Comelec yet to bare list of candidates By Anthony S. Allada

HE Commission on Elections in the Davao region has yet to release to media the complete list of candidates who filed their certificate of candidacy in the May 13, 2013 midterm elections. Edge Davao requested for a copy of the list yesterday afternoon from the Comelec regional here but the request was denied by a staff in the absence of a formal written request. New Comelec regional director Wilfred Jay Balisado and legal counsel Danilo Cullo were
not around to clarify the matter. The staff said they were attending a meeting. Balisado only reported for work on October 3 although his transfer order was dated last September 20. He was supposed to swap positions with then Comelec 11 director Remlane Tambuang who was assigned to Region 12. A Comelec administrative order had directed all regional offices to forward the list of candidates to the central office in Manila for consolidation on or before yesterday.

OME officials in Mindanao dread a repeat of the war in 2008 that erupted following the botched signing of the controversial memorandum of agreement on ancestral domain (MOA-AD) between the Moro Islamic Liberation Front and the Government peace panels. However, many of them view the framework agreement on the Bangsamoro entity positively as it would lead soon to the signing of a formal peace deal between the government and the Moro Islamic Liberation Front. This developed following the passing of Provincial Ordinance 303-2012 regulating smoking in public places like schools both private and government owned, elevators, stairways, gasoline stations, public and private hospitals in the province. Smoking is also absolutely prohibited in medical, dental and optical clinics, health centers, nursing homes, laboratories, airports, bus and jeepney terminals,
restaurants, conference halls and food preparation areas where food and beverages are being prepared. Owners, proprietors, operators, possessors, managers and administrators of establishments within area of jurisdiction of Agusan del Norte province are obliged to determine size and specifications of the non-smoking and smoking areas in conformity with Presidential Decree 1096 of the National Building Code and the Philippine Society of Mechanical Engineers’ Code. Comelec orders ex-soldier Ex-guv De Pedro appointed to vacate barangay post South Cotabato administrator F B ARELy a year before the next Barangay elections come, the Commission on Elections (Comelec) has ordered a former soldier to vacate his post as chairman of a village here and relinquish it to the real winner who is also a former member of the Philippine Army. In a recent decision penned by the Second Division of the Comelec, it ordered Joven de Jucos to cease and desist from performing his duties as chairman of Barangay Lanao, one of the biggest villages in the city, to make way for Alberto Canonoy. Both Canonoy and de

Jucos were retired soldiers. Canonoy ran as chairman of Barangay Lanao in October 2010 against Arnulfo dela Cerna. Dela Cerna won over Canonoy by just four votes. Canonoy, not convinced by the results of the barangay elections, filed an election case, two years ago. But even before the Comelec could decide on the case, dela Cerna died in 2011 due to a lingering illness. However, Canonoy was prevented by assuming the post since his case was still unresolved. Instead, the Commission ordered the first baran-
gay councilor, de Jucos, to take the post after dela Cerna died. On October 9, former trial court Judge Francis Palmones, the lead lawyer of Canonoy, received a copy of the recent order of the Comelec about the election case filed by his client. “It was a divine intervention. I’ve waited for this for so long. But I still would follow due process,” said Canonoy. Canonoy has yet to receive a writ of execution from the court. For his part, de Jucos said he’s willing to relinquish his post ‘to the real winner.’ [PNA]
Senate committee okays ComVal state college bill
HE Senate committee on education and culture chaired by Sen. Edgardo J. Angara has approved House Bill No. 4586 proposing to establish the Compostela Valley State College (CVSC) during its meeting on October 9. The measure is principally authored by Rep. Maria Carmen S. Zamora. “This is a milestone for Comvaleños. I hope the bill will be considered by the Senate for plenary deliberations and approval the soonest time,” Rep. Zamora. The Compostela Valley solon, who is still in her 30’s, attended the Senate Committee hearing along with Bukidnon State University President Victor
Barroso, and congressional consultant and former Schools Division Superintendent Dr. Lilia Calicdan. With the committee’s approval, the measure is expected to eventually pass plenary approval on Second and Third Reading. Ms Zamora had been lobbying for the immediate passage of the bill creating the CVSC in view of the Commission on Higher Education’s rationalization scheme of amalgamating state universities and colleges (SUCs) by creating regional state university systems. This will ensure Compostela Valley’s equitable representation in an amalgamated set-up.
