he Davao City Police Office (DCPO) is intensifying border control in Davao City by activating Oplan Davao Defense System (DDS) following a bombing incident in Koronadal City on Thursday.

The DDS includes conducting checkpoints and strengthening police visibility in Davao City.

On Thursday noon, a bomb exploded inside a Yellow Bus Line (YBL) passenger transport bus with plate no. MMB 216 along the National Highway, Gen. Santos Drive, Zone 3, Koronadal City, South Cotabato.

Based on report, the aforementioned bus was traversing the stretch of Gensan Drive, an explosion suspected to be an Improvised Explosive Device (IED) at its back portion, which resulted to the wounding of three individuals.

The incident was immediately responded by Koronadal Municipal Police Station (MPS) and Explosive Ordnance Disposal (EOD), South Cotabato Provincial

Police Office (SCPPO).

To begin with, let me pres-

ent to you the elements of when a person can be found liable for cyberlibel under Section 4 (c)(4) of Republic Act No. 10175 in relation to Article 355 of the Revised Penal Code.

The elements are as follows: a. There must be an imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance. b. The imputation must be made publicly. c. The imputation must be malicious. d. The imputation must be directed at a natural or juridical person, or one who is dead. e. The imputation must tend to cause the dishonor, discredit or contempt of the person defamed.

In your case, it appears that the elements here are present. First, that you have been imputed of a vice or defect; Second, that it was made publicly through the Tarlac Bentahan Facebook Marketplace and it has spread through the Facebook community; Third, it was directed towards you considering that your picture and your name was placed in the said post; Fourth, that such post has tended to cause dishonor or discredit over your own person; and Fifth, there has been malice on the part of the person who posted (or the accused). The last element is where you have a better fighting chance to prove your claim of cyberlibel.

It is clear that the element

of malice is present here considering that the said person (or accused) has already admitted to the said post. Using the case of Disini vs. The Secretary of Justice, 727 Phil. 28, 113 (2014), the Supreme Court has explained the concept of ‘actual malice’ as “malice in fact when the offender makes the defamatory statement with the knowledge that it is false or with reckless disregard of whether it was false of not.”

Thus, applying such case in your situation, the fact that the said accused has already admitted to the said post, with a reckless disregard of whether such statement was false or not, already shows that malice is clearly established in your case.

I hope the readers of this article will remember one important statement: Think Before You Click. In the day and age where social media has been a platform for writing, one must still be aware of the ramifications of cyberlibel or other cybercrimes under Republic Act No. 10175.

GOING NUCLEAR Just before he will exit as president of the Philippines, Rodrigo R. Duterte is hoping that president-elect Ferdinand “Bongbong” Marcos, Jr. would consider nuclear energy as an alternative source of power to reduce the country’s dependence on fossil fuels.

“I hope that the next administration will explore the possibility of nuclear (energy),” Duterte was quoted as saying by national media. After all, it was Bongbong’s father, the late president Ferdinand Marcos who initiated the construction of Bataan Nuclear Power Plant (BNPP).

Started in 1976, it was finished in 1984.

According to Duterte, it would be a “good” advantage for the Philippines to transition from fossil oil fuel to nuclear power.

Fossil fuel, he said, is not only costly but also limited. In comparison, nuclear energy is “more efficient.”

“You know, (fossil) oil is not infinite. It won’t last forever.

Someday it will dry up,” Duterte pointed out.

Some years back, in another news report, Energy Secretary Alfonso G. Cusi described nuclear power as a “cheap and reliable” source of energy.

It must be recalled that Ambassador Zenaida Angara Collinson, the country’s permanent representative to the United Na-

tions and other international organizations in Vienna, reported that many of the future nuclear power plants will be set up in Asia.

“They (the countries) can no longer get it from biomass, solar. The solar wind, the renewables, they are fluctuating and we cannot use them as baseload,” Collinson told Philippine Daily Inquirer.

“The country is joining more than two dozen other countries looking to add nuclear power to their energy mix, including neighbors Indonesia, Vietnam, Malaysia and Thailand,” a Reuters report said.

