Activists: You have a right to know Officials and advocates debate public notification of sewage spills Record rainfalls this summer – on August 14 and on August 28 with Hurricane Irene – impacted the health and safety of local waterways, creating myriad problems at the Cedar Creek (in Wantagh) and Bay Park sewage treatment plants. Yet the public was not notified. “There is currently no law requiring municipalities or the state DEC [Department of Environmental Conservation] to notify members of the public when a sewage overflow occurs,” remarked Adrienne Esposito, executive director for the Citizens Campaign for the Environment. “This is wrong. The public deserves to be notified.” On August 14, “5,000 gallons of treated – but not chlorinated – sewage effluent from the final settling tanks and rain water spilled onto the grass and roadway at the Cedar Creek plant, and then entered the storm drains that drain into Wantagh Creek,” said Bill Fonda, spokesperson for the state DEC. On the same day, in nearby Baldwin, there was a raw sewage backup into the homes and roadway on Barns Avenue. Manholes,

which were bolted down, lifted several inches above the road, allowing sewage to flow down the road onto lawns, into gardens and through basements. Ultimately, the sewage discharged into Parsonage Creek, a tributary into the South Shore Estuary Reserve.

watchdog group that monitors the health and safety of our waters along the South Shore. At Bay Park in East Rockaway, there were seven violations in June for exceeding settleable solids, total suspended solids and turbidity standards. In March 2010, over 3.5 million gallons of sewage overflowed, creating a brown plume. The public only learned

‘There is currently no law requiring municipalities to notify the public of spills’ Is ignorance being cultivated? “Days later those who were unaware of this release could be seen fishing and crabbing in Parsonage Creek,” said Ms. Esposito. “Many residents don’t know what’s going on and when the water is effected. Ignorance is not bliss; ignorance is dangerous. The law cultivates ignorance and as a result people are getting sick.” Between 2003 and 2011 there were over 600 New York state permit discharge violations from local sewage treatment plants, according to SPLASH, an environmental

in 24 hours. If the sewage spill has the potential to impact shellfish harvesting areas, the county is required to notify the DEC’s Bureau of Marine Resources within two hours of the spill. Although beaches may be closed due to spills, the county Board of Health will only make warnings “if the area is a lifeguarded body of water,” explained Mr. Bockner, a member of Sludge Stoppers, which has been monitoring the spills at Bay Park. “So, are you telling me we have to put a lifeguard to stand there all the time? And what about those Jetskiing or boating or fishing?” he asked. More partisan politics To address the lack of communication (continued on page 2)

The bill was submitted to the county Legislature in April but remained in the office of Republican Presiding Officer Peter Schmitt until last week, when the Republicans came up with their own notification system. “It’s partisan politics,” said Ms. Esposito. “They have been sitting on this for months. We are going to the state to see if they will pass a similar bill.” While the Democratic minority supports the bill, the Republican majority does not. Avi Fertig, representing Legislator Howard Kopel, Republican of Oceanside, doesn’t support the bill. Legislator Denise Ford, Democrat of Long Beach who votes with Republicans, did not return this newspaper’s calls. Legislator Norma Gonsalves told this newspaper “the county legislature is not an appropriate venue. This is a New York state issue. Our legal counsel said we have no authority to enact this legislation at this time.” Also, the Republican majority

are you telling me we have to put a lifeguard to stand there all the time? And what about those Jetskiing or boating or fishing?” he asked. More partisan politics To address the lack of communication toward the public, county Legislator David Denenberg wrote the Nassau County Right to Know of a Spill Bill, docket number 138-11, that would require the Nassau County Department of Health to alert the public, through the media, about a sewage spill that could effect waterway use and activities including swimming and diving, as well as commercial and recreational fishing. “It was written to be like the mosquito spraying bill. We used the same language and we thought this is about our health, why not pass it,” said Mr. Bockner.

