Editorial Distributor Dear Fecc members, I have the pleasure of sending you the last and final edition of the quarterly Distributor publication, covering news about Fecc regulatory activities from August 2018 until now.

The last six months have been a little shaky due to the departure of all but one of the Fecc team in charge of Fecc in June 2018. We were happy and grateful that under these challenging circumstances, Dr. Gerhard Ahlbrecht remained on board. Dr. Ahlbrecht, of German nationality, joined Fecc on 7 January 2015. His role is Regulatory Affairs Manager in charge of the Technical Committees Responsible Care, Logistics, Precursors and the ESAD Steering Committee. He faithfully supported us as Fecc “memory” during these busy months. These months have given us the unique opportunity to build a new, very diverse team with an open, co-operative and dynamic mindset. The Fecc President, Dr. Neville Prior, Chairman of the Cornelius Group; Fecc Vice-President, Frank Schneider of the IMCD Group and the Fecc Treasurer, Peter Newport, CEO of CBA, as well as the whole Fecc Board gave their full support and guidance in navigating through these turbulent, but interesting times. Together with forming a team that is characterised by expertise and diversity inclusion, we dedicated time and efforts to modernising the Fecc offices and making them more able to rise to the challenge of remote meetings. At the same time, we turned them into an attractive place to work in and visit. We did that as much for the staff, as for the representatives of Fecc members and stakeholders as well as for the organisations with whom we work. We also modernised our network of service suppliers, including IT, and simplified administrative processes to free up time to focus on Fecc’s core competencies and the delivery of its services to members. In November 2018, we co-signed the ADCA letter to the Commissioner and Vice President Frans Timmermans. Fecc remains actively engaged in INDUSTRY4 EUROPE – a coalition of European Associations working together in a joint advocacy effort for an ambitious EU Industrial Strategy – by participating in several events in Brussels during Q1 of this year.

We had a very productive meeting with the Chairs and ViceChairs of all Fecc Technical Committees and Task Forces at the end of February 2019 and reviewed our goals, the topics to be covered, and the membership and operating rules of these committees. A decision, approved by the Fecc Board, was taken to keep the existing Committees as they are, whilst the need for mapping and evaluating the networking activities we have in Cefic groups and other networking organisations was emphasised. This will be taken up once again in the coming months and shared with you as soon as the work is complete. More details on the Committees and Task Force activities are given below. Before turning to the report on the activities, allow me to introduce you to the newcomer to the Fecc Team, Michela Pichereddu. From 25 March 2019, Michela, of Italian nationality, Communications Officer and Web Master. BA in Foreign Languages and Multicultural Communications and MSc in International Relations from the Faculty of Political Sciences, University of Milano. She worked for 4 years as a communications manager and web master, as well as the social media manager for the Federation of European Neuroscience Societies (FENS), hosting meganetworking events and bringing together 24,000 members, predominantly scientists, from 33 European countries. Michela, will join the new team introduced to you in the 2018 Christmas Greetings. The whole Fecc team, each in their respective area of expertise, is fully committed and motivated to serve Fecc members to the best of their abilities. Our managers in regulatory affairs, in particular, are ready to offer their knowledge and their technical support to Fecc members regarding the fulfilment of legal obligations. They will also work with the distribution sector on the identification, development, and sharing of best practice in trading and chemical distribution so that sustainability goals can be met. In addition to actively promoting Fecc and the Distribution sector at Fecc or at joint events with stakeholders, our managers will also develop new projects in the Technical Committees and Task Forces, and share the conclusions of research, studies and benchmarks through workshops that are designed to challenge.

We all know it is as important to communicate about performance, as it is to achieve things. Therefore, from mid- April 2019 onwards, we will replace the quarterly Distributor with a monthly “Fecc News” edition comprising:

1. News about Fecc activities (the Board of Directors, Technical Committees, staff news)

2. News from Fecc members 3. News about the general market. 4. One month before the Fecc General Assembly, we

will issue an Annual Report with the 2018 audited accounts, the audit report, a letter from the President, a short description of achievements in 2018 and 2019, plans and strategy development, a membership list & development and governance descriptions.

