Etihad appeals German court ruling against airberlin codeshares Etihad Airways has appealed a German court‘s decision revoking the approval of 29 of its codeshare flights with airberlin. The notice of appeal was filed Jan. 4 in the higher administrative court in Germany‘s Lüneburg. The Abu Dhabi-based carrier said the German Ministry of Transport raised concerns on 29 of the codeshares last summer, based on lobbying by Lufthansa. As a result, in November it approved the 29 codeshares only through Jan. 15, 2016. Last week, the Administrative Court of Braunschweig ruled the German Ministry of Transport was entitled to reject the 29 Etihad-airberlin codeshares. The decision is effective from Jan. 16 through the end of the current IATA winter schedule ending March 30, 2016. Etihad president and CEO James Hogan said in a statement: ―With airberlin, we are working to ensure that no traveler suffers as a result of this dispute, and all bookings will be honored. We will fight all the way to protect our investment, to protect our partnership with airberlin, and to protect competitive choice in German air travel.‖ He said Etihad‘s commitment to airberlin was in stark contrast to the lack of support demonstrated by the German Ministry of Transport for a ―proud German airline.‖ In 2011, Etihad Airways took a 29.2% stake in airberlin, following encouragement from German regional and national Government representatives. The airlines had approval for codeshare services on a total of 63 air routes. The remaining codeshares remain unaffected. Etihad said codeshare services to international destinations that have operated for years without any concerns were being raised as procompetitive. ―That was entirely correct, given that they meet the terms of the air services agreement between Germany and the UAE—a fact confirmed not just by our own legal team and expert advisors but by a former Director General of Civil Aviation for Germany,‖ Hogan said. Airberlin CEO Stefan Pichler said in a separate statement: ―We are appealing against this decision because it does not serve the best interests of the traveling public. Indeed, the main beneficiary of the decision is Lufthansa. Airberlin is Lufthansa‘s sole competitor in the German domestic market. We keep the competition honest, strong and effective, as otherwise Lufthansa would have a monopoly which would be disastrous for German consumers.‖

Hogan said that after four years of investing in Germany, supporting airberlin jobs and creating own new employment in Germany, ―We find the rules have changed. As a global business, we focus our investments in markets which will deliver long-term returns. We were encouraged to invest in airberlin.‖ However, Hogan added that since that initial investment, the carriers have faced a series of significant challenges, including the introduction of airport taxes, which have directly eroded airberlin‘s profitability. ―In other markets, such as Australia, India, Italy, Serbia and the Seychelles, our investments have been welcomed and supported. Yet in Germany, our commitment continues to be undermined by the lobbying efforts and protectionist tactics of Lufthansa,‖ Hogan said. ―Unless the German government can show its commitment to support all German companies and German jobs, its reputation as a safe country in which to invest is at stake. Investors need every reassurance that the integrity of their investments in Germany will be respected and protected,‖ Hogan said. He added that Etihad is but one investor in one industry. ―But our experience will serve as a warning to others when it comes to making international investment decisions: Make no mistake. Protectionism will undoubtedly harm the investment landscape in Germany.‖

http://atwonline.com/ Chinese lessor to buy two more A320-200s China Aircraft Leasing Group (CALC) has agreed to buy two Airbus A320-200ceos, bringing its order book to 142 A320 series aircraft. According to CALC, the deal is worth ―no more than $194 million.‖ Deliveries are estimated to be in November 2016. CALC chairman and CEO Chen Shuang said, ―The acquisition of additional aircraft supports CALC‘s growth strategy and fleet expansion plan. It also reflects our close relationship with Airbus and the Group‘s ability to source new aircraft to match customer demand under dynamic market conditions. We are seeing strong demand for our aircraft in 2016, and the near term deliveries perfectly match with such demand. The Group will continue to capitalize on the favorable conditions of the aircraft leasing market through proactive enhancement and management of our aircraft portfolio, to bring sustainable growth to our business, while providing our airline customers with capital management efficiency and operating flexibility.‖ The Hong Kong-based lessor said its portfolio comprises 63 current generation Airbus and Boeing aircraft with an average age of less than four years. ―With the newly signed purchase agreement, CALC‘s fleet is expected to expand to 170 aircraft by 2022,‖ it said in a statement. ―The Group is speeding up its international expansion plans and has strengthened its cooperation with fast-growing carriers from the expanding emerging markets in order to diversify its portfolio. CALC targets to build a balanced portfolio of Chinese and nonChinese airlines clients by 2020.‖

