Announcement of the National Council for Peace and Order No. 72/2557 Subject: Implementation of the Organic Law on the Prevention and Suppression of Corruption ***** In order to ensure that the Provincial Anti-Corruption Commissions under the National Anti-Corruption Commission (NACC) are able to operate in an orderly manner, the Organic Law on the prevention and suppression of corruption B.E. 2542 (1999) amended (II) B.E. 2554 (2011) shall be amended as follows: 1. Provision in Section 103/12 of the Organic Act on the prevention and suppression of corruption B.E. 2542 (1999) amended (II) B.E. 2554 (2011) shall be nullified and adopt the following provision instead: “ Section 103/12: To appoint the Provincial Anti-Corruption Commission, there shall be a selection committee comprising 5 members with an authority to select appropriate candidates as Provincial AntiCorruption Commissioners. Members of the selection committee are: (1) Deputy Secretary-General of the NACC or Vice Secretary-General of the NACC who has been assigned by the Secretary-General of the NACC (2) Provincial Public Prosecutor (3) Director of the Provincial Election Commission (4) Director of the Provincial Audit Office (5) Deputy Director of the Provincial Internal Security Command (Military) Should there be a case that certain member(s) of the selection committee is absent, the NACC has authority to decide on how to proceed. The Deputy Secretary-General of the NACC or Vice Secretary-General of the NACC shall act as the chairman of the selection committee, and the Director of the Provincial Election Commission as the secretary to the selection committee.” 2. Provision in Section 103/18 of the Organic Act on the prevention and suppression of corruption B.E. 2542 (1999) amended (II) B.E. 2554 (2011) shall be nullified and adopt the following provision instead: “Section 103/18 the Provincial Anti-Corruption Commission shall have authority in its province to: (1) Promote the prevention and suppression of corruption by coordinating with the public and other government agencies in order to raise public awareness at all levels regarding the impact of corruption, by preventing acts of corruption, and by strengthening the attitude and value of honesty, as well as by engaging the public or groups of people in all sectors to participate in the prevention and suppression of corruption.


(2) Suggest measures, opinions, or recommendations to the NACC so as to promote the prevention and suppression of corruption (3) Perform other duties as assigned by the NACC Pursuant to paragraph I, the Chairman of the Provincial Anti-Corruption Commission or the Director of the Provincial NACC Office is authorized to sign documents so as to fulfill the duty� 3. The selections and appointments of the Provincial Anti-Corruption Commissioner done before this announcement are valid. However, the ongoing selection and appointment process shall be deferred until further notice. This Announcement shall take effect immediately.
