INFORMATION FOR BUYERS 1

Introduction. The following informative notes are intended to assist Buyers, particularly those inexperienced or new to our salerooms. All sales are conducted on our printed Conditions of Sale which are readily available for inspection and normally accompany catalogues. Our staff will be happy to help you if there is anything you do not fully understand.

Agency. As auctioneers we usually contract as agents for the seller whose identity, for reasons of confidentiality, is not normally disclosed. Accordingly if you buy your primary contract is with the seller.

Estimates. Estimates are designed to help buyers gauge what sort of sum might be involved for the purchase of a particular lot. The lower estimate may represent the reserve price and certainly will not be below it. Estimates do not include the Buyer’s Premium or VAT (where chargeable). Estimates are prepared some time before the sale and may be altered by announcement before the sale. They are in no sense definitive.

Buyers Premium. The Conditions of Sale oblige buyers to pay a buyer’s premium at 25.2% inclusive of VAT on the hammer price of each lot purchased.

VAT. (†) indicates that VAT is payable by the purchaser at the standard rate (presently 20%) on the hammer price as well as being an element in the buyer’s premium. This imposition of VAT is likely to be because the seller is registered for VAT within the European Union and is not operating the Dealers Margin Scheme or because VAT is due at 20% on importation into the UK. The double symbol (**) indicates that the lot has been imported from outside the European Union and the present position is that these lots are liable to a reduced rate of VAT (5%) on the gross lot price (i.e. both the hammer price and the buyer’s premium). Lots which appear without either of the above symbols indicate that no VAT is payable on the hammer price. This is because such lots are sold using the Auctioneers’ Margin Scheme and it should be noted that the VAT included within the Premium is not recoverable as input tax.

Conditions of lots. Please note carefully the exclusion of liability for the condition of lots contained in the Conditions of Sale. Intending buyers have ample opportunity form inspection of goods and neither the seller nor we as the auctioneers accept any responsibility for their condition. In particular, mechanical objects of any age are not guaranteed to be in working order. However, in specified circumstances lots mis-described because they are ‘deliberate forgeries’ may be returned and repayment made. There is a 2 week limit. (The expression ‘deliberate forgery’ is defined in our Conditions of Sale).

Condition reports. We may be able to assist buyers unable to view by providing a condition report, but these reports are based solely on our own opinion and are for guidance only and no responsibility is accepted for their accuracy. Intending buyers are strongly encouraged to view. (Please see our Conditions of Sale). All sizes are approximate.

Export of goods. Buyers intending to export goods should ascertain (a) whether an export licence is required and (b) whether there is any specific prohibition on importing goods of that character because, e.g. they may contain prohibited materials such as ivory. Ask us if you need help.

Bidding. Bidders may be required to register before the sale commences and lots will be invoiced to the name and address on the registration form. Some form of identification may be required if you are unknown to us. Please enquire in advance about our arrangements for telephone bidding.

10 Commission bidding. Commission bids may be left with the auctioneers indicating the maximum amount to be bid excluding buyers’ premium. They will be executed as cheaply as possible having regard to the reserve (if any) and competing bids. If two buyers submit identical commission bids the auctioneers may prefer the first bid received. Please enquire in advance about our arrangements for the leaving of commission bids by telephone or Email. 11 Methods of Payment. As a general rule any cheques tendered will need to be cleared before removal of the goods is permitted. Please discuss with our Office in advance of the sale if other methods of payment are envisaged (except cash). We accept card payments provided that your registered address is the same as the card address. There is a surcharge of 2.5% plus VAT on credit cards but no charge on debit cards. 12 Collection and storage. Please note what the Conditions of Sale state about collection and storage. It is important that goods are paid for and collected promptly. Any delay may involve the buyer in paying storage charges which are currently set at £5 plus VAT per lot per day. 13 Artists’ resale rights. Buyers of lots executed by qualifying artists are subject to ARR payments which will be added to the purchaser’s invoice. Where possible such lots are marked in the catalogue with §. The charge will be applied only where the hammer price exceeds 1,000 Euros and will be at a maximum of 4% for full details see www.dacs.org.uk or telephone +44 (0)845 410 3410.

EXPLANATION OF PICTURE CATALOGUING TERMS Any statement as to authorship, attribution, origin, date, age, provenance and condition is a statement of opinion and is not to be taken as a statement of representation of fact. The Auctioneers reserve the right, in forming their opinion, to consult and rely upon any expert or authority considered by them to be reliable. The forename(s) and surname of the artist: In our opinion a work by the artist. The initials of the forename(s) and the surname of the artist: In our opinion a work of the period of the artist which may be wholly or in part his work. The surname only of the artist: In our opinion a work of the school or by one of the followers of the artist or in his style and of uncertain date. English School’, ‘Italian School’: etc: In our opinion a work executed at a later date that the style may suggest. Signed’: Has a signature which in our opinion is a recognised signature. Dated’: Is so dated and in our opinion was executed at that date. The term ‘bears’ a signature and/or date and/or an inscription: Means that in our opinion the artist’s name and/or date and/or inscription have been added by another hand. Measurements: Height precedes width.

