DSWD 11 distributes cash aid to 16 former rebels in DavSur

The Department of Social Welfare and Development in the region has provided P20,000.00 cash assis tance to each of the 16 for mer rebels (FRs) in Davao del Sur, who are currently

undergoing de-radicaliza tion program under the Tupad Pangako Program of the Task Force Balik Loob of the NTF-ELCAC of the province.

The DSWD-XI turned over a total of

P320,000.00 livelihood assistance to the Provin cial Social Welfare and Development Office of Davao del Sur headed by Geraldine S. Lano.

Aside from the cash assistance, the 16 FRs

are also beneficiaries of the Enhanced Compre hensive Local Integration Program (E-CLIP) of the Department of the Interi or and Local Government (DILG) Davao del Sur.

BARMM development a priority of the Marcos admin

The development of the Bangsamoro Autonomous Re gion in Muslim Mindanao (BARMM) is at the cen terpiece of government efforts under the adminis tration of President Ferdi nand “Bongbong” Marcos Jr., according to Secretary Carlito G. Galvez, Jr., chief of the Office of the Presi dential Adviser on Peace, Reconciliation and Unity (OPAPRU).

“We saw the discus sion of the President after we reorganized the OP PAP, more than half of per sonnel will be dedicated to Bangsamoro. In fact, we assigned more than 200 personnel for implemen tation of the Bangsamoro and IGRB (Intergovern mental Relations Body),” Galvez said in a press con ference at the Malacañan of the South in Davao City on Thursday.

OPAPP stands for the Office of the Presidential Adviser on the Peace Pro cess, the old name of OPA PRU.

Galvez said the IGRB is one of the major com ponents in implementing the Comprehensive Agree ment on the Bangsamoro with the Moro Islamic Lib eration Front.

Bangsamoro Educa tion Minister Mohagher Iqbal said BARMM’s con tribution to the national development is to make sure that the regional gov ernment functions effi ciently.

He said several issues were discussed during the meeting of the IGRB mem bers here, including “bilat eral decisions” between the national government and Bangsamoro.

He, however, refrained from disclosing the details of the discussion pending signatures of the chairs of the body.

Budget and Manage ment Secretary Amen ah Pangandaman, IGRB co-chair, added that they agreed to convene the rest of the intergovernmental bodies before the end of this year.

Comelec 11 encourages youth to register for Barangay, SK elections

DOT 11 kicks off ‘Kaon Ta, Kain Pa!” in Davao City

The regional office of the Department of Tourism (DOT 11) kicked off the 21st edi tion of the “Kaon Ta, Kain Pa!” Food and Travel Fes tival on December 2-4 at the Abreeza Ayala Mall in Davao City on Friday.

Carrying the theme “Food Tripping Christ mas,” the event is staged in partnership with the Ayala Malls, which fea tures a flavorful spread of local and modern holiday cuisines and local bever ages from Regions 1, 5, 6, 8, 9, 10, 11, 12, 13 as well as from the Cordillera Ad ministrative Region and the National Capital Re gion.

The three-day event aims to position the Phil ippines as a premiere cu linary destination in Asia and globally. It will incor porate food, travel and Christmas.

“We all love to eat and food is always top of mind whenever we visit places, more so during Christ mas when we celebrate the holidays with family

and loved ones during noche buena. This event is indeed a welcome treat for all of us Dabawenyos who will get to travel the country thru our taste buds and will surely leave us craving for more,” said Janice Parreno, Ayala Malls area head for oper ations-Mindanao in her message during the open ing on Friday at the activi ty center of Abreeza Mall.

She said through the activity, Ayala Malls is reaffirming its unwaver ing support for the DOT in promoting the Phil ippines’ rich heritage through tourism.

An official of the Commission on Elec tions 11 (Comelec 11) encouraged the youth to register in preparation for the Barangay and Sangguniang Kabata an Elections (BSKE).

Lawyer Gay Enumer ables, Comelec-Davao as sistant director, reminded that registration will start from December 12, 2022 until January 31, 2023, from Monday to Saturday including holidays except December 24 and 31.

