Using Copyrighted Material in Online Teaching: The TEACH ACT A common misconception among online educators is that the TEACH Act gave more leniency toward posting copyright material in course management systems such as Blackboard. The act supplements copyright law’s fair use exception that allows certain uses of copyrighted works without the permission of the copyright holder. However, there are still limitations: • Motion media (e.g., video): Up to 10% or 3 minutes, whichever is less. • Text material: Up to 10% or 1000 words, whichever is less, usually 1 chapter or 1 article per journal issue. • Music, Lyrics, Music Video: Up to 10%, but no more than 30 seconds. • Illustrations, Photographs: No more than 5 images from an artist/photographer, or no more than 10% or 15 images, whichever is less, of collective work. In face-to-face teaching, a professor can show the full length of a movie as long as the movie is directly related to the course content and only students on the class roster are viewing the movie. In an online only class, a professor cannot convert the full length of a movie to a streaming format without obtaining the permission of the copyright holder. Why? According to copyright law, Title 17 United States Code section 106, the right to reproduce the copyrighted work in copies or phonorecords is the exclusive right of the copyright holder. In response to this copyright dilemma, EKU Libraries has purchased films and documentaries that are already in a streaming format so that professors can easily add these types of movies into your Blackboard class. Blackboard Librarians Libraries Fall 2013
Librarians are able to provide library instruction and reference assistance to students in your Blackboard classes. As embedded librarians, we can answer research questions on the Discussion Board (Ask Your Librarian), conduct online library instruction, post links to library skills tutorials, or engage your students in live chats. Learning Resources Center EKU Libraries’ LRC provides library instruction, collections, and services to support EKU’s College of Education. The LRC supplies resources to the College of Education which are appropriate for use in a P-12 classroom (including P-12 appropriate books, puppets, games, puzzles, models, kits, etc.) as well as professional materials for P-12 teachers. Online students, faculty, and staff in the College of Education are invited to take advantage of these great resources, which can be delivered via Library Express (see library.eku.edu/library-express for more details). How-to Tutorial videos are also available for assistance with LRC resources at library.eku.edu/how-tutorials-completelist or library.eku.edu/learningresourcescenter. Don’t delay in taking advantage of these great resources just because you and/or your students are not on EKU’s Main campus. Justice & Safety Library Services Relocated As of July 1, library services offered at Stratton’s Justice & Safety Learning Commons were redirected to the Main Library. Utilized primarily for its fantastic technology and comfortable study space, the J&S Learning Commons continues to serve students, faculty and staff with technology assistance provided by the College of Justice and Safety. Moving library staff allows for a greater level of service in the Main Library during challenging budgetary times. Although relocating, Nicole Montgomery provides library instruction and assistance electronically and on-site in her role as library liaison to the College of Justice & Safety.
