he family of Amierkhan Mangacop has filed a Motion for Reconsideration on July 22, 2022 before the City Prosecutor’s Office (CPO) hoping that the CPO will review the case with “fairness and equality.” The motion was made after the resolution of CPO released on July 20, 2022 downgrading the charges against suspect Dr. Marvin Rey Andrew Pepino to homicide. Pepino is the sus-

pect behind the shooting of 19-year-old Amierkhan Pulalon Mangacop on July 2, 2022 at the parking area of Lugar Bar in Davao City. In a statement shared to media, the Mangacop

family believes that this is a case of murder due to the following factors based on the autopsy conducted by National Bureau of Investigation-Davao Region: gravity of injuries inflicted to Amierkhan; use of hollowed point bullets by Dr. Pepino, which has been prohibited by the Hague Convention Declaration III. It also mentioned in the statement that Pepino is a “champion shooter and

lawmaker on Friday said the rehabilitation of the Agus-Pulangi hydropower complex (APHPC) should be a top priority of the Marcos administration to ensure a clean and reliable energy source in Mindanao while fighting climate change. Davao City First District Representative Paolo Duterte said the rehabilitation project would initiate the transition process to low-emission energy sources and will contribute to the country’s commitment toward climate change adaptation and mitigation. “If we want to be a global leader in climate action, we can start with rehabilitating the Agus-Pulangi power plants in Mindanao. This long-term measure will eventually reduce Mindanao’s reliance on coal, and accelerate our shift to clean energy sources,” Rep. Duterte said in a statement. He made the remark in response to Finance Secretary Benjamin Diokno’s recent pronouncement before a high-level Group of Twenty (G20) forum that the Marcos administration will continue to pursue a “whole-of-nation” approach in mitigating climate risks and become a world leader in the fight against the climate crisis. The rehabilitation project, he said, would also help fulfill President Marcos’s goal of developing more renewable energy (RE) sources to meet the country’s power generation requirements. Under the govern-

ment’s National Renewable Energy Program (NREP) 2020-2040, the Department of Energy (DOE) is targeting to increase the share of RE sources in the power generation mix to at least 35 percent by 2030 and to more than 50 percent by 2040. He said the repair and rehabilitation of the Agus-Pulangi would ensure the reliability of the power supply in Mindanao “now and in the years to come.” Composed of seven hydropower plants, the Agus-Pulangi complex has an installed capacity of 1,001 megawatts, but only 600 to 700 MW is available because of the limitations of its old facilities. The APHC consists of seven mostly run-of-river hydropower plants with a total installed capacity of 1,001 MW. Six of the seven hydropower plants are located along the Agus River which flows for 36.5 kilometers (km) from Lanao Lake to Iligan Bay. The seventh hydropower plant is the Pulangi 4, located on the Pulangi River in Bukidnon. In June, the Department of Finance (DOF) said it has been finetuning a proposed arrangement with the Power Sector Assets and Liabilities Management Corporation (PSALM) and National Power Corp. (NPC) on the funding rollout and implementation of the estimated PHP16.71-billion rehabilitation projects for

he sector of persons with disability in Davao del Norte presses attention on the resolution passed by the Provincial Council on Disability Affairs (PCDA) calling on local chief executives to include the PCDA among the signatories in issuing local building permits. Guesting in the latest edition of the Kapihan sa DavNor, Provincial Disability Affairs Officer (PDAO)-designate Larry Ablen revealed that still a number of buildings in Davao del Norte including public buildings, have yet to comply with the accessibility requirement of the Accessibility Law or Batas Pambansa Bilang 344. PB 344 or “The Act to Enhance the Mobility of Disabled Persons by Requiring Certain Buildings, Institutions, Establishments and Other Public Utilities to Install Facilities and Other Devices” provide the accessibility requirement to facilitate mobility of persons with disabilities. The PCDA resolution was aimed at counter-checking non-compliance to the Accessibility Law, Ablen said. Citing the last inter-agency audit-in-

spection that the PCDA conducted prior to the pandemic period, Ablen said some buildings were not fitted with disability features. “Ang among concern, daghan wala pa jud napatuman sa Accessibility Law,” he said during the latest Kapihan sa DavNor in line with the 44th National Disability Prevention and Rehabilitation Week. port as of July 22,2022, the number of cases reached 231 wherein three deaths were recorded: a 10-yearold boy, a 67-year-old, and a 32-year-old male teacher. Out of 231, active cases are 70 wherein 60 are admitted at the wards of the Southern Philippines Medical Center (SPMC) and pri-

vate hospitals in Toril while there are 93 outpatients and seven patients still being verified. He also said that the number of affected barangays is still the same and there are no reports of new barangays outside Toril affected with diarrhea. The total barangays affected are still 21 with 18 barangays coming from Toril and three outside Toril. Since you are questioning the property transfer, you have to go to Court. The law applicable to your predicament is the A.M. No. 19-0815-SC, 2019 PROPOSED AMENDMENTS TO THE REVISED RULES ON EVIDENCE. Section 22. How genuineness

