Conditions for participation

III.2.1)

Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers Information and formalities necessary for evaluating if the requirements are met: Following conditions will be used for the selection for participation and in case of more than 7 applicants, for the ranking of these applicants. Maximum 7 applicants will be selected for receiving the request for proposal. The applicant may be excluded from participating in the contract if he: a) Is bankrupt or is being wound up, whose affairs are being administered by the court, who has entered into an arrangement with creditors, has suspended business activities or is an any analogous situation arising form a similar procedure under national laws and regulations; b) Is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding up or administration by the court or for an arrangement with creditors or of any similar proceedings under national laws or regulations; c) Has been convicted of an offence concerning his professional conduct by a judgment which has the force of res judicata; d) Has been guilty of grave professional misconduct proved by any means which the contracting entity can justify; e) Is guilty of serious misrepresentations in supplying the information herein required. f) Does not submit a recent certificate of good behaviour or extract from the "judicial record". These documents may be replaced by a declaration on oath. In case of a joint venture, each of the partners separately has to submit the documents mentioned above. Furthermore, a joint venture has to submit copy of the act of its establishment and of the proxies concerning representation. The Contracting entity reserves the right to demand at any time from the applicant the written evidence and all the justificatory, official documents related to the legal position as specified above. III.2.2)

Economic and financial ability Information and formalities necessary for evaluating if the requirements are met: 1. The applicant is required to submit the following documents: balance sheets, statements of the overall turnover as well as a calculation sheet with the financial ratio’s proving his financial solvability (based on e.g.liquidity ratio, solvency, efficiency ratio, etc.). For the past 3 years (this calculation sheet is available on the Elia web site: www.elia.be --> Suppliers and contractors --> Information and tools for suppliers (http://www.elia.be/en/suppliers-and-contractors/informationand-tools-for-suppliers); 2. The applicant is required to list any company able to offer similar supplies/services and which has direct or indirect control over his company, as well as any company who is controlled – directly or indirectly – by his company (control being defined as having the possibility to influence materially the appointment of the majority of directors and/or the orientation of the strategy and governance); 3. The applicant is required to describe the shareholder structure; 4. The applicant needs to provide an organization chart showing the main functional responsibilities and departments relevant for the tender; 5. The applicant needs to provide a statement of the firm's average annual manpower and the number of managerial staff for the last 3 years.

Technical capacity Information and formalities necessary for evaluating if the requirements are met: The absence of the requested documents and/or sufficient proof will not automatically result in the exclusion of the applicant but will influence the evaluation of the file of the applicant with regard to the selection process. 1) The applicant must provide 5 references from customers where he rendered similar material and services during the last 3 years in an industrial, multi site environment (mention following details: spend, scope, the name of the customer as well as the contact person and his phone number); 2) The technical single point of contact of the applicant and the operators who will install the material need to speak the language of the region (Dutch in Flanders/ French in Wallonia) they're willing to work in; 3) Indicate all the sites from which your organization will operate the maintenance and installation services; 4) Any certification can be an added value.
