ompared to other industries, the live entertainment and event business was robust in 2008 and, according to most industry observers, ticket sales and audience attendance showed little-to-no decline from the previous year. However, this assessment came with a qualification that many of the tickets had been purchased and the events had been held before the more dire economic news came to the forefront in the 4th quarter of 2008. Even after this relatively strong year, the live entertainment and event industry will not be able to rest on its past achievements. Our industry doesn’t operate in a vacuum. Rising unemployment, decreasing disposable income and lack of consumer confidence have the potential to negatively impact ticket sales and the size of the audience. Letting the Industry Know

or Booking Agents, Promoters, Talent Buyers and FBooking Special Event Planers – i.e., the readers of the Facilities Guide – producing successful and profitable

events require that a facility’s staff provide quality service to both the performers and their audiences; by the same token, the facility’s physical attributes: seating, market, lighting, sound, staging, food & beverage, dressing rooms, backstage, access/egress, etc., must be likewise be at a level of quality where they enhance (and do not subtract from) the live event experience. For facility managers, nothing is better than their bookers making the industry know that facility and its staff is doing a great job serving their event clientele. Turn to page 9 of this issue and you too can be part of the process that lets the industry know which venues successfully meet and exceed the expectations of those who book facilities. Booking promoters and other representatives of artists and other performers should always be on the lookout for cost-effective dates to round out a tour and new audiences to increase existing fan bases. This new section shines a spotlight on the demographics of audiences and the selection of facilities within a specific state. Oklahoma, our debut spotlight state, boasts many unique attributes. Its centralized location makes it accessible tours passing through the Southeast, Midwest and Southwest. Plus, Oklahoma City and Tulsa, the state’s two major cities, are vibrant, well-populated urban centers containing diverse new audiences for a wide range of concerts as well as other performances and events. “Cautious Yet Optimistic: Assessing the Live Event Industry” (page 18) is our latest State-of-The-Industry Report. BUSINESS Perspectives 10 Steps for Successful Negotiations By Lee A. Esckilsen

I

n our business and personal lives, negotiating is a skill we use every day. The ability to negotiate skillfully and successfully gives us something we all strive for — Control — over what we have to give in order to receive what we want. Yet negotiating skills — and how to develop them — are something most people know very little about, spend very little time thinking about, and spend even less time working to improve. My career has included the successful management of seven arenas. I teach negotiating strategies and skills in my current position as a university professor. The following process is one that I advocate to my clients as well as teach and encourage my students use in their negotiations. I refer to this as the negotiation progression strategy. 1. Research and preparation • Define specifically what you are negotiating for. • Does the person/organization you will be negotiating with have what you want? • Are there other sources to get what you want? (This can be used as “leverage” later.) • What is your perceived value of what you want? • What is the perceived value of the person/organization you want it from? • You can never research too much. Remember, “Knowledge is power.” 2. Introductions and relationship creation • You need to know with whom you will be negotiating. • You need to establish some type of relationship with the other party. • Does the person(s) you will be negotiating with have the authority to make an agreement with you? 3. Initial offers • Now that you have established what you will be negotiating for and whom you will be negotiating with, you need to make your initial offer. • Some authorities will tell you to let the other person/ company make the initial offer and others will advise you to make the first offer so the other side will set their position based on your offer , either strategy can work, so... • Select your strategy based on what you are negotiating for and with whom you are negotiating. 4. Negotiations • Always be willing to reciprocate. • Use your leverage and the relationship you developed early in the process to move the negotiations forward to a “win-win” close. • Make sure that you document the discussions, decisions and agreements during the negotiations process.