“Ang registration is in tended for the BSKE. Ang

gihangyo nato is ang ka bataan, 15 years old. Para sa mga mudagan sa SK, 18 to 24 years old lang ang mudagan on the day of the elections para sa mga kandidato. Ang 15 years old and below 18 years old para sa voters for SK only. For 18 years old and above until 30 years old,

regular voter siya at the same time SK voter,” Enu merables explained over Davao City Disaster Radio (DCDR) on Friday.

Requirements for first-time voters is school ID or library card.

“As much as possible nakaspecify ang ilahang address,” she said.

Enumerables empha sized that there is no final date yet for BSKE.

Election lawyer Ro mulo Macalintal is re questing the Supreme Court (SC) to order the

Comelec to prepare for the BSKE that should now set to be held in May 2023, although his peti tion to resume the sched uled BSKE is still pending SC’s resolution.

Macalintal reported ly urged the high court to order the Comelec to resume its preparations for the BSKE at an earli er date than the one stat ed in Republic Act (RA) 11935, which moves the BSKE to October 2023.

“This is very exciting.

We know how important Cebu City is in terms of facilitating trade, bring ing in investments, and tourism. We can do a lot of marketing promotion with this,” Maritess Ma guindra, BARMM tourism director said.

Sabi po nung nag-pahi ram na kapag di mabayaran sa due date ay kanila na ang lupa gamit ang open deed of sale. Valid po ba to? May mga remedy po ba kami?

The transaction entered by your parents is quite precarious and they may be possibly vic

tims of a land grabbing modus known as the “open deed of sale scheme”.

The transaction executed is clearly a loan and mortgage of the land. The land is encum bered by way of security for the payment of the loan, and its au tomatic transmission of owner ship in case of default and with the use of “open deed of sale” is called pactum commissorium, which is prohibited under Arti cle 2088 of the Civil Code which states:

“The creditor cannot appro priate the things given by way of pledge or mortgage or dispose of them. Any stipulation to the contrary is null and void.”

While pactum commissori um is null and void, it does not

mean that the loan obligation is already extinguished. The loan agreement still exists, and your parents must still pay the prin cipal loan.

The interest of 10% per month is unconscionable and may be struck down by the court to 6% per annum for loan and forbearance of money.

For your remedy, if the loan obligation is still existing, which means that the title has not yet been transferred to creditor through the open deed of sale, your parents can file a case in court for reformation of contract so that the true in tention of the parties will be expressed – which in your case, is a loan and mortgage agree ment.

If the title has been trans ferred to the name of the cred itor, the remedy of your parents would be to file an action for nullity of title as the same was acquired through pactum com missorium and to declare the sale transaction as equitable mortgage

The Highest Court ruled in ARTURO A. DACQUEL versus SPOUSES ERNESTO SOTELO ET. AL. G.R. No. 203946, August 4, 2021: “As the transaction between the parties herein was demon strated to be one of equitable mortgage, petitioner did not become owner of the subject property but a mere mortgag ee thereof. As such, petitioner was bound by the prohibition

against pactum commissorium as embodied in Article 2088 of the Civil Code: Art. 2088. The creditor cannot appropriate the things given by way of pledge or mortgage or dispose of them. Any stipulation to the contrary is null and void.

The mortgagee’s consol idation of ownership of the mortgaged property upon the mortgagor’s mere failure to pay the obligation is the essence of pactum commissorium. The mortgagor’s default does not operate to automatically vest on the mortgagee the ownership of the encumbered property. This Court has repeatedly declared such arrangements as contrary to morals and public policy and thus void.”

This Yuletide season Santa Claus is very much alive, and to think this way out from a Muslim’s perspective, is doubly amazing. I can’t speak for the Christians, though, and those who likewise celebrate Christmas with Santa Claus as the other prominent fig ure in the Christmas decorations in addition to the symbolisms of the Nativity.

For our Christian neighbors here I have not seen any difficulty in the way they hold the religious Christmas from the fantasy and celebrate them both, and in doing so they both give and receive.