I have seen nuclear power plants up close twice: in the United States (while driving from Detroit going to Columbus, Ohio) and in China (while riding a bullet train from Beijing to Ningbo City).

During the time of Jericho L. Petilla as energy secretary, he was also contemplating nuclear energy as an option for the country as a power source. “We’re looking at it on a long-term basis,” he said.

“We’re counting on (nuclear as an option). At the same time, we have to look at the technical side, and then recommend later on if studies show that it’s good for the country.”

The Philippines is a member of the Association of Southeast Nations (ASEAN). Right now, the

region is “exploring an approach to diversify its energy mix by introducing clean and reliable energy, such as civilian nuclear energy,” wrote Albertcassy C. Masinas and four others in an opinion that was published in Energy Voice.

“The Philippines, as the third-largest economy and the second most populated country in ASEAN, is having the same battle in balancing the future energy supply and demand,” Masinas and his co-authors wrote. “The country is a net coal and oil importer, which imports nearly half the country’s primary energy supply.”

In 2019, the country’s power supply reportedly reached a total of 25,532 megawatts (MW) of installed capacity, of which fossil fuels accounted for 60%, as coal (35.4%) increased its share of the total power generation to cover for the reduced hydropower output.

“For the upcoming future, especially for meeting the sustainable post-pandemic recovery, the challenges in meeting future energy demand are substantial,” Masinas et. al. wrote. “Moreover, the importance of energy transition has opened opportunities for the Philippines to reduce fossil fuel usage and explore other alternative energy sources including nuclear energy.”

Nuclear energy has the ca-

pacity to produce baseload power for a continuous supply of electricity 24 hours a day, seven times a week, Dr. Arcilla pointed out. He added that conventional sources such as coal and natural gas also have similar capacity, but nuclear does not entail the high cost of refueling fossil fuels or the carbon emissions that are the bane of a world ravaged by climate change.

In a press release obtained by this author, it is said that a single pellet of uranium fuel almost the size of a pencil eraser contains as much energy as a ton of coal (907 kilograms), three barrels of oil (149 gallons), or as much as 17,000 cubic feet of natural gas.

The PNRI is the country’s lead agency in atomic research and development. It is a member of the Nuclear Energy Program Inter-Agency Committee (NEPIAC) created by Executive Order 116. NEPIAC, whose main task is to study the adoption of a national position on nuclear power, is chaired by the Department of Energy (DOE) with the DOST as vice chair.

In a statement, the PNRI believes that adding nuclear to the current energy mix will pave the way for more efficient and less costly power cost. “(T)he dependence on imported fossil fuels makes the country vulnerable to world

energy price volatility. By comparison, the cost of generating nuclear energy is less sensitive to nuclear fuel price due to the larger component contributed by its capital cost,” said the National Academy of Science and Technology.

Nuclear power is the use of sustained nuclear fission to generate heat and electricity.

But there is an ongoing debate about the use of nuclear energy. Proponents, such as the World Nuclear Association, the IAEA and Environmentalists for Nuclear Energy contend that nuclear power is a sustainable energy source that reduces carbon emissions.

But environmentalists and militant groups see it differently.

The Economist said nuclear power “looks dangerous, unpopular, expensive and risky,” and that “it is replaceable with relative ease and could be forgotten with no huge structural shifts in the way the world works.”

“Nuclear power is beset by problems that go well beyond its propensity for occasional accidents,” wrote Christopher Flavin, of the Washington-based Worldwatch Institute. “Technologically, economically, and politically, nuclear power faces a series of obstacles that will prevent it from coming close to displacing fossil fuels to significantly delay global warming.”

Gov’t to borrow P250B in final month of Duterte presidency

n the last full month of the Duterte administration, the Bureau of the Treasury (BTr) plans to raise P250 billion by offering government securities to local creditors to boost state coffers.

In a memorandum dated May 25, the BTr issued the schedule of short-dated Treasury Bills and longer-tenor Treasury Bonds for the month of June.

Broken down, the BTr is planning to borrow from local creditors P75 billion in Treasury Bills and P175 billion in Treasury Bonds.