The Breadalbane Grand Piano, Important carved walnut Grand Piano by Collard and Collard, commissioned by the 6th Earl of Breadalbane and Holland, The Grand Piano was commissioned in May 1868 by the vendor’s Great Great Grandfather as a gift for his daughter Lady Eva Campbell, to celebrate J A G Campbell’s accession to the title in 1862. It took two years to construct due to the profuse and stunning wood carving. Made from Victorian Burr (Sicilian) walnut carved all over with coats-of-arms and devices of the Campbell family within neo-classical beaded and moulded panels on squared baluster legs. In the detail surrounding the Piano one can find three sets of his children’s initials as well as other details. The boars head is part of the Coats of Arms of the Campbells of Breadalbane. The heart with the arrow is part of the coat of arms of Campbell of Glenfalloch It cost £2000 to make in 1868 and half of that cost was in the carvings themselves. There is a number 88981 The Piano size is 8’ 6” by 5’ 3” (weight...approx 700KG). It has all the original mechanisms and the original sound board. It is not however possible to get it fully up to pitch anymore in its present condition, because the sound board is too weak (the strings are said to pull a tension of 10 tons). £2,000-3,000 See Illustration. 1117

GEMS DRIVEN BY ROMANCE AND PETROL IN EWBANK’S AUTUMN AUCTION Solitaire ring sells for £12,000, restored 1949 Jaguar Mark V Coupé for £23,000 Perhaps it was because Christmas is approaching, but buyers of fine jewellery in a sale at Ewbank’s, Surrey’s premier auctioneer of fine art and antiques, ignored presale price guidelines and spent freely on the saleroom’s Autumn selection of 300 lots, almost all consigned for sale by private individuals. Top of the shop was a stunning four carat solitaire diamond ring, the gem set in 18 carat white gold, which sold to a Hatton Garden dealer for £12,000. Ultimately, it will make its eventual owner a very happy lady. Elegance of an earlier era was provided by an Art Deco ring, the 2.5 carat diamond flanked by smaller diamonds, all set in platinum, sent for sale by a Kent lady and purchased by a Guildford buyer for £4,400. On Monday November 10, Ewbank’s in-house jewellery specialist Andrea Machen will be joined by the firm’s consultant gemmologist to hold a jewellery valuation day and offer advice on buying and selling at auction. The day runs from 10am to 5pm and is free of charge and entirely without obligation. Appointments are not necessary. There was a gem for the gents too, but this one had

advertisement in his local paper. He paid £1,750 with just 18,000 miles on the clock, but it was a rusting wreck. The epic restoration took four years of almost full time work, all recorded in his book “A Mechanic’s Dream”, published by Aston Martin Heritage Trust. Mr Tocock died earlier this year, by which time the Jaguar had passed to another owner. From the same source was a 2005 Jaguar XJ6 SE Automatic, which sold for £4,000 and a 2001 MG MGF, which sold for £1,400. The auction attracted a number


of cars from other deceased estates including a 2011 Volvo V50 SE LUX Edition D3 Automatic (£8,500) and a 1967 classic, a Vauxhall Viva SL, which sold for £2,400, all on or above estimates. One of the most exotic tea caddies seen in a regional saleroom in recent times lived up to expectations when it sold for £3,200 after its Surrey owner had emailed pictures to the saleroom requesting a valuation. Made from ivory, the caddy had a domed top engraved intricately with foliage decoration, while the velvetlined interior has two cut glass bottles with silver lids by Thomas & Jabez Daniell (London 1773). It came from Vizagapatam, an 18th century port and trading post on the Coromandel Coast of southeast India, near Madras, which became a centre for remarkable furniture and works of art. It was purchased by a London buyer who ignored the £1,500-2,500 estimate.

and pique work, the name given to the 18th century decoration, revived by Art Dec craftsmen in the 1920s, using inlaid fragments of silver (or gold) to form patterns. The frames were consigned from a private Surrey home and sold to a London dealer for £1,200, a multiple of their estimate. Most valuable painting in the sale was a dramatic seascape by David James (1853-1904) titles ‘Tide Coming In, St Agnes Bay, Cornwall’ an oil on canvas signed and dated 1888, which sold for £4,000. From a deceased estate, the painting, which measured 20 by 29 inches (51 x by 74cm) had been in the late owner’s family for decades. It was purchased by a Suffolk collector.

