Re-imagining 1031 Exchanges
In the words of Yogi Berra… “If you don’t know where you’re going, you’ll get there every time.” As 77 million baby boomers brace for retirement, the road to financial security is paved with uncertainty. For most active landlords and property owners, the question looms large of how to reposition highly-appreciated real estate into sustainable streams of passive monthly income. Long ago, when dinosaurs still walked the earth and I was a sophomore at the University of Texas at Austin, some buddies and I made plans over a pitcher of beer at Scholtz’s Garden to mount a camping expedition to Enchanted Rock, between Llano and Fredericksburg.
Shortly thereafter, we found ourselves hiking up the “easy side” of that magnificent mountain (okay, maybe it’s really a large hill), packing in water, tents, and sleeping bags.
We made a point of scheduling the trip during a full moon, and I’ll never forget that moonrise across the windswept granite, or the sharp scent of cedar filling the air, or—even though it was long ago—the diadem of stars suspended overhead, so very close you could almost touch them.
As Texas celebrates the 100th anniversary of our State Parks, I realize now that we were following the directive of Governor Pat Neff, who, when he created the first Texas State Parks Board in 1923, expressed his hope that the eventual parks—including the Enchanted Rock State Natural Area—would provide outdoor spaces where Texans “might go and forget the anxiety and strife and vexation of life’s daily grind.”
The very first state park was created after the Governor’s mother, Isabella Neff, donated six acres on the Leon River southwest of Waco to which a local benefactor named F.P. Smith added another 259 acres. Mrs. Neff was nicknamed Mother Neff by the cowboys to whom she offered food, coffee, and motherly comfort as they came up the Chisholm Trail, hence the name of the first Texas park: Mother Neff State Park.

In a state where 95% of the land mass is privately owned, the park system eventually fulfilled the Governor’s vision, expanding to 50 parks and over 630,000 acres. When President Roosevelt created the Civilian Conservation Corps in 1933 to send unemployed Americans back to work, it built infrastructure still visible today at Garner State Park, Palo Duro Canyon State Park, and Balmorhea State Park.

INDIAN RAIDS
For hundreds of years the Comanche were a part of the Shoshone tribe living in Wyoming and Montana. Once the Comanches acquired horses, their greater mobility and access to new hunting grounds led them south making their way into Texas in the late 1700s.
Almost immediately, the Comanches dominated every Indian tribe. They came close to wiping out the Apaches and constant raids into a more populated Mexico singlehandedly brought the migration of Mexicans into Texas to a halt.
The Comanches were always on the move following the buffalo that provided them food, clothing and shelter. The Comanche grew in number because of their raids into Mexico where they kidnapped women and children. These raids into Mexico resulted in
one-third of the Comanche nation bearing Hispanic heritage.
The Comanches were brutal and feared by everyone. When their warriors were killed, they felt honor-bound to exact a revenge and that resulted in torture killings that knew no boundaries.
In 1836, an early settler family called the Parkers had joined other families in building a stockade they called Fort Parker near what is known today as Groesbeck in Limestone County. One hundred mounted Comanche Indians approached the fort waving a white flag.
Benjamin Parker went outside the gate to meet the Comanches. He was suddenly surrounded and they drove their spears through him. The Indians then surged
By Mark Hannatoward the fort and burst inside before Silas Parker could bolt the gate. Silas was immediately killed and his father and mother quickly killed and dismembered. Silas’ wife and four children tried to run but they were all captured and taken away.
One of those captured was 9-year-old Cynthia Ann Parker. She spent most of her life a part of the Comanche tribe and married Chief Peta Nocona. Their son, Quanah Parker, would become one of the prominent Comanche chiefs and war leaders.
In 1840, the various tribes of Comanches and Kiowa Apaches agreed to become allies after bitter in-fighting, the successes of Texas Rangers against them and devastating bouts with smallpox. Both tribes knew they would have to join forces to fight as one against the
ever increasing encroachment of American settlers coming into Texas.
The Comanches agreed to peace talks with Texas government officials in San Antonio on March 19, 1840. The Texans demanded that the Comanches abandon Central Texas, cease interfering with Texan incursions and avoid all White settlements.