We hope you enjoy reading the Distributor and while you do, the whole Fecc team will be working hard on the upcoming Fecc Congress is Sitges, near Barcelona, Spain, to be held on 13 and 14 June this year. The congress will be preceded, as usual, by internal Fecc meetings during the day of 12 June 2019, and the opening networking cocktail in the evening of 12 June. 13 June 2019 Registrations will be open from 08:00 AM. The 2019 Fecc Congress will follow a new programme format starting with a networking Breakfast at 8.30 taking place in front of the congress meeting room. The congress programme consists of two panel sessions, one in the morning (09:30 AM – 12:30 PM) and one in the afternoon (02:00 PM – 05:00 PM). Speakers are high-level participants who will debate and share their vision and expectations of the future for chemical distribution. The speakers will include suppliers and customers of the distributors. Moderated by the experienced Katrina Sichel, the panels will be on the following topics: ❚ ❚ ❚ ❚

FECC PRECURSORS COMMITTEE Explosives Precursors

Fecc continued to participate in the revision process of EU Regulation 98/2013 (Marketing and Use of Explosives Precursors). After having provided input to online surveys, online workshops, interviews and an open public consultation engaging actively with the European Commission, DG HOME, in particular the Standing Committee on Precursors (SCP), and submitting the Fecc Position (Feedback), Fecc engaged further in the legislative process by discussing the topic with the Rapporteur of the LIBE Committee on this

subject in the European Parliament (EP) on 29 August 2018. As a result of these advocacy activities, Fecc — in close cooperation with CBA/VCH — had the opportunity to make a presentation at the LIBE Shadows Meeting (EP) on 5 September 2018, thus outlining the position and concerns of the chemical distribution sector. Further input was provided by commenting the various MEP amendments in the process.

Chemical Distribution Sector Voice heard at Joint CBRN Advisory Group & SCP Meeting in Brussels on 24 September 2018 Fecc, accompanied by CBA and VCH, participated proactively in the dialogue between the European Commission and the private sector on the occasion of the Joint Meeting of the CBRN (Chemical, Biological, Radiological and Nuclear) Advisory Group and the SCP (Standing Committee on Precursors) in Brussels on 24 September 2018. In this context, Fecc’s member national association CBA made a presentation outlining industry’s progress in

contributing to the management of CBRN issues. Thus, the European Commission learned about the proactive and collaborative initiatives taken by industry at a national, global and EU level to deal with contemporary CBRN threats. They include creating awareness of the issues and the substances of concern, improving the vigilance of employees, applying correct systems and procedures, and reducing the risk of the illegal diversion of chemical substances.

Drug Precursors Fecc provided comprehensive feedback for the Consultants’ (RPA) Targeted Questionnaire for Industry Associations and took part in the Public Consultation on the Evaluation of the EU Drug Precursors Regulation — submitting the chemical distribution sector’s view in October 2018 after

having internally consolidated input from its members. In an in-depth interview, Fecc/CBA provided further insight to RPA and analysed the draft study findings which were then discussed at the European Commission Workshop on the EU Drug Precursors Regulation held on 14 December 2018.

MAKING EUROPE A SAFER PLACE: DEMONSTRATING THE IMPACT OF EU-FUNDED SECURITY RESEARCH The Committee Secretariat is pleased to advise that the European Commission and the Austrian Ministry for Transport, Innovation and Technology held the 2018 Security Research Event (SRE) on 5 and 6 December 2018 in Brussels at the Square Meeting Centre. Conference overview The SRE is the annual conference where industry, public authorities and knowledge institutions come together to discuss the state-of-play and future challenges for security research in Europe, and where a selection of EU-funded, security-related projects are showcased in a large exhibition area.

Under the theme ‘Making Europe a safer place — demonstrating the impact of EU-funded security research’, SRE 2018 demonstrated the strength and inspiring results of security-related research and innovation activities. The event brought together 800 participants, representing a wide range of security stakeholders: researchers, industry representatives, public security providers and practitioners (i.e. fire services, police, border guards, intelligence agencies, etc.), as well as policymakers from across Europe.

second day was focused on thematic panels debating the overarching theme in the security-related areas of Border Management, Citizens Awareness, Cybercrime, Protection of Public Spaces, Maritime Security, Disaster-Resilient Societies, Terrorism and Radicalisation. Furthermore, during the two-day event, up to 50 projects representing the different areas of EU security research were showcased. The conference agenda is available on the SRE website.