of handwriting proved. – The handwriting of a person may be proved by any witness who believes it to be the handwriting of such person because he or she has seen the person write, or has seen writing purporting to be his or hers upon which the witness has acted or been charged, and has thus acquired knowledge of the handwriting of such person. Evidence respecting the handwriting may also be given by a comparison, made by the witness or the court, with writings admitted or treated as genuine by the party against whom the evidence is offered, or proved to be genuine to the satisfaction of the judge. (22) Under the Rules of Court, the genuineness of a handwriting may be proved by the following: (1) A witness who actually saw the person writing the instrument; (2) A witness familiar with such handwriting and who can give his opinion thereon, such opinion being an exception to the opinion rule; (3) A comparison by the court of the questioned handwriting and admitted genuine specimen thereof; and (4) Expert evidence. During the court hearing, the persons who signed the deed of sale would be examined by the court Since you did not sign the deed, these people and the witnesses who took their oath and lied that they

saw you signed when in fact you did not sign, would be liable for Perjury under Article 183 of the Revised Penal Code which states that any person, who knowingly makes untruthful statements … and shall testify under oath, or make an affidavit, upon any material matter before a competent person authorized to administer an oath .. shall be liable for perjury in solemn affirmation. The Court may also examine the signatures and make conclusions after comparing both signatures. As to the expert evidence, the NBI and the PNP have forensic experts or document examiners who could examine the signatures at the questioned deed of sale and compare it with your genuine signatures in other instruments. The Court may direct the NBI forensic experts to examine the signature and in that case, you need to prepare documents containing your signatures with dates existing or occurring in the same period of time. According to you, since you were staying abroad at the alleged date stated in the deed of sale, then this could be used in your favor. It must be noted that each signature has its individuality or uniqueness. It is this principle of individuality or the principle of uniqueness that forms the basis for handwriting analysis. That is to say, no two persons share the same combination of

handwriting. However, there should be sufficient quantity and quality of writing to compare. The reason that you need to submit sufficient documents containing your signatures with dates existing or occurring in the same period of time is to examine the variation of your signatures at the period of its execution. But do not be disturbed even if there would be variation in your writings, as one could not write exactly the same way, even within several repetitions of writings, it must be noted that an individual’s known writing, including past writings or writings completed during his lifetime, would enable document examiners to assess which is the genuine signature. But take note, the findings of forensic experts or document examiners would not always be given credence. Courts are not bound to give probative value or evidentiary value to the opinions of handwriting experts, as resort to handwriting experts is not mandatory. In the case of Heirs of Corazon A Salud vs Rural Bank [G.R. No. 202756, April 06, 2016 ], the presumption of validity and regularity of a notarized document prevails over allegations of forgery and fraud. In the said case, the NBI handwriting expert stated that age and health conditions could affect one’s handwriting. The CA also stated that

slight dissimilarities in handwriting are only natural and not indicative of forgery. In the case of Phil Trust Co Vs Gabinete.[ G.R. No. 216120, March 29, 2017], it was stated that when the dissimilarity between the genuine and false specimens of writings is visible to the naked eye and would not ordinarily escape notice or detection from an unpracticed observer, resort to technical rules is no longer necessary and the instrument may be stricken off for being spurious. In other words, when so established and is conspicuously evident from its appearance, the opinion of handwriting experts on the forged document is no longer necessary. In the said case, the Supreme Court stated that the signatures that were submitted to the NBI could not be considered as sufficient standards for comparison. Since you were not around, you can easily present a strong, complete, and conclusive proof of the falsity of the deed of sale. A mere disclaimer is not sufficient. As a rule, forgery cannot be presumed and must be proved by clear, positive, and convincing evidence and the burden of proof lies on you. Lastly, you have a strong case. This case can be investigated. Just remember that “Time will expose everything because fake people could not hide long in life”.