Air France unions to strike in January

Air France has confirmed it has been informed of strike action by the CGT trade union on Thursday, Jan. 28, 2016 and by Alter, a minor pilots‘ union, from Jan. 10-13. According to several media reports, CGT is protesting job cuts as well as the legal action taken against five employees involved in an Oct. 5, 2015, attack on Air France officials after the airline presented its restructuring plan. The Alter pilots‘ union, representing about 10% of Air France pilots, has called for the strike actions to protest disciplinary procedures involving two of its members, which were suspended in October after helping demonstrators enter the company‘s headquarters near the Charles de Gaulle airport in connection with the October layoff announcement. ―At this stage, there is no impact on Air France‘s flight program. It is too early to have an exact idea of the consequences of this strike action, should it be confirmed. Air France will, of course, inform its customers if the situation changes,‖ the carrier told ATW. Last October, ATW reported the Air France-KLM Group estimated the two-week Air France pilot strike in September could cost the group €500 million ($634 million).

http://atwonline.com/ ANA: A380 deal not decided

Japanese carrier All Nippon Airways (ANA) has denied reports that parent company ANA Holdings has completed a deal to acquire three Airbus A380s that were repossessed from lowcost carrier Skymark Airlines. Tokyo-based Skymark filed for bankruptcy early in 2015 and defaulted on payments for an order for six A380s. In August, Skymark‘s creditors approved a rehabilitation planthat saw ANA take a 16.5% stake in the company. Over the Christmas holidays, reports surfaced in the Nikkei, Bloomberg and Reuters that Airbus had done a deal to sell three of those A380s to ANA. However, an ANA spokesman told ATW that nothing was decided. ―The story is not based on our official announcement and there is nothing decided yet. We are currently formulating the next mid-term corporate strategy and considering various options for airplanes as we have done so in the past,‖ he said. The spokesman added that ANA plans to issue its mediumterm corporate strategy on Jan. 29. ANA has an all-Boeing widebody fleet. The carrier was the launch customer for the 787 Dreamliner and is a 777X customer. The Star Alliance carrier does operate Airbus A320s and is a customer for the re-engined A320neo.

