The President showed his support to his son mayoral candidate Sebastian “Baste” Duterte as he attended the ‘Miting de Avance” of the Hugpong Ng Pagbabago - Hugpong sa Tawong Lungsod (HNP-HTL) at the San Pedro Square in Davao City on Friday evening. The President opened his message by thanking

the Dabawenyos for making him a mayor, congressman, the vice mayor of Mayor Sara, and the 16th President of the country. “Nahimo kong sikat tungod ninyo, tawo, katawhan sa Davao. Kamoy nagsugod nako padulong ngadto sa akong biyahe ngadto sa pagka-Presidente unya diha sa Malacañan. Unya sama sa

Removal of teachers for poll duty in BARMM not yet final: education exec

T

he removal of public school teachers who will serve as members of the Electoral Board (EB) for the May 9 national and local polls in the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM) is not yet final, an education official clarified Friday. Mobarak Pandi, chief information officer of the Ministry of Basic, Higher and Technical Education (MBHTE), said the changes in the composition of the EBs in some precincts in the Bangsamoro region are not yet executory. “The MBHTE has recommended to the Commission on Elections (Comelec) changes in the composition of some EBs. However, it is the Comelec that will have a final say on the teachers who will serve as members of the EBs,” he said in a phone interview. As of Friday morning, the Comelec has yet to release the final list of appointments of the members of the EB, Pandi added. He noted the regional education office merely forwarded to the Comelec the recommendations of the school divisions. “The role of the MBHTE is only recommendatory. We only submitted the recommendations of the school division (heads), who are the ones who really know who among their ranks are willing

and able to serve in the elections,” Pandi explained. The MBHTE has no control on who the school divisions will recommend to serve as EB members, he said. Reports said that at least 200 public school teachers who were trained to handle vote counting machines were replaced by Islamic teachers from madaris schools. In a report by the staterun Philippine News Agency (PNA), reelectionist Cotabato City Mayor Cynthia Guiani-Sayadi said the new names were allegedly not trained to serve as members of the EBs by the Ministry of Science and Technology, which, according to her, is illegal. Sayadi, bet of the Nationalist People’s Coalition, is being challenged by three-term councilor Bruce Matabalao, candidate of the United Bangsamoro Justice Party, the political party of the Moro Islamic Liberation Front (MILF). She campaigned for the exclusion of Cotabato City to the Bangsamoro region during the 2019 plebiscite for the ratification of Republic Act 11054 or the Organic Law for the BARMM. The creation of the Bangsamoro region is the centerpiece of the Comprehensive Agreement on the Bangsamoro, which was signed by the government and the MILF in 2014 after 17 years of negotiations.

Three Indian BPO firms eyes Davao City

A

n official of Information Communication Technology (ICT)Davao announced that at least three Indian business process outsourcing (BPO) companies are eyeing to locate in Davao City. ICT-Davao president Samuel Matunog told Edge Davao that during their meeting, the said companies inquired whether Davao City has the talent or workers to fill up their requirements. He added that these companies want to start as soon as they can hire the people they need. He also said that the companies are also looking at some of the available Philippine Economic Zone Authority (PEZA)-registered buildings in Davao City. Matunog shared that one of the companies focuses on healthcare such as medical coding, billing, insurance, and revenue cycle management. “The other is a multinational corporation that provides information technology, consulting, and business process services,” he said. He said the third is a BPO with several existing locations nationwide that are looking to expand in Davao City.

“The presence of these companies mean there will be more competition for qualified talent. But their investment will ensure that our current cohort of college students of more than 80,000 will have a ready market for their talents,” Matunog said. On April 20, 2022, the Davao City Investment and Promotion Center (DCIPC) facilitated a meeting with one of the ICT/BPO investors, AGS Health, in cooperation with the Board of Investments (BOI), and ICT Davao. DCIPC discussed the investment opportunities and tax incentives offered by the city government of Davao and the BOI to AGS Health, an Indian outsourcing company. Matunog conveyed to the key officers of AGS Health the competitive human resource that Davao City produces which can be a source of their manpower once they locate in the city. Gil Dureza of the BOI assured the Indian investors that they can avail themselves of the national incentives that the BOI provides and the local incentives through the DCIPC.