A walrus ivory lidded box decorated with engraving and floral tortoiseshell inlay, made by Russian craftsmen from Kholmogory, Archangel, a noted centre for the traditional handicraft, sold to a buyer in Ireland for £1,200. Novelty silver always sells for a premium, as it was with an unusual Victorian cruet set in the form of wheat sheaves, which caught the attention of a collector in Melbourne, Australia. Comprising salt, pepper and mustard pot and spoon, the set was made by London silversmith Charles Edwards and was assayed (tested for silver content) in 1877. Weighing just eight ounces, it sold for an above estimate £1,400, having been sent for sale by a Liverpool owner. Equally charming was a pair of Edwardian silver and tortoiseshell photograph frames applied with stringing

Nearest contender was a dramatic painting recalling one of the many bloody, hand to hand skirmishes between French and German infantry between September and October 1915 in the village of Mesnilles-Hurlus. The watercolour was by the prolific French artist Eugène Galien-Laloue (1854-1941) and sold to a collector in Arizona, bidding live via the Internet for £2,400. An oil on board by the Irish artist James Humbert Craig (1878-1944) showing two figures and a donkey working in the fields, sold for £2,100,

closely followed by a pair of watercolours of coastal landscapes by the Irish artist William Percy French (1854-1920), signed and dated ’99, which sold for £2,000, a multiple of the estimate. They were purchased by a Scottish dealer. The Scottish artist Joseph Farquharson (1846-1935) was represented by an oil on board view of ducks in and near a stream, which sold to a Surrey collector for £1,400, while the most valuable print was an amusing engraving by Richard Muller, titled ‘The Courtship’, which sold for £1,800. Dating from 1914 and signed in pencil in the margin, the print depicted a bashful stork, the bird’s top hat and gloves by his feet, and a standing nude, her face concealed by a bunch of flowers. Most valuable clock was also the oldest and most primitive in the sale: a single-hand, 30-hour lantern clock dating from the 17th century by William Holloway of Stroud, dated 1668, which sold to a Midlands dealer on estimate for £3,000. The sale was also successful for a Surrey bibliophile who consigned a number of rare books. A trio proved the most wanted: number 873 of 1,000 from a limited, first edition copy of James Joyce’s ‘Ulysses’, published on the author’s 40th birthday by Shakespeare & Co in 1922, which sold

to an East Sussex bookshop on top estimate for £6,000; ‘The History of the Royal Residences of Windsor Castle, St James’s Palace, Carlton House, Kensington Palace, Hampton Court, Buckingham House and Frogmore’, by William Henry Pyne, in three volumes printed for A. Dry, 36, Upper Charlotte Street, Fitzroy Square, in 1819, each with numerous coloured illustrations and bound in full red leather, £3,000; and a first edition of ‘The Worst Journey in the World, Antarctic, 1910-1913’ by Aspley Cherry-Garrard, in two volumes, published by Constable & Company Limited, 1922, each with numerous illustrations and maps, £1,200. ANDY WARHOL SILKSCREEN DAZZLES IN EWBANK’S 20TH CENTURY AUCTION ‘Diamond Dust Hearts’ sells to Beverley Hills buyer for £39,000 A diamond-dusted picture by American Pop Artist Andy Warhol, discovered when the contents of a storage unit were auctioned off to settle unpaid charges, sold for £39,000 in Surrey’s premier auctioneer of fine art and antiques Ewbank’s sale of 20th Century Art and Design. It was purchased by a collector living in Beverley Hills, California. The work, a silkscreen titled ‘Diamond Dust Hearts’, was sold originally to pay a removal company’s unpaid bill. It was purchased in an

auction and acquired subsequently by Ewbank’s vendor. He had owned the work for the past 15 years and had now decided to realise his investment. Signed and dated ‘84’ by Warhol on the reverse, the picture of four blue-tinged hearts which glitter in the light was created in silkscreened acrylic paint and coated with the dust of industrial diamonds. It is believed the artist’s fascination with heart imagery began with a Valentine card he sent as a gift in 1979. Warhol popularised silkscreen printing in the

United States, producing a series of diamond dust series including ‘Diamond Dust Shoes’, in his image of the Disney character Mickey Mouse and again in 1985 to add sparkle to the royal edition of his famous ‘Reigning Queens’ series. Two-dimensional art took many of the other top prices in the sale, although two works by the Chinese born contemporary artist Zhuang Hon Yi (born 1962) are three-dimensional in their execution, such is the methods used in their creation. The flower motif dominates Zhuang’s work, the pictures crafted from delicate pieces of painted rice paper, which he bends and folds into hundreds of tiny petals and buds. This was a technique he learned at the Sichuan College of Fine Arts, where he first studied. In Chinese culture, the flower is a significant image, although the paintings bear the influence of Impressionism and other Western taste. other, signed and dated 2011, sold to a Zurich collector for £1,600. In contrast, Luton-born John Plumb (1927-2008) was one of the most notable of the abstract painters to emerge in Britain after the war but who never found the recognition he deserved, although his work is represented in Tate Modern. Formerly employed in Vauxhall Motors’ styling department, he “dropped out” to concentrate on painting in his Chiswick studio, producing work in a style known as “hard edge”. An example in acrylic on canvas dating from around 1970 but untitled, sent for sale from a local owner, sold to a London dealer on estimate for £3,000.