A total of 33 Comanche chiefs and warriors accompanied by 32 other Comanches, including some women and children, arrived for the peace talks. Texas officials had hoped the Comanches would bring many, if not most of the white women and children the Indians had been holding hostage. Instead, the Comanches brought a Mexican boy and a 16 year old white girl named Matilda Lockhart. Matilda and her sister were captured in 1838.
Officials were shocked when they saw Matilda. Her entire body was battered, burned and bruised with sores. Her nose had been literally burned off. She described the horrors of how she had been tortured by both the men and women.
When Matilda said there were at least 15 other captives like her left behind, Texas lawmakers immediately ordered the arrests of the Comanche chiefs. When the Comanches realized what was happening, they began fighting their way out with bows and arrows and knives. But they were surrounded by soldiers who opened fire. Twelve Comanche leaders were killed inside the Council House, while 23 others were shot and killed in the streets of San Antonio. Thirty Comanches were taken captive. Seven Texans including two judges were killed in the melee.
When word of what became known as the Council House Massacre got back to the Comanche tribe, all of their captives were killed and Comanche chief Buffalo Hump launched a massive raid of an estimated 600 warriors, whose deadly trek started at the Edwards Plateau in West Texas and went all the way to the Texas coast. The Comanches raided several cities including Victoria and Linnville. At the time, Linnville was the second largest port in Texas and Indians burned it to the ground. The city never recovered.
At least 25 settlers were killed and several were taken captive including the granddaughter of Daniel Boone, who was later killed by her captors. During the massive raid Comanches captured a huge herd of horses and mules as well as firearms and a cache of mirrors, liquor and cloth.
Texans responded with what led to the Battle of Plum Creek on August 12, 1840. On their way back from the coast, the Comanches were chased by a group of 200 armed settlers, many of them Texas Rangers and Tonkawa Indians who were marked as allies by wearing a white arm band. After a one hundred mile chase, the two sides confronted each other at Good’s Crossing on Plum Creek near the town of Lockhart. The running gun battle continued all the way to San Marcos. The Comanches lost 80 chiefs and warriors while only one Texan was killed and seven injured. This battle ended the Comanche penetration of settled portions of south Texas.
While peace may have settled in for settlers, such as the hundreds of Germans and Czechs who migrated into south and south central Texas, settlers trying to make a living in north Texas were frequently targeted by bands of marauding Comanches. An estimated 200 settlers were killed each year by Indians. Settlers first built stockades, or private forts, as a way of defending themselves, but much more protection was needed.
With the annexation of Texas, the U.S. Army began building forts for protection. The state’s first fort was built in Brownsville in 1845 to deal with Mexican forces, but four years later, an entire line of forts were built in north Texas to deal with the Comanches. A second line of forts was built further west to defend the increasing number of settlers coming into Texas.
In the 1850s, bands of Comanche warriors were terrorizing north Texas settlers. These new Texans were wanting to stake claim to what had been prize Comanche hunting grounds. While U.S. Government officials in Washington were trying their best to make peace with the Comanches and provide them protection, settlers were under almost constant attack.
The protection provided by federal troops was not enough and the creation of the Texas Rangers was a tremendous boost to keeping the Comanches in check. Texas Rangers rode horseback and could ride as well as Comanches. The Rangers were also equipped with the new Colt six-shooter and allied with the Tonkawa Indians. The Rangers were so effective that the federal government paid them for their services.
In 1854, the U.S. Army opened the first of three Indian reservations near Fort Belknap. The reservations were hundreds of acres of land set aside for the various tribes to farm
and ranch. The U.S. Government gave the Indians thousands of dollars in supplies to build themselves a new protected place to live. In a perfect world with perfect weather, the federal project may have worked, but Texas weather wasn’t cooperating with the project and neither were the Indians, especially the Comanches. Settlers who lived near the reservations had ongoing skirmishes with the Indians, who often raided nearby farms and ranches and then returned to the reservations for cover. The continuous fighting only led to more distrust and anger.
In 1858, a large contingent of Texas Rangers and Tonkawa Indians began tracking Comanches who were responsible for deadly raids in north Texas. The Rangers pursued Comanches into Indian Territory in southern Oklahoma, where the Comanches had a permanent camp that was supposedly protected. The Rangers followed the Comanches to Little Robe Creek where 200 armed Texans fought 600 Comanches. The fight left 80 Comanches dead and only one Ranger.
