Have you Unexpectedly Been Left Out of A Loved One’s Will?
The loss of a loved one is a challenging time. We understand that individuals may be facing a multitude of emotions and questions, and it can be particularly upsetting if your loved one has either left you out of their Will or left you less than expected.
The Inheritance (Provision for Family and Dependants) Act 1975
English law has a long-established principle that allows an individual the testamentary freedom to leave their property, assets, and other wealth to whoever they wish on their death. However, it is possible for the English courts to intervene and help certain categories of applicants who have not been provided with “reasonable financial provision” in a loved one’s Will, or where there is no Will, they fail to benefit under the rules of intestacy.
A claim is not limited to simply having no provision made for an applicant under their loved one’s Will and can also include circumstances where not enough provision has been made for them.
It can of course be difficult to ascertain what might constitute “reasonable financial provision” as each applicant will have unique circumstances.
The court follows two stages when considering a claim:
(a) Has reasonable financial provision been made for the applicant?
(b) If not, there needs to be an objective assessment for what provision should be made.
The legislation governing this area of law is known as the Inheritance (Provision for Family and Dependants) Act 1975 (“the 1975 Act”). In order to pursue a claim, it is a pre-requisite that the deceased died domiciled in England or Wales.
Who Can Make a Claim?
The following category of applicants are eligible to make a claim:
• The spouse or civil partner of the deceased;
• A former spouse or civil partner of the deceased (providing they have not remarried or entered into a new civil partnership);
• A person who has cohabited with the deceased and was living in the same household as him/her for two years immediately ending before the date the deceased has died and as though that person and the deceased were a married couple or civil partners;
• The child of the deceased as well as anyone treated as a child of the family by the deceased due to marriage or civil partnership;
• Lastly, any person who was being maintained, either wholly or partly by the deceased immediately before their death.
What Constitutes “Reasonable Financial Provision”?
In determining “reasonable financial provision” a court would look at what it is that is reasonable for an applicant to receive for their maintenance. For spouses and civil partners, the provision extends to what is reasonable for them to receive, regardless of whether it is necessary for their own upkeep. This standard is higher than that awarded to other applicants.
In considering what to award, the court applies a test of fairness so that awards are not based on luxurious standards, but neither are they based on poverty levels. As part of the exercise in determining reasonable financial provision, the court will have regard to what is commonly referred to as “the section 3 factors”.
The Section 3 Factors
The court will have regard to the factors referred to in section 3 of the Act when considering what might amounts to “reasonable financial provision”. These include the following:
1. An applicant’s future financial needs and resources, including earning capacity.
2. The future needs and resources of any other applicant including earning capacity.
3. The future financial needs and resources of any beneficiary including earning capacity.
4. The deceased’s obligations and responsibilities towards the applicant or beneficiary.
5. The size and nature of the deceased’s net estate.
6. The physical and/or mental condition of the applicant or any other beneficiary.
7. Any other matter the court considers relevant, including the condition of the party.
The opposite is not a conclusive list and there are also further considerations given to particular applicants that is not discussed in this article.
Time Limits for Bringing a Claim
Any claim must be brought within six months of the date the grant of probate was issued. Any claim outside of this time requires the consent of the court which is only granted in exceptional circumstances. Ideally, you would want to start dialogue with the Personal Representatives of the deceased’s estate long before the 6-month deadline with a view to settling matters without the need to issue a claim. For that reason, the sooner you obtain legal advice following a loved one’s passing, the better.

One of the UK’s finest collections of vintage Star Wars toys and original cinema posters is going on display in a stunning exhibition brought to you by Discover Bucks Museum. Back when the movie Star Wars broke box office records in 1977 no one could have predicted that the merchandising would go on to earn even more than the film itself. The toys of Star Wars took the world by storm and became the must-have playthings for an entire generation. From 1977 - 1985 an estimated 300 million action figures were sold, allowing children to re-enact the adventures of Luke Skywalker, Princess Leia and Han Solo Craft In Focus is thrilled to announce its return to Waterperry Gardens with two stunning events – a Celebrating Ceramics Festival and a Desire Jewellery and Silversmithing Fair. Set against the backdrop of Waterperry House, these fairs will take place from 19-21 July. Held in semi open-sided marquees adjacent to the beautiful grounds of Waterperry Gardens, these fairs will showcase a diverse array of makers from the world of contemporary ceramics and feature some of the UK’s premier contemporary silversmiths and independent jewellery makers working in various media.

The gardens at Danesfield were completed in 1901 by Robert Hudson, the Sunlight Soap magnate who built the house. Since the house opened as a hotel in 1991, the gardens have been admired by several thousand guests each year. We’ll be running Special Family Craft Days
from 24 July to 30 August. Choose from Make-AToy Mondays, Out-Of-This-World Wednesdays and Fantastic Fridays. Each session has a different theme so you can try something different throughout the holidays.

