EO on Bangsamoro TransCom now with Executive Secretary

T

he executive order creating the15-member Transition Commission (TransCom) for the Bangsamoro poltical entity is now with the office of the executive Secretary (oeS) and should be out soon, Secretary Teresita Quintos-Deles, Presidential adviser on the Peace Process, said. Deles on october 19 told Mindanews the eo would be out “in two to three weeks in light of the Undas holiday.” on november 10, she said the oeS is “proposing some reformulations – so we need a little more time to process.” Malacanang wants to “ensure there are no legal infirmities.” While the oeS is working on the “reformulations,” the peace panels of the government (gPh) and the Moro islamic Liberation Front (MiLF) resumed talks in Kuala Lumpur this week to finish the Framework agreement on the Bangsamoro’s (FaB) an-

nexes on power-sharing, wealth-sharing and normalization. The panels’ technical working groups are focusing on the annexes. Both sides hope to finish the annexes by December. 300 MW Aboitiz coal plant construction in full swing T he construction of the P25-billion, 300-MegaWatt (MW) coal-fired power plant owned by aboitiz Power Corporation located at the boundary of Davao City and Davao del Sur is in full swing and is expected to start operating by 2015. “The plant will be able to meet a substantial part of the power requirements of Mindanao which is expected to have a shortfall of 484 MW by 2014,” aboitiz Power Mindanao affairs First Vice President Manuel orig said. aboitiz had the chance to convince students and environmentalists to see the benefits of the coalfired power plant during a forum held at the Finster auditorium of the ateneo de Davao University last Friday, november 9. orig assured the people that the coal-fired power plant makes use of modern technology and is capable of meeting en-

vironmental standards. he said the plant is in full swing and while there are minor problems, these are manageable and won’t delay the opening of the pla nt. The biggest economic problem facing Mindanao today, he said, is the lack of power to fuel economic growth. The projected power shortfall by 2014, he added, is equivalent to the power usage of various cities including general Santos, Davao, Cagayan de oro, Zamboanga and Butuan. “The only viable option available is the putting up of a generating facility that can provide adequate and reliable power supply at competitive rates and with the least adverse effect to the environment,” he said. he said aboitiz has considered renewable fuels but “it would be extremely difficult to find and attain the scale of renewable fuels capable of meeting the shortfall.”

it is important to reduce Mindanao’s dependence on hydro power, he said, although the cost of other sources like biomass, solar and wind are higher than hydro. aboitiz is counting on the high environmental standards practiced by the Steag coal-fired power plant in Misamis oriental ever since it started operating in 2006. he said Steag’s actual emissions are lower than the Philippine Clean air act, Denr and even World Bank standards. “This coal-fired power plant is the best available and most practical solution to Mindanao’s biggest problem,” he said. aside from being capable of producing adequate and reliable power, he said, the plant can also produce power at competitive rates. he said Davao City is also proximate to Kalimantan, indonesia where the coal will be sourced. DPWH 11 to finish paving Globe, PLDT interconnect all road networks by 2015 landlines in GenSan, SCot By Anthony S. Allada

T

he Department of Public Works and highways 11 aims to finish the concreting and asphalting of all primary arterial and secondary roads by the end of 2015. DPWh 11 regional director Mariano alquiza said this goal is based on the time table set by the DPWh central office while the agency is even now evaluating its application to international organization Standardization (iSo) 9001-2008 certification.

alquiza said that as of october this year, the region’s primary arterial roads were already 84 percent paved while only 16% are still unpaved while 53% of secondary roads are paved and 47% have yet to be paved. “The 132-km Digos-Malita road under the Davao del Sur 2nd District engineering office remains to be the only primary arterial road still unpaved and this is our biggest project to complete by the end of 2015,” he said.

There are still 382 kilometers of secondary roads, including 137 kilometers in Compostela Valley, to be paved out of the region’s over-all 1,649-kilometer road network. “Most of our road networks are concrete while some are asphalted,” alquiza said. he said to fast-track the completion of the projects he has to make the rounds of all eight district engineering offices and conduct regular staff meetings to address problems that may crop up.

