Re-imagining 1031 Exchanges
In the words of Yogi Berra… “If you don’t know where you’re going, you’ll get there every time.” As 77 million baby boomers brace for retirement, the road to financial security is paved with uncertainty. For most active landlords and property owners, the question looms large of how to reposition highly-appreciated real estate into sustainable streams of passive monthly income. Most investment real estate owners have worked a lifetime for Return on Investment. However, at this stage of life, the goal is to transform self-managed property into versatile lifestyle income that can be used for “living or giving.” We
call this “Return on Life.”
According to the USDA Farms and Land Summary Report dated February 2022, there are more than 2,000 private farms and ranches in the U.S. representing over 1 billion acres and an estimated value of nearly $3 Trillion. In light of changing business models and aging demographics, we believe that property owners are focused on profitable exit

Under IRS 1031 exchange rules, investment property sellers can defer capital gain taxes provided they reinvest proceeds into another investment property or properties. For most investors, a 1031 exchange starts with tax deferral. After all, taxes represent a permanent loss of capital as well as reduced earning power. However, as financial history demonstrates, we believe it is far more important to focus on investment fundamentals than tax advantages. All real estate is not created equal. Investors should remember that a 1031 exchange is an investment strategy first…and a tax strategy second.
One of the fastest growing segments of the broader 1031 exchange market is the alternative

Centuries of debate have yet to set the optimal size of an agriculture operation. Years of experience have shown that collaboration strengthens farms and ranches. For the Emert Ranch of Hermiston, Oregon the willingness to learn, adapt, and work together fosters success. The Emert family’s niche is fall calving to provide beef to Country Natural Beef customers in a low supply period. Nutrition, femininity, and carcass data informs their cattle management.
Sleek and rounded, the Emert cattle are bright-eyed and healthy. “At the auction yard,” recalls Jerri Emert, “if the cattle buyers didn’t dock us for a rattail, they’d cite our calves as too heavy for compensatory gain.”
During this frustration, neighbors wanted to background their calves for Country Natural Beef—a beef market cooperative of family ranches. “The neighbors needed at least 60 calves to begin,” Jerri says. “They were short, so asked us if we’d like to add some. Country Natural Beef needed more fall calves and agreed for us to place nine calves with the neighbor’s group.”
The Emerts attended the co-op meetings as perspective members. “We learned from Temple Grandin for two days.” Jerri says. “That was a great experience. Working on our own, would we have had that opportunity? Not likely.”
The Emert calves performed well in the Country Natural Beef backgrounding and finishing programs. Yet, the co-op doesn’t recruit small producers. “There are inherent problems with small producers like us,” Jerri says, “For instance, usually our cattle lack exposure to illness—termed ‘naive cattle’— and become sick when mingled with cattle from other ranches.”
Lets Work Together
Yet, cooperatives often benefit the small producers the most. “A co-op, like Country Natural Beef, bridges some of the gap between the producers and consumers,” says Jacob Murstig, the grandson of Jerri
and her husband Robert. “Previously, we did not finish our cattle for beef, because it was difficult to get appointments at the few processors around here. Through Country Natural Beef we retain ownership of our cattle until the beef products are sold— mostly by wholesale to grocery retailers and restaurants. It’s not direct-to-consumer, yet it’s closer than we were before.”
Last night, Jacob and his girlfriend Allison Smith took Allison’s visiting grandma out to their favorite burger place in Pendleton. “We were seated at a table in front of the wall with photos of the Emerts and many of the neighbors,” Allison says. “The restaurant serves Country Natural burger patties. It’s really cool for people that aren’t familiar with what goes on here in ranch country to see the faces behind their food.”
To promote this understanding, Country Natural Beef members are required to annually visit grocery retailers to educate customers about ranching and beef. Jerri enjoys talking to the shoppers. “The store visits are a venue where I can meet people that eat our beef and visit with them,” she says. “It’s my niche, through conversation, to narrow the chasm between the people that grow food and the people that live in town.”
“There’s a growing trend of people that want to know more about their food, to be connected to us who produce it,” says Robert Emert, Jerri’s husband. “It’s encouraging. Without us going to the city and meeting these people, we would miss that positivity. Our visits are a big deal for the stores. Beef sales always go up.”
“I don’t know how, but they instantly know who we are when we walk into a store,” Jerri says

