buyer. With that being said, it is possible that while a sale transaction indeed happened, the party (this could be the buyer or the seller) did not process the registration of the sale just yet. WIDESPREAD FLOODING: NOT CAUSED BY DEFORESTATION? “Floods are among the most destructive calamities man has to cope with.” The statement comes from the Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA). A really big flood can result in millions, even billions of pesos of damages to road and bridges, buildings and other economic infrastructure, in the loss of agricultural crops and livestock, loss of productivity in industry, commerce and trade – not to mention the incalculable loss of human life. More often than not, people blame the destruction of forests when rains lead to severe flooding. But former United Nations official Patrick Durst begged to disagree with this conventional wisdom. Durst was then the regional forestry officer of the UN Food and Agriculture Organization in Bangkok, Thailand. In a conversation, he said there is no scientific evidence to link major, large-scale floods to the loss of forests. “Government officials, aid groups and the media are often quick to blame flooding on deforestation caused by small farmers and tree cutters,” he

said. Such belief in the past, he pointed out, led some governments to force poor farmers from their lands and away from forests while doing nothing to prevent future flooding. “Such actions are totally misguided,” he said. Now, this is getting interesting. Are floods caused by nature or by human activities like logging and farming? That’s a tough question to answer if it is going to be asked in a beauty pageant question and answer segment. The FAO came up with a book that tries to separate fact from fiction on issues related to forests and water. Forests and Floods: Drowning in Fiction or Thriving on Facts? also dispels some of the commonly held misconceptions about the role of forests in flood mitigation. “Clearly, floods are caused by nature; but in some cases, they are exacerbated by human activities,” Durst said. “The floods blamed on deforestation almost always occur after prolonged rains, which saturate the soil, including forest soil, so that it can no longer absorb more water,” explained the 30-page FAO publication. “Rain then has nowhere to go but into

rivers where it fills them to overflowing.” At its root, the flood equation is pretty simple: If a river cannot handle the load of water it’s required to carry, it must rise. With enough water, it must rise above its banks and flood. The faster water runs from the watershed into the river, the higher a flood will be. Thus, anything that increases runoff speed – like excessive pavement or ditching of farmland – will contribute to floods. Some experts believe that economic and human losses from floods have increased over the years mainly because more people live and work in areas where floods are common. “People need to stop blaming floods on those who live and work in and around forests,” said Pal Singh of the World Agroforestry Center. Trees and forests may partly play a role in environmental protection. “Planting trees and protecting forests can have many environmental benefits, but preventing large scale floods is not one of them,” explained David Kaimowitz, who was then the director-general of the Center for International Forestry Research when he said those words.

“If deforestation was causing floods, you would expect a rise in major flood events paralleling the rise in deforestation, but that is not the case,” he said. “The frequency of major flooding events has remained the same over the last 120 years going back to the days when lush forests were abundant.” Large-scale floods that happened in the Chiang Mai valley in northern Thailand are well-documented for events in 1918-1920 and again in 1953. “These floods all occurred when lush forests were still abundant in Thailand,” the FAO report said. The conventional view for 100 years has been that forests prevent floods by acting as a giant sponge. According to this theory, developed by European foresters at the end of the 19th century, the complex of forest soil, roots and litter acts as a giant sponge, soaking up water during rainy spells and releasing it evenly during dry periods, when the water is most needed. When major floods do occur, it is most often towards the end of the rainy season, when heavy rain falls and soils are already saturated and incapable of soaking up additional water, the FAO report noted.

“The reality is far more complex,” said Dr. He Changchui, former FAO regional representative for Asia and the Pacific. “Although forested watersheds are exceptionally stable hydrological systems, the complexity of environmental factors should cause us to refrain from overselling the virtues of forests and from relying on simple solutions.” After all, there can be a political interest in leaving the conventional wisdom about forests and floods unchallenged, the report points out. Governments can respond to floods with logging bans and give the appearance to the public they are taking decisive steps to stop flooding. The practical effect of such policies is to force poor farmers - who are routinely portrayed as major perpetrators of illegal logging - to abandon their lands. “While the ability of forests to prevent catastrophic floods is limited, watershed management should definitely not be abandoned,” the FAO publication urged. “Forests provide a variety of environmental services, which need to be protected and nurtured for the benefit of today and tomorrow’s upland and lowland populations.”

