Turn your investment property into potential cash-flowing real estate...and defer taxes after you sell. ABOUT PETRA Petra Capital Properties is a national real estate investment firm specializing in diversified 1031/DST exchange solutions. We are passionate about helping our investors discover the potential of income producing real estate without the burden of day-to-day property management. www.petracapitalproperties.com

So, what are generational farmers, ranchers, sporting and lifestyle property owners to do when evaluating the hold-versus-sell decision? Is it possible to achieve both tax deferral and preservation of investment value in this competitive real estate market? Is there an integrated 1031 solution that combines tax deferral with potential streams of passive income, simplified estate planning, and diversified real estate holdings? If you are asking these questions and ready to transition from actively managed property to passively owned investment real estate, then read on…

“We’re going to give you our money. We worked really hard for it. Please don’t lose it.” These were the words from a third-generation farm-owner who had just made one of the most pivotal decisions of his life… To sell the family farm that had provided a living, built a family, and established a legacy for the next generation. As I sat across the kitchen table with the patriarch, his daughter, and granddaughter, I was reminded that the most valuable form of currency isn’t money—it’s trust. Trust is the foundation of relationships and starts with shared values and aligned interests.

tax strategy second. The surging demand for investment real estate has resulted in a limited supply of quality 1031 replacement properties. As a result, many investors can be hesitant to sell their relinquished property until they have reasonable assurance of locating and closing a suitable 1031 replacement solution.

We are seeing the perfect storm with the convergence of highly appreciated property, aging demographics, and the desire to transition from the burden of day-to-day property management to passive lifestyle income. With recent increases in property values of agricultural land1 , we believe investment property owners are more motivated than ever to explore their exit strategies through 1031 tax deferred reinvestment options. For many active property owners, the hardest part of the hold/sell decision is letting go of the familiar…to embrace the unfamiliar. Any worthwhile investment solution begins with education and trusted research.

Re-imagining 1031 Tax InvestmentDeferredSolutions

Under IRS 1031 exchange rules, sellers of investment property can defer capital gains and other taxes, provided they reinvest proceeds into another qualified investment property. However, at its core, a 1031 tax deferred exchange should always be a fundamental investment strategy first and a

One of the fastest growing segments of the 1031 exchange market is the Delaware Statutory Trust (“DST”)2 . Pre-structured DSTs are intended to be a “turn-key” solution designed for diversified property ownership, potential for multiple streams of passive income, and efficient replacement property identification and closing. Many DSTs are pre-structured programs, sponsored by national investment management companies with proven track records. In some cases, investors can identify and close on their individual DST property interests within days of selling their relinquished property and potentially begin enjoying passive cash flow.

While there is always risk to real estate investing, DSTs are offered as securitized real estate that must pass through multiple levels of due diligence and underwriting before being offered to qualified investors. If you are interested in learning how to transform your hard-earned wealth into a diversified portfolio of DST properties with the potential for passive income, please give us a call.

DSTs can be offered as either all-cash investments or partially leveraged programs with non-recourse debt. With low investment minimums, investors can combine multiple property interests like building blocks or “Legos” to arrange highly-diversified and personalized real estate investment portfolios. DSTs represent diverse asset classes and investment strategies, including: New Class “A” multifamily residential communities, Industrial properties such as Amazon and Ford distribution facilities, Manufactured Housing, Self-Storage portfolios, Healthcare/Medical properties, and Essential Service properties such as Kroger Grocery, Dollar General, Tractor Supply, Walmart, and Walgreens. Depending on the investment amount, and the investor’s risk tolerance and investment objectives, Petra can generally allocate to each of these asset classes in an attempt to increase diversification and optimize performance outcomes.

Iron Horse Ranch bears testament to human habitation dating back centuries if not millennia; don’t miss out on this incredible opportunity to own a part of American history!

In the 1950s, prominent Phoenix family Rutherfords acquired the ranch and ran a successful operation raising Charolais cattle. In 1995, the Finley family bought the ranch and proceeded to make vast improvements to the property. Thank you for allowing us to share this wonderful property with you along with its special history.

At this point on its journey to the Colorado River, Kirkland Creek leaves the relative flat flood plains and enters a canyon system. For this reason, this has long been a logical place for human settlement. The first to permanently inhabit the ranch area was a relatively large community of Natives known as the Patayan. Large amounts of evidence exist proving that this culture not only lived but thrived here. The remains of their dwellings and the large amounts of artifacts along with enigmatic petroglyphs leave us to ponder their existence here.

In May of 1863, the first wave of gold prospectors arrived when the Weaver, Wick enburg, and Peeples expedition discovered the Rich Hill lode and the large gold depos its in the Bradshaw mountains. By the late 1880s into the turn of the century, land was being claimed, consolidated, and devel oped as ranches. The Iron Horse Ranch was no exception and was settled in the 1920s.