The sale included two such works from the same London vendor, the more valuable proving to be signed and dated 2013 on the reverse, which sold to a bidder in the Netherlands for £1,700. The

Canadian artist David Alexander Colville (19202013) was represented by ‘Toronto Snow’, a striking image in which the viewer sees only the backs of a couple dressing, looking through a window at the white expanse outside. A serigraph (silkscreen) dated 1969, it sold for £2,400. The work had been given to the vendor by the artist as a wedding present in 1979, at which time


Plumb was a neighbour. Appropriately, the buyer was a gallery in Vancouver, British Columbia, once again underlining the auctioneers’ ability to attract international buyers. Colville was a former war artist, born in Toronto. After the war, he joined the fine arts department at Mount Allison University in New Brunswick leaving in 1963 to devote himself to painting and print-making. He was made an Officer of the Order of Canada in 1967, elevated to Companion in 1982, the order’s highest level and his studio home is now named Colville House. Better known is Paul Klee (1879-1940) the Swiss German watercolourist, painter and etcher who became one of the most inventive artists of the 20th century. He was represented by a small, unframed, coloured lithograph titled ‘Park’, the image measuring just five by four inches on paper measuring 10.5 x 7.25 inches. Signed in pencil and dated 1920, number 157 in a limited edition of 300, the lithograph, it was acquired by the vendor’s grandmother, Katherina Matthiesen, in Switzerland sometime after 1938. The vendor’s grandfather was the renowned Berlin and London art dealer Francis Matthiesen.

bronze base signed ‘Lorenzl’, for Josef Lorenzl (1892-1950) the gifted Austrian sculptor and ceramicist. sold for £2,800. The same Somerset vendor consigned an attractive mottled pink cameo glass vase with purple overlay produced at the Schneider glassworks at Epinaysur-Seine in France from about 1918-1933. Signed in cameo ‘Charder’, a contraction of Charles Schneider, it sold to a buyer in Spain for £1,400. Pick of a number of pieces of Arts & Crafts jewellery was a stylish necklace, circa 1910, with five oval cabochon opals set in 9ct gold and linked by a fine chain with seed pearl studded shieldshaped tablets. It sold for £2,100, a multiple of its estimate, the same enthusiasm being shown for a silver necklace comprising four pendant enamelled flowerheads with mother of pearl centres. Both sold to London buyers, the latter for £1,100. Discerning collectors are turning their attention increasingly to contemporary Danish furniture,

It sold to a buyer in the East of England for £1,200. The same money was paid for each of two oils on board by Petersfield, Hampshire. artist Reg Gammon RWA (1894- 1997), one titled ‘Workers in a Yellow Field’, the other ‘Kelp Harvest Brittany’. Gammon produced romantic and intensely coloured landscapes. often speckled with peasant figures gypsies and itinerants working the land. He had a retrospective exhibition at the Royal West England Academy (RWA) in 1985 and held his first one man show aged 92. However, the sale included much more than pictures. A good Art Deco bronze and ivory figure of a coquettish dancer wearing a split skirt, the