tioned are covered under Article 124 of the Family Code which provides, “Art. 124. The administration and enjoyment of the conjugal partnership property shall belong to both spouses jointly. In case of disagreement, the husband’s decision shall prevail, subject to recourse to the court by the wife for a proper remedy, which must be availed of within five years from the date of the contract implementing such decision. In the event that one spouse is incapacitated or otherwise unable to participate in the administration of the conjugal properties, the other spouse may assume sole powers of administration. These powers do not include the powers of disposition or encumbrance which must have the authority of the court or the written consent of the other spouse. In the absence of such authority or consent the disposition or encumbrance shall

be void. However, the transaction shall be construed as a continuing offer on the part of the consenting spouse and the third person, and may be perfected as a binding contract upon the acceptance by the other spouse or authorization by the court before the offer is withdrawn by either or both offerors.” Also, in the case of Dennis Tuazon et.a.l, vs Myra Fuentes, the Supreme Court stated that” the law requires that the disposition of common property by the husband as an administrator in appropriate cases requires the written consent of the wife, otherwise, the disposition is void.” In the same case, the Supreme Court stated that “lower courts aptly declared the lease contracts executed without the written consent of Fuentes as void. The subject of the contracts of lease involved common property; hence, for the con-

tracts to be effective, the consent of both husband and wife must concur. It is immaterial whether Fuentes had knowledge of the questioned transactions as the latter admittedly did not give her written consent to the contracts. Significantly, Tuazon himself admitted that Fuentes did not participate nor sign the contracts of lease.” In Abakada Guro Party List v. Hon. Exec. Ermita, 506 Phil. 1, 113, 2005, citing Agpalo, Statutory Construction, 1990 ed., p. 45, the Supreme Cout stressed that “the law requires written consent of the other spouse, otherwise, the disposition of common property is void. The requirement under the law is clear, categorical, unambiguous, and makes no room for interpretation. Under the rules on statutory construction, where the law is clear and unambiguous, it must be taken to mean exact-

ly what it says, and courts have no choice but to see to it that the mandate is obeyed.” As you can see, there is a law that protects the conjugal property from being disposed by the husband or wife without his or her written consent. The law and jurispudence are both clear, that in the disposition or encumbrance of common properties, written consent is required. This should also serve as a reminder to everyone that a conjugal property is a special nature of ownership and property regime governed by marriage. As for husbands, even if they are heads of the family, they still need to get the consent of their wives in disposing their conjugal properties. That is what a good husband should do. Remember, “No man is good enough to govern any woman without her consent”

Lon Jacobe, writing for Parade, related an anecdote about who is the king of the jungle. And so, the lion approached a rhinoceros and asked, “Who is the king of the jungle?” To which, the rhinoceros replied, “You are, O lion.” The lion went up to the hippopotamus and asked again, “Who is the king of the jungle?” The same reply: “You are, O lion.” Whereupon, the lion went up to the elephant and asked the same question. The elephant seized the lion with his trunk, whirled him around, tossed him in the air, caught him on the way down, and slammed him into a tree. Half-dazed, severely beaten, the lion shook himself and managed to mutter: “Just because you don’t know the right answer, you don’t have to get angry.” That may be funny but anger is a serious subject matter.

Aristotle said, “Anybody can become angry – that is easy, but to be angry with the right person and to the right degree and at the right time and for the right purpose, and in the right way – that is not within everybody’s power and is not easy.” Joel Osteen also said, “Every day we have plenty of opportunities to get angry, stressed or offended. But what you’re doing when you indulge in these negative emotions is giving something outside yourself power over your happiness.” In an interview with CBS radio host Don Swaim in 1987, award-winning author Toni Morrison said, “Anger… it’s a paralyzing emotion… you can’t get anything done. People sort of think it’s an interesting, passionate, and igniting feeling – I don’t think it’s any of that – it’s helpless… it’s absence of control – and I need all of my skills, all of the control, all of my powers… and anger doesn’t provide any of that – I have no use for it whatsoever.” Everyone gets angry: man or woman, child or adult, famous or infamous, the weak and the strong. No one is spared from anger. Even Jesus Christ was angry when he saw the