has said the law is unnecessary and redundant. Rob Weltner of SPLASH also supports the county legislation, and helped to spearhead a letter-writing campaign to county legislators. “It’s a good bill. About 100 letters have been sent to various county legislators and to Peter Schmitt,” he said. Then, late last week the Republicans unveiled their own plan for reporting spills. Sign up to learn of spills Here’s how it works. Residents may sign up to receive e-mails (www.nassaucountyny.gov/dpw) through the Nassau County website and will be notified within four hours of any reportable incident that results in a wastewater spill in any waterway near Bay Park, Cedar Creek or Glen Cove. The county Department of Health has also established a telephone hotline, 2279700, for residents to call to determine if any event has caused the DOH to close

local beaches. This bill [Spill Bill] is “superfluous and unnecessary,” said Christina Brennan, spokesperson for Legislator Schmitt. “The Department of Public Works will e-mail anyone who wants to know about a spill.” This newspaper asked what will happen if the county decides to privatize the plants. Can the public trust its welfare to a private concern, especially if it will cost them money? “It’s like the fox watching the hen house,” said Mr. Bockner. “There is no reason not to pass this bill,” said Legislator Denenberg, “except that I’m the author of it. I still think you need to inform the media, just like you do when there is a mosquito spraying in the county.” “Things are going to happen,” said Mr. Bockner, referring to spills and break down of equipment at the plants. “It’s not about blame. Machines break down; there will be damage. Just tell us so we know to stay out of the water.”

Two vying for Hempstead Town’s Fifth Council District The campaign of town Councilwoman Angie Cullin submitted the following candidate statement on her behalf: Hempstead Town Councilwoman Angie Cullin is a forceful advocate for residents of the fifth Council District. Protecting the quality of life enjoyed by South Shore neighbors while working with Supervisor Kate Murray to produce a 2012 tax-freeze budget is a priority for Councilwoman Cullin. The first woman elected to the town board and the first female receiver of taxes in Hempstead Town’s history, Mrs. Cullin has a wealth of government experience and the depth of knowledge that has served her constituents well. Fighting to preserve the suburban character of our communities, Angie Cullin is working with neighbors to battle a proposed cabaret in Wantagh. In fact, she is proposing legislation that would impose stronger public notice requirements on businesses seeking variances from the local zoning Board of Appeals for property uses such as a cabaret. Ms. Cullin was also the primary sponsor of a landmark cell tower law that has been called the toughest anywhere in the country. The law has stopped wireless commu-

nications giants from building unnecessary cell towers in residential neighborhoods where they would negatively impact home values and damage residential areas. What’s more, Councilwoman Cullin has overseen downtown beautification projects in Merrick, Bellmore and Wantagh the same time as she has shepherded parks improvement projects in Merrick, Bellmore, Seaford, Wantagh and Lido Beach.

Securing grant monies and working with volunteer groups, the councilwoman has helped establish and enhance nature preserves in the district, install storm drain filters to protect our bays and waterways from pollution, and she has restored beaches in waterfront communities that have fallen prey to coastal erosion. Angie Cullin is particularly proud of her work with Supervisor Murray to start construc-

tion on an ANCHOR Program building for children with special needs in Lido Beach. Councilwoman Cullin has been a genuine leader, committed to improving the quality of life for Hempstead Town neighbors while working aggressively on a 2012 town budget that holds the line on taxes. The community newspaper - the glue that helps hold a community together, and the spur that helps keep it moving forward