As a settler in north Texas you stayed armed whether you were traveling or working. You
were always watching for Indians who not only killed unsuspecting settlers, but took their scalps as well.
On June 15, 1860, Josephus and Frank Browning, were riding outside their ranch in search of cattle, when they stopped to rest in the shade on a hot day near the Clear Fork River in Crystal Falls in Stephens County. Soon, the boys heard Indians coming, so they hurriedly cut the hobbles from their horses and started away. Josephus had problems with his horse and he was soon overtaken and killed. Frank was badly wounded and fell off his horse near Hubbard Creek. His horse, with two arrows sticking in his body, galloped to the ranch. The boy’s father instantly knew that Indians had attacked his sons and he set off with others in back-trailing the pony. They found Frank who was still conscious and able to tell his father what had happened. Frank had shot two of the Indians but he had been shot with arrows 17 times and at least two of the arrows passed completely through his body. Thanks to a doctor nearby at Fort Belknap, Frank recovered, but 20 years later, he succumbed to his wounds.
A group of only six men led by John R. Baylor set out to find the Indians responsible for the Clear Fork raid. The men caught up with the Indians in Haskell County and after a fierce fight, 13 warriors were killed. The scalp of Josephus Browning and that of a frontier lady’s scalp were recovered as well as several horses that had been stolen in Palo Pinto County. When they returned home, Baylor and his men were honored with celebrations and barbecues in Crystal Falls, Palo Pinto and Weatherford.
The Comanches and Kiowa Apaches continued to be pushed further north, but the protection Texas settlers had received from U.S. Army troops disappeared at the start of the Civil War in 1861. Settlers had to rely on Texas Rangers and their own militia to fight the Indians and for the next ten years, Indian raids were relentless and deadly.
The next Texas Frontier will look at the last Indian battles that took place in Texas.
Costa Grande Ranch is located along the Texas Gulf Coast waterfront in Calhoun County just three miles west of Port O’Connor, 75 miles northeast of Corpus Christi, 110 miles southwest of Houston, and 130 miles southeast of San Antonio. The ranch fronts on the south side of state Hwy 185 for over two miles and along the shoreline of the Gulf Intracoastal Waterway for 2.5 miles. The ranch also has access from a private, gated ranch community easement through neighboring properties. Totaling 2,805 acres, the Costa Grande Ranch is remarkably diverse
with its scattered mottes of coastal live oak, intact wetlands, coastal prairies, and a range of fishery habitats.
The ranch is high-fenced along the west boundary and lowfenced along the remaining three sides into multiple working pastures. Through a series of raised and constructed roads, mowed lanes, and adjoining public roads, ranch accessibility is favorable. Multiple submersible and solar wells are scattered throughout the ranch and connected through a substantial system of pipes and storage to various locations. The property

Tidal bayous, brackish emergent marshes, saltwater lakes, and channels further enhance the ranch’s biological diversity. This broad soil diversity supports a unique assemblage of native grasses, forbs, brush, and trees. It is home to a wide array of wintering waterfowl, shorebirds, and waterbirds such as ducks, geese, cranes, stilts, plovers, egrets, bitterns, and herons. Fishing on the ranch and in adjacent waters is world class. Redfish, trout, flounder, and drum are all part of the fishery that makes Port O’Connor a fishing destination. With the jettied pass out into the Gulf, offshore fishing for billfish, snapper, ling, and tuna are all possible. Significant improvements have been made in habitat management, infrastructure, and wildlife management. Prescribed burning has been an ideal tool for coastal prairie management and regular use of it has had significant impact on the health of the native range. Ranching livestock has been the traditional use of this ranch over past generations and is still a part of the management and use of the ranch today. In 2020, the properties were enrolled with the Texas Wetland Prairie Program, a cooperative led by US Fish and Wildlife Service, NRCS, and Ducks Unlimited for assistance in enhancing and restoring coastal wetlands. This has allowed for enhancements for over 38 acres of wetlands and installing/ upgrading water wells to ensure controlled flooding can occur. This objective is for waterfowl, as well as threatened and rare species to find migratory refuge on the ranch. $3,850 per acre or $10,799,250.
