A PRECEDENT RULING BY THE ISRAELI SUPREME COURT IN JERUSALEM IN RESPECT OF “HIMALAYA CLAUSE” –

CLAIM AGAINST CARRIER NOT DISMISSED ON FOREIGN JURISDICTION CLAUSE –

When a sea carrier files for insolvency in the course of the sea carriage, onsiderable additional costs and expenses occur in the efforts to deliver the cargo to the consignee, which also have increased chance to suffer damage or delay. Dr. Marco Remiorz discusses the implications for forwarders.

In a split decision, the Israeli Supreme Court recently ruled that while the jurisdiction clause applied to a third party through the application of the Himalaya Clause, that party's suit could only be resisted in reliance on the clause if the party raising the clause agrees to waive the time-bar for bringing suit in the selected forum. In another development relating to bill of lading jurisdiction clauses, the Haifa Magistrates Court refused a motion to dismiss a claim before it in spite of a jurisdiction clause in the bill of lading favouring London. TOPOCEAN, SINGAPORE STARTS RAILWAY TRANSPORTATION Topocean has started a new service on railway transportation ~ One Belt One Road (OBOR) & China-Singapore initiative. This service runs Ex-China (Chong Qing) to Germany (Duisburg) on weekly basis & mainly caters for LCL service. Duisburg, is a commercial HUB in Western Germany, while Chong Qing is a home for car parts & IT factories. The advantage of this Rail service is; 2 X faster than Sea Transport 2 X cheaper than Air Transport

E-COMMERCE COUNTERFEITERS FLOURISH DESPITE CPB, ICE EFFORTS In a test conducted by the U.S. Government Accountability Office (GAO), at least 20 of 47 products sold by third-party sellers online were proven to be counterfeit, according to a review of the U.S. Customs and Border Protection (CBP) and Immigration and Customs Enforcement. The seizure of counterfeit goods increased 38% between 2012. and 2016. According to the GAO's report, most of the counterfeit goods seized between 2012 and 2016 were shipped from China and Hong Kong, marking those two locations as high-risk for counterfeits. This is where supply chain visibility tools become so valuable: As more companies digitize and effectively track the path of goods through the supply chain and oversee the end-to-end supply chain, they can mitigate counterfeit risk. New technology, such as real-time tracking or block chainbased ledgers, can help spot and address fake products early in the sourcing process. Read more in an article from Supply Chain Dive.

The Chinese customs authorities have advised that as of June 1, 2018, it will be mandatory to include the shipper code and contact identifier on the MAWB and HAWB for all shipments destined to or transiting through China. The shipper code corresponds to a number that varies per country (in Canada for example, it is the Corporation Number). The shipper code must be indicated on the source document (on the OCI line of the AWB). Air Canada Cargo cannot verify the validity and authenticity of shipper codes. Please ensure all data is true and correct to avoid delays or penalties. The contact identifier corresponds to the method of contact for the shipper, such as fax or telephone. The contact number is the corresponding number; it must not include any special characters such as dashes (-) or dots (.), for example: Telephone: 5555555555.