Visit the Desire Jewellery & Silversmithing Fair to discover and purchase stunning contemporary jewellery and exquisite silverware. Exhibitors have been selected for their superb and innovative designs and craftsmanship as well as outstanding quality and are all independent professional makers. Anyone celebrating a special occasion – maybe a birthday or anniversary - may also like to speak to the makers about commissioning bespoke pieces of jewellery or silverware. Several visitors in the past have commissioned engagement or wedding rings at the event and, by collaborating with
the designer maker, have been able to have input into the design and produce something that means so much more and is completely individual. Many of the makers will also be happy to speak about remodelling inherited jewellery to give it a more contemporary feel.
The Celebrating Ceramics Festival offers visitors the opportunity to see the best in contemporary ceramics - all with the ‘wow’ factor. Visitors can purchase directly from these ceramic artists, many of whom will showcase their skills through live demonstrations giving an insight into the techniques involved with working with clay and creating the pieces on display. And don’t miss the Make Mine Miniature display – a competition for exhibitors to make a unique miniature piece which is a true representation of their work.
A visit will make an interesting and fun day out for all ages and will include an exciting selection of food, drink, and live music. Within the Waterperry Estate, there’s a farm shop, museum, playground, tea shop, plant centre and garden shop, gallery, and gift shop. It’s a fabulous day out for everyone! The stunning landscaped ornamental gardens at Waterperry are a magical place where visitors are surrounded by beautiful trees, shrubs and flowers, classical borders, modern planting, secret corners, and long vistas, not forgetting the waterlily canal and arboretum.

Your Local Heritage Railway!
Did you know there is a heritage railway just down the road in Quainton?
Buckinghamshire Railway Centre is located at the original site of Quainton Road railway station, which is on the original Metropolitan underground line. The Metropolitan line is the oldest underground railway in the world, opening in 1863. Quainton Road Station opened in 1868 as part of an expansion out to Verney Junction, near Winslow. Passenger trains ran to Quainton for nearly 100 years, until it closed in 1963.
Six years later, in 1969, the site was bought by what is now known as Quainton Railway Society and opened as a working museum. At the end of the century, they received a grant to dismantle and re-erect the original, but no longer used, Oxford railway station building at Rewley Road. This stunning, glass-roofed building now takes centre stage at the site in Quainton and acts as a wonderful visitor centre, housing beautiful exhibits, their Railway Café, gift shop and staff offices. Now trading as Buckinghamshire Railway Centre, you can visit the site on Sundays from April-October, when you will be taken back in time to the Age of Steam!
Visitors can enjoy short passenger rides in a train pulled by a restored steam engine; plus, they can visit the large railway museum, stunning visitor centre,
travelling post office carriages, miniature and model railways and wander around 25 acres of railwayland, full of railway artefacts and buildings. Most Sundays are steaming days, but also they have special events ranging from heritage vehicle rallies to children’s character days, like their popular Day Out
With Thomas when families get to ride in trains pulled by Thomas and Percy, full-size, restored steam engines; and meet Sir Topham Hatt! (NB Closed on Saturdays for weddings.) During the summer holidays, children’s tickets are only £1 on Steaming Days, which are also held on Wednesdays from 24th July-28th August! During the week (Monday to Friday), there are no train rides, but the Railway Café inside the visitor centre is open 9.30am-2pm with no ticket required. A stunning setting for friends to meet for a coffee, or for parents/carers to bring children and be surrounded by these wonderful giants of the steam age – plus there’s a play area and train tables to keep the little ones amused whilst you enjoy a cuppa or a bite to eat in their good value café. The RAF Museum presents FLYING THEATRE!
This summer the RAF Museum London has teamed with Highly Sprung Performance to create a 45-minute-long family show TRAILBLAZERS.

Grand Reopening of Historic House Follows More Than £10 Million Investment to Create World Class Private Members’ Club & Plan to Grow Golf Portfolio
The transformation of the historic country estate just 15 miles from Notting Hill and 10 miles from Heathrow Airport is part of a major investment to create a prestigious private members’ club on London’s doorstep – and signals plans by the Arora family to develop a portfolio of world class golf venues.

Towersey Festival announces final wave of inspiring programming for its final event.
Towersey Festival, the UK’s longest running festival since 1965, has unveiled another wave of inspiring programming for its 60th, and last ever event. Taking place on the beautiful Claydon Estate in Buckinghamshire from Friday 23rd to Monday 26th August, organisers have added a fabulous range of street theatre, one-off special performances, and even more family entertainment for this momentous event. with the luxurious flavour of the smoked eel, its earthy and rich flavours cut with the sharp horseradish cream and crisp apple all working in harmony with each other for a decadent lunch dish or impressive first course when entertaining friends or family. Smoked mackerel or even a little good quality smoked salmon can replace the eel if necessary and the rye bread could be swapped for some pumpernickel bread or thinly sliced sourdough.

