Connection tariffs 2007 The tariff conditions for a connection to the Elia-grid as stipulated by the decision of the CREG of December 21st 2006, March 15th 2007, June 15th 2007 and September 14th 2007 are applicable from January 1st 2007 until December 31st 2007. These conditions are: o o o o

1. The tariff for an orientation study The tariff for an orientation study for either a new connection or for the adaptation of an existing connection is a one-shot whose amount depends on the nominal power to connect. The amounts of the tariff are published in the table below:

2. The tariff for a detail study 2.1. Detailstudie met het oog op de aansluiting van nieuwe uitrustingen of de aanpassing van bestaande uitrustingen The tariff for a detail study for either a new connection or for the adaptation of an existing connection is a one-shot tariff depending on the level of the estimated cost of the connection considered in the study. The tariff for the detail study of an investment, of which the estimated cost is smaller than € 100.000,00, is individually determined according to specifications. The tariffs for the detail study of investments, of which the estimated cost is situated between € 100.000,00 and € 2.500.000,00, are fixed following the table mentioned underneath:

For investments of which the estimated cost is higher than € 2.500.000,00 the tariff for the detail study is € 7.500,00 + (0,006 x the estimated cost of the investment). The charged tariffs for the detail study are reduced of the connection cost in case the realization of this connection is ordered in its totality. 2.2. “Power Quality” evaluation for connection or modification of disturbing installations or of compensation installations (pre-assessment) In order to deliver a voltage according to the specifications intended by the article 47 of the Technical Code, the permitted level of the caused disturbance on the grid, intended by the article 46 of the Technical Code, has to be respected. On this subject, the article 54 of the Technical Code imposes the grid user to communicate on his own initiative at Elia all information concerning his installations that have an impact on the quality, the reliability and the efficiency of the grid. Depending on the nature of the concerned equipment and their nominal power, Elia will decide whether to carry out a “Power Quality” evaluation. The basis amount for such a “Power Quality” evaluation is 2.000€. This tariff covers the costs of Elia in order to give to give an authorisation, without having to use supplementary means. For this, Elia either examines the technical data the grid user gave or makes an evaluation of the results of a study made by a third party on demand of the grid user. In some cases, in order to formulate an advice Elia will have to realise supplementary studies concerning the impact of the considered installations on the quality of the voltage of the Elia grid.

(1) In accordance to the instructions Synergrid C10/17 “ Power Quality instructions for the users connected to the high voltage grids”. (2) These costs cover among other things the measures realised in the connection point of the grid user. If supplementary measures in the installations of the user are needed, extra costs will be charged to the user. The charged tariff for “Power Quality” studies cannot be reclaimed when the connection is ordered. At the end of the studies, Elia delivers to the grid user a report containing the recommendations of Elia and the conclusions of the study. 3. The tariff for the use of the connection bay The tariff for the use of the connection bay consists of o a yearly charge to realize or modify in a substantial way the connection bay o a yearly charge to operate and to maintain the connection bay. These yearly charges, whose amounts are mentioned in the summary table further in the text, give the grid user a right to use the total functionality of the connection bay including preservation and replacement. The connection bay includes one metering equipment for invoicing. The amounts of these charges are mentioned in the summary table under section 5. Charges to put an existing connection bay at disposal of the grid user are proportionally adapted in order to reflect the financial interventions that the grid user has done in the past. This adaptation is valid until the date of replacement of the connection bay and not longer than 33 years after the date the connection has been put into service.

4. The tariff for the use of other connection equipments: lines or cables and their requisites, equipments for transformation, compensation of reactive power and filtering of the voltage wave 4.1. For a new connection (or the adaptation of an existing connection): charge to realize or modify in a substantial way The amount B, representing the total amount of investment, is determined according to specification. The first part of the amount B (this is the amount B1) is covered by a one-shot payment, depending on the agreements Elia has made with its suppliers. This compensation must be paid not later than the moment the connection will be put into service. The requester of the connection is free to chose the amount B1 insofar the proportion B1/B does not exceed 20%. The grid operator proposes the payment schedule for this tariff, following the chronological evolution of its expenses for this connection. The difference (this is B2 = B – B1), if there is one, is paid on the basis of yearly constant payments: •