The dissemination and outreach of projects were the cornerstone of the conference's discussions. The first day of the conference was dedicated to high-level panels, and a dinner reception was hosted by the Austrian Presidency. The

In October 2018, Fecc — in cooperation with Brenntag — successfully submitted its application for expert membership of the newly formed Digital Transport & Logistics Forum (DTLF), DG MOVE — European Commission. Brenntag (represented by Philipp Szukat, Digital Supply Chain Manager EMEA) and Fecc (represented by Gerhard Ahlbrecht, Responsible Care & Logistics Manager) attended the first Plenary Meeting which took place in Brussels on 15 January 2019. The Committee Secretariat wishes to advise you about the publication of the document below: Commission Implementing Decision (EU) 2018/936 of 29 June 2018 authorising Member States to adopt certain derogations pursuant to Directive 2008/68/EC of the European Parliament and of the Council on the inland transport of dangerous goods (notified under document C(2018) 4003), OJ L 165, 2.7.2018, p. 42. The text is available online at:  Commission Implementing Decision (EU) 2018/936 Furthermore, we would like to inform you that: DIRECTIVE 2014/47/EU (2014) on the technical roadside inspection of the roadworthiness of commercial vehicles circulating in the European Union had to be adopted and published by Member States by 20 May 2017 whereby national measures shall be applied from 20 May 2018.

CoESS has published the deliverables of an Insider Threat project, funded by DG HOME (Internal Security Fund). It consists of awareness training, as well as an Insider Threat Program Builder and a manual that can be downloaded. This manual is currently being updated; the new version should be ready in spring 2019. 

Finally, the Committee Secretariat would like to inform you that: ❚C IT (International Rail Transport Committee) has published a change in rail transport documents. Be aware that the new documents entered into force on 1 January 2019. ❚T he documents concern the new specimens of the CIM/SMGS consignment note, CIM/SMGS additional invoice, CIM/ SMGS wagon and container lists, and CIM/ SMGS formal report. ❚T he circular letter is also available on the CIT website and can be downloaded here.

Thank you for your collaboration. At the Fecc Logistics Committee Meeting held in Brussels on 6 November 2018, Catherine Piana, Director General of the Confederation of European Security Services (CoESS), made an extremely interesting presentation on ‘Best practices in Land Transport Security’ (available on request for Fecc members only). A presentation encompassing all modes of transport can be found here: CoESS. An important issue here is ‘Insider Threat’, for which CoESS developed the Help2Protect platform, a platform where

During the event, Gerhard Ahlbrecht, Fecc Responsible Care & Logistics Manager, gave the following outline: ‘Fecc is the voice of the Chemical Distribution Industry in Europe. Brenntag has been one of our larger-sized company members promoting Responsible Care over many years and showing their commitment to continuous improvement. The Committee Meeting on 19 September 2018 was held at the Brenntag House of Elements for the first time. Speaking on behalf of the Fecc Responsible Care Committee, I would like to say “Thank You” for hosting the meeting and my sincere congratulations to Brenntag for their newly designed

headquarters. It was great to see that with the LEED Gold certified House of Elements, Brenntag has clearly demonstrated that environmental sustainability is very much embedded into the company’s culture.’ Robert Stuyt, Secretary General of the Dutch Chemical Trade Association VHCP and Chairman of the Fecc Responsible Care Committee, added: ‘The Team very much enjoyed Brenntag’s hospitality at the House of Elements which contributed a lot to the success of our Responsible Care Committee meeting. Fecc developed the European

Responsible Care Programme as a pan-European tailormade initiative for distributors. The programme aims to accelerate the progress of Responsible Care at a European level and boost recognition of credible implementation by suppliers and customers. Once again, Brenntag has shown that the company is taking a leading role in making this programme a great success.’ At the Meeting in Essen, the Committee addressed, among other things, increasing concerns with regard to misloads as illustrated in the video ‘Mixed Connection — Toxic Results’, a CSB case study on chlorine gas development after misload. This issue, which represents a major risk in

the chemical distribution sector, was high on the agenda. A presentation on ‘Misloads — Brenntag Global Approach’ was made by Brenntag’s QSHE Manager EMEA Aliaksei Lashuk. The European Solvent Recycler Group — (ESRG) published the ESRG study ‘Carbon footprint of Recycled Solvents at the sectoral level comparted to virgin solvents’ The study illustrates the benefits of solvent recycling. The ESRG in cooperation with ETHOS Research (UK) has released a comparative study which illustrates the annual CO2 footprint of organic solvents recycled in Europe by ESRG members in relation to the CO2 footprint of virgin solvents. A Life Cycle Assessment following the ISO 14044 methodology was used as a tool to estimate the CO2 footprint of both types. The findings suggest that recycling 309 kt of used solvents each year

can save 618 kt CO2 eq. per year. This is equivalent to annually avoiding the greenhouse gas emissions of 280 000 diesel cars. For more informatiion, please go to the ESRG Press Release which contains a link to the ESRG website where you can find the study itself.