480-223-3633

In 1604, the Spanish explorer Jaun de Oñate passed through here on his way to the Hopi mesas on his quest for gold. There are no reminders of his visit here, although rumors persist that some sort of treasure was left behind, buried in the granite boulders behind the ranch.

This large alpine ranch is a unique inholding in the 1.4-million-acre MantiLa Sal National Forest, which borders or overlooks three high mountain lakes, and runs from 8,800 feet up to 9,700 feet in elevation. Despite the alpine location of this mountain paradise, the ranch still enjoys year-round, publicly maintained access from paved State Road 31 which runs through the south end of the ranch. Inside the borders of the ranch is an excellent network of private dirt roads, which provide comfortable vehicle access to every canyon and key portions of the ranch. The landscape is covered in pines and aspens, with lush meadows fed by springs and small creeks in every canyon. A portion of Cleveland Reservoir is located on the ranch, and parts of the ranch overlook Electric Lake to the east and Huntington Reservoir to the south. The ranch is a big-game hunter’s paradise, and its shape and protective topography make it excellent habitat for elk and deer. Trophy-quality bulls are the norm given its location within a limited entry bull elk unit, and the abundant mule deer bucks which call the ranch home can be hunted with a general season tag. Historically, the ranch has been grazed by sheep to maintain its favorable tax status, and eight separate livestock watering rights are included. In addition, 120 shares of the Huntington-Cleveland Irrigation Company are included, giving the ranch tremendous development possibilities. For the conservation-minded buyer, the Bear Canyon Ranch is not yet encumbered with any type of conservation easement, leaving the tax advantages of that possibility to the next owner. There are very few private ranches in Utah that offer the level of alpine aesthetics which are found on every single acre of the Bear Canyon Ranch. $5,750,000.

26 Farm Ranch | Volume 88

The Skyline Ranch is situated on the top of the Wasatch Plateau Mountain range in central Utah, surrounded by the 1.4-million-acre Manti-La Sal National Forest. It is accessed by the famed “Skyline Drive.” As one of the largest private land holdings on this entire mountain range, this rare block of private land runs from 8,000 feet to over 9,500 feet in elevation. The landscapes of the Skyline Ranch are dominated by large aspen stands, punctuated by dense pines on its northern exposures, and by large alpine meadows which sweep across its gentle plateaulike topography. The numerous lush, canyon bottoms are full of springs and small creeks, and almost two full miles of Gooseberry Creek runs directly through the ranch. Gooseberry Creek offers excellent fly fishing for large cutthroat and rainbow trout, which flourish in its cold and clear high-mountain waters. Fishing opportunities for larger trout can be found within walking distance of the ranch, in the well-stocked Gooseberry Reservoir located on national forest land. The Skyline Ranch protects areas considered critical for elk calving, and the large resident elk herds that inhabit the ranch through late fall offer some of the best hunting opportunities for trophy elk in all of Central Utah. This area is also famous for its trophy mule deer hunting, largely due to the mountain range’s jaw-dropping alpine aesthetics. $11,500,000.

Story and Photography

Five backcountry riders escape the cold mountains of Wyoming to experience a dry, rugged, and prickly pack trip along Utah’s San Rafael Swell.

Besides occasional horseback riders, the largest animals in the canyon are the cattle

that graze it in early spring. A cow path doesn’t always suit a packhorse carrying panniers double the width of a cow; and a mounted rider is much taller than a cow. In the coming days, willows thwacked and snapped around the panniers and snatched our hats off our heads. Despite the heat, I was quite glad I wore chinks to protect my legs. Occasionally, we resorted to riding in the river as it was the path of least resistance. We avoided this whenever possible though, because the US BLM range conservationist for the area had warned us about quicksand.

My friends—Perry, Gayle, Tammy and LeeAnne—and I had horsepacked into the 18-mile-long Little Grand Canyon for a short springtime desert pack trip in a warmer environment than our still-snowing Wyoming. It would be a new experience for us in desert country.

Because it is federal land, the United States Bureau of Land Management manages it. I contacted the local BLM field office prior to our pack trip to learn about water holes, availability of grass, and presence of feral BLM horses—we wanted to avoid them because of their aggressions toward domestic horses. This information guided where we chose to explore on our trip. We set camp in a narrow stretch of canyon at a river bow under shady cottonwoods. The river was a diminutive waterway that amounted to what we call a creek in Wyoming; but it holds an abundance of water for the desert.

Today, we rode out on a day ride into Salt Wash to summit a nearby mountain. We never gained it.

A cow path doesn’t always suit a packhorse carrying panniers double the width of a cow; and a mounted rider is much taller than a cow.

