What Rights Do I Have In A Property
Not In My Name?
Imagine owning a property without ever being named as legal owner. Sounds intriguing, right? Welcome to the world of beneficial interests in property.
Where property is registered at the Land Registry or on the title deeds in the name of a party, that party is referred to as the “legal owner” and is, at first instance, presumed to be the true owner of the entire beneficial interest in the property. By “beneficial interest,” we mean that party who has the benefit of the property. In other words, they are the true owners entitled to the economic benefit in the property. They are the persons entitled to live in the property, receive any rental income and have the benefit of the proceeds of sale when the property is sold. It is not unusual for the beneficial interest in the property to be unrecorded and this is where disputes can arise, where the legal owner seeks to deny the beneficial owner of their rights in the property.
Examples of how these situations arise are as follows:
1. Joint ownership: This is where more than one person has legal title to the property. The extent of their respective beneficial interests in the property may not be recorded and it may be that there is an intention for them to have specific shares. For example, they may own 80/20% rather than the starting position of 50/50.
2. Inheritance: When a property is inherited, the legal title might be held by an executor or trustee, while the beneficiaries under the Deceased’s estate have the beneficial interest.
3. Trust situations: When property is held in a trust, the trustee holds the legal title, but they hold the property either for themselves with other beneficiaries or for other beneficiaries entirely.
Examples of the different types of trust that exist are dealt with below.
Express Trust
A common way to create a beneficial interest is through an express trust. This is where the legal owner signs a trust deed or written agreement declaring that the legal owner holds the property ‘on trust’ for someone else, who is the beneficial owner. This type of trust rarely causes a dispute.
Resulting Trusts
A resulting trust can arise where a party contributes to either the purchase price and/or the subsequent mortgage of the property. If these monies were not a gift, there is an argument that the payment towards the property amounted to a resulting trust.
If a resulting trust can be established, a court would normally calculate a party’s interest in a property based upon the amount of their financial contribution. So, for example, where one party contributed 10% towards the purchase price, and the other 90%. it is likely that both would be awarded an interest in the property equivalent to their contributions.
Constructive Trusts
A constructive trust arises where there is some sort of express or implied agreement, arrangement or understanding (referred to as a “common intention”) that the beneficial ownership of the property would be shared between parties and the conduct of the non-owning party supports this.
For example. Party E and Party F decide to buy a house together. As Party E has a better credit score, the property is registered in Party E’s name. They agree that they both own the property before they move in and in reliance on this, Party F pays for renovation works. Party E and Party F spit up and Party E asserts that the property belongs entirely to him. Where the constructive trust is based on an express agreement, that agreement, however imperfectly remembered and however imprecise it might be, must generally arise prior to the acquisition of the property and relate to the shared ownership of the property as opposed to an agreement about the occupation of the property. These factors must be accompanied by some detrimental reliance or significant alteration on the part of the non-owning party.
In the absence of an express agreement the court may infer an agreement from the way in which the parties conducted themselves. This is called an implied agreement. Contributions are not limited to just the purchase price or the mortgage and can include substantial renovations to the property or capital improvements such as installing a new kitchen, bathroom or carrying out extension works. Essentially, a party would need to show that their contribution would be more than is ordinarily expected from a non-owner or someone who is simply occupying the property with there being no real intention of beneficial ownership.
Proprietary Estoppel
Proprietary estoppel is another way non-owners can establish property rights.
To succeed it must be shown that:
(a) a representation, assurance or promise was made by the legal owner that a party would get all or a share of the property.
(b) The promised party must show that they relied on that representation/assurance/promise to their detriment.
(c) It must be unconscionable for the legal owner to renege upon the assurances that they had given.
For example, a father may tell his son, that if he carries out significant renovation works to his home, his son will be given a 50% share of the sale proceeds when he sells the property.
The son then carries out significant works on the property, but the father refuses to give him 50% of the sale proceeds when it is sold.