Winners of the Cefic Responsible Care Awards 2018: BASF, Reckhaus GmbH & Co, Versalis SpA and Essenscia

BASF received the Chemical Safety Award for its successful multi-year stakeholder engagement programme to demonstrate the safety of nanomaterials to regulators and NGOs;

SQAS Distributors / ESAD Steering Committee: New SQAS/ESAD Questionnaires + Breakthrough on TfS Recognition

Reckhaus GmbH & Co won the Environmental Responsibility Award for its innovative project Insect Respect, which ensures ecological compensation for insects killed by a biocide;

The SQAS/ESAD Questionnaires were revised and updated within the Committee, in close collaboration with Cefic, as part of the general revison of the SQAS system and its different modules. The new Questionnaires (2019) entered into force at the beginning of 2019.

Versalis SpA won the Sustainability Workplace Award with the development of a safety perception and behavioural model to improve employee safety culture and ethics at Versalis’ facilities; Essenscia (the Belgian Federation for Chemistry and Life Sciences industries) carried off the National Associations Award for their capacity-building project to help Belgian SMEs comply with EU chemicals legislation, including support with meeting the last REACH registration deadline. Though not selected as winners, the jury gave a special mention to: ❚ The Association of the Chemical Industry of the Czech Republic for their project aimed at engaging with young people to encourage them to study chemistry and join the chemical industry;

Under this SQAS/ESAD 2019 Revision, CBA/Fecc made presentations at the three SQAS Re-Accreditation Assessor Training events — organised in November 2018 — explaining the major changes in the new ESAD Questionnaires to assessors. The SQAS core has also now been adopted as the basis of the ESAD questionnaire, supplemented by any questions in the Distributor (Di) document not covered in the SQAS core. TfS recognition has now been achieved for ESAD 2019 on the same basis as other modules. However, Ecovadis assessments are not included in the recognition.

UN Global Compact Progress Report 2018 published The Report provides an assessment of how companies in the UN Global Compact are adopting the Ten Principles and taking action to deliver on the Sustainable Development Goals. Based on data collected in the UN Global Compact annual survey and other sources, the report takes stock of how companies are performing when it comes to integrating the Ten Principles into their strategies and operations. FECC SHE COMMITTEE CHEMICAL DISTRIBUTION SECTOR VOICE FOR REACH REGULATION PROJECTS Exchange Network on Exposure Scenarios (ENES)

This collaborative network aims to identify good practices on preparing and implementing exposure scenarios and develop an effective communication exchange between supply chain actors to improve the protection of human health and the environment. Under ECHA’s ‘ENES Work Programme until 2020: Improving safe use of chemicals in supply chains’, Fecc continued to take part in the ECHA project ‘ECHA-Stakeholder Exchange Network on Exposure Scenarios (ENES)’. Brenntag engaged actively with the Fecc members in the online survey and compiled the answers, while Brenntag representative Mrs Marianne Lyngsaae, Quality System Manager, REACH and Biocide Advisor, participated in the ECHA Forum-31 meeting on 13-16 November 2018, with a presentation on Fecc good practice guidance for tank storage. Proposals for harmonisation of consolidated exposure scenarios were published in the Fecc Guidance on Exposure Scenarios, while the conclusions of a wider analysis of collected public data will be provided in a final report to

ECHA in the first semester of 2019 and disseminated to Fecc members. 

European Union Observatory for Nanomaterials (EUON) The European Union Observatory for Nanomaterials (EUON) provides information about the safety, innovation, research and uses of nanomaterials on the EU market. It is funded by the European Commission and hosted and maintained by ECHA. At present, Fecc mainly participates in the next generations of nanomaterials, i.e. those which go beyond the first generation of passive nanostructures. The twofold objective of the project is to identify those next generation nanomaterials already on the market or which may appear on the market in the coming years, while considering whether the terminology in the EU chemicals regulations and the legal requirements for their identification and characterisation are suitable for dealing with these next generations. 

FECC PARTICIPATION IN EXPERT GROUPS Fecc takes part in the ECHA Nanomaterials Expert Group (ECHA-NMEG) The ECHA-NMEG now consists of 34 representatives of the Member State Competent Authorities, 21 representatives of various accredited stakeholder organisations and six representatives of the EU institutions, namely the European Commission (DG GROW and JRC) and European Food Safety Authority. The list of experts nominated for NMEG and the NMEG manual will be made public on the ECHA website by the end of March.

A specific revision of the REACH information requirements for nanomaterials has now been adopted by the European Commission. Further input was provided by commenting on the various stages in the current activities of the Nanomaterials Experts Group. The amendments clarify the information that companies placing substances in nanoform on the market need to provide in their registration dossiers. The new rules apply as of 1 January 2020. Fecc participates as an observer in the HelpNet Steering Group and provides harmonised answers to REACH and CLP questions.