Just as Santa Claus seems to be seen as more of an immortal being now, or at least in the eyes of the innocent children, so is his memory and the way some peo ple fantasize about him, bring a lot of wonderful experiences ev ery Christmas. Whatever that is, I hope I don’t touch on the sen sitivities of those who faithfully believe in Santa Claus, by this somewhat humorous take on this bigger-than-life being.

This is just wistful thinking, before any of you might think I am already less sane. But I think it is best to write to Santa this ear ly before he becomes too busy to read our letters.

But wait. Can anyone please tell me the exact address of Santa Claus? Otherwise, I will just hang this out in the chimney.

Dear Santa,

At the outset, please allow me to introduce myself. I am a Muslim and I don’t celebrate Christmas – which doesn’t mean that we Muslims are in different to it but it is simply non-existent in our culture, cus toms or tradition.

That makes this letter free from any self-serving motive.

However, having been educat ed in a sectarian school, I knew too well how Christmas is cele brated and how Christian chil dren from all walks of life were told to be good for goodness’ sake and not to cry nor pout because YOU are coming to town.

So, what’s the big deal over your coming to town?

Though you never told any one as to when and where you were born, I surmised that you must have come from a place quite far away from the Philip pines or in our promised land of Mindanao.

At this time of the year, I know you have not been to any place yet as you are busy making a list and checking it twice. I wonder for whom your gifts are intended to after finding out who’s naughty

or nice and good or bad. Are they for the nice and good children only, for the naughty and bad or for both? I ask this silly question however I know that you do not discriminate in the matter of giv ing gifts. But what are those gifts for if they were not meant as in centives for children to be nice and good? I leave everything to you and assume that you know better.

Somehow, you can’t keep me from wondering why you keep doing what you do? What do you get in return? And why do you leave Mrs. Claus all alone, out in the cold, on Christmas Eve? I think it is quite unkind of you to stay away from your loved ones on a night that is supposed to be special for them and with you by their side.

I have a lot of questions to ask you even if I know that the chance of me being visited by YOU is al most nil. But if by chance we meet, some of the other questions I will ask are: a) What gifts do you usually give to children? b) What are your criteria in selecting who are entitled to your gifts? c) How do you define children in terms of age? I might still qualify as recipi ent of your gifts, otherwise, I will just speak for the children in my corner of the world.

Well, I think, I just have to do that especially after I found out that most, if not all, children

here are no longer as enthusias tic as say, five or six decades ago, to meet you in person. Worse, and I really hope not, they have stopped believing in you. And most probably, I am the only adult left who still believes in you.

Whatever it is, I know that you travel a lot, otherwise, there is no need for your fantastic sleigh pulled by reindeer under the guidance of Rudolph; that red-nosed reindeer whose nose glows in the dark – the primary reason why you engaged him to guide your sleigh.

I always see a picture of you on your sleigh: at one time, dashing through the snow; at other times, cruising along the stars. You must be traveling at the speed of light, otherwise, you won’t be able to visit all the world’s children of your choice in one Christmas Eve.

I hope you are safe, Santa. And, likewise, I wish that what you do really makes you happy. I know a lot of people who are un happy. I think they are stressed by selfishness, greed, pride and van ity, arrogance, envy or simply by their unfortunate circumstances. I wish you could give them hap piness instead of material gifts which do not guarantee long and lasting joy.

I really wish gift-giving isn’t so materialistic this time. In fact if I had known that you also give

PEACE as a gift, I would prefer that over anything else. That is so wanting in our Mindanao or probably in the whole world now. And I will have to add, please bring peace and joy to the unfor tunate victims of typhoon ‘Paeng’, which recorded more than half of the country’s over a hundred fatalities in Maguindaao alone. ‘Paeng’ was such a wicked and naughty old man.

Finally, if the children in our corner of the world complain that you are just as elusive as before, you can be assured that they will stop expecting from you or at least they will no longer prepare for your coming. I can only hope that they will still continue to be nice and good whether you are coming to town or not.