John’s journey started at a young age showing a flare for cooking at just 14 where he started as a kitchen porter in a local restaurant. Studying at a professional culinary school in Birmingham led John to his first big break at The Belfrey Hotel and Resort.
After a successful period at The Belfry Hotel and Resort John was enrolled within a three-year culinary programme at the exclusive Mandarin Oriental Hotel in Knightsbridge. This allowed John to further his experience in different culinary disciplines, including cold larder, banqueting, fine dining and pastry.
At the conclusion of the three-year program,
and to continue his quest for culinary excellence
John took on a new role at the renowned Bar Boulud, the only European restaurant under the guidance of multi award winning and culinary hall of fame chef Daniel Boulud.
Building on his experience John took on a new challenge opening his first restaurant, a vibrant all day dining restaurant and bar called 14 Hills, perched on the 14th floor of 120 Fenchurch Street in the heart of London’s Square Mile.
As his career was growing so was his family, and John wanted to bring his knowledge of fine dining and the vibrant energy of all-day dining of the city back to his hometown in Hertfordshire. Being based in Hitchin, Brocket Hall was the perfect venue for John to show off his culinary flare and expertise in both a fine dining and banqueting and so his Brocket Hall journey began.
The re opening of the Auberge du Lac has been driven by John’s passion to showcase his culinary excellence within the stunning listed building that still embellishes the original features from its origins as the estates hunting lodge. October truly is the time for comforting food, the game season is in full swing and Artichoke has access to some of the country’s finest. Partridge pheasant wild duck and venison are at their very best whilst root vegetables brassicas pumpkins and squashes prepare to take centre stage. With so many different varieties to choose from each offering their
unique tastes and culinary uses. At the restaurant we transform the spectacular iron bark pumpkin into this velvety soup. With the addition of the shredded confit pheasant legs will really take this dish to the next level, accompanied with a sprinkling of toasted pumpkins seeds and a splash of pumpkin oil over each bowl to give a true reflection of the glorious British Autumn.
Autumn Tasting Menu Offer
RECIPE: ROASTED PUMPKIN SOUP, CONFIT OF PHEASANT
Ingredients
Serves 4
Soup
• 1 medium pumpkin
• 1 clove of garlic chopped
• A few sprigs of thyme
• Salt and pepper
• 1.5 litres chicken or vegetable stock – warmed
• 70 ml double cream
• 200 ml orange juice
• 25 g butter
• 2 table spoon toasted pumpkins seeds
• Splash of pumpkin oil
Pheasant Confit
• 4 pheasant Legs
• 100g duck fat or vegetable oil
• 2 bay leaves
• 10 juniper berries
• 1 tsp garam masala
• 4 garlic cloves, crushed
• 20 black peppercorns
• 1 cinnamon stick
Method
Confit of Pheasant Leg
1. Preheat oven to 180 degrees C
2. Wash and dry the pheasant legs to remove any blood. Place the legs in a deep oven roasting dish. Add the bay leaves, juniper berries, whole crushed garlic cloves, peppercorns, cinnamon stick and garam masala.
3. Cover the legs with either vegetable oil or duck/goose fat. Slowly bring the oil to a very slow simmer, cover with greaseproof paper and put in a slow oven for 3 to 4 hours.
4. To test if the legs are ready, the bone should pull out with just a gentle twist. Leave to cool in the fat.
5. Once cool, remove from the fat and remove the bones. Put the pheasant legs in the oven and cook until the skin crisps. Remove, season and cool a little and then shred the pheasant meat off the bone.

Soup
1. Split the pumpkin in half – scrap out the loose fibre and seeds from the middle
2. Cut into large chunks leaving the skin on. Rub with oil, salt and pepper, garlic and thyme place on a tray
3. Roast in a hot oven 200 degrees C for 40 -45 minutes depending on size. Test with a small knife to see if the pumpkin is nicely roasted and soft.
4. Scoop out the hot flesh from the skin into a food processor and then whizz with the warm stock and the orange juice until smooth. Add the cream and the butter to finish.
5. Pass through a sieve into a saucepan and then warm gently – season to taste
6. Your delicious soup is then ready to serve – pour into warmed bowls and serve with the shredded pheasant leg, a sprinkle of toasted pumpkin seeds and a splash of pumpkin oil.

