A pregnant Utah woman gave her baby an eviction notice and made it official with a judge’s signature. The baby promptly obeyed. Kaylee Bays was pregnant with her third child, and thought she was going into labor last week, but it stopped. She returned to work as a judicial assistant in Provo, and jokingly asked District Judge Lynn Davis to serve an eviction notice on her baby. A troop ahead of the curve CHEVY CHASE, MD. In the Great Hall of All Saints Church in Chevy Chase, Md., the members of Boy Scout Troop 52 recently planned a trip to Shenandoah National Park. They talked about what clothes to wear, what food to bring and their campsite’s expected elevation. And, as usual, they recited the Boy Scout law. But it wasn’t just boys participating in the meeting and preparing for the trip — girls were a part of the group too. While the Boy Scouts of America announced on Oct. 11 that it will be fully inclusive for girls for the first time in its nearly 100-year history, Troop 52 may be one of the few groups that already know what inclusion looks like. Though the girls are technically part of a Venture Scout crew, which is a co-ed program, they’ve been participating in activities alongside the boys since 1997. In recent years, Boy Scouts of America has changed membership rules, lifting the ban on openly gay scouts and troop leaders and allowing transgender boys. Troop 52 has never been one to wait around for the national organization to officially permit a change. An openly gay scout, Pascal Tessier, belonged to the troop before the ban on gay troops was lifted and he then became one of the nation’s first openly gay youths to achieve the Eagle Scout ranking under the changed policy. Senior patrol leader Camaran Gaillard, 17, said it’s been normal for him to participate alongside the girls and he’s glad the national change will allow girls to work toward the same recognition as the boys who achieve the highest rank of Eagle Scout. “They’ve always been doing the same Scout skills as we’ve been doing. They’ve always been a part of this troop,” Camaran said. “We’ve grown so accustomed to them being there so it’s not a big deal to us. local MARYLAND A week after a three-judge panel declared a 40-foot cross memorializing veterans unconstitutional, Gov. Larry Hogan on Tuesday directed Maryland’s attorney general to support a legal challenge against the ruling. Hogan told Attorney General Brian Frosh to file an amicus brief in support of the parties challenging the ruling, once an appeal is filed. The ruling this month by a panel of the U.S. Court of Appeals for the 4th Circuit concluded that the memorial “excessively entangles the

government in religion.” In a letter, Hogan noted that the Peace Cross in Bladensburg is a memorial to 49 Prince George’s County residents who died in World War I. The governor also noted that the cross, which is on a state highway median just outside Washington, has been in place for more than 90 years. “The conclusion that this memorial honoring veterans violates the [Constitution’s] Establishment clause offends common sense, is an affront to all veterans, and should not be allowed to stand,” Hogan, a Republican, wrote in the

Arcing problems for Metro on rise Tunnel leaks blamed for electrical failures that could start fires TRANSPORTATION Electrical arcing incidents — which can lead to track fires — have more than doubled on Metro since last summer, a spike that undermines the agency’s contention that safety and reliability are improving. Arcing happens when stray electrical current from the track’s third rail finds an alternate path to the ground, usually because of dirt, mud or puddled water. From July to September, there were 19 arcing events. During the same period in 2016, there were nine such incidents, according to a safety report released Monday by Metro that covered the first three months of the
fiscal year that began July 1. Metro safety officials say the increase was probably caused by water leaking into underground tunnels. The increase in arcing events — with their sometimes dramatic displays of smoke, sparks and fire — is particularly concerning because they were a big part of the reason for the agency’s year-long SafeTrack rehabilitation program. The uptick in incidents is happening while the agency is trying to make the case that the system has gotten safer in the two years since General Manager Paul J. Wiedefeld was brought on and safety oversight was handed to the federal government. “We’re hoping that there’s a way to get this problem under control,” said Metro board member Robert Lauby, vice chairman of the panel’s safety committee. That number includes 71 hires of “senior sergeants” and “senior detectives” — retired officers who have been allowed to return under an emergency measure that ends next year. The added time does not affect their pension benefits. THE DISTRICT The D.C. police department now has more than 3,800 officers, an increase from the previous year when the size of the force fell below that mark for the first time in a decade, prompting concern from city leaders. Police Chief Peter Newsham told Mayor Muriel Bowser and council members Tuesday that fewer officers are leaving each month, an indication the force is stabilizing after years of failing to keep pace with attrition. “I feel comfortable with the size of the force right now,” Newsham said during the meeting at the John A. Wilson Building, where he outlined several incentive programs designed to attract and keep officers.

