WHY do I do this to myself? Why do I need this? Why do I want to be a lawyer? Is it worth it?

As law students we learn skills in our degree that are valued by employers across a range of sectors. However, given the current dynamic state of the workforce, employers are looking past your degree. They are searching for evidence of a well rounded individual; one that has demonstrated an early interest in their chosen career path through the pursuit of relevant extra curricula activities. These activities do not need to be legal, but they do need to develop a transferable skill to assist you in establishing yourself as a future legal professional.

Throughout your law degree there will inevitably come a time when you will stop and engage in some self reflection and soul searching. For instance, reading a 150 page unformatted judgment, cross checking citations, the Saturday night you spend reading your text book, the cost of that text book , exam time in all its glory, chronic sleep deprivation and so on, all call you to ask:

These are all very valid questions that deserve very valid answers. If you are reading this guide I am certain you have had one such moment, so I invite you to consider what your answer was. Most likely it had something to do with the ‘bigger picture’, your career or lifestyle visions and goals. Capture this thought. Goals provide a sense of direction, inspiration and focus. They are the key to achieving success, in the most efficient way, via the most enjoyable process for every task throughout your life. Understanding your current motivation will provide you with further drive and a clear sense of direction - elements integral to the realisation of your career goals.

There are ample opportunities available to aid your professional development and this guide aims to link you to a few such resources. Take responsibility for your own future by keeping your career aspirations at the forefront of your mind when making decisions at university, from the electives that you take, to the competitions and social activities that you participate in. This will help you get the most out of your university experience and prepare you for the ‘real world’. With early planning, the right information and dedication to your goals, you will get to wherever you want to go. This guide is complementary to the 2011 Careers Guide, released last year and available on the DLSS website. For students in their penultimate year, you will find current seasonal application dates and additional application tips. For students in younger year levels, please use this guide to develop an early plan, to motivate you through your studies, and make application time less stressful. Please note that this guide is not exhaustive, it should just be used as a base for your own research. Your own research will form the foundation of your future goals and career aspirations so dedicate enough time to it — ensure your success.

There are an extremely extensive range of resources online that address goal setting, provide detailed steps, quotes and strategies. I highly recommend you investigate the best process for you, given the importance of the task and its time commitment, below I have included my personal process.

STEP 1 What sort of professional do you envision yourself as?

BIG PICTURE PLANNING

Conjure an image of yourself at the height of your career success. What do you see that defines your success? This step is not about the specifics but consider what task you are doing, your image, work ethic and surroundings, this will help identify your job values and expectations.

STEP 2 How can you develop professionally to secure your vision?

STEP 3 Making an action plan.

Ideally, you would then take each individual goal, and break it down into manageable tasks. It is up to you how many sub-goals you desire, infact your future vision can turn into a step-by-step guide recorded hourly in your personal timetable. the closer you will get to an hourly vision plan.

Your Application

You should have a professional ‘to do’ list by this stage listing every individual goal, activity, experience that you would like to engage in, as well as any academic results you want to achieve, in particular subjects. Spread these out over the course of your degree with consideration to any timing restrictions study abroad must completed before your final year, you cannot graduate without 30 days legal experience, international study tours are normally run during the holidays etc.

What skills and experiences do you possess in your vision, that you currently lack? Research how you can develop these skills and continually seek opportunities to do so. See the section titled ‘Getting the Edge’ for advice on selecting university activities that align with your career objectives.

STEP 4 Is your plan realistic? Seasonal Clerkship

if your goal is within the context of established human capacity, it is achievable. However, the course of action you just planned may not result in success. Consider how hard you need to work both at university and in your career, and whether you are willing to do so. If you remain true to yourself and your personal abilities and consistently strive to be challenged, than following an effective goal system will almost always get you exactly where you want to be.

Learn to be accountable to yourself as you are now your own career CEO of your personal career planning service business. There is no point of having goals if you do not reflect on the reasons behind your successes and failures and the lessons you can learn or worse yet, you forget that you even set them. Career goals are not ‘ new years resolutions’. Update them regularly to align them with any new, significant, information or experience you have had. The clearer and more relevant the goal, the more likely it will provide an effective source of motivation.

YOUR LEGAL PERSONALITY The legal profession is traditionally quite conservative and highly ethical. If you have compromised your ability to demonstrate your respect for the law you may not be admitted into practise or if you do, you may not find a job.

Things to consider;

1. Don’t break the law You will need to declare all your speeding fines and any other infringement or charge before you are admitted as a solicitor. Sometimes you may be asked to justify yourself and explain why you want to practise law when you have demonstrated a disrespect towards it. One fine won’t jeopardize your career, but don’t let them add up.

Even if your profile is on private, there are ample methods on the internet to still find out information about you, and sources encouraging recruiters to utilize this tool. There are many stories that detail how facebook has effected the employment prospects of certain individuals. Though it may not be professional or fair and maybe even not a common technique, with so much uncertainty around internet privacy why take the risk? Rule of thumb: If you won’t present your status update, or photo in an interview, do not post it for the world. If you absolutely must, then put your profile on private, don’t add people you do not know and make sure you keep up to date with facebook changes as they usually effect your privacy settings.

3. Be nice The people in your law school will be your colleagues. You have an amazing opportunity to network now so make the most of it.

Some students pick electives in order to study overseas (China study tour), some pick electives pursuant to their perceived difficulty or lack thereof, some for a particular interest in that area of law or perhaps an opportunity to develop a practical skill (eg mediation). Each reason is equally as valid provided you have carefully considered all your options and made an informed choice. For instance, if you used up your electives and then decide you would like to practise international law, it would have benefited you to select a subject that exposed you to that field. Therefore when selecting subjects, consider each option carefully in the context of your established, or potential career goals. This unit analyses the impact of The Charter of Human Rights and Responsibilities 2006 (Vic) and how it impacts on all areas of the law.

The impact of The Charter is wide randing and thus students must be able to advise their future clients (if indeed they choose to practice) about how The Charter impacts their rights and responsibilities.

