Challenging the Validity of a Will
Sometimes, when a loved one passes away, there are circumstances where the family left behind do not accept that their loved one’s last Will accurately reflects their intentions. This could be for a number of reasons and you may want to investigate further, particularly when something doesn’t look quite right. There are steps that can be taken in those circumstances, to investigate the circumstances under which the Will was prepared.
Lodging a Caveat
In order to deal with the assets of a deceased, the executors of a Will would need to apply for a “grant of probate” which is a document that provides the executor (who is named in the Will) with the legal authority to deal with the administration of a deceased’s estate.
If you have concerns about the validity of the last Will, you can stop a grant of probate being taken out by entering a “caveat” at the probate registry. This is a relatively simple procedure that requires a short application to be made to the Probate Registry
and prevents a grant of probate from being taken out. A caveat lasts 6 months from the date of entry and can be renewed every 6 month periods for the same period. This allows you time to raise enquiries about the circumstances under which the Will was prepared in the secure knowledge that your loved one’s estate is not being administered.
Types of challenge
The most common reasons for challenging the validity of a Will are dealt with below.
Want of Due Execution
To be valid, a Will must be executed in accordance with s. 9 of the Wills Act 1837. In short
• The Will must be in writing and the testator must sign it, or another person must sign it in their presence and at their direction.
• It must appear that the testator intended by their signature to give effect to the Will.
• The signature must be either made or acknowledged in the presence of at least two witnesses present at the same time.
• Each witness must sign the Will, or acknowledge their signature, in the presence of the testator (but not necessarily in the presence of any other witness).
If the Will fails to comply with the above, it will be considered invalid.
Lack of Testamentary Capacity
For a testator to make a Will, they must have sufficient testamentary capacity to do so. The test set out in Banks v Goodfellow provides that a testator must understand:
1. the nature of the act of making a Will and the effects of the Will;
2. the extent of the property of which they are disposing of;
3. the claims on their estate to which they ought to give effect; and
There should also be no disorder of the mind so for example, if the testator had severe dementia at the time he or she made his Will, they are unlikely to have had the necessary capacity.
Want of Knowledge and Approval
The testator must have known and approved the contents of their Will in order for the Will to be valid. Proof of the testamentary capacity of the testator and due execution of the Will provides an inference that the testator knew and approved its contents. However, issues under this head may arise in the following circumstances:
1. the testator is deaf, dumb or blind;
2. where the party who writes or prepares the Will takes a benefit from it;
3. where there is an obvious mistake in the Will.
Undue Influence
A Will that has been procured by undue influence is not valid because it does not represent the testator’s true wishes. In Edwards v Edwards [2007] EWHC 1119, undue influence was described as coercion which is a:
‘pressure that overpowers the volition without convincing the testator’s judgment. It is to be distinguished from mere persuasion, appeals to ties of affection or pity for future destitution, all of which are legitimate.’
Establishing undue influence is difficult as by its very nature, it takes place behind closed doors. The court recognises this and will take a holistic view of all the circumstances before reaching its conclusion.
Fraudulent Calumny
Fraudulent calumny differs from undue influence in that the offending party changes the testator’s mind by casting dishonest aspersions on a potential beneficiary. The following factors must be established:
1. There must be a false representation;
2. To the testator;
3. About the character of an existing or potential beneficiary;
4. For the purpose of inducing the testator to alter their testamentary disposition;
5. In the knowledge that the representation is untrue, or recklessness as to its truth; and
6. The fraudulent calumny induced the testator to make the disputed will.
Forgery
The most common form of fraud pleaded in Will validity claims is forgery which usually involves a claim that the signature to a Will that is forged. Other types of fraud on a Will include where sections or pages of the Will are removed, inserted, replaced or if the entire document is forged.

Your Local Heritage Railway!
Did you know there is a heritage railway just down the road in Quainton?
Buckinghamshire Railway Centre is located at the original site of Quainton Road railway station, which is on the original Metropolitan underground line. The Metropolitan line is the oldest underground railway in the world, opening in 1863. Quainton Road Station opened in 1868 as part of an expansion out to Verney Junction, near Winslow. Passenger trains ran to Quainton for nearly 100 years, until it closed in 1963.
Six years later, in 1969, the site was bought by what is now known as Quainton Railway Society and opened as a working museum. At the end of the century, they received a grant to dismantle and re-erect the original, but no longer used, Oxford railway station building at Rewley Road. This stunning, glass-roofed building now takes centre stage at the site in Quainton and acts as a wonderful visitor centre, housing beautiful exhibits, their Railway Café, gift shop and staff offices. Now trading as Buckinghamshire Railway Centre, you can visit the site on Sundays from April-October, when you will be taken back in time to the Age of Steam!