Authorities said at least seven people were injured when a car drove into a restaurant in Prince George’s County. A spokesman for the fire department said in an online post Tuesday that two people were taken to a hospital with serious but non-life threatening injuries after the incident. A Virginia man who admitted he shot a bald eagle and then ran it over several times with an all-terrain vehicle has been sentenced to a month of house arrest. The VirginianPilot reports that Allen H. Thacker, 62, also was ordered Monday to complete 100 hours of community service at an area wildlife refuge and pay $500 in fines along with $1,500 in restitution. Thacker pleaded guilty in July to violating the Bald and Golden Eagle Protection Act. (AP)

Agencies slacking: More can be done to curb sex abuse “Sexual misconduct is a challenge the federal government must aggressively and consistently address to ensure the well-being and safety of its workforce,” said Chairman Trey Gowdy, R-S.C. “The American people deserve a workforce and a work environment reflective of the law, their high standards for appropriate conduct, and conducive with maximum productivity.” But that challenge is not specifically recognized by seven agencies that “have a Table of Penalties, but do not expressly mention sexual misconduct,” according to the report, which was issued by the majority Republican staff. Citing a Justice Department inspector general’s report on “the dangers associated with the lack of a Table of Penalties,” the House document said the department’s “Civil Division’s handling of sexual misconduct allegations was not consistent, penalties were not consistent for high-performing employees, and employees received performance awards even while the subject of ongoing sexual harassment or misconduct investigations or while disciplinary actions were in effect.”

Amid a growing number of scandals involving serial sexual misconduct cases comes word that Uncle Sam is a real slacker in policing his workforce. The federal workplace might have a better record than a Hollywood casting couch — or it might not. It’s hard to know the extent of sexual misconduct in the federal government because of Uncle Sam’s poor and inconsistent disciplinary practices and record keeping. A House Oversight and Government Reform Committee report says eight agencies have no table of penalties at all, including the Office of Personnel Management (OPM), which should be the model for a government that thinks itself a model employer. A table of penalties is a list of suggested disciplinary actions for various forms of staff misconduct. The government’s largest federal employee union, however, argues against overuse of tables of penalties, liking them to rigid mandatory minimum sentences in the criminal justice area.
Rep. Trey Gowdy, R-S.C., said, “Sexual misconduct is a challenge the federal government must aggressively and consistently address.”
At the other end of the spectrum are the U.S. Agency for International Development and the Federal Aviation Administration (FAA), which has “the most developed list of sexual misconduct categories.” The FAA list has “10 distinct categories of sexual misconduct,” said the House report, including sexual teasing; suggestive looks or gestures of a sexual nature; and the threat or act of reprisal for refusal to provide sexual favors. The American Federation of Government Employees
(AFGE) argued that “the report’s reliance on the use of a table of penalties as a solution is misplaced,” and said moves to undermine civil service protections weaken the fight against sexual harassment. “Efforts underway in this Congress to roll back union rights and hamstring unions will make it more difficult for the union to help police workplace sexual misconduct,” the union statement said. The TSP for federal employees and military personnel operates under many of the same tax code provisions as 401(k)s, including what is called the “elective deferral limit.” That figure will rise from $18,000 to $18,500 in 2018. For those making both pretax and after-tax “Roth” investments, it applies to the combination. That limit counts only personal investments and not agency contributions into the TSP accounts of employees under the Federal Employees Retirement System. They get an automatic employer contribution of 1 percent of salary, plus up to another 4 percent in matching contributions. The TSP also mirrors general tax policy in allowing “catch-up contribution” investments in a year by those who are age 50 or older, if they reach the regular limit or are investing at a rate to hit it by the end of the year. That maximum will remain $6,000. Regular investments continue year to year unless changed, so to take advantage of the higher limit you’ll have to make a new payroll withholding election in 2018. ENVIRONMENT A nonpartisan federal watchdog says climate change is already costing U.S. taxpayers billions of dollars each year, with those costs expected to rise as devastating storms, floods, wildfires and droughts become more frequent in future decades. A Government Accountability Office report released Monday said the federal government has spent more than $350 billion in the last decade on disaster assistance programs and losses from flood and crop insurance. That tally does not include the massive toll from this year’s wildfires and hurricanes. The report predicts these costs will average $35 billion each year by 2050. Recent history suggests that is a conservative estimate. “The impacts and costs of extreme events … will increase in significance as what are considered rare events become more common and intense because of climate change,” the report said. It also chastised the government for inadequate planning to manage climate risks. President Trump has announced his intent to withdraw from the Paris climate accord and revoke Obama-era initiatives to curb greenhouse gas emissions. He has also appointed Cabinet officials who question the scientific consensus that carbon released into the atmosphere from burning fossil fuels is the primary driver of global warming. POLITICS A pair of senators from President Trump’s own Republican Party blistered him with criticism Tuesday in a dramatic day of denunciation that laid bare a GOP at war with itself. Jeff Flake of Arizona declared he would not be “complicit” with Trump and announced his surprise retirement, while Bob Corker of Tennessee said the president “debases our nation” with constant untruths and name-calling. Corker, too, is retiring at the end of his term, and the White House shed no tears at the prospect of the two GOP senators’ departures. Andy Surabian — a former adviser to Steve Bannon, Trump’s ex-strategist — called it all “a monumental victory for the Trump movement.” At midafternoon, Flake stood at his Senate desk and delivered an emotional speech in which he dissected what he considered his party’s accommodations with Trump and said he could no longer play a role in them. “We were not made great as a country by indulging in or even exalting our worst impulses, turning against ourselves, glorifying in the things that divide us and calling fake things true and true things fake,” Flake said. Hours earlier, Corker leveled his own searing criticism of Trump in a series of interviews. “I think the debasement of our nation will be what he’ll be remembered most for and that’s regretful,” Corker said. A furious Trump didn’t let that pass unremarked. On Twitter, he called Corker “incompetent,” said he “doesn’t have a clue” and claimed the two-term lawmaker “couldn’t get elected dog catcher in Tennessee.” An overstatement to be sure, but White House spokeswoman