HB No. 5311 sponsored by Rep. Isidro Ungab of Davao City is proposing to create a Davao Regional State University System (DRSUS) by incorporating therein as constituent units the existing SUCs in the Davao Region. Arthur Pingoy Jr. appointed De Pedro after Isidro Janita resigned from the post to run as councilor in his Banga hometown. was won by former three-term governor Daisy Avance Fuentes. Prior to his appointment, De Pedro vowed to support Pingoy in the 2013 gubernatorial race. HE provincial government of Davao del Norte seeks to make the province free from malaria by 2020 with the help of the more than a million financial grant from the Pilipinas Shell Global Fund of the USAID for the campaign’s operations. “As of January 2012 we only had three cases of malaria but we still have to wait for the stratification of the Department of Health to determine the endemicity of the province,” Provincial Health Officer Dr. Agapito Ornido said. Endemicity or the intensity of the malaria disease is a way of measuring the prevalence of a disease like malaria in a particular location. He said more than 400 malaria cases were noted in the province in the past years but the
statistics went down after the intervention. Malaria cases in the province have decreased by more than 70% from 400 to only 106 cases in 2010 and to a mere 19 cases in 2011. “The province has been identified as one of the recipients of the Byaheng Kulambo Activity Program of the Global Fund because of its high malaria endemicity Pilipinas Shell Foundation, Inc. (PSFI) project officer Hazel Ann Siatan said. Up to eight areas in Davao del Norte have been identified as endemic. Siatan said three of them, the municipalities of Kapalong, Talaingod and Sto. Tomas are classified as stable areas where continuous cases of malaria have been monitored. She said the rest are classified as spo-
radic and unstable, or areas without regular malaria cases monitored. The more than a million fund granted by PSFI for the project is also being supported by the provincial government which has invested P100,000 for the program this year, Ornido said. Siatan said the funds given does not include the cost of the nets distributed to the people estimated at P1,200 per mosquito. She said up to 32 thousand nets with an estimated price of P38.4 million have been distributed in 2011. For this year, up to 8,000 mosquito nets with an estimated cost of P9.6 million have been earmarked for 2012. “We have already distributed 5,000 nets this year and only 3,000 nets

Website calls on people to become ‘bat detectives’ A
website is calling on citizen scientists to help researchers monitor and record Europe’s bat population. The Bat Detective website needs people to help identify bat calls to help develop automated identification tools. The site converts normally inaudible bat calls into something humans can hear and provides information needed to help visitors identify species. Scientists say understanding bat populations provides an important indicator of ecosystem health. “Bats use a lot of different types of sounds, from singing to each other to find a mate and to using echoes from their tweets to find their way around, “ explained Kate Jones, joint University College of London (UCL) and Zoological Society of London (ZSL) chairwoman of ecology and biology. “Usually, bat sounds are inaudible to humans as they are too high for us to hear but special ‘time expansion’ ultrasonic detectors convert these sounds to a lower frequency,” Prof Jones, who is also chairwoman of the UK Bat Conservation Trust, explained. “Visitors to the Bat De-
tective website can listen to these unique recordings and help us distinguish different sounds.” Lend an ear Conservationists say one-in-four species are threatened with extinction, adding that better automated identification devices were “desperately needed”. “We hope hundreds of thousands of people will help us listen in to what the bats are saying and to also build important tools
for conservation,” said Dr Chris Lintott from the University of Oxford, who led the team that designed and built the website. In a recent paper in the Journal of Applied Ecology, researchers published details about a freely available online tool used identify the calls of bat species found in Europe, helping to improve knowledge of the mammals. The raw data, collected by volunteers across Europe, allowed them to