REACH and CLP helpdesks of the 27 EU Member States, Norway, Iceland and ECHA form the HelpNet Steering Group. The European Commission is an associated member.

HelpNet is the common network of national REACH and CLP (Classification, Labelling and Packaging) helpdesks. The objective of the network is to promote consistent, harmonised answers and the best possible advice to companies seeking to fulfil their obligations under the REACH and CLP Regulations, in order to contribute to the overall success of REACH and CLP implementation.

The HelpNet Steering Group also has observers from EU-wide helpdesks operated by industry stakeholders as well as observers representing EU candidate countries. The HelpNet Steering Group meets on a regular basis to discuss issues of common interest, future activities and the functioning and organisation of the helpdesks and the network. 

FECC BIOCIDES TASK FORCE Fecc participates as an observer in the ECHA Biocidal Products Committee Fecc, as an accredited stakeholder, supports ECHA's work through participation in consultations and attendance at opening sessions of meetings in order to ensure an efficient information flow from the field to ECHA and vice versa. 

Fecc involved in the ECHA Biocides Coordination Group (CG) As a member of the working group, together with other relevant stakeholder observers, Fecc provides feedback and support to ECHA’s Biocides Committee for the preparation of its guidance document and opinions, contributing to the harmonisation of risk assessment under the Biocidal Products Regulation (BPR). Fecc discusses and expresses its

opinion on any general proposals or technical documents related to the responsibilities specified in the BPR, and is committed to actively contributing to the efficient conduct of the business of the CG, taking on their fair share of the workload, respecting agreed deadlines and taking part in the discussions of the CG.

Summit on Health, Safety and Environment Fecc representatives attended the biggest health and safety event, the HSE 360° Summit on 7 and 8 February, 2019, in Frankfurt, Germany. Fecc had its say during debate sessions on a wide range of topics, including safety culture & leadership, technology, behavioural safety, regulatory updates, risk management, and how to engage employees in HSE culture.

FECC LIFE SCIENCES COMMITTEE Life Sciences Committee: Initially, the Committee had focused on the pharmaceutical sector, where Fecc Members are committed to the WHO standards for Good Trade and Distribution Practice (GTDP). However, the Committee has recently expanded its activities to include food, feed and cosmetics industries, where it monitors European and international initiatives and works actively to define GTDP for these sectors.

The Committee also acts as a stakeholder in relevant meetings with the European and international regulatory authorities, including the European Medicines Agency (EMA), the Council of Europe, the WHO and the European Food Safety Authority (EFSA). It monitors and works closely with other international organisations involved in the pharmaceutical supply chain.

Achievements 2018 Successful NEW STRUCTURE of the Committee ❚ I n 2017, the former GTDP Committee members agreed on a new structure and name for the Committee. The newly named Life Sciences Committee has successfully opened the scope and been divided into two different sub-committees dedicated to Food&Feed and Pharma&Cosmetics. Creating NEW ALLIANCES and fostering old ones ❚ I n line with this new structure, Fecc has created new alliances with European Associations like the EU Association of Specialty Feed Ingredients and their Mixtures (FEFANA), FoodDrinkEurope and MedTech, and has revitalised and strengthened the existing ones with IPEC Europe, APIC and CosmeticsEurope. TECHNICAL WORKSHOP: Challenges and tools in the pharmaceutical ingredients’ Supply Chain ❚A s an example of these alliances, Fecc organised the technical workshop on the Challenges and tools in the pharmaceutical ingredients’ Supply Chain with the support of collaborators from IPEC and APIC.

News from the Committee 2019 ❚ S ylvain Bougoin had his first meeting with the Life Sciences Committee. ❚M edTech was invited to the January Life Sciences Committee and gave an introduction to MedTech activities. ❚ T he Chair of the Life Sciences Committee announced that he would like to resign from his position as Chairperson. ❚M aria Almenar, Azelis, applied to be the new Chairperson. Maria will be co-chairing the Committee with Catherine Martin, initially Vice-Chairperson of the Life Sciences Committee. ❚ T he Life Sciences Committee will redefine the objectives of the Committee for 2019.

Next meetings Life Sciences Committee: 8 October 2019. ❚ I n addition, the Committee agreed to have a teleconference in May: ❚ S ubgroup Pharma and Cosmetics: 6 May (10:00am – 12:00pm) ❚ S ubgroup Food and Feed: 7 May (10:00am – 12:00pm)