people using the church as a public market. At the University of Leyden in Holland, they have famous disputes and arguments for the public. An old shoemaker, who had little or no education, was often seen in the audience. As the public debates were held in Latin, and he knew nothing of this tongue, a friend once asked why he came to the discussions. “I don’t know what is said,” the cobbler replied, “but I know who is wrong in the argument.” The friend was surprised by what he heard. “How,” he inquired. The shoemaker replied, “By seeing who is angry first.” Elizabeth Kenny, the famed Australian nurse behind the Kenny method of polio treatment, was once asked by a friend how she managed to stay so constantly cheerful despite all the troubles she encountered. “I suppose you were just born calm and smiling,” the friend commented. “Of course, not,” Kenny replied. “As a girl, my temper often got out of bounds. But one day, when I became angry at a friend over some trivial matter, my mother gave me the counsel that I have since stored in my

mind, and have called upon for guidance ever since.” Ever wondered what Kenny’s mother told her? “Elizabeth,” the mother said, “anyone who angers you, conquers you.” That’s one way of conquering anger. Here’s another one, related by Clifton Fadiman, which happened to Edwin Stanton, the secretary of war of American President Abraham Lincoln. Stanton had some trouble with a major general who accused him in abusive language of favoritism. When he could no longer control his anger, he complained to the president. After hearing his dilemma, the president suggested that he write the office a strident letter. Stanton obliged and after doing so, he showed the strongly-worded letter to the president, who praised its powerful language. “What are you going to do with it?” Lincoln inquired. He was totally flabbergasted with the question of Lincoln. “Why, send it, of course,” he told the president. But Lincoln objected. “No, you don’t want to send that letter,” the president said. “Put it on the stove. That’s what I do

when I have written a letter while I am angry. It’s a good letter and you have a good time writing it, and now you feel better. So, the best thing you can do now is burn it and write another.” I was reminded of the words of Laurence J. Peter. “Speak when you are angry,” he said, “and you’ll make the best speech you’ll ever regret.” Don’t let that feeling of wanting revenge engulf you. But how? “When angry, count to ten before you speak,” advised American President Thomas Jefferson. “If very angry, count to one hundred.” More importantly, ask for direction from that Someone Up There. “Our tendency in the midst of suffering is to turn on God,” Rob Bell argues. “To get angry and bitter and shake our fist at the sky and say, ‘God, you don’t know what it’s like! You don’t understand! You have no idea what I’m going through. You don’t have a clue how much this hurts.’ “The cross is God’s way of taking away all of our accusations, excuses and arguments,” Bell continues. “The cross is God taking on flesh and blood and saying, ‘Me, too.’”

SB Corp. releases P7.2-B microloans for MSMEs

D

epartment of Trade and Industry (DTI) Secretary Ramon Lopez said the agency’s financing arm has released a total of PHP7.2 billion worth of loans to micro, small and medium enterprises (MSMEs) to help them recover from the pandemic.

At the launch of the Rise Up Program Friday, Lopez said the PHP7.2-billion loan disbursed to MSMEs came from the Coronavirus disease 2019 Assistance to Restart Enterprises (CARES) program of Small Business (SB) Corp. Lopez said CARES loan has assisted around 42,100 borrowers.

SBCorp launched the CARES program, a zero-interest loan, in 2020 with a PHP1-billion budget funded internally. With the success of the program, Congress allocated PHP10 billion under the Bayanihan to Recover as One (Bayanihan 2) for the CARES loan. However, the Department of Budget and

Management (DBM) only released PHP8.08 billion to the DTI’s financing arm. Of the total released fund, PHP4 billion was allotted for multi-sectoral MSMEs and PHP4 billion for tourism-related MSMEs. The rest was spent for the mobilization and operating expenses to roll out the microfinancing program. Lopez said loans for multi-sectoral MSMEs were fully utilized while the facility for the tourism sector was underutilized as tourism-related enterprises were reluctant to borrow money even at zero-interest rate due to their low operating capacity.