pick of which in this sale was a rosewood dinning suite comprising extending table, six chairs and a sideboard by Niels Moller (1920-1981) for J.L. Moller, the company he founded in 1944 and which continues today under his son’s ownership. The suite sold for £2,100, while a rosewood ‘Flip Flap’ circular dining table and set of 10 matching chairs with red upholstered seats by Dyrlund, founded in 1960, sold for £1,650, prices both above estimate. EWBANK’S TO SELL THE WILLIAM ‘BILL’ HEWISON STUDIO COLLECTION OF THEATRICAL AND POLITICAL CARTOONS Online sale on December 9-10 in conjunction with The Auction Room Original cartoons and caricatures by legendary cartoonist William “Bill” Hewison which for 30 years kept readers of Punch, The Times, The Listener, The Oldie and Europe magazine smiling are to be sold by Ewbank’s, Surrey’s premier auctioneer of fine art and antiques. The sale of more than 1,000 original drawings by Hewison, art editor of Punch from 1960-1984, will be held over two days on December 9-10. company mittens, and sift through the hundreds and hundreds of roughs submitted by the extraordinary numbers of extraordinary cartoonists which – and, remember, I speak as a writer – made Punch the brilliant and, most important of all, hilarious magazine it was. I miss the six hours of those golden-era Tuesdays when Bill and I would struggle – handicapped by constant helpless laughter – to choose, from 20 times as many, the 50-odd cartoons we needed to lift the readers’ spirits and break their ribs in next week’s magazine.” Ewbank’s sale will showcase Hewison’s original artwork for no fewer than 40 iconic Punch front covers, together with numerous cartoons printed on its pages throughout the period he was associated with it. Another highlight is the collection within a collection of 250 cartoons for theatrical reviews for Punch until its closure in 1992 and subsequently commissioned by The Times. Hewison was a theatre caricaturist for 30 years. The sale offers the opportunity to purchase a caricature of virtually every actor who has been in a major production on the London stage from 1960-2000. Each drawing is inscribed with the name of the play, the theatre in which it was being staged, the opening date and, most importantly, the names of the actors and actresses depicted, making the cartoons a unique archive in their own right. Elsewhere the collection includes topical, political and simply humorous cartoons such as one lampooning the “BBC Censorship Department”, its male and female members sitting naked in a bath; President Nixon; “The British in Los Angeles”; “Salvador Dali as he might have been”, showing the eccentric lying on a psychiatrist’s couch being consulted by a likeness of himself; a grotesque old man holding a glass eye; “Three monarchs perhaps the gloomiest, the greatest and the filthiest; “If we had a Fascist Britain; “The scene at London termini at this time of year makes one doubt whether we are really preparing our young for the infinite variety of adult life”; and “Tribute to Gerald Scarfe”. The 1,050 individual drawings will be sold in 578 lots, of which 464 are single cartoons. Estimates are highly affordable, ranging from £30 to £300. The most valuable single lot comprises Hewison’s original 19 illustrations published in Roy Lewis’s 1959 book “What we did to Father”, a story charting human evolution, centred on the lives of a Stone Age family. It is estimated at £200-300. A selection of around 100 lots from the collection will be on public view in central London at Dreweatts & Bloomsbury Auctions, 24 Maddox Street W1 from 9.30am to 5.30pm from November 17-21. About the artist William “Bill” Hewison (1925-2002) was born in South Shields, County Durham, the youngest son in a family of greengrocers. His father was a sign maker and decorator, and the young Hewison began to paint and draw at an early age. He attended South Shields Art School from 1941 to 1943 but his training was interrupted during the Second World War, during which time he served as a gunner and a wireless operator with the 1st Royal Tank Regiment in France and Egypt. On demobilisation, he returned to study painting and obtained an Art Teacher’s Diploma, which he put to use as the assistant art master at The Latymer School in Hammersmith from 1950-56. His first cartoon was published in 1949 in the saucy literary magazine Lilliput, and he began contributing to Punch from 1950. In 1956, after years of work as a freelance artist, Hewison was invited to join the Punch editorial board as deputy art editor. He won the position over Quentin Blake, only because, Hewison said, he was Blake’s senior. He became art editor in 1960 and was responsible, with the editor, for selecting all of the cartoons that would appear in the magazine. Hewison also contributed to Punch in

his own right as an illustrator, cartoonist and cover artist and, from 1961, as the theatre caricaturist, a job that he inherited from Ronald Searle, partially because Hewison had worked as an amateur actor during his school days. He loved the theatre, and grew to love this job, which he continued after he left Punch. Hewison worked subsequently for various other publications, and when Punch closed in 1992, he began to work as theatre caricaturist for The Times. He exhibited at the National Theatre every five years, beginning in 1980, and his drawings of various actors are now in countless private collections. Until his death in 2002, Hewison continued to be a presence at lunches around the famous Punch table carved with the initials of staff and contributors, including his own, to which only the most distinguished literary figures and humorists were invited. Interestingly, Hewison’s artwork for a cartoon featuring a performance by Marianne Faithful, Mark Dignam and Nick Williamson in Hamlet at the Round House Theatre, which featured in Punch on March 5, 1969, is inscribed on reverse of the mount: “This picture belongs to William Hewison, it is on permanent loan to the Punch Table Room”. TERMS OF CONSIGNMENT FOR SELLERS 1.

Interpretation. In these Terms the words 'you', 'yours', etc. refer to the Seller and if the consignment of goods to us is made by an agent we assume that the Seller has authorised the consignment and that the consignor has the Seller's authority to contract. Similarly the words 'we', 'us', etc. refer to the Auctioneers.

2.

Commission is charged to sellers calculated per lot, as follows: 15% up to £1,000 - 10% thereafter. Marketing and Internet Listing charge on each lot (sold or unsold) £10. Catalogue illustration / late entry charge on each lot (sold or unsold) £10. Loss and damage warranty 1.5%. All the above are subject to VAT at current rates

3.

