c) has been convicted of an offence concerning his professional conduct by a judgment which has the force of res judicata; d) has been guilty of grave professional misconduct proved by any means which the contracting entity can justify; e) is guilty of serious misrepresentations in supplying the information herein required. f) does not submit a recent certificate of good behaviour or extract from the “judicial record”. With regard to points g, h and i, the applicant has to submit a certificate issued by the competent authority in the member state concerned. In case of a joint venture, each of the partners separately has to submit the documents mentioned above. Furthermore, a joint venture has to submit copy of the act of its establishment and of the proxies concerning representation. The Contracting entity reserves the right to demand at any time from the applicant the written evidence and all. The justificatory, official documents related to the legal position as specified above. The absence of the requested documents and/or sufficient evidence about the clauses above will not automatically result in the exclusion of the applicant but will influence the evaluation of the file of the applicant with regard to the selection process. III.2.2)

Economic and financial capacity The applicants have to submit the following documents and/or information: — All information/data asked in the vendors questionnaire available on http://www.elia.be/repository/Lists/. Library/Attachments/672/vendors_questionnaire_supplies.xls. — balance sheets and cost revenue sheets of last 3 years, — VAT and DUNS number, — a company presentation and an organisation chart showing main functional responsibilities. A severe negative financial or economical capacity (D&B rating 4) will lead to exclusion of the contractor. Other negative financial or economical capacity (example D&B rating 3) may lead to exclusion of the contractor.

III.2.3)

Technical capacity Information and formalities necessary for evaluating if requirements are met The supplier needs to: — have realised the prequalification test following the IEC60840 with a dry type GIS termination in the proposed cable system: reports and explanation to be added in qualification file, — submit the file showing the procedures of the different tests (type, routine, qualification, prequalification) concerning the accessories, — have produced a power cable with a nominal voltage greater than or equal to 110 kV with a section greater or equal to 2 000 mm² Alu, — have produced a power cable with a nominal voltage greater than or equal to 110 kV with integrated optical fiber,

— submit a proof of delivery of 2 similar (greater than or equal to 110 kV) industrial underground high voltage links in Europe (links to be in service) with cable with integrated optical fibre, — prove his experience in assembling aluminium core (references to be listed by voltage level), —provide his ability to produce high voltage cables and a presentation of the factory which will produce the material for this framework agreement, — have a presence of technical expertise and qualified jointers in Europe, — prove his ability of the contact person and the person in charge of the on site installation to communicate orally and in writing in French and Dutch, — prove sufficient mounting capacities (number of teams) available for the Belgian market, — provide a prove of the quality insurance, the qualification procedure and experience of his mounting teams, — prove that mounting activities of the accessoires are performed by trained technicians with a proven track record related to the proposed accessoires, — prove the availability of technical experts within 24 hours during the installation works, — comply with the following technical requirements, —— The supplier should have an extrusion of a dry type, —— The insulation of the cable should be XLPE, —— The delivery of terminations in porcelain will not be accepted, —— The joints should be of premoulded type. The absence of the requested documents and/or sufficient evidence about the clauses above could automatically result in the exclusion of the applicant. III.2.4)
