1. Rates

General rates in NSW are levied on rateable land under the NSW Local Government Act 1993 and generalallowableincreasesotherthenapprovedratevariations,are regulatedby theIndependent Pricing and Regulatory Tribunal (IPART) NSW. IPART determines an annual limit to which a council mayraisethetotalgeneralratesthatitcollects.Thisiscalledthe“ratepeg”.

1.1 Rate peg 2024/25

IPARThasissuedaninformationpapernotifyingthatthe2024-25ratepegforNSWcouncilsranges from4.5%to8.2%(2023-24:3.7%to6.8%).

IPARThassettheratepegforthe2024-25financialyearusingtheirnewratepegmethodology.The ratepegforthe2024-25financialyearforeachcouncil,beforeapplyingthepopulationfactor,ranges from4.5%to5.5%.Theratepegbeforethepopulationfactor(thecoreratepeg),foreachcouncilis basedon:

 TheBaseCostChange(BCC)foritscouncilgroup.

 Acatch-upadjustmentforpastchangesinthesuperannuationguaranteerate.

 A separate Emergency Services Levy (ESL) factor to reflect annual changes in council ESL contributions that differ from the changes to the council’s BCC. Council ESL contributions supporttheworkofemergencyservices(StateEmergencyServiceandRuralFireService)in NSW.

 Additionally,somecouncilswillreceiveacouncil-specificadjustmentintheirratepegforthe 2024-25financialyeartoreflecttheincreaseintheESLintheyearswhenincreaseswerenot captured by the rate peg because they were subsidised by the NSW Government. IPART intendtophaseinthesubsidisedincreasesthatwerepreviouslyexcludedoverseveralyears, and at different rates for different councils, to manage affordability for ratepayers. IPART plantoconsultonhowbesttophaseintheseincreases.

Councils also receive a population factor. The population factor maintains the amount of rates collectedperpersoninareasthathaveagrowingpopulation.Thepopulationfactorforeachcouncil rangesfrom0%to2.7%.Inthe2024-25financialyearthepopulationfactorincludes:

 Anannualpopulationfactortoadjustforthechangeintheresidentialpopulationofa councilarea(excludingtheprisonpopulation)from2020-21to2021-22.

 Apopulationtrue-upbasedon2021Censusdata.

Each council that receives a population factor will be able to spread the larger increase in general income over a growing number of ratepayers. This helps reduce the impact on existing ratepayers andstillprovidecouncilswiththeincreaseinincomerequiredtofundservicestoalargerpopulation.

Federation Council was issued with a final rate peg of 4.5% (4.5% core rate peg + 0.0% population factor).

1.2 Special Rate Variation 2023-24

Inearly2023,FederationCouncilappliedtoIPARTforanincreaseabovetheratepegforfouryears commencingJuly2023.ThisiscalledaSpecialRateVariation(SRV)oraSpecialVariation(SV)asIPART nowrefertheprocessas.Councilappliedforacumulative74.59%SRVoverfouryears(includingthe particularmaximumratepegseteachyearforFederationCouncil)tocommenceon1July2023(19% in 2023/24, 17% in 2024/25, 14% in 2025/26 and 10% in 2026/27). In June 2023 IPART granted approval for a temporary Special Rate Variation (SRV) increase of 19% in 2023-24, inclusive of the 4.2%ratepeg,andthiswasapplied,andthena 17% increase was approved in 2024-25

Atemporaryincreasemeansthatin2025/26,generalrateswillreverttotheamountthatwouldhave beenpermissibleundertheratepeg,(4.2%in23/24and4.5%for24/25). Thatis assuming nofurther SRV application is made or granted, to lock those two temporary increases in, and gain any further increases.

It is likely that Council will as per the Planned scenario in the current adopted Long Term Financial Plan, re-apply in 24/25 to lock in those two temporary increases, and gain a further increase to continue to address Councils financial sustainability challenges. This will be subject to further engagement with the community as part of the re-application should Council endorse this.

1.3 Total general rates permissible to be levied in 2024/25

The rate peg or any approved Special Rate Variation is applied to the total rates that Council is permittedtolevyonrateablepropertiesintheCouncilarea.

Accordingly,

TotalGeneralrates permissibletobe leviedfor2024/25 = TotalGeneralrates permissibletobelevied for2023/24 x (1+approved2024/25 SRVincrease) = $11,063,0001 x (1+17%) = $12,943,000

Based on this, Council may levy up to $12,943,000 on rateable properties across the Federation Councilarea.