T

The Little Grand Canyon is located in the San Rafael Swell—a dome-shaped anticline, or upward swelling fold of rock, that measures 40 miles wide and an incredible 75 miles long in south-central Utah. It makes for amazing rock formations, spectacular views and narrow canyons in its depths.

he morning sun slanted into Salt Wash. Its beams colored the cottonwood tree leaves chartreuse. To beat the afternoon heat that spiked to more than 80 degrees Fahrenheit, we had ridden out of camp shortly after dawn. Without the sun’s warmth, the Utah desert turns chilly in April. The moisture from the San Rafael River also cooled our camp set under the 1,000-foot plus walls of the Little Grand Canyon. My cold fingers tingled happily when the sun’s rays reached the canyon floor.

Occasionally, the terrain and lack of trail wide enough for packhorses forced the group to ride the San Rafael River. This prompted careful study to avoid quicksand.

Up in Salt Wash, instead of a beaverslide or willow thicket, a beaver dam halted us. The structure created a deep pond that stretched from canyon wall to wall. While we thought the term “river” grandiose for the amount of water in the San Rafael River, Utah’s washes are considerable. In Wyoming, a wash is a dry, shallow drainage of an ephemeral creek. A Utah wash slices between cliffs.

The beavers thwarted us. The canyon, and its side washes, host thriving beaver colonies. Beaver dams choked every meander of the San Rafael River, causing us to re-route often.

94 Farm Ranch | Volume 88

A horse does not easily ford a beaver pond. The dam causes silt to settle in the pond and the soft muck quickly sucks in horse legs. And, you don’t know the pond depth. I dismounted at the pond’s edge and dipped a lengthy willow switch into the water. I estimated that the pond bank dropped straight down into five feet of water. Horses can swim, but a plunge off of a cutbank and a slippery scramble up the probable cutbank on the other side concerned us.

We were disappointed to not summit the mountain. Yet, the sun glistened on the beaver pond. The craggy walls of Salt Wash towered above us. We had flushed several turkeys on our ride. Now, in our stillness, the flitting of songbirds was noticeable. We decided to break for breakfast snacks in a cottonwood grove and enjoy the morning.

THOSE BEAVERS

Next, we sought passage around the beaver pond. We had spotted Bighorn sheep scampering above us on the walls of the Little Grand Canyon. But the sandstone cliffs that edged the beaver pond, a gambol for the sheep, were a no-go for horses.

We’d follow a trail to find a river bend had eroded the sandy soil and the trail-tread all the way to a canyon wall. Then, we’d tunnel through willows only to discover the gap we thought was a trail down the riverbank was actually a steep beaverslide, a slope in the bank made by beavers dragging branches. We listened to our packhorses’ complaints reversing inside willow thickets, and began to send our “outriders,” two riders not leading packhorses, to locate the trail forward.

come across cattle in BLM areas where cattle graze seasonally, by permit.

It is difficult to read brands on flighty cows in a willow thicket. We sidled up to one, and the brand was not the rancher’s we had spoken with, but all of their ear tags matched, which marked them as belonging to the same outfit. We planned to call the rancher regardless, because he might know their owner. It’s not uncommon to sometimes

Rerouting around willow thickets and beaver dams led Perry and the rest of the group down some steep embankments.

On the ride back to camp where Salt Wash empties into the canyon, we found some cattle, a few pairs, a yearling calf, and some dry cows. Before we rode into the canyon, a rancher had driven into the trailhead and asked if we’d seen any cattle. We hadn’t, at the time but I wrote down his name, phone number, brand, and ear tag just in case we did.

By now it was mid-day, and the sun scorched us. It is one thing to read a weather forecast for high 80-degree Fahrenheit temperatures. It is another to arrive on the southern desert fresh from a Wyoming spring snowstorm. Our horses were still furry with winter hair. To avoid heat stress on our horses and ourselves, we planned early morning rides completed by noon and scheduled afternoon siestas.

As we cooked our lunch in the shade, our hobbled horses dozed or nibbled grass. Bailey lowered herself down into the sand to itch. Then, she rolled fully over and into a

mess of prickly pear cacti! The cactus spines sank deeply into her shoulder and flank.

The next day was our last in the canyon. When Tammy saddled her horse, she spotted a lizard clutching her saddle’s cantle, and decided to let it hitchhike down the trail. At the beginning of our pack trip, the lizards that scurried underfoot on the trail scared Bailey more than the bears that she and I have encountered in the mountains. As Gayle held the haltered Bailey, I pulled out needles with my multi-tool’s pliers. I flattened my hand, pressed it against Bailey’s skin, and moved it against the hair growth to locate needles. I searched especially close where her saddle, girth and breast collar would contact her skin and irritate the spines.

I wanted to retreat with my horses back into the canyon of beavers and towering walls. It had been a great, new experience for us all.

At the trailhead, we rode into a different kind of critter: a dizzying throng of people. It had been just us at the trailhead before we rode into the canyon in the middle of the week. Now, it was the weekend. Parties sat in the river in their folding chairs. A wedding was being held on the river bank. Off-road vehicles zoomed along the access road that dead-ended at the trailhead. Camper trailers, with flapping awnings, now encircled the stock corral.