Comelec convenes election board

T

he Commission on elections (Comelec) in general Santos City is set to convene the election registration board to assess and validate the applications for registration of new voters from the city’s 26 barangays. Lawyer Jose Villanueva, city election officer, said the assessment and validation is part of the processes set by the Comelec to ensure that the registered voters within a locality are legitimate and to prevent possible irregularities in the May 2013 midterm national and local elections. The registration board, which has set an initial hearing on nov. 19, comprises the Department of education’s city division, Local Civil registrar and the city Comelec as chair, he said. “We will check all these applications one by one and decide whether

to approve them or not,” Villanueva said. he said the assessment and validation will cover all applications filed during the last quarter of the regular registration period, which ended last oct. 31. The election registration board is mandated “to act on all applications for registration” as provided for under republic act (ra) 8189 or the Voter’s registration act of 1996. it said the board, by majority vote, shall approve or disapprove the applications and eventually publish them. Villanueva said their mandate includes addressing questions or complaints regarding the validity of the applications for registration, specifically those involving the non-compliance of the six months minimum residency requirement. ARMM creates council against trafficking

he newly-created arMM Council against Trafficking (aCaT) has enough powers to apprehend and prosecute those involved in illegal recruitment and other forms of trafficking, said a top executive from the autonomous region in Muslim Mindanao The aCaT was organized after a series of workshops and consultations with several stakeholders in the arMM, according to executive Secretary anwar Malang. The council was launched last Thursday in Tawi-Tawi, reports said. The island of Tawi-Tawi, Malang noted, has become the “gateway” of many Filipinos, most of them from the arMM, to Sabah, Malaysia. “it’s so easy to (bring

in) people from arMM to Sabah, Malaysia using the island of Tawi-Tawi as gateway. no need for documentation, for passports… at a cheaper price. in just seven hours, you would reach Sabah, just like that,” said Malang. he enthused that with aCaT, the office of the regional governor (org) and the attached agencies would become more proactive in the campaign against trafficking. at least P2 million from the Special Purpose Funds of arMM gov. paign against trafficking. “Based on the data, many of the trafficked persons come from the arMM. also, the illegal recruiters used as exit or backdoors some of the islands in the region, so it’s so easy for them to ferry their recruits to other countries in asia,” noted Malang. aCaT, he stressed, is under the office of the regional governor where it can command all agencies in the org to work on the rehabilitation and integration of the trafficked persons back to their community and at the same time focus on the prosecution, using as basis republic act 9054 (the law expanding arMM’s organic act) and other laws. “Many of our kababayans are looking for greener pastures outside the arMM. While it’s true that we can’t stop them, we want them oriented of their rights and responsibilities…. We can strengthen that through education and information drive the government would launch, through aCaT, in the coming days,” said the arMM executive secretary. Last week, 73 traf-

ficked women, some of them minors, were rescued during a highway check in agusan del Sur, reports said. They were onboard four Town ace vehicles from Cotabato City. FTer a month of preventive maintenance, the coal-fired power plants owned by the STeag State Power, inc. (SPi) are now fully operational, improving Mindanao’s power situation that has been racked by rotating brownouts. in a statement, Jerome Soldevilla, head of the communications department of STeag, said the two coal plants situated in Villanueva, Misamis oriental each with a capacity of 105 megawatts are now back online. The first unit shut its power from october 6 until november 4 this year, while the second from october 29 until nov 10. Soldevilla said that STeag’s Unit 2 located in Villanueva town was officially synchronized to the Mindanao grid at 8:58 a.m. today. around 10 a.m. today, STeag officially declared that 200MW of power from its coal plants be-

came available to the grid. “The precarious power supply condition in Mindanao is expected to substantially improve with the full capacity operation of STeag’s power plants beginning today,” said Soldevilla. he stressed that the preventive maintenance, as planned and scheduled, will bring longterm benefits for Mindanao power consumers in terms of operational reliability. Data from STeag showed that their power plants sustained an availability rate of 93.3 percent and a low unplanned outage rate of less than one percent. Since november 2006, the plants had delivered more than 8.3 billion kilowatt hours (kWh) of electricity to Mindanao, which represented about 20 percent of the island’s generation mix, STeag records show. Cockatoo shows tool-making skills a