It is assessed by a combination of (i) on-going participation (20%); (ii) reflective essay of about 1000 words (10%); (iii) final role play on 5th day lasts about 2 hours (40%); (iv) 3000 word research paper due the last day of the relevant teaching term

This is an intensive 4 day workshop and is introductory in nature. While the focus is on mediation students are introduced to some of the key elements of interst-based negotiation and are encouraged to devlop an understandingof key interviewing, fact-finding and counselling skills relevant to all aspects of legal and related forms of profesional practice. These are skills that are not usually taught in a systematic manner in the curriculum.

This unit will grant students the skills in needed for not only mediation in the legal field but also interview skills and professional skills required for many areas across many industrties.

The law of restitution can be regarded as the third branch of civil obligations, which also comprises tort and contract. This unit examines the concept of unjust enrichment, which is the main principle underlying instances of restitutionary relief, and the nature of restitutionary relief. It also examine specific instances in which restitutionary relief may or may not be awarded, as well as defences.

A knowledge of restitution law is important for legal practitioners intending to work in commercial law or litigation, as it provides an ancillary or alternative cause of action or remedy in cases involving torts, contracts, and equity.

The unit aims to introduce students to the legal complexities associated with international trade and to familiarise them with some of the more important areas of law affecting that activity. The syllabus includes international supply of goods, Vienna sales convention, international carriage, conflict of laws, GATT, international banking and finance, marine insurance, foreign investment and resolution of international trade disputes.

This unit enables students to gain a further understanding of commercial transactions primarily on an international scale.

Chinese Commercial Law

The unit aims to enable students to develop an understanding of the Chinese legal system and its relationship to Chinese history and culture as well as to develop an awareness of Chinese commercial law in the context of foreign trade and investment. The unit covers Chinaâ&#x20AC;&#x2122;s legal history and current legal system, law of contract, law of joint ventures and 100% foreignowned enterprises, foreign trade law, protection of foreign intellectual property, labour and employment issues in foreign investment enterprises and dispute resolution.

With the Chineese economy growing at an unprecedented level, Chineese commercial transactions are proving to be a more prominent and lucrative occurrence within Australia and will aid any student planning on entering the broader area of commercial law.

Law Clinic

Community legal centres located in Melbourne, Geelong, St Albans, Melton, Ascot Vale, Coburg, Newport. Victoria Legal Aid, Ringwood office,. Also offered in India but must be completed with the the India Study Tour.

30% journal marked by the unit chair and 70% host employer assessment as to conduct and ability of student whilst attending law clinic.

The unit is only offered to Bachelor of Laws students. MLL351 Law Clinic counts for 12 days towards the professional work experience component of the course. (12 days of professional work experience. Most law clinic places offer students the opportunity to deal with real clients and real legal issues. STudents will assist lawyers with file work, attendance at court, conducting community legal education programs or designing them.

This unit provides a hands on real life work opportunity. Students are encouraged to interact with clients and assist in current legal matters. There is a high demand for this unit and students must apply for a position. The unit looks at the ways in which the interent challenges existing legal paradigms in areas such as jurisdiction, contract, intellectual property, privacy, content regulation and crime and assesses the responses of these challenges at national and international levels, with particular emphasis on Australian law.

The School of Law offers a Postgraduate Certificate in Commercial Law (Financial Crime Control) for students who wish to deepen their knowledge in relation to financial crime.

Environmental Law

Research paper 1 2000-2500 words 30%, research paper 2 5000-6000 words 70%

The unit aims to provide students with a sound understanding of the environmental protection regime in Victoria under the Environmental Protection Act 1970. The unit also examines common law mechanisms that may indirectly protect the environment. Federal initiatives, including Australiaâ&#x20AC;&#x2122;s new National Environment Protection Measures are also considered. An introduction to international regimes is undertaken in order to highlight the relationship between state, commonwealth and international measures.

This unit will enable students to discover whether or not the interesting and fullfilling field of environmental law is a right career path for them.

The nature, principles, structure and institutions of public international law are studied to enable students to develop an understanding of past and current issues concerning international affairs from an international law perspective. Topics include: the history, nature, sources, and subjects of international law; jurisdictions and immunity; creation and recognition of states and governments; the United Nations and International Court of Justice; human rights; refugees and the use of force.

This unit will allow students the insight of where our legal system fits in a global context in order to provide insight of whether or not students want to practice on an international level.

4 assignment tasks due upon the student’s return from India. May include participation, reflections, essay’s project work.

Covers a range of Indian laws, materials are provided to students prior to departing and students attend an induction program. The tour runs in India for approximately 15 days and covers at least 3 regions of India. A range of local Indian guest speakers participate in the program and students are given many opportunities to mix with Indian students.

The unit investigates the phenomenon of international financial crime and regulatory steps to combat crimes such as money laundering, terror financing, corruption and insider trading.

Commercial lawyers are required to mitigate financial crime risks when they engage clients, draft contracts and structure or conclude transactions. An understanding of financial crime is also essential for those who wish to follow a career in corporate compliance and legal risk management.

Provides an overview of the family law system in Australia and covers, marriage, de facto relationships, valid and invalid marriages, divorce, children’s issues, property issues and family violence.

Migration and refugee law are two of the fastest growing areas of law in Australia. Traditionally, migration agents represented individuals with migration or refugee related concerns. The unit also analyses the substantive and procedural rules and principles governing these areas of law.

India The purpose of the tour is to provide students with insights into the business, political, social and cultural diversity of this dynamic country.

Your Application

The tour transits with a stopover in Singapore then begins in Delhi, the capital of modern India. Next we visit the mystical city of Agra, home to the magnificent Taj Mahal and the Agra Fort then on to Jaipur, the renowned ‘pink city’. Finally we reach Mumbai, the business hub of India, for an extended program of engagement activities with students from partner universities. We will be hosted by some of Delhi’s and Mumbai’s leading universities. An exciting series of major inter-varsity activities are scheduled in each city: The ‘Great Debate’ and the Reach-Out Program receive great reviews and in cricket passionate India, the three intervarsity Twenty20 Cricket Challenges are always a highlight. VIS MOOT (Vienna, Hong Kong)

The Vis Moot involves three distinct stages of preparation — developing a memorandum containing legal arguments on behalf of the Claimant, then developing a memorandum containing legal arguments on behalf of the Respondent, and finally undertaking an intensive practice moot program in preparation for the oral rounds — which are held in Hong Kong and Vienna each year.

