Protect your children with a Life Interest Will If you’ve remarried following divorce or bereavement, and have children from your former marriage, a Life Interest Will can protect your children’s inheritance at the same time as ensuring the financial security of your current spouse.

If you were to draw up a standard Will leaving everything to your new partner, your assets would become theirs when you died. Then, on their death, those assets are passed on to their beneficiaries – totally depriving your children from a former marriage of any inheritance.

However, a ‘Life Interest Will’ allows you to avoid this situation, keeping you in control of where your assets are distributed - for example the family home. If you own the home outright and want to leave it to your children but allow your current partner to live in it after you have died, you can give your partner a life interest in the property. This means that after you die they can live in the property until they die (or remarry if you prefer), at which time it passes to your beneficiaries.

The same applies if you jointly own a property with your new spouse. You can give your partner a ‘life interest’ in your share of the property – allowing them to live there after your death but ensuring it passes onto your children from your first marriage when your new partner dies or remarries. For more information on Life Interest Wills, or to book a free initial consultation, call Nadia Faki, Davina Charlton or Annam Nasir now on 01858 445480.

Legal expert Lisa Bacon, a Director at Salusbury Harding & Barlow Solicitors, explains how you can plan ahead to avoid unnecessary hassle.

Salusbury Harding & Barlow advise all clients to make a Lasting Power of Attorney (LPA) in respect of their financial affairs and their health and welfare.

As we get older it’s good to have the peace of mind that comes from knowing that our affairs are in order. Just a little planning now can avoid hassle and stress later down the line -just when you or your family need it the least. Tings to consider include making sure that a Lasting Power of Attorney and an up-to-date Will are in place.

These documents allow a nominated person to make a decision on someone’s behalf should they become incapacitated. People often overlook health and welfare LPAs. but we strongly urge clients to consider them because they relate to nursing home choice, medical decisions and end of life plans.

If there’s a property to sell to enable a move into a care home, then a legal firm can also take care of the conveyancing. A variety of circumstances can make a Will outdated. These include getting married a er a Will was made (if the Will was not made in contemplation of the marriage), a change in your wishes and a change in the value of your assets. It may also be the case that your Executors are no longer able to fulfil their role.

Some people find it preferable to meet a legal professional in their own home or in a care setting such as a hospital or nursing home, so the firm’s experts are geared-up for visiting clients throughout Leicestershire and Rutland. Salusbury Harding & Barlow is a family-run practice that has a reputation for putting people first, pledging a high level of personal attention along with value for money.

Experts at Salusbury Harding & Barlow can be named as Executors, should this be required, and this can avoid putting relatives through the stress and conflict that can so often arise from administering a Will.