captive-bred goffin’s cockatoo has surprised researchers by spontaneously making and using “tools” to reach food. The species is not known to use tools in the wild. researchers in austria recorded the cockatoo named Figaro - repeatedly breaking off splinters from a wooden beam and using them to reach nuts on the other side of his wire enclosure. The team believe Figaro’s feat is the first recorded instance of tool-making among parrots. The study, published in the journal Current Biology, was carried out at an aviary near Vienna by scientists from the University of oxford; the University of Vienna and the Max-Planck-institute for ornithology in germany. “no-one has ever reported [a parrot] sculpturing a tool out of shapeless wood in order to use it later with great sophistication,” said Professor alex Kacelnik of oxford

University, an author of the study. While birds from the corvid family, such as new Caledonian crows, are known to make tools in the wild, this specialised ability is very rarely reported in other bird species. researchers were unexpectedly alerted to Figaro’s tool-using ability while he was playing with a pebble and accidentally dropped it out of reach on the other side of his wire mesh enclosure. after some unsuccessful attempts to reach his toy with his claw, Figaro used a stick from the aviary floor to try to fish for the object, levering it with his beak. The team then carried out a series of tests that involved placing nuts outside the cockatoo’s enclosure, and video-recorded the results. in the first test, Figaro tried unsuccessfully to reach the nut with a stick that was too short. he then made his own tool by biting large splinters from a wooden beam.

When they were the right size and shape to use as a “raking” tool, he would use them to successfully collect the nuts. The team repeated the exercise in 10 trials over three days. Figaro was successful each time in

making and using tools to retrieve the nut. The time that it took the cockatoo to manufacture suitable tools also improved over the course of the tests. “it’s almost as if he discovered a solution and

then managed to apply it,” Prof Kacelnik told BBC nature. But he added: “nobody yet understands in what sense tool-use requires a very high level of intelligence.” While Figaro is alone

among goffin’s cockatoos to have been recorded making and using tools, Prof Kacelnik says that his behaviour could display a “level of intelligence for solving a new problem” in the species.

Loren Legarda was the first to file Senate resolution no. 294 directing the Senate committees on foreign relation and environment and natural resources to investigate the incident. She was followed Sens. Miriam Defensor-Santiago and aquilino Pimentel iii who filed Sr nos. 295 and 296, respectively. The lawmakers called for a Senate probe after tanker MT glenn guardian, owned by Malaysian firm glenn Defense Marine asia, reportedly dumped 500 liters of domestic waste and 760 liters of bilge water (a combination of water, oil and grease) into Subic Bay. The liquid waste aboard MT glenn guardian was collected from american ships that participated in the recently concluded joint military exercises in the country under the provisions of the VFa. Pimentel noted the liquid waste was dumped into the sea adjoining the Subic Bay without the requisite permits from the Philippine Coast guard and the SBMa ecology Center. “in flagrant breach of the standards set by international marine pollution conventions, the test results

Legarda chided the Malaysian company for claiming coverage under the Visiting Forces agreement with the US to avoid investigation and possible criminal liability. ”This investigation, in aid of legislation, will be a necessary step for us to re-evaluate the implementation of our environmental laws and to ensure that implementation of treaties and agreements with other countries will continue to serve the paramount objective of protecting the national interest,” Legarda said. Legarda stressed the need to establish how the VFa Commission ensures the enforcement of the VFa provisions guaranteeing respect for Philippine laws in connection with the implementation of the agreement and its related activities.