PRIVATELY EDUCATED PEOPLE DOMINATE TOP BRITISH JOBS
The study, by the Sutton Trust education charity, shows that virtually every key profession is dominated by privately educated pupils grabbing the senior management/director positions
Their grip on power is most noticeable in the judiciary, where 74 per cent of leading judges (those in the High Court or Court of Appeal) were privately educated.
Figures in the report also show that one in three MPs (32 per cent) was privately educated –as were half the members of the Conservative Cabinet. Even in Jeremy Corbyn’s Shadow Cabinet, 13 per cent of members went to private school. Nationally, the figure is just 7 per cent.
The report, carried out by Dr Philip Kirby, goes on to show that 71 per cent of senior Army officers – two-star generals and above – went to private schools. Only 12 per cent attended comprehensives.

In medicine, 61 per cent of doctors were privately educated while 22 per cent went to selective state grammar schools and just 16 per cent to comprehensives. The list goes on – 48 per cent of civil servants were educated privately, 29 per cent went to selective grammar schools and 23 per cent to comprehensives.
The higher echelons of journalism are also dominated by the private sector, with 51 per cent educated in independent schools. And of those chief executives of FTSE 100 companies who were educated in the UK, 34 per cent were privately educated.
Nearly half the top actors – 42 per cent of Bafta Award winners – went to private schools, fuelling criticism that the profession is becoming more elitist.
“Our research shows that your chances of reaching the top in so many areas of British life are so much better if you went to an independent school,” said Sir Peter Lampl, the chairman of the Sutton Trust. “As well as academic achievement, an independent education tends to develop the essential skills such as confidence, articulacy and teamwork, which are vital to career success.

Alienating behaviour: How to protect your relationship with your child
Alienating behaviour (or parental alienation) is a serious issue that can arise during or after the breakdown of a relationship or marriage. It occurs when one parent, intentionally or unintentionally, manipulates a child to reject or distance themselves from the other parent. This behaviour can be emotionally harmful to the child and is increasingly recognised by UK courts as a form of emotional abuse.
At Blaser Mills, we recognise how this can disrupt family relationships. Lucinda Holliday, Partner and Head of Family & Divorce, highlights the challenges of parental alienation and how it can be effectively handled to protect the child’s best interests.
What is parental alienation?
Alienation involves behaviours by one parent that undermines the relationship between the child and the other parent. These behaviours can range from subtle comments and criticisms to outright efforts to limit contact. Examples include:
• Badmouthing the other parent in front of the child.
• Restricting or preventing communication and visitation.
• Creating false or exaggerated narratives about the other parent’s behaviour.
• Encouraging the child to take sides, often by instilling feelings of guilt.
The behaviour can be conscious or unconscious however, the end result is that the child may begin to view the alienated parent negatively, refuse to spend time with them, or even express unjustified anger or hostility.
The legal perspective on alienating behaviour UK courts take the well-being of children very seriously, and alienation is increasingly being recognised as a form of coercive and controlling behaviour that causes psychological harm to the child. The Children Act 1989 guides family courts in prioritising the welfare of the child above all else when making decisions about the arrangements for the children. In cases where parental alienation is proven, it can have significant implications for child arrangements.
If a parent believes they are a victim, they can bring the matter before the Family Court. The court may order interventions such as contact orders or specific issue orders, which legally mandate contact between the child and the alienated parent. In severe cases, where alienation is causing significant emotional harm, the court may even consider changing the child’s residence to the alienated parent.
How can I prove this?
It is crucial to gather clear evidence if you suspect parental alienation is taking place. Evidence can include communications, witness statements, and expert reports from child psychologists or social workers. The court will consider all evidence to determine whether the child’s relationship with one parent is being undermined whether consciously or unconsciously by the other parent.
Protecting your child
To protect a child in cases of alienating behaviour, the court may issue orders to ensure regular contact with both parents, involving child arrangement or specific issue orders. Early intervention, mediation, and professional assessments can help restore a balanced relationship as can the use of Child Inclusive Mediation where the child or children can speak to a mediator about the situation.