1.4 Federation Council rating structure

Pursuant to section 497 of the Local Government Act, general rates may, at a council’s discretion, consistof—

(a) anadvaloremamount,or

(b) abaseamounttowhichanadvaloremamountisadded.

FederationCouncil’scurrentratingstructureprovidesabaseamounttowhichanadvaloremamount isadded.

Thebaserateisasetamountthathasbeenappliedequallytoallrateableproperties,regardlessof ratingcategoryorlandvalue.

The ad valorem is an amount that is calculated based on a property’s unimproved land value as determined each 4 years or so, by the NSW Valuer General. Properties that have lower values will paylessadvalorem,andpropertieswithahighvaluewillpayahigheradvaloremamount.

Councilhasthefollowingthreeratingcategories:

Farmland

ConsistentwiththeLocalGovernmentAct1993(section515),landistobecategorisedas farmland if itis aparcelofrateablelandvaluedasoneassessmentanditsdominantuseisfor farming(thatis, thebusinessorindustryofgrazing,animalfeedlots,dairying,pig-farming,poultryfarming,viticulture, orcharding,bee-keeping,horticulture,vegetablegrowing,thegrowingofcropsofanykind,forestry or aquaculture within the meaning of the Fisheries Management Act 1994, or any combination of thosebusinessesorindustries)which—

(a) hasasignificantandsubstantialcommercialpurposeorcharacter,and (b) isengagedinforthepurposeofprofitonacontinuousorrepetitivebasis(whetherornota profitisactuallymade).

Landisnottobecategorisedasfarmlandifitisruralresidentialland.

Residential

Pursuanttosection516,landistobecategorisedas residential ifitisaparcelofrateablelandvalued asoneassessmentand—

(a) itsdominantuseisforresidentialaccommodation(otherwisethanasahotel,motel,guest-house, backpacker hostel or nursing home or any other form of residential accommodation (not being a boardinghouseoralodginghouse)prescribedbytheregulations),or (b) in the case of vacant land, it is zonedor otherwise designated for use under an environmental planninginstrument(withorwithoutdevelopmentconsent)forresidentialpurposes,or (c) itisruralresidentialland.

Business

Pursuanttosection518,landistobecategorisedas business ifitcannotbecategorisedasfarmland, residentialormining.Councildoesnothaveaminingcategorysolandistobecategorisedasbusiness ifitcannotbecategorisedasfarmlandorresidential.

1.6 Proposed rates for each rating category for 2024/25

As detailed in section 1.3, Council may levy up to $12,943,000 on rateable properties across the FederationCouncilareain2024/25.

Fouroptionshavebeendevelopedforlevyingofgeneralratesfor2024/25.Thefouroptionsretain theexistingratingstructurefortheFederationCouncilareawithvaryingbaserates.

Asthebaseratelowers,moreratesarerequiredtobe leviedthroughtheadvalorem amount.This has the effect of increasing the rates on properties with higher values. This is an approach that Councilcouldconsidertorespondtothecurrentcostoflivingsituationandsupportmorevulnerable ratepayers(capacitytopay).

The percentage rate increase, whether by the rate peg or by an IPART approved SRV, does not apply to an individual ratepayers’ rates but to Council’s general rates income in total as detailed under section 1.3. Individual rates are also affected by other factors, such as land valuations. Therefore, an individual ratepayer’s rates may increase by more or less than the percentage rate increase amount.

1.7 Ratepayer impact considerations

The IPART decision approving a temporary SRV in June 2023 reminds Council of its obligation to ensure thattheimpactof rateincreasesisreasonable,havingregardto thecurrentratelevels,the existing ratepayer base and the purpose of any SRV. Brief commentary follows on each of these elements.

Current rate levels

TheassociatedIPARTreportconcludesthatattheendofyear2oftheSRV,averageresidentialrates wouldbe1%lessthantheaveragefortheOLGGroup11councils,averagebusinessrateswouldbe 30% below the average for comparative councils and average farmland rates would be 30% above theaverageforcomparativecouncils.

Averageratesmaynotprovidethebestrepresentationwhencomparingbetweencouncilareas.

Forexample,

 FederationCouncilhas1,030farmlandpropertieswithatotalvalueof$3,476,951,470, thereforeanaveragelandvalueof$3.37millionperpropertyassessment.

 GreaterHumeCouncilhas2,352farmlandpropertieswithatotalvalueof$2,451,787,820, thereforeanaverageof$1.04millionperpropertyassessment.