Sarah Huckabee Sanders said in regard to the impending retirements, “The people both in Tennessee and Arizona supported this president, and I don’t think that the numbers are in the favor of either of those two senators in their states and so I think this was probably the right decision.” Until Tuesday, Flake had insisted he had no plans to retire. He was raising money at a good rate and casting his re-election campaign as a test case of conservatism against Trumpism. But he made clear Tuesday he’d concluded that, for now at least, Trumpism had prevailed. “It is clear at this moment that a traditional conservative who believes in limited government and free markets, who is devoted to free trade, who is proimmigration, has a narrower and narrower path to nomination in the Republican Party,” he said. Corker’s retirement plans also underscore the question of what the Republican Party will look

POLITICS The Hillary Clinton campaign and the Democratic National Committee helped fund research that resulted in a now-famous dossier containing allegations about Donald Trump’s connections to Russia and possible coordination between his campaign and the Kremlin, people familiar with the matter said. Marc E. Elias, a lawyer representing the Clinton campaign and the DNC, retained Fusion GPS, a Washington firm, to conduct the research. After that, Fusion GPS hired dossier author Christopher Steele, an ex-British intelligence officer with ties to the FBI and the U.S. intelligence community. Elias and his law firm, Perkins Coie, retained the firm in April 2016 on behalf of the Clinton campaign and the DNC. Prior to that, Fusion GPS’ research into Trump was funded by an unknown Republican client. The Clinton campaign and the DNC through the law firm continued to fund the research through the end of October 2016. The Democrats paid for research, including by Fusion GPS, because of concerns that little was known about Trump and his business interests, sources say. President Trump’s four-month worldwide ban on refugees ended Tuesday, officials said, as his administration prepared to unveil tougher new screening procedures. Under an executive order Trump signed earlier this year, the U.S. had temporarily halted admissions for refugees from all countries, with some exceptions. The end-date written into the order came and went Tuesday with no new order from Trump to extend it. Tiny firm gets big relief deal Puerto Rico utility signs $300M contract with a 2-year-old company