develop the identification tool, iBatsID, which has been used identify 34 out of continent’s 45 known species. It is this raw data that visitors to the website will be able to access and help the Bat Detective team identify. Non-government organizations (NGOs) in Puerto Princesa City involved in the sustainable protection of the environment and care for the health of the people of Palawan strongly and vehemently opposed Monday the proposed 15-megawatt circulating fluidized bed coal-fired power plant by the David Mendoza Consunji, Inc. (DMCI) Power Corporation. In a public hearing MOnday, lawyer Grizelda Mayo-Anda of the Environment Legal Assistance Council (ELAC) said they are against the coal-fired power plant because “it is the dirtiest sources of power, and it contravenes existing environmental management and conservation programs and policies; there is no safe way to dispose off coal fly ash; and it will be situated in an ecologically sensitive area.” Anda said Panacan is very close to Rasa Island, a protected area because of its critically endangered Philippine cockatoo inhabitants; and the Victoria Anipaan Range, a mountain in the central of Palawan, which forms the largest ad-

Not here, not in a key biodiversity area. Copenhagen forum urges green free trade regulations An alliance of private sector companies for green growth, attending the second annual conference of the Global Green Growth Forum (3GF), on Tuesday called on national governments to liberalize trade in clean technologies by engaging with multilateral trade organizations. In an open letter advocating creation of global, green free trade regulations, the World Economic Forum’s Green Growth Action Alliance (G2A2), a grouping of leading companies, called for pragmatic solutions to challenges facing trade in green growth products. It warned that “the rising tide of green import tariffs, local content requirements and other non-tariff barriers demonstrates that more action is needed,” and urged all parties “to avoid escalating trade retaliation measures.” Released at the 3GF in Copenhagen, the open letter comes as the U.S. and the European Union launched anti-dumping

HE United States Agency for International Development (USAID) has partnered with Bank of the Philippine Islands (BPI) for an eight-year credit facility agreement with the Bank acting as the channel and implementor of the agency’s program. Through this partnership, BPI and USAID are reaching out to the Small and Medium Enterprises (SME) based in key provincial areas to make bank financing more accessible for more Filipino entrepreneurs. US Ambassador Harry Thomas Jr. commends the banks for their leadership in reaching out the SME sector which has traditionally lacked access to capital. He states, “Working together on this facility, we are sure to lift the entrepreneurial spirit of Filipinos. Growing demand propels
PHL bamboo industry W
ITH the growing demand for bamboo as an ecologically friendly alternative material to wood products, the Philippine bamboo industry is seen as an industry cluster with a huge potential in contributing to the country’s economic growth. “At present, there is a supply deficit (which) is about 2 million bamboo poles for furniture and 340,000 bamboo poles for handicrafts, with an estimated demand of 3.5 million poles for furniture and 575,000 poles for handicrafts,” Trade and Industry Undersecretary MerlyM. Cruz said in her speech during the recent Philippine Bamboo Congress. This supply deficit would require additional bamboo plantations of 150 thousand to 166 thousand hectares by 2015. Cruz also said that the local bamboo demand stood at Php 450 million per annum. By 2015, the world demand for bamboo is expected to grow to US$ 15 to US$ 20 billion. Farmers unhappy over GM corn? By Kerima Bulan T. Navales

EN years after the Philippine government allowed the introduction of genetically-engineered varieties of corn, the state of farmers who shifted to planting the varieties have gone from bad to worse. It’s because of the costly farm inputs needed to grow the varieties that are pushed by transnational agricultural companies like Monsanto. Fred Paris, a farmer from the province of North Cotabato in Mindanao, said farmers who opted to plant genetically-modified corn varies “only pushed us farmers to a cycle of heavy debt.” A study conducted by Masipag, a group of farmer groups advocating for organic and sustainable agriculture, and a think-tank Ibon Foundation, showed that farmers planting GM
corn are having difficult times because of expensive corn seeds and the costly chemicals needed in the production. “This resulted to loss of ownership rights to their lands, including food insecurity, threat to health and the environment,” said the study which was conducted in the provinces of Isabela, Pangasinan, Iloilo, Capiz, Bukidnon, South Cotabato and Sultan Kudarat. The study said farmers have had to endure the exorbitant interests imposed by loansharks to continue farming. Traders also usually charge farmers with five percent to 10 percent monthly interest for the loans. Farm inputs are also even higher when loaned, with prices marked up from P5 to P30 to as high as P100 to P1,500 on chemicals, seeds or other inputs.