The Willem C. Vis International Commercial Arbitration Moot (the ‘Vis Moot’) is one of the world’s most highly regarded private international law mooting competitions. Like the moots you will be used to arguing from your experience in the PLS program and DLSS competitions, the Vis Moot involves teams of students arguing legal points in relation to a hypothetical legal dispute. However, unlike other moots you may have had an involvement with, the Vis Moot is an arbitration moot — being set in an international commercial arbitration setting rather than a court — and applies international commercial law relating to arbitration and the international sale of goods — rather than the domestic law of any particular country.

‘The Overseas Experience’ Deakin is one of the few universities from around the world to have competed in the Vis Moot every year since its inception. The oral rounds are held in Hong Kong and Vienna. Of the ten to twelve team members, the four most outstanding oralists are selected to represent the team and the Law School at these oral rounds. In both Hong Kong and Vienna, the oral rounds consist of four days of ‘general rounds’ and then a series of elimination finals. While the overseas experience is certainly an attractive part of the Vis Moot program, the most important part of the process are by far the skills you will acquire along the way if you are to take part. A substantial amount of time and effort goes into developing lengthy and high quality written submissions, practicing oral submissions through our practice moot program, and working together as a team to tackle a very large moot problem - this year’s problem was 73 pages in length! It is my experience that team members can get a lot out of the Vis Moot process - whether travelling to the oral rounds or not.

STUDENTS SAY Breigh Smith The Vis Moot provides students with a unique and exciting opportunity to learn the art of oral advocacy. Oral advocacy requires a different skill set to that which is used when writing an essay or answering an exam problem. Students are trained to build a persuasive case using techniques involving presentation, style and substance. To this end, the detailed individual feedback provided by experienced lawyers is invaluable to learning how to effectively communicate. Indeed, the Vis Moot is essential training for any aspiring legal advocate. However irrespective of whether you want to pursue a courtroom career; the skills learned give students an advantage in any vocation.

Karina Milshtein The opportunity to work on a realistic legal problem, developing research, drafting and oral advocacy skills, with a great team of people, under the guidance of a dedicates coach and with feedback from succesfull practicing lawyers, is unparalleled. To then gain international recognition for our team work on the written memoranda was incredible. I highly recommend this subject to everyone that wants to practise law or anyone just looking to have a fun and rewarding summer.

What’s involved? This year, the Deakin School of Law will be assembling a team of 10 to 12 students to participate in the Vis Moot program (with the four most outstanding oralists being selected to represent the team at the oral rounds). Work on this year’s problem will commence shortly after Trimester 2 exams conclude, and will continue full time at the Burwood Campus through to Easter 2012. The benefits of joining There is no denying that the Vis Moot is a lot of hard work, however there are few other programs that will allow you to undertake the depth of study, gain the mooting experience, and work closely in a team, that the Vis Moot provides. Successful completion of the program will earn you one credit point in MLL355 International Litigation and Dispute Settlement and, moreover, the Vis Moot is a very well known and highly regarded competition in the profession. The Australian National Rounds are held annually in February at the campus of the Australian National University, Canberra. In 2004 17 Australian law schools competed. The final is traditionally held in Court 1 of the High Court (think The Castle!) by a bench of three experts in international law. A sitting High Court Justice has acted in the past as President of the ICJ bench. Both teams which reach the Australian final go to Washington to moot with international teams.

Jessup Moot (Canberra, America)- The Philip C Jessup International Law Moot, held each year in Washington DC since 1959 is the largest and the most prestigious mooting competition in the world, More than 300 law schools from almost 50 nations participate. Set in the International Court of Justice the competition requires teams to prepare oral and written pleadings for a complex international legal problem. The Jessup moot problems are renowned for being cutting edge and controversial and the 2004 problem was no exception with the problem based upon the application and jurisdiction of the Rome Statute of the International Criminal Court.

DEVELOPING AN EDGE Employers these days are looking for well rounded individuals. Reciting the constitution off by heart may be impressive to fellow students, but a firmâ&#x20AC;&#x2122;s clients would not share the same enthusiasm. Participating in activities outside your studies can demonstrate an array of valued skills ie team work, community engagement, time management, interpersonal etc. Investigate and participate in the activities that you will enjoy and that will enrich your university experience and get you closer to your goals.

Work Experience Employers look for work experience as it shows maturity and that responsibility. They do not discount students who have had no legal work experience and recognise that the skills they look for can be demonstrated through a wide range of occupations. There is however a 30 day work experience requirement to graduate with a law degree, so make sure you plan accordingly!

Where to find legal work experience? Paralegal Paralegal jobs are very competititve. Most larger firms encourage you to send your resume in and they will keep it on file and notify you should an appropriate opportunity come up.

A word from former DLSS President Charlie Low Your time at university should be used to not only learn what is in your books, but your other personal strengths and weaknesses! If you were accepted by Deakin to study Law, a strength is obviously your studies, which only puts you on par with everyone else doing the same degree. Work experience, great references and knowing people in high places will all go some way to helping you get your foot in the door to a job of interest; no one doubts that. However, none of these may give you the professional and life experiences that are necessary to help with your self-development. It is the Deakin Law Students’ Society (DLSS) that can help you realise your strengths and weaknesses, whilst letting you improve yourself on a personal and professional level. The involvement within your role is very social and what you achieve is genuinely rewarding as it will affect your life as a Law student perhaps on a day-to-day basis. My time as a committee member has involved working in a team, problem solving, budgeting, drafting letters, networking with professionals, liaising with the School of Law, travelling interstate and dealing with student enquiries to name only a few; all of which you may not do in a regular hospitality or retail job. Granted you don’t get paid in this not-for-profit organisation, but that is not to say that you can still find time to hold down a job and develop your time management skills! Your career is very important and the DLSS, apart from it allowing you to improve yourself as a person, is the perfect subject of discussion in a job interview that you may have. Your experiences will cover so many of the bases that will be discussed such as giving examples when you have worked in a team, been put out of your comfort zone, been faced with a difficult situation, and displayed leadership. I owe so much of confidence to the DLSS and the opportunities that it presented me. If I could do my time again at University, getting involved with the DLSS would be priority number one.