Removal costs. Items for sale must be consigned to the sale room by any stated deadline and at your expense. We may be able to assist you with this process but any liability incurred to a carrier for haulage charges is solely your responsibility.

4.

Loss and damage warranty (a) All goods on our premises are warranted against fire, theft or accidental damage while on our premises and sellers are charged at the rate of 1.5% of the hammer price plus VAT or our best estimate of what the hammer price would have been had the goods sold.

5.

Illustrations. Almost all lots in our sales are illustrated on the internet. There are is a £10 plus VAT marketing and internet listing charge. Many lots in our Quarterly Fine and Specialist sales have an illustration in a physical catalogue. Where this is the case, or where a lot is entered for sale after the published catalogue closing date, then there is a £10 plus VAT catalogue illustration charge. The copyright in respect of such illustrations shall be the property of us, the auctioneers, as is the text of the catalogue.

6.

Minimum bids and our discretion. Goods will normally be offered subject to a reserve agreed between us before the sale in accordance with clause 7. We may sell Lots below the reserve provided we account to you for the same sale proceeds as you would have received had the reserve been the hammer price. If you specifically give us "discretion" we may accept a bid of up to 20% below the formal reserve.

7.

Reserves. (a) You are entitled to place prior to the auction a reserve on any lot consigned, being the minimum hammer price at which that lot may be sold. Reserves must be reasonable and we may decline to offer goods which in our opinion would be subject to an unreasonably high reserve (in which case goods carry the storage and Loss and Damage Warranty charges stipulated in these Terms of Consignment). (b) A reserve once set cannot be changed except with our consent. (c) Where a reserve has been placed only we may bid on your behalf and only up to the reserve (if any) and you may in no circumstances bid personally.

8.

Electrical items. These are subject to detailed statutory safety controls. Where such items are accepted for sale you accept responsibility for the cost of testing by external contractors. Goods not certified as safe by an electrician (unless antiques) will not be accepted for sale. They must be removed at your expense on your being notified. We reserve the right to dispose of unsafe goods as refuse, at your expense.

9.

Soft furnishings. The sale of soft furnishings is strictly regulated by statute law in the interests of fire safety. Goods found to infringe safety regulations will not be offered and must be removed at your expense. We reserve the right to dispose of unsafe goods as refuse, at your expense. The rights of disposal referred to in clause 8 and 9 are subject to the provisions of The Torts (Interference with Goods) Act 1977, Schedule 1, a copy of which is available for inspection on request

10. Descriptions. Please assist us with accurate information as to the provenance etc. of goods where this is relevant. There is strict liability

for the accuracy of descriptions under modern consumer legislation and in some circumstances responsibility lies with sellers if inaccuracies occur. We will assume that you have approved the catalogue description of your lots unless informed to the contrary. Where we are obliged to return the price to the buyer when the lot is a deliberate forgery under Condition 15 of the Conditions of Sale and we have accounted to you for the proceeds of sale you agree to reimburse us the sale proceeds. The liability to reimburse the sale proceeds shall not arise where you are acting reasonably and honestly and are unaware of the forgery but we are or ought to have been aware of it. 11. Unsold and withdrawn items. If an item is unsold it may with your consent be re-offered at a future sale. Where in our opinion an item is unsaleable you must collect such items from the saleroom promptly on being so informed. Otherwise, storage charges may be incurred. We reserve the right to charge for storage in these circumstances at a reasonable daily rate. 12. Withdrawn and bought in items. These are liable to incur a charge of 10 % plus VAT on being bought in or withdrawn after being catalogued. Minimum charge £10. 13. Conditions of Sale. You agree that all goods will be sold on our Conditions of Sale. In particular you undertake that you have the right to sell the goods either as owner or agent for the owner. You undertake to compensate us and any buyer or third party for all losses liabilities and expenses incurred in respect of and as a result of any breach of this undertaking. 15. Authority to deduct commission and expenses and retain premium and interest. (a) You authorise us to deduct commission at the stated rate and all expenses incurred for your account from the hammer price and consent to our right to retain beneficially the premium paid by the buyer in accordance with our Conditions of Sale and any interest earned on the sale proceeds until the date of settlement. (b) You authorise us in our discretion to negotiate a sale by private treaty not later than the close of business on the day of the sale in the case of lots unsold at auction, in which case the same charges will be payable as if such lots had been sold at auction and so far as appropriate these Terms apply. 16. Warehousing. We disclaim all liability for goods delivered to our saleroom without sufficient sale instructions. and reserve the right to make minimum warehousing charge of £5 per lot per day. Unsold lots are subject to the same charges if you do not remove them within a reasonable time of notification. If not removed within three weeks we reserve the right to sell them and defray charges from any net proceeds of sale or at your expense to consign them to the local authority for disposal. 17. Settlement. After sale settlement of the net sum due to you normally takes place 21 days after the sale (by crossed cheque to the seller) unless the buyer has not paid for the goods. In this case no settlement will then be made but we will take your instructions in the light of our Conditions of Sale. You authorise any sums owed by you to us on other transactions to be deducted from the sale proceeds. You must note the liability to reimburse the proceeds of sale to us as under the circumstances provided for in Condition 10 above. You should therefore bear this potential liability in mind before parting with the proceeds of sale until the expiry of 21 days from the date of sale.

