AURIFIL USA INC | Minimum Advertised Pricing (MAP) Policy
Established in 2007, Aurifil USA has invested time and resources to proudly build a brand renowned for its impeccable quality. Aurifil USA, therefore, chooses to partner with distributors and retailers who share in its brand's philosophy by investing meaningfully in the promotion of Aurifil’s products and dedication to consumer product education.
To preserve the value of the Aurifil brand and to properly position Aurifil’s products in today's market, Aurifil USA inc. is instituting the following unilateral Minimum Advertised Price (MAP) Policy effective for all Aurifil distributors and retailers located in the United States ("Retailers,", “Resellers”, "Distributors" or "You”).
1. In a unilateral policy decision concerning the marketing of its products, Aurifil USA has determined that Aurifil branded products should not be advertised at a price less than Aurifil USA per Aurifil’s price list (available by email from administrator@aurifilusa.com). This Policy applies to all Aurifil-branded products, including those that have been customized for the Reseller.
2. The MAP policy applies to all forms of advertising in any and all media including, but not limited to Internet or similar electronic media, promotional videos, email solicitations and newsletters, forums, rebate coupons, flyers, posters, newspapers, mailers, inserts, catalogs, mail order catalogs, television, radio or any public signage.
3. Advertising the bundling or free or discounted products (whether made by Aurifil or another manufacturer) or gift card or other incentives that would reduce the advertised price with an Aurifil product covered by this MAP policy would violate this policy and is not permitted.
4. From time to time, Aurifil may authorize Retailers to advertise specific products at a price below the Designated MAP for a specified period of time. The aforementioned instances will be communicated in writing by the Aurifil MAP administrator.
5. No "Retailers,", “Resellers”, "Distributors", or "You" are permitted to sell to Amazon Vendor Central or on Amazon, Ebay, or Alibaba without prior approval from Aurifil USA inc.
6. A violation of this MAP Policy occurs if a Retailer's Advertised Price is below the Designated MAP for that Aurifil product. A violation of this MAP Policy also occurs if a Retailer sells or provides Aurifil’s products to a reseller or other third party whose Advertised Price is below the Designated MAP Price for that Aurifil product. Intentional or repeated failure to abide by this policy will result in termination of partnership, cancellation of all current orders for our products, or instruction passed to our distributor to indefinitely refuse additional orders for our products from that reseller. Only Aurifil USA can determine if a violation of this Policy has occurred. We will not discuss any conditions of acceptance related to this policy, as it is nonnegotiable and will not be altered for any reseller. Our sales personnel have no authority to modify or grant exceptions to this policy.
7. Distributors of Aurifil products must supply a copy of this policy to any new or existing Reseller.
8. Aurifil USA Inc may revise this MAP Policy or its price list at any time and in any respect. When and if it does, best efforts will be made to provide those revisions to You. However, Aurifil takes no responsibility for ensuring that You receive updates or revisions to the MAP policy and MAP prices.
9. This MAP Policy is effective 1 2022 and will remain in effect until further written notice from Aurifil’s MAP Administrator. Aurifil reserves the right to terminate or amend this Policy at its sole discretion at any time without prior notice. This MAP Policy supersedes all previous policies established by Aurifil USA on the same subjects.