It would be expected that there is a vast difference between the farmland properties, size and agricultural pursuits that results in an average farmland value that is three times that of a neighbouringcouncilarea.Inaddition,thissignificantlylowerlandvaluewouldbeexpectedtohave anaveragelowergeneralrateslevel.

Existing ratepayer base – shifts since 2010 in valuations across rate categories

Council’s existing ratepayer base comprises three type of property holdings (known as rate categories, being – business, farmland and residential. Over the past 12 years there has been a significantshiftinthevalueofthecomponentcategories.

In 2010, the total value of residential land was greater than the total value of farmland. Residential land made up 53%, and farmland 38%, of the total land value.

Over subsequent years there has been a significant increase in the value of farmland relative to other categories, with farmland now comprising 72% of the total rateable land value, and residential land reducing to 25%.

Thefollowinggraphdisplaystheincreaseinlandvalueoverthis12yearperiod.

The data reports a 992% increase in the value of farmland, a 248% increase in the value of residential land and a 186% increase in the value of business land.

Itisnotedthatsinceatleast2019/20(using2016valuations)increasestothetotalgeneralratesto becollectedbyCouncilhavebeenappliedateachcategorylevel,ratherthanatthetotalrateslevel. Thishasresultedintheproportionofratespaidbyatypeofratepayerremainingconsistentandthis approachwasusedtominimisefluctuations(increasesanddecreases)experiencedbyratepayers.

Giventheincreaseinthevalueoffarmlandproperties,thishasalsoresultedintherateinthedollar paid by farmland property owners decreasing from 59% of the residential rate to 51% of the residentialratein2023/24.

Purpose of any SRV

TheSRVapprovedinJune2023wastoprovideadditionalfundsforassetmaintenanceandrenewal, particularlyroads,andtoaddressCouncil’sfinancialsustainabilityneeds.Thisbenefitsallratepayers and it is difficult to quantify the benefit that each of the ratepayer category receives from such outcomes. Far more extensive community consultation and research is now being undertaken by Council with the assistance from the appointment of the University of Newcastle, led by Professor JosephDrew,withregardstothereapplicationforthefutureSRV. Thiswillalsoexaminecapacityto payandotherfactorsrequiredtobeconsideredaspertheIPARTrequirements.

1.8 Hardship Policy

CounciladoptedanupdatedDebtManagementandHardshipPolicyinNovember2022.

Ratepayersexperiencinghardshiporfindingitdifficultto paytheirratesareencouragedtocontact Council.ThePolicyoffersmeasuresthatcanprovideassistancetoratepayersinthesecircumstances. AcopyofthepolicyisavailableonCouncil’swebsite.

Work is continuing as mentioned above with the University of Newcastle led by Professor Joseph Drewto furtherconsidercapacitytopay andotheroptionstomanagetheimpactofrateincreases onratepayersandprovideadvicetoCouncilinmakingfinaldecisionsonapportionmentofratesand thequantumofthefutureSRV

2. Water Pricing

Council's water charges are levied in accordance with the NSW State Government Best Practice PricingPrinciples. CouncildoesnotprovidewatertotheformerUranaShireCouncilareatownsand villages,asthisisprovidedbytheRiverinaWaterCountyCouncil.

Separate to the town potable (treated) water schemes for properties in Corowa, Howlong and Mulwala, Council also provides an untreated basic water supply to Balldale, managed under the Generalfund,andwithvolunteerassistance,supportsaruralschemefortheDaysdalecommunity.

ThebelowinformationonlypertainstotheCorowa,HowlongandMulwalatownships.

Corowa, Howlong and Mulwala Water Charges (Water fund)

The2024-25wateraccesschargeswillincreasebyanaverageof10%toworktowardsaddressingthe gapinfundingtheincreasedcostofservicedelivery.Overtimewithfurtherstrategicwork,Council will align charges with Best Practice Water Supply and Sewerage guidelines of appropriate split betweentherevenuegeneratedfromaccesschargestoconsumptioncharges(recommended25/75, currentlyat23/77).

Commencing 1 July 2023 Council revisedthe threshold for water consumptioncharges from 450 kl to350kl.Residentialwaterusagechargeswillbeincreasedto$2.05perklforwaterconsumptionup to350klandat$3.05perklthereafter.Thisistoencouragethemoresustainableuseofwater.