CONDITIONS OF SALE Ewbank’s carries on business with bidders, buyers and all those present in the auction room prior to or in connection with a sale on the following General Conditions and on such other terms, conditions and notices as may be referred to herein. 1. DEFINITIONS In these Conditions:

(a) "auctioneer” means the firm of Ewbank’s or its authorised auctioneer, as appropriate; (b) “deliberate forgery” means an imitation made with the intention of deceiving as to authorship, origin, date, age, period, culture or source but which is unequivocally described in the catalogue as being the work of a particular creator and which at the date of the sale had a value materially less than it would have had if it had been in accordance with the description; (c) “hammer price” means the level of bidding reached (at or above any reserve) when the auctioneer brings down the hammer; (d) “terms of consignment” means the stipulated terms and rates of commission on which Ewbank’s accepts instructions from sellers or their agents; (e) “total amount due” means the hammer price in respect of the lot sold together with any premium, Value Added Tax chargeable and any additional charges payable by a defaulting buyer under these Conditions; (f) “sale proceeds” means the net amount due to the seller, being the hammer price of the lot sold less commission at the stated rate, Value Added Tax chargeable and any other amounts due to us by the seller in whatever capacity and however arising; (g) “You”, “Your”, etc. refer to the buyer as identified in Condition 2 (h) The singular includes the plural and vice versa as appropriate.

2. BIDDING PROCEDURES AND THE BUYER (a) Bidders are required to register their particulars before bidding and to satisfy any security arrangements before entering the auction room to view or bid; (b) the maker of the highest bid accepted by the auctioneer conducting the sale shall be the buyer at the hammer price and any dispute about a bid shall be settled at the auctioneer’s absolute discretion by reoffering the Lot during the course of the auction or otherwise. The auctioneer shall act reasonably in exercising this discretion. (c) Bidders shall be deemed to act as principals. (d) Our right to bid on behalf of the seller is expressly reserved up to the amount of any reserve and the right to refuse any bid is also reserved. 3. INCREMENTS Bidding increments shall be at the auctioneer’s sole discretion. 4. THE PURCHASE PRICE The buyer shall pay the hammer price together with a premium thereon of 25.2% inclusive of VAT [or incremental] at the rate imposed by law. 5. VALUE ADDED TAX Value Added Tax on the hammer price is imposed by law on all items affixed with a ‘†’ or double asterisk. Va l u e Added Tax is charged at the appropriate rate prevailing by law

at the date of sale and is payable by buyers of relevant Lots. (Please refer to “Information for Buyers” for a brief explanation of the VAT position). 6. PAYMENT (1) Immediately a Lot is sold you will: (a) give to us, if requested, proof of identity, and (b) pay to us the total amount due in cash or in such other way as is agreed by us. (c) Any payments by you to us may be applied by us towards any sums owing from you to us on any account whatever without regard to any directions of you or your agent, whether express or implied. 7. TITLE AND COLLECTION OF PURCHASES (1) The ownership of any Lots purchased shall not pass to you until you have made payment in full to us of the total amount due. (2) You shall at your own risk and expense take away any lots that you have purchased and paid for not later than 3 working days following the day of the auction or upon the clearance of any cheque used for payment after which you shall be responsible for any removal, storage and Loss and Damage Warranty charges. (3) No purchase can be claimed or removed until it has been paid for. 8. REMEDIES FOR NON-PAYMENT OR FAILURE TO COLLECT PURCHASES (1) If any Lot is not paid for in full and taken away in accordance with these Conditions or if there is any other breach of these Conditions, we, as agent for the seller and on our own behalf, shall at our absolute discretion and without prejudice to any other rights we may have, be entitled to exercise one or more of the following rights and remedies: (a) to proceed against you for damages for breach of contract; (b) to rescind the sale of that Lot and/or any other Lots sold by us to you; (c) to resell the Lot (by auction or private treaty) in which case you shall be responsible for any resulting deficiency in the total amount due (after crediting any part payment and adding any resale costs). Any surplus so arising shall belong to the seller; (d) to remove, store and insure the Lot at your expense and, in the case of storage, either at our premises or elsewhere; (e) to charge interest at a rate not exceeding 1.5% per month on the total amount due to the extent it remains unpaid for more than 3 working days after the sale; (f) to retain that or any other Lot sold to you until you pay the total amount due; (g) to reject or ignore bids from you or your agent at future auctions or to impose conditions before any such bids shall be accepted; (h) to apply any proceeds of sale of other Lots due or in future becoming due to you towards the settlement of the total amount due and to exercise a lien (that is a right to retain possession of) any of your property in our possession for any purpose until the debt due is satisfied. (i) We shall, as agent for the seller and on our own behalf pursue these rights and remedies only so far as is reasonable to make appropriate recovery in respect of breach of these conditions