THE BATTLE OF SEXES Man is man and woman is woman. A man can never be a woman nor a woman can be a man. In the same manner, James Bond – the fictional British Secret Service agent created in 1953 by writer Ian Fleming – can never be a Jane Bond. That’s what Ana de Armas, who appeared opposite Daniel Craig in No Time to Die, thinks so, too. “There’s no need for a female Bond,” she was quoted as saying by The Sun. “There shouldn’t be any need to steal someone else’s character, you know, to take over. This is a novel, and it leads into this James Bond world and this fantasy of that universe where he’s at.” Craig echoed the same opinion. “The answer to that is very simple,” Craig replied when asked whether or not Bond should be a woman. “There should simply be better parts for women and actors of color. Why should a woman play James Bond when there should be a part just as good as James Bond, but for a woman?” Barbara Broccoli, the franchise’s longtime producer of Bond flicks, couldn’t help but agree. “He’s a male character. He was written as a male and I think he’ll probably stay as a male,” she told The Guardian. “And that’s fine. We don’t have to turn male characters into women. Women can do what men can do. In some instances, they can even outdo men. Genesis 2:21-23 chronicles how the first woman came to be: “So the Lord God caused the man to fall into a deep sleep; and while he was sleeping, he took one of the man’s ribs and closed up the place with flesh. Then the Lord God made a woman from the rib he had taken out of the man, and he brought her to the man. The man said, ‘This is now bone of my bones and flesh of my flesh; she shall be called ‘woman’ for she was taken out of man.’ The Bible story came into my mind when I heard a little girl who was asked during a Sunday school if she knew the story of Adam and Eve. “Of course, I do,” she replied.

“First God made Adam and then looked at him and said, ‘I think I can do better,’ so He created a woman.” Here’s another version: A small child came home from Sunday school and told her mother: “The teacher told us how God made the first man and the first woman. He made man first, but the man was very lonely with no one to talk to, so God put the man to sleep, and while he was asleep, God took out his brains and made a woman out of them.” Then, the battle of sexes took place. “Being a woman is a terribly difficult task since it consists principally in dealing with men,” said Joseph Conrad. British novelist Oscar Wilde has this opinion: “Women have a much better time than men in this world; there are far more things forbidden to them.” With women, there are always two choices. Will Rogers advises: “There are two theories to arguing with a woman. Neither one works.” Ihre Freundin said: “There are two kinds of women in the world: those who take a man’s strength and those who give a man strength.” Now talking about two types of women, a psychoanalyst shares: “My women patients can be divided into two categories: the ones who work and the ones who stay at home. The former suffer from a guilt complex, the latter from frus-

tration.” Have you ever wondered why there are few women in combat? Elaynse Boosler replies: “We have women in the military, but they don’t put us in the front lines. They don’t know if we can fight, if we can kill. I think we can. All the general has to do is walk over to the women and say, ‘You see the enemy over there? Diesel set for slight price drop, as rollback forecast

T

he pump prices of petroleum products are expected to have mixed movements in the coming week.

Citing oil trading monitoring in the past four days (July 18-21), based on the Mean of Platts Singapore (MOPS), an oil industry source said that the price per liter of diesel may be slashed by P1.60 to P1.80. Gasoline, meanwhile, may increase by P0.05 per liter or have no change. Mary Ellen Estoque, acting vice president of SSS South Mindanao Division said the ALKANSSSYA which was launched in 2013 aims to expand SSS membership to the informal sector particularly the tricycle drivers organized under the TODA and also organized market vendors.

Over the years it has included other professional groups like freelancers, job orders and self-employed. “Now they are not just for TODA (tricycle drivers) and market vendors they can also be availed by professionals,” Estoque said. The ALKANSSSYA program is likened to an alkansya or piggy bank where members under an organized group can give their contributions in the form of daily savings. These savings are then picked by a SSS authorized collector.

According to Reverend Arnold Neri Rebuta of the Free Methodist Church they decided to partner with the SSS for the ALKANSSSYA as they wanted the pastors to be covered by SSS. ‘Masagana 150’ key agricultural focus of Marcos administration

he Department of Agriculture (DA) is looking into a “Masagana 150” program that will target to produce 150 cavans of rice harvest per hectare, Undersecretary Kristine Evangelista has said. President Ferdinand “Bongbong” Marcos Jr.’s father and namesake, the late president Ferdinand Marcos Sr., introduced Masagana 99 in the 1970s to prevent a nationwide rice shortage. The program was designed to increase rice pro-

duction by giving farmers high-yielding rice varieties, with the goal of promoting the country’s rice self-sufficiency by raising the average palay crop yield from 40 cavans per hectare to 99 cavans per hectare. The Masagana 150 program, Evangelista said, would employ new technology in helping the farmers increase their yield. “It’s anchored in increasing the yield based on the tech we can avail of, and the tech we have but the idea is to reach that much as far as cavans is concerned. We’re looking at how and when this can be implemented,” she said in an interview on ANC on Wednesday. “We plant in October, we harvest next year. To manage expectations, it’s not going to be harvested this year. If Masagana 150 will be implemented, we’re looking at it to bring down the price of rice and helping our farmers come up with better yield.” Evangelista said currently, the department is exploring all possibilities to be able to push through with the program. More farmlands The government is also looking into developing more agricultural land, even in urban areas, she said, adding that the country’s local supply of rice is at 12.37 million metric tons and imports about 2.36 million metric tons. “There’s a piece of land here in Quezon City where people are farming there already. We’re bringing in younger farmers because they are innovative and