To date, some PHP2.7 billion is still available for MSMEs in the tourism sector, Lopez said. PEZA to construct 33-story building for commercial use

he Philippine Economic Zone Authority (PEZA) will construct a 33-story building on its 5,000-square meter land along Roxas Boulevard, its director general Charito Plaza said in an interview. Plaza told reporters that PEZA is currently in talks with three groups to construct the office building that will be leased for commercial use. She said these groups include Alloy MTD, a unit of Malaysian firm MTD Capital Bhd., which is involved in the initial development of New Clark City; local construction firm Rhodium; and a Chinese firm. “We are preparing the TOR (terms of reference) so we can award the bid and start the construction this year, but not before the end of the Duterte administration,” the PEZA chief said. This new stream of income for PEZA could contribute to its remittance of dividends to the Bureau of the Treasury.

From 2016 to 2021, PEZA has remitted a total of PHP10.79 billion in dividends to the national government, PHP5.6 billion of which was turned in the last five years. The investment promotion agency does not receive any budget from the government. PEZA is self-sufficient through the fees and charges it collected in economic zones such as permit and inspection fees, processing fees, sewerage/garbage, fines, transshipment, and utility fees as well as other sources of revenues including service concession and rentals. Meanwhile, Plaza said PEZA will finish the construction of its 13-story office building to be fully used by the agency in 2024. PEZA is spending around PHP1.5 billion for its own office building in its 5,000-sqm property along Roxas Blvd. This is also the first office building funded by the Land Bank of the Philippines, Plaza added.

PH trade gap widens to $5B in March 2022 Security Bank will no longer finance coal power plants

s part of efforts to cut greenhouse gas emissions and limit global warming, Security Bank Corp. on Friday announced that it will no longer finance new coal-fired power plants in the country. In a statement, Security Bank said its plan to end funding for coal-fueled projects is in line with the Philippine government’s pledge during the 2021 United Nations Climate Change Conference of the Parties (COP26) as well as the 2015 Paris climate agreement. “A focus of our ESRMS (Environmental and Social Risk Management System) is to specifically address sustainability and climate risk, as well as health and safety risk in our operations, investment practices, and supply chain,” said Eduardo Olbes, chief financial officer and chairman of the sustainability committee of Security Bank. “A key aspect of the ESRMS is our coal policy, which specifies our commitment to discontinue financing the construction of

new coal-fueled power generation plants, with a view to exit funding coal generation by 2033,” said Olbes. In 2021, Security Bank said its board of directors approved the lender’s ESRMS, which details the policies and enhanced due diligence required for identifying, addressing, and mitigating environmental and social risks in the bank’s operations, lending and investing practices, and supply chain. In 2020, Security Bank’s board approved its Sustainability Framework, which outlines its principles for addressing environmental, social, and governance issues. Citing market and consumer research company Statista, Security Bank said that, as of 2020, the Philippines still relies heavily on coal as the main source of energy, accounting for 57% of the country’s energy requirements. Renewable energy sources such as hydro, wind, solar, and geothermal energy make up only 21% of the country’s energy resources, it said.

n May 9, 2022, we will elect a new set of 18,086 national and local officials across 14 regions and 7,640 islands of our archipelagic country, if we exclude the Panatag or Scarborough Shoal which is claimed, occupied and controlled by China. After 187 years of having periodic national elections since 1935, and after 30 years of local elections since 1992, it appears not much have changed. Paradoxically, we are still hearing similar complaints about the ineffectivity of government, and its failure to provide basic needs of our countrymen. Until now, we are still shouting, even much louder than before, for change. Election is a process of selecting the best men and women who can ably represent us and articulate our interests, concerns that matter most in our lives. Hence, the overarching question is who among the candidates is prepared with well-studied, realistic,doable and attainable plans, programs and projects that are responsive to the demands of time and circumstance including universal healthcare and hospital services for all; revitalization of agriculture and fishery; recovery of our lost coastline and ocean fishing areas, irrigation, and upgrading of our outdated educational system, and the interconnecting problems of our nation? This 2022 election comes at the cusp of our recovery from Covid-19 and the vaccination of entire population; when our country is already drowning in staggering problems and saddled by P12.3-trillion indebtedness and with budget deficit that might compel the next administration to impose new and higher taxes to spur bigger revenues. Who among the candidates have a package of solutions to the formidable economic and financial problems of our country? This election comes also at the most critical moment when

