Conditions for participation

III.2.1)

Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers Information and formalities necessary for evaluating if the requirements are met: Following conditions will be used for the selection for participation of the applicants. 1. The applicant may be excluded from participating in the contract if he a) is bankrupt or is being wound up, whose affairs are being administered by the court, who has entered into an arrangement with creditors, has suspended business activities or is an any analogous situation arising form a similar procedure under national laws and regulations; b) is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or administration by the court or for an arrangement with creditors or of any similar proceedings under national laws or regulations; c) has been convicted of an offence concerning his professional conduct by a judgment which has the force of res judicata; d) has been guilty of grave professional misconduct proved by any means which the contracting entity can justify; e) is guilty of serious misrepresentations in supplying the information herein required. f) does not submit a recent certificate of good behaviour or extract from the “judicial record�. These documents may be replaced by a declaration on oath, available at the following address: sworn statement. g) has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which he is established or with those of the country of the contraction entity; h) has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country in which he is established or those of the country of the contracting authority; i) does not submit a recent certificate of non bankruptcy or of absence of proceedings for a declaration of bankruptcy or of absence of a similar situation or proceeding issued by the registry of the Court of Commerce or by the competent authority of another state. With regard to points g, h and i, the applicant has to submit a certificate issued by the competent authority in the Member State concerned. In case of a joint venture, each of the partners separately has to submit the documents mentioned above. Furthermore, a joint venture has to submit copy of the act of its establishment and of the proxies concerning representation. The Contracting entity reserves the right to demand at any time from the applicant the written evidence and all the justificatory, official documents related to the legal position as specified above. 2. The applicant or his subcontractors has to submit a certificate proving his registration as a Belgian contractor, if any.

Economic and financial ability Information and formalities necessary for evaluating if the requirements are met: The applicants have to submit the following documents: bank statements, balance sheets, statements of the overall turnover and a calculation sheet with the financial ratio’s proving their financial solvability (based on e.g. liquidity ratio, solvency, efficiency ratio, etc) for the past three years.

Technical capacity Information and formalities necessary for evaluating if the requirements are met: The applicants need to provide the following documents and/or information: 1. 3 to 5 references of similar achievements (by indicating their volume) during the last three years. At least one of these need to be in Europe and ideally could be visited; 2. proof of a Quality System taking into account the return of experience with the clients through corrective acts; 3. description of the qualifications of the applicant and, more in particular, of the qualifications of the personnel and technicians responsible for the execution of the on site installation whether or not they belong to the firm; 4. additional certificates concerning quality, environment and safety, if any; 5. CE ecolabel, percentage of recycle material, ergonomy of the material, respect of CE or Belgian norms for office furnitures; 6. Confirmation of capacity to deliver 350 work places in 90 calendar days. 7. ability to deliver small additional quantities in a lead time of 4 to 6 weeks. 8. Ability of the commercial spoc (single point of contact) to speek Dutch and/or French; 9. Ability of the foreman of the assembly team to speak Dutch and/or French 10. production plant in Europe for audit reasons. 11.