Visitors can enjoy short passenger rides in a train pulled by a restored steam engine; plus, they can visit the large railway museum, stunning visitor centre,
travelling post office carriages, miniature and model railways and wander around 25 acres of railwayland, full of railway artefacts and buildings. Most Sundays are steaming days, but also they have special events ranging from heritage vehicle rallies to children’s character days, like their popular Day Out
With Thomas when families get to ride in trains pulled by Thomas and Percy, full-size, restored steam engines; and meet Sir Topham Hatt! (NB Closed on Saturdays for weddings.) During the summer holidays, children’s tickets are only £1 on Steaming Days, which are also held on Wednesdays from until the 28th August! During the week (Monday to Friday), there are no train rides, but the Railway Café inside the visitor centre is open 9.30am-2pm with no ticket required. A stunning setting for friends to meet for a coffee, or for parents/carers to bring children and be surrounded by these wonderful giants of the steam age – plus there’s a play area and train tables to keep the little ones amused whilst you enjoy a cuppa or a bite to eat in their good value café. Pannacotta literal translation is ‘cooked cream’ and the reduction is where the secret to a good panna cotta lies. Thought to have originated in the northern mountains of Italy, it has now become extremely popular all over the world. This fantastic
combination of rich cream, with the intense flavour of the citrus orange blossom honey and vanilla marry together superbly, finished with the subtle sweetness of fresh English berries, now at their best, the tartness of crème fraiche and the crunch of your very own homemade honey comb!
Exclusive Summer Holiday Offering
Ingredients
Serves 6
Raspberry Puree
• 200g raspberries
• 12g caster sugar
• Squeeze of lemon juice
Vanilla pannacotta
• 300 ml orange blossom clear honey
• 600ml double cream
• 1.5 gelatine leaves
• 75ml cold milk
• 25g icing sugar
• Honey
• 1 punet of plump English Raspberries
• Crème fraiche to serve
Method
For the Raspberry Puree:
1. Macerate the raspberries with a little sugar and a squeeze of lemon juice for five minutes.
2. Place in a blender and puree until smooth then strain through a conical strainer.
For the Pannacotta:
3. Place the honey in a saucepan and reduce by two thirds.
4. Leave to cool
5. Soak your gelatine in the milk until soft.
6. Pour 400ml of your cream into a heavy bottomed pan and add the seeds of vanilla pod and infuse with the pod.
7. Reduce by a third – take off the heat. Remove the vanilla pod.
8. Take the gelatine out of milk, then whisk into the reduced cream until dissolved.
9. Leave the cream mixture to cool for 5 minutes and then place in the fridge for approx 1 hour until the mixture thickens to a lightly whipped cream consistency.
10. Add the reduced honey and whisk in.
11. Lightly whip the remaining cream with the icing sugar and fold in to the mixture
12. Spoon into six pretty glass dishes and place in the fridge to set.
For the Honeycomb:
13. Place the sugar and syrup into a saucepan and stir together to mix.
Honeycomb
• 100g caster sugar
• 4 x 15ml tablespoons golden syrup
• 1½ teaspoons bicarbonate of soda
• 4 tbsp whipped cream
• 1 apple sliced and cut into batons
14. Place the pan on medium heat and let the mixture first melt, then turn to goo and then to a bubbling mass the colour of maple syrup - this will take 3 minutes or so.
15. Take off the heat, whisk in the bicarbonate of soda and watch the syrup turn into a bubbling cloud of aerated pale gold. Turn this immediately onto a piece of reusable baking parchment or greased foil.
16. Leave until set ant then chop roughly into little nuggets saving the dust with a large knife.
To Serve
Place five plump raspberries in a circle on top of each set pannacotta. Drizzle with the raspberry puree sprinkle with the nuggets and crushed honeycomb Finish with a scoop of crème fraiche or crème fraiche ice cream.

How to safeguard your pet in a UK divorce
Divorce can be a challenging and emotional process with many aspects to consider. One often overlooked element is the day-to-day arrangements for beloved pets and the cost of their upkeep.
In the UK, pets are legally considered to be “chattels” which are personal property like furniture or cars. This legal classification can complicate matters when it comes to deciding who gets to keep the family pet after a separation and who pays for them.
The concept of ‘pet nuptial agreements’ is a growing trend that aims to address this issue proactively.
A pet nuptial agreement, sometimes referred to as a “petnup,”, is a legal document that outlines ownership and care arrangements for pets in the event of a divorce or relationship breakdown. It is also possible to include arrangements for a pet in a pre-nuptial, post-nuptial agreement or a separation agreement.
