TERMS OF SALE 1 - All material is deemed authentic and free of any hidden defects, otherwise it would be indicated. The lots are described with utmost accuracy and good faith. Regarding photographed lots the reproduction is determinant for margins, centring, perforation, cancellation and general aspects of lots. The numeration is in conformity with Sassone catalogue for Italy, Italian territories and Europe while Yvert is used for countries abroad, with the Filagrano catalogue for the Interi Postali. Where appropriate other catalogues will be indicated in the description.

2 - The Auctioneer has the power, in his own unobjectionable judgement, to withdraw and divide the offered lots, and to refuse offers arrived.

3 - The base prices are expressed in euro. Offers lower than base prices will not be accepted.

4 - The lots shall be awarded to the highest bidder. In case there are several offers received by mail, the starting price in the auction-room shall be calculated by the last bid but one increased of the 10% for example: base price euro 100,00, received offers euro 150,00, 200,00, 300,00.The lot will start (in the auction-room) from euro 220,00). If there were two or more than two offers of the same amount in writing, the lot shall start in the auctionroom from the sum itself and, where there are no offers in the auction-room, the lot shall be awarded to the first one received. Offers received in writing take precedence over the ones with the same amount bid in the auction-room.

5 - The bids increases will be at the auctioneer’s discretion but they will not be over the 10% with a minimum of € 10.00 . Bids stating such expressions as “the best” or similar phrases will not be taken into consideration.

6 - All bids mailed, faxed, email or otherwise received in our office of Dogana, Piazza Enriquez 22/c, will be able to be accepted only if received within and not later than May 27th, 2021 at 6:00 o’clock p.m. or inserted on our live.filsam.com website in pre-auction or through participation in real time “live auction”. Filatelia Sammarinese s.r.l. decline all responsibility for any problems that may occur previously or during the internet connection.

7 - In addition to the price awarded the buyer shall pay a 15% commission on the amount. The shipment of the sold lots will be carried out only on request. The same will be charged a refund equal to 10,00 euro for Italy and 15,00 € for the other countries up to 350 grams in weight, over weight that the reimbursement will be charged to the cost incurred.

8 - The awarded material is meant to be delivered to the buyer at the moment of the award and has to be collected in the auction-room or by our offices in Dogana (R.S.M.). All the buyers who want to receive their lots at home by registered post must indicate it in their offer stating all the formalities. It will be at their charge, at their own responsibilities and at their own risk. In this case the material will be delivered only after the payment has been done.

9 - Your payment must be made at the moment of your withdrawal, or in any case within 7 days from communication of your award. In case of non payment of the ordered or received lots, FILATELIA SAMMARINESE reserves, in its own unobjectionable judgment, the power to act for the forced execution of the consideration obligations, both of its own and of the buyer’s, or to impose the rescission of the contract with any consequent compensation.

10 - The Filatelia Sammarinese may allow extension of payment, which must be agreed before your offer, being understood and being confirmed the “reserved domination” in favour of the buyer.

11 - Eventual claims must be made at the moment of your withdrawal in our office, otherwise within 7 days since the delivery date if delivered by mail or any other means. Do not accept claims for lots composed of more than 10 pieces, collections and lots described as "to be examined".

12 - Sales by auction as well as all its legal relations are subject to Sammarinese law. Regarding disputes, San Marino’s law-courts are competent.

CONDIZIONI GENERALI DI VENDITA 1 - Tutto il materiale è garantito autentico e privo di difetti occulti, salvo diversa indicazione, e descritto con la massima cura ed in buona fede.

Per i lotti fotografati la riproduzione è determinante per quanto riguarda margini, centratura, dentellatura, annullo ed aspetto generale. La numerazione si riferisce al Catalogo Sassone per l’area italiana, al Catalogo Unificato per l’Europa ed al Catalogo Yvert per il resto del mondo, al Catalogo Filagrano per gli interi postali. Eventuali altri cataloghi sono indicati di volta in volta nella descrizione.

2 - Il banditore si riserva a suo insindacabile giudizio il diritto di raggruppare, ritirare e dividere i lotti offerti, nonché di rifiutare offerte in qualsiasi forma o modo pervenute.