PUERTO RICO For the sprawling effort to restore Puerto Rico’s crippled electrical grid, the territory’s state-owned utility has turned to a 2-year-old company from Montana that had just two full-time employees on the day Hurricane Maria made landfall. The company, Whitefish Energy, said last week that it had signed a $300 million contract with the Puerto Rico Electric Power Authority to repair and reconstruct large portions of the island’s electrical infrastructure. The contract is the biggest yet issued in the troubled relief effort. Whitefish said Monday it has 280 workers in the territory, using linemen from across the country, most of them as subcontractors, and that the number grows on average from 10 to 20 people a day. The power authority, also known as PREPA, opted to hire Whitefish rather than activate the “mutual aid” arrangements it has with other utilities. For many years, such agreements have helped U.S. utilities — including those in Florida and Texas recently — recover quickly after natural disasters. The unusual decision to instead hire a tiny for-profit company is drawing scrutiny from Congress and comes amid

concerns about bankrupt Puerto Rico’s spending as it seeks to provide relief to its 3.4 million residents, the great majority of whom remain without power a month after the storm. “The fact that there are so many utilities with experience in this and a huge track record of helping each other out, it is at least odd why [the utility] would go to Whitefish,” said Susan F. Tierney, a former senior official at the Energy Department and state regulatory agencies. “I’m scratching my head wondering
how it all adds up.” PREPA’s executive director, Ricardo Ramos, and a spokesman did not respond to emails asking why the utility didn’t activate the mutual-aid network. On a tour of the idled Palo Seco power plant, Ramos told reporters that Whitefish was the first company “available to arrive and they were the ones that first accepted terms and conditions for PREPA.” Ramos said that the utility is “completely content” with the work Whitefish is doing.
Whitefish officials acknowledged it had only two full-time employees when Maria struck but say its business model calls for ramping up rapidly by hiring workers on short-term contracts. Whitefish Energy is based in Whitefish, Mont., the hometown of Interior Secretary Ryan Zinke. Its chief executive, Andy Techmanski, and Zinke acknowledge knowing one another — but only, Zinke’s office said in an email, because Whitefish is a small town where “everybody knows everybody.” One of Zinke’s sons “joined a friend who worked a summer job” at one of Techmanski’s construction sites, the email said. Zinke’s office said he had no role in Whitefish securing the contract for work in Puerto Rico. Techmanski also said Zinke was not involved. Techmanski said that the contract emerged from discussions between his company and the utility rather than from a formal bidding process. He said he had been in contact with the utility two weeks before Maria “discussing the ‘what if’ scenarios” of hurricane recovery. The House Committee on Natural Resources is examining Whitefish’s role in Puerto Rico, said Parish Braden, a spokesman for the committee. “The size and unknown details of this contract raises numerous questions,” he said. According to a study published in Proceedings of the National Academy of Sciences, unlike modern trees that lay down a growth ring under the bark each year, new growth would form in rings around each of the individual strands spaced around the perimeter of a hollow trunk. Congress OKs $36.5B to fund disaster relief Congress gave final approval Tuesday to a $36.5 billion emergency spending plan to pay for ongoing relief from recent natural disasters — but lawmakers from storm-ravaged states are expecting more money next time. The spending deal includes $18.7 billion for the Federal Emergency Management Agency’s response to disasters stretching from Puerto Rico to Northern California. There’s also a $16 billion increase in the National Flood Insurance Program’s borrowing limit; $576.5 million to address wildfires in the West; and $1.2 billion for nutrition assistance programs for low-income residents of Puerto Rico. Relief for Puerto Rico after Hurricane Maria dominated the latest round of emergency funding. More than 80 percent of the island is still without power more than a month after the storm, and there are growing concerns that a failure to restore power and provide basic services to residents could cause a mass exodus to the mainland U.S. The bill now goes to President Trump for his signature. The White House has assured lawmakers concerned about issues such as flood insurance reforms and more aid for their states that they will be addressed in the next round of emergency funding. Xi tightens grip on China BEIJING The ruling Communist Party on Tuesday formally lifted President Xi Jinping’s status to China’s most powerful ruler in decades, setting the stage for the authoritarian leader to tighten his grip on the country while pursuing an increasingly muscular foreign policy and military expansion. The move to insert Xi’s name a nd dogma i nto the
party’s constitution alongside the party’s founders came at the close of a twice-a-decade congress that gathered the Xi country’s ruling elite alongside rank-and-file party members. Here’s the best way to describe the status of Terrelle Pryor Sr. in Washington’s offense: When Kirk Cousins was asked specifically about his outside receivers following a limp loss to the Eagles on Monday night, the quarterback mentioned six names — including two tight ends and a running back. Pryor’s name didn’t come up. After a first-half benching against the Eagles, Pryor said he wasn’t sure if he’d sit again Sunday versus Dallas. “That’s a good question,” he said. “I don’t know.” To the many problems on coach Jay Gruden’s agenda — a battered offensive line, a defense that’s given up 87 points over three games, a secondary with more injuries than interceptions, a team-wide tendency to close games with a whimper — add this one: The head coach just sidelined his presumed top wideout on national television. He did so,
Gruden said, to provide more chances to second-year man Josh Doctson, who responded by setting a career high in receptions … with three. Maybe it wouldn’t matter if the whole crew was rotating in and out. The first-half rotation, though, skipped right over Pryor, not just in favor of Doctson but also Ryan Grant, the fourth-year man who caught nine passes last season. Pryor had 77 with the Browns, and then arrived in Washington suggesting there were greater things in store. Surely, he must have been surprised to find himself on the field for just one play in the first quarter? “First quarter? First half,” Pryor noted. “I didn’t play at all. You know, that’s coach’s call.” Pryor, to be fair, said the right things about this stunning rebuke. That he was rooting for his teammates. That he trusts his coaches. That there’s a lot of season left and he’s not the only receiver struggling to get in rhythm with a new team.