with a chuckle. “I don’t wear a cowboy hat. We think we look like everybody else, but they [store employees] say, ‘There’s our ranchers.’”
After a trial period as Country Natural Beef prospective members, the Emerts were accepted into the cooperative as one of the smallest ranches. The Emerts meet a need. Their fall calves provide beef during low inventory in the months of November and December, because most members calve in the spring and summer.
Additionally, the well-fed, healthy Emert cattle are an asset to the co-op. Country Natural Beef is free of antibiotics and hormones. If a steer takes ill, and must be treated with antibiotics, it becomes ineligible to be sold under the co-op’s brand. These cattle, and any deceased during backgrounding and finishing, are marked as out-of-program at a financial loss for the members that submitted them.
“Most people have such big numbers [of cattle] that the likelihood of having zero outof-program is small,” says Robert of their zero out-of-program award from the coop. “Our cattle are healthy and have good genetics, which gives them a boost.”
“When Robert and Jerri sold cattle at auction to a middleman, or whoever would finish them,” Jacob says, “the price was mainly determined by the cattle’s appearance. With the co-op, it’s all about cattle performance and carcass yield. Price is based on the quality of the beef.”
Going Genetic
Robert and Jerri have stewarded the family ranch for almost 50 years. They assumed management of a predominantly Hereford herd from Robert’s parents. The Hereford cows were bred to Black Angus bulls. Then, the Emerts switched to Angus/Limousine bulls. After seven calf crops, the Limousine were replaced with Simmental bulls.
“The calves were just way too big,” Jerri recalls of the Simmental genetics, “so we went back
to Black Angus—the composite. Then, we got some Red Angus bulls to live cover after AIing [artificial insemination]. We want medium frame cows with medium calves that are winter hardy, since we calve in the fall.”
“We calve in the fall because it fits well with our farming schedule for alfalfa and corn,” Jacob explains. “In the spring, we’re busy turning on irrigation and planting.” Fall calving, and its January breeding season, requires specific nutrition for success. During winter, the Emert cows eat high-fiber hay, fast grow supplement, and a custom mineral mix.
The Emerts developed their nutrition plan after a terrible calving season. “One cow wasn’t doing well, and birthed a dead calf,” Jerri recalls. “Then, another cow looked fine and delivered a dead calf. And so on, until we had a small herd of disasters. Finally, I
had the Alltech sales rep[resentative] come out. She tested the water, grass and hay to measure nutrients.”

The test results showed that the Emert cattle’s diet was critically low in selenium and copper. The supplement and custom mineral mix provide what the cattle need