Tagum hails agri-fishery assistance

AGUM City Mayor Rey T. Uy extended his gratitude to two government agencies based in Region XI for being staunch allies in his administration’s pursuit for development by officially turning over 2.4 million pesos that will be used to fund various programs and projects initiated by this city’s local government. Regional Director Fatma Idris of the Bureau of Fisheries and Aquatic Resources Office XI personally turned over the check amounting to 1.2 million pesos that will be used for the construction of a community-based multi-species hatchery geared towards the vision of increasing the yield of fisherfolks in
the coastal areas of the city. Idris bared her aim of making Tagum as the “Crab Country of the Philippines” through this landmark initiative of the City Government of Tagum. The Department of A g r i c u l t u re - Re g i o n a l Field Unit XI through its Regional Director Constancio Maghanoy, Jr. also turned over 1.2 million pesos on the same day. The Council of Women of the city will be given 500,000 pesos from the said amount which will be utilized for livelihood training program for its members on meat processing and virgin coconut oil production. Another 500,000 pesos will also be allocated for the Care for
School Chairs Program of Mayor Uy, which was promised by Agriculture Secretary Proceso J. Alcala in his visit to the city last May 14, 2012. In return, agriculture-related information materials such as vegetable and root crops will be painted in kiddie tables and shall be distributed to kindergarten schools in the city. The Tagum City Agriculture Office under its officer-in-charge Mr. George Grandea also received 200,000 pesos for the purchase of various planting mats such as black pepper, coffee, cacao and rubber, among others, according to Mr. Sonny Manigo of the City Planning and Development Office. Cajucom said that on the average, the expense for one hectare is between 25,000 to 30, 000 per cropping. The subsidy is open to farmers whose land area is seven hectares or less. Cajucom said that more than one-half of their fund had already been released, thus farmers had to shoulder the entire premium once there was no more fund for the subsidy.
The P150 million of DA, on the other hand, is tied up with Sikat Saka program and those that will go into third cropping, instead of the usual two croppings, he said. The Sikat Saka program is being implemented in partnership with the LandBank of the Philippines (LBP). It is a loan facility available to farmers with land area of not more than five hectares and not less than half-a-hectare. A loan package of P42, 000 per hectare for those who plant hybrid rice and P37, 000 for inbred is available to qualified farmers. [PNA]

HE Philippine Crop Insurance Corp. (PCIC) has allotted P333.771 million for subsidy to the crop insurance of farmers this year. The PCIC infused some P183.771 million while the Department of Agriculture (DA) shelled out P150 million for the insurance subsidy. “Our farmers are very vulnerable. Our aim now is to enroll more farmers in our crop insurance,” PCIC acting senior vice-president Norman R. Cajucom said. HE Department of Agriculture (DA) and the Department of Education (DepEd) will jointly explore ways to improve the delivery of agriculture and fishery courses in 126 agri-fishery technical vocational schools. This collaboration aims to further strengthen DepEd’s current offerings and provide students more options to earn a living when they graduate. In a previously signed memorandum of understanding between Education Secretary Br. Armin A. Luistro FSC and Agriculture Secretary Proceso Alcala, the two parties have agreed to co-share resources so that tech-voc schools can better serve students who choose agriculture and fishery as their preferred livelihood. Luistro said the MOU was aligned with the K to 12 Basic Education Pro-
gram in which one of the objectives was to develop the skills of students in technical and vocational education. “Dapat baguhin natin ang imahe ng agri-fishery schools. Dapat alam natin kung saan dadalhin ang ating curriculum, kung paano ito magiging attractive sa mga mag-aaral. Dapat nakatutok sa local development.” said Luistro. As agreed, the DA will extend technical assistance and know-how by providing resource persons in training tech-voc teachers in agriculture and fishery education. DA will likewise provide seedlings, fingerlings, fertilizer and other production inputs for the development of demonstration farms, nurseries and breeding stations. The agriculture department has also agreed to offer scholarship grants to deserving graduating high