Difficult to stop rising commodity prices: DTI

he Department of Trade and Industry (DTI) said it couldn’t keep the prices of some commodities low because cost of raw materials have increased.

“Hindi na natin mapigilan na hindi magalaw, hindi magalaw iyong presyo dahil sa nagtataas na presyo ng raw materials naman na ginagamit nila, major ingredients nila sa paggawa,” Trade Undersecretary Ruth Castelo said in a televised briefing. In a virtual briefing on Friday, Xendit Chief Executive Officer (CEO) and Managing Director for Philippine operations Yang Yang Zhang said their latest capital boost, which came from several investors like Accel, Tiger Global, and Kleiner Perkins, brought to USD538 million the capital they have raised so far. She said they want to continue supporting startups and micro, small, and medium enterprises (MSMEs) just like how they got the same boost a few years back. “(We intend to) invest directly in startups…. We want to put where our mouth is,” she said. The company started operations in Indonesia but Zhang said they con-

he Bureau of Internal Revenue on Friday said the now suspended closure order against Megaworld Corp stemmed from its initial refusal to comply with an audit following a dispute on jurisdiction over several properties. Failure to comply with the audit is a ground for closure, BIR Regional Director Eduardo Pagulayan Jr said in a statement. The investigation involves verification of taxes on One-Time Transactions (ONETT) on the sale or transfer of properties by Megaworld, the BIR said. Pagulayan said BIR Revenue Region No. 8B - South NCR has jurisdiction over such enforcement activity. Megaworld is a large taxpayer under the jurisdiction of the Large Taxpayer Service of the BIR National Office. But the ONETT falls under the jurisdiction of the BIR Regional Office “where the property is located,” the tax bureau said. “The said properties being subjected to investigations are located within the premises of Taguig City, which clearly falls within the jurisdiction of the said BIR Regional Office and not with the Large Taxpayer

Service,” the BIR said. “At first instance, Megaworld refused to comply with the BIR audit. The BIR Regional Office, however, found that the said corporation failed in its compliance and reportorial requirements under the Tax Code,” it said. On Wednesday, the BIR said it would issue a closure order to Megaworld Corp. The closure order has since been suspended. “It was resolved that Megaworld will now comply with the audit. Hence, closure was set aside. Now, the investigation is ongoing,” the BIR said. Megaworld earlier said it had a “disagreement” with the BIR regarding jurisdiction but it has since been clarified. It also said it has no pending unpaid liabilities and has vowed to cooperate with the tax authorities. House Committee on Ways and Means Chairman Joey Salceda on Friday urged the BIR the further explain the matter since the “bizarre” event undermines the stability of the country’s tax institution and financial market since Megaworld is a listed company under the Philippine Stock Exchange.

Hidilyn survives tough Thai challenge en route to SEAG gold

t didn’t turn out easy breezy for Olympic champion Hidilyn Diaz in the 31st Southeast Asian Games in Vietnam.

On Friday, Diaz clinched the gold medal in the women’s 55kg category as she tallied a total of 206 kg’ Her total lift was 3kg ahead of second-running Sanikun Tanasan of Thailand who gave er a tough fight in the Hanoi Games. The pride of Zamboanga City said this feat signaled her intention to defend her Olympic championship. “My journey towards Paris (Olympics) starts here, so this SEA Games gold is very important for me,” Diaz, 30, said. “Napaka-meaningful nito (SEAG). After winning the gold medal, bumalik pa din ako, nakapag-deliver ng gold medal for the Philippines. Masaya ako na nandito ako ulit ako sa SEA Games, na i-represent ang Pilipinas.” It was not a walk in the park for the Filipina sports icon as she was challenged by Tanasan, the Rio Olympics gold medalist, at the start of the competition.