5.Reaching the Best Alternative to a Negotiated Agreement • Make sure that you document the final agreement and get the other party to sign off, literally, before the deal points are sent to a lawyer to be put into a legal document. 6. Contract Development & Signatures • When you receive the contract back from your lawyer, make sure that you read the entire document carefully and give the other party the same opportunity. • Be sure that the contract matches the “spirit” of the agreement reached in the negotiation. • Discuss any issues after the other person/organization has reviewed the document. • Have both parties sign the agreement and have it witnessed if necessary. 7. Implementing the contract • Make sure that all of the people in your organization that will be affected by the contract have an opportunity to thoroughly read the document and ask questions before it is adopted and implemented. 8. Monitoring and Managing the contract • You have worked hard to successful negotiate this contract, so be diligent and make sure that both sides are following the agreement. • Don’t assume that the other side will follow the contract. 9. Evaluate and document the successes and failures of contract • As the contract is running its course, note the parts of the agreement that work or don’t work based on your initial research and facts that were presented in the negotiations. 10. Contract analysis • Use the previous step (9.) as you begin your research and preparation (1.) to start the process of your next successful negotiation progression with that person/company. • Learn from this negotiation progression strategy and apply this knowledge and experience to all future negotiations. • Experience is the great “educator” if you learn from to the lesson it teaches you. 5 Ideas for Better Promotions By Tiffany Davis

“W

hat’s the latest word on event and show promotions? I asked dozens of top promoters, agents and artist reps about the current state of promotion strategies. Here’s what they had to say about what’s working . . . and what isn’t. 1. What are the newest ways to promote a show? Social Media works. Facebook campaigns are the new tried-and-true. Engaging and empowering fans to promote a show through Facebook, Twitter and other social media outlets is the fastest way to reach the most people. Hands down. Online campaigns are best fueled by incentivizing fan bases – discounted tickets and other perks – who in turn spread the word about upcoming shows. 2. What promotions are both successful and cost effective? Street teams are alive and well and “activated” through what else, social media campaigns at virtually no cost. Eblasts to online subscribers of venues, fan clubs and ticket outlets work, too. There are many eblast companies that create sleek emails and manage lists easily and at a low cost. It’s important to be creative with the subject lines and have the copy be short, to the point and fun-to-read in order to optimize your results. Promoters should reach to Blogs and other online forums, which can drive customers to a ticket purchase platform also drive sales. Partnering with local radio or TV, who in turn partner with a local sponsor like a grocery store or other retail outlet to create contests, can be a huge win-win. It may be old school, but it still works. Freebie magazines available in most metro markets are still a go-to for the latest in entertainment. In certain markets some of the old standbys still work—local newspaper ads in smaller towns and even highway billboards can generate buzz. 3. What’s the best way to engage fans at the show? Meet and greets still offer the ultimate fan experience, and an artist who is enthusiastic about meeting their fans makes it even more memorable. 8

Running web contests pre-show and even live from the stage to win a post-show meet and greet are always an exciting way to pump up energy levels in house. Fan club seating upgrades are another motivator for the die-hard. At the end of the day, nothing replaces the experience of a phenomenal show! 4. What obstacles keep venues, promoters and artists from playing nice together? Many reps from the venue, promoter and artist management feel there isn’t enough cooperation from all parties, and the finger always points to the other guy. Here are some typical comments: “Venues often want to advertise the show in their market but face resistance from promoters who won’t permit it. What’s more, promoters don’t include venues in their marketing plans.” “The promoters and artists expect the venue to assume an active role in selling the show, but artists aren’t willing to take an active part in local promotions.” “Agents want too much for artist guarantees making promotion by smaller venues extremely hard.” “Managers don’t respond to requests and inquiries in a timely manner, slowing the wheels of progress on a promotion.” Obviously, cooperation is essential and all parties should not only strive towards a better working relationship together, but iron out promotion details and identify where they will be working together well in advance of the event date. 5. What can all sides agree on? In most cases everyone involved wants an equal split of all profits in exchange for an equal split of the financial risk. Sounds easy enough but in practice it is not always that simple to get everyone on the same page— even when being on the same page is in everyone’s best interest. Additionally, the combination of talent fees resulting in smaller profit margins and competition in the marketplace, the partnership has come to encompass the sharing of ancillary revenues such as food & beverage, merchandise and parking. Industry Forecast: I do see more artists going on the road [in 2012] than last year. However the trend appears to be later than normal artist confirmations, which allows only for smaller marketing windows. This may work for the superstars but for most performers, we need time to build the audience.