DO Think personally Consider what you currently value in your life, what lifestyle you desire in the future and whether the organization can support this. If you love travelling, does the firm have international offices? Are there flexible working arrangements? If you play sport, will you have time to keep playing? Does the firm have their own team? Though you must demonstrate specific work based knowledge when applying, personal considerations help you develop a genuine interest in the firm, which is the key to a good application.

DON’T Generalize ‘Tiers’ and other labels are only indicative of certain traits for example the size and revenue of a firm. You should avoid adopting inferences that associate firm tiers with benefits that need to be subjectively qualified ie work complexity, job perks, level of intellectual stimulation For instance, do you consider a job perk as a free gym membership? Early finish time? Free cocktail parties? High superannuation contributions? These are all very different perks that are available in a range of very different firms and sectors. Make informed choices based on your own research, not generalisations.

Researching the firm is integral to a proper application. You need to demonstrate an interest in the firm you are applying for, and the best way to achieve this is to show knowledge of their practices, clients and legal work. Your first point of call for research is the firm’s website. Most firms maintain an extensive website outlining their goals, values and clients. Use this as a general background to the firm, but do not rely on it as your sole source of information. Be sure to check out the firm’s core values, its recent major deals and its size, including the location and scope of remote offices. The firm may also have recently published information on awards or professional recognition their partners may have garnered, so also be sure to check for this.

These sites are incredibly useful in forming a better picture of the firm you are applying to — to a young student many of the firms can seem similar, but a careful read of the above resources reveals the key differences between each one. Use these sites to check the firm’s areas of practice and, more importantly, which areas they are strongest in. The internet isn’t the only resource available to students. The year above provides you with a rich source of information — it’s just a matter of finding the right person to speak to. If you don’t know anyone who has previously clerked personally, approach the Deakin Law Students’ Society and they will be able to direct you — or possibly even help you themselves — to a previous clerk who may be able to help you with some questions.

WRITING APPLICATION General Advice Your written application must be sufficiently detailed to impress the reader and make them want to meet you. To achieve this within the confines of the word limit, you must write concisely and be selective in the information you provide. You must make an overall impact.

How? Use your specific knowledge of the firm from its work to its culture to consider what makes a ‘perfect’ candidate.

Revisit each element on your resume (achievements, employment history, activities etc) to identify how each one demonstrates a quality that would be valued by the firm, and why. If you can’t make a clear link – omit the information from your resume. If you cannot explain a point on your resume, detailing your experiences – omit it. You never know what the interviewers may find interest in, and even if you were not lying about it, if you cannot explain it, it won’t look good.

Your cover letter is where you can demonstrate your research on the firm, using it to substantiate your reasons for applying. For instance you could express your interest in a particular practise group, perhaps that interest stemmed from a case you read and then make a personal link to a job you took or activity that demonstrates your interest.

Take time to research everywhere you are applying to. Promising applications often demonstrate a genuine interest in, and understanding of, the firm to which the application is made. While many students skim websites or promotional material, those who go the extra mile to research a firm’s strengths, practice areas or direction (for example, by speaking with staff or reviewing industry publications) will appear to a reviewer to be far more engaged with that organisation.

There are many different organisations offering opportunities to law students. The first step in planning your application is to consider where you are applying. If you apply to a criminal law firm but state your chief interests as banking or taxation, that firm is less likely to consider you a serious candidate because your focus is not aligned with that of the firm. As the law offers careers in a varied range of fields, take the time to identify which organisations provide opportunities best matched to your goals and areas of interest.

Many students give in to the temptation to use complicated, old-fashioned language with the intention of sounding impressive. However, your covering letter is a reviewerâ&#x20AC;&#x2122;s first contact with you, so the chances of that letter resonating with the reader are higher if you come across as natural and sincere.

7. Show us your personality Firms want to learn about you as a person. Tell us what you are interested in outside the law. Donâ&#x20AC;&#x2122;t be afraid to list a few interests at the end of your resume. We want to see that you are a well-rounded and interesting person.

8. Highlight your strengths Success cannot be pre-determined with reference to a strict set of qualifications, skills and qualities. However, some characteristics that may provide a good indication of your strength as a candidate are your communication, leadership, teamwork, management and technical skills. Think about your everyday experiences which may demonstrate these qualities. Leadership may be shown by stagemanaging a play or taking a senior role in part-time employment. Balancing competing priorities (work, study and hobbies) demonstrates management skills. Teamwork may have been strengthened through group sports or a committee role. Technical skills are evidenced by academic results and practical experience relevant to the role for which you are applying. Finally, communication skills can be learned through tutoring or public speaking, and are demonstrated by your clear and concise covering letter and resume.

Support your claims with examples Irrespective of the strengths you choose to focus on in an application, you should support your assertions by providing practical examples in your resume of those experiences which have helped to hone your skills. It may also be useful to note your time commitments to specific activities (for example, stating how many hours per week you work or manage a hockey team), so that a reviewer gets a sense of the extent of your extra-curricular commitments.

Regardless of how qualified or intelligent you are, the notion of walking into a room and being interviewed can be extremely daunting. So here are a few simple rules...

Preparation is the key to a successful interview. Ensure that you conduct some background research on the firm and the people you will be meeting. Researching the particular partner or manager interviewing you and the cases they have been involved in will spark up conversation and show you are interested in the firm. If you are unsure of whom you will be meeting, ask the person organising the interview.

Be familiar with your CV. Be prepared to discuss your personal accomplishments and academic achievements in detail. Prior to the interview, prepare some questions that you may want to ask during the interview that cover areas such as the firm’s culture and future direction, training programs, career progression etc. The questions you ask an interviewer can be just as important as your answers to their questions.