The national govern-

ment plans to issue a total of P15 billion in Treasury Bills at P5 billion each for the 91-day, 182-day, and 364-day tenors per day for five days—June 1, 8, 15, 22, and 29. The auction dates for the Treasury Bill issuances are set two days before the scheduled issue date.

Meanwhile, P35 billion worth of three-year Treasury Bonds will be

issued on June 2, while the auction date is set for May 31.

Another P35 billion worth of Treasury Bonds is set to be issued on June 9 with a five-year tenor or maturity period.

On June 16, June 23, and June 30, the Treasury would have issued P35 billion per day worth of Treasury Bonds with seven-year, 10-year, and another seven-year tenors, respectively.

National Treasurer Rosalia De Leon said that the BTr’s planned fund-raising initiatives this month were meant

to increase funding for COVID-19 recovery measures and infrastructure development.

Incoming Finance Secretary Benjamin Diokno intends to retain most of the undersecretaries of the Department of Finance (DOF), including De Leon.

The next administration will be left with the task of managing the country’s fiscal position after the outgoing Duterte regime incurred P3.2 trillion in additional debt following the COVID-19 pandemic, which could

Rice import tariffs collection up 18.6% to P7.35B from Jan 1 to May 13: BOC

he Bureau of Customs (BOC) has collected a total of P7.35 billion in duties from rice imports from January 1 to May 13 of 2022, representing an increase of P1.15 billion or 18.6 percent from last year’s collections of P6.2 billion for the same period.

This amount is already 73 percent of the P10 billion fund earmarked yearly for the Rice Competitiveness Enhancement Fund (RCEF) to finance the modernization of the agriculture sector and raise the incomes of palay growers.

Customs Commissioner Rey Leonardo Guerrero said in his report to Finance Secretary Carlos Dominguez III during a recent DOF Executive Committee (Execom) meeting that the January 1 to May 13 collections came from 1.26 million metric (MT) tons of rice shipments entering the country.

Compared to last year’s 883,068 MT collected during the same period last year, the 1.26

million MT is 43.3 percent higher, Guerrero said.

Under Republic Act (RA) No. 11203 or the Rice Tariffication Law (RTL), tariffs collected from rice imports go to the RCEF. Collections in excess of the P10 billion fund go to the Rice Farmer Financial Assistance (RFFA). The law took effect on March 5, 2019.

Guerrero said the value of rice continued to drop, posting a decline of 17 percent from P20,126 per MT in the January 1 to May 13 period of last year to P16,710 per MT during the same period this year.

For pork imports, Guerrero said tax collections as of May 13 totaling P5.3 billion had already overtaken the estimated amount of foregone revenues as a result of the earlier presidential directives lowering the import tariffs on pork.

Nat’l gov’t fiscal position improved to surplus of P4.9B in April —BTr

he national government’s fiscal balance reverted to a surplus in April as state revenues exceeded spending during the period.

Data released by the Bureau of the Treasury (BTr) showed the government posted a budget surplus of P4.9 billion last month, compared to a deficit of P44.4 billion in the same month last year.

The Treasury attributed the budget surplus to “faster year-over-year revenue collection growth of 19.19% against the marginal 1.98% increase in public expenditures.”

From January to April, the resulting fiscal position remained at a deficit of P311.9 billion, albeit lower by 14.76% compared to the budget shortfall of P365.9 billion in the first four months of 2021.

Revenues In April, state collections reached P348 billion, up by P56 billion from P291.9 billion in revenues in the same month of 2021, “as all government collecting agencies exhibited positive outturns,” the BTr said.

This brought year-todate revenue to P1.132 trillion, up 14.56% from P988.4 billion year-onyear. Taxes comprised the bulk, or P1.004 trillion (89%) of total state collections, while the remaining 11% came from non-tax sources.

In particular, collections by the Bureau of Internal Revenue totaled P240 billion in April,

bringing the taxman’s year-to-date collections to P742.4 billion, up 7.79% year-on-year.

The Bureau of Customs collected P65.7 billion in April, up 26.82% from a year earlier.

The higher Customs collection was attributed to the “improved valuation, intensified enforcement against illegal importations, and the improved compliance by traders to customs laws,” the BTr said.