What promoters look for: A full-service partner in today’s market. It’s also critical to know what acts/genres can sell tickets in your particular market and to share that information with the promoter. Audience Expectations: Audiences expect more from the entertainment experience than they did in the 80s. Escalating ticket prices and technological advances (HDTV, surround sound, & the internet) have contributed to this expectation level. Audiences expect to be “wowed” from start to finish. Industry Forecast: “A” level acts will continue to do well. As discretionary income continues its slow growth in our shaky economy, the concern I have is for the “B” & “C” level acts. The mid-level acts that keep their ticket prices reasonable will have the best chance to succeed. Management Philosophy: Do the right thing always. Relationships and reputation mean everything in this business. It’s impossible to have longterm success in this field while taking moral and ethical short cuts.

Cautious Yet Optimistic

Assessing the Live Event Industry Rob Beckham, who has more than 20 years experience in the Live Entertainment industry, is Co-Head, with Greg Oswald, of the Nashville office of WME. The clients for whom Beckham is responsible for touring and other activities include: Brad Paisley, Rascal Flatts, Blake Shelton, Reba McEntire, Gary Allan, The Band Perry, Chris Young, and Jerrod Niemann. WME is the result of the 2009 merger of the William Morris Agency with the Endeavor Agency which combined the oldest talent agency in the world with the newest of the “major” agencies, creating what is considered to be the largest talent agency in the world. Jeffrey Byron Bowen is Founder and President / CEO of Starbooker Presents, a full service Talent Booking and Management agency based in Greensboro, North Carolina. Bowen, born into a show business family, worked in front of and behind the scenes since his childhood in the early 1950s, but for the past 22 years, Bowen has concentrated on producing live theatrical and musical events across the country. Starbooker Presents represents a wide range of artists, 18

including Checkered Flag, Scorch Sisters, Charlene Tilton, Kris Moore and Francesca Capasso, providing professional entertainment for concerts, theatrical, sporting events, speakers, trade shows, conventions and special events. Ali Harnell, Senior Vice President, AEG Live/ The Messina Group (since 2004), manages the Southeastern region for AEG, and is responsible for bookings in the region and oversees all aspects of the operations. Harnell also manages AEG’s touring activity for country music’s Sugarland and Keith Urban. Prior to joining AEG, Harnell was Senior Vice President, Clear Channel Entertainment / SFX Entertainment / Pace Concerts (1995 – 2003), moving from her VP/Talent Buyer post at Delsener/ Slater Enterprises in New York in 1995 to run Pace Concerts Southeast. Harnell was also key in reviving concert activity at the historic Ryman Auditorium beginning in 2000. Wendy Kay, President of Utopia Artists & Event Production, joined the Mars Talent Agency, which was founded by her father, in 1985. autious optimism has been the goto phrase used to explain the current state of the Live Event industry. The recession is over, but the recovery has been anemic and the economy remains sluggish. The negative impact on the amount of dollars consumers spend on live entertainment due to an uncertain economy may be a trend the entertainment industry has seen before, but the difference is that today’s tough economy is accompanied by a paradigm shift in what had been a foundation of the music business, traditional record labels and the recording industry.