INSTITUTIONALIZING DENGUE AND OTHER VECTOR-BORNE DISEASES PREVENTION AND CONTROL PROGRAM IN THE PROVINCE OF DAVAO DEL SUR

Be it ordained by the 17th Sangguniang Panlalawigan of Davao del Sur in session assembled:

WHEREAS, Section 15, Article II, of the Philippine Constitution provides that, “the State shall protect and promote the right to health of the people and instill health consciousness among them”;

WHEREAS, Section 16 of Republic Act 7160, otherwise known as the Local Government Code of the Philippines provides that, “every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate or incidental for its efficient and effective governance and those which are essential to the promotion of the general welfare. Within their respective territorial jurisdictions, local government units shall ensure and support among other things, the preservation and enrichment of culture, promote health and safety, enhance the right of people to balance ecology, encourage and support development of appropriate and selfreliant scientific and technological capabilities, improve public morals, enhance economic prosperity and social justice, promote full employment among their residents, maintain peace and order and preserve the comfort and convenience of their inhabitants”;

WHEREAS, the World Health Organization (WHO) estimates that about forty percent (40%) of the world’s population is at risk of being infected with dengue;

WHEREAS, Dengue is the fastest spreading vector-borne disease in the world, endemic in 100 countries and in the Philippines, and had been declared in 2019 as “national endemic” by the Department of Health (DOH);

WHEREAS, as per (provincial) record, dengue cases continuously increase over the years and poses a significant health problem among the residents of Davao del Sur;

WHEREAS, other vector-borne diseases are also present in the Country and more specifically in the Province of Davao del Sur such as malaria, chikungunya, Japanese encephalitis and Zika Virus;

WHEREAS, the Local Government Unit (LGU) of the Province of Davao del Sur sees its importance to institutionalize and strengthen the dengue and other vector-borne disease prevention and control program to ensure healthy lives and well-being of Davsuranons at all ages and lessen the burden of dengue and other vector-borne diseases;

WHEREAS, the province shall appropriate funds and provide penalties for violations of this ordinance;

WHEREAS, such goal requires concerted and collaborative efforts among one component city, various municipalities, barangays and the private sectors throughout the province.

SECTION 1. Title. This Ordinance shall be known as,” Davao del Sur Dengue and Other Vector-Borne Diseases Prevention and Control Ordinance.”

SECTION 2. Definition of Terms. As used in this ordinance, the following terms shall have the meaning ascribed to them in this section:

2.1. Aedes aegypti and Aedes albopictus mosquitoes - are species of local mosquitos, commonly found in rural and urban areas of the country that transmits dengue virus.

2.2. Breeding Places – areas/places where mosquitoes propagate, classified as follows:

a. Indoor-includes flower vases, utensils tray, drums and water containers, refrigerator drain and dish rack.

2.3 Chikungunya - is a mosquito-borne viral disease transmitted to humans by Chikungunya virus, characterized by fever and severe joint pains and with an incubation period of 1-12 days.

2.4. Dengue infection-an acute infectious disease caused by a flavivirus transmitted by day biting Aedes aegypti and Aedes albopictus mosquitoes with sudden onset of headache, fever, prostration, severe joint and muscle pain, swollen glands (lymphadenopathy) and rash and which may vary from a simple Dengue Fever (DF) to a more serious Dengue Hemorrhagic Fever (DHF) and its subsequent fatal form, the Dengue Shock Syndrome (DSS).

2.5. Establishment - shall refer to a business organization and public institution such as hotels, motels, dormitories, commercial buildings, lodging and boarding houses, apartments, hospitals, libraries, museums, offices, malls, markets, supermarkets, movie houses, parks, plazas, cemeteries/memorial parks, terminals, schools, colleges and universities and other similar institutions.

2.6. Fumigation - the act of applying, releasing and dispensing a toxic chemical so that it reaches the target organism, primarily or wholly in gaseous state.

2.7 Impending outbreak – occurrence where a number of cases in at least 1 week exceeds 2 standard deviation of the 5 year weekly mean number of cases in a particular barangay

2.8 Japanese encephalitis - is a viral brain infection that’s spread through mosquito bites. It’s most common in rural areas in southeast Asia, the Pacific islands and the Far East, but is very rare in travelers. The virus is found in pigs and birds, and is passed to mosquitoes when they bite infected animals.