Sent to the bench: Redskins’ Pryor reaches new low
Terrelle Pryor Sr. played in 84 percent of Washington’s offensive snaps in Week 1. He was on the field for just 47 percent of them on Monday night.
Still, this had to sting for a player who arrived on a oneyear prove-it deal. Pryor’s public message has remained upbeat, but you have to wonder whether the team’s flashiest free agent signing will turn into not just a disappointment, but an actual bust. The former 1,000-yard receiver, signed to help replace Pierre Garcon and DeSean Jackson, played a season-low 30 snaps Monday — less than half his total from the week before. He’s totaled 37 yards over the past two weeks. His 223 yards receiving rank 91st in the league. When he was on the
field in the second half Monday, he caught two short passes and dropped two balls. He promised not to turn diva, saying “you’re not going to see any animosity with me, you’re not going to see me angry.” Still, this all has been an unpleasant development. He came here strikingly sure of himself. Monday night, he was asked why it’s been so difficult to get involved in Washington’s offense. “I’m not sure,” he said. “I’m not sure.”
Last Friday, buried behind the news that manager Dusty Baker wouldn’t be back in Washington, the Nationals put out a one-paragraph news release that said AllStar second baseman Daniel Murphy had microfracture surgery to repair articular cartilage in his right knee. A timeline wasn’t included, but there’s a chance that Murphy, 32, won’t be ready for opening day in 2018. Two orthopedic specialists who haven’t seen the damage in Murphy’s knee but have experience with the injury said he will need six to 12 months to make a full recovery. The Nats’ season begins March 29, a little more than five months after the procedure, and Murphy will likely need a rehab assignment. (TWP)

Pike & Rose in North Bethesda continues its growth with the addition of condos wrought-iron railings and streetlamps with flower-filled planters. Symbols incorporated into steps, railings and building details include ampersands for the “&” in Pike & Rose. The community is designed with numerous outdoor spaces where people can gather to socialize. In addition to restaurants and retail shops, Pike & Rose is home to the Amp by Strathmore music venue, an iPic movie theater and the bowling and bocce venue Pinstripes. “Residents here can have [the] ... experience of walking to restaurants, shops and nightlife” from their apartment or condo, says Michael Ennes, vice president of the residential division at Federal Realty. When complete, Pike & Rose will have 864 apartments and condos, with 12.5 percent in each of its three rental buildings reserved as affordable workforce housing. In addition to three rental buildings — Persei, Pallas and The Henri — a condo building, 930 Rose, will occupy the 11th through 20th floors above the Hilton Canopy hotel and is slated to open during the first quarter of 2018. The 99 condos include units ranging from a 650-square-foot studio to a 2,382-square-foot unit with three bedrooms and