Punctuality is crucial. Arriving late or even too early is very unprofessional. You will be judged on appearance so dress up! If in doubt wear a suit. Even if it’s jeans day at work, it’s never jeans day for an interview. Make sure you are not chewing gum. Take your i-Pod earphones out and switch off your mobile phone. A vibrating phone in your pocket during an interview can be disconcerting. Greet your interviewer with a firm handshake and greet them by name. Try not to intoxicate the interviewer with an overdose of perfume of aftershave and don’t wear so much ‘bling’ that you cause a distraction.

The majority of questions will all be phrased with an emphasis on the past, prompting you to talk through previous real life experiences – work, university, extracurricular activities etc. In order to answer these types of questions successfully, it’s important to think S.T.A.R. – Situation, Task, Action and Result. This will trigger your mind to think of the exact situation you were in at the time, the task that lay ahead of you, the action (or steps) you took to complete the task, and finally the result in terms of what transpired successfully or perhaps even not so successfully … after all nobody’s perfect! Think about what competencies (personal traits) you possess that can’t be assumed by simply looking at your CV. A few of the most commonly assessed competencies in interview rooms today are: assertiveness; enthusiasm; flexibility, leadership; organisational ability; and team contribution. However, do not limit yourself by preparing only for these. Finally remember to thank the interviewer for their time. Follow up is also advisable; sending a quick note to the person you have met thanking them for their time will be viewed positively.

Imagine yourself in an interview room. How would you answer these questions? Q: Describe yourself. In answering this question, the interviewer essentially wants to know: a) Who you are

c) Why you’re unique Self analysis and reflection is often the hardest step in interview preparation, and one of the most important. Think about the qualities that make you “you” and how this would translate into success in the role you are interviewing for. Bear in mind, the purpose of asking this question is for the interviewer to get a better idea of who you are. It is advisable to not over-think your response or to answer in a complex way.

To answer this question coherently, do not simply ‘list’ your interests. eg. “I am passionate about sport and reading”. Rather, expand on this by stating what you do, where you do it, and what it involves. eg. “I am passionate about rowing. I train three times a week and on Sunday mornings, I coach a group of high school kids.” An answer such as this indicates that not only are you passionate about your interest but you actively pursue your interest in life and try to make something of it.

The answer to a question such as this is critical to your success in the interview. 1. Know your three core values. These are personal values that are deeply ingrained in your character, such as loyalty, honesty, being proactive, etc. In other words, know what things are important to you and why these things important.

The term “strengths” refers to your core competencies or personal attributes. As mentioned previously, do some self reflection and think about the personal traits you possess that can’t be assumed by simply looking at your CV. Again, don’t just ‘list’ them — give examples!

In terms of “weaknesses”, having these is normal and completely natural so don’t be afraid to voice them. However, make sure you indicate your desire to work on or improve these, and show that you have begun to do so whether through your university or employment experience. eg. A weakness could be being overly perfectionist. A way to overcome this is to understand that ‘time means money’ in the commercial world, nobody’s perfect and sometimes asking for others’ input can help.

PROCESS SEASONAL CLERKSHIPS Seasonal clerkships traditionally have been an opportunity for students to get a feel for practicing law and what it is like to work in a firm. However, more so now than ever, they have become an opportunity for firms to get a feel for students and for students to get a feel of life as a lawyer and for working for a particular firm. Seasonal clerkships are important for a few reasons. The first is that it gives you a chance to find out what the practice of law is all about and to see first hand what is expected of a solicitor. Studying law is quite different from its application, so clerkships allow students to find out what they are working towards. This will also answer some of the perennial questions that haunt law students, like ‘is this really what I want to do?’, ‘do I have what it takes to succeed?’ and ‘will this firm block Facebook?’ All reasonable questions that will be answered during the clerkship. The work done by seasonal clerks is real legal work. Depending on the firm and practice group, work may include drafting letters of advice for clients, attending live mediations and hearings, or researching areas of law relevant to real cases. Firms will provide training and an introduction to the different practice areas as well as social events to help the transition from university to work life. These experiences can help to reveal the real nature of the firm being considered more than any advertisement or profile ever will. Seasonal clerkships are critically important to a firm when deciding who will be offered a Traineeship position. This may sound like a very competitive environment and it is, and at times it can be stressful, but throughout the clerkship, students are supported by both the firm and the other clerks. It can be demanding, but it is always incredibly enjoyable and rewarding. One of the main drawbacks from completing a clerkship is giving up holidays. However, students do complete clerkships collectively, with anywhere from 5 to 35 others students, and most importantly do enjoy the perks of the firm such as free drinks, which are usually showered over the clerks.

When made, seasonal offers will be open for at least 24 hours, and will pertain to the two summer clerkship periods, November/ December 2010 and January/February 2011, and the one winter clerkship period, June/July 2011. Most clerkships will last for 3-4 weeks and, at the conclusion of the winter clerkship 2011 period, applications for 2012 Graduate/Traineeship positions will open. These changes have been made to allow for a national uniformed application system, which will give students a better opportunity of applying interstate, as well as allowing firms to better predict their future graduate numbers (given that they will be predicting 6 months in advance, rather then an entire year). Apart from taking the next step in your careers development, you will spend three weeks forging friendships and building professional relationships. For these reasons, completing a seasonal clerkship may be one of the most important and satisfying experiences for a law student. Kate Burton Alexandra Wilson

2011 As any offer made under these guidelines relates to a graduate traineeship commencing in 2012, it is open to students who have already completed their law degree or students who will commence their final semester in 2011.

Law firms who have entered sponsorship arrangements with disadvantaged students, such as those employed under the Indigenous Cadetship Program, are exempt from complying with these guidelines in relation to those students.

Except as provided in paragraphs three, four, seven, eight and nine law firms will not interview applicants or make offers or arrangements concerning interviews before Monday, 22 August 2011.

As an exception to the principles set out above, law firms may make ‘priority offers’ of traineeships on the date set out in paragraph nine, to the following students:

An applicant, who due to ‘genuine necessity’ will be unable to attend an interview during the interview period, should apply to the Law Institute of Victoria (LIV) for permission to be interviewed at an earlier date. ‘Genuine necessity’ is defined as the need to be outside of Victoria during the interview period, for the purpose of postgraduate study, work experience or other purpose deemed reasonable by the LIV. Applications should be made to the LIV in writing and include appropriate supporting documentation. Written permission is to be granted at the sole discretion of the LIV.