school students as well as master’s degree programs for tech-voc teachers and officials on agriculture specific and fishery-oriented courses in University of the Philippines Los Baños, Mindanao State University and Central Luzon State University, among others. The MOU will be effective for two years and subject to renewal based on the positive outcome of the joint agreement. DepEd’s Strengthened Technical Vocational Education Program aims to equip high school graduates with TESDA-certifiable tech-voc skills that would allow them to venture into self-starting businesses. Sara brought Christmas goodies and entertainment to the highlanders to save them the trouble of having to trek down with their children—including infants and the aged--to the city’s poblacion and putting up with the Spartan accommodation and lack of basic amenities in congested gyms. LSO dubbed as “Double 10,” Oct. 10, 1977 was a day of infamy for the whole country when Brig. Gen. Teodulfo Bautista, the soft-spoken commanding general of the First Infantry “Tabak” Division of the Philippine Army, and 34 of his men were brutally massacred after they were lured into a peace dialogue by local Muslim rebel leader Usman Sali in Patikul, Sulu. Only one -- a radio man who played possum or pretending to be dead -- survived the mass killing. Thirty-five years have passed but this reporter can still vividly recall that day when the earthshaking news about the massacre reached Camp Aguinaldo, the headquarters of the Armed Forces of the Philippines in suburban Quezon City. The AFP’s rank and file could not believe that 35 soldiers, including a general and four Army colonels, were massacred in the Patikul public market just like that. Martial law was still in effect then and defense reporters could not just write stories like that without clearance from the defense or military hierarchy. But military authorities allowed defense reporters to write the story of the massacre, giving us all the information the media needed. Retired Brig. Gen. Arnulfo D. Bañez, then AFP deputy chief of staff for intelligence (J2) and deputy of the Intelligence Service of the AFP (ISAFP), now 88, could still remember the details of the gory massacre. In an interview with the Philippines News Agency on Tuesday, the eve of the 35th anniversary of the Patikul massacre, Bańez said Gen. Romeo C. Espino, then AFP chief of staff, was shocked upon receiving the news of the massacre. He said they were in Davao City for a regular inspection of troops when Espino was informed late in the afternoon of Oct. 10, 1977 about the massacre. “Gen. Espino’s immediate reaction was to rush to Jolo, Sulu that very moment but Col. Tony Lukban, the pilot of the F-27 Fokker plane of the Philippine Air Force, told the general that the Jolo airport has no landing lights and suggested they fly early the following morning,” Bańez said. Piecing together the massacre, Bañez, still witty and strong despite his age, said Sali, the rebel leader of the Moro National Liberation Front (MNLF) in Sulu, agreed to meet with Gen. Bautista originally at the headquarters of the Army’s First Infantry Division, for a peace dialogue together with 150 of Sali’s men. But a last-minute decision was made by Sali and proposed to Gen. Bautista that they instead meet at the Patikul public market. Bautista agreed without second thought of any security threat from Sali. It proved fatal. Bañez said that while Bautista and his group were on their way to Patikul, he saw Col. Pangilinan, the AFP adjutant general, his classmate who was conducting a seminar in Jolo. Bautista told Pangilinan to join him in Patikul for a peace dialogue with MNLF commander Usman Sali. In fact, Bautista earlier asked then Lt. Gen. Fidel V. Ramos, chief of the Philippine Constabulary and AFP vice chief of staff, who was in Jolo at that time, to join him but Ramos declined because he had a previous engagement in Zamboanga City. Bañez said that “when Bautista and his men arrived at the Patikul public market aboard two 6x6 trucks in the morning of Oct. 10, 1977, the place was empty.”

Confused and outright unfavorable reaction
OW THE AUTONOMy FOR MUSLIM MINDANAO STARTED – After a series of consultations and dialogues with the different sectors the past several months and bilateral meetings between the government and Moro Islamic Liberation Front (MILF) peace panels, a framework agreement has been reached mainly designed to address the problems of the people in Muslim Mindanao. Foremost in the outline is the renaming of the Autonomous Region in Muslim Mindanao (ARMM) to Bangsamoro land. Representatives of the government, MILF, some senior officials and lawmakers expressed high hopes for the new framework agreement to be fully implemented before the term of President Benigno Aquino III ends in 2016. Well, let’s move a bit backward to have a background on how the ARMM Organic Act started. On July 13, 1989 both leaders of the legislative branches signed the autonomy bill for Muslim Mindanao, originally House Bill 22929, which was reconciled with Senate Bill 902 at the conference committee of Congress. Then on August 1, the bill was signed into law by President Corazon C. Aquino and became Republic Act 6734. The autonomy act for Muslim Mindanao finally was presented in a plebiscite to 13 provinces and 9 cities on November 19 of the same year. Certain provisions of the Constitution declared that only those provinces and cities which vote for the Organic Act will become part of the autonomous region. The referendum was held in the provinces of Zamboanga del Norte,