3 - I prezzi di base sono espressi in euro. Non vengono accettate offerte inferiori alla base.

4 - I lotti vengono aggiudicati al maggior offerente. In caso di più offerte per corrispondenza il prezzo di partenza in sala sarà calcolato maggiorando la penultima offerta del 10% (esempio: base 100,00, offerte ricevute 150,00, 200,00, 300,00. Il lotto partirà in sala da euro 220,00). In caso di due o più offerte scritte della stessa cifra il lotto partirà in sala dalla cifra stessa e, nel caso non vi siano offerte in sala, verrà aggiudicato a quella pervenutaci prima. Le offerte scritte hanno la precedenza su quelle di pari importo fatte in sala.

5 - Gli scatti delle offerte saranno a discrezione del Banditore ma non supereranno il 10% con un minimo di 10,00 €. Non si accettano offerte con la clausola “al meglio” o simili.

6 - Tutte le offerte potranno essere accettate se pervenute per lettera, fax, email o altrimenti recapitate presso i nostri uffici di Dogana, Piazza Enriquez 22/C, entro e non oltre le ore 18,00 del 27 Maggio 2021, o inserite sul nostro sito internet live.filsam.com in pre asta o mediante partecipazione in tempo reale “asta live”. Filatelia Sammarinese s.r.l. declina ogni responsabilità per eventuali disguidi che possono intervenire precedentemente o durante il collegamento internet.

7 - Oltre al prezzo di aggiudicazione l’acquirente dovrà corrispondere una commissione onnicomprensiva del 15%. La spedizione dei lotti aggiudicati sarà effettuata esclusivamente su richiesta del cliente. Sulla stessa sarà addebitato un rimborso spese pari a 10,00 euro per l’Italia e 15,00 euro per gli altri paesi fino a 350 grammi di peso, oltre tale peso il rimborso verrà addebitato al costo sostenuto.

8 - Il materiale si intende consegnato all’acquirente al momento dell’aggiudicazione e dovrà essere ritirato in sala oppure presso i nostri uffici di Dogana (R.S.M.). Gli acquirenti che desiderano ricevere i lotti al loro domicilio sono pregati di farne esplicita richiesta al momento dell’ordine indicandone le modalità, assumendone il costo ed il rischio. In tal caso il materiale verrà consegnato solo dopo l’avvenuto pagamento.

9 - Il pagamento dovrà essere effettuato al momento del ritiro, ed in ogni caso entro sette giorni dalla comunicazione dell’avvenuta aggiudicazione, preferibilmente a mezzo versamento nel nostro c/c Postale 10247476 (IBAN: IT52L0760113200000010247476) BIC/SWIFT: BPPIITRRXXX, bonifico nel nostro conto IBAN: SM63C0303409800000060105882, BIC/SWIFT: BASMSMSMXXX presso la B.A.C. / I.B.S. S.P.A di Dogana, R.S.M, tramite carta di credito sul nostro sito www.filsam.com oppure tramite Paypal all’email paola@filsam.com (+ 4% spese). La proprietà dei lotti viene trasferita agli acquirenti solo dopo il totale pagamento degli stessi. Nel caso di mancato pagamento dei lotti ordinati o ricevuti Filatelia Sammarinese si riserva, a proprio insindacabile giudizio, la facoltà di agire per l’esecuzione forzata degli obblighi di corrispettivo, sia propri che del committente, o di far valere la risoluzione del contratto con ogni conseguente risarcimento.

10 - Possono essere concesse dilazioni di pagamento che dovranno essere richieste e concordate prima dell’eventuale offerta, fermo e confermato il “riservato dominio” a favore del committente.

11 - Eventuali reclami dovranno essere fatti al momento del ritiro del materiale presso la nostra sede oppure entro sette giorni dal ricevimento nel caso di consegna per posta od altro mezzo. Non si accettano reclami per lotti composti da più di 10 pezzi, per collezioni e per lotti descritti come “da esaminare”.

12 - La vendita all’asta così come tutti i rapporti giuridici che ne derivano sono sottoposti al diritto Sammarinese. Per ogni controversia è competente il Foro di San Marino.