The ‘priority offers’ made under paragraph eight can be made between 9.00am on Wednesday, 10 August 2011 and 12.00pm on Friday, 12 August 2011 and must remain open until the earlier of acceptance/rejection in accordance with paragraph 9(a) or 5:30pm on Friday, 12 August 2011. (a) An applicant will not hold more than two ‘priority offers’ for longer than a 24 hour period.

Firms intending to make priority offers are not permitted to interview applicants or to make offers or arrangements concerning traineeships prior to making a priority offer.

A firm may withdraw from the guidelines by giving (30) days written notice of its intention to the Law Institute of Victoria (LIV), the law faculties and law student societies at all Victorian law schools.

The LIV will maintain an up to date list of all signatory firms which will be publically available on the LIV website.

I have thoroughly enjoyed completing a seasonal clerkship at Blake Dawson. From the first day, I felt welcomed and it was clear that Blake Dawson actively made the effort to get to know their seasonal clerks. I applied for Blake Dawson for two main reasons. Firstly, Blake Dawson is a top-tier firm with an excellent client base, top quality practice teams and international recognition of its excellence. I was particularly impressed by the fact that the firm is the first (and only) law firm with an office in Tokyo, which creates even more opportunities for growth across the Asian region. The second reason was because I liked their clerkship program, which included mentoring by a Supervising Partner, a lawyer and a ‘buddy’ graduate, as well as a second contact in another practice team. What can you expect from a clerkship at Blake Dawson? Meeting heaps of friendly people. I have a feeling I have almost met everyone in the firm! Everybody wants to meet the new seasonals and get to know who we are. I used to feel quite intimidated about speaking to a partner, but discovered quite quickly they are down-to-earth, friendly and keen to make my experiences enjoyable in the firm. You can also expect to receive challenging work. There were definitely times when I felt out of my depth, but I think that made me more the willing to learn from my supervising partner and lawyer about how to tackle the issue. A highlight from my clerkship was being involved in client matters. It was exciting to know that my work would not only be seen by the team, but also presented to the client. You are probably wishing that I would just tell you how to get a clerkship at Blake Dawson, rather than force you to read about what a good time I had as a seasonal. The fact is Blake Dawson does not have set criteria for what they look for in a seasonal. If you have been to their information sessions, you would know that the HD average is not the norm. But I can tell you that during the interview, I did emphasise the advantages of being a Deakin law student, including being a very commercially focussed law student, choosing to study commerce-specific electives and having practical legal training (i.e. the 30-day PLT!) under my belt. Other tips I can share is to show you are involved in extra-curricular activities. My interviewers were very interested in what I do with my time besides studying. So I talked about my exchange experience in the Chinese Commercial Law Study Tour (highly recommended!), my role in the Undergraduate Student Mentor Program at Deakin (also highly recommended!) and my participation in the Victorian Women Lawyer (VWL) mentoring program. My interviewers were even interested in my obsession with snowboarding! So I guess to conclude, I would advise you to apply widely to all law firms but I definitely recommend the seasonal clerkship at Blake Dawson. Make the most of what DLSS offers law students and be involved in extracurricular activities!

I was given tasks by every lawyer and senior associate in my practice group, as well as my supervising partner. The opportunity to get feedback from so many professionals was incredibly helpful. Every task, no matter how small, was explained in context so I could gain an appreciation for the relevance of my work. The people at Corrs genuinely make sure that you feel as like you’re part of the team which is really fantastic.

Getting the Edge

The first two days of clerkship are spent with the other clerks getting to know about what is expected of us, learning the computing and research systems, Corrs policies, getting to know each other and meeting our supervising senior associate and partners. I was half expecting a competitive group of law students fighting to out-do one another; however, our group wasn’t competitive in the slightest. Rather, everybody went out of their way to support one another. I really got to know the other students in our group and still keep in contact with many of them.

Last December I had the opportunity to complete a four-week seasonal clerkship with Corrs Chambers Westgarth. Corrs are a large commercial law firm with offices in Brisbane, Perth, Sydney and Melbourne. I was lucky enough to be granted my first preference of working in the Workplace Relations practice group, having just completed (and enjoyed) my Workplace Law unit in semester two. I was also really fortunate to be invited, along with the other clerks, to the Corrs Christmas party and to my practice group’s Christmas party which was awesome. This is a real perk of completing a December clerkship!

The following represents a typical day of my clerkship:

9:00am: Check in with my buddy, mentor and supervising partner. I’ll be given new tasks for the day if any work has come in which I can assist with.

10am – 1pm: Work at my desk — usually involves managing at least two ongoing assignments. Might grab a coffee with another lawyer from our practice group if time permits. 1pm – 2pm: Lunch with other clerks in the lobby cafeteria. 2pm – 3pm: Attend a meeting or event with another lawyer — During my clerkship I attended pro bono briefings, client meetings, client presentations and a very interesting discussion between major Australian business leaders regarding the increased charitable spending of the Australian government chaired by the Corrs CEO John Denton.

Overall, I thoroughly enjoyed my experience at Corrs. I learned far more about life as a lawyer, generally and at Corrs specifically, than I would ever be able to gleam from a website or second-hand experiences. The highlight of my experience was definitely the amazingly friendly people around the office who helped create an incredibly supportive working environment. I strongly recommend that you apply for a clerkship at Corrs.

3pm – 6pm: Continue working at my desk. If I realise I may have capacity to complete my work for the day, I’ll knock on office doors and ask if there is anything else I can help with. This will normally give me a couple of jobs which I will either be able to complete today, or I will continue on with it the next morning if it is not urgent. My finishing time varied from day to day, however on average I would finish around 6pm. There was no expectation, nor even a desire, for me to remain in the office late and more than once I was encouraged to leave and enjoy the sunshine.