2.9. Malaria - an acute febrile illness caused by Plasmodium parasites, which are spread to people through the bites of infected female Anopheles mosquitoes

2.10 Prevention and Control - method of preventing and controlling pests through the use of several different methods and procedures which are used to complement each other. These procedures may include the use of pesticides, environmental sanitation measures, natural as well as mechanical and biological control methods, among others.

2.11. Negligence – a failure to behave with a level of care that someone of ordinary prudence would have exercised under the same circumstances.

2.12. Person-in-Charge – those persons in charge of household or establishment including owners, managers and administrators.

2.12. Public Place - is generally an indoor or outdoor area, which is accessible to the public.

2.13. Vector - an organism that can carry a particular disease –causing agent without actually developing the disease.

2.14. Yes to fogging – application of fogging (intervention) only in hot spot areas where increase of cases is registered for two consecutive weeks

2.15. Zika is a virus transmitted by the bite of an infected mosquito from the Aedes genus, mainly Aedes aegypti, in tropical and subtropical regions. This virus is also transmitted from mother to fetus during pregnancy, through sexual contact, transfusion of blood and blood products, and organ transplantation.

SECTION 3. Establishment of AKSYON BARANGAY KONTRA DENGUE (ABKD) PROGRAMBarangay Level. Each Sangguniang Barangay (SB) Council headed by the Punong Barangay (PB) in the province of Davao del Sur shall allot an annual budget for the whole-year round implementation of ABKD program including the creation of its ABKD Task force which shall have the following membership:

E.) Ensure that every household and establishments within their territorial jurisdiction shall comply with the following mandatory regulations:

1.1 All possible breeding places of mosquitoes inside and outside of houses must be covered and /or destroyed;

1.2. All unwanted and unnecessary containers that will collect water must be disposed properly;

1.3. All water storage containers such as water drums, pails and galloons must be covered at all times and regularly inspected;

1.4. All unused water receptacles must be emptied;

1.5. All house gutters must be de-clogged and cleaned;

1.6. All waterways, house canals and other water outlets must be flushed and cleaned regularly;

1.7. Properly collect, store, dispose or recycle if possible all unused tin cans, jars, bottles including covers or caps;

1.8. Check and drain water in all plant vases and pots;

1.9. Open bamboo poles or pipe posts, coconut shells and other natural or artificial container that may accumulate water;

1.10. Properly dispose broken appliances and other bulky materials which may accumulate rain water;

1.11. Puncture or cut properly dispose old or discarded tires including those used on top of roofs;

1.12. Seek early consultation for those individuals who are experiencing fever for at least two (2) days;

1.13. Junk shops should provide roofing to prevent scraps from containing water which may become a breeding ground for mosquito to propagate;

1.14. Uninhabited lots must be free from all kinds of waste and regularly clean by its owners to prevent it from becoming a possible breeding ground for Aedes mosquitoes;

1.15. Abandoned swimming pools (privately or publicly owned) must be treated with larvicides or other means of controlling the vectors;

F.) Submit the names of authorized deputy officers of this ordinance to the City/ Municipal Anti- Dengue Prevention and Control Council;

G.) Conduct monthly meeting for planning and monitoring activities relative to the program;

SECTION 5. Punishable Acts. The following acts are subject to imposition of penalties under this Ordinance:

5.1.) Disregard in the elimination, disposal and destruction of potential breeding places of mosquitoes within its premises mentioned in the preceding section;

5.2.) Neglect and /or failure in cleaning water reservoirs or containers which may harbor mosquito vector;

5.3.) Leaving garbage piles and scrap materials uncovered that can be potential breeding places for mosquitoes;

5.4.) Conducting of fogging, spraying and other chemical fumigation activities without prior approval from the City/Municipal Health Office of concerned LGU and failure to secure clearance from the concerned Anti-Dengue Council;

5.5.) Repeated or persistent positive findings of presence of mosquito larva or “kitikiti” by the ABKA Task Force within the concerned household/establishment.