ETIHAD AIRWAYS LAUNCHES LEGAL APPEAL TO PROTECT AIRBERLIN INVESTMENT AND ENSURE CONSUMER CHOICE Etihad Airways today launched fresh legal action in a bid to overturn a German court‘s decision to revoke the approval for 29 of its codeshare flights with airberlin. Last week, the Administrative Court of Braunschweig decided that the German Ministry of Transport was entitled to reject the 29 Etihad Airways - airberlin codeshares, which had been approved only until 15 January 2016. As the notice of appeal was filed in the higher administrative court in Lüneburg today, Etihad Airways President and Chief Executive Officer, James Hogan, reiterated the airline‘s unwavering support for airberlin, saying it remained committed to the German carrier, to competition and to consumer choice for German travellers. ―With airberlin, we are working to ensure that no traveller suffers as a result of this dispute, and all bookings will be honoured. ―We will fight all the way to protect our investment, to protect our partnership with airberlin and to protect competitive choice in German air travel.‖ Mr Hogan said Etihad Airways‘ commitment to airberlin was in stark contrast to the lack of support demonstrated by the German Ministry of Transport for a proud German airline. Etihad Airways took a 29.2 per cent stake in airberlin in 2011, following encouragement from German regional and national Government representatives. The airlines had approval for codeshare services on a total of 63 air routes, providing German travellers with new choices to destinations around the world. In the summer of 2014, the German Ministry of Transport raised concerns about 29 of the codeshares, based on lobbying by Lufthansa, and in November 2015 only approved the 29 codeshares until 15 January 2016. The remaining codeshares remain unaffected. Mr Hogan said: ―Together, airberlin and Etihad Airways have created new competitive choice for German travellers, based on codeshare services to international destinations that have operated for years without any concerns being raised as they are pro-competitive and increase consumer choice. That was entirely correct, given that they meet the terms of the air services agreement between Germany and the UAE – a fact confirmed not just by our own legal team and expert advisors but by a former Director-General of Civil Aviation for Germany. ―Now, after four years of investing in Germany, supporting airberlin jobs as well as creating our own new employment in Germany, we find the rules have changed. ―As a global business, we focus our investments in markets which will deliver long-term returns. We were encouraged to invest in airberlin. Investors need every reassurance that the integrity of their investments in Germany will be respected and protected. ―Etihad Airways is but one investor in one industry. http://www.atn.aero/ In 2015 AEA member airlines achieve highest rate of growth since 2011 According to first estimates of our research team, AEA member airlines in 2015 achieved the highest rate of growth in passenger traffic since 2011, carrying more passengers with passenger load factors once again at record high levels. AEA member airlines welcomed close to 307 million passengers on scheduled services in 2015, an increase of 12.6 million over 2014, representing a growth of +4.3%. Cargo volumes remained a significant challenge, with zero to negative growth expected for full year 2015. On services within Europe and on domestic services AEA member airlines carried an additional 10.1 million passengers, an increase of +4.5%. With RPK at +4.6% outstripping capacity there will be a further improvement in the passenger load factor which is expected to end the year at 77%, up from 76.5% in 2014. Long haul services registered a marginal improvement in passenger load factor, now estimated at 83.7% for full year 2015. This was achieved on a +3.3% increase in passenger numbers and a +4.5% growth in RPK. Despite some signs of recovery in air cargo in recent years, 2015 is likely to bring a further set-back, with a result in freight tonne-kms close to zero or even negative for the year just concluded. This result is driven by weak all-cargo traffic growth whereas cargo carried in belly-hold on passenger aircraft is more buoyant. Cargo development is closely linked to the strength of the economy, which has yet to reach full potential. ―EU must now provide a policy for sustainable growth‖ ―AEA member airlines have been able to achieve these positive results by serious restructuring and the introduction of new commercial strategies‖, says AEA‘s CEO Athar Husain Khan. ―Unfortunately, the current regulatory framework in Europe did not help them. European airlines are still in need of a European policy that allows them to achieve sustainable growth in the future.‖ AEA therefore welcomes the long-awaited Aviation Strategy announcement of the EU Commission which is the result of a year's work by the Commission. However, the strategy lacks ambition and does not propose adequate measures to bolster the competitiveness of air European operators. Athar Husain Khan: ―There is an urgent need for the Commission to now propose more specific and far-reaching remedies. This is the top priority on our agenda in 2016. AEA will continue to liaise with the EU Commission and EU decision makers to request immediate actions. ‖Ineffective regulations, airport capacity, air traffic control and cost / tax burdens imposed on our airlines must be resolved. ‖