9:15am: Seminar with other clerks learning in depth about a practice group or function of Corrs. These presentations allowed us to learn more about the work Corrs is involved in outside of our own practice group, as well as other functions such as the pro bono program which I was happy to be involved in.

8:30am: Arrive at work, check emails and organise my day. Typically I’ll have a couple of ongoing tasks which may be due by the end of the day or week.

Clayton Utz looks for candidates with strong academics who, in addition, are well rounded people as evidenced by a broad range of experiences such as part-time employment, voluntary work, legal experience (voluntary or otherwise) and other activities, whether they be sporting, cultural or community pursuits. They need to show evidence of certain behavioural skills such as time management, initiative, goal-setting and achievement, teamwork, an understanding of client service and selfmotivation. To ensure you have all the help you need during your clerkship, you will be allocated a Supervising Partner, Mentor and a Buddy. Your Supervising Partner will be responsible for your workload, skills training and practical experience. Your Mentor is a senior lawyer who provides you with day-to-day guidance, including clarifying what is expected of you as well as helping you build your skills base to assist with your career development. Your Buddy is a junior lawyer who will help you settle into the firm and your practice group.

What sort of work will be undertaken?

Our two-year graduate program encompasses three rotations in different practice groups. During each rotation of eight months, graduates are assigned a supervising partner and buddy. A structured learning and development program also supports the on-the-job learning. One of the best ways of finding out if Freehills is the right fit for you is to spend some time working with us — so we do encourage students to participate in our vacation clerkship program. We fill the majority of our graduate positions through that program. The aim of our vacation clerkship program is to provide penultimate year students with a taste of how a large commercial law firm goes about meeting the needs of its clients. Our offices in Sydney, Melbourne, Perth and Brisbane and Singapore run vacation clerkships in summer, and some run smaller programs in the winter months. The program includes a detailed introduction to the firm and to each practice group as well as the opportunity to work with our legal teams on real matters. COMMUNITY LEGAL CENTRES: A passion for justice Community legal centres (CLCs) address social and economic disadvantage through a strategic combination of legal advice, casework, community legal education and law reform. They empower individuals and communities to be their own agents of positive change. CLC lawyers are social change lawyers who go beyond the traditional transactional approach of legal services to change the underlying conditions which cause social and economic inequity. CLCs are closely connected to the community in which they work are driven by their communityâ&#x20AC;&#x2122;s needs. CLC work is about improving peopleâ&#x20AC;&#x2122;s lives through the law. The CLC Law Graduate Scheme

The skills and knowledge required to be a successful CLC lawyer goes beyond the scope of traditional legal training and practice. The CLC Law Graduate Scheme program provides new CLC lawyers with the specialised legal and community development skills required for effective social change practice. The Law graduates in the program make a direct and immediate contribution to service delivery in the host CLCs through casework, community legal education and law reform work. I am currently the Co-Chair of the Regional and Suburban Young Lawyers’ Committee of the Law Institute of Victoria (“LIV”), the Gippsland Young Lawyers’ Representative and the Gippsland Law Association Secretary and through these roles and being a young lawyer I bring a realistic point of view to the experience of working as a graduate in regional and rural Australia (herein referred to regional areas). A part of my role is to support regional young lawyers and encourage young lawyers to practise in regional Victoria and support local law firms with the notion that employing graduates can have significant benefits to their firms.

Your Application

I am also keen on educating graduates who come to Regional Victoria and young lawyers who have commenced their traineeship in Regional Victoria by facilitating social and networking events in regional (and suburban) areas for young lawyers with their peers. I volunteer my time to provide these interactions and help create connections amongst young lawyers in the hope that in time young lawyers may become entrenched in the regional area and wish to remain rather than relocate back to the metropolitan regions. As a young lawyer that was educated and grew up in Melbourne, I can bring a fresh perspective as I now call Regional Victoria home.

During university I never really had a strong desire to practise at a top tier law firm and my mentors, which included barristers, were weary of my larger than life personality being stifled by them. I did however have a strong desire to enter into advocacy in any form with the intention of eventually going to the BAR as a barrister. Consequently, my mentors told me to consider applying for Articles in Gippsland as I was fortunate that my parents had a country property that I could move into straight away.

Initially I mocked the idea because of that unspoken stigma but as my friends started to confirm acceptances of their Articles, I started doing research about firms in the Warragul area of Gippsland because I knew that my beloved Melbourne was only an hour’s drive away. I was lucky enough to obtain Articles at the first firm I applied for being Wakefield & Vogrig Lawyers who have offices in Warragul and Drouin.

Choosing Your Path

Deciding where to apply to do your traineeship, formerly, Articles of Clerkship (“Articles”) should be a personal decision. It is a decision that is overlooked by many graduates as practising in a top tier firm is the most commonly marketed avenue presented to them at university and any other options have an unnecessary and unspoken stigma attached to it. Having spoken to law students at length, there is a common misconception that anything other than a corporate role in a top tier city firm is not considered real legal work, and given the competitiveness of law schools, these students feel like the large firms are the only option.