NEIGHBORHOODS If strip malls represent the zenith of the American love affair with the car, new walkable urban-suburban communities exemplify the new love of walking, biking, ride-sharing and relying on public transportation. These “surban” developments are more than a fad; they’re a reimagination of how people prefer to live. Take the Pike & Rose development, which has risen from the former strip malls along Rockville Pike in North Bethesda thanks to Federal Realty Investment Trust. Rather than resembling a planned, cookiecutter “town center,” the neighborhood looks as if it has grown organically. Chris Weilminster, president of the mixed-use division at Federal Realty, says that eventually the roads surrounding Pike & Rose will all connect, part of the developer’s partnership with Montgomery County, which has allocated $150 million for infrastructure improvements in the area. Rockville Pike, Old Georgetown Road, Montrose Parkway and Towne Road form the boundaries of the new development. Developers use the term “placemaking” to describe the process underway at Pike & Rose, where the attention to detail includes stone walls,

A. The insurance coverage for condominiums that is similar to rental coverage is called an HO-6 policy. Every condominium owner in the United States should have it. In fact, in some jurisdictions — including Maryland and the District — it is mandatory for condo owners to have an HO-6 policy. Strict liability applies in those two jurisdictions; that means that if a problem occurs in your unit — such as a pipe that serves only your unit bursts — regardless of fault, you have to pay the association’s deductible. So if you have to pay $5,000 to the association, your HO-6 will pay $4,500 and you will be out of pocket only $500. MUSIC REVIEW Certain people expect certain styles of music to obey certain laws, but the rest of us know that it’s the anti-laws that keep a musical tradition breathing. Here’s an eternal anti-law of jazz: Anything can be played. But there’s a difference between anything and everything, and Christian Scott aTunde Adjuah knows all about it. This year, the 34-year-old trumpeter has released an exquisite trilogy of albums — “Ruler Rebel,” released in March, “Diaspora” in June and “The Emancipation Procrastination,” which debuted last week — where the music feels both coherent and vast. It’s jazz, maybe, but it leans toward trap and techno, starting somewhere between Miles Davis eclat circa 1985 and Jon Hassell
atmospherics circa 1986. And sure, Adjuah could be warning us about the shape of jazz to come, but does every great jazz recording have to be a lighthouse? For right now, he’s just getting comfortable in a fog that feels gorgeously anti-lawful. A serialized triple album probably qualifies as a grand gesture, but this music is made up of elegant micro-gestures, with Adjuah blowing soft, elastic phrases over forward-motion rhythms. His harmonies rarely change altitude, which might thwart our expectations about which muscles a jazz musician is supposed to flex — but hey, that’s how rap and techno producers work, too. Adjuah’s most sympathetic collaborator is Elena Pinderhughes, a tenacious flutist who stands near the center of the triple album’s

two brightest flares. The first comes on “Rebel Ruler” during “Encryption” — over a techno pulse, Pinderhughes begins her solo with a fluttering, six-step ascent as if she’s stepping off this planet, up into heaven. The second comes during the title track of “Diaspora,” where Adjuah and Pinderhughes gently blend
their telepathic phrases, letting us know that we’re back on Earth. It’s a lot like feeling the sun and the breeze on your skin at once. This is airy music. Even when Adjuah’s electronic textures take on a liquid quality, they sound like they’re evaporating. You can hear it best on “The Emancipation Procrastination” during “Videotape,” where the faint electric fizz in the background conjures phantom carbonation, as if the music were literally effervescing into the air. Here, and everywhere else, Adjuah is creating an atmosphere — one with its own temperature, its own humidity, its own taste, its own scent. Is this where jazz is going? There’s simply no filler on her eighth studio album, her first with Atlantic Records. After Kelly Clarkson was quoted in Attitude magazine as saying, “When I was really skinny, I wanted to kill myself,” she tweeted a clarification of her remarks. “I wasn’t ever miserable because I had to be thin.