Honoring his memory Schoolchildren in classrooms all over this area likely remember the late Bill Uhlinger, who died recently of pancreatic cancer. He was the big Teddy Bear of a guy who visited their schools, often bringing his horse, and told about another Teddy, rough-riding President Theodore Roosevelt, who owned a summer home in Oyster Bay that is now a national museum. Many local schoolchildren also have classmates who are Type 1 diabetics, learning to manage their disease so they can live normal lives. If they cannot manage to hold insulin fluctuations in check, they will be at risk later in life for all kinds of health problems, including pancreatic cancer. So for their sake, and to honor the memory of Bill Uhlinger, we are asking our readers to take a moment, visit the Juvenile Diabetes Research Foundation International website and sign the artificial pancreas petition. On December 1, the U.S. Food and Drug Administration will issue Bill Uhlinger guidance that will determine the speed with which an articifial pancreas reaches patients in this country. The petition states, “We ask that the FDA adopt outside clinical recommendations allowing short term inhospital evaluation of artificial pancreas systems followed by outpatient trials no more than three months long.” FDA obstacles have kept a low glucose suspend device, the precursor to the artificial pancreas, from being available to patients in the U.S. The artificial pancreas is considered the most revolutionary advance in the treatment of diabetes since the discovery of insulin. It would allow people with Type 1 diabetes to maintain tight control of blood glucose levels, reducing the risk of life-threatening fluctuations and helping manage their disease. This is important. Please take a minute to help make it happen.

When You pre-pay complete funeral arrangements with Leo F. Kearns, they are guaranteed in four ways:

1. We guaranty that you or your heirs will not have to pay any additional money due to future funeral home price increases. Once the funds for a complete service are deposited in our Pre-Plan Trust, the money will earn a high rate of interest that will cover those future inflationary increases. 2. You will have confidence that your wishes are entrusted to a local, family-owned and managed firm that has won the confidence and respect of families for four generations. 3. Your money is placed in trust and remains under your ultimate control. At any time, and for any reason, your principal and interest is refundable without any cancellation fee. (For individuals concerned about Medicaid eligibility, a special irrevocable trust can be established.) 4. Your money is deposited in a New York bank that is fully insured by the Federal Deposit Insurance Corporation. There’s no speculation or chance involved.

Last chance local art show Last chance to see a spectacular work of art by local Merrick artist, Dr. Norma Jabin at the East Meadow Library! Her awardwinning “Best in Show” painting called “Shame” is part of the Art League of Nassau County juried art show. The piece will be on exhibit through Friday, October 28. The library is open from 9 a.m.-9 p.m., and the art show is a must-see for Merokians who appreciate highly accomplished local talent. The library is at 1886 Front Street at the corner of East Meadow Avenue. A retired doctor, clinical and school phycologist of Merrick, Dr. Jabin discovers in herself an innate talent that she has for seeing images within images, and then bringing them out in beautiful ways. When Dr. Norma Jabin – an avid museum goer and poet – was in her earlier mid-life, she realized she had a rare creative talent. Influenced by browsing galleries – par-

If you were a LIRR commuter coming home last Friday in Wantagh, you saw an orderly lineup outside of Mulcahy’s. While it is not unusual to see people going into the concert hall, this lineup was completely different. Instead, you saw a table with a green table skirt and the words “Bellmore JFK Alumni Inc.” And the lineup was for the Multi-Year JFK Reunion, the first event for the newly created official not-forprofit alumni association. “Our board only came up with the idea in August to have a launch event for our alumni association,” said Gary Morganstern, president of the association board. Howard Kaden, board vicepresident, said, “We were hoping to