the world is shuddering on the brink of a full-scale biochemical, hypersonic nuclear war as a consequence of the Russia-Ukraine war. Considering that we cannot be immune from this clear and present danger, this evokes a question as to who among the candidates has the grasp of international security challenges and prepared with defense programs and policies for our country’s protection and survival? Viewed from the prisms of our borderless world, we need not be a Cassandra to predict that the implications of intersecting problems arising from the Russia-Ukraine war will have far-reaching consequences. Moreover, with the rise of China as the dominant power in Asia, with the strategic convergence of the United States, India, Japan and Australia in the region, and the Philippines now at the epicenter of cross-cutting economic, political and security issues, who among the candidates has the expertise in foreign relations and prepared with the strategic formula to resolve our maritime disputes, recover our island, fishing oceans and coastlines to protect and preserve our sovereignty and territorial integrity? In today’s world, it is inevitable that the collateral damages of this catastrophic events will permeate countries by way of high inflation and borrowing interests rates, triggering increasing cost of imports of gas and oil, petroleum products, and commodities including rice and other food supplies. Thirteen years from today or in 2035, our republic will have become 200 hundred years old. As it appears, not much has changed. It seems as if we merely had been riding on a merrygo-round, if not dancing in the rigodon choreographed by politicians motivated by self-interest. While we were focused in

the pursuit of our individual needs and happiness, we kept silent, complacent and oblivious while politicians strengthen the ties that bind them,to perpetuate control of an “oligarchy-syndicated government”, and to retain monopoly of opportunities and resources. What we are seeing from the conditions obtaining, it is undeniable that we have now reached a turning point in our lifetime as a democratic country. We are now living in a complex and constantly changing world reshaped by advances in technology, including artificial intelligence requiring a new kind of leadership, knowledge, talents and skills. Traditional leadership is no longer responsive to present-day realities.Antiquated ways have been overtaken by the morass of time and tide of events. To paraphrase Einstein, “Yesterday’s solutions cannot solve today’s problems.” We need leaders who can stand up for what is right, and the nerve to rectify what is wrong. Leaders who won’t hesitate to undertake bold changes necessary for the betterment of the country. We need leaders who understand our legal system, who know that laws should be properly enforced for the protection of the population. We cannot just take a chance, and entrust posterity to those who practice money politics. Vote buying emasculates our free will. Selling our votes is a surrender of our individual sovereignty. It deprives us of our personal freedom of choice. The Philippines is an archipelagic country. Hence, who among the candidates is prepared with a plan for our maritime development to enhance inter-island connectivity, facilitate delivery of government services, encourage inter-island trade, enhance communication, promote understanding and peaceful co-

existence among inhabitants. The Philippines is a multi-tribal country, in need of a common denominator for peaceful coexistence. The BARMM is already established. However, it would take a long way to determine if it is the ultimate solution to the Mindanao problem. We need leaders with a vision about what kind of a country would they like the Philippines to be during their incumbency. Who among those candidates aspiring to lead us has that vision and who knows how to lead and guide us through the way forward to attain that vision? Who among the candidates has THE SOLUTIONS? While we are not looking for a saint to vote into office, prudence and due diligence dictate we should refrain from voting for candidates who are engaged in vote buying. Voters who sell their votes will later realize too late that the backlash is a lifetime of regrets. As often expressed in vernacular, “Ang isang daglit na kaligayahan, ang kapalit ay buong buhay na pagsisi at kahirapan.” Government is the system, or group of people normally consisting of legislature, executive, and judiciary governing an organized community like a country, province, city or municipal, and barangay. Local governments are the backbone of the nation. They are involved in practically everything we require in our daily lives. Accordingly, politics is an art and science of government, while election is a contest of ideas, talents and skills on who can better lead and serve. It is the system or process of choosing the most qualified candidate who can better lead, serve and preserve It is a process of selecting a candidate whom we can vest with temporarily with the authority to represent our interests, and decide on issues that concerns us most , and on matters required in our daily lives.