Parks and Gardens Water

3. Sewerage Pricing

4. Waste Management

TheLocalGovernmentAct1993doesnotallowdomesticwastemanagementtobesubsidisedfrom thegeneralrate.Allcostsassociatedwithcollectionanddisposalofdomesticwastemustbefinanced fromacharge(s)forthatpurpose:

In accordance with Section 496 of the Local Government Act, 1993, Council determines an annual Kerbside Waste Charges (a)(i) and(a)(ii) forthe provision ofdomesticwaste management services foreachoccupiedpropertywithinthedesignatedwastecollectionasdetailedinthetablebelow,or arelocatedoutsidethedesignatedareabutusetheservice;

In accordance with Section 496 of the Local Government Act, 1993, Council determines an annual Domestic Waste Management Charge (b) of $61 per annum for each vacant property within the designatedwastecollectionareas;

In accordance with Section 501 of the Local Government Act, 1993, Council determines an annual Business Kerbside Waste Charges (c)(i) and (ii) per annum for the waste management services for each property categorised as Business in accordance with Section 493 of the Act and where those propertiesarelocatedwithinthedesignatedwastecollection;

5. Waste Facility/Environmental Levy

Council provides waste facilities inCorowa,Howlong,Oaklands andUranaand atransfer station in Mulwala.There areobligationson Council torehabilitate landfillswhenthey close. Thischargewill assist in funding the future decommissioning and rehabilitation of these landfills. A waste managementstrategyisunderdevelopmentandwillguidethefutureofthischarge.

6. Onsite Sewerage Annual Management Fee

7. Statement of Borrowings

Provisionhasbeenmadewithinthebudgetforthepaymentofprincipalandinterestonexistingloan borrowings.

Strategic work is currently underway to determine future needs of Council’s water and sewer services, particularly the renewal of the Corowa Sewage Treatment Plant and the Mulwala Water Treatment Plant. There are some NSW government grant programs, to assist councils in renewing waterandsewerinfrastructure.FurtherassessmentoffutureborrowingrequirementsfortheWater andSewerFundswillbeundertakeninthecomingyearsasthestrategicworkadvances.

9. Private Works

"TheCouncilmaybyagreementwiththeowneroroccupierofanyprivatelandcarryoutontheland anykindofworkthatmaylawfullybecarriedoutontheland"(S.67(1)).

Due to the unpredictable nature of costs relating to the supply of materials for Private Works undertakings,itisnotpossibletodevelopanaccuratescheduleoffeesandchargesthatwouldapply forthecomingtwelve-monthperiod.

“Council carries out work for external parties on private land. In performing this work, Council is generating additional income and/or acting in a community service role. Income from these works will cover all incremental direct costs and overheads and where appropriate add a profit element. The profit element of pricing varies with the relevant organisations taking into account the considerations of service to the community and general market competitiveness."

Theseprivateworksinclude:

 Kerbandgutterconstruction(asperfeesandcharges),

 Roadandassociatedworkscontribution,

 Drainagecontribution,

 Watersupplyrelatedworks,and

 Sewerageanddrainageconnection.

Private Work’s charges will therefore be calculatedon the basis of the cost to Council (inclusive of on-costs)/ normalmarketvalues plusamarginof20% tocoveradministrationandoverheadcosts. ThetotalcalculatedcostwillbesubjecttoGSTattheapplicablerate(currently10%).

It is strongly recommended that a quotation/estimate be obtained from Council prior to requesting/orderingPrivateWork’sundertakings.

Note: In accordance with Council Private Works Policy, the client is to authorise the work and agree to pay the estimated cost prior to work commencing.

10. Fees, charges and policies (Appendix 1)

(ProvidedinaccordancewithSection404oftheLocalGovernmentAct1993)

ThefollowingstatementprovidesdetailsofeachfeeandchargeleviedbyFederationCouncilunder the provisions of Chapter 15 Part 10 of the Local Government Act 1993. It outlines the nature of eachfeeorchargeandthepricingpolicyusedbyCouncilinsettingeachfeeorcharge.

ThefeesandchargesarepresentedunderfunctionalheadingsasprovidedbyAAS27.Thosegoods and/orservicessubjectedtoGSThavebeenidentifiedintheattachedScheduleofFeesandCharges asGSTincluded.

Some goods and/or services supplied by Council have been declared "GST free" or are excluded under Division 81 of the legislation. For goods and/or services, which are "GST free" or excluded fromGSTnomentionofGSTappearsintheScheduleofFeesandCharges.