A first part of this amount (this is the amount B2g) is object of constant periodical payments (annuities) and of a bank guarantee on first demand, which has to cover the outstanding balance of the total amount B. The annuities are calculated on the basis of the duration of the industrial project and with an interest rate equal to the WACC (the weighted average cost of capital) of ELIA; The difference (this is the amount B2r = B2 - B2g) is covered by constant periodical payments (annuities). This part doesn’t need to be covered by a bank guarantee. The annuities are calculated on the basis of the duration of the project and with an interest rate (i) equal to the WACC of ELIA, increased with a risk premium (S) for the concerned grid user or his guarantor following the formula: i =WACC + S*B2r/B2.
The grid user is free to chose the amounts B2g and B2r insofar the proportion B2r/B2 does not exceed 50 % and insofar B2g+B2r+B1 equals B. 4.2 Charges to put existing equipments at disposal of the grid user The annual charge is the one as mentioned in the summary table under section 5, which has to be des-indexed on basis of the consumption price index until the date the concerned equipment has been put into service. If there were financial interventions in the past, those charges have to be reduced on a proportional basis. 4.3. Charges to operate and maintain the connection equipments (new or existing ones) The charge to operate and maintain the « other » connection equipments is mentioned in the summary table under section 5. For the transformers that have a capacity that differs from those indicated in the table above, following formula is applied to determine the charges:

Where - K is the charge to put the concerned transformer at disposal and to operate and maintain it - MVA is the transformer capacity of the concerned transformer - K0 and MVA0 are respectively the charge to put the reference transformer at disposal and to operate and maintain it and the transformer capacity of the reference transformer, chosen in the list of the summary table so that the primary voltage equals the one of the concerned transformer and the transformer capacity is nearest to the one of the concerned transformer. 4.3 Fixed charges applicable in case a user owns its connection and operates and maintains it in the name and for account of Elia This tariff is applied in case the user operates and maintains himself the connection equipments other than the connection bay. 6. The tariff for the use of supplementary protection-equipments, supplementary equipments for alarm signalisation, metering, supplementary equipments for centralised teleactions and/or telecontrol The tariff for the use of supplementary protection-equipments, supplementary equipments for alarm signalisation, metering, supplementary equipments for centralised teleactions and/or telecontrol will be determined case-by-case, taking into account the specificity of the concerned equipments. New metering equipment is made according to specifications. The annual charge for operation and maintaining of these metering equipments is 440€/equipment. Hereunder we examine in particular the cases of centralised telecommunications, “Power Quality” reception tests and « Power Quality » monitoring. Centralised telecommunications It concerns the centralised telecommunications of which the equipments are property of Elia and that are operated and maintained by Elia in order to deliver at the Distribution Grid Operators the signalisation they need. 6

“Power Quality” reception test While installations are put into service or after modification of these installations, Elia has the right to realise reception tests in order to control the level of perturbation caused by these installations. If the verification of these levels can be done on basis of measures of the voltage at the connection point of the user, the tariff for the reception tests equals 2.500 €. At the end of these tests, Elia delivers a report to the grid user with most important measuring results and the conclusions of the tests. For grid users with emission limits of « stage 3 » as well as for the cases that impose more complex measures, an extra charge of 4.000 € will be imposed (the total for those cases is thus 6.500 €). “Power Quality” Monitoring Each grid user can optionally apply for a service in the matter of controlling and analysing the continuity and the quality of the tension. This service, called “power quality monitoring”, includes the delivery of an annual report concerning the quality and continuity of the power supply of the grid user at a particular connection point. The price for this service is 1.250€. The price covers the costs related to the installation, the operation and maintaining of the metering equipment as well as the operation of the software needed to follow up and create the quality report. The report contains information and statistics on the interruptions and the voltage dips the grid user experiences as well as on harmonic, flicker, voltage imbalance and rms voltage.

7. Particular terms 7.1 Reduction coefficients if several users use simultaneously the same connection bays All costs covered by a one-shot tariff relative to (a part of) the equipments that are used by 2 or more grid users, except for the costs for the equipments for metering, can be divided under those users. The equipments for metering have to be installed separately for each user. The division is done proportionally to the power of connection as stipulated in the Connection contract. All costs covered by a periodically applied tariff relative to (a part of) the equipments that are used by 2 or more grid users, will first be multiplied by a coefficient k1 (1+0,05) and then be divided proportionally to the power of connection as stipulated in the Connection contract. This coefficient reflects the increased risk for Elia that one of the users will stop using the connection. In order to cover the extra administrative costs, the increase of 5% will be replaced by an amount of 1.000 â&#x201A;Ź/year if that increase of 5% corresponds to an amount inferior to 1.000â&#x201A;Ź/year. 7.2 Reduction coefficients on the connection tariffs for the use of connections of production units based on renewable energy sources with limited predictability and for the use of connections of auto-production units A production unit based on renewable energy sources with limited predictability is defined as a production unit based on wind, solar or hydraulic energy. A reduction on the normal tariff for connection equipments of X% is foreseen, if the option of a one-shot payment of the connection equipment is chosen. A reduction on the normal tariff for connection equipments of Y% (charge to put the equipment at disposal of grid users) is foreseen, if the option of a periodical tariff is chosen, but being limited to the first N yearly payments. The values of X%, Y% and N are respectively 30%, 30% en 10 for 2007. The reduction coefficients are applicable insofar as the auto-production unit is situated in an access point in which there is an off-take as well.