My experience and discovered benefits of practising in Regional Victoria Practising in a regional area is different from practising in the metropolitan and city regions. Every day is different, the work diverse and challenging and the cases ever changing: there is no typical week. My experience was summed up by myself in an article I wrote for the LIV Young Lawyers Journal Edition in Winter 2009 entitled “Life in Regional Victoria: Practising in regional Victoria involves a lot more than cows on the road” the following are some excerpts: I began my Articles in March 2007 at the Drouin office of Wakefield & Vogrig Lawyers I was fortunate enough to already have a place to live, but the next thing I knew I was faced with the issue of cows roaming on the side of the road and foxes howling at night. I thought “What have I done,” but two years [now almost four years on] I can unequivocally say that it was one of the best decisions I could have made for my career. In my articles year I was the instructing solicitor for a million-dollar intellectual property matter in the Federal Court which meant I got to go to Melbourne a lot. I was also granted leave to appear in the Magistrates’ Court as an articled clerk for both summary and indictable matters. I have also appeared in the Supreme Court. I think I was the youngest in the courtroom. There is no price that you can put on this experience. I have noticed that in one of the main areas I practise, criminal law, there is a striking difference between the city and the regional areas. In the regional areas you are able to build relationships with the local judiciary and enjoy stronger and more tangible relationships with the prosecution. And there is always the opportunity to get a city fix by coming to Melbourne to instruct in trials in the County, Supreme, Federal and Federal Magistrates Courts. Initially, I would drive back to Melbourne every night and weekend to keep up my social calendar until I made the conscious decision to engross myself into the community and embrace the region, including the wineries. I also thought I should find a local beautician and learn to cook. This might sound facetious but I was not going to survive if I kept driving home to Melbourne to get my nails done and to have home cooked meals every night. I decided to attend my first young event by myself during my Articles year, I know that not everyone is willing to move out of their comfort zone, but I thought this was one way to meet other young professionals however only two other people attended. I then decided to nominate myself for positions of the Gippsland Young Lawyers’ Representative and co-chair of the Regional and Suburban Young Lawyers’ Committee. I was successful in obtaining these roles which has allowed me to build professional and social networks and promote the needs of young lawyers in the region. These are stimulating and rewarding roles that have greatly improved my professional skills and furnished me with exciting opportunities for the future. As the Young Lawyer representative I have hosted several dinners including a Murder Mystery evening and several dinners with members of the local judiciary but it has been hard work. My first function was a wine appreciation evening and I only had three young lawyers reply so I arranged for my friends and parents from Melbourne to attend together with my colleagues from the firm to support my function. Despite it being a great event I was concerned that the young lawyer response was similar to the first young lawyer event I attended. So over the last three years I made it a priority to “harass” my fellow young lawyers, within enthusiastic reason, and to get to know them so that they felt comfortable to attend an event knowing another young lawyer. Now we host regularly dinners and the latest event was at a Traralgon Vineyard during Regional and Suburban Young Lawyers Week to which we had 25 young lawyers and two local Magistrates’ attend. Such events provide the young lawyers with an invaluable opportunity to network with the local judiciary so their next appearance in the local Magistrates’ Court is not so daunting. Unlike other regional areas, I have always been mindful of a main issue in my region being the distance young lawyers are from each other. Gippsland is a vast area therefore I have ensured that the events I 146

I can summarise the benefits as a result of my experience from practising in regional Victoria as follows:

Client relationships: The personal dealings with your clients are invaluable as you are more likely to be involved with the duration of the engagement with a client. There is nothing more satisfying then seeing the completion and result of all your hard work. Furthermore, it allows you to develop your own client base and rapport with those clients.

Cost of living: Living in the regional area means that the cost of housing is cheaper and often your fruit and vegetables is fresh local produce. As local lawyers you offer a huge service to the community by allowing access to justice so that clients do not have to travel to metropolitan areas for legal advice plus many firms provide legal aid.

Choosing Your Path

Work life balance: Moreover, the work and life balance is encouraged in regional areas. Although there is an obvious requirement that you put the essential amounts of attention, time and energy into your work, there is also a strong acknowledgement of the fact that there is only so much fuel in our tanks, and that taking the time to relax with family and friends is a necessity. And, with the appealing array of natural, culinary and tourist attractions on offer in regional Australia - from its vineyards and beaches, to its national parks and cute cafes - why wouldn’t you want to balance up the scales and take time to explore your surrounds such local vineyards or take in the local scenery.

Autonomy: Young lawyers are more likely to gain credibility by being successful with handling their own files and cases. The level of autonomy will lead to your gathering momentum and clients will gravitate, especially as you cases can get local media attention. In addition, you are not required to invoice in six minute increments and have a lot more flexibility.

Your Application

Areas of Law: A common issue is that young lawyers are often seen as unable to handle complicated cases. Practising in a regional area enables you to deal with several areas of law, to help solve the most complex of cases earlier on in your career and see the intricacies of how the law works outside of a textbook. For example, one week I dealt with Family Violence Intervention Orders, drafted Wills and Leases, prepared for a rape trial, appeared in a Magistrates’ Court that is an hour away to do several pleas, the next to be instructed in a pre-hearing conference involving issues with hay and then a civil matter involving water buffaloes. No week is the same.

Getting the Edge

Diversity: Practising in a regional law firm allows you to deal with a diverse range of areas in law and each day is different. For example, one week I went from dealing with injuries against cows and intellectual property litigation, the next week was opening up two new files dealing with a fraud and rape trial.

Creating Your Experiences

I have now been practicing in Gippsland for almost four years and have instructed in Supreme Court trials which lead to a moment of glory on the nightly news and often run my own contest hearings in the Magistrates’ Court. I also appeared in a successful County Court Appeal. This allows me to satisfy my love of the theatre of law in advocacy. l challenge you to ask any young lawyer in Melbourne if they can say the same they have had the same depth of experience in a short period of time.

I have found it interesting that many of the benefits that I have detailed were also addressed in the 2009 Law Council of Australia/Law Institute of Victoria nationwide survey of lawyers in rural regional and remote (RRR) areas of Australia (the RRR survey). It is not until you work in a regional area that you will be able to truly appreciate what it has to offer. Where else can you go from one central location to an abundance of beautiful places such as beaches, the snow or vineyards, after spending a day in court or in the office? Plus the drive to work or court is usually surrounded by exquisite scenery.

Being apart of the community: More recently many local practitioners were able to keep the community spirit alive as a result of the Black Saturday Fires on 7 February 2009 which seriously affected many local clients. This tragic event changed the relationship between the regional community and their local lawyers who assisted at the relief centres in case local residents needed legal advice. I assisted at the relief centre in Labertouche that assisted West Gippsland that was affected by the Bunyip State Forest fires there also were relief centres in Latrobe Valley that assisted the victims of the Churchill fire. There were many other relief centres that lawyers volunteered in across regional Victoria which was arranged by the LIV, PILCH, Victorian Bar, Victoria Legal Aid and Victoria Law Foundation. It was at this point that I realised the difference between city and country lawyering, and that is the communities and how we were able to assist during such times. After all it is unlikely you will bump into your clients down the street grocery shopping or be able to see them after their file is closed in the metropolitan regions.