Emirates marks key milestones in 2015, its 30th year of operations Emirates concluded another year of growth underscored by standout milestones across its fleet, network, and customer experience initiatives. Since January 2015, the airline has carried over 51.3 million passengers, which represented 9% more passengers during the same period in 2014. Emirates operated around 3,600 flights on average per week, or over 186,000 flights in 2015, travelling more than 824 million kilometres around the globe, which is the distance equivalent of more than 1,000 trips to the moon and back. The airline served over 57 million meals on its flights departing Dubai*, and handled over 35 million pieces of baggage in Dubai alone. Strategic fleet investment Emirates added 26 new aircraft to its fleet in 2015, comprising 15 A380s, 10 Boeing 777-300ERs and 1 Boeing 777 Freighter, rounding off the year with 246 aircraft in service. With the addition of new aircraft in 2015 and 26 more aircraft slated to retire in 2016, Emirates is committed to flying a younger, modern and environmentally friendly fleet that provides customers with a superior level of comfort and safety. The airline marked its 150th Emirates 777 delivery milestone, as part of a triple delivery of two Boeing 777-300ERs and one Boeing 777 Freighter in one day in September. An Airbus A380 was also part of that delivery. At the Dubai Airshow in November, Emirates introduced the world‘s first two class configured A380 with the capacity to carry 615 passengers. The aircraft drew in over 18,000 visitors in five days, and currently serves passengers flying to Copenhagen and Bangkok. Connecting the world to, and through Dubai The airline expanded its network to 150 destinations in 2015, with the addition of six new passenger destinations: Bali, Multan, Orlando, Mashhad, Bologna and Sabiha Gokcen in Istanbul; and three cargo-only destinations in Ouagadougou (Burkina Faso), Columbus (USA) and Ciudad del Este, (Paraguay). In addition, Emirates uplifted frequencies and upgraded capacity to numerous points across its network. In August, Emirates announced plans to launch services to Panama City, beginning 1st February 2016. The new service will be the longest non-stop flight in the world (17 hours 35 minutes) and will be Emirates‘ first gateway destination in Central America. In 2015, Emirates expanded the number of cities served by its A380 aircraft to 36. Emirates brought A380 services to Perth, Dusseldorf, Madrid and Copenhagen, and layered on more A380 services to the schedules of nine other existing points spanning east to west, to highly positive customer feedback. During the year, Emirates also led one-off A380 services to seven destinations: Prague, Taipei, Brussels, Sao Paulo, Cologne, Manama and Doha.

Enhancing customer experience Emirates continues to invest over USD 20 million annually to install and operate inflight connectivity systems which enable onboard Wi-Fi services. This year alone, over four million Emirates passengers connected to Wi-Fi on board. Emirates rolled out its newest generation in-flight entertainment (IFE) system on its newly delivered Boeing 777-300ER in August and Airbus A380 aircraft in November. This followed the launch of new, redesigned headphones for Economy Class travellers in April. In October, Emirates launched new amenity kits for its First and Business Class customers in collaboration with Bvlgari. For travelling families, Emirates released its newest range of toys and activity packs in November to keep young travellers entertained - Fly With Me Animals, and Fly With Me Lonely Planet Kids activity bags. On the ground, Emirates expanded its lounge network with the opening of new facilities in Tokyo Narita and Los Angeles International airports, taking the total number of dedicated Emirates Lounges globally to 38. Making it easier for customers to access their flight information and manage their travel, Emirates launched its mobile App for customers using the Android platform, and an App for Apple Watch designed to complement the popular Emirates iPhone app. Emirates also launched its mobile site in several languages including: Arabic, Spanish, French, German, Japanese, Russian, Chinese, Turkish, Greek, Italian, Korean and Polish. Economic contribution Emirates continues to have an important positive impact on the economies of the markets it serves - through the provision of international air transport links that facilitate trade and tourism flows, direct employment through its growing business, and indirect employment through the aviation supply chain and the other industries reliant on commercial air transport. In 2015, this effect was felt again through the aviation supply chain when Emirates announced a historic US$9.2 billion (€8.7 billion) deal with Rolls-Royce for Trent 900 engines to power 50 of its A380 aircraft, and a long-term TotalCare package. The deal was the largest ever for Rolls-Royce, and one of the largest ever export orders for a UK-based company. In November, Emirates signed a USD 16 billion OnPoint solution agreement with GE Aviation for the maintenance, repair and overhaul (MRO) of the GE9X engines that will power the airline‘s fleet of 150 Boeing 777X aircraft. Spanning 12 years, the deal is Emirates‘ largest engine MRO contract to date, and also GE Aviation‘s largest ever commercial jet engine award from an airline. In March, a report by Frontier Economics was released, estimating that Emirates contributed €6.8 billion to the economies of European Union countries in 2013 and 2014, supporting more than 85,000 jobs.