SECTION 6. Creation of City/Municipal Anti-Dengue Councils. Each LGU shall create its own Anti-Dengue Prevention and Control Council composed of the following:

Section 7. Functions of the City/Municipal Anti Dengue Council. The City/Municipal Anti-

Dengue Council shall have the following functions and responsibilities:

7.1. To diligently craft a Comprehensive City/Municipal Dengue Prevention and Control Program;

7.2. To monitor the implementation of the ordinance in the barangay level and exercise over-all supervision over ABKD Task Force within their territorial jurisdiction;

7.3. To establish a Secretariat of the Council who would keep the records and make a report regarding the activities of the council;

7.4. To reproduce Information Education Campaign (IEC) materials, reporting forms to be distributed to the barangays, schools and establishments;

7.5. To take charge with the approval of abatement program for the elimination of vector and in the registration or accreditation of pest control operators prior to render of services to the public;

7.6. To provide clearance involving interventions especially the use of chemicals other than for research purposes prior to its use;

7.7. To recommend annual appropriations in their local budget to be used for technical and logistics support to the barangays;

7.8. To convene monthly or quarterly meetings or as the need arises for the purpose of planning and monitoring of activities relative to the program;

7.9. To recommend the establishment of Citation Ticket System for violators of this ordinance and the penalty associated with it under the following guidelines:

A. The City/Municipal Treasurer shall formulate and facilitate the printing and re-print ing of citation tickets.

B. Official booklet of Citation Tickets shall be issued by the City/Municipal Treasurer to the Barangay Treasurer of the respective barangays and the former shall issue the same to duly authorized enforcers within ninety (90) calendar days from the effectivity of this ordinance.

C. A Citation Ticket shall be issued to the person/s liable for violation of this ordinance upon finding of the violation by duly authorized enforcers (as determined by the ABKD Task Force in the barangay).

D. A Citation Ticket shall contain the following information: i. Checklist of the violations under this ordinance. ii. Penalty association with each violation. iii. Due date for compliance with the obligations imposed by the ticket.

E. When Citation Ticket is issued to a violator, he/she shall report to the City/Municipal Office within five (5) regular business days after such issuance and pay the corresponding violation committed/ or perform community service in the barangay where the violation/s is/are committed.

F. The Barangay Treasurer’s Office shall keep a duplicate of all Citation Tickets issued to violators as well as other records relative to this ordinance.

SECTION 8. PENALTIES. Any person-in-charge who shall be found to have violated, disobeyed, refused or neglected to comply with this ordinance shall be meted with the following penalties:

First Offense: Warning and mandatory attendance to 2 to 3 hours conference to be conducted by the City/Municipal Health Officer or his/her authorized representative.

Second Office: A fine of Two Thousand Pesos (PHP 2,000.00). In case of incapacity to pay fine, the violator shall be required to render (24) hours of Community Service on den gue and other vector-borne disease prevention on the Barangay or place of apprehension.

Third Offense: A fine of Five Thousand Pesos (PHP 5,000.00). In case of incapacity to pay fine, the violator shall be required to render thirty-six (36) hours of Community Service on dengue and other vector-borne disease prevention on the Barangay or place of appre hension.

SECTION 9. Collection of Fees - The fees collected shall be issued with an Official Receipt at the City/Municipal Treasurer’s Office. The division of the fines shall be as follows: 50% to the Barangay of apprehension, 30% to the City/ Municipality of apprehension and 20% to the Province of Davao del Sur.

SECTION 10. Community Service - As cited above, the failure to pay the fine(s), would require the violator to render community service that is related to dengue and other vector-borne disease prevention and control which will be under the supervision of the ABKD Task Force who shall be tasked to supervise and monitor the imposed community service.