The BOC’s January to April revenues amounted to P254.2 billion, outpacing last year’s performance by 26.50%.

Meanwhile, income generated by the Treasury totaled P25.7 billion, more than double last year’s level of P9 billion.

“The substantial increase was largely driven by higher dividend remittances as well as income from BSF (Bond Sinking Fund) investment and national government’s share from PAGCOR (Philippine Amusement and Gaming Corporation) income,” the Treasury said.

The BTr’s cumulative revenue of P74.4 billion for the four-month period likewise represented a double-digit growth of 53.85%, or P26.1 billion more than the P48.4 billion raised a year ago.

Cacao growers cite Inday Sara’s legacy

acao Industry Development Association of Mindanao (CIDAMI) president Val Turtur cited outgoing Davao City Mayor and Vice President-elect Sara Duterte in the growth of the cacao industry in Davao City.

“The City Government program thru Mayor Inday, we were given free cacao seedlings at the same time they continued to provide trainings they also gave equipment and machines for chocolate processors,” Turtur said.

The City Government had various programs and projects to assist cacao growers and choco-

late processors in Davao City.

In a statement, the

central bank said order was issued through Memorandum 2022-026 to all central bank-supervised financial institutions following President Rodrigo Duterte’s directive to suspend all e-sabong operations in the country effective May 3, 2022.

Duterte issued the order upon the recommen-

dation of the Department of the Interior and Local Government (DILG) to stop e-sabong or online cockfighting operations.

The President’s decision came following a survey conducted by the by DILG in cities and provinces regarding e-sabong operations, which is being blamed for the

EO 128, which lowered pork import tariffs to 5 per-

cent within its minimum access volume (MAV) and 15 percent outside MAV for the first three months, took effect from April 7 to May 14, 2021.

EO 134, which superseded EO 128 and took effect on May 17 last year, set tariffs on pork imports under the MAV to 10 percent for the first three months, and 15 percent in the next nine months.

For imports outside the MAV, the tariff rates were set at 20 percent for the first three months and 25 percent for the succeeding nine months.

The BTr said that April interest payments amounting to P37.3 billion were 56.61%, or P13.5 billion, higher relative to the P23.8 billion paid a year ago.

Similarly, the total IP of P186.6 billion as of end-April grew by 24.69% over last year’s four-month total of P149.7 billion.

The BSP also directed its supervised financial institutions to inform their clients who still have remaining funds in their e-sabong accounts to transfer the funds back to their e-wallets within 30 days from the issuance of the memorandum.

After 30 days, the central bank said financial institutions are directed to disable the link between e-sabong accounts and e-money wallets, including e-sabong merchant operator accounts.

The memorandum also emphasized that

BSP-supervised financial institutions “shall strictly observe customer due diligence, continuously monitor accounts and transactions, report suspicious transactions, and ensure that appropriate control measures are in place to restrict access of minors, government employees, and other prohibited players to online gambling facilities.”

arvin Ham, a long-time assistant coach for the reigning NBA champion Milwaukee Bucks, has been hired as coach of the Los Angeles Lakers, according to multiple reports on Friday.

ill Kai Sotto be drafted in the upcoming 2022 NBA Draft?

Sports Illustrated thinks so.

In its mock draft, Sports Illustrated sees the 7-foot3 Pinoy cager being picked 49th overall by the Sacramento Kings.

According to Sports Illustrated’s Brett Siegel, Sotto is mostly likely to be drafted

by Sacramento in the second round.

Sotto, who played for a season with the Adelaide 36ers in Australia’s National Basketball League, is currently in the US to work out with several NBA teams in anticipation of the draft this coming June 23.

He is looking to become the first full-blooded Filipino

to be drafted into the NBA. On Thursday, Sotto participated in a pre-draft workout with the Orlando Magic.

The former four-star prospect averaged 7.5 points and 4.5 rebounds on 50% shooting from the field in 23 games with the 36ers.

He produced perhaps his best game of the season on April 10 after recording a career-high 21 points.

The 20-year-old declared for the NBA draft on April 28 and was said to have at least 12 workouts scheduled with teams beginning this week.