Climate change threat T to Arabica coffee crop C

LiMaTe change could severely reduce the areas suitable for wild arabica coffee before the end of the century. That is the conclusion of work by a UK-ethiopian team published in the academic journal Plos one. it supports predictions that a changing climate could damage global production of coffee - the world’s second most traded commodity after oil. Wild arabica is important for the sustainability of the coffee industry because of its genetic diversity. arabica coffee and robusta coffee are the two main species used commercially, although the former provides about 70% of production. The arabica crops grown in the world’s coffee plantations are from very limited genetic stock and are thought to lack the flexibility to cope with climate change and other threats such as pests and diseases. The researchers from the royal Botanic gardens in Kew, UK, and the environment and Coffee Forest Forum (eCFF) in addis ababa, ethiopia, examined the future distribution of wild arabica using climate modeling. They looked at how wild arabica might be af-

fected under three different carbon emission scenarios and over three time intervals (2020, 2050 and 2080). When the researchers looked at what would happen in the locations where arabica was currently grown, the best-case outcome was a 65% reduction in suitable sites by 2080. The worst-case outcome was a 99.7% reduction by 2080. a different analytical approach yielded a 38% reduction as the most favourable outcome and a

90% reduction as the least favourable by 2080. Cause for concern aaron Davis, head of coffee research at the royal Botanic gardens, said: “The extinction of arabica coffee is a startling and worrying prospect. however, the objective of the study was not to provide scaremonger predictions for the demise of arabica in the wild. “The scale of the predictions is certainly cause for concern, but should be seen more as a baseline, from which we can more fully assess what actions

are required.” The researchers said the results should be regarded as “conservative”, because the modelling does not factor in the largescale deforestation that has occurred in the highland forests of ethiopia and South Sudan (the natural home of arabica coffee). Moreover, because of the lack of suitable data, the models assumed intact natural vegetation, whereas the highland forests of ethiopia and South Sudan are highly fragmented due to deforestation.

Maguindanao Massacre: Shutting the door on media

T

he Supreme Court has reversed its 2011 decision which allowed live media coverage of the Maguindanao Massacre trial. in a new twist, the high Court has shut the door on live media coverage of the high profile case. The decision stemmed from a motion for reconsideration filed by prime suspect andal ampatuan, Jr. who complained that the public trial violates his right to equal protection and presumption of innocence and subjects him to psychological punishment. The Court’s ruling was anchored on giving more weight to the rights of the accused over those of non-direct parties. The rights of direct parties, the accused primarily and the direct offended parties, bear more weight than the right of the public to know the progress of the case. Which leads us to the question: is the media not a direct party to this case where 34 out of the 58 massacred were journalists? Media interest in this case comes with the territory since more than half of the victims were their colleagues in an industry that is the very bulwark of democracy itself – freedom of speech and of the press. The trial is not just an indirect case, not a mere news coverage

The case in itself is a search for truth which, in the end, can either set some or all of the accused free--or otherwise. nothing more, nothing less, which is the court’s responsibility, not media’s. With the Court’s reversal of its earlier decision, the legal definition of non-direct parties strictly embraces the media organizations and, ultimately, the public which closely follow the case with anticipation. The genesis of this exclusionary rule is the constitutional principle of tilting balance in favor of the accused in the face of the competing interests between the freedom of the press and the right to public information on one hand and the rights of the accused on the other. Where the exclusion is clear, we cannot for now question the wisdom of the Court’s decision and can only hope that despite the door being shut on live media coverage, the definition of non-direct parties as inclusive of the offended institution is not strictly exclusionary but only illustrative. oLiCy and political circles are now both talking about the prospect of comprehensive federal tax reform next year. From Capitol hill to Wall Street to Main Street, people are asking how this reform will be structured. They should look to states across the country for their model. Many are due to embark on sweeping overhauls, even complete rewrites, of their tax codes in 2013. Lawmakers in numerous state capitals are now poised to introduce major tax reform when they come back into session early next year. as we’ve seen with other policy matters, reforms that percolate in the states often make their way to Washington. More than half of all state governments are controlled by one political party, so it’s likely that state lawmakers will move far more quickly than the folks on Capitol hill. What these state legislators do will provide a preview of and parallel the debate in the new Congress.