Zamboanga del Sur, Tawi-tawi, Sulu, Sultan Kudarat, South Cotabato, Maguindanao, Palawan, Lanao del Sur, Lanao del Norte, Davao del Sur, Basilan and North Cotabato. And the cities included in the plebiscite are Zamboanga, Puerto Prinsesa, Pagadian, Marawi, Iligan, General Santos, Dipolog, Dapitan and Cotabato. Hopes are high at that time in Congress that the majority of the areas will approve the Organic Act. Once it is approved, elections for the regional governor, vice governor and three representatives for the regional assembly from each congressional district will be held not later than 90 days after the referendum. A month later an Oversight Committee from the national government will supervise the transfer of properties and personnel. The Act sets a maximum period of six years from the time the regional government is established for effecting complete transfer of all government agencies to the new regional government. In the rush to join the campaign for the autonomous region, Congress revised its legislative calendar to allow congressmen more time to inform their constituencies of the Organic Act. However, after its
passage in Congress on June 8, 1989 and was ratified in a plebiscite held November 19, only four provinces – Lanao del Sur, Maguindanao, Sulu and Tawi-Tawi – approved the Act. The Laban ng Demokratikong Pilipino (LDP), then the ruling political party favored the Act at the outset. Senior party leaders said the LDP was obliged to take stand on the issue. They believed the establishment of the autonomous region would have national ramifications; the act largely the handiwork of the LDP-dominated House of Representatives. Although the LDP had taken an early pro-Organic Act stance, the members of the House from the affected areas were inclined to take individual positions on the issue. Members of the House of Representatives crossed party positions to take stands that they felt reflected the sentiments of their constituencies. Initial reaction to the autonomous bill had ranged from confused to outright unfavorable in many areas. The final results in which only four provinces and not even one city approved the Organic Act have been given negative interpretations. Though in several occasions Congress leaders pointed out that the autonomous bill would serve to achieve greater autonomy for Muslim Mindanao and allow the region greater flexibility to address its interlocking problems in its own way. But it is rather unfortunate those 23 years after the ratification of the Organic Act for ARMM, the results proved otherwise. More on our subsequent column piece, folks!

Gaining popularity among tourists The only time Mendoza Jr. promoted the memorial museum was when it opened in the latter months of 2011. He does not know how it happened, but the place has now gained popularity among domestic and foreign tourists, who like to know about the war history of the places they visit. Of the many students who have come for study tours, 960 are from different schools in Puerto Princesa and other parts of Palawan. “Sadly, only a few know about who my father as our local hero. If you ask them, they do not know that the Japanese came to conquer the province. This memorial museum serves as their gateway to their own place’s history,” he said. Out of the many nations in the world, the museum has now been visited by at least 47 nations, and Mendoza Jr. keeps all flags of the world in a special section of the museum and displays them whenever a foreign national visits.

CCORDING to the Court, not only its specific provisions but the very concept underlying them, namely, the associative relationship envisioned between the GRP and the BJE, are unconstitutional, for the concept presupposes that the associated entity is a state and implies that the same is on its way to independence. On the other hand, the Framework Agreement does not call for a new identity like the BJE which must be created outside the flexibilities of the present constitution. As understood in the new Agreement however, the State continues to exercise sovereign powers, without prejudice to inclusion of other powers which may in the future be agreed upon by the parties, including defense and external security; foreign policy; common market and global trade, and the like. These very same powers are also granted to the state by the ARMM Organic Law. Again, much like the ARMM under R.A. 9054, Bangsamoro shall also be granted judicial powers, revenue generation and a just and equitable share in the fruits of national patrimony. All transitional processes will be undertaken within the Constitution and pertinent laws of the Philippines. All told, the Bangsamoro is not a separate political entity but its territory shall remain part of the Philippines and its inhabitants part of the Filipino nation. The powers granted to it are inclusive within the concept of autonomy, nothing more. Clearly, this is a radical departure from the MOA-AD which contemplates a BJE that is a sub-state thus implying a move towards independence. For obvious reasons, the State cannot allow the violation of the national integrity provisions of the Constitution which the establishment of the BJE will precisely do. As clarified by Leonen, the commitments made by the government are within the parameters of the Constitution, or within the flexibilities of the existing Constitution. He added that while part of the powers of the 15-member Transition Commission will be “to work on