Anyone who owns a pet will know that they often become adored family members, and their well-being can be a significant concern for both parties
during a divorce. A petnup ensures that both individuals’ attachments and the pet’s best interests are considered as well as providing clarity, preventing disagreements and the associated legal costs later on down the line.
Unlike standard property division, a petnup allows couples to detail personalised arrangements that reflect the pet’s needs and the owners’ wishes. It can outline how the cost of the pet’s care will be divided. This can include everyday expenses like food and grooming, as well as medical bills and insurance. It can also include defining who will make decisions about the pet’s health and wellbeing, such as medical treatments or changes in routine.
While pet nuptial agreements are not legally binding, if they are properly entered into then they are likely to be persuasive to the court in the event of a divorce or relationship breakdown.

With summer reaching its peak, our minds are turning turn to thoughts of out-of-office messages, feeling some sun on our faces, and finally finding time to wind down.
Focus lands on our indoor and outdoor spaces and how we can indulge in, or escape, the heat.
As the world of interior design continues to evolve and progress, the term ‘trend’ gets thrown around a lot. While we’re not focused on fleeting TikTok-esque crazes with cryptic names, it’s evident that the design zeitgeist and the broader cultural atmosphere, coupled with our individual style and personal history, does gently influence our design choices. These elements serve as our creative compass, empowering us to authentically express ourselves in our homes, and make living that bit more delightful.
For 2024 so-far, the general theme has been... no theme. As recent design shows Salone del Mobile and 3daysofdesign disappear into the distance, new shapes, sizes, colours, tones, textures and materials are ripe for the picking. Colours are fusing in new and
interesting ways, contours are getting more audacious, influences range the plain to the pioneering, and furniture is helping us to all connect.

WHISPERING LUXE:
Whispering Luxury focuses on high-quality, designer icons that are crafted to last a lifetime, and rooms should still be places that feel beautiful but not overdone, while we’re adding in the occasional statement object, conversationprompting pieces of design to show off our personality and taste in a way that elevates the everyday, as well as being elegant.
It zooms in on excellence, timelessness, refinement, and careful selection, but with a dash of fun and personality mixed in. More characterful, less austere. A way to live with both chic-ness and joy.
COLOSSAL CURVES:
We’re still stuck on curves – and we’re not sorry. They’re just more soul-enriching and soothing than harsh and sharp am-I-going-to-bump-myself-onthat angles and lines.
Over the past few seasons, we’ve seen curves move through the home, first on upholstered pieces then in accessories and smaller items until the curved hard furniture movement came last year. As our homes get ever comfier and more comforting, curves have become bigger, bolder, braver and better than before. And it feels good.
This all goes hand-in-hand with the contemporary penchant for ‘seating systems,’ seats and sofas that extend and lengthen to create multi-person seating islands which provide endless seating arrangement options in a litany of shapes.
SURPRISING SHADES:
It works, it really does, the pop of that-doesn’tmatch brightness smiling out from a space putting a grin on faces too. Moving forward, we’re liberating, loosening up and getting ready to experiment. It’s time for ‘Unexpected Colour’ to enter the home, a zing of vividity where there’s no business being one. Be it lemon yellow, sage green or glowing magenta, the only rule is that the pigment should stand out and draw the eye.
Let’s break free from the design constraints, and dictate ourselves the colours that will take the spotlight from room to room. Showcasing a single splash of standout colour or a restrained few pieces of pigment in a space is – there’s no other word for it – fun.
TALKING POINTS:
The time of the TV as the entertainment centre du jour is over – so why should all of our furniture angle towards it? Let’s shake off that convention and make rooms more about people again, about talking and contemplating. About hosting and games and drinks and snacks and generally connecting. Try to put that phone down for a moment. Sounds good doesn’t it?
Decorating-wise, it’s really quite simple. Some kind of vague circle formation is key, do bear in mind the other beautiful things to enjoy – window views or artworks or fireplaces – but seating should be primarily focused on the most important thing in the room: other people.
PAPER FOLDS:
Paper-inspired forms are seeing a rise in 2D-esque experimental approaches to furniture construction, from Ron Arad’s sculptural One Page chair and footstool for Moroso which was conceived when considering the curves of a single piece of paper, to Tiziano Guardini and Luigi Ciuffreda’s Narinari chair for B&B Italia: back and seat seemingly folding together origami-like. Meanwhile Lema’s Blanca armchair by Roberto Lazzeroni appears to be composed of shapely cut out pieces, leaving a gaping recess in the back, while Gallotti & Radice’s H2O chair by Studiopepe is decorated with a circle cut out from its backrest, and the brand’s Selce-T table – also by Studiopepe –comprises of cut-and-stick-style fragmented shapes. chaplins.co.uk