Consider north Carolina. republicans took control of the general assembly in 2010 for the first time since reconstruction, and next month the Tar heel State is likely to become the 26th state where republicans control the governor’s mansion and both chambers of the state legislature. The republican gubernatorial nominee, former Charlotte Mayor Pat McCrory, has said that tax reform will be a top priority if he is elected, which appears likely given his double-digit lead in the latest polls. The state now has one of the nation’s least competitive tax regimes. But based on proposals being discussed at the capitol, north Carolina lawmakers next year could enact one of the boldest and most progrowth state tax reforms in history. reducing and possibly eliminating the state personal and corporate income tax, both now the highest in the Southeast, is also a top priority for many in the legislature. in north Carolina’s final gubernatorial debate last week, McCrory reiterated his intention to provide personal and corporate income tax relief. Legislative leadership and McCrory have made clear that any tax reform would be revenue neutral. This is the same commitment that republican presidential nominee Mitt romney has made at the federal level. it’s an important marker to lay down, since it tells spending interests that tax reform will not be used as a Trojan horse for raising taxes.

Christmas is drawing very near and it is high time we start with our “halaya” (purple yam pudding). and like with so many delicacies made in Malabon, making “halaya” is a tedious and back-breaking process appreciated only by those who literally saw the dish prepared and cooked before their very eyes, in the toasting heat of a charcoal or wood fire. ingredients of this yuletide dish consist of “ube”, white sugar, cheddar cheese, margarine, eggs, coconut milk, and condensed milk. and depending on the income of the family who will cook this traditional pudding, they can cook as a little as one kilogram of the sweet (for those in a tight budget) and as much as a 20 kilograms (for those really well off ). old-time residents prepare “halaya” by peeling and boiling first their “ube” until it is soft like rice porridge. and when the “ube” is in that consistency, persons-in-charge of cooking this dish, will then cool it down before hauling to the “gilingan” (grinders) to

late Sunday, one day after Lakers officials met with Jackson to discuss the possibility of him becoming the franchise’s coach a third time. Jackson, league sources said, was seeking greater personnel control, a relaxed travel schedule and a two-year contract that would pay him at least $10 million a season. D’antoni, 61, signed a four-year contract with the Lakers, said his agent, Warren Legarie. he re-

Call it power of love. That unexplainable feeling that transforms a man’s speed from fast

to ultra-fast turbo mode propped the love-struck nerza like a restless warrior to win the 36th Milo national Marathon Davao Qualifying race on Sunday morning in another classic ‘Milo-dramatic’ storybook ending. nerza, the resurgent former champion, in his prime at 23, ran side by side with a hurting reigning champion Bryan Lupio through the race’s grinding 16 kilometers as the two rivals blasted away from the field in a pace so blistering that they finished even before half of the entire 14,000-strong sea of runners were even flagged off. realizing he can keep up with Lupio’s pace, nerza made his move with

five kilometres left in the race and surprisingly found no challenge from his archrival. With Lupio’s image getting smaller in his rear view mirror, nerza knew the race was his to take by the time he curled into the final straightaway at J.P. Laurel avenue. There was the huge chunk of the record field still waiting to be fired off when nerza emerged towards the final dash to the Milo arc. The awe-struck crowd broke in cheers as the 23-year old Physical education student of Brokenshire College strode to the finish all by himself in a fast time of one hour 12 minutes and 34 seconds— his best time so far in that distance. “Di pa nga kami nakaumpisa tapos na sya,” said one runner standing at the starting gate among the mammoth field of around 11,000 entered in the 5-Kilometer division alone, flagged off by organizers in batches to avoid a logjam. Maganda ang pakiramdam ko ngayon. inspirado,” the usually shy nerza told eDge Davao unabashedly after the race. after gulping down a cup of water and towelling his sweat-drenched body off, nerza walked back to the nearby winner’s tent at the start-finish gate and waited for his sweetheart avergonzado who was contending for the title in the women’s side. The 20-year old avergonzado checked in third in one hour and 37 minutes failing to join nerza in the Manila finals by a shade of 120 seconds. The lost seconds would not matter for avergonzado as the time difference faded in the comforting arms of the new men’s champion. “ok lang, basta panalo siya, masaya kami,” said avergonzado, a fourth year Business administration student also at Brokenshire. it was the third Milo race together for the couple and the first real crack for the two to advance to the finals together. While nerza’s brewing love story was the power pill behind his new-found energy, another story of passion took the back page of this year’s romance-ridden finish.