proposals to amend the Philippine Constitution for the purpose of accommodating and entrenching in the Constitution the agreements of the parties whenever necessary without derogating from any prior peace agreement, there is no commitment there that such a proposal is going to be acted upon by Congress. As envisioned, the Bangsamoro will not infringe the Constitution since it will merely replace the Autonomous Region in Muslim Mindanao (ARMM) whose creation was mandated by the Constitution itself and by its Organic Act Republic Act 9054. Even the ministerial form of government, which to many may be a not-so familiar concept, does not necessarily call for a constitutional amendment since in reference to Bangsamoro, it merely relates to the provisions of autonomy which is still within the constitutional framework. Again as explained by Leonen, it is akin to a parliamentary government where genuine political parties will “dominate and try to capture seats that are allocated maybe to various geographical areas or probably the presenting certain sectors” and from which they select their chief minister, but stressed that they would still be under the supervision of the President. Clearly, the Bangsamoro is not the BJE. Both the GPH and the MILF would have been extremely conscious of the MOA-AD fiasco and averse running the risk of engaging in extensive negotiations only to come up with an agreement that will fail to pass judicial scrutiny because it violates the Constitution. But they have not given up dreaming--and they both got their wish. Brian, who has been diagnosed with acute myelogenous leukemia last year, piloted a simulated Philippine Airlanes flight from Manila to Singapore on Oct. 3. He was accompanied by PAL Captain Jojo Nomorosa using the brand new A320 simulator, which also has his parents onboard. The simulation “allowed Brian to experience all the phases of a flight, including occasional air turbulence,” PAL said in its website. “With his eagerness to learn, Brian had no qualms asking about the complex control panels, flight procedures and the simulator’s virtual display,” PAL added. E L LINGTON, New Zealand -Australia granted Mike Tyson a visa Wednesday, one week after New Zealand barred the former heavyweight boxing champion from entering that country due to his 1992 rape conviction. Officials carefully weighed the pros and cons of his visit and of his character given his criminal past before making the decision, said Cian Manton, a spokeswoman for Australia’s Department of Immigration and Citizenship. She said it was the first time Tyson had applied for a visa to Australia and he was warned the privilege could be revoked if he broke any laws.
‘’Given the purpose of his visit and the short duration, we considered the risk of him reoffending to be very low,’’ Manton said. The entertainment visa he was granted covers the duration of Tyson’s fivecity Australian tour starting next month. One day, three meals, all with great company WhENEVER I fly to Manila, I try to meet up with friends and oftentimes the best way to catch up on life is to just sit down at a restaurant or cafe, order great food, and chatter the day away. Breakfast at Cafe Mary Grace I started the day at the Serendra area where I met up with college friends Mike and Xochi. We decided to visit Cafe Mary Grace and have some of their famous ensaymadas along with some hot chocolate. Mary Grace’s homemade ensaymadas are soft and moist, and the sweet and salty taste (thanks to the generous amounts of shaved edam cheese) makes it deliciously over the top. Of course there are other things to eat such as Filipino-style breakfast sets and pasta, but nothing beats the rich and energy filled ensaymada to start the day. Lunch at Italianni’s I decided to meet up with Budi and Christianne
for lunch. having transferred to Manila because of their jobs, it was a reunion of Dabawenyos who love their food and in big servings at that, so we decided to have lunch at Italianni’s at Bonifacio high Street. We decided to not scrimp with the calories and go straight for the good stuff. We started with Italianni’s rustic pizza and followed it up with my favorite Fettucine with truffle and prosciutto.
Every bite of the pasta cooked al dente was like a bite of heaven with a rich creamy finish thanks to the truffle and rich creamy sauce. and yes, prosciutto is love. Dinner at Cafe Breton
after the very filling lunch, I had to leave for the Podium to meet up with Mark. Deciding to skip entrees, we went directly to Cafe Breton that brings me back ten years to college and going to Cafe Breton’s first store at Malate. although the original store is already closed, Cafe Breton not has stores at the Podium and Greenbelt. The mean reason why we decided to skip dinner and go directly to dessert is that Cafe Breton still has some of the best crepes in Metro Manila and shame on us to not leave space for something so delicious. Mark choose the adam and Eve Crepe which is filled with apple slices and cinnamon topped with vanilla ice cream while I had a hazelnut cream filled crepe to satisfy my Nutella craving. So after three filling meals and enough talk to fill pages and pages of my diary, I call it a day and rest my happy stomach.