have a decent turnout, maybe 100 people or so.” While Maury and Beth Josephson, high school sweethearts at Kennedy, gave out the name tags, Mark Meyerowitz and David Weiss made sure that many raffle tickets for the giant flat-screen TV were sold. Treasurer Craig Maltz kept a watchful eye as the funds came in. When asked what the association would do with the money being made from the event, Elyse Singer Lowe and Amy Gaon replied, almost in unison, “We are going to support and promote many social, educational and scholarship programs to meet the needs of both the students and the alumni of JFK. need to maintain continued relations between JFK and its alumni.” Board member Gwen Rappel Rosenberg and professional photographer Steven Buchbinder took photos of the over 300 guests and placed them on Facebook for all to see. Eileen Connolly – owed many thanks – is the vice-principal of Kennedy High School. She and Jay Fishbein worked the crowd, telling all the alumni about a future directory that will be published, about a website under development and about how it will have all the past yearbooks posted online for viewing. The alumni were having such a phenomenal time reminiscing about the past and listening to the band Big Shot, they forgot about how annoying Ronald Steiger, the public relations person for the board, was in sending out hundreds of Facebook e-mails and press releases pushing the event. Mr. Steiger said, “I really didn’t care if I sent out too much information too many times, I just wanted to make sure that we had a good turnout and everyone would have a great night.” He wanted the event to be so good that the alumni who didn’t make it to the reunion would feel as if they really missed out on something special and be upset. This way, they won’t miss the next event! The real purpose of the event was to launch the alumni association. It wanted to make sure that alumni all over the country knew about the reunion and their new alumni association, and all the great things it is going to do in the future. “With that in mind, we were very successful,” said Mr. Steiger. “The alumni here are having the most wonderful time and cannot thank us enough,” said Mr. Kaden and Mr. Morganstern. Mr. Steiger explained to some out-of-towners – Linda Savino of California and Harvey Cavayero of New Jersey – about some future projects. Some of the grads from the years 1965-75 were told about a battle of the bands night and reunion event that the alumni association is exploring with bands that were around in the late ’60s and ’70s. A few of the alumni crowd were

made up of past teachers and athletes from Kennedy. And as retired teacher and wrestling coach Bob Wigand looked on, David Weiss, a heavyweight wrestler for Kennedy in the late ’60s, drew a crowd. He was telling the alumni that gathered around him about the athletic and health-related alumni events the association has in the planning stages, such as a walkathon and bikeathon. Maury Josephson explained that “We had hoped to have and hold some of these events as joint functions with the Kennedy Athletic Department, this way the present Kennedy students, their parents and older JFK alumni could participate together. We really want to instill the pride in the quality education for our children that this JFK community affords us.” The new association hopes and asks for alumni to support its efforts and come and join its members at a meeting, get involved on the board or on one of many committees. The meetings are held at the high school, Room 136, at 7 p.m. The next scheduled meetings are Tuesdays, November 29 and January 31. The e-mail is Bellmorejfk1@gmail.com. The Facebook group page is called “Bellmore Merrick JFK Alumni” and it has an alumni page on the school district’s Bellmore JFK website. Please join us. – from the reunion committee

ticularly those in Greenwich Village, where she found inspiration – she became an avid admirer of artist Judith Cane. To her delight, upon an art trip to Vermont, she met Ms. Cane, whose work had been so inspiring to her earlier. It started as a hobby, taking a local class here and there at the Freeport Recreation Center, among others places. She said the advertisement read “Bring a pencil and a rag.” Much to her surprise, her teachers said of her very early work, “This is quite good, we are hanging it in the lobby” and “You must have this well-framed.” She is also a poet, saying the language in her poetry “...seemed like it was striving to describe things in colors and shapes, the way painters express themselves on canvas.” As a physician, Dr. Jabin worked with patients using a psychological test called Rorschach technique, in which perceptions of ink blots are recorded and analyzed using psychological techniques. She told Merrick Life that on her own time, she would see shapes within the Rorschach ink blots, such as those of people. So she began to draw them and in 1978 she developed an art form of her own called “Projective Art,” which is now a recognized art form. In 1980 she was diagnosed with breast cancer and given a bleak prognosis for survival. Refusing chemotherapy, she emmersed herself in a macrobiotic diet and against all odds beat the cancer. She is a healthy cancer survivor to this day – with a full schedule! Now an accomplished fine artist, clinical and school phycologist, she belongs to many art associations throughout New York City and Long Island, such as the Art Association of Rockville Centre, Art Association of Long Beach, Art League of Nassau County and the National League of American Penn Women and more. A piece of work she painted was published by Turner Publishing in a book named “the Art of Healing” that