The benefit to patients when surgeons use Mako robotic-assisted joint replacement surgery compared to traditional surgery may include significantly reduced pain after surgery and faster recovery times.
The Mako technology provides each patient with their own personalised surgical plan, bespoke to their specific body shape and surgical requirements. CT scans are used to create a 3D model of the hip or knee for pre-surgical planning. In the operating theatre, the surgeon follows the personalised surgical plan while preparing the bone for the joint implant. The Mako robotic arm guides the surgeon, so they remain within pre-defined surgical areas to avoid

by Extreme Design The Reservoir Kitchen
AGrand Design like no other, the Reservoir Kitchen by Extreme Design is part of an ambitious project by owners Rosa and Craig to transform an inherited railway reservoir into a unique home. The couple’s vision was to reimagine the building as a family home whilst retaining the connection to its industrial history. Rosa and Craig’s journey was documented by Grand Designs, where Kevin McCloud followed their project throughout the renovation. Their story was broadcast in series 24.
Situated in the Wye Valley, the sunken home nestles discreetly into the land to minimise its impact on the landscape. Designed by Loyn + Co Architects, the building features external architecture and an interior scheme sympathetic to the building’s original use as a reservoir and the rural countryside setting.
For a building with such historical and personal significance, Rosa and Craig approached Extreme Design in Gerrards Cross to create a kitchen that would do it justice. Rebecca Sharrocks, Studio Manager of Extreme Gerrards Cross, was the lead

designer on the project, “This land and the reservoir itself had sentimental value to our clients, so the kitchen needed to respect this connection. To do this, we fused industrial style with natural materials to complement the architecture. We chose rich black timber cabinets to create the dramatic impact they sought and to tie in with the exposed black steel beams. The design introduces warm tones with the quartzite surfaces in homage to the original reservoir building’s heavily weathered, rusting exterior and incredible sunsets views.”
On first impressions, the kitchen creates a strong visual impact. The symmetrical layout aligns perfectly with the floating walkway above, creating harmony between architecture and kitchen design. However, the kitchen manages to be bold without being overwhelming and contemporary without losing its sense of history. Delving deeper into the design, we discover that each material and feature has a story with emotional significance to the owners. Everything was designed intentionally, giving the kitchen a purpose that will transcend any trend.

Oakley Wood Timber are a family run business that specialise in flooring & doors. Within their large showroom in Oakley, Buckinghamshire. They have over 500 different types of flooring on display in solid and engineered wood as well as luxury vinyl and laminate. They also have a great selection of Internal doors and hardwood worktops on display plus they offer local fitting and home or site delivery if required.
Owner Darren Wren began his career in flooring back in 1996 working for a local sawmill in Brill as a yard hand before progressing into the showroom in 2001. It was in late 2003 that he decided to setup his own company and in early 2004 along with his then business partner the company Everything Wood Timber was created.
Darren then spent 12 years developing the business before selling his half of the company in 2016 to a former employee.
On July the 1st 2016 Oakley Wood Timber opened its doors for the first time and since then the company has grown from strength to strength.
Darren has seen the flooring industry change a lot over the last 28 years and although LVT and Laminate have become very popular, engineered wood flooring is still at the heart of what they do.
Oakley Wood Timber have over 400 engineered wood floors on display in many grades, colours, textures, finishes and board sizes. Although the online market has become huge Darren is a strong believer that to truly understand what you are
buying you must see a larger display area. When viewing small hand samples many floors can look the same however there will be lots of differences. If something is cheap it’s for a reason.
Darren has worked with some great designers and architects in his time and is well placed to offer some experienced advice if required. If you just want to browse the showroom, then that’s fine too as there’s no hard sell with us.
There’s no need to make an appointment and the showroom is open from Monday to Friday 8am to 5pm and Saturday’s 10am to 1pm. Please check the website for any upcoming closures before making your visit.