James tweeted she was “thrilled” that Marcel, who wrote the script for saving Mr. banks last year and cocreated terra Nova, would be bringing her book to the silver screen. “kelly’s work demonstrates her flawless structural technique and passionate commitment to emotion, humor and depth of character which is particularly visible in the celebrated screenplay for the upcoming saving Mr. banks,” said Michael De Luca, who will be producing Fifty shades of Grey along with Dana brunetti. (saving Mr. banks, starring tom Hanks, emma thompson and Colin Farrell, tells the tale of Walt Disney’s 20-year pursuit to the film rights for P.L. travers’ novel Mary Poppins and the tumultuous relationship between the two of them.) Appearing on the today show, the pro-wrestling legend and erstwhile Hogan knows best star talked about the sex tape that has been the source of much mortification to him and his family since it was leaked to the Web last week. “First off, I had no idea there was a camera in the room. It was at a very, very low point. I’m not making excuses. I’m accountable. I was the guy. I was there. I made the choice,” the 59year-old Hogan told cohosts kathie Lee Gifford and Hoda kotb when they asked about “the elephant in the room.” but the WWe icon, who was appearing on today to plug his new venture as general manager of tNA Impact Wrestling, was quick to point out that the secretly recorded sexual relations came when his 25-year old union to his first wife, Linda Hogan, had already imploded. “It was at a really low point in my life when I was in a previous marriage when things were bottomed out completely,” said Hogan. “I was with
some friends and I made a wrong choice. And now, all of a sudden, it surfaces over six years later, and it’s just appalling. ELEK, Turkey -- The anticipated matchup between Rory McIlroy and Tiger Woods on Wednesday may not count for much after both lost their opening matches at the eight-player World Golf Finals. McIlroy lost to Matt Kuchar by six shots and Woods fell to Charl Schwartzel by one shot on Tuesday in the $5.2 million event at the Sultan course in Antalya. In the other group of the medal match-play format, Lee Westwood beat Webb Simpson by one shot and Justin Rose defeated Hunter Mahan by four strokes. McIlroy and Woods - ranked No. 1 and No. 2 - face each other Wednesday in the last of their three group matches, but both could already be eliminated by then. IAMI (AP) -- Twotime NBA champion Dwyane Wade is signing with Chinese sportswear provider LiNing, which is giving the Miami Heat guard his own brand within the company along with plenty of creative and strategic input. The partnership will be announced Wednesday in Beijing, where Li-Ning is headquartered and where the Heat are visiting for the NBA China Games tour. Wade told The Associated Press that he expects the Li-Ning deal to continue through at least the remainder of his playing career. Wade wore Converse for his first six seasons, then Jordan Brand for the past three years. ‘’It was a great nine years, but for me, it was just time to move on,’’ Wade told the AP. ‘’I have certain goals that I want to reach and I felt that I had to leave to reach those. So I’m doing things a little differently. That’s how I am, in a sense. I’m not necessarily a status-quo type guy.’’ Wade’s debut in LiNing sneakers is expected Thursday, when the Heat play a preseason game in Beijing against the Los Angeles Clippers. ALL of Fame boxing trainer Ignacio “Nacho” Beristain hopes Mexican champion Juan Manuel Marquez will be able to send his great rival, Filipino ring icon Manny “Pacman” Pacquiao, to the canvas at least once in their fourth bout . After their first three fights all ended in controversy, Pacquiao and Marquez will meet yet again on December 8 at the MGM Grand Garden Arena in Las Vegas, with both boxers gunning for a decisive finish. Scene, Beristain said he is hoping that for this fight , Marquez will be able to knock down Pacquiao. “We want to gain a little more speed,” he said. “In the third fight , we were able to keep up with him, and we want to use that approach again to see if we can put him down on the canvas at least once.” Marquez has never knocked down Pacquiao through their 36 rounds of boxing. Meanwhile, the “Pacman” was able to knock down Marquez three times in the first round of their first fight , though the Mexican rallied to
force a draw. Pacquiao knocked down Marquez again in their 2008 rematch, which he won via split decision. There were no knockdowns in the trilogy bout , which Pacquiao won once again, this time by majority decision. Beristain acknowledged that it will be difficult for Marquez to send Pacquiao to the canvas. “I would like to believe, and hope to God, that we put him down once or twice,” he said. “But it is a bit difficult because the Filipino is also a warrior and a very tough fighter.”
But Beristain knows that the only way to guarantee a victory for Marquez is for the Mexican to get a knockout . “Last time, we thought we had the fight in the bag, but look at what happened,” he pointed out . “you can never tell what the judges are thinking.” On the other side of the fence, Pacquiao’s trainer Freddie Roach is also hoping that his fighter can finish off Marquez. Roach has said that he does not believe they can win by decision this time, stressing a need for a knockout .

The PBA Legends games, to be played in the cities of Dammam, Jeddah and Riyadh, will be in connection with the the annual celebration of the Hajj season on Oct. 24-29 in Saudi Arabia. Hajj is the pilgrimage to Mecca and is one of the greatest religious observances in Islam.