SECTION 11. Creation of Provincial Anti-Dengue Council of Davao del Sur (PADC-DDS)

The Provincial Anti-Dengue Council of Davao del Sur shall be composed of the following:

12.5. To convene quarterly or as the need arises for the purpose of planning and mon itoring;

12.6. To organize the “Annual Provincial Anti-Dengue Prevention and Control Summit” of the province whenever the conduct of the same is necessary as determined by the council and provide funds thereof subject to the availability of funds; and

12.7 To establish a Secretariat of the Council who would keep the records and make a report regarding the activities of the council;

12.8 To recognize and give additional cash incentives to LGUs which have successfully implemented the ABKD program in their locality

SECTION 13. Role of Local Government Units and Involvement of CSOs, POs and Private Sector. The various local government units in the province of Davao del Sur , in coordination with concerned agencies, shall ensure continued observance of the Four o’clock habit and the sustained prevention and elimination of mosquito breeding places at the community level. They shall also be responsible for mobilizing the community, especially, the barangays, churches, non-government organizations, people’s organizations, and the private sector in the Program.

SECTION 14. Conduct of Information-Dissemination Campaign. The Provincial/City/ Municipal Information Offices of various LGUs in Davao Sur in coordination with the Provincial Health Office (PHO) and other concerned agencies shall undertake a massive media information-dissemination to educate and raise public awareness on dengue prevention and control.

SECTION 15. Submission of Regular Reports. The various LGUs Anti-Dengue Prevention and Control Council throughout the province shall submit quarterly reports to the PADCDavao del Sur on the status of dengue cases and its program implementation.

SECTION 16. Funding. An annual funding of at least Five Million Pesos (PHP 5,000,000.00), subject to the availability of funds, shall be appropriated to be used for the effective implementation of this ordinance throughout the province.

SECTION 17. Separability Clause. If any provision of this Ordinance is declared unconstitutional or illegal, the same shall not affect the validity and effectivity.

SECTION 18. Repealing Clause. All ordinances, orders or rules and regulations inconsistent with the provisions of this ordinance are hereby repealed or modified accordingly.

SECTION 19. Effectivity. This ordinance shall take effect, fifteen (15) days after publication of a newspaper of general circulation.

The Jose Maria College (JMC) Kings have come a long way, from an obscure basketball squad to a Mindanao champion.

When coach Cholo Elegino of Holy Cross of Davao College told me about the LYR Mindan ao Collegiate Basketball Cham pionships in Tagum, I was a bit impressed to know that Tagum City has now become a venue for a Mindanao-wide basketball tournament.

The tournament was made possible by the LYR Group of Companies and thanks to the Rubinos family for making this a reality.

From what I gathered, there were 16 teams that entered.

IBA College of Mindan ao-Bukidnon and Jose Maria College-Davao City advanced to the final while Ateneo de Davao University and Notre Dame of Midsayap College fought for the third spot.

And probably, you already know that the JMC Kings emerged champion recently.

I am a bit more interested on the development of the JMC Kings, who years ago was virtu ally a newcomer, I think around 2005.

Being a new squad, it was slowly making some waves in the Davao college basketball cir cuit.

Coach Flordelito “Dodong” Cagampang was one of the re liables of coach Ramon Joven Adriano of the Rizal Memorial Colleges (RMC) Bulldogs and for the Montana Pawnshop, a regu lar in the commercial leagues. The Montana squad was actu ally bannered by the Bulldogs, thanks to the good relations of coach Ramon and Montana Pawnshop owner Armando Qu ibod, who himself loves to play basketball and dine with the players over Lomi at a nearby restaurant after a game.

This is the advantage of teams having coaches who were natural point guards during their playing years. Coach Dodong has that advantage, be ing trained by coach Ramon to create plays for each game they played. I had the pleasure of seeing Dodong play for my her mano Ramon in the Mindanao Championships of the Philip pine National Games (PNG) in Butuan City. It was a lovely sight seeing them play against the best of Mindanao that year.

The rise of JMC Kings

And there is also the pres ence of one cool player-turned coach Nicanor “Nick” Serafica, who used to mentor the Mon tana Jewellers in the Philippine Basketball League (PBL).

Two point guards who are now coaches. As the saying goes, two heads are better than one.

But what is the most import ant factor in the success of the JMC Kings?

I bet you know the answer.

It’s the huge support of the JMC Management and the school’s founder, Pastor Apollo C. Quiboloy.

You see, Pastor Quiboloy plays the sport too and clearly understands the ins and outs of the sport.