In a “Virtual Roundtable,” leading promoters, bookers and agents discuss the current and future state of concerts, shows and live events. By Timothy Herrick, Editorial Director

Kirves is an Agent with 30 years experience at all levels of the live Music Business, ranging from Roadie/ Tech to Venue Owner, but more extensively he has worked in the areas of Promoter, Agent, Producer and Talent Buyer. Prior to his current position, he was Northwest Territorial Agent USA and Canada for Buddy Lee Attractions and Operations Director for BLA’s Main Stage division. Artists he worked with include Jeff Foxworthy, Miranda Lambert and Jason Aldean. Not only has the move towards downloaded (both legal and illegal) music depleted industry revenues, but audiences have become more fragmented, their expectations for the Live Event Experience have changed and reaching ticket-buying consumers has become a more complicated affair in our current era. In other words, cautious optimism no longer is valuable analysis. Just how “cautious,” and how “optimistic,” are promoters, agents and bookers about the current state of the live event industry. To get a handle on this, we talked to five professionals who have decades of experience in many facets and levels of live event production to find out just where the cautiousness ends and the optimism begins. The format was a Virtual Roundtable, with interviews being conducted via email, and the responses have been compiled according to general topics. Roundtable participants are: Rob Beckham of WME; Jeffrey Byron Bowen, President/ CEO of Starbooker Presents; Ali Harnell, Senior Vice President; AEG Live/The Messina Group; Wendy Kay, President of Utopia Artists & Event Production; and Gary R. Kirves, CEO of Artist Events. What started as a request to assess 2011 and forecast 2012 turned into an informative, if somewhat sprawling, discussions about the overall state of Live Entertainment specifically and pop culture in general. These professionals not only enlighten readers about a range of issues relevant to the Live Entertainment Industry, but remain devoted to the end results – satisfying audiences with professionally produced events. 19

Current State of the Live Music Industry Rob Beckham: I actually think we are in great shape. Sales are strong and I see nothing in the near future that changes that. The economy is getting stronger, and concert fans have more discretionary income to spend. Wendy Kay: I believe the economy has gotten worse, ticket prices are way too high, gas prices too high and the internet allows consumers to stay at home and enjoy artists music right from home. Jeff Bowen: I truly believe that “things” are improving. I can feel a turnaround with acts wanting to get back out there. We are seeing newer and bigger family shows getting ready to tour, and corporate money is beginning to free up. Ali Harnell: Business for a promoter (even at the biggies) was tougher than ever in 2011. The country’s economic state was an extreme challenge. Yet, if you made the right deal with the act, scale the house right for the patrons, kept a tight eye on expenses, cut the best deal with the venue, you did alright. 2011 ended up surprising me a great deal. Gary R. Kirves: I’d be a liar if I told you it was a bowl of cherries. These are very hard times. Live music entertainment business in general at all levels, is struggling. Agents, managers and business people are still able to make decent living in music business, however, most promoters and artists are really having to fight for everything. You will always have the Super tour and Super Artist agent point of view saying this is the best ever and it’s all blue sky. Most everyone else out here is having to keep reinventing new ways to sell tickets and on the artist side, stay bookable.

2012 Outlook Beckham: In 2012, it would be foolhardy for the live entertainment industry to overlook value and bang for the buck. Disposable spending is back to a degree, but people still want value. Bowen: Things will get better as we progress through 2012. People are getting back to work, they have a little more spending money, and they want to be entertained. I predict that we will see acts touring that haven’t been out in a while. At least three new large family shows are debuting

in North America. Producers are spending mega money to get ready to tour, and they are attracting Promoters who haven’t been willing to risk their money on these shows. Kay: I personally do not see the economy getting better therefore live entertainment may worsen. If artists and promoters come back down in pricing to affordable dollars for their consumers, then I believe things will pick up.  Harnell: I’m hopeful for 2012. Many acts are working, the classic biggies like Madonna, Van Halen, Bruce Springsteen, Roger Waters, etc., are touring which creates excitement in the marketplace. Kenny Chesney and Tim McGraw are hitting stadiums across the country. Dave Matthews Band returns after a year playing very limited festival dates. Young / new artists are finding innovative ways to capture fans. People want relief from the hardships of their situations and can typically afford a concert ticket versus a luxury item or vacation. Kirves: The initial cost of doing business in 2012 is the hurdle. Cost for everyone and everything is up – fuel, crew, bands, agent, managers, promoters, ticket fees, production company, labor, venue, advertising. Packaging 6 -7 artists together is now another very popular festival proposition, presenting a bigger-bang-for-the-buck theory.