Serves 4
Soup
• 6 medium red beetroot
• 1.5 l hot water just under boiling point
• 2 tbs red wine vinegar
Horseradish Cream
• 300ml double cream lightly whipped
• 1 tbs hot horseradish sauce
• 1 pinch Maldon salt
Method
Soup
1. Foil wrap and roast your beetroot in a medium oven 180 degrees C until soft for 45 mins to 1 hour
2. Bring the vegetable stock with the red wine vinegar to the boil in a large pan
3. Peel the beetroot whilst warm and large dice
Rye Bread Wafer
• 4 thin strips toasted rye bread
• 2 tbsp apple sauce
• 3 smoked eel fillets
• 4 tbsp whipped cream
• 1 apple sliced and cut into batons
4. Add to the liquid and then bring to the boil – take off the heat and blend carefully in batches in a liquidiser until smooth and then pass through a fine sieve
5. Season to taste
Rye Bread Wafer
6. Blend together the eel and the cream and cream until smooth
7. Pipe along the toasted rye bread wafer
8. Dot a little apple sauce next to the eel and add the crisp apple batons to garnish
Horseradish Cream
9. Add the Horseradish to the whipped double cream and season with a little Maldon salt
To Serve
Gently warm the beetroot soup
To serve add a couple of teaspoons of horseradish cream to each bowl Garnish by placing the decorated crisp over your bowl.
Most good stores sell rye bread cut it to size brush with a little melted butter and bake in a hot oven till golden brown and crisp

You want to protect your loved ones But who will protect you?
Many of you will recognise the importance of Wills in helping to protect your loved ones after you’re gone. But having a Lasting Power of Attorney (LPA) in place is just as important. It’s rather like a comforting “insurance” policy, as it enables you to appoint someone whom you trust to deal with your affairs if you lose physical ability or mental capacity to manage your own affairs, due to injury or illness. With regards to your property and financial affairs, you could also appoint someone to simply make your life easier, for example if you are abroad or in hospital for several months.
If you lose capacity to manage your own affairs, and you do not have an LPA (or an Enduring Power of Attorney) in place, someone will need to obtain a Court of Protection Order to be appointed as your “Deputy” (the Court of Protection’s version of an attorney). The person appointed as Deputy might not be the incapacitated person’s first choice, in fact they could be someone with no family connections at all.
The Deputy application is a long and expensive process, there will also be ongoing fees paid to the Court, for example an annual insurance bond, and there are extensive reporting obligations to the Court on an ongoing basis.
The Deputy can only do what they have applied for under the Order and
may need to apply to court again for other decisions, so the process is more rigid, and it can take much longer for decisions to be reached.
It may work in some situations, but can add stress and burden on the Deputy, which could be avoided by creating an LPA.
How can B P Collins LLP help?
1. Although LPAs can be created without one, a lawyer can fully explain the pros and cons and what an LPA means for the donor.
2. They can also make sure that the donor has capacity to understand the process, comprehends the purpose and significance of the LPA, and that there is no undue influence involved in the making of the LPA.
3. Lawyers are good sounding boards when the client is deciding who to appoint and how they can act.
4. Lawyers can add an extra safeguard by storing the LPA until needed, as it is a live document once registered with the Office of Public Guardian.
5. Lawyers can be appointed as attorneys too, in more complex situations.

Light therapy is the exposure of light at a specific wavelength using Low Level Laser Therapy (LLLT) and has been clinically proven to offer extensive health benefits. In basic terms, light (red or near infrared) is applied directly to skin, stimulating vital cell function which enhances the body’s natural healing process.
Said Emma, “I first discovered the power of light therapy when my horse suffered a nasty soft tissue injury on his leg. Due to the position of the injury, conventional stitches were not holding and the wound became infected. Despite antibiotics and anti-inflammatories, the wound would not heal. A friend sent me a home use light therapy machine and talked me through how to use it. I was taking photos weekly and I could literally see the wound healing before my eyes!”

Designing for Longevity

Decorating trends come and go, especially as social media accelerates the pace at which some fashions are adopted and then perhaps forgotten.
But great design is timeless. At HollandGreen, our ethos is to create interior design that is sympathetic to the features and era of a property. This is the most successful way to create character and bring enduring elegance to a home.
In the past, furniture and textiles were designed to last a lifetime and be passed down through generations, but much like the culture of ‘fast-fashion’, there has been a big rise in ‘fast-furniture’, much of which ends up in landfill.
Investing in craftsmanship in your home – for example choosing quality timber flooring and hardwearing limestone tiles - will be worth the initial investment and outlast cheaper, lower quality options. If the fabric on a classic high-quality sofa eventually gets tired or you’re ready for an update, reupholstery will bring it back to life while the bones of the piece will withstand the test of time. Similarly, sturdy fixtures and hardware made from robust materials such as solid brass will guarantee durability.
One of our favourite ways to bring character and meaning into a home is to mix old with new. The
juxtaposition blends a freshness of the contemporary pieces against the charm of unique, vintage finds. We love to combine an antique console table or sideboard with a statement lamp and a contemporary oil painting above. With longevity in mind, consider flexible functionality of your pieces. Choose furniture and decor with simple, classic lines, avoiding overly trendy or ornate pieces that may date quickly. Natural materials such as wood, stone, leather, and metal all develop character and beauty with age and remain stylish over time.