THIRD PARTY LIABILITY All members of the public on our premises are there at their own risk and must note the lay-out of the accommodation and security arrangements. Accordingly neither the auctioneer nor our employees or agents shall incur liability for death or personal injury (except as required by law by reason of our negligence) or similarly for the safety of the property of persons visiting prior to or at a sale. 10. COMMISSION BIDS Whilst prospective buyers are strongly advised to attend the auction and are always responsible for any decision to bid for a particular Lot and shall be assumed to have carefully inspected and satisfied themselves as to its condition we will if so instructed clearly and in writing execute bids on their behalf. Neither the auctioneer nor our employees or agents shall be responsible for any failure to do so save where such failure is unreasonable. Where two or more commission bids at the same level are recorded we reserve the right in our absolute discretion to prefer the first bid so made. 11. WARRANTY OF TITLE AND AVAILABILITY The seller warrants to the auctioneer and you that the seller is the true owner of the property consigned or is properly authorised by the true owner to consign it for sale and is able to transfer good and marketable title to the property free from any third party claims.

(2) Private treaty sales made under these Conditions are deemed to be sales by auction for purposes of consumer legislation.

15. FORGERIES Notwithstanding the preceding Condition, any Lot which proves to be a deliberate forgery (as defined) may be returned to us by you within 21 days of the auction provided it is in the same condition as when bought, and is accompanied by particulars identifying it from the relevant catalogue description and a written statement of defects. If we are satisfied from the evidence presented that the Lot is a deliberate forgery we shall refund the money paid by you for the Lot including any buyer’s premium provided that:-

(1) if the catalogue description reflected the accepted view of scholars and experts as at the date of sale

- or (2) you personally are not able to transfer a good and marketable title to us, you shall have no rights under this condition. The right of return provided by this Condition is additional to any right or remedy provided by law or by these Conditions of Sale GENERAL 16. We shall have the right at our discretion, to refuse admission to our premises or attendance at our auctions by any person. 17. (1) any right to compensation for losses liabilities and expenses incurred in respect of and as a result of any breach of these Conditions and any exclusions provided by them shall be available to the seller and/or the auctioneer as appropriate.

12. AGENCY The auctioneer normally acts as agent only and disclaims any responsibility for default by sellers or buyers.

13. TERMS OF SALE The seller acknowledges that Lots are sold subject to the stipulations of these Conditions in their entirety and on the Terms of Consignment as notified to the consignor at the time of the entry of the Lot.

18. Any notice to any buyer, seller, bidder or viewer may be given by first class mail or Swiftmail in which case it shall be deemed to have been received by the addressee 48 hours after posting.

14. DESCRIPTIONS AND CONDITION (1) Whilst we seek to describe Lots accurately, it may be impractical for us to carry out exhaustive due diligence on each lot. Prospective buyers are given ample opportunities to view and inspect before any sale and they (and any independent experts on their behalf) must satisfy themselves as to the accuracy of any description applied to a lot. Prospective buyers also bid on the understanding that, inevitably, representations or statements by us as to authorship, genuineness, origin, date, age, provenance, condition or estimated selling price involve matters of opinion. We undertake that any such opinion shall be honestly and reasonably held and accept liability for opinions given negligently or fraudulently. Subject to the foregoing neither we the auctioneer nor our employees or agents nor the seller accept liability for the correctness of such opinions and all conditions and warranties, whether relating to description, condition or quality of lots, express, implied or statutory, are hereby excluded. This Condition is subject to the next following Condition concerning deliberate forgeries and applies save as provided for in paragraph 6 ‘information to buyers’.

(2) Such rights and exclusions shall extend to and be deemed to be for the benefit of employees and agents of the seller and/or the auctioneer who may themselves enforce them.

19. Special terms may be used in catalogue descriptions of particular classes of items in which case the descriptions must be interpreted in accordance with any glossary appearing at the commencement of the catalogue. 20. Any indulgence extended to bidders buyers or sellers by us notwithstanding the strict terms of these Conditions or of the Terms of Consignment shall affect the position at the relevant time only and in respect of that particular concession only; in all other respects these Conditions shall be construed as having full force and effect. 21. English law applies to the interpretation of these Conditions.