2012 Concerns Harnell: Election years are tricky. Fears are played upon in the media which causes concern for people. Also media time gets very expensive to buy and cost prohibitive for concert marketing budgets. Bowen: My biggest concern is the election in November. If the public doesn’t have faith in the person elected then we could have an economic setback.

2011 Highlights Beckham: We have more headliners than we have had in many years. Country music is very healthy and strong.

State-of-the-Industry What Audiences Want

Harnell: Value, Customer Service, Entertainment. They want a good experience, from ease in purchasing a fair priced ticket from a reliable source, to customer service oriented venues (from the time they park, buy their F&B, get to their seat, go to the bathroom in a nice facility, etc.) to the artist giving them a great show. Kirves: I feel promoters should bring back certain classic artists combined with the contemporized artists of today and give audiences a new kind of experience. Some artists are recognizing older songs are worthy of a remake. For example, Exile just rerecorded their hit – I Wanna Kiss You All Over – with Trace Adkins, for a program called Hit Exchange; CMT crossroads program is another show that put a lot of credence into artist influences like, Ronnie Milsap with Los Lonely Boys.

Tour Routing Bowen: The amount of new and exciting mega family shows, 2011 ushered in a new form of entertainment that was introduced with “Walking with Dinosaurs” a couple of years ago. Family shows aren’t just puppets, ice skating, and lions, tigers, and bears anymore.

Reducing Costs Beckham: Production and tour size are the touring costs that can be most easily held down. Rising fuel prices can affect expenses the most. It is always more cost effective to have 3-4 day weekends, especially those artists who are carrying full production. Kay: Because airline and gas costs have been so high many artists just can not afford to be on the road. The offers are lower and the costs to do the gigs are higher. Harnell: Gas prices are a consideration. Conversely, I’m finding that advertising budgets can be reduced for many touring acts if you know how to maximize social media efforts. Bowen: Many artists and even family productions have tried to cut back on the amount of production. We have had to base ticket prices on what it takes to break even rather than what the market will bear. That then puts a Talent Buyer or Promoter in a position where they have to risk more or promote less.

Effective Co-promotions Beckham: The most cost-effective co-promotion is when the venue buys direct. It allows the best opportunity to provide programming that would not exist otherwise. Bowen: Co-promotions are very much on the rise. We aren’t out of the economic woods yet and more and more venues and Promoters / Producers are working together now than ever before. Again, it doesn’t have to be a co-promotion in the historical sense of a 50/50 up and down situation. There just has to be some give and take. There has to be a true and equal partnership in these days of high risk.

Kay: Adding dates will amortize the costs of the entire tour. When you submit offers to venues, submit offers with open ended dates so I can find other venues to route a tour even if its 3-4 dates. Bowen: Adding dates does not always mean added revenue. If it costs “X” to do one show then it costs “X” times 40 to do 40 shows plus added travel expense. If you are a major Promoter who can afford to buy the whole tour then you can amortize some of the cost over the length of the tour, but in the end you still have to give the show the money promised from show one. The decision to add or drop is often determined mid-tour. Others could give buyers a lower guarantee in smaller markets but you had to increase by that decrease somewhere along the way in order to get back to the money the artist expected.

Harnell: I’m always looking for venues and venue management teams who value what I am trying to accomplish, are aggressive in helping construct a deal that creates a win/win for all (artist, fan, venue, promoter) through fair and competitive deals, a strong marketing department to partner with, and a fan-friendly attitude.