for optimal health. The Emerts also modify their ranch management practices according to regenerative agriculture to promote mycorrhizae between soils and plants for minerals to be naturally available for their cattle.
“Country Natural Beef brings experts to our meetings,” says Jerri. “We listened to Gabe Brown of North Dakota talk about soil health for a couple days. I found his information vastly interesting. We just started a compost project.”
With assistance from the USDA Natural Resources Conservation Service (NRCS), the Emerts compost old hay, soiled straw bedding, and cattle manure to apply as fertilizer to row crop, hay and pasture fields. Soil tests are conducted annually before and after compost application for the 7-year NRCS project. The compost replaces the
use of synthetic chemical fertilizers, and encourages mycorrhizae.
“The cattle rotate through our [center] pivots after the corn is harvested and they graze the fifth cutting of alfalfa hay,” Jerri says. “When we get the compost system going well, we want to inter-seed a forage into the alfalfa. We don’t want bare soil between the plants. Bare soil wants to grow weeds.”
“Our sandy soils are highly erodible, primarily from the wind,” Robert adds. “Organic matter and water retention is very low.”
Ever Improving
Intrinsically, agriculture is interdependent. It succeeds when a farm and ranch is managed holistically for the health of the landscape,
livestock, wildlife and people. A lifelong learner, Jerri doesn’t rest on the laurel of having zero out-of-program cattle with Country Natural Beef. She wants to keep it that way.
Jerri seeks more femininity, stronger disease resistance, and excellent carcass yield and marbling. Her genetics research led her to the British White Park breed. From there, she learned of the Speckle Park breed. Speckle Park was developed in Canada as a cross between British White Park, Shorthorn, and Angus cattle. It is popular in Canada and Australia, yet remains low profile in the US. The cattle’s attractively speckled hides and pretty faces catch attention, yet their production qualities add vitality.
Recognition of the Speckles’ excellent maternity and beef attributes continues to grow. Intrigued, Jerri ordered semen from
a Speckle Park breeder in Montana. The Emerts artificially inseminated select cows with Speckle Park semen in 2020 and 2021. Now, they observe how the Speckle Parkcross cattle perform before adding more of the bloodline to their herd.
Thus far, none of the Speckled-cross cows have been culled for a feisty disposition. Only one has been treated with antibiotics for an illness. “The Speckled-cross calves may be slightly smaller than our other calves,” Jerri notes. “Yet, shoot, they’re moms are two-yearold heifers. It’s all about femininity. We have not pulled a single calf from the Speckles.”
“Interestingly, in the first group of Speckledcross calves,” Jerri continues, “two-thirds of them were girls. We went for broke, and saved all of them as replacement heifers. I’ve heard that if you feed good, you’ll get more females than bulls. I’m afraid of seeing that true here. Yet, nutrition impacts a lot of things.”
It’s nutrition for which Jerri attributes the Emert Ranch’s high rate of twins. “I tell you,” Jerri says with exasperation, “we have a 10% twinning rate. Robert feeds the cows well.”
“I feel it’s my moral obligation to feed the cows as well as I feed myself,” Robert interjects.
“The supplement and custom mineral mix may cause some of it, too,” Jerri responds.
“Also, we emphasize femininity. This year, the first set of twins didn’t survive. The 10 sets after that did, though. I have three Jersey girls feeding six calves right now. It’s hard to have a 100% live rate, even with single calves. We graft twins on to any cows we deem worthy. This works because our operation is small and intensive.”
As Country Natural Beef members, the Emerts retain ownership of their beef cattle until processing, and receive a spreadsheet of carcass data. Jacob runs his finger down the columns to locate the Speckled Park cross steers that have been harvested. “The Speckles finish out on forage really well, and more quickly than our other steers,” he says. “The co-op backgrounds and finishes
on pasture. The irrigated circles have bunks along the edge to feed extra forage rations.
“You can see here,” Jacobs says as he refers to the spreadsheet, “that the bigger Speckle twin went to processing before it’s smaller twin. Although, they both graded high [USDA] Choice. Some of the Speckles had an inch of back fat. We only have data from one batch of Speckles. We need more to go through the co-op program before we can accurately judge carcass performance.”
“You can’t just go for the end product, though,” Jerri cautions, “because then maternal traits are left out. We have to look at the whole animal for balanced genetics— ultrasound the ribeye, measure the scrotum. When we went for growth rate years ago, it boogered up calving ease.”
“You almost need two separate herds,” Robert says thoughtfully, “one to raise replacement heifers and another to produce the beef cattle going to feedlot.”
What the Emerts no longer have to consider in their cattle genetics: hide color. It’s beef quality that matters to Country Natural Beef. Free of worry over white spots, the Emerts can add femininity, beef marbling, and carcass conversion to their cattle through Speckle Park genetics. “The Speckle Parks are a conversation starter,” Jacob says. “On some of the Speckle crosses the full color pattern didn’t come through, but for most of them it’s pretty obvious.”
“We love it,” Jerri says. “Come on, speckles. With Country Natural Beef, they don’t care what color the hide is. What matters is, ‘Is the meat good?’”