Sound Advice Kirves: We have all but closed the door on consistent quality live entertainment at the introduction artist level. There are no training grounds left, no consistent club work for the new and merging artist. That is right where 90 percent of all great artists started and became great. That was the Troubadour music ladder method. Today, those live music clubs that should be accommodating artists in small town America are out of business. This lack of a thriving live music club environment has created a void in the places for new young artists to perfect and develop their skills. But, I stay open minded about the possibility of great new talent emerging and I do believe it’s out there. Harnell: I hire and train people I believe in. Concession Promotions & Customer Service By Chris Bigelow

T

he hot dogs are always hotter and the beer always colder when the team wins. But of course when the team loses those same hot dogs get colder and the beer becomes flat and warm. So goes a common saying in the concession industry. The mantra for today’s venue manager is enhancing the customer experience. You can’t control what happens on the playing field, but you can control how much your customer enjoys themselves from their first interaction with your venue to when they leave the parking lot after the game. The audience experience at the concession stand will often determine how they feel about the quality of your facility. While concessions are a crucial revenue stream, which can be augmented with marketing and sponsorship, if the customer experience is not your paramount concern, loyalty and future attendance will suffer. Often if the event draws poorly, the first thing venue officials do is lower concession prices, hoping that the customer won’t notice the amount of the ticket price, the “convenience” & “processing” fees and parking costs. Sales are sluggish for the home team, so implement the $1 hot dog night or the league has been on strike for half the season, so welcome fans back with 1⁄2-priced, opening-day concessions. All potentially good promotions, but only if your concessions department and marketing department are working as partners. If marketing over promises and concessions physically cannot deliver the promotion efficiently with quick service and high quality product, then it’s a bad customer service and public relations nightmare. If the customer must stand in a longer line for the specially priced hot dog that had to be cooked and pre-wrapped three hours before selling in order to handle the increased demand, do you really think he or she will forget the cost of the ticket? Venue and concession departments need to understand each other’s benefits and costs in every promotion and sponsorship. When financial sacrifice is requested, both sides really need to help each other. Many of today’s newest – and profitable – sponsors are food or beverage related, whose activation comes from sampling or selling their product during events. But before you name the XYZ company, the official 2011-2012 Facilities Booking Guide

hot dog, meat pie, pizza, ice cream, etc. of your arena, have you ensured the concessions department that the price they pay for hot dogs will not rise over normal market pricing? If not, a $50,000 sponsorship may really be only worth $35,000 after the concessionaire deducts that sponsorship premium from their commissions to the venue. Remember, discounts will not make the food taste any better. Customer service is not about cheap prices, it’s about value; getting your money’s worth for the “best” product you ever tasted. In other words, charge all you want but give me something that makes that expense feel reasonable. If you are just going to sell me an average hot dog, or worse yet a cold one with limited condiments and a soft drink or bottle of water five times what I pay in the convenience store, then I am going to undervalue my experience at your arena. Then, to take it a step further, what happens when the concessionaire is aware that the customers don’t like the brands of products sold, but is required to sell those products by the arena manager or team, because they are sponsors of the venue? You now have an unhappy consumer, an unhappy concessionaire and probably an unhappy sponsor because they are not selling enough of their product. Sponsorships are essential for the economics of any arena management, but does selling the wrong sponsorship actually reduce the concessions commissions to the arena management? Are you more willing to go the extra mile when you feel you are no longer earning a reasonable profit? That is the same feeling your concessions department will have towards your marketing department, if the two can’t share in the benefits as well as the liabilities of any venue sponsorship. 10 Favorite Movie Facilities

S

tadiums and arenas provide critical scenery in movies. Their distinctive looks, known not only by fans in attendance, but by having featured games and events broadcasted globally via web and satellite technology, have made audiences around the world immediately aware of the distinctive personalities these public assembly facilities possess. Here are some of the more notable movies featuring supporting roles played by some of our favorite stadiums & arenas, which as widely recognizable as these facilities are, one could say play a supporting role in the films... 1. The critically acclaimed Moneyball (2011) was last year’s most popular release in which a stadium or arena is given heightened prominence. Most of the main baseball scenes were filmed in Oakland’s O.co Coliseum. Brad Pitt portrays Oakland A’s General Manager Billy Beane, who develops a championship baseball team based almost solely upon statistics, a theory ridiculed at the time but now has been widely accepted throughout professional sports. Fenway Park also appears at the end of the film.